为了规范报废机动车回收活动，保护环境，促进循环经济发展，保障道路交通安全，制定本办法。
This regulation is formulated to regulate the recycling activities of end-of-life vehicles, protect the environment, promote the development of circular economy, and ensure road traffic safety.
本办法所称报废机动车，是指根据《中华人民共和国道路交通安全法》的规定应当报废的机动车。
For the purposes of this regulation, 'end-of-life vehicles' refer to motor vehicles that should be scrapped according to the provisions of the Road Traffic Safety Law of the People's Republic of China.
不属于《中华人民共和国道路交通安全法》规定的应当报废的机动车，机动车所有人自愿作报废处理的，依照本办法的规定执行。
For motor vehicles that are not required to be scrapped under the Road Traffic Safety Law of the People's Republic of China, if the owner voluntarily chooses to scrap them, the provisions of this regulation shall apply.
国家鼓励特定领域的老旧机动车提前报废更新，具体办法由国务院有关部门另行制定。
The State encourages early scrapping and replacement of old motor vehicles in specific sectors. Specific measures shall be formulated separately by the relevant departments of the State Council.
国务院负责报废机动车回收管理的部门主管全国报废机动车回收(含拆解，下同)监督管理工作，国务院公安、生态环境、工业和信息化、交通运输、市场监督管理等部门在各自的职责范围内负责报废机动车回收有关的监督管理工作。
The department of the State Council responsible for the management of end-of-life vehicle recycling shall be in charge of the supervision and management of end-of-life vehicle recycling (including dismantling, the same below) nationwide. The public security, ecological environment, industry and information technology, transportation, and market supervision and management departments of the State Council shall be responsible for the supervision and management related to end-of-life vehicle recycling within their respective duties.
县级以上地方人民政府负责报废机动车回收管理的部门对本行政区域内报废机动车回收活动实施监督管理。县级以上地方人民政府公安、生态环境、工业和信息化、交通运输、市场监督管理等部门在各自的职责范围内对本行政区域内报废机动车回收活动实施有关的监督管理。
The department responsible for the management of end-of-life vehicle recycling of the local people's government at or above the county level shall implement supervision and management of end-of-life vehicle recycling activities within its administrative region. The public security, ecological environment, industry and information technology, transportation, and market supervision and management departments of the local people's government at or above the county level shall implement relevant supervision and management of end-of-life vehicle recycling activities within their respective duties.
国家对报废机动车回收企业实行资质认定制度。未经资质认定，任何单位或者个人不得从事报废机动车回收活动。
The State implements a qualification accreditation system for end-of-life vehicle recycling enterprises. Without qualification accreditation, no unit or individual may engage in end-of-life vehicle recycling activities.
国家鼓励机动车生产企业从事报废机动车回收活动。机动车生产企业按照国家有关规定承担生产者责任。
The State encourages motor vehicle manufacturers to engage in end-of-life vehicle recycling activities. Motor vehicle manufacturers shall assume producer responsibility in accordance with relevant state regulations.
取得报废机动车回收资质认定，应当具备下列条件：
To obtain qualification accreditation for end-of-life vehicle recycling, the following conditions shall be met:
(一)具有企业法人资格；
(1) Having the status of a legal person enterprise;
(二)具有符合环境保护等有关法律、法规和强制性标准要求的存储、拆解场地，拆解设备、设施以及拆解操作规范；
(2) Having storage and dismantling sites, dismantling equipment and facilities, and dismantling operation specifications that meet the requirements of environmental protection and other relevant laws, regulations, and mandatory standards;
(三)具有与报废机动车拆解活动相适应的专业技术人员。
(3) Having professional and technical personnel suitable for end-of-life vehicle dismantling activities.
拟从事报废机动车回收活动的，应当向省、自治区、直辖市人民政府负责报废机动车回收管理的部门提出申请。省、自治区、直辖市人民政府负责报废机动车回收管理的部门应当依法进行审查，对符合条件的，颁发资质认定书；对不符合条件的，不予资质认定并书面说明理由。
Entities intending to engage in end-of-life vehicle recycling activities shall apply to the department responsible for the management of end-of-life vehicle recycling of the people's government of the province, autonomous region, or municipality directly under the Central Government. The said department shall conduct a review in accordance with the law, and if the conditions are met, issue a qualification certificate; if not, it shall deny the qualification and provide a written explanation.
