Kindergarten Management Regulations

幼儿园管理条例

This regulation governs the establishment, management, and operation of kindergartens in China, covering children aged three and above.

Local people's governments at all levels may establish kindergartens in accordance with these Regulations, and shall encourage and support enterprises, institutions, social organizations, residents' committees, villagers' committees, and individual citizens to establish kindergartens or donate funds to support kindergartens.

Kindergartens shall have care, education, medical, and other staff who meet the following conditions:

Kindergartens shall establish safety protection systems, strictly prohibit the installation of dangerous buildings or facilities that threaten children's safety within the kindergarten, and strictly prohibit the use of toxic or harmful materials to make teaching aids or toys.

幼儿园发生食物中毒、传染病流行时,举办幼儿园的单位或者个人应当立即采取紧急救护措施,并及时报告当地教育行政部门或卫生行政部门。

When food poisoning or an infectious disease outbreak occurs in a kindergarten, the unit or individual that established the kindergarten shall immediately take emergency rescue measures and promptly report to the local education administrative department or health administrative department.

Education administrative departments at all levels shall be responsible for supervising, evaluating, and guiding kindergarten care and education work, organizing the training of kindergarten teachers, examining and certifying kindergarten teacher qualifications, assisting health administrative departments in inspecting and guiding kindergarten health care work, and jointly with construction administrative departments in formulating standards for kindergarten buildings and facilities.

Kindergartens may charge childcare and education fees from children's parents in accordance with the fee standards formulated by the people's government of the province, autonomous region, or municipality directly under the central government.

任何单位和个人,不得侵占和破坏幼儿园园舍和设施,不得在幼儿园周围设置有危险、有污染或影响幼儿园采光的建筑和设施,不得干扰幼儿园正常的工作秩序。

No unit or individual may occupy or damage kindergarten buildings and facilities, may not set up buildings or facilities that are dangerous, polluting, or affect kindergarten lighting around the kindergarten, and may not interfere with the normal work order of the kindergarten.

凡具备下列条件之一的单位或者个人,由教育行政部门和有关部门予以奖励:

违反本条例,具有下列情形之一的幼儿园,由教育行政部门视情节轻重,给予限期整顿、停止招生、停止办园的行政处罚:

In violation of these Regulations, a kindergarten with any of the following circumstances shall be subject to administrative penalties by the education administrative department, depending on the severity of the circumstances, including a deadline for rectification, suspension of enrollment, or closure of the kindergarten:

违反本条例,具有下列情形之一的单位或者个人,由教育行政部门对直接责任人员给予警告、罚款的行政处罚,或者由教育行政部门建议有关部门对责任人员给予行政处分:

In violation of these Regulations, any unit or individual with any of the following circumstances shall be subject to administrative penalties by the education administrative department, including a warning or fine imposed on the directly responsible person, or the education administrative department shall recommend that the relevant department impose administrative sanctions on the responsible person:

前款所列情形,情节严重,构成犯罪的,由司法机关依法追究刑事责任。

If the circumstances listed in the preceding paragraph are serious and constitute a crime, the judicial authorities shall pursue criminal liability according to law.

当事人对行政处罚不服的,可以在接到处罚通知之日起十五日内,向作出处罚决定的机关的上一级机关申请复议,对复议决定不服的,可在接到复议决定之日起十五日内,向人民法院提起诉讼。当事人逾期不申请复议或者不向人民法院提起诉讼又不履行处罚决定的,由作出处罚决定的机关申请人民法院强制执行。

If a party is dissatisfied with an administrative penalty, they may apply for reconsideration to the authority at the next higher level within 15 days of receiving the penalty notice. If dissatisfied with the reconsideration decision, they may file a lawsuit with the People's Court within 15 days of receiving the reconsideration decision. If the party neither applies for reconsideration nor files a lawsuit within the time limit, nor complies with the penalty decision, the authority that made the penalty decision shall apply to the People's Court for enforcement.
