总 则
General Provisions
为了规范住房租赁活动，维护住房租赁活动当事人合法权益，稳定住房租赁关系，促进住房租赁市场高质量发展，推动加快建立租购并举的住房制度，制定本条例。
This Regulation is formulated to regulate housing rental activities, protect the legitimate rights and interests of parties involved in housing rental activities, stabilize housing rental relationships, promote the high-quality development of the housing rental market, and accelerate the establishment of a housing system that encourages both renting and purchasing.
城镇国有土地上住房租赁活动及其监督管理，适用本条例。
This Regulation applies to housing rental activities and their supervision and management on urban state-owned land.
住房租赁市场发展应当贯彻党和国家路线方针政策、决策部署，坚持市场主导与政府引导相结合。
The development of the housing rental market shall implement the Party and state's guidelines, policies, and decisions, adhering to a combination of market orientation and government guidance.
国务院住房城乡建设主管部门负责全国住房租赁活动的监督管理工作。
The competent department of housing and urban-rural development under the State Council shall be responsible for the supervision and management of housing rental activities nationwide.
县级以上地方人民政府房产管理部门负责本行政区域内住房租赁活动的监督管理工作。
The real estate management departments of local people's governments at or above the county level shall be responsible for the supervision and management of housing rental activities within their respective administrative regions.
县级以上人民政府市场监督管理、公安等部门依照本条例和其他有关法律、法规的规定，在各自的职责范围内负责住房租赁活动的监督管理工作。
The market supervision and management, public security, and other departments of people's governments at or above the county level shall, in accordance with this Regulation and other relevant laws and regulations, be responsible for the supervision and management of housing rental activities within their respective duties.
国家鼓励居民家庭将自有房源用于租赁，支持企业盘活改造老旧厂房、商业办公用房、自持商品住房等用于租赁，多渠道增加租赁住房供给。
The State encourages resident families to use their own housing for rental, and supports enterprises in revitalizing and renovating old factories, commercial office buildings, self-owned commercial housing, etc., for rental, to increase the supply of rental housing through multiple channels.
国家鼓励出租人和承租人依法建立稳定的住房租赁关系，推动租购住房在享受公共服务上具有同等权利。
The State encourages lessors and lessees to establish stable housing rental relationships in accordance with the law, and promotes equal rights for rented and purchased housing in accessing public services.
从事住房租赁活动，应当遵守法律、法规，遵循平等、自愿、公平、诚信原则，不得危害国家安全、损害公共利益和他人合法权益，不得违背公序良俗。
Engaging in housing rental activities shall comply with laws and regulations, follow the principles of equality, voluntariness, fairness, and good faith, and shall not endanger national security, harm public interests or the legitimate rights and interests of others, or violate public order and good customs.
出租与承租
Leasing and Renting
用于出租的住房应当符合建筑、消防、燃气、室内装饰装修等方面的法律、法规、规章和强制性标准，不得危及人身安全和健康。
Housing used for rental shall comply with laws, regulations, rules, and mandatory standards concerning construction, fire safety, gas, interior decoration, etc., and shall not endanger personal safety and health.
厨房、卫生间、阳台、过道、地下储藏室、车库等非居住空间，不得单独出租用于居住。
Non-living spaces such as kitchens, bathrooms, balconies, hallways, underground storage rooms, and garages shall not be separately rented for residential use.
租赁住房单间租住人数上限和人均最低租住面积，应当符合设区的市级以上地方人民政府规定的标准。
The maximum number of occupants per room and the minimum per capita living area in rental housing shall comply with the standards set by the local people's government at or above the city with districts level.
出租人和承租人应当使用实名签订住房租赁合同。
Lessors and lessees shall sign a housing rental contract using their real names.
出租人应当按照规定，通过住房租赁管理服务平台等方式将住房租赁合同向租赁住房所在地房产管理部门备案。房产管理部门应当提高住房租赁合同备案服务水平，不得就住房租赁合同备案收取任何费用。
The lessor shall, in accordance with regulations, file the housing rental contract with the real estate management department of the location of the rental housing through the housing rental management service platform or other means. The real estate management department shall improve the service level for filing housing rental contracts and shall not charge any fees for the filing.
