Labor and Social Security Inspection Regulations

(Adopted at the 68th Executive Meeting of the State Council on October 26, 2004, promulgated by Order No. 423 of the State Council of the People's Republic of China on November 1, 2004, effective as of December 1, 2004)

为了贯彻实施劳动和社会保障(以下称劳动保障)法律、法规和规章，规范劳动保障监察工作，维护劳动者的合法权益，根据劳动法和有关法律，制定本条例。

These Regulations are formulated in accordance with the Labor Law and relevant laws for the purpose of implementing labor and social security (hereinafter referred to as labor security) laws, regulations and rules, standardizing labor security inspection work, and safeguarding the legitimate rights and interests of workers.

对企业和个体工商户(以下称用人单位)进行劳动保障监察，适用本条例。

These Regulations apply to labor security inspections of enterprises and individual industrial and commercial households (hereinafter referred to as employing units).

对职业介绍机构、职业技能培训机构和职业技能考核鉴定机构进行劳动保障监察，依照本条例执行。

Labor security inspections of job placement agencies, vocational skills training institutions, and vocational skills assessment and certification institutions shall be carried out in accordance with these Regulations.

国务院劳动保障行政部门主管全国的劳动保障监察工作。县级以上地方各级人民政府劳动保障行政部门主管本行政区域内的劳动保障监察工作。

The labor security administrative department of the State Council shall be in charge of labor security inspection work nationwide. The labor security administrative departments of local people's governments at or above the county level shall be in charge of labor security inspection work within their respective administrative regions.

县级以上各级人民政府有关部门根据各自职责，支持、协助劳动保障行政部门的劳动保障监察工作。

The relevant departments of local people's governments at or above the county level shall, in accordance with their respective functions and duties, support and assist the labor security administrative departments in carrying out labor security inspection work.

县级、设区的市级人民政府劳动保障行政部门可以委托符合监察执法条件的组织实施劳动保障监察。

The labor security administrative departments of people's governments at the county level and at the level of a city divided into districts may entrust organizations that meet the conditions for inspection and law enforcement to carry out labor security inspections.

劳动保障行政部门和受委托实施劳动保障监察的组织中的劳动保障监察员应当经过相应的考核或者考试录用。

Labor security inspectors in labor security administrative departments and organizations entrusted to carry out labor security inspections shall be recruited after passing relevant assessments or examinations.

劳动保障监察证件由国务院劳动保障行政部门监制。

Labor security inspection certificates shall be produced under the supervision of the labor security administrative department of the State Council.

县级以上地方各级人民政府应当加强劳动保障监察工作。劳动保障监察所需经费列入本级财政预算。

Local people's governments at or above the county level shall strengthen labor security inspection work. The funds required for labor security inspections shall be included in the fiscal budget at the corresponding level.

用人单位应当遵守劳动保障法律、法规和规章，接受并配合劳动保障监察。

Employing units shall comply with labor security laws, regulations and rules, and accept and cooperate with labor security inspections.

各级工会依法维护劳动者的合法权益，对用人单位遵守劳动保障法律、法规和规章的情况进行监督。

Trade unions at all levels shall safeguard the legitimate rights and interests of workers according to law, and supervise the compliance of employing units with labor security laws, regulations and rules.

劳动保障行政部门在劳动保障监察工作中应当注意听取工会组织的意见和建议。

Labor security administrative departments shall pay attention to the opinions and suggestions of trade union organizations in labor security inspection work.

劳动保障监察遵循公正、公开、高效、便民的原则。

Labor security inspections shall follow the principles of fairness, openness, efficiency, and convenience for the people.

实施劳动保障监察，坚持教育与处罚相结合，接受社会监督。

In carrying out labor security inspections, the combination of education and punishment shall be adhered to, and social supervision shall be accepted.

任何组织或者个人对违反劳动保障法律、法规或者规章的行为，有权向劳动保障行政部门举报。

Any organization or individual has the right to report to the labor security administrative department any act that violates labor security laws, regulations or rules.

劳动者认为用人单位侵犯其劳动保障合法权益的，有权向劳动保障行政部门投诉。

Workers who believe that an employing unit has infringed upon their legitimate labor security rights and interests have the right to file a complaint with the labor security administrative department.

劳动保障行政部门应当为举报人保密；对举报属实，为查处重大违反劳动保障法律、法规或者规章的行为提供主要线索和证据的举报人，给予奖励。

Labor security administrative departments shall keep the identity of whistleblowers confidential; whistleblowers whose reports are verified and who provide major clues and evidence for investigating and punishing serious violations of labor security laws, regulations or rules shall be rewarded.

