Measures for the Administration of Chinese Citizens' Travel to and from the Taiwan Region

(Promulgated by Decree No. 93 of the State Council of the People's Republic of China on December 17, 1991, and revised in accordance with the Decision of the State Council on Amending the Measures for the Administration of Chinese Citizens' Travel to and from the Taiwan Region on June 14, 2015)

为保障台湾海峡两岸人员往来，促进各方交流，维护社会秩序，制定本办法。

These Measures are formulated to ensure the travel of people across the Taiwan Strait, promote exchanges between the two sides, and maintain social order.

居住在大陆的中国公民(以下简称大陆居民)往来台湾地区(以下简称台湾)以及居住在台湾地区的中国公民(以下简称台湾居民)来往大陆，适用本办法。

These Measures apply to Chinese citizens residing in the mainland (hereinafter referred to as mainland residents) traveling to the Taiwan region (hereinafter referred to as Taiwan) and Chinese citizens residing in the Taiwan region (hereinafter referred to as Taiwan residents) traveling to the mainland.

本办法未规定的事项，其他有关法律、法规有规定的，适用其他法律、法规。

Matters not covered by these Measures shall be governed by other relevant laws and regulations if so provided.

大陆居民前往台湾，凭公安机关出入境管理部门签发的旅行证件，从开放的或者指定的出入境口岸通行。

Mainland residents traveling to Taiwan shall use travel documents issued by the exit and entry administration departments of the public security organs and pass through open or designated ports.

台湾居民来大陆，凭国家主管机关签发的旅行证件，从开放的或者指定的入出境口岸通行。

Taiwan residents traveling to the mainland shall use travel documents issued by the competent state authorities and pass through open or designated ports.

中国公民往来台湾与大陆之间，不得有危害国家安全、荣誉和利益的行为。

Chinese citizens traveling between Taiwan and the mainland shall not engage in acts that endanger national security, honor, or interests.

大陆居民前往台湾定居、探亲、访友、旅游、接受和处理财产、处理婚丧事宜或者参加经济、科技、文化、教育、体育、学术等活动，须向户口所在地的市、县公安局提出申请。

Mainland residents who wish to travel to Taiwan for purposes such as settlement, visiting relatives, visiting friends, tourism, accepting or disposing of property, handling marriage or funeral matters, or participating in economic, scientific, technological, cultural, educational, sports, or academic activities shall apply to the public security bureau of the city or county where their household registration is located.

大陆居民申请前往台湾，须履行下列手续：

Mainland residents applying to travel to Taiwan shall fulfill the following procedures:

(一)交验身份、户口证明；

(1) Submit identity and household registration documents for verification;

(二)填写前往台湾申请表；

(2) Complete the application form for travel to Taiwan;

(三)在职、在学人员须提交所在单位对申请人前往台湾的意见；非在职、在学人员须提交户口所在地公安派出所对申请人前往台湾的意见；

(3) Employed or enrolled persons shall submit the opinion of their employer or school on the applicant's travel to Taiwan; unemployed or non-enrolled persons shall submit the opinion of the public security police station in their household registration location on the applicant's travel to Taiwan;

(四)提交与申请事由相应的证明。

(4) Submit supporting documents corresponding to the purpose of the application.

本办法第七条第四项所称的证明是指：

The supporting documents referred to in Article 7(4) of these Measures are as follows:

(一)前往定居，须提交确能在台湾定居的证明；

(1) For settlement, submit proof of the ability to settle in Taiwan;

(二)探亲、访友，须提交台湾亲友关系的证明；

(2) For visiting relatives or friends, submit proof of relationship with relatives or friends in Taiwan;

(三)旅游，须提交旅行所需费用的证明；

(3) For tourism, submit proof of sufficient funds for travel expenses;

(四)接受、处理财产，须提交经过公证的对该项财产有合法权利的有关证明；

(4) For accepting or disposing of property, submit notarized proof of legal rights to the property;

(五)处理婚姻事务，须提交经过公证的有关婚姻状况的证明；

(5) For handling marriage matters, submit notarized proof of marital status;

(六)处理亲友丧事，须提交有关的函件或者通知；

(6) For handling funeral matters of relatives or friends, submit relevant correspondence or notification;

(七)参加经济、科技、文化、教育、体育、学术等活动，须提交台湾相应机构、团体、个人邀请或者同意参加该项活动的证明；

(7) For participating in economic, scientific, technological, cultural, educational, sports, or academic activities, submit proof of invitation or consent from the relevant institution, organization, or individual in Taiwan;

(八)主管机关认为需要提交的其他证明。

(8) Other supporting documents deemed necessary by the competent authorities.