出租人未办理住房租赁合同备案的，承租人可以办理备案。
If the lessor fails to file the housing rental contract, the lessee may file it.
出租人应当遵守下列规定：
The lessor shall comply with the following provisions:
(一)向承租人出示身份证明材料、拟出租住房的不动产权属证书或者其他证明其具有合法出租权利的材料，并配合承租人依法查询、核实拟出租住房有关信息；
(1) Present to the lessee identity documents, the real estate ownership certificate of the housing to be rented, or other materials proving the legal right to rent, and cooperate with the lessee in lawfully inquiring and verifying relevant information about the housing to be rented;
(二)核验承租人的身份证明材料，不得将住房出租给拒绝出示身份证明材料的单位或者个人；
(2) Verify the lessee's identity documents, and shall not rent the housing to any unit or individual that refuses to present identity documents;
(三)不得擅自进入租赁住房，但是经承租人同意或者依法可以进入的除外。
(3) Shall not enter the rental housing without authorization, except with the lessee's consent or as permitted by law.
出租人收取押金的，应当在住房租赁合同中约定押金的数额、返还时间以及扣减押金的情形等事项。除住房租赁合同约定的情形以外，出租人无正当理由不得扣减押金。
If the lessor collects a deposit, the amount of the deposit, the time for return, and the circumstances under which the deposit may be deducted shall be agreed upon in the housing rental contract. Except for the circumstances agreed upon in the housing rental contract, the lessor shall not deduct the deposit without justifiable reasons.
承租人应当遵守下列规定：
The lessee shall comply with the following provisions:
(一)向出租人出示身份证明材料；
(1) Present identity documents to the lessor;
(二)安全、合理使用租赁住房，不得损坏、擅自拆除、停用消防设施或者改动租赁住房承重结构，不得私拉乱接水、电、燃气管线；
(2) Use the rental housing safely and reasonably, shall not damage, dismantle without authorization, or disable fire-fighting facilities, or alter the load-bearing structure of the rental housing, or arbitrarily connect water, electricity, or gas pipelines;
(三)未经出租人同意，不得擅自改变租赁住房用途、拆改室内设施或者改动租赁住房其他结构；
(3) Without the lessor's consent, shall not change the use of the rental housing, dismantle or alter indoor facilities, or alter other structures of the rental housing;
(四)遵守物业管理规约，不得任意弃置垃圾、超标准排放污染物或者产生噪声、违反规定饲养动物、违章搭建、侵占公共通道、高空抛物或者实施其他损害他人合法权益的行为；
(4) Comply with property management regulations, shall not arbitrarily discard garbage, discharge pollutants exceeding standards, or generate noise, violate regulations on keeping animals, construct illegally, encroach on public passages, throw objects from heights, or engage in other acts that harm the legitimate rights and interests of others;
(五)对出租人依法确需进入租赁住房的，予以配合。
(5) Cooperate with the lessor when the lessor lawfully needs to enter the rental housing.
出租人依法解除住房租赁合同的，应当通知承租人，并为承租人腾退租赁住房留出合理时间。
If the lessor terminates the housing rental contract in accordance with the law, the lessor shall notify the lessee and allow a reasonable time for the lessee to vacate the rental housing.
出租人不得采取暴力、威胁或者其他非法方式迫使承租人解除住房租赁合同或者腾退租赁住房。
The lessor shall not use violence, threats, or other illegal means to force the lessee to terminate the housing rental contract or vacate the rental housing.
住房租赁合同连续履行达到规定期限的，出租人按照有关规定享受相应的政策支持，承租人按照有关规定享受相应的基本公共服务。
If a housing rental contract is continuously performed for a specified period, the lessor shall enjoy corresponding policy support in accordance with relevant regulations, and the lessee shall enjoy corresponding basic public services in accordance with relevant regulations.