省、自治区、直辖市人民政府负责报废机动车回收管理的部门应当充分利用计算机网络等先进技术手段，推行网上申请、网上受理等方式，为申请人提供便利条件。申请人可以在网上提出申请。
The department responsible for the management of end-of-life vehicle recycling of the people's government of the province, autonomous region, or municipality directly under the Central Government shall make full use of advanced technical means such as computer networks to promote online applications, online acceptance, and other methods to provide convenience for applicants. Applicants may submit applications online.
省、自治区、直辖市人民政府负责报废机动车回收管理的部门应当将本行政区域内取得资质认定的报废机动车回收企业名单及时向社会公布。
The department responsible for the management of end-of-life vehicle recycling of the people's government of the province, autonomous region, or municipality directly under the Central Government shall promptly publish the list of end-of-life vehicle recycling enterprises that have obtained qualification accreditation within its administrative region to the public.
任何单位或者个人不得要求机动车所有人将报废机动车交售给指定的报废机动车回收企业。
No unit or individual may require the owner of an end-of-life vehicle to sell the vehicle to a designated end-of-life vehicle recycling enterprise.
报废机动车回收企业对回收的报废机动车，应当向机动车所有人出具《报废机动车回收证明》，收回机动车登记证书、号牌、行驶证，并按照国家有关规定及时向公安机关交通管理部门办理注销登记，将注销证明转交机动车所有人。
For the end-of-life vehicles it recycles, the end-of-life vehicle recycling enterprise shall issue a 'Certificate of End-of-Life Vehicle Recycling' to the vehicle owner, retrieve the motor vehicle registration certificate, license plate, and driving license, and promptly handle the cancellation of registration with the traffic management department of the public security organ in accordance with relevant state regulations, and transfer the cancellation certificate to the vehicle owner.
《报废机动车回收证明》样式由国务院负责报废机动车回收管理的部门规定。任何单位或者个人不得买卖或者伪造、变造《报废机动车回收证明》。
The format of the 'Certificate of End-of-Life Vehicle Recycling' shall be prescribed by the department of the State Council responsible for the management of end-of-life vehicle recycling. No unit or individual may buy, sell, forge, or alter the 'Certificate of End-of-Life Vehicle Recycling'.
报废机动车回收企业对回收的报废机动车，应当逐车登记机动车的型号、号牌号码、发动机号码、车辆识别代号等信息；发现回收的报废机动车疑似赃物或者用于盗窃、抢劫等犯罪活动的犯罪工具的，应当及时向公安机关报告。
For the end-of-life vehicles it recycles, the end-of-life vehicle recycling enterprise shall register the model, license plate number, engine number, vehicle identification number, and other information for each vehicle; if it discovers that the recycled end-of-life vehicle is suspected of being stolen goods or a tool used for criminal activities such as theft or robbery, it shall promptly report to the public security organ.
报废机动车回收企业不得拆解、改装、拼装、倒卖疑似赃物或者犯罪工具的机动车或者其发动机、方向机、变速器、前后桥、车架(以下统称“五大总成”)和其他零部件。
End-of-life vehicle recycling enterprises shall not dismantle, modify, reassemble, or resell vehicles suspected of being stolen goods or criminal tools, or their engines, steering gears, transmissions, front and rear axles, frames (hereinafter collectively referred to as the 'five major assemblies'), and other parts.
回收的报废机动车必须按照有关规定予以拆解；其中，回收的报废大型客车、货车等营运车辆和校车，应当在公安机关的监督下解体。
Recycled end-of-life vehicles must be dismantled in accordance with relevant regulations; among them, recycled end-of-life large passenger cars, trucks and other commercial vehicles, and school buses shall be dismantled under the supervision of the public security organ.
拆解的报废机动车“五大总成”具备再制造条件的，可以按照国家有关规定出售给具有再制造能力的企业经过再制造予以循环利用；不具备再制造条件的，应当作为废金属，交售给钢铁企业作为冶炼原料。
If the dismantled 'five major assemblies' of end-of-life vehicles meet the conditions for remanufacturing, they may be sold to enterprises with remanufacturing capabilities for remanufacturing and recycling in accordance with relevant state regulations; if they do not meet the conditions for remanufacturing, they shall be sold as scrap metal to steel enterprises as smelting raw materials.
