总则
General Provisions
为了加强地图管理，维护国家主权、安全和利益，促进地理信息产业健康发展，为经济建设、社会发展和人民生活服务，根据《中华人民共和国测绘法》，制定本条例。
These Regulations are formulated in accordance with the Surveying and Mapping Law of the People's Republic of China to strengthen map management, safeguard national sovereignty, security, and interests, promote the healthy development of the geographic information industry, and serve economic construction, social development, and the people's livelihood.
在中华人民共和国境内从事向社会公开的地图的编制、审核、出版和互联网地图服务以及监督检查活动，应当遵守本条例。
The compilation, review, publication, and internet map services of maps made available to the public within the territory of the People's Republic of China, as well as supervision and inspection activities, shall comply with these Regulations.
地图工作应当遵循维护国家主权、保障地理信息安全、方便群众生活的原则。
Map work shall follow the principles of safeguarding national sovereignty, ensuring geographic information security, and facilitating the people's daily life.
地图的编制、审核、出版和互联网地图服务应当遵守有关保密法律、法规的规定。
The compilation, review, publication, and internet map services of maps shall comply with relevant laws and regulations on confidentiality.
国务院测绘地理信息行政主管部门负责全国地图工作的统一监督管理。国务院其他有关部门按照国务院规定的职责分工，负责有关的地图工作。
The competent department of surveying, mapping, and geographic information under the State Council shall be responsible for the unified supervision and management of map work nationwide. Other relevant departments under the State Council shall be responsible for related map work in accordance with the division of duties prescribed by the State Council.
县级以上地方人民政府负责管理测绘地理信息工作的行政部门(以下称测绘地理信息行政主管部门)负责本行政区域地图工作的统一监督管理。县级以上地方人民政府其他有关部门按照本级人民政府规定的职责分工，负责有关的地图工作。
The administrative department responsible for surveying, mapping, and geographic information management under the local people's government at or above the county level (hereinafter referred to as the competent department of surveying, mapping, and geographic information) shall be responsible for the unified supervision and management of map work within its administrative region. Other relevant departments under the local people's government at or above the county level shall be responsible for related map work in accordance with the division of duties prescribed by the people's government at the same level.
各级人民政府及其有关部门、新闻媒体应当加强国家版图宣传教育，增强公民的国家版图意识。
People's governments at all levels, their relevant departments, and news media shall strengthen the publicity and education of the national territory, enhancing citizens' awareness of the national territory.
国家版图意识教育应当纳入中小学教学内容。
Education on national territory awareness shall be incorporated into the teaching content of primary and secondary schools.
公民、法人和其他组织应当使用正确表示国家版图的地图。
Citizens, legal persons, and other organizations shall use maps that correctly represent the national territory.
国家鼓励编制和出版符合标准和规定的各类地图产品，支持地理信息科学技术创新和产业发展，加快地理信息产业结构调整和优化升级，促进地理信息深层次应用。
The state encourages the compilation and publication of various map products that meet standards and regulations, supports innovation in geographic information science and technology and industrial development, accelerates the adjustment and optimization of the geographic information industry structure, and promotes deep application of geographic information.
县级以上人民政府应当建立健全政府部门间地理信息资源共建共享机制。
People's governments at or above the county level shall establish and improve mechanisms for sharing geographic information resources among government departments.
县级以上人民政府测绘地理信息行政主管部门应当采取有效措施，及时获取、处理、更新基础地理信息数据，通过地理信息公共服务平台向社会提供地理信息公共服务，实现地理信息数据开放共享。
The competent administrative department of surveying, mapping, and geographic information under the people's government at or above the county level shall take effective measures to timely acquire, process, and update basic geographic information data, provide geographic information public services to society through the geographic information public service platform, and achieve open sharing of geographic information data.
地图编制
Map Compilation
从事地图编制活动的单位应当依法取得相应的测绘资质证书，并在资质等级许可的范围内开展地图编制工作。
Units engaged in map compilation activities shall obtain corresponding surveying and mapping qualification certificates in accordance with the law and carry out map compilation work within the scope permitted by the qualification level.