劳动保障行政部门实施劳动保障监察，履行下列职责：

Labor security administrative departments shall perform the following duties when carrying out labor security inspections:

(一)宣传劳动保障法律、法规和规章，督促用人单位贯彻执行；

(1) Publicizing labor security laws, regulations and rules, and urging employing units to implement them;

(二)检查用人单位遵守劳动保障法律、法规和规章的情况；

(2) Inspecting the compliance of employing units with labor security laws, regulations and rules;

(三)受理对违反劳动保障法律、法规或者规章的行为的举报、投诉；

(3) Accepting reports and complaints of acts violating labor security laws, regulations or rules;

(四)依法纠正和查处违反劳动保障法律、法规或者规章的行为。

(4) Correcting and punishing acts violating labor security laws, regulations or rules according to law.

劳动保障行政部门对下列事项实施劳动保障监察：

Labor security administrative departments shall carry out labor security inspections on the following matters:

(一)用人单位制定内部劳动保障规章制度的情况；

(1) The formulation of internal labor security rules and regulations by employing units;

(二)用人单位与劳动者订立劳动合同的情况；

(2) The conclusion of labor contracts between employing units and workers;

(三)用人单位遵守禁止使用童工规定的情况；

(3) Compliance by employing units with the provisions prohibiting the use of child labor;

(四)用人单位遵守女职工和未成年工特殊劳动保护规定的情况；

(4) Compliance by employing units with the special labor protection provisions for female workers and underage workers;

(五)用人单位遵守工作时间和休息休假规定的情况；

(5) Compliance by employing units with the provisions on working hours, rest and leave;

(六)用人单位支付劳动者工资和执行最低工资标准的情况；

(6) Payment of wages by employing units and implementation of minimum wage standards;

(七)用人单位参加各项社会保险和缴纳社会保险费的情况；

(7) Participation by employing units in various social insurances and payment of social insurance premiums;

(八)职业介绍机构、职业技能培训机构和职业技能考核鉴定机构遵守国家有关职业介绍、职业技能培训和职业技能考核鉴定的规定的情况；

(8) Compliance by job placement agencies, vocational skills training institutions, and vocational skills assessment and certification institutions with the state provisions on job placement, vocational skills training, and vocational skills assessment and certification;

(九)法律、法规规定的其他劳动保障监察事项。

(9) Other labor security inspection matters as provided by laws and regulations.

劳动保障监察员依法履行劳动保障监察职责，受法律保护。

Labor security inspectors who perform their duties according to law shall be protected by law.

劳动保障监察员应当忠于职守，秉公执法，勤政廉洁，保守秘密。

Labor security inspectors shall be devoted to their duties, enforce the law impartially, be diligent and honest, and keep secrets.

任何组织或者个人对劳动保障监察员的违法违纪行为，有权向劳动保障行政部门或者有关机关检举、控告。

Any organization or individual has the right to report or accuse labor security inspectors of illegal or disciplinary acts to the labor security administrative department or relevant authorities.

对用人单位的劳动保障监察，由用人单位用工所在地的县级或者设区的市级劳动保障行政部门管辖。

Labor security inspections of employing units shall be under the jurisdiction of the labor security administrative department of the county or city divided into districts where the employing unit is located.

上级劳动保障行政部门根据工作需要，可以调查处理下级劳动保障行政部门管辖的案件。劳动保障行政部门对劳动保障监察管辖发生争议的，报请共同的上一级劳动保障行政部门指定管辖。

Higher-level labor security administrative departments may, as needed, investigate and handle cases under the jurisdiction of lower-level labor security administrative departments. In case of a dispute over jurisdiction, the labor security administrative departments shall report to the common higher-level labor security administrative department for designation of jurisdiction.

省、自治区、直辖市人民政府可以对劳动保障监察的管辖制定具体办法。

People's governments of provinces, autonomous regions, and municipalities directly under the Central Government may formulate specific measures for the jurisdiction of labor security inspections.

劳动保障监察以日常巡视检查、审查用人单位按照要求报送的书面材料以及接受举报投诉等形式进行。

Labor security inspections shall be carried out in the form of routine patrol inspections, review of written materials submitted by employing units as required, and acceptance of reports and complaints.

劳动保障行政部门认为用人单位有违反劳动保障法律、法规或者规章的行为，需要进行调查处理的，应当及时立案。

If a labor security administrative department believes that an employing unit has committed an act violating labor security laws, regulations or rules and needs to be investigated and handled, it shall promptly file a case.