拆解的报废机动车“五大总成”以外的零部件符合保障人身和财产安全等强制性国家标准，能够继续使用的，可以出售，但应当标明“报废机动车回用件”。
Parts other than the 'five major assemblies' of dismantled end-of-life vehicles that meet mandatory national standards for personal and property safety and can continue to be used may be sold, but shall be marked as 'end-of-life vehicle reusable parts'.
国务院负责报废机动车回收管理的部门应当建立报废机动车回收信息系统。报废机动车回收企业应当如实记录本企业回收的报废机动车“五大总成”等主要部件的数量、型号、流向等信息，并上传至报废机动车回收信息系统。
The department of the State Council responsible for the management of end-of-life vehicle recycling shall establish an end-of-life vehicle recycling information system. End-of-life vehicle recycling enterprises shall truthfully record the quantity, model, flow direction, and other information of the 'five major assemblies' and other main parts of the end-of-life vehicles they recycle, and upload it to the end-of-life vehicle recycling information system.
负责报废机动车回收管理的部门、公安机关应当通过政务信息系统实现信息共享。
Department responsible for the management of end-of-life vehicle recycling、Public security organs shall achieve information sharing through government information systems。
拆解报废机动车，应当遵守环境保护法律、法规和强制性标准，采取有效措施保护环境，不得造成环境污染。
Dismantling end-of-life vehicles，Shall comply with environmental protection laws、Regulations and mandatory standards，Take effective measures to protect the environment，Shall not cause environmental pollution。
禁止任何单位或者个人利用报废机动车“五大总成”和其他零部件拼装机动车，禁止拼装的机动车交易。
It is prohibited for any unit or individual to use end-of-life vehicles“Five major assemblies”And other parts to assemble motor vehicles，Trading of assembled motor vehicles is prohibited。
除机动车所有人将报废机动车依法交售给报废机动车回收企业外，禁止报废机动车整车交易。
Except where the vehicle owner legally sells the end-of-life vehicle to an end-of-life vehicle recycling enterprise，Trading of complete end-of-life vehicles is prohibited。
县级以上地方人民政府负责报废机动车回收管理的部门应当加强对报废机动车回收企业的监督检查，建立和完善以随机抽查为重点的日常监督检查制度，公布抽查事项目录，明确抽查的依据、频次、方式、内容和程序，随机抽取被检查企业，随机选派检查人员。抽查情况和查处结果应当及时向社会公布。
The department responsible for the management of end-of-life vehicle recycling under the local people's government at or above the county level shall strengthen supervision and inspection of end-of-life vehicle recycling enterprises，Establish and improve a routine supervision and inspection system focusing on random inspections，Publish the catalog of inspection items，Clarify the basis for inspections、Frequency、Methods、Content and procedures，Randomly select enterprises to be inspected，Randomly select inspection personnel。Inspection results and handling outcomes shall be promptly disclosed to the public。
在监督检查中发现报废机动车回收企业不具备本办法规定的资质认定条件的，应当责令限期改正；拒不改正或者逾期未改正的，由原发证部门吊销资质认定书。
If during supervision and inspection it is found that an end-of-life vehicle recycling enterprise does not meet the qualification conditions stipulated in these Measures，It shall be ordered to rectify within a specified period；If it refuses to rectify or fails to rectify within the specified period，The original issuing authority shall revoke the qualification certificate。
县级以上地方人民政府负责报废机动车回收管理的部门应当向社会公布本部门的联系方式，方便公众举报违法行为。
The department responsible for the management of end-of-life vehicle recycling under the local people's government at or above the county level shall publicly disclose its contact information，To facilitate public reporting of illegal activities。
县级以上地方人民政府负责报废机动车回收管理的部门接到举报的，应当及时依法调查处理，并为举报人保密；对实名举报的，负责报废机动车回收管理的部门应当将处理结果告知举报人。
The department responsible for the management of end-of-life vehicle recycling under the local people's government at or above the county level shall, upon receiving a report, promptly investigate and handle it in accordance with the law, and keep the reporter confidential; for a real-name report, the department responsible for the management of end-of-life vehicle recycling shall inform the reporter of the handling result.