编制地图，应当执行国家有关地图编制标准，遵守国家有关地图内容表示的规定。
When compiling maps, the relevant national standards for map compilation shall be implemented, and the provisions of the state on the representation of map content shall be observed.
地图上不得表示下列内容：
The following content shall not be represented on maps:
(一)危害国家统一、主权和领土完整的；
(1) Content that endangers national unity, sovereignty, and territorial integrity;
(二)危害国家安全、损害国家荣誉和利益的；
(2) Content that endangers national security, damages national honor and interests;
(三)属于国家秘密的；
(3) Those that are state secrets;
(四)影响民族团结、侵害民族风俗习惯的；
(4) Those that affect national unity or infringe upon ethnic customs and habits;
(五)法律、法规规定不得表示的其他内容。
(5) Other content that shall not be represented as provided by laws and regulations.
编制地图，应当选用最新的地图资料并及时补充或者更新，正确反映各要素的地理位置、形态、名称及相互关系，且内容符合地图使用目的。
When compiling a map, the latest map data shall be selected and supplemented or updated in a timely manner, correctly reflecting the geographical location, form, name, and interrelationships of each element, and the content shall conform to the purpose of map use.
编制涉及中华人民共和国国界的世界地图、全国地图，应当完整表示中华人民共和国疆域。
When compiling a world map or a national map involving the national boundaries of the People's Republic of China, the territory of the People's Republic of China shall be completely represented.
在地图上绘制中华人民共和国国界、中国历史疆界、世界各国间边界、世界各国间历史疆界，应当遵守下列规定：
When drawing the national boundaries of the People's Republic of China, China's historical boundaries, boundaries between countries of the world, and historical boundaries between countries of the world on a map, the following provisions shall be complied with:
(一)中华人民共和国国界，按照中国国界线画法标准样图绘制；
(1) The national boundaries of the People's Republic of China shall be drawn in accordance with the standard sample drawings of China's boundary line drawing method;
(二)中国历史疆界，依据有关历史资料，按照实际历史疆界绘制；
(2) China's historical boundaries shall be drawn in accordance with relevant historical materials and based on the actual historical boundaries;
(三)世界各国间边界，按照世界各国国界线画法参考样图绘制；
(3) Boundaries between countries of the world shall be drawn in accordance with the reference sample drawings of the boundary line drawing method of countries of the world;
(四)世界各国间历史疆界，依据有关历史资料，按照实际历史疆界绘制。
(4) Historical boundaries between countries of the world shall be drawn in accordance with relevant historical materials and based on the actual historical boundaries.
中国国界线画法标准样图、世界各国国界线画法参考样图，由外交部和国务院测绘地理信息行政主管部门拟订，报国务院批准后公布。
Standard sample maps for drawing China's national boundaries and reference sample maps for drawing national boundaries of countries around the world shall be drafted by the Ministry of Foreign Affairs and the administrative department of surveying, mapping and geographic information under the State Council, and shall be published after approval by the State Council.
在地图上绘制我国县级以上行政区域界线或者范围，应当符合行政区域界线标准画法图、国务院批准公布的特别行政区行政区域图和国家其他有关规定。
When drawing the administrative division boundaries or scope at or above the county level of China on a map, the standard drawing of administrative division boundaries, the administrative division maps of special administrative regions approved and published by the State Council, and other relevant provisions of the state shall be complied with.
行政区域界线标准画法图由国务院民政部门和国务院测绘地理信息行政主管部门拟订，报国务院批准后公布。
The standard drawing of administrative division boundaries shall be drafted by the civil affairs department of the State Council and the administrative department of surveying, mapping and geographic information under the State Council, and shall be published after approval by the State Council.
在地图上表示重要地理信息数据，应当使用依法公布的重要地理信息数据。
When representing important geographic information data on a map, the important geographic information data published in accordance with the law shall be used.
利用涉及国家秘密的测绘成果编制地图的，应当依法使用经国务院测绘地理信息行政主管部门或者省、自治区、直辖市人民政府测绘地理信息行政主管部门进行保密技术处理的测绘成果。
When compiling a map using surveying and mapping results involving state secrets, the surveying and mapping results that have undergone confidentiality technical treatment by the administrative department of surveying, mapping and geographic information under the State Council or the administrative department of surveying, mapping and geographic information of the people's government of a province, autonomous region, or municipality directly under the Central Government shall be used in accordance with the law.