劳动保障行政部门或者受委托实施劳动保障监察的组织应当设立举报、投诉信箱和电话。

Labor security administrative departments or organizations entrusted to carry out labor security inspections shall set up mailboxes and telephone lines for reports and complaints.

对因违反劳动保障法律、法规或者规章的行为引起的群体性事件，劳动保障行政部门应当根据应急预案，迅速会同有关部门处理。

For mass incidents caused by acts violating labor security laws, regulations or rules, the labor security administrative department shall, in accordance with the emergency plan, promptly handle the matter jointly with relevant departments.

劳动保障行政部门实施劳动保障监察，有权采取下列调查、检查措施：

When carrying out labor security inspections, labor security administrative departments have the right to take the following investigation and inspection measures:

(一)进入用人单位的劳动场所进行检查；

(1) Entering the workplace of the employing unit for inspection;

(二)就调查、检查事项询问有关人员；

(2) Inquiring relevant personnel about the matters under investigation or inspection;

(三)要求用人单位提供与调查、检查事项相关的文件资料，并作出解释和说明，必要时可以发出调查询问书；

(3) Requiring the employing unit to provide documents and materials related to the matters under investigation or inspection, and to provide explanations and clarifications; if necessary, issuing an investigation inquiry letter;

(四)采取记录、录音、录像、照像或者复制等方式收集有关情况和资料；

(4) Collecting relevant information and materials by means of recording, audio recording, video recording, photographing, or copying;

(五)委托会计师事务所对用人单位工资支付、缴纳社会保险费的情况进行审计；

(5) Entrusting an accounting firm to audit the wage payment and social insurance premium payment of the employing unit;

(六)法律、法规规定可以由劳动保障行政部门采取的其他调查、检查措施。

(6) Other investigation and inspection measures that may be taken by labor security administrative departments as provided by laws and regulations.

劳动保障行政部门对事实清楚、证据确凿、可以当场处理的违反劳动保障法律、法规或者规章的行为有权当场予以纠正。

Labor security administrative departments have the right to immediately correct acts violating labor security laws, regulations or rules that are clear in facts, conclusive in evidence, and can be handled on the spot.

劳动保障监察员进行调查、检查，不得少于2人，并应当佩戴劳动保障监察标志、出示劳动保障监察证件。

Labor security inspectors shall conduct investigations and inspections with at least two persons present, and shall wear the labor security inspection badge and present the labor security inspection certificate.

劳动保障监察员办理的劳动保障监察事项与本人或者其近亲属有直接利害关系的，应当回避。

Labor security inspectors who have a direct interest in the labor security inspection matters they handle, either personally or with their close relatives, shall recuse themselves.

劳动保障行政部门对违反劳动保障法律、法规或者规章的行为的调查，应当自立案之日起60个工作日内完成；对情况复杂的，经劳动保障行政部门负责人批准，可以延长30个工作日。

The investigation of acts violating labor security laws, regulations or rules by labor security administrative departments shall be completed within 60 working days from the date of case filing; for complex cases, the period may be extended by 30 working days with the approval of the head of the labor security administrative department.

劳动保障行政部门对违反劳动保障法律、法规或者规章的行为，根据调查、检查的结果，作出以下处理：

Based on the results of investigation and inspection, labor security administrative departments shall make the following dispositions for acts violating labor security laws, regulations or rules:

(一)对依法应当受到行政处罚的，依法作出行政处罚决定；

(1) For acts that should be subject to administrative penalties according to law, a decision on administrative penalty shall be made according to law;

(二)对应当改正未改正的，依法责令改正或者作出相应的行政处理决定；

(2) For acts that should be corrected but have not been corrected, a correction order or corresponding administrative disposition decision shall be made according to law;

(三)对情节轻微且已改正的，撤销立案。

(3) For minor acts that have been corrected, the case shall be closed.

发现违法案件不属于劳动保障监察事项的，应当及时移送有关部门处理；涉嫌犯罪的，应当依法移送司法机关。

If it is found that an illegal case does not fall within the scope of labor security inspection matters, it shall be promptly transferred to the relevant department for handling; if a crime is suspected, it shall be transferred to the judicial authority according to law.

