Implementation Measures of the State Council on the National Voluntary Tree-Planting Campaign

为了切实贯彻执行第五届全国人民代表大会第四次会议《关于开展全民义务植树运动的决议》，特制定如下实施办法。
In order to effectively implement the "Resolution on Launching a National Voluntary Tree-Planting Campaign" adopted at the Fourth Session of the Fifth National People's Congress, the following implementation measures are hereby formulated.
一、县以上各级人民政府均应成立绿化委员会，统一领导本地区的义务植树运动和整个造林绿化工作。各级绿化委员会由当地政府的主要领导同志，以及有关部门和人民团体的负责同志组成。委员会的办公室设在同级政府的主管部门，不另增加编制。
I. People's governments at or above the county level shall establish a Greening Committee to uniformly lead the voluntary tree-planting campaign and overall afforestation and greening work in their respective regions. The Greening Committee at each level shall be composed of the main leaders of the local government and responsible persons from relevant departments and people's organizations. The office of the committee shall be set up in the competent department of the government at the same level, without additional staffing.
个别地方，由于气候、土地等条件限制确实难以开展植树运动的，经省、自治区、直辖市绿化委员会批准，可以不开展全民义务植树运动，不成立绿化委员会。
In individual localities where it is truly difficult to carry out the tree-planting campaign due to climatic, land, or other constraints, the provincial, autonomous region, or municipality directly under the Central Government Greening Committee may approve the non-implementation of the national voluntary tree-planting campaign and the non-establishment of a Greening Committee.
二、各级绿化委员会应当组织和推动本地区各部门、各单位，通过各种形式，广泛深入地宣传《关于开展全民义务植树运动的决议》和本实施办法，宣传全民植树、绿化祖国的重大意义，认真做好思想动员，提高认识，造成声势，做到家喻户晓，人人皆知。同时，要努力做好调查研究、规划安排、苗木培育、技术训练等准备工作，有计划有步骤地开展植树运动，要扎扎实实，讲求实效，不搞形式主义和“一刀切”。
II. Greening committees at all levels shall organize and promote various forms of extensive and in-depth publicity of the "Resolution on Launching a National Voluntary Tree-Planting Campaign" and these Implementation Measures, publicize the great significance of nationwide tree planting and greening the motherland, earnestly conduct ideological mobilization, raise awareness, create momentum, and ensure that the campaign is known to every household and every individual. At the same time, efforts shall be made to conduct thorough research and investigation, planning and arrangement, seedling cultivation, technical training, and other preparatory work, and to carry out the tree-planting campaign in a planned and step-by-step manner, ensuring solid and practical results, avoiding formalism and a "one-size-fits-all" approach.
三、凡是中华人民共和国公民，男十一岁至六十岁，女十一岁至五十五岁，除丧失劳动能力者外，均应承担义务植树任务，各单位要将人数据实统计上报当地绿化委员会，作为分配具体任务的依据。
III. All citizens of the People's Republic of China, males aged 11 to 60 and females aged 11 to 55, except those who have lost the ability to work, shall undertake the task of voluntary tree planting. Each unit shall accurately count and report the number of such persons to the local Greening Committee as the basis for assigning specific tasks.
县级绿化委员会在分配义务植树任务时，要按照每人每年植树三至五棵的要求，确定具体指标，因地制宜地进行灵活多样的安排。可以按单位划分责任地段，承担整地、育苗、栽植和管护任务；也可以按相应劳动量，分配承担造林绿化的某一单项和几个单项的任务。此项任务，可以一年一定，也可以一定几年。
When assigning voluntary tree-planting tasks, the county-level Greening Committee shall determine specific targets in accordance with the requirement of planting three to five trees per person per year, and make flexible and diverse arrangements according to local conditions. Tasks may be assigned by dividing responsibility areas among units for land preparation, seedling cultivation, planting, and tending; or, based on equivalent labor, tasks may be assigned for one or several individual items of afforestation and greening. Such tasks may be determined annually or for a fixed number of years.
对十一岁至十七岁的青少年，应当根据他们的实际情况，就近安排力所能及的劳动。
For adolescents aged 11 to 17, labor that is within their capabilities shall be arranged nearby according to their actual conditions.
