为加强社会治安，保障印铸刻字业的合法经营，防范不法分子伪造假冒，特制定本规则。
These Rules are formulated to strengthen public security, ensure the lawful operation of the printing and seal-engraving industry, and prevent criminals from forging and counterfeiting.
凡经营铸造厂、制版社(制造钢印、铜版、胶版、石印版、珂罗版、火印、锌印、证明牌号等)、印刷局(以机械或化学材料印刷簿册、证券、商标等)、证章店、刻字店、刻字摊(雕刻戳记、印版、印章、胶皮印等)及所有上属性质之营业者，不论专营、兼营、公营、私营，(国家机关专用不以营业为目的者例外)或属何国籍，除法令另有规定者外，均依本规则管理之。
Any person operating a foundry, plate-making company (manufacturing steel seals, copper plates, offset plates, lithographic plates, collotype plates, branding irons, zinc plates, certification badges, etc.), printing house (printing books, securities, trademarks, etc. by mechanical or chemical means), badge shop, seal-engraving shop, seal-engraving stall (engraving stamps, printing plates, seals, rubber stamps, etc.), and all businesses of the above nature, whether specialized or concurrent, publicly or privately operated (except those exclusively used by state organs and not for profit), or of any nationality, unless otherwise provided by law, shall be governed by these Rules.
公章刻制经营者取得市场监管部门核发的营业执照后，应当在5日内将以下信息材料向所在地县级人民政府公安机关备案：
After obtaining a business license from the market supervision department, an official seal engraving operator shall, within 5 days, file the following information and materials with the public security organ of the local county-level people's government for recordation:
(一)营业执照复印件；
(1) A copy of the business license;
(二)法定代表人、经营负责人及从业人员有效身份证件复印件；
(2) Copies of valid identity documents of the legal representative, the person in charge of operations, and the employees;
(三)标注安全防范设施的经营场所内部结构平面图；
(3) A floor plan of the business premises marked with security facilities;
(四)公章刻制和信息备案设备清单；
(4) A list of equipment for official seal engraving and information recordation;
(五)内部管理制度和安全制度。
(5) Internal management systems and security systems.
公安机关能够通过部门间信息共享获得的备案信息，不要求当事人提供。
If the public security organ can obtain the recordation information through inter-departmental information sharing, the party concerned shall not be required to provide it.
公章刻制经营者上述备案信息发生变化的，应当自有关变化发生之日起15日内向原备案公安机关更新备案信息。
If the above recordation information of an official seal engraving operator changes, the operator shall update the recordation information with the original public security organ within 15 days from the date of the change.
公章刻制经营者终止公章刻制业务的，应当及时向公安机关办理备案注销。
If an official seal engraving operator terminates its official seal engraving business, it shall promptly apply to the public security organ for cancellation of the recordation.
凡在本规则颁布前，已开业之印铸刻字业，均须补办第三条规定之手续。
Any printing and seal-engraving business that was already in operation before the promulgation of these Rules shall go through the procedures specified in Article 3 retroactively.
凡经营印铸刻字业者，均须遵守下列事项：
Any person operating a printing or seal-engraving business shall comply with the following:
(一)公章刻制经营者应当核验刻制公章的证明材料，采集用章单位、公章刻制申请人的基本信息，并应当在刻制公章后1日内，将用章单位、公章刻制申请人等基本信息及印模、刻制公章的证明材料报所在地县级人民政府公安机关备案。
(1) An official seal engraving operator shall verify the supporting materials for engraving the official seal, collect the basic information of the seal-using entity and the applicant for seal engraving, and shall, within 1 day after engraving the official seal, report the basic information of the seal-using entity and the applicant, the seal impression, and the supporting materials for engraving the official seal to the public security organ of the local county-level people's government for recordation.
(二)凡经营印铸刻字业者，均需备制营业登记簿，以备查验。属本条第一项规定之各印制品，承制者一律不准留样，不准仿制，或私自翻印。
(2) Any person operating a printing or seal-engraving business shall prepare a business registration book for inspection. For the printed products specified in item (1) of this Article, the contractor shall not retain samples, imitate, or privately reprint them.
(三)遇有下列情形之一者，须迅速报告当地人民公安机关：
(3) In any of the following circumstances, the operator shall promptly report to the local people's public security organ:
1．伪造或仿造布告、护照、委任状、袖章、符号、胸章、证券及各机关之文件等。
1. Forging or imitating notices, passports, letters of appointment, armbands, insignia, chest badges, securities, and documents of various organs, etc.