住房租赁企业
Housing Rental Enterprises
国家完善政策措施，培育市场化、专业化的住房租赁企业。
The State shall improve policies and measures to cultivate market-oriented and specialized housing rental enterprises.
住房租赁企业，是指以自有住房或者依法取得经营管理权的他人住房开展住房租赁经营业务的企业。住房租赁企业应当具备与其经营规模相适应的自有资金、从业人员和管理能力。
A housing rental enterprise refers to an enterprise that conducts housing rental business using its own housing or housing of others for which it has lawfully obtained management rights. A housing rental enterprise shall have self-owned funds, employees, and management capabilities commensurate with its business scale.
住房租赁企业出租住房，适用本条例有关出租人的规定。
When a housing rental enterprise rents out housing, the provisions of this Regulation concerning lessors shall apply.
住房租赁企业依法登记的经营范围应当使用“住房租赁”的表述。
The lawfully registered business scope of a housing rental enterprise shall use the expression "housing rental."
住房租赁企业应当自领取营业执照之日起30日内，向所在地县级以上地方人民政府房产管理部门报送开业信息。房产管理部门应当将住房租赁企业开业信息向社会公开。
A housing rental enterprise shall, within 30 days from the date of obtaining its business license, submit start-up information to the real estate management department of the local people's government at or above the county level. The real estate management department shall make the start-up information of housing rental enterprises public.
住房租赁企业应当在其经营场所醒目位置公示本企业开业信息、服务规范和标准等。
A housing rental enterprise shall display its start-up information, service standards, etc., in a conspicuous place at its business premises.
住房租赁企业发布的住房地址、面积、租金等房源信息应当真实、准确、完整，在其经营场所、互联网等不同渠道发布的房源信息应当一致，发布的房源图片应当与实物房源一致，不得发布虚假或者误导性房源信息，不得隐瞒或者拒绝提供拟出租住房的有关重要信息。
The housing address, area, rent, and other listing information published by a housing rental enterprise shall be true, accurate, and complete. The listing information published through different channels such as its business premises and the Internet shall be consistent. The pictures of the housing published shall be consistent with the actual housing. It shall not publish false or misleading listing information, and shall not conceal or refuse to provide important information about the housing to be rented.
住房租赁企业应当建立住房租赁档案，如实记载相关信息，并健全住房租赁信息查验等内部管理制度。
A housing rental enterprise shall establish housing rental files, truthfully record relevant information, and improve internal management systems such as housing rental information verification.
住房租赁企业不得非法收集、使用、加工、传输他人个人信息，不得非法买卖、提供或者公开他人个人信息。
A housing rental enterprise shall not illegally collect, use, process, or transmit others' personal information, and shall not illegally buy, sell, provide, or disclose others' personal information.
住房租赁企业应当按照规定向所在地县级以上地方人民政府房产管理部门报送其经营的租赁住房信息及其变化情况。
A housing rental enterprise shall, in accordance with regulations, report to the real estate management department of the local people's government at or above the county level the information on the rental housing it operates and any changes thereto.
从事转租经营的住房租赁企业应当按照规定设立住房租赁资金监管账户并向社会公示，并通过该账户办理住房租赁资金收付业务，具体办法由国务院住房城乡建设主管部门会同国务院有关部门制定。
A housing rental enterprise engaged in subleasing business shall, in accordance with regulations, establish a housing rental fund supervision account and make it public, and conduct housing rental fund receipt and payment business through such account. Specific measures shall be formulated by the competent department of housing and urban-rural development under the State Council jointly with relevant departments under the State Council.
自然人转租他人住房开展住房租赁经营业务，经营规模达到国务院住房城乡建设主管部门会同国务院市场监督管理部门等有关部门规定标准的，适用本条例有关住房租赁企业的规定。
If a natural person subleases others' housing to conduct housing rental business, and the business scale reaches the standards prescribed by the competent department of housing and urban-rural development under the State Council jointly with the market supervision and management department under the State Council and other relevant departments, the provisions of this Regulation concerning housing rental enterprises shall apply.