公安机关受理大陆居民前往台湾的申请，应当在30日内，地处偏僻、交通不便的应当在60日内，作出批准或者不予批准的决定，通知申请人。紧急的申请，应当随时办理。

The public security organ shall, within 30 days of accepting an application from a mainland resident to travel to Taiwan, or within 60 days in remote areas with inconvenient transportation, decide whether to approve or disapprove the application and notify the applicant. Urgent applications shall be processed promptly.

经批准前往台湾的大陆居民，由公安机关签发或者签注旅行证件。

Mainland residents approved to travel to Taiwan shall be issued or endorsed with travel documents by the public security authorities.

经批准前往台湾的大陆居民，应当在所持旅行证件签注的有效期内前往，除定居的以外，应当按期返回。

Mainland residents approved to travel to Taiwan shall travel within the validity period of the endorsement on their travel documents, and except for those who settle there, shall return on schedule.

大陆居民前往台湾后，因病或者其他特殊情况，旅行证件到期不能按期返回的，可以向原发证的公安机关或者公安部出入境管理局派出的或者委托的有关机构申请办理延期手续；有特殊原因的也可以在入境口岸的公安机关申请办理入境手续。

If a mainland resident, after traveling to Taiwan, cannot return on schedule due to illness or other special circumstances and the travel document expires, they may apply for an extension to the public security authority that issued the original document or to an agency dispatched or authorized by the Exit and Entry Administration of the Ministry of Public Security; for special reasons, they may also apply for entry procedures at the public security authority at the port of entry.

申请前往台湾的大陆居民有下列情形之一的，不予批准：

Applications from mainland residents to travel to Taiwan shall not be approved in any of the following circumstances:

(一)刑事案件的被告人或者犯罪嫌疑人；

(1) The applicant is a defendant or criminal suspect in a criminal case;

(二)人民法院通知有未了结诉讼事宜不能离境的；

(2) The people's court has notified that there are unresolved litigation matters that prevent departure;

(三)被判处刑罚尚未执行完毕的；

(3) The applicant is serving a sentence that has not yet been completed;

(四)正在被劳动教养的；

(4) The applicant is currently undergoing re-education through labor;

(五)国务院有关主管部门认为出境后将对国家安全造成危害或者对国家利益造成重大损失的；

(5) The relevant competent department of the State Council considers that departure would pose a threat to national security or cause significant losses to national interests;

(六)有编造情况、提供假证明等欺骗行为的。

(6) The applicant has engaged in deceptive acts such as fabricating circumstances or providing false certificates.

台湾居民要求来大陆的，向下列有关机关申请办理旅行证件：

Taiwan residents who wish to come to the mainland shall apply for travel documents from the following relevant authorities:

(一)从台湾地区要求直接来大陆的，向公安部出入境管理局派出的或者委托的有关机构申请；有特殊事由的，也可以向指定口岸的公安机关申请；

(1) For those who wish to come directly from the Taiwan region to the mainland, apply to an agency dispatched or authorized by the Exit and Entry Administration of the Ministry of Public Security; for special reasons, they may also apply to the public security authority at a designated port;

(二)到香港、澳门地区后要求来大陆的，向公安部出入境管理局派出的机构或者委托的在香港、澳门地区的有关机构申请；

(2) For those who wish to come to the mainland after arriving in Hong Kong or Macao, apply to an agency dispatched by the Exit and Entry Administration of the Ministry of Public Security or an authorized agency in Hong Kong or Macao;

(三)经由外国来大陆的，依据《中华人民共和国护照法》，向中华人民共和国驻外国的外交代表机关、领事机关或者外交部授权的其他驻外机关申请。

(3) For those who come to the mainland via a foreign country, apply to the diplomatic missions, consular offices, or other overseas offices authorized by the Ministry of Foreign Affairs of the People's Republic of China in accordance with the Passport Law of the People's Republic of China.