县级以上人民政府测绘地理信息行政主管部门应当向社会公布公益性地图，供无偿使用。
The administrative department of surveying, mapping and geographic information of the people's government at or above the county level shall publish public welfare maps to the public for free use.
县级以上人民政府测绘地理信息行政主管部门应当及时组织收集与地图内容相关的行政区划、地名、交通、水系、植被、公共设施、居民点等的变更情况，用于定期更新公益性地图。有关部门和单位应当及时提供相关更新资料。
The administrative department of surveying, mapping and geographic information of the people's government at or above the county level shall promptly organize the collection of changes in administrative divisions, place names, transportation, water systems, vegetation, public facilities, residential areas, etc. related to map content, for the purpose of regularly updating public welfare maps. Relevant departments and units shall promptly provide relevant update materials.
地图审核
Map Review
国家实行地图审核制度。
The state implements a map review system.
向社会公开的地图，应当报送有审核权的测绘地理信息行政主管部门审核。但是，景区图、街区图、地铁线路图等内容简单的地图除外。
Maps made available to the public shall be submitted to the administrative department of surveying, mapping and geographic information with review authority for review. However, maps with simple content such as scenic spot maps, street maps, and subway line maps are excluded.
地图审核不得收取费用。
Map review shall not charge any fees.
出版地图的，由出版单位送审；展示或者登载不属于出版物的地图的，由展示者或者登载者送审；进口不属于出版物的地图或者附着地图图形的产品的，由进口者送审；进口属于出版物的地图，依照《出版管理条例》的有关规定执行；出口不属于出版物的地图或者附着地图图形的产品的，由出口者送审；生产附着地图图形的产品的，由生产者送审。
For publishing a map, the publisher shall submit it for review; for displaying or publishing a map that is not a publication, the displayer or publisher shall submit it for review; for importing a map that is not a publication or a product with map graphics attached, the importer shall submit it for review; for importing a map that is a publication, the relevant provisions of the 'Publication Management Regulations' shall apply; for exporting a map that is not a publication or a product with map graphics attached, the exporter shall submit it for review; for producing a product with map graphics attached, the producer shall submit it for review.
送审应当提交以下材料：
The following materials shall be submitted for review:
(一)地图审核申请表；
(1) Map review application form;
(二)需要审核的地图样图或者样品；
(2) Sample map or sample product to be reviewed;
(三)地图编制单位的测绘资质证书。
(3) Surveying and mapping qualification certificate of the map compilation unit.
进口不属于出版物的地图和附着地图图形的产品的，仅需提交前款第一项、第二项规定的材料。利用涉及国家秘密的测绘成果编制地图的，还应当提交保密技术处理证明。
For importing a map that is not a publication or a product with map graphics attached, only the materials specified in items (1) and (2) of the preceding paragraph need to be submitted. If the map is compiled using surveying and mapping results involving state secrets, a confidentiality technical processing certificate shall also be submitted.
国务院测绘地理信息行政主管部门负责下列地图的审核：
The surveying and mapping geographic information administrative department of the State Council is responsible for the review of the following maps:
(一)全国地图以及主要表现地为两个以上省、自治区、直辖市行政区域的地图；
(1) National maps and maps mainly covering the administrative areas of two or more provinces, autonomous regions, or municipalities directly under the Central Government;
(二)香港特别行政区地图、澳门特别行政区地图以及台湾地区地图；
(2) Maps of the Hong Kong Special Administrative Region, the Macao Special Administrative Region, and the Taiwan region.
(三)世界地图以及主要表现地为国外的地图；
(3) World maps and maps primarily depicting foreign regions;
(四)历史地图。
(4) Historical maps.
