These Measures are formulated to strengthen the administration of foreign participation in the salvage of sunken ships and sunken objects in China's coastal waters and to protect the legitimate rights and interests of the parties concerned.

These Measures apply to activities in which foreign parties participate in the salvage of sunken ships and sunken objects of commercial value in China's coastal waters.

本办法下列用语的定义:

For the purposes of these Measures, the following terms are defined as:

(1) "Foreign party" means a foreign enterprise, other economic organization, or individual.

(2) "Coastal waters" means the internal waters, territorial sea, and other sea areas under the jurisdiction of the People's Republic of China.

(三)沉船沉物,是指沉没于中国沿海水域水面以下或者淤埋海底泥面以下的各类船舶和器物,包括沉船沉物的主体及其设备、所载的全部货物或者其他物品。

(3) "Sunken ships and sunken objects" means various types of ships and articles that have sunk below the water surface or are buried under the seabed mud surface in China's coastal waters, including the hulls of sunken ships and sunken objects and their equipment, all cargo carried, or other items.

Sunken warships and weapons and equipment of important military value, as well as sunken ships and sunken objects confirmed as cultural relics, are not subject to foreign participation in salvage.

(4) "Salvage operations" means various construction activities carried out on sunken ships and sunken objects under a joint salvage contract or a salvage enterprise contract, including survey and detection, implementation of salvage, and related activities.

中国政府依法保护参与打捞中国沿海水域沉船沉物的中外双方(以下简称参与打捞的中外双方)的应得收益和其他合法权益。

The Chinese government protects, in accordance with the law, the due income and other legitimate rights and interests of both Chinese and foreign parties participating in the salvage of sunken ships and sunken objects in China's coastal waters (hereinafter referred to as the Chinese and foreign parties participating in the salvage).

All activities of the Chinese and foreign parties participating in the salvage must comply with the relevant laws, regulations, and rules of the People's Republic of China and accept the management and supervision of the competent authorities of the Chinese government.

外商参与打捞中国沿海水域沉船沉物,可以采取下列方式:

Foreign participation in the salvage of sunken ships and sunken objects in China's coastal waters may take the following forms:

(一)与中方打捞人签订共同打捞合同,依照合同规定的双方权利和义务,实施打捞活动;

(1) Entering into a joint salvage contract with a Chinese salvor, and carrying out salvage activities in accordance with the rights and obligations of both parties stipulated in the contract;

共同打捞合同和打捞企业合同必须有明确的打捞标的。参与打捞的中外双方在打捞过程中发现的不属于合同标的的其他沉船沉物,不得擅自实施打捞。

TranslationArticle 7

A joint salvage contract or a salvage enterprise contract must have a clear salvage target. The Chinese and foreign parties participating in the salvage shall not arbitrarily salvage other sunken ships or sunken objects discovered during the salvage process that are not the subject of the contract.

国务院交通运输主管部门负责统一组织与外商洽谈打捞中国沿海水域沉船沉物的事宜,确立打捞项目,并组织中方打捞人与外商依法签订共同打捞合同或者打捞企业合同;涉及军事禁区、军事管理区的,应当符合《中华人民共和国军事设施保护法》的有关规定。

The competent transport department of the State Council is responsible for uniformly organizing negotiations with foreign parties on matters concerning the salvage of sunken ships and sunken objects in China's coastal waters, establishing salvage projects, and organizing Chinese salvors to sign joint salvage contracts or salvage enterprise contracts with foreign parties in accordance with the law; where military restricted zones or military management zones are involved, the relevant provisions of the Law of the People's Republic of China on the Protection of Military Facilities shall be complied with.

外商与中方打捞人签订共同打捞合同,应当符合《中华人民共和国合同法》的有关规定。共同打捞合同签订后,外商应当按照规定向市场监督管理部门申请营业登记,并向当地税务机关办理税务登记手续。

TranslationArticle 9

A joint salvage contract signed between a foreign party and a Chinese salvor shall comply with the relevant provisions of the Contract Law of the People's Republic of China. After the joint salvage contract is signed, the foreign party shall apply to the market supervision and administration department for business registration and go through tax registration procedures with the local tax authority.

外商参与在中华人民共和国内海或者领海内打捞沉船沉物,应当承担打捞作业期间的全部费用和经济风险。中方打捞人负责与有关部门的协调,办理必要的手续及打捞作业期间的监护。

A foreign party participating in the salvage of sunken ships or sunken objects in the internal waters or territorial sea of the People's Republic of China shall bear all costs and economic risks during the salvage operations. The Chinese salvor shall be responsible for coordination with relevant departments, handling necessary procedures, and providing supervision during the salvage operations.

外商参与在中华人民共和国内海、领海外属中华人民共和国管辖的其他海域内打捞沉船沉物,应当承担扫测探摸阶段的全部费用和经济风险。需要打捞的,由中外双方按照合同规定实施打捞。

Translation

A foreign party participating in the salvage of sunken ships or sunken objects in sea areas under the jurisdiction of the People's Republic of China other than the internal waters and territorial sea shall bear all costs and economic risks during the survey and detection phase. If salvage is required, the Chinese and foreign parties shall carry out the salvage in accordance with the contract.