台湾居民申请来大陆，须履行下列手续：

Taiwan residents applying to come to the mainland shall fulfill the following procedures:

(一)交验表明在台湾居住的有效身份证明和出境入境证件；

(1) Present valid identity documents showing residence in Taiwan and exit-entry documents;

(二)填写申请表；

(2) Fill in an application form;

(三)提交符合规定的照片。

(3) Submit photographs that meet the requirements.

国家主管机关可以根据具体情况要求台湾居民提交其他申请材料。

The competent state authority may, based on specific circumstances, require Taiwan residents to submit other application materials.

对批准来大陆的台湾居民，由国家主管机关签发旅行证件。

For Taiwan residents approved to come to the mainland, the competent state authority shall issue travel documents.

台湾居民来大陆，应当按照户口管理规定，办理暂住登记。在宾馆、饭店、招待所、旅店、学校等企业、事业单位或者机关、团体和其他机构内住宿的，应当填写临时住宿登记表；住在亲友家的，由本人或者亲友在24小时(农村72小时)内到当地公安派出所或者户籍办公室办理暂住登记手续。

Taiwan residents coming to the mainland shall, in accordance with household registration regulations, register their temporary residence. Those staying in hotels, restaurants, guesthouses, inns, schools, or other enterprises, institutions, or organizations shall fill in a temporary accommodation registration form; those staying with relatives or friends shall, by themselves or through their relatives or friends, complete temporary residence registration procedures at the local police station or household registration office within 24 hours (72 hours in rural areas).

台湾居民要求来大陆定居的，应当在入境前向公安部出入境管理局派出的或者委托的有关机构提出申请，或者经由大陆亲属向拟定居地的市、县公安局提出申请。批准定居的，公安机关发给定居证明。

Taiwan residents who wish to settle in the mainland shall, before entry, submit an application to an agency dispatched or authorized by the Exit and Entry Administration of the Ministry of Public Security, or through a mainland relative, submit an application to the public security bureau of the city or county where they intend to settle. Upon approval of settlement, the public security authority shall issue a settlement certificate.

台湾居民来大陆后，应当在所持旅行证件有效期之内按期离境。所持证件有效期即将届满需要继续居留的，应当向市、县公安局申请换发。

Taiwan residents, after coming to the mainland, shall leave within the validity period of their travel documents. If the validity period of the documents is about to expire and they need to continue their stay, they shall apply to the city or county public security bureau for a renewal.

申请来大陆的台湾居民有下列情形之一的，不予批准：

Applications from Taiwan residents to come to the mainland shall not be approved in any of the following circumstances:

(一)被认为有犯罪行为的；

(1) Those who are deemed to have committed criminal acts;

(二)被认为来大陆后可能进行危害国家安全、利益等活动的；

(2) Those who are deemed likely to engage in activities endangering national security or interests after entering the mainland;

(三)不符合申请条件或者有编造情况、提供假证明等欺骗行为的；

(3) Those who do not meet the application conditions or have engaged in deceptive acts such as fabricating information or providing false certificates;

(四)精神疾病或者严重传染病患者；

(4) Those suffering from mental illness or serious infectious diseases;

(五)法律、行政法规规定不予批准的其他情形。

(5) Other circumstances where approval is not granted as stipulated by laws and administrative regulations.

治病或者其他特殊原因可以批准入境的除外。

Except for those who may be approved to enter for medical treatment or other special reasons.

大陆居民往来台湾，台湾居民来往大陆，须向开放的或者指定的出入境口岸边防检查站出示证件，填交出境、入境登记卡，接受查验。

Mainland residents traveling to Taiwan and Taiwan residents traveling to the mainland shall present their travel documents at the border inspection stations of open or designated ports, fill in exit and entry registration cards, and undergo inspection.