负责报废机动车回收管理的部门在监督管理工作中发现不属于本部门处理权限的违法行为的，应当及时移交有权处理的部门；有权处理的部门应当及时依法调查处理，并将处理结果告知负责报废机动车回收管理的部门。
If, during supervision and management, the department responsible for the management of end-of-life vehicle recycling discovers an illegal act that is not within its handling authority, it shall promptly transfer the case to the department with authority; the department with authority shall promptly investigate and handle it in accordance with the law, and inform the department responsible for the management of end-of-life vehicle recycling of the handling result.
未取得资质认定，擅自从事报废机动车回收活动的，由负责报废机动车回收管理的部门没收非法回收的报废机动车、报废机动车“五大总成”和其他零部件，没收违法所得；违法所得在5万元以上的，并处违法所得2倍以上5倍以下的罚款；违法所得不足5万元或者没有违法所得的，并处5万元以上10万元以下的罚款。对负责报废机动车回收管理的部门没收非法回收的报废机动车、报废机动车“五大总成”和其他零部件，必要时有关主管部门应当予以配合。
Anyone who engages in end-of-life vehicle recycling activities without obtaining qualification accreditation shall be subject to confiscation by the department responsible for the management of end-of-life vehicle recycling of the illegally recycled end-of-life vehicles, the 'five major assemblies' and other parts of end-of-life vehicles, and illegal gains; if the illegal gains are 50,000 yuan or more, a fine of not less than 2 times but not more than 5 times the illegal gains shall also be imposed; if the illegal gains are less than 50,000 yuan or there are no illegal gains, a fine of not less than 50,000 yuan but not more than 100,000 yuan shall also be imposed. For the confiscation by the department responsible for the management of end-of-life vehicle recycling of the illegally recycled end-of-life vehicles, the 'five major assemblies' and other parts of end-of-life vehicles, the relevant competent departments shall provide cooperation when necessary.
有下列情形之一的，由公安机关依法给予治安管理处罚：
In any of the following circumstances, the public security organ shall impose a public security penalty in accordance with the law:
(一)买卖或者伪造、变造《报废机动车回收证明》；
(1) Buying, selling, or forging or altering the 'End-of-Life Vehicle Recycling Certificate';
(二)报废机动车回收企业明知或者应当知道回收的机动车为赃物或者用于盗窃、抢劫等犯罪活动的犯罪工具，未向公安机关报告，擅自拆解、改装、拼装、倒卖该机动车。
(2) An end-of-life vehicle recycling enterprise, knowing or having reason to know that the recycled vehicle is stolen property or a criminal tool used for theft, robbery, or other criminal activities, fails to report to the public security organ and arbitrarily dismantles, modifies, assembles, or resells the vehicle.
报废机动车回收企业有前款规定情形，情节严重的，由原发证部门吊销资质认定书。
If a recycling enterprise for end-of-life motor vehicles has the circumstances specified in the preceding paragraph and the circumstances are serious, the original issuing department shall revoke the qualification certificate.
报废机动车回收企业有下列情形之一的，由负责报废机动车回收管理的部门责令改正，没收报废机动车“五大总成”和其他零部件，没收违法所得；违法所得在5万元以上的，并处违法所得2倍以上5倍以下的罚款；违法所得不足5万元或者没有违法所得的，并处5万元以上10万元以下的罚款；情节严重的，责令停业整顿直至由原发证部门吊销资质认定书：
If a recycling enterprise for end-of-life motor vehicles has any of the following circumstances, the department responsible for the management of end-of-life motor vehicle recycling shall order correction, confiscate the 'five major assemblies' and other parts of the end-of-life motor vehicles, and confiscate illegal gains; if the illegal gains are more than 50,000 yuan, a fine of not less than 2 times but not more than 5 times the illegal gains shall be imposed; if the illegal gains are less than 50,000 yuan or there are no illegal gains, a fine of not less than 50,000 yuan but not more than 100,000 yuan shall be imposed; if the circumstances are serious, the enterprise shall be ordered to suspend business for rectification until the original issuing department revokes the qualification certificate:
(一)出售不具备再制造条件的报废机动车“五大总成”；
(1) Selling the 'five major assemblies' of end-of-life motor vehicles that do not meet the conditions for remanufacturing;
(二)出售不能继续使用的报废机动车“五大总成”以外的零部件；
(2) Selling parts other than the 'five major assemblies' of end-of-life motor vehicles that cannot be reused;
(三)出售的报废机动车“五大总成”以外的零部件未标明“报废机动车回用件”。
(3) Selling parts other than the 'five major assemblies' of end-of-life motor vehicles without marking them as 'reusable parts from end-of-life motor vehicles'.