劳动保障行政部门对违反劳动保障法律、法规或者规章的行为作出行政处罚或者行政处理决定前，应当听取用人单位的陈述、申辩；作出行政处罚或者行政处理决定，应当告知用人单位依法享有申请行政复议或者提起行政诉讼的权利。

Before making a decision on administrative penalty or administrative disposition for an act violating labor security laws, regulations or rules, the labor security administrative department shall hear the statements and defenses of the employing unit; when making a decision on administrative penalty or administrative disposition, the employing unit shall be informed of its right to apply for administrative reconsideration or file an administrative lawsuit according to law.

违反劳动保障法律、法规或者规章的行为在2年内未被劳动保障行政部门发现，也未被举报、投诉的，劳动保障行政部门不再查处。

If an act violating labor security laws, regulations or rules has not been discovered by the labor security administrative department, nor reported or complained about within two years, the labor security administrative department shall no longer investigate and punish it.

前款规定的期限，自违反劳动保障法律、法规或者规章的行为发生之日起计算；违反劳动保障法律、法规或者规章的行为有连续或者继续状态的，自行为终了之日起计算。

The period specified in the preceding paragraph shall be calculated from the date on which the act violating labor security laws, regulations or rules occurred; if the act is continuous or ongoing, the period shall be calculated from the date on which the act ended.

用人单位违反劳动保障法律、法规或者规章，对劳动者造成损害的，依法承担赔偿责任。劳动者与用人单位就赔偿发生争议的，依照国家有关劳动争议处理的规定处理。

If an employing unit violates labor security laws, regulations or rules and causes damage to a worker, it shall bear compensation liability according to law. If a dispute arises between the worker and the employing unit over compensation, it shall be handled in accordance with the state provisions on labor dispute handling.

对应当通过劳动争议处理程序解决的事项或者已经按照劳动争议处理程序申请调解、仲裁或者已经提起诉讼的事项，劳动保障行政部门应当告知投诉人依照劳动争议处理或者诉讼的程序办理。

For matters that should be resolved through labor dispute handling procedures, or matters that have already been applied for mediation, arbitration, or litigation in accordance with labor dispute handling procedures, the labor security administrative department shall inform the complainant to handle the matter in accordance with labor dispute handling or litigation procedures.

劳动保障行政部门应当建立用人单位劳动保障守法诚信档案。用人单位有重大违反劳动保障法律、法规或者规章的行为的，由有关的劳动保障行政部门向社会公布。

Labor security administrative departments shall establish credit files for employing units regarding their compliance with labor security laws. If an employing unit has a major act violating labor security laws, regulations or rules, the relevant labor security administrative department shall make it public to the society.

用人单位有下列行为之一的，由劳动保障行政部门责令改正，按照受侵害的劳动者每人1000元以上5000元以下的标准计算，处以罚款：

If an employing unit commits any of the following acts, the labor security administrative department shall order it to make corrections and impose a fine calculated at the rate of not less than 1,000 yuan but not more than 5,000 yuan per affected worker:

(一)安排女职工从事矿山井下劳动、国家规定的第四级体力劳动强度的劳动或者其他禁忌从事的劳动的；

(1) Assigning female workers to engage in labor in underground mines, labor of the fourth level of physical intensity as stipulated by the state, or other labor prohibited for them;

(二)安排女职工在经期从事高处、低温、冷水作业或者国家规定的第三级体力劳动强度的劳动的；

(2) Assigning female workers during their menstrual period to engage in work at heights, in low temperatures, in cold water, or labor of the third level of physical intensity as stipulated by the state;

(三)安排女职工在怀孕期间从事国家规定的第三级体力劳动强度的劳动或者孕期禁忌从事的劳动的；

(3) Assigning female workers during pregnancy to engage in labor of the third level of physical intensity as stipulated by the state, or other labor prohibited during pregnancy;

(四)安排怀孕7个月以上的女职工夜班劳动或者延长其工作时间的；

(4) Assigning female workers who are seven or more months pregnant to work night shifts or extending their working hours;

(五)女职工生育享受产假少于90天的；

(5) Granting female workers maternity leave of less than 90 days;

(六)安排女职工在哺乳未满1周岁的婴儿期间从事国家规定的第三级体力劳动强度的劳动或者哺乳期禁忌从事的其他劳动，以及延长其工作时间或者安排其夜班劳动的；

(6) Assigning female workers who are nursing a baby under one year old to engage in labor of the third level of physical intensity as stipulated by the state, or other labor prohibited during the nursing period, or extending their working hours or assigning them to night shifts;

(七)安排未成年工从事矿山井下、有毒有害、国家规定的第四级体力劳动强度的劳动或者其他禁忌从事的劳动的；

(7) Assigning underage workers to engage in labor in underground mines, toxic or hazardous work, labor of the fourth level of physical intensity as stipulated by the state, or other labor prohibited for them;

(八)未对未成年工定期进行健康检查的。

(8) Failing to conduct regular health examinations for underage workers.