有下列情形之一的，边防检查站有权阻止出境、入境：

Border inspection stations have the authority to prevent exit or entry in any of the following circumstances:

(一)未持有旅行证件的；

(1) Not holding a travel document;

(二)持用伪造、涂改等无效的旅行证件的；

(2) Holding a forged, altered, or otherwise invalid travel document;

(三)拒绝交验旅行证件的；

(3) Refusing to present a travel document for inspection;

(四)本办法第十二条、第十九条规定不予批准出境、入境的。

(4) Circumstances specified in Articles 12 and 19 of these Measures where exit or entry is not approved.

大陆居民往来台湾的旅行证件系指大陆居民往来台湾通行证和其他有效旅行证件。

Travel documents for mainland residents traveling to Taiwan refer to the Mainland Residents Travel Permit to Taiwan and other valid travel documents.

台湾居民来往大陆的旅行证件系指台湾居民来往大陆通行证和其他有效旅行证件。

Travel documents for Taiwan residents traveling to the mainland refer to the Taiwan Residents Travel Permit to the Mainland and other valid travel documents.

大陆居民往来台湾通行证有效期为10年；台湾居民来往大陆通行证分为5年有效和3个月一次有效两种。

The Mainland Residents Travel Permit to Taiwan is valid for 10 years; the Taiwan Residents Travel Permit to the Mainland is divided into two types: valid for 5 years and valid for a single entry within 3 months.

大陆居民往来台湾通行证实行逐次签注。签注分一次往返有效和多次往返有效。

The Mainland Residents Travel Permit to Taiwan requires endorsements for each trip. Endorsements are divided into single-entry valid and multiple-entry valid.

大陆居民遗失旅行证件，应当向原发证的公安机关报失；经调查属实的，可补发给相应的旅行证件。

If a mainland resident loses their travel document, they shall report the loss to the original issuing public security organ; after investigation and verification, a replacement travel document may be issued.

台湾居民在大陆遗失旅行证件，应当向当地的市、县公安机关报失；经调查属实的，可以允许重新申请领取相应的旅行证件，或者发给一次有效的出境通行证件。

If a Taiwan resident loses their travel document in the mainland, they shall report the loss to the local city or county public security organ; after investigation and verification, they may be allowed to reapply for a corresponding travel document or be issued a single-exit travel document.

大陆居民前往台湾和台湾居民来大陆旅行证件的持有人，有本办法第十二条、第十九条规定情形之一的，其证件应当予以吊销或者宣布作废。

If the holder of a travel document for mainland residents traveling to Taiwan or Taiwan residents traveling to the mainland falls under any of the circumstances specified in Articles 12 and 19 of these Measures, their travel document shall be revoked or declared invalid.

审批签发旅行证件的机关，对已发出的旅行证件有权吊销或者宣布作废。公安部在必要时，可以变更签注、吊销旅行证件或者宣布作废。

The authority that approves and issues travel documents has the power to revoke or declare invalid any travel document already issued. The Ministry of Public Security may, when necessary, alter endorsements, revoke travel documents, or declare them invalid.

持用伪造、涂改等无效的旅行证件或者冒用他人的旅行证件出境、入境的，除依照《中华人民共和国公民出境入境管理法实施细则》第二十三条的规定处罚外，可以单处或者并处100元以上、500元以下的罚款。

Anyone who uses a forged, altered, or otherwise invalid travel document or uses another person's travel document to exit or enter the country shall, in addition to being punished in accordance with Article 23 of the Implementation Rules of the Law of the People's Republic of China on the Entry and Exit of Citizens, be subject to a fine of not less than 100 yuan but not more than 500 yuan, either alone or in addition.

伪造、涂改、转让、倒卖旅行证件的，除依照《中华人民共和国公民出境入境管理法实施细则》第二十四条的规定处罚外，可以单处或者并处500元以上、3000元以下的罚款。

Anyone who forges, alters, transfers, or sells travel documents shall, in addition to being punished in accordance with Article 24 of the Implementation Rules of the Law of the People's Republic of China on the Entry and Exit of Citizens, be subject to a fine of not less than 500 yuan but not more than 3,000 yuan, either alone or in addition.

