外币票据暂行处理办法
Foreign Currency Instruments Enclosed in Mail

为严格执行外汇管理，防止利用国内或国际邮件夹带外币或外币票据互相转让流通及私营外汇等情事，特制定本办法。
These Measures are formulated to strictly implement foreign exchange control and prevent the use of domestic or international mail to enclose foreign currency or foreign currency instruments for mutual transfer, circulation, and private foreign exchange transactions.
本办法所称外币系指一切外国币券，所称外币票据系指各种以外币支付之汇票、支票、旅行支票、期票及其他付款凭证等。
The term "foreign currency" as used in these Measures refers to all foreign currency notes and coins; the term "foreign currency instruments" refers to various payment instruments denominated in foreign currency, such as drafts, checks, traveler's checks, promissory notes, and other payment vouchers.
本办法所指邮件之查检工作，应由各地海关或公安机关执行之；其查获外币及外币票据之存兑事宜，由中国人民银行总行授权各地中国银行办理之，无中国银行机构设立之地区则由人民银行办理之。
The inspection of mail as referred to in these Measures shall be carried out by local customs or public security organs; the deposit and exchange of seized foreign currency and foreign currency instruments shall be handled by the Bank of China authorized by the head office of the People's Bank of China, or by the People's Bank of China in areas where no Bank of China branch is established.
在本国境内互寄或寄往国外之邮件中，如夹带外币一经查获，应报由司法机关一律全部没收之。
If foreign currency is found enclosed in mail sent within the territory of China or to foreign countries, it shall be reported to the judicial authorities and shall be fully confiscated.
在本国境内互寄或寄往国外之邮件中，如夹带外币票据一经查获，应由主管检查机关视其情节轻重，报由司法机关令其存兑，处以罚金或予以没收。
If foreign currency instruments are found enclosed in mail sent within the territory of China or to foreign countries, the competent inspection authorities shall, depending on the severity of the case, report to the judicial authorities to order the deposit and exchange, impose a fine, or confiscate the instruments.
由国外寄至国内邮件中，如夹带外币或外币票据，一经发现，可由各该邮局暂时代为保管，俟与收件人联系后，持向中国银行换取外汇存单或按牌价兑换人民币，予以发还。
If foreign currency or foreign currency instruments are found enclosed in mail sent from abroad to within the country, upon discovery, the respective post office may temporarily hold them in custody. After contacting the recipient, the recipient may present them to the Bank of China to obtain foreign exchange deposit certificates or exchange them for Renminbi at the listed rate, and the items shall be returned.
经主管检查机关查获应予没收之外币或外币票据，应交由各相关邮局，随时解送所在地之中国银行或人民银行，按牌价折合人民币，由中行或人行签发国库局抬头支票，由各该邮局送交当地国库换取收据，再由邮局将收据备函寄交寄件人(无中行或人行设立之地区，可由各相关邮局解送附近设有中行或人行地区之邮局代办解库手续，俟取得国库收据后，仍交由各相关邮局处理之)。
Foreign currency or foreign currency instruments that should be confiscated as discovered by the competent inspection authorities shall be handed over to the respective post offices, which shall promptly remit them to the local Bank of China or People's Bank of China. They shall be converted into Renminbi at the listed rate, and the Bank of China or People's Bank of China shall issue a check payable to the National Treasury Bureau. The post office shall deliver the check to the local treasury to obtain a receipt, and then the post office shall send the receipt by letter to the sender. (In areas without a Bank of China or People's Bank of China, the respective post office may remit the items to a post office in a nearby area that has a Bank of China or People's Bank of China to handle the treasury procedures on its behalf. After obtaining the treasury receipt, it shall still be handled by the respective post office.)
所有经主管检查机关查获应予没收外币或外币票据之相关邮件，应由各该邮局于邮件内加盖“内装外 币外币票据 已被主管机关查扣”戳记后，随时封发或投递，不得稽延积压，并由各该邮局通知寄件人。
For all mail containing foreign currency or foreign currency instruments that should be confiscated as discovered by the competent inspection authorities, the respective post office shall stamp the mail with a seal reading "Contains foreign currency/foreign currency instruments, has been seized by competent authorities" and then promptly dispatch or deliver the mail without delay or backlog, and the respective post office shall notify the sender.
凡中国银行或国内经人民银行指定经营外汇业务之银行，基于正当外汇业务所开国外付款之票据，或国外银行所开国内中国银行及指定银行之票据，可不受本办法第五条及第六条条文之限制。
Any instruments payable abroad issued by the Bank of China or domestic banks designated by the People's Bank of China to handle foreign exchange business based on legitimate foreign exchange transactions, or instruments issued by foreign banks payable to the Bank of China or designated banks within China, shall not be subject to the restrictions of Articles 5 and 6 of these Measures.
凡查获应予没收之外币票据属于抬头人性质者，应由主管检查机关移送司法机关，勒令寄件人签妥空白背书或重开支票之手续。
If the foreign currency instruments that should be confiscated as discovered are of a bearer nature, the competent inspection authorities shall transfer the case to the judicial authorities and compel the sender to sign a blank endorsement or go through the procedures for reissuing the check.
凡无中国银行或人民银行机构设立之边远或乡村地区，其持有外币或外币票据拟寄递至附近地区中国银行或人民银行存兑者，经当地区级以上政府证明后，可不受本办法第四条及第五条条文之限制。
In remote or rural areas where there is no Bank of China or People's Bank of China institution, if a person holding foreign currency or foreign currency instruments intends to send them to a nearby Bank of China or People's Bank of China for deposit or exchange, upon certification by the district-level or higher government, the restrictions of Articles 4 and 5 of these Measures shall not apply.
本办法自发布之日起实行。
These Measures shall come into effect on the date of promulgation.