报废机动车回收企业对回收的报废机动车，未按照国家有关规定及时向公安机关交通管理部门办理注销登记并将注销证明转交机动车所有人的，由负责报废机动车回收管理的部门责令改正，可以处1万元以上5万元以下的罚款。
If a recycling enterprise for end-of-life motor vehicles fails to timely handle the deregistration with the traffic management department of the public security organ and transfer the deregistration certificate to the motor vehicle owner in accordance with relevant national regulations for the recycled end-of-life motor vehicles, the department responsible for the management of end-of-life motor vehicle recycling shall order correction and may impose a fine of not less than 10,000 yuan but not more than 50,000 yuan.
利用报废机动车“五大总成”和其他零部件拼装机动车或者出售报废机动车整车、拼装的机动车的，依照《中华人民共和国道路交通安全法》的规定予以处罚。
If the 'five major assemblies' and other parts of end-of-life motor vehicles are used to assemble motor vehicles, or if complete end-of-life motor vehicles or assembled motor vehicles are sold, punishment shall be imposed in accordance with the provisions of the Road Traffic Safety Law of the People's Republic of China.
报废机动车回收企业未如实记录本企业回收的报废机动车“五大总成”等主要部件的数量、型号、流向等信息并上传至报废机动车回收信息系统的，由负责报废机动车回收管理的部门责令改正，并处1万元以上5万元以下的罚款；情节严重的，责令停业整顿。
If a recycling enterprise for end-of-life motor vehicles fails to truthfully record the quantity, model, flow direction and other information of the 'five major assemblies' and other main parts of the end-of-life motor vehicles it recycles and upload them to the end-of-life motor vehicle recycling information system, the department responsible for the management of end-of-life motor vehicle recycling shall order correction and impose a fine of not less than 10,000 yuan but not more than 50,000 yuan; if the circumstances are serious, the enterprise shall be ordered to suspend business for rectification.
报废机动车回收企业违反环境保护法律、法规和强制性标准，污染环境的，由生态环境主管部门责令限期改正，并依法予以处罚；拒不改正或者逾期未改正的，由原发证部门吊销资质认定书。
If a recycling enterprise for end-of-life motor vehicles violates environmental protection laws, regulations and mandatory standards and pollutes the environment, the competent department of ecological environment shall order correction within a time limit and impose punishment according to law; if the enterprise refuses to correct or fails to correct within the time limit, the original issuing department shall revoke the qualification certificate.
负责报废机动车回收管理的部门和其他有关部门的工作人员在监督管理工作中滥用职权、玩忽职守、徇私舞弊的，依法给予处分。
If staff members of the department responsible for the management of end-of-life motor vehicle recycling and other relevant departments abuse their power, neglect their duties, or engage in malpractice for personal gain in the supervision and management work, they shall be given sanctions according to law.
违反本办法规定，构成犯罪的，依法追究刑事责任。
If a violation of the provisions of these Measures constitutes a crime, criminal liability shall be pursued according to law.
报废新能源机动车回收的特殊事项，另行制定管理规定。
Special matters concerning the recycling of end-of-life new energy motor vehicles shall be separately formulated by management regulations.
军队报废机动车的回收管理，依照国家和军队有关规定执行。
The recycling management of military end-of-life motor vehicles shall be implemented in accordance with the relevant provisions of the state and the military.
本办法自2019年6月1日起施行。2001年6月16日国务院公布的《报废汽车回收管理办法》同时废止。
These Measures shall come into force on June 1, 2019. The Measures for the Administration of Recycling of End-of-Life Vehicles promulgated by the State Council on June 16, 2001 shall be repealed simultaneously.