四、此项义务劳动，限于用在本县、本市所辖范围，营造国有林和集体林。义务植树的地段或参加绿化劳动的项目，各地要经过周密的调查研究，作出统一规划和安排。城市要优先搞好风景游览区、名胜古迹和主要街道等公共场所的绿化。农村要尽快搞好“四旁”绿化和农田防护林建设。机关、团体、企业、学校等单位和居民区，都要大力植树、种草、栽花，美化环境。
IV. This voluntary labor shall be limited to the scope of the county or city where the unit is located, for the purpose of establishing state-owned forests and collective forests. The locations for voluntary tree planting or the projects for participating in greening labor shall be subject to thorough investigation and research, and unified planning and arrangement by each locality. Cities shall prioritize the greening of scenic spots, places of historic interest and scenic beauty, main streets, and other public places. Rural areas shall promptly improve the greening of "four sides" (around houses, villages, roads, and water bodies) and the construction of farmland shelterbelts. All organs, organizations, enterprises, schools, and other units, as well as residential areas, shall vigorously plant trees, grass, and flowers to beautify the environment.
五、使用义务劳动，在国有土地上栽植的树木，林权归现在经营管理这些土地的单位所有；没有明确经营管理单位的，由当地政府指定的部门、单位所有。在集体土地上义务栽植的树木，林权归集体单位所有。如果情况特殊，另有协议或合同，按协议或合同的规定办理。对林权所有单位，县以上人民政府要发给证书，切实保障其合法权益。
V. For trees planted with voluntary labor on state-owned land, the forest ownership shall belong to the unit that currently manages and operates the land; if there is no clearly defined management and operation unit, it shall belong to the department or unit designated by the local government. For trees planted voluntarily on collective land, the forest ownership shall belong to the collective unit. If there are special circumstances and separate agreements or contracts exist, the provisions of the agreements or contracts shall prevail. For the unit owning the forest rights, the people's government at or above the county level shall issue a certificate to effectively protect its legitimate rights and interests.
六、为确保义务植树所需苗木，各地应当努力办好现有的国营苗圃和集体苗圃，并安排必需数量的土地和专业人员，扩建和新建苗木基地，培育良种壮苗。凡是有条件的单位，都要积极自办苗圃。提倡城镇家庭和农村社员开展营养钵育苗。
VI. To ensure the seedlings needed for voluntary tree planting, all localities shall strive to run existing state-owned and collective nurseries well, allocate the necessary amount of land and professional personnel, expand and build new seedling bases, and cultivate improved varieties and strong seedlings. All units with the conditions shall actively establish their own nurseries. Urban households and rural commune members are encouraged to carry out nutrient-bowl seedling cultivation.
七、对义务栽植的树木和现有的林木，必须大力加强培育管护，确保成活成林，不受破坏。林木所有的单位或承担管护义务的单位，应当根据情况组织林场、专业队或确定专人负责管护。要严肃法制和纪律，建立爱林护林的乡规民约。采伐更新，必须按照森林法的规定，经过林业或园林部门批准。城市绿地要严加保护，不得侵占破坏。违者要给予经济处罚或法律制裁。
VII. For trees planted voluntarily and existing forests, cultivation, tending, and protection must be vigorously strengthened to ensure survival and growth, and to prevent damage. The unit owning the forest rights or the unit undertaking the tending and protection obligations shall, according to the circumstances, organize forest farms, professional teams, or designate specific personnel to be responsible for tending and protection. The legal system and discipline shall be strictly enforced, and village rules and civil agreements for loving and protecting forests shall be established. Felling and regeneration must be approved by the forestry or garden department in accordance with the provisions of the Forest Law. Urban green spaces shall be strictly protected and shall not be encroached upon or damaged. Violators shall be subject to economic penalties or legal sanctions.
八、植树绿化，要讲究科学，注重实效。要培训技术骨干，加强技术指导，普及植树绿化的技术知识，严格按照技术规程办事，保证质量。
VIII. Tree planting and greening shall be scientific and focus on practical results. Technical backbone personnel shall be trained, technical guidance shall be strengthened, technical knowledge of tree planting and greening shall be popularized, and operations shall be strictly carried out in accordance with technical procedures to ensure quality.