经 纪 机 构
Brokerage Agencies
从事住房租赁业务的房地产经纪机构(以下简称住房租赁经纪机构)应当具备与其经营规模相适应的自有资金、从业人员和管理能力。
A real estate brokerage agency engaged in housing rental business (hereinafter referred to as a housing rental brokerage agency) shall have self-owned funds, employees, and management capabilities commensurate with its business scale.
住房租赁经纪机构应当将其从业人员名单向所在地县级以上地方人民政府房产管理部门备案。住房租赁经纪机构的从业人员不得同时在两个或者两个以上住房租赁经纪机构从事业务。
A housing rental brokerage agency shall file the list of its employees with the real estate management department of the local people's government at or above the county level. Employees of a housing rental brokerage agency shall not concurrently engage in business at two or more housing rental brokerage agencies.
住房租赁经纪机构的从业人员不得以个人名义承接住房租赁经纪业务。
Employees of a housing rental brokerage agency shall not undertake housing rental brokerage business in their own names.
住房租赁经纪机构发布房源信息前，应当核对并记录委托人的身份信息、住房权属信息，实地查看房源，与委托人签订住房租赁经纪服务合同，编制住房状况说明书。住房租赁经纪服务合同、住房状况说明书应当加盖住房租赁经纪机构印章，并按照有关规定保存。
Before publishing listing information, a housing rental brokerage agency shall verify and record the client's identity information and housing ownership information, inspect the housing on site, sign a housing rental brokerage service contract with the client, and prepare a housing condition statement. The housing rental brokerage service contract and housing condition statement shall be stamped with the seal of the housing rental brokerage agency and kept in accordance with relevant regulations.
本条例第十五条第二款和第三款、第十六条、第十七条的规定，适用于住房租赁经纪机构。
The provisions of Article 15, paragraphs 2 and 3, Article 16, and Article 17 of this Regulation shall apply to housing rental brokerage agencies.
住房租赁经纪机构不得有下列行为：
A housing rental brokerage agency shall not engage in the following acts:
(一)为出租不符合建筑、消防、燃气、室内装饰装修等方面的法律、法规、规章或者强制性标准的住房提供经纪服务；
(1) Providing brokerage services for housing that does not comply with laws, regulations, rules, or mandatory standards concerning construction, fire safety, gas, interior decoration, etc.;
(二)为单独出租厨房、卫生间、阳台、过道、地下储藏室、车库等非居住空间用于居住提供经纪服务；
(2) Providing brokerage services for separately renting non-living spaces such as kitchens, bathrooms, balconies, hallways, underground storage rooms, and garages for residential use;
(三)为单间租住人数上限或者人均最低租住面积不符合规定标准的住房出租提供经纪服务；
(3) Providing brokerage services for renting housing that does not meet the standards for the maximum number of occupants per room or the minimum per capita living area;
(四)代收、代付住房租金、押金；
(4) Collecting or paying housing rent or deposits on behalf of others;
(五)未经当事人同意，以当事人名义签订住房租赁合同；
(5) Signing a housing rental contract in the name of a party without the party's consent;
(六)法律、法规、规章禁止从事的其他行为。
(6) Other acts prohibited by laws, regulations, or rules.
住房租赁经纪机构应当对收费服务项目明码标价，不得在标价之外加价或者收取未予标明的费用。
A housing rental brokerage agency shall clearly mark the prices of its fee-based services and shall not add extra charges beyond the marked prices or charge fees not indicated.
出租人和承租人通过住房租赁经纪机构签订住房租赁合同的，由住房租赁经纪机构办理住房租赁合同备案。
If a lessor and lessee sign a housing rental contract through a housing rental brokerage agency, the housing rental brokerage agency shall handle the filing of the housing rental contract.