编造情况，提供假证明，或者以行贿等手段获取旅行证件的，除依照《中华人民共和国公民出境入境管理法实施细则》第二十五条的规定处罚外，可以单处或者并处100元以上、500元以下的罚款。

Anyone who fabricates circumstances, provides false certificates, or obtains travel documents by bribery or other means shall, in addition to being punished in accordance with Article 25 of the Implementing Rules of the Law of the People's Republic of China on the Control of the Entry and Exit of Citizens, be fined not less than 100 yuan but not more than 500 yuan, either alone or concurrently.

有前款情形的，在处罚执行完毕6个月以内不受理其出境、入境申请。

If the circumstances described in the preceding paragraph exist, the exit or entry application shall not be accepted within six months after the execution of the penalty.

机关、团体、企业、事业单位编造情况、出具假证明为申请人获取旅行证件的，暂停其出证权的行使；情节严重的，取消其出证资格；对直接责任人员，除依照《中华人民共和国公民出境入境管理法实施细则》第二十五条的规定处罚外，可以单处或者并处500元以上、1000元以下的罚款。

If a state organ, organization, enterprise, or institution fabricates circumstances or issues false certificates to obtain travel documents for an applicant, its authority to issue certificates shall be suspended; if the circumstances are serious, its qualification to issue certificates shall be revoked; and the person directly responsible shall, in addition to being punished in accordance with Article 25 of the Implementing Rules of the Law of the People's Republic of China on the Control of the Entry and Exit of Citizens, be fined not less than 500 yuan but not more than 1,000 yuan, either alone or concurrently.

违反本办法第十六条的规定，不办理暂住登记的，处以警告或者100元以上、500元以下的罚款。

Anyone who violates the provisions of Article 16 of these Measures by failing to register for temporary residence shall be given a warning or fined not less than 100 yuan but not more than 500 yuan.

违反本办法第十八条的规定，逾期非法居留的，处以警告，可以单处或者并处每逾期1日100元的罚款。

Anyone who violates the provisions of Article 18 of these Measures by overstaying illegally shall be given a warning and may be fined 100 yuan for each day of overstay, either alone or concurrently.

被处罚人对公安机关处罚不服的，可以在接到处罚通知之日起15日内，向上一级公安机关申请复议，由上一级公安机关作出最后的裁决；也可以直接向人民法院提起诉讼。

If a person subject to a penalty disagrees with the penalty imposed by a public security organ, he may, within 15 days from the date of receipt of the penalty notice, apply for reconsideration to the public security organ at the next higher level, which shall make a final decision; or he may directly file a lawsuit with a people's court.

来大陆的台湾居民违反本办法的规定或者有其他违法犯罪行为的，除依照本办法和其他有关法律、法规的规定处罚外，公安机关可以缩短其停留期限，限期离境，或者遣送出境。

If a Taiwan resident who comes to the mainland violates the provisions of these Measures or commits other illegal or criminal acts, in addition to being punished in accordance with these Measures and other relevant laws and regulations, the public security organ may shorten his period of stay, order him to leave the territory within a time limit, or deport him.

有本办法第十九条规定不予批准情形之一的，应当立即遣送出境。

If any of the circumstances under which approval is not granted as provided in Article 19 of these Measures exists, the person shall be deported immediately.

执行本办法的国家工作人员，利用职权索取、收受贿赂或者有其他违法失职行为，情节轻微的，由主管部门予以行政处分；情节严重，构成犯罪的，依照《中华人民共和国刑法》的有关规定追究刑事责任。

If a state functionary implementing these Measures, by taking advantage of his position, extorts or accepts bribes, or commits other illegal or derelict acts, if the circumstances are minor, he shall be given administrative sanctions by the competent authority; if the circumstances are serious and constitute a crime, criminal liability shall be investigated in accordance with the relevant provisions of the Criminal Law of the People's Republic of China.

对违反本办法所得的财物，应当予以追缴或者责令退赔；用于犯罪的本人财物应当没收。

Any property obtained in violation of these Measures shall be recovered or ordered to be returned; the personal property of the offender used for the crime shall be confiscated.

罚款及没收的财物上缴国库。

Fines and confiscated property shall be turned over to the state treasury.

本办法由公安部负责解释。

These Measures shall be interpreted by the Ministry of Public Security.

本办法自1992年5月1日起施行。

These Measures shall come into force as of May 1, 1992.