2．私自定制各机关、团体、学校、公营企业之钢印、火印、徽章、证明、号牌或仿制者。
2. Privately ordering or imitating steel seals, branding irons, badges, certifications, or license plates of various organs, organizations, schools, or state-owned enterprises.
3．遇有定制非法之团体、机关戳记、印件、徽章或仿制者。
3. Ordering or imitating stamps, printed matter, or badges of illegal organizations or organs.
4．印制反对人民民主、生产建设及宣传封建等各种反动印刷品者。
4. Printing various reactionary printed materials opposing the people's democracy and production construction, or promoting feudalism.
(四)凡印刷铸刻本条第三项所规定之各项物品者，除没收其原料及成品外，得按照情节之轻重，予以惩处。
(4) For printing or engraving any of the items specified in item (3) of this Article, in addition to confiscating the raw materials and finished products, penalties shall be imposed according to the severity of the circumstances.
(五)对人民公安机关之执行检查职务人员，应予协助进行。
(5) Assistance shall be provided to personnel of the people's public security organs performing inspection duties.
公安机关可以通过网络等方式，便利公章刻制经营者备案，并应当向备案的公章刻制经营者免费提供或者协助其安装公章刻制信息备案系统软件。
Public security organs may facilitate the recordation of official seal engraving operators through the internet or other means, and shall provide free of charge or assist in installing official seal engraving information recordation system software to the recordation-applying official seal engraving operators.
违反本规则第三条第一款、第三款规定的，由公安机关责令限期改正，予以警告；逾期不改正的，对公章刻制经营者处3000元以上3万元以下罚款。公章刻制经营者备案时提供虚假信息的，由公安机关责令限期改正，并处5000元以上1万元以下罚款；逾期不改正的，处1万元以上5万元以下罚款。
Any violation of Article 3, paragraph 1 or paragraph 3 of these Rules shall be ordered by the public security organ to make corrections within a specified period and a warning shall be given; if no correction is made within the time limit, the official seal engraving operator shall be fined not less than 3,000 yuan but not more than 30,000 yuan. If an official seal engraving operator provides false information during recordation, the public security organ shall order corrections within a specified period and impose a fine of not less than 5,000 yuan but not more than 10,000 yuan; if no correction is made within the time limit, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed.
违反本规则第五条第一项规定的，由公安机关责令限期改正，予以警告；逾期不改正的，责令停业整顿1个月至3个月，对公章刻制经营者并处5000元以上5万元以下罚款，对直接负责的主管人员和其他直接责任人员处500元以上5000元以下罚款；情节较重的，由市场监管部门吊销营业执照。
Whoever violates the provisions of Article 5, paragraph 1 of these Rules shall be ordered by the public security organ to make corrections within a specified period and given a warning; if no correction is made within the time limit, the business shall be ordered to suspend operations for rectification for a period of 1 to 3 months, and the seal engraving operator shall be concurrently fined not less than 5,000 yuan but not more than 50,000 yuan, and the directly responsible person in charge and other directly responsible persons shall be fined not less than 500 yuan but not more than 5,000 yuan; if the circumstances are serious, the business license shall be revoked by the market supervision department.
凡遵照本规则各条规定进行报告、检举，因而查获重大罪犯、破获重大案件者，由公安局酌情予以名誉或物质奖励。
Whoever reports or informs in accordance with the provisions of these Rules, thereby leading to the capture of major criminals or the solving of major cases, shall be given honorary or material rewards by the public security bureau as appropriate.
省级以上人民公安机关，得依据本规则之精神，制定补充办法；县(市)级人民公安机关如有制定补充办法之必要时，须经省级人民公安机关批准。
People's public security organs at or above the provincial level may formulate supplementary measures based on the spirit of these Rules; if a people's public security organ at the county (city) level finds it necessary to formulate supplementary measures, it must obtain approval from the provincial-level people's public security organ.
本规则经中央人民政府政务院政治法律委员会批准，由中央人民政府公安部发布施行。
These Rules are approved by the Political and Legal Committee of the Government Administration Council of the Central People's Government and are promulgated and implemented by the Ministry of Public Security of the Central People's Government.