监 督 管 理
Supervision and Management
国务院住房城乡建设主管部门会同国务院市场监督管理部门制定并公布住房租赁合同、住房租赁经纪服务合同示范文本。
The competent department of housing and urban-rural development under the State Council, jointly with the market supervision and management department under the State Council, shall formulate and publish model texts for housing rental contracts and housing rental brokerage service contracts.
设区的市级以上地方人民政府应当建立住房租金监测机制，定期公布本行政区域内不同区域、不同类型住房的租金水平信息。
Local people's governments at or above the city with districts level shall establish a housing rent monitoring mechanism and regularly publish information on rent levels for different areas and types of housing within their administrative regions.
县级以上地方人民政府房产管理部门应当通过住房租赁管理服务平台开展合同备案、租赁住房信息管理、统计监测等管理与服务，并与民政、自然资源、教育、市场监督管理、金融管理、公安、税务、统计等部门建立信息共享机制。
The real estate management department of the local people's government at or above the county level shall, through the housing rental management service platform, carry out management and services such as contract filing, rental housing information management, and statistical monitoring, and establish an information sharing mechanism with civil affairs, natural resources, education, market supervision and management, financial management, public security, taxation, statistics, and other departments.
县级以上地方人民政府房产管理部门应当会同有关部门加强对住房租赁活动的监督检查，依法及时处理违法行为。
The real estate management department of the local people's government at or above the county level shall, jointly with relevant departments, strengthen the supervision and inspection of housing rental activities and handle illegal acts in a timely manner in accordance with the law.
县级以上地方人民政府房产管理部门可以委托实施单位承担住房租赁管理的支持辅助等相关具体工作。房产管理部门委托的实施单位不得以营利为目的。
The real estate management department of the local people's government at or above the county level may entrust implementing units to undertake specific tasks such as support and assistance in housing rental management. The implementing units entrusted by the real estate management department shall not operate for profit.
县级以上地方人民政府房产管理部门应当对其委托的实施单位加强监督，并对实施单位在委托范围内的行为后果承担法律责任。
The real estate management department of the local people's government at or above the county level shall strengthen supervision over the implementing units it entrusts and shall bear legal liability for the consequences of the acts of the implementing units within the scope of entrustment.
县级以上地方人民政府房产管理部门应当会同有关部门、住房租赁相关行业组织加强住房租赁行业诚信建设，建立住房租赁企业、住房租赁经纪机构及其从业人员信用评价制度，将相关违法违规行为记入信用记录，纳入全国信用信息共享平台，并根据信用状况实施分级分类监管。
The real estate management department of the local people's government at or above the county level shall, jointly with relevant departments and industry organizations related to housing rental, strengthen the construction of integrity in the housing rental industry, establish a credit evaluation system for housing rental enterprises, housing rental brokerage agencies, and their employees, record relevant illegal or non-compliant acts in credit records, incorporate them into the national credit information sharing platform, and implement graded and classified supervision based on credit status.
住房租赁相关行业组织应当建立健全行业规范，加强行业自律管理，促进行业健康发展。
Industry organizations related to housing rental shall establish and improve industry norms, strengthen industry self-discipline management, and promote the healthy development of the industry.
在住房租赁活动中，因押金返还、住房维修、住房腾退等产生纠纷的，由出租人和承租人协商解决；协商不成的，可以依法申请调解、仲裁或者提起诉讼。
In housing rental activities, disputes arising from deposit refund, housing repair, housing vacating, etc., shall be resolved through negotiation between the lessor and lessee; if negotiation fails, mediation, arbitration, or litigation may be applied for in accordance with the law.
提供住房租赁信息发布服务的网络平台经营者(以下简称网络平台经营者)应当核验住房租赁信息发布者的真实身份信息。
An online platform operator that provides housing rental information publishing services (hereinafter referred to as an online platform operator) shall verify the true identity information of the publisher of housing rental information.
网络平台经营者知道或者应当知道信息发布者有提供虚假信息等违法情形的，应当依法采取删除相关信息等必要措施，保存相关记录，并向有关部门报告。
If an online platform operator knows or should know that an information publisher has illegal circumstances such as providing false information, it shall take necessary measures such as deleting the relevant information in accordance with the law, keep relevant records, and report to the relevant department.