省、自治区、直辖市人民政府测绘地理信息行政主管部门负责审核主要表现地在本行政区域范围内的地图。其中，主要表现地在设区的市行政区域范围内不涉及国界线的地图，由设区的市级人民政府测绘地理信息行政主管部门负责审核。
The surveying, mapping and geoinformation administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government shall be responsible for reviewing maps that primarily depict areas within its administrative region. Among these, maps that primarily depict areas within the administrative region of a city divided into districts and do not involve national boundaries shall be reviewed by the surveying, mapping and geoinformation administrative department of the people's government of that city divided into districts.
有审核权的测绘地理信息行政主管部门应当自受理地图审核申请之日起20个工作日内，作出审核决定。
The surveying, mapping and geoinformation administrative department with review authority shall make a review decision within 20 working days from the date of accepting the map review application.
时事宣传地图、时效性要求较高的图书和报刊等插附地图的，应当自受理地图审核申请之日起7个工作日内，作出审核决定。
For current affairs publicity maps, and books, newspapers, etc. with high timeliness requirements that include attached maps, the review decision shall be made within 7 working days from the date of accepting the map review application.
应急保障等特殊情况需要使用地图的，应当即送即审。
For maps needed under special circumstances such as emergency support, the review shall be conducted immediately upon submission.
涉及专业内容的地图，应当依照国务院测绘地理信息行政主管部门会同有关部门制定的审核依据进行审核。没有明确审核依据的，由有审核权的测绘地理信息行政主管部门征求有关部门的意见，有关部门应当自收到征求意见材料之日起20个工作日内提出意见。征求意见时间不计算在地图审核的期限内。
Maps involving professional content shall be reviewed in accordance with the review standards formulated by the surveying, mapping and geoinformation administrative department of the State Council jointly with relevant departments. If there are no clear review standards, the surveying, mapping and geoinformation administrative department with review authority shall seek opinions from relevant departments, and the relevant departments shall provide opinions within 20 working days from the date of receiving the materials for opinion. The time for seeking opinions shall not be counted in the map review period.
世界地图、历史地图、时事宣传地图没有明确审核依据的，由国务院测绘地理信息行政主管部门商外交部进行审核。
For world maps, historical maps, and current affairs publicity maps without clear review standards, the surveying, mapping and geoinformation administrative department of the State Council shall consult the Ministry of Foreign Affairs for review.
送审地图符合下列规定的，由有审核权的测绘地理信息行政主管部门核发地图审核批准文件，并注明审图号：
If the submitted map complies with the following provisions, the surveying, mapping and geoinformation administrative department with review authority shall issue a map review approval document and indicate the review number:
(一)符合国家有关地图编制标准，完整表示中华人民共和国疆域；
(1) Comply with the national map compilation standards and completely represent the territory of the People's Republic of China;
(二)国界、边界、历史疆界、行政区域界线或者范围、重要地理信息数据、地名等符合国家有关地图内容表示的规定；
(2) National boundaries, borders, historical boundaries, administrative division boundaries or extents, important geographic information data, place names, etc., comply with the national regulations on map content representation;
(三)不含有地图上不得表示的内容。
(3) Does not contain content that shall not be represented on maps.
地图审核批准文件和审图号应当在有审核权的测绘地理信息行政主管部门网站或者其他新闻媒体上及时公告。
The map review approval document and review number shall be promptly announced on the website of the competent surveying, mapping and geographic information administrative department with review authority or other news media.
经审核批准的地图，应当在地图或者附着地图图形的产品的适当位置显著标注审图号。其中，属于出版物的，应当在版权页标注审图号。
For a map approved after review, the review number shall be prominently marked in an appropriate position on the map or on the product with map graphics attached. If it is a publication, the review number shall be marked on the copyright page.
全国性中小学教学地图，由国务院教育行政部门会同国务院测绘地理信息行政主管部门、外交部组织审定；地方性中小学教学地图，由省、自治区、直辖市人民政府教育行政部门会同省、自治区、直辖市人民政府测绘地理信息行政主管部门组织审定。
National primary and secondary school teaching maps shall be examined and approved by the education administrative department of the State Council jointly with the surveying, mapping and geographic information administrative department of the State Council and the Ministry of Foreign Affairs; local primary and secondary school teaching maps shall be examined and approved by the education administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government jointly with the surveying, mapping and geographic information administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government.