外商为履行共同打捞合同所需船舶、设备及劳务,在同等条件下应当优先向中方打捞人租用和雇佣。

TranslationArticle 11

For vessels, equipment, and services required by a foreign party to perform a joint salvage contract, the foreign party shall, under equal conditions, give priority to leasing and hiring from Chinese salvors.

外商参与打捞中国沿海水域沉船沉物的捞获物(以下简称捞获物)应当按照下列方式处理:

Salvaged objects obtained from foreign participation in the salvage of sunken ships and sunken objects in China's coastal waters (hereinafter referred to as salvaged objects) shall be handled in the following manner:

(一)在中华人民共和国内海或者领海内捞获的沉船沉物,属中华人民共和国所有,外商根据共同打捞合同或者打捞企业合同的规定,从捞获物或者其折价中取得收益;

(1) Sunken ships and sunken objects salvaged in the internal waters or territorial sea of the People's Republic of China belong to the People's Republic of China, and the foreign party shall obtain income from the salvaged objects or their converted value in accordance with the provisions of the joint salvage contract or the salvage enterprise contract;

中方打捞人根据国家有关规定或者打捞企业合同的规定从捞获物或者其折价中取得收益。

Chinese salvors shall obtain proceeds from the salvaged objects or their converted value in accordance with relevant state provisions or the provisions of the salvage enterprise contract.

(二)在中华人民共和国内海、领海外属中华人民共和国管辖的其他海域内捞获的沉船沉物,由参与打捞的中外双方按照合同规定的比例对捞获物或者其折价进行分成。

(2) For sunken ships and objects salvaged in other sea areas under the jurisdiction of the People's Republic of China outside the internal seas and territorial seas, the Chinese and foreign parties participating in the salvage shall share the salvaged objects or their converted value according to the proportions stipulated in the contract.

(三)捞获物中夹带有文物或者在打捞作业活动中发现文物的,应当立即报告当地文物行政管理部门,由文物行政管理部门按照中华人民共和国有关文物保护的法律、法规处理,并给有关人员适当的奖励。

Translation

(3) If cultural relics are mixed in the salvaged objects or discovered during salvage operations, the matter shall be immediately reported to the local cultural relics administrative department, which shall handle the matter in accordance with the laws and regulations of the People's Republic of China on the protection of cultural relics and give appropriate rewards to the relevant personnel.

外商依法取得的捞获物可以按照国际市场价格由中国政府有关部门收购或者由外商依法纳税并办理海关手续后运往国外。

TranslationArticle 13

Salvaged objects lawfully obtained by foreign businessmen may be purchased by the relevant government departments of China at international market prices, or shipped abroad by foreign businessmen after paying taxes according to law and completing customs formalities.

Foreign exchange income or other proceeds obtained by foreign businessmen may be remitted abroad according to law after tax payment.

打捞作业者在实施打捞作业前,应当按照《中华人民共和国海上交通安全法》的有关规定申请发布航行警告。

Before carrying out salvage operations, the salvager shall apply for the issuance of navigation warnings in accordance with the relevant provisions of the Maritime Traffic Safety Law of the People's Republic of China.

国务院交通运输主管部门应当将打捞作业的起止时间、地理位置等情况通报国家海洋局等有关部门。

The competent transport department of the State Council shall notify the State Oceanic Administration and other relevant departments of the start and end times, geographical locations, and other information of the salvage operations.

打捞作业者实施打捞作业时,必须在港务监督核准的作业区域内进行,并按照港务监督的要求报告有关活动情况。实施打捞作业不得使用危害海洋资源、海洋环境、海底设施、海上军事设施和其他损害中华人民共和国利益的方法。

Translation

When carrying out salvage operations, the salvager must operate within the operation area approved by the harbor superintendency and report relevant activities as required by the harbor superintendency. Salvage operations shall not use methods that harm marine resources, the marine environment, seabed facilities, maritime military facilities, or otherwise damage the interests of the People's Republic of China.

实施打捞作业应当自始至终有参与打捞的中外双方的有关人员参加,双方共同负责捞获物的登记和保管工作。

TranslationArticle 15

Salvage operations shall be carried out with the participation of relevant personnel from both the Chinese and foreign parties throughout the process, and both parties shall jointly be responsible for the registration and custody of the salvaged objects.

所有捞获物应当在中国政府主管部门指定的地点接受有关部门的检查。

All salvaged objects shall be subject to inspection by relevant departments at a location designated by the competent government department of China.

Original Chinese第十七条

违反本办法打捞中国沿海水域沉船沉物的,港务监督有权责令其停止打捞作业,并可给予警告、罚款的处罚,其中已给国家和他人造成损失的,应当承担赔偿责任。

TranslationArticle 17

If a person violates these Provisions in salvaging sunken ships or objects in China's coastal waters, the harbor superintendency has the authority to order the cessation of salvage operations and may impose warnings or fines. If losses have been caused to the state or others, the violator shall bear compensation liability.

罚款数额按照国家有关海上交通管理处罚的规定执行。

The amount of fines shall be implemented in accordance with the relevant state provisions on maritime traffic management penalties.

香港、澳门、台湾的企业、个人及其他经济组织参与打捞中国沿海水域的沉船沉物,参照本办法执行。

Enterprises, individuals, and other economic organizations from Hong Kong, Macao, and Taiwan that participate in the salvage of sunken ships and objects in China's coastal waters shall refer to these Provisions for implementation.

These Provisions shall come into force as of the date of promulgation.