网络平台经营者不得代收、代付住房租金、押金。
An online platform operator shall not collect or pay housing rent or deposits on behalf of others.
出租人应当按规定如实登记并报送承租人及实际居住人信息，发现违法犯罪活动应当及时向公安机关报告。具体办法由国务院公安部门制定。
The lessor shall truthfully register and report the information of the lessee and actual occupants in accordance with regulations, and shall promptly report to the public security authority if any illegal or criminal activity is discovered. Specific measures shall be formulated by the public security department under the State Council.
承租人不得利用租赁住房实施违法犯罪活动。
The lessee shall not use the rental housing to engage in illegal or criminal activities.
法 律 责 任
Legal Liability
有下列情形之一的，依照有关法律、法规、规章的规定处罚：
In any of the following circumstances, penalties shall be imposed in accordance with the provisions of relevant laws, regulations, and rules:
(一)出租不符合建筑、消防、燃气、室内装饰装修等方面的法律、法规、规章或者强制性标准的住房；
(1) Renting out housing that does not comply with laws, regulations, rules, or mandatory standards concerning construction, fire safety, gas, interior decoration, etc.;
(二)损坏、擅自拆除、停用消防设施；
(2) Damaging, dismantling without authorization, or disabling fire-fighting facilities;
(三)改动租赁住房承重结构；
(3) Altering the load-bearing structure of the rental housing;
(四)私拉乱接水、电、燃气管线。
(4) Arbitrarily connecting water, electricity, or gas pipelines.
将厨房、卫生间、阳台、过道、地下储藏室、车库等非居住空间单独出租用于居住，或者租赁住房不符合规定的单间租住人数上限或者人均最低租住面积标准的，由县级以上地方人民政府房产管理部门责令改正，给予警告；拒不改正的，对单位处2万元以上10万元以下的罚款，对个人处2000元以上1万元以下的罚款；有违法所得的，没收违法所得。
If non-living spaces such as kitchens, bathrooms, balconies, hallways, underground storage rooms, and garages are separately rented for residential use, or if the rental housing does not meet the prescribed standards for the maximum number of occupants per room or the minimum per capita living area, the real estate management department of the local people's government at or above the county level shall order correction and give a warning; if correction is refused, a fine of not less than 20,000 yuan but not more than 100,000 yuan shall be imposed on the unit, and a fine of not less than 2,000 yuan but not more than 10,000 yuan shall be imposed on the individual; if there is illegal income, the illegal income shall be confiscated.
住房租赁企业、住房租赁经纪机构不具备与其经营规模相适应的自有资金、从业人员、管理能力的，由县级以上地方人民政府房产管理部门责令改正，给予警告；拒不改正、造成严重后果的，责令停业整顿。
If a housing rental enterprise or housing rental brokerage agency does not have self-owned funds, employees, or management capabilities commensurate with its business scale, the real estate management department of the local people's government at or above the county level shall order correction and give a warning; if correction is refused and serious consequences are caused, it shall be ordered to suspend business for rectification.
住房租赁企业、住房租赁经纪机构有下列情形之一的，由县级以上地方人民政府房产管理部门责令改正，给予警告；拒不改正的，处2万元以上10万元以下的罚款：
If a housing rental enterprise or housing rental brokerage agency falls under any of the following circumstances, the real estate management department of the local people's government at or above the county level shall order correction and give a warning; if correction is refused, a fine of not less than 20,000 yuan but not more than 100,000 yuan shall be imposed:
(一)未按照规定报送开业信息；
(1) Failing to submit start-up information in accordance with regulations;
(二)未在其经营场所醒目位置公示本企业开业信息、服务规范和标准等；
(2) Failing to display its start-up information, service standards, etc., in a conspicuous place at its business premises;
(三)未建立住房租赁档案并如实记载相关信息，或者未健全住房租赁信息查验等内部管理制度；
(3) Failing to establish housing rental files and truthfully record relevant information, or failing to improve internal management systems such as housing rental information verification;
(四)未按照规定办理住房租赁合同备案。
(4) Failing to file the housing rental contract in accordance with regulations.