任何单位和个人不得出版、展示、登载、销售、进口、出口不符合国家有关标准和规定的地图，不得携带、寄递不符合国家有关标准和规定的地图进出境。
No unit or individual may publish, display, upload, sell, import, or export maps that do not comply with relevant national standards and regulations, nor may they carry or send by post maps that do not comply with relevant national standards and regulations into or out of the country.
进口、出口地图的，应当向海关提交地图审核批准文件和审图号。
When importing or exporting maps, the map review approval document and review number shall be submitted to the customs.
经审核批准的地图，送审者应当按照有关规定向有审核权的测绘地理信息行政主管部门免费送交样本。
For a map approved after review, the submitter shall, in accordance with relevant regulations, submit samples free of charge to the competent surveying, mapping and geographic information administrative department with review authority.
地图出版
Map Publication
县级以上人民政府出版行政主管部门应当加强对地图出版活动的监督管理，依法对地图出版违法行为进行查处。
The publication administrative department of the people's government at or above the county level shall strengthen the supervision and management of map publication activities, and investigate and deal with illegal map publication acts in accordance with the law.
出版单位从事地图出版活动的，应当具有国务院出版行政主管部门审核批准的地图出版业务范围，并依照《出版管理条例》的有关规定办理审批手续。
A publishing entity engaging in map publishing activities shall have a map publishing business scope reviewed and approved by the publishing administrative department of the State Council, and shall go through the approval procedures in accordance with the relevant provisions of the Regulations on the Administration of Publishing.
出版单位根据需要，可以在出版物中插附经审核批准的地图。
A publishing entity may, as needed, insert maps that have been reviewed and approved into its publications.
任何出版单位不得出版未经审定的中小学教学地图。
No publishing entity may publish teaching maps for primary and secondary schools that have not been reviewed.
出版单位出版地图，应当按照国家有关规定向国家图书馆、中国版本图书馆和国务院出版行政主管部门免费送交样本。
When publishing a map, a publishing entity shall, in accordance with the relevant provisions of the state, submit free samples to the National Library of China, the China Library of Editions, and the publishing administrative department of the State Council.
地图著作权的保护，依照有关著作权法律、法规的规定执行。
The protection of map copyright shall be implemented in accordance with the relevant copyright laws and regulations.
互联网地图服务
Internet Map Services
国家鼓励和支持互联网地图服务单位开展地理信息开发利用和增值服务。
The state encourages and supports internet map service units to carry out geographic information development, utilization, and value-added services.
县级以上人民政府应当加强对互联网地图服务行业的政策扶持和监督管理。
People's governments at or above the county level shall strengthen policy support and supervision over the internet map service industry.
互联网地图服务单位向公众提供地理位置定位、地理信息上传标注和地图数据库开发等服务的，应当依法取得相应的测绘资质证书。
An internet map service unit that provides services such as geographic location positioning, geographic information upload and annotation, and map database development to the public shall obtain the corresponding surveying and mapping qualification certificate in accordance with the law.
互联网地图服务单位从事互联网地图出版活动的，应当经国务院出版行政主管部门依法审核批准。
An internet map service unit engaging in internet map publishing activities shall be reviewed and approved by the publishing administrative department of the State Council in accordance with the law.
互联网地图服务单位应当将存放地图数据的服务器设在中华人民共和国境内，并制定互联网地图数据安全管理制度和保障措施。
Internet map service providers shall place servers storing map data within the territory of the People's Republic of China and establish internet map data security management systems and safeguard measures.
县级以上人民政府测绘地理信息行政主管部门应当会同有关部门加强对互联网地图数据安全的监督管理。
The competent departments of surveying, mapping and geoinformation of the people's governments at or above the county level shall, together with relevant departments, strengthen the supervision and management of internet map data security.
互联网地图服务单位收集、使用用户个人信息的，应当明示收集、使用信息的目的、方式和范围，并经用户同意。
If an internet map service provider collects or uses users' personal information, it shall clearly state the purpose, method, and scope of collection and use, and obtain user consent.
互联网地图服务单位需要收集、使用用户个人信息的，应当公开收集、使用规则，不得泄露、篡改、出售或者非法向他人提供用户的个人信息。
If an internet map service provider needs to collect or use users' personal information, it shall disclose the collection and use rules, and shall not disclose, alter, sell, or illegally provide users' personal information to others.