用人单位与劳动者建立劳动关系不依法订立劳动合同的，由劳动保障行政部门责令改正。

If an employing unit fails to conclude a labor contract according to law when establishing a labor relationship with a worker, the labor security administrative department shall order it to make corrections.

用人单位违反劳动保障法律、法规或者规章延长劳动者工作时间的，由劳动保障行政部门给予警告，责令限期改正，并可以按照受侵害的劳动者每人100元以上500元以下的标准计算，处以罚款。

If an employing unit violates labor security laws, regulations or rules by extending the working hours of workers, the labor security administrative department shall give a warning, order it to make corrections within a specified period, and may impose a fine calculated at the rate of not less than 100 yuan but not more than 500 yuan per affected worker.

用人单位有下列行为之一的，由劳动保障行政部门分别责令限期支付劳动者的工资报酬、劳动者工资低于当地最低工资标准的差额或者解除劳动合同的经济补偿；逾期不支付的，责令用人单位按照应付金额50%以上1倍以下的标准计算，向劳动者加付赔偿金：

If an employing unit commits any of the following acts, the labor security administrative department shall order it to pay the worker's wage remuneration, the difference between the worker's wage and the local minimum wage standard, or the economic compensation for termination of the labor contract within a specified period; if it fails to pay within the specified period, the employing unit shall be ordered to pay additional compensation to the worker calculated at a rate of not less than 50% but not more than 100% of the amount payable:

(一)克扣或者无故拖欠劳动者工资报酬的；

(1) Withholding or defaulting on the worker's wage remuneration without reason;

(二)支付劳动者的工资低于当地最低工资标准的；

(2) Paying the worker's wage below the local minimum wage standard;

(三)解除劳动合同未依法给予劳动者经济补偿的。

(3) Failing to provide economic compensation to the worker according to law upon termination of the labor contract.

用人单位向社会保险经办机构申报应缴纳的社会保险费数额时，瞒报工资总额或者职工人数的，由劳动保障行政部门责令改正，并处瞒报工资数额1倍以上3倍以下的罚款。

If an employing unit, when declaring the amount of social insurance premiums payable to the social insurance agency, conceals the total wage amount or the number of employees, the labor security administrative department shall order it to make corrections and impose a fine of not less than one time but not more than three times the concealed wage amount.

骗取社会保险待遇或者骗取社会保险基金支出的，由劳动保障行政部门责令退还，并处骗取金额1倍以上3倍以下的罚款；构成犯罪的，依法追究刑事责任。

If anyone fraudulently obtains social insurance benefits or social insurance fund expenditures, the labor security administrative department shall order the return of the amount and impose a fine of not less than one time but not more than three times the fraudulently obtained amount; if a crime is constituted, criminal liability shall be pursued according to law.

职业介绍机构、职业技能培训机构或者职业技能考核鉴定机构违反国家有关职业介绍、职业技能培训或者职业技能考核鉴定的规定的，由劳动保障行政部门责令改正，没收违法所得，并处1万元以上5万元以下的罚款；情节严重的，吊销许可证。

If a job placement agency, vocational skills training institution, or vocational skills assessment and certification institution violates the state provisions on job placement, vocational skills training, or vocational skills assessment and certification, the labor security administrative department shall order it to make corrections, confiscate the illegal gains, and impose a fine of not less than 10,000 yuan but not more than 50,000 yuan; if the circumstances are serious, the license shall be revoked.

未经劳动保障行政部门许可，从事职业介绍、职业技能培训或者职业技能考核鉴定的组织或者个人，由劳动保障行政部门、工商行政管理部门依照国家有关无照经营查处取缔的规定查处取缔。

If an organization or individual engages in job placement, vocational skills training, or vocational skills assessment and certification without a license from the labor security administrative department, the labor security administrative department and the administrative department for industry and commerce shall investigate and ban it in accordance with the state provisions on investigating and banning unlicensed operations.