住房租赁企业未按照规定报送其经营的租赁住房信息及其变化情况，或者住房租赁经纪机构未按照规定与委托人签订住房租赁经纪服务合同或者未编制住房状况说明书的，依照前款规定处罚。
If a housing rental enterprise fails to report the information on the rental housing it operates and any changes thereto, or if a housing rental brokerage agency fails to sign a housing rental brokerage service contract with the client or fails to prepare a housing condition statement in accordance with regulations, the penalty shall be imposed in accordance with the preceding paragraph.
住房租赁企业、住房租赁经纪机构发布虚假或者误导性房源信息，隐瞒或者拒绝提供拟出租住房有关重要信息的，由县级以上地方人民政府房产管理部门责令改正，给予警告，处2万元以上10万元以下的罚款；有违法所得的，没收违法所得；拒不改正的，责令停业整顿；情节严重的，由县级以上地方人民政府房产管理部门提请同级市场监督管理部门依法吊销其营业执照。
If a housing rental enterprise or housing rental brokerage agency publishes false or misleading listing information, or conceals or refuses to provide important information about the housing to be rented, the real estate management department of the local people's government at or above the county level shall order correction, give a warning, and impose a fine of not less than 20,000 yuan but not more than 100,000 yuan; if there is illegal income, the illegal income shall be confiscated; if correction is refused, it shall be ordered to suspend business for rectification; if the circumstances are serious, the real estate management department of the local people's government at or above the county level shall request the market supervision and management department at the same level to revoke its business license in accordance with the law.
住房租赁企业、住房租赁经纪机构非法收集、使用、加工、传输他人个人信息，或者非法买卖、提供或者公开他人个人信息的，依照有关个人信息保护的法律、法规的规定处罚。
If a housing rental enterprise or housing rental brokerage agency illegally collects, uses, processes, or transmits others' personal information, or illegally buys, sells, provides, or discloses others' personal information, the penalty shall be imposed in accordance with the provisions of laws and regulations on personal information protection.
从事转租经营的住房租赁企业未按照规定设立住房租赁资金监管账户并向社会公示，或者未按照规定通过该账户办理住房租赁资金收付业务的，由县级以上地方人民政府房产管理部门责令改正，给予警告，处2万元以上10万元以下的罚款；拒不改正的，处10万元以上50万元以下的罚款。
If a housing rental enterprise engaged in subleasing business fails to establish a housing rental fund supervision account and make it public, or fails to conduct housing rental fund receipt and payment business through such account in accordance with regulations, the real estate management department of the local people's government at or above the county level shall order correction, give a warning, and impose a fine of not less than 20,000 yuan but not more than 100,000 yuan; if correction is refused, a fine of not less than 100,000 yuan but not more than 500,000 yuan shall be imposed.