互联网地图服务单位应当采取技术措施和其他必要措施，防止用户的个人信息泄露、丢失。
Internet map service providers shall adopt technical measures and other necessary measures to prevent the disclosure or loss of users' personal information.
互联网地图服务单位用于提供服务的地图数据库及其他数据库不得存储、记录含有按照国家有关规定在地图上不得表示的内容。互联网地图服务单位发现其网站传输的地图信息含有不得表示的内容的，应当立即停止传输，保存有关记录，并向县级以上人民政府测绘地理信息行政主管部门、出版行政主管部门、网络安全和信息化主管部门等有关部门报告。
The map databases and other databases used by internet map service providers for providing services shall not store or record content that is not allowed to be represented on maps according to relevant state regulations. If an internet map service provider discovers that map information transmitted on its website contains content that is not allowed to be represented, it shall immediately stop the transmission, preserve relevant records, and report to the competent departments of surveying, mapping and geoinformation, publishing, and cybersecurity and informatization of the people's government at or above the county level.
任何单位和个人不得通过互联网上传标注含有按照国家有关规定在地图上不得表示的内容。
No unit or individual may upload or mark content that is not allowed to be represented on maps according to relevant state regulations via the internet.
互联网地图服务单位应当使用经依法审核批准的地图，加强对互联网地图新增内容的核查校对，并按照国家有关规定向国务院测绘地理信息行政主管部门或者省、自治区、直辖市测绘地理信息行政主管部门备案。
Internet map service providers shall use maps that have been reviewed and approved according to law, strengthen the verification and proofreading of new content added to internet maps, and file with the competent department of surveying, mapping and geoinformation of the State Council or the competent departments of surveying, mapping and geoinformation of provinces, autonomous regions, or municipalities directly under the Central Government in accordance with relevant state regulations.
互联网地图服务单位对在工作中获取的涉及国家秘密、商业秘密的信息，应当保密。
Internet map service providers shall keep confidential any information involving state secrets or business secrets obtained in the course of work.
互联网地图服务单位应当加强行业自律，推进行业信用体系建设，提高服务水平。
Internet map service providers shall strengthen industry self-discipline, promote the construction of an industry credit system, and improve service levels.
从事互联网地图服务活动，适用本章的规定；本章没有规定的，适用本条例其他有关规定。
The provisions of this Chapter shall apply to activities involving Internet map services; where this Chapter has no provisions, other relevant provisions of these Regulations shall apply.
监督检查
Supervision and Inspection
县级以上人民政府及其有关部门应当依法加强对地图编制、出版、展示、登载、生产、销售、进口、出口等活动的监督检查。
The people's governments at or above the county level and their relevant departments shall, in accordance with the law, strengthen the supervision and inspection of activities such as map compilation, publication, display, loading, production, sale, import, and export.
县级以上人民政府测绘地理信息行政主管部门、出版行政主管部门和其他有关部门依法进行监督检查时，有权采取下列措施：
When conducting supervision and inspection in accordance with the law, the competent departments of surveying, mapping, and geoinformation, the competent departments of publication, and other relevant departments of the people's governments at or above the county level shall have the authority to take the following measures:
(一)进入涉嫌地图违法行为的场所实施现场检查；
(1) Entering the premises where suspected map violations are occurring to conduct on-site inspections;
(二)查阅、复制有关合同、票据、账簿等资料；
(2) Reviewing and copying relevant contracts, bills, account books, and other materials;
(三)查封、扣押涉嫌违法的地图、附着地图图形的产品以及用于实施地图违法行为的设备、工具、原材料等。
(3) Sealing or seizing suspected illegal maps, products with map graphics attached, and equipment, tools, raw materials, etc., used for map violations.
国务院测绘地理信息行政主管部门、国务院出版行政主管部门应当建立健全地图监督管理信息系统，实现信息资源共享，方便公众查询。
The competent department of surveying, mapping, and geoinformation of the State Council and the competent department of publication of the State Council shall establish and improve a map supervision and management information system to achieve information resource sharing and facilitate public inquiries.