用人单位违反《中华人民共和国工会法》，有下列行为之一的，由劳动保障行政部门责令改正：

If an employing unit violates the Trade Union Law of the People's Republic of China by committing any of the following acts, the labor security administrative department shall order it to make corrections:

(一)阻挠劳动者依法参加和组织工会，或者阻挠上级工会帮助、指导劳动者筹建工会的；

(1) Obstructing workers from joining or organizing a trade union according to law, or obstructing a higher-level trade union from helping or guiding workers in establishing a trade union;

(二)无正当理由调动依法履行职责的工会工作人员的工作岗位，进行打击报复的；

(2) Without justifiable reasons, transferring a trade union staff member who is performing duties according to law to another position, or retaliating against such staff member;

(三)劳动者因参加工会活动而被解除劳动合同的；

(3) Terminating a worker's labor contract because the worker participated in trade union activities;

(四)工会工作人员因依法履行职责被解除劳动合同的。

(4) Terminating a trade union staff member's labor contract because the staff member performed duties according to law.

有下列行为之一的，由劳动保障行政部门责令改正；对有第(一)项、第(二)项或者第(三)项规定的行为的，处2000元以上2万元以下的罚款：

If any of the following acts is committed, the labor security administrative department shall order it to make corrections; for acts specified in items (1), (2) or (3), a fine of not less than 2,000 yuan but not more than 20,000 yuan shall be imposed:

(一)无理抗拒、阻挠劳动保障行政部门依照本条例的规定实施劳动保障监察的；

(1) Unreasonably refusing or obstructing a labor security administrative department from carrying out labor security inspections in accordance with these Regulations;

(二)不按照劳动保障行政部门的要求报送书面材料，隐瞒事实真相，出具伪证或者隐匿、毁灭证据的；

(2) Failing to submit written materials as required by the labor security administrative department, concealing the truth, producing false evidence, or concealing or destroying evidence;

(三)经劳动保障行政部门责令改正拒不改正，或者拒不履行劳动保障行政部门的行政处理决定的；

(3) Refusing to make corrections after being ordered to do so by the labor security administrative department, or refusing to comply with an administrative disposition decision of the labor security administrative department;

(四)打击报复举报人、投诉人的。

(4) Retaliating against whistleblowers or complainants.

违反前款规定，构成违反治安管理行为的，由公安机关依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。

If an act violating the preceding paragraph constitutes a violation of public security administration, the public security authority shall impose a public security administrative penalty according to law; if a crime is constituted, criminal liability shall be pursued according to law.

劳动保障监察员滥用职权、玩忽职守、徇私舞弊或者泄露在履行职责过程中知悉的商业秘密的，依法给予行政处分；构成犯罪的，依法追究刑事责任。

If a labor security inspector abuses his power, neglects his duty, engages in malpractice for personal gain, or discloses business secrets learned in the course of performing his duties, he shall be given an administrative sanction according to law; if a crime is constituted, criminal liability shall be pursued according to law.

劳动保障行政部门和劳动保障监察员违法行使职权，侵犯用人单位或者劳动者的合法权益的，依法承担赔偿责任。

If a labor security administrative department or a labor security inspector exercises its powers illegally and infringes upon the legitimate rights and interests of an employing unit or a worker, it shall bear compensation liability according to law.

属于本条例规定的劳动保障监察事项，法律、其他行政法规对处罚另有规定的，从其规定。

If laws or other administrative regulations provide otherwise for penalties concerning matters subject to labor security inspection as specified in these Regulations, those provisions shall prevail.

对无营业执照或者已被依法吊销营业执照，有劳动用工行为的，由劳动保障行政部门依照本条例实施劳动保障监察，并及时通报工商行政管理部门予以查处取缔。

For entities without a business license or whose business license has been revoked, but which engage in labor employment activities, the labor security administrative department shall carry out labor security inspections in accordance with these Regulations and promptly notify the administrative department for industry and commerce to investigate and ban them.

国家机关、事业单位、社会团体执行劳动保障法律、法规和规章的情况，由劳动保障行政部门根据其职责，依照本条例实施劳动保障监察。

The compliance of state organs, institutions, and social organizations with labor security laws, regulations and rules shall be subject to labor security inspections by the labor security administrative department in accordance with its functions and duties and these Regulations.

劳动安全卫生的监督检查，由卫生部门、安全生产监督管理部门、特种设备安全监督管理部门等有关部门依照有关法律、行政法规的规定执行。

Supervision and inspection of labor safety and health shall be carried out by the health department, the work safety supervision and management department, the special equipment safety supervision and management department, and other relevant departments in accordance with relevant laws and administrative regulations.

本条例自2004年12月1日起施行。

These Regulations shall come into force as of December 1, 2004.