九、对义务植树，各单位每年都要进行检查，并将完成情况据实上报。绿化委员会应当定期组织评比，成绩优异的，要给予表扬和奖励；年满十八岁的成年公民无故不履行此项义务的，所在单位要进行批评教育，责令限期补栽，或者给予经济处罚。整个单位没有完成任务的，要追究领导责任，并由当地绿化委员会收缴一定数额的绿化费。
IX. For voluntary tree planting, each unit shall conduct inspections annually and report the completion status truthfully. The Greening Committee shall organize regular evaluations; those with outstanding achievements shall be commended and rewarded. Adult citizens aged 18 or above who fail to fulfill this obligation without justifiable reasons shall be criticized and educated by their unit, ordered to make up for the planting within a time limit, or subject to economic penalties. If an entire unit fails to complete the task, the leadership shall be held accountable, and the local Greening Committee shall collect a certain amount of greening fees.
十、各级林业和园林部门，应当在绿化委员会领导下，会同有关部门，努力搞好规划设计和苗木培育等各项具体工作。基层机构不健全的，应当充实和加强。
X. Forestry and garden departments at all levels shall, under the leadership of the Greening Committee, work with relevant departments to diligently carry out various specific tasks such as planning and design, seedling cultivation, etc. Where grassroots institutions are not well-established, they shall be strengthened and reinforced.
十一、义务植树所需的苗木费、管护费，应当根据自力更生勤俭节约的原则，一般由林权所有单位负责解决。有的单位因绿化任务大，资金困难，确实无力承担全部费用的，按单位隶属关系，由各级财政酌情解决。参加义务植树的单位和个人所需交通等费用，由参加单位自理。
XI. The costs of seedlings and tending required for voluntary tree planting shall, in accordance with the principle of self-reliance, thrift, and economy, generally be borne by the unit owning the forest rights. If a unit has a large greening task and financial difficulties and is truly unable to bear all the costs, the matter shall be resolved by the financial authorities at various levels according to the unit's affiliation. Transportation and other expenses incurred by units and individuals participating in voluntary tree planting shall be borne by the participating units themselves.
十二、开展全民义务植树运动是促进整个造林绿化的一个重大措施。各地在开展此项运动时，必须同加快整个造林绿化工作结合起来，在苗木、经费、技术力量的使用和林木管护等方面进行统筹安排，既要搞好义务植树，又要完成年度造林绿化计划。对于一个地方来说，完成了义务植树任务，但整个造林绿化工作没有做好，不能给予表扬和奖励。
XII. Launching a national voluntary tree-planting campaign is a major measure to promote overall afforestation and greening. When carrying out this campaign, all localities must combine it with accelerating the overall afforestation and greening work, and make overall arrangements for the use of seedlings, funds, technical personnel, and forest management and protection. Both voluntary tree planting and the annual afforestation and greening plan must be completed. If a locality completes the voluntary tree-planting task but fails to do well in the overall afforestation and greening work, it shall not be commended or rewarded.
十三、根据《关于开展全民义务植树运动的决议》和本实施办法的规定，各省、自治区、直辖市人民政府可以结合实际情况，制定实施细则。
XIII. In accordance with the provisions of the "Resolution on Launching a National Voluntary Tree-Planting Campaign" and these Implementation Measures, the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may formulate detailed implementation rules based on actual conditions.
人民解放军指战员参加营区外义务植树的办法，按国务院、中央军委《关于军队参加营区外义务植树的指示》(〔1982〕3号)的规定执行；营区内植树办法，由解放军总部另定。但各地人民政府必须密切合作，合理规划，帮助军队解决应解决的实际问题。
The measures for officers and soldiers of the People's Liberation Army to participate in voluntary tree planting outside the barracks shall be implemented in accordance with the "Instructions on the Participation of the Military in Voluntary Tree Planting Outside the Barracks" (Guo Fa [1982] No. 3) issued by the State Council and the Central Military Commission; the measures for tree planting inside the barracks shall be separately formulated by the PLA headquarters. However, local people's governments at all levels must cooperate closely, make reasonable plans, and help the military solve practical problems that need to be addressed.