县级以上人民政府测绘地理信息行政主管部门应当根据国家有关标准和技术规范，加强地图质量监督管理。
The competent departments of surveying, mapping, and geoinformation of the people's governments at or above the county level shall strengthen the supervision and management of map quality in accordance with relevant national standards and technical specifications.
地图编制、出版、展示、登载、生产、销售、进口、出口单位应当建立健全地图质量责任制度，采取有效措施，保证地图质量。
Units engaged in map compilation, publication, display, loading, production, sale, import, and export shall establish and improve a map quality responsibility system and take effective measures to ensure map quality.
任何单位和个人对地图违法行为有权进行举报。
Any unit or individual has the right to report map violations.
接到举报的人民政府或者有关部门应当及时依法调查处理，并为举报人保密。
The people's government or relevant department that receives the report shall promptly investigate and handle it according to law, and keep the reporter confidential.
法律责任
Legal Liability
县级以上人民政府及其有关部门违反本条例规定，有下列行为之一的，由主管机关或者监察机关责令改正；情节严重的，对直接负责的主管人员和其他直接责任人员依法给予处分；直接负责的主管人员和其他直接责任人员的行为构成犯罪的，依法追究刑事责任：
If a people's government at or above the county level or its relevant department violates these regulations by committing any of the following acts, the competent authority or supervisory organ shall order correction; if the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be given sanctions according to law; if the acts of the directly responsible person in charge and other directly responsible personnel constitute a crime, criminal liability shall be pursued according to law:
(一)不依法作出行政许可决定或者办理批准文件的；
(1) Failing to make an administrative licensing decision or handle approval documents according to law;
(二)发现违法行为或者接到对违法行为的举报不予查处的；
(2) Discovering illegal acts or receiving reports of illegal acts but failing to investigate and handle them;
(三)其他未依照本条例规定履行职责的行为。
(3) Other acts of failing to perform duties in accordance with these regulations.
违反本条例规定，未取得测绘资质证书或者超越测绘资质等级许可的范围从事地图编制活动或者互联网地图服务活动的，依照《中华人民共和国测绘法》的有关规定进行处罚。
If, in violation of these regulations, a party engages in map compilation activities or internet map service activities without obtaining a surveying and mapping qualification certificate or beyond the scope permitted by the surveying and mapping qualification level, penalties shall be imposed in accordance with the relevant provisions of the Surveying and Mapping Law of the People's Republic of China.
违反本条例规定，应当送审而未送审的，责令改正，给予警告，没收违法地图或者附着地图图形的产品，可以处10万元以下的罚款；有违法所得的，没收违法所得；构成犯罪的，依法追究刑事责任。
If, in violation of these regulations, a map that should have been submitted for review is not submitted, the party shall be ordered to correct, given a warning, and the illegal maps or products with map graphics shall be confiscated; a fine of not more than 100,000 yuan may be imposed; if there is illegal income, the illegal income shall be confiscated; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，不需要送审的地图不符合国家有关标准和规定的，责令改正，给予警告，没收违法地图或者附着地图图形的产品，可以处10万元以下的罚款；有违法所得的，没收违法所得；情节严重的，可以向社会通报；构成犯罪的，依法追究刑事责任。
If, in violation of these regulations, a map that does not require review does not comply with relevant national standards and provisions, the party shall be ordered to correct, given a warning, and the illegal maps or products with map graphics shall be confiscated; a fine of not more than 100,000 yuan may be imposed; if there is illegal income, the illegal income shall be confiscated; if the circumstances are serious, the matter may be publicly notified; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，经审核不符合国家有关标准和规定的地图未按照审核要求修改即向社会公开的，责令改正，给予警告，没收违法地图或者附着地图图形的产品，可以处10万元以下的罚款；有违法所得的，没收违法所得；情节严重的，责令停业整顿，降低资质等级或者吊销测绘资质证书，可以向社会通报；构成犯罪的，依法追究刑事责任。
In violation of these regulations, if a map that has been reviewed and found not to meet relevant national standards and requirements is made public without being corrected as required by the review, the violator shall be ordered to correct, given a warning, and the illegal maps or products with map graphics shall be confiscated, and a fine of not more than 100,000 yuan may be imposed; if there is illegal income, the illegal income shall be confiscated; if the circumstances are serious, the violator shall be ordered to suspend business for rectification, have its qualification grade lowered or its surveying and mapping qualification certificate revoked, and may be publicly notified; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，弄虚作假、伪造申请材料骗取地图审核批准文件，或者伪造、冒用地图审核批准文件和审图号的，责令停止违法行为，给予警告，没收违法地图和附着地图图形的产品，并处10万元以上20万元以下的罚款；有违法所得的，没收违法所得；情节严重的，责令停业整顿，降低资质等级或者吊销测绘资质证书；构成犯罪的，依法追究刑事责任。