住房租赁经纪机构有下列情形之一的，由县级以上地方人民政府房产管理部门责令改正，给予警告，处2万元以上10万元以下的罚款；有违法所得的，没收违法所得；拒不改正的，责令停业整顿：
If a housing rental brokerage agency falls under any of the following circumstances, the real estate management department of the local people's government at or above the county level shall order correction, give a warning, and impose a fine of not less than 20,000 yuan but not more than 100,000 yuan; if there is illegal income, the illegal income shall be confiscated; if correction is refused, it shall be ordered to suspend business for rectification:
(一)发布房源信息前未核对并记录委托人的身份信息、住房权属信息，或者未实地查看房源；
(1) Failing to verify and record the client's identity information and housing ownership information before publishing listing information, or failing to inspect the housing on site;
(二)为出租不符合建筑、消防、燃气、室内装饰装修等方面的法律、法规、规章或者强制性标准的住房提供经纪服务；
(2) Providing brokerage services for renting housing that does not comply with laws, regulations, rules, or mandatory standards concerning construction, fire safety, gas, interior decoration, etc.;
(三)为单独出租厨房、卫生间、阳台、过道、地下储藏室、车库等非居住空间用于居住提供经纪服务；
(3) Providing brokerage services for separately renting non-living spaces such as kitchens, bathrooms, balconies, hallways, underground storage rooms, and garages for residential use;
(四)为单间租住人数上限或者人均最低租住面积不符合规定标准的住房出租提供经纪服务；
(4) Providing brokerage services for renting housing that does not meet the standards for the maximum number of occupants per room or the minimum per capita living area;
(五)代收、代付住房租金、押金；
(5) Collecting or paying housing rent or deposits on behalf of others;
(六)未经当事人同意，以当事人名义签订住房租赁合同；
(6) Signing a housing rental contract in the name of a party without the party's consent;
(七)未按规定将其从业人员名单备案。
(7) Failing to file the list of its employees in accordance with regulations.
网络平台经营者代收、代付住房租金、押金的，依照前款规定处罚。
If an online platform operator collects or pays housing rent or deposits on behalf of others, the penalty shall be imposed in accordance with the preceding paragraph.
住房租赁经纪机构的从业人员同时在两个或者两个以上住房租赁经纪机构从事业务，或者以个人名义承接住房租赁经纪业务的，由县级以上地方人民政府房产管理部门责令改正，给予警告，可以处1万元以下的罚款；有违法所得的，没收违法所得；拒不改正的，1年内不得从事住房租赁经纪业务；情节严重的，5年内不得从事住房租赁经纪业务。
If an employee of a housing rental brokerage agency concurrently engages in business at two or more housing rental brokerage agencies, or undertakes housing rental brokerage business in his/her own name, the real estate management department of the local people's government at or above the county level shall order correction, give a warning, and may impose a fine of not more than 10,000 yuan; if there is illegal income, the illegal income shall be confiscated; if correction is refused, the employee shall be prohibited from engaging in housing rental brokerage business for one year; if the circumstances are serious, the employee shall be prohibited from engaging in housing rental brokerage business for five years.
网络平台经营者未履行核验责任的，县级以上地方人民政府房产管理部门应当通报网信部门，由网信部门依据职责予以处置，可以处10万元以下的罚款；情节严重的，可以责令暂停相关业务或者停业整顿。
If an online platform operator fails to perform its verification obligations, the real estate management department of the local people's government at or above the county level shall notify the cyberspace administration department, which shall handle the matter according to its duties and may impose a fine of not more than 100,000 yuan; if the circumstances are serious, it may order the suspension of relevant business or suspension of business for rectification.
房产管理部门和其他有关部门工作人员在住房租赁活动监督管理工作中滥用职权、玩忽职守、徇私舞弊的，依法给予处分。
If staff members of the real estate management department and other relevant departments abuse their powers, neglect their duties, or engage in malpractice for personal gain in the supervision and management of housing rental activities, they shall be given sanctions in accordance with the law.
违反本条例规定，给他人造成损失的，依法承担赔偿责任；构成违反治安管理行为的，由公安机关依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
If a violation of this Regulation causes loss to others, the violator shall bear compensation liability in accordance with the law; if the act constitutes a violation of public security administration, the public security authority shall impose public security administration penalties in accordance with the law; if the act constitutes a crime, criminal liability shall be pursued in accordance with the law.
附 则
Supplementary Provisions
保障性住房的租赁活动及其监督管理，国家另有规定的，从其规定。
If there are other provisions of the State on the rental activities and supervision and management of indemnificatory housing, those provisions shall prevail.
集体土地上住房租赁活动，由省、自治区、直辖市人民政府根据实际情况，制定管理办法。
For housing rental activities on collective land, the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall formulate management measures based on actual conditions.
本条例自2025年9月15日起施行。
This Regulation shall come into force on September 15, 2025.