In violation of these regulations, if anyone obtains a map review approval document by fraud or falsifying application materials, or forges or fraudulently uses a map review approval document or review number, the violator shall be ordered to stop the illegal act, given a warning, and the illegal maps and products with map graphics shall be confiscated, and a fine of not less than 100,000 yuan but not more than 200,000 yuan shall be imposed; if there is illegal income, the illegal income shall be confiscated; if the circumstances are serious, the violator shall be ordered to suspend business for rectification, have its qualification grade lowered or its surveying and mapping qualification certificate revoked; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，未在地图的适当位置显著标注审图号，或者未按照有关规定送交样本的，责令改正，给予警告；情节严重的，责令停业整顿，降低资质等级或者吊销测绘资质证书。
In violation of these regulations, if the review number is not prominently marked in an appropriate position on the map, or if the sample is not submitted in accordance with relevant regulations, the violator shall be ordered to correct and given a warning; if the circumstances are serious, the violator shall be ordered to suspend business for rectification, have its qualification grade lowered or its surveying and mapping qualification certificate revoked.
违反本条例规定，互联网地图服务单位使用未经依法审核批准的地图提供服务，或者未对互联网地图新增内容进行核查校对的，责令改正，给予警告，可以处20万元以下的罚款；有违法所得的，没收违法所得；情节严重的，责令停业整顿，降低资质等级或者吊销测绘资质证书；构成犯罪的，依法追究刑事责任。
In violation of these regulations, if an internet map service provider uses a map that has not been reviewed and approved according to law to provide services, or fails to verify and check newly added content of the internet map, the violator shall be ordered to correct, given a warning, and a fine of not more than 200,000 yuan may be imposed; if there is illegal income, the illegal income shall be confiscated; if the circumstances are serious, the violator shall be ordered to suspend business for rectification, have its qualification grade lowered or its surveying and mapping qualification certificate revoked; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，通过互联网上传标注了含有按照国家有关规定在地图上不得表示的内容的，责令改正，给予警告，可以处10万元以下的罚款；构成犯罪的，依法追究刑事责任。
In violation of these regulations, if content that is not allowed to be displayed on maps according to relevant state regulations is uploaded and marked through the internet, the violator shall be ordered to correct, given a warning, and a fine of not more than 100,000 yuan may be imposed; if a crime is constituted, criminal liability shall be pursued according to law.
本条例规定的降低资质等级、吊销测绘资质证书的行政处罚，由颁发资质证书的部门决定；其他行政处罚由县级以上人民政府测绘地理信息行政主管部门决定。
The administrative penalties of lowering the qualification grade and revoking the surveying and mapping qualification certificate as provided in these regulations shall be decided by the department that issued the qualification certificate; other administrative penalties shall be decided by the competent department of surveying, mapping and geographic information of the people's government at or above the county level.
附则
Supplementary Provisions
军队单位编制的地图的管理以及海图的管理，按照国务院、中央军事委员会的规定执行。
The management of maps compiled by military units and the management of nautical charts shall be implemented in accordance with the provisions of the State Council and the Central Military Commission.
本条例自2016年1月1日起施行。国务院1995年7月10日发布的《中华人民共和国地图编制出版管理条例》同时废止。
These regulations shall come into force on January 1, 2016. The Regulations of the People's Republic of China on the Compilation and Publication of Maps promulgated by the State Council on July 10, 1995 shall be abolished simultaneously.
