为了加强对长城的保护，规范长城的利用行为，根据《中华人民共和国文物保护法》(以下简称文物保护法)，制定本条例。
These Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of Cultural Relics (hereinafter referred to as the Cultural Relics Protection Law) to strengthen the protection of the Great Wall and regulate the use of the Great Wall.
本条例所称长城，包括长城的墙体、城堡、关隘、烽火台、敌楼等。
For the purposes of these Regulations, the Great Wall includes the walls, castles, passes, beacon towers, and watchtowers of the Great Wall.
受本条例保护的长城段落，由国务院文物主管部门认定并公布。
The sections of the Great Wall protected under these Regulations shall be identified and announced by the competent department of cultural relics under the State Council.
长城保护应当贯彻文物工作方针，坚持科学规划、原状保护的原则。
The protection of the Great Wall shall implement the principles of cultural relics work, adhering to the principles of scientific planning and original state protection.
国家对长城实行整体保护、分段管理。
The state implements overall protection and segmented management of the Great Wall.
国务院文物主管部门负责长城整体保护工作，协调、解决长城保护中的重大问题，监督、检查长城所在地各地方的长城保护工作。
The competent department of cultural relics under the State Council is responsible for the overall protection of the Great Wall, coordinating and resolving major issues in Great Wall protection, and supervising and inspecting the Great Wall protection work of local governments along the Great Wall.
长城所在地县级以上地方人民政府及其文物主管部门依照文物保护法、本条例和其他有关行政法规的规定，负责本行政区域内的长城保护工作。
The local people's governments at or above the county level along the Great Wall and their competent departments of cultural relics shall be responsible for the protection of the Great Wall within their respective administrative regions in accordance with the Cultural Relics Protection Law, these Regulations, and other relevant administrative regulations.
长城所在地县级以上地方人民政府应当将长城保护经费纳入本级财政预算。
Local people's governments at or above the county level along the Great Wall shall include the funds for Great Wall protection in their fiscal budgets.
国家鼓励公民、法人和其他组织通过捐赠等方式设立长城保护基金，专门用于长城保护。长城保护基金的募集、使用和管理，依照国家有关法律、行政法规的规定执行。
The state encourages citizens, legal persons, and other organizations to establish Great Wall protection funds through donations and other means, specifically for the protection of the Great Wall. The raising, use, and management of Great Wall protection funds shall be implemented in accordance with relevant national laws and administrative regulations.
国家对长城保护实行专家咨询制度。制定长城保护总体规划、审批与长城有关的建设工程、决定与长城保护有关的其他重大事项，应当听取专家意见。
The state implements an expert consultation system for Great Wall protection. Expert opinions shall be solicited when formulating the overall plan for Great Wall protection, approving construction projects related to the Great Wall, and deciding other major matters related to Great Wall protection.
公民、法人和其他组织都有依法保护长城的义务。
Citizens, legal persons, and other organizations have the obligation to protect the Great Wall in accordance with the law.
国家鼓励公民、法人和其他组织参与长城保护。
The state encourages citizens, legal persons, and other organizations to participate in the protection of the Great Wall.
国务院文物主管部门、长城所在地县级以上地方人民政府及其文物主管部门应当对在长城保护中作出突出贡献的组织或者个人给予奖励。
The competent department of cultural relics under the State Council, local people's governments at or above the county level along the Great Wall, and their competent departments of cultural relics shall reward organizations or individuals that have made outstanding contributions to the protection of the Great Wall.
长城所在地省、自治区、直辖市人民政府应当对本行政区域内的长城进行调查；对认为属于长城的段落，应当报国务院文物主管部门认定，并自认定之日起1年内依法核定公布为省级文物保护单位。
The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government along the Great Wall shall conduct surveys of the Great Wall within their administrative regions; sections believed to be part of the Great Wall shall be reported to the competent department of cultural relics under the State Council for identification, and within one year from the date of identification, they shall be verified and announced as provincial-level cultural relic protection units in accordance with the law.
本条例施行前已经认定为长城但尚未核定公布为全国重点文物保护单位或者省级文物保护单位的段落，应当自本条例施行之日起1年内依法核定公布为全国重点文物保护单位或者省级文物保护单位。
Sections that have been identified as the Great Wall before the implementation of these Regulations but have not yet been verified and announced as national key cultural relic protection units or provincial-level cultural relic protection units shall be verified and announced as national key cultural relic protection units or provincial-level cultural relic protection units within one year from the date of implementation of these Regulations.
国家实行长城保护总体规划制度。
The state implements a system of overall planning for Great Wall protection.
国务院文物主管部门会同国务院有关部门，根据文物保护法的规定和长城保护的实际需要，制定长城保护总体规划，报国务院批准后组织实施。长城保护总体规划应当明确长城的保护标准和保护重点，分类确定保护措施，并确定禁止在保护范围内进行工程建设的长城段落。
The competent department of cultural relics under the State Council, together with relevant departments under the State Council, shall formulate an overall plan for Great Wall protection based on the provisions of the Cultural Relics Protection Law and the actual needs of Great Wall protection, and submit it to the State Council for approval before implementation. The overall plan for Great Wall protection shall specify the protection standards and key points for the Great Wall, determine protection measures by category, and identify sections of the Great Wall where construction projects are prohibited within the protection zones.
长城所在地县级以上地方人民政府制定本行政区域的国民经济和社会发展计划、土地利用总体规划和城乡规划，应当落实长城保护总体规划规定的保护措施。
Local people's governments at or above the county level along the Great Wall, when formulating national economic and social development plans, land use master plans, and urban and rural plans for their administrative regions, shall implement the protection measures specified in the overall plan for Great Wall protection.
长城所在地省、自治区、直辖市人民政府应当按照长城保护总体规划的要求，划定本行政区域内长城的保护范围和建设控制地带，并予以公布。
The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government along the Great Wall shall, in accordance with the requirements of the overall plan for Great Wall protection, delineate the protection zones and construction control zones for the Great Wall within their administrative regions and announce them.
省、自治区、直辖市人民政府文物主管部门应当将公布的保护范围和建设控制地带报国务院文物主管部门备案。
The competent departments of cultural relics of provinces, autonomous regions, and municipalities directly under the Central Government shall report the announced protection zones and construction control zones to the competent department of cultural relics under the State Council for record.
任何单位或者个人不得在长城保护总体规划禁止工程建设的保护范围内进行工程建设。在建设控制地带或者长城保护总体规划未禁止工程建设的保护范围内进行工程建设，应当遵守文物保护法第十七条、第十八条的规定。
No unit or individual may carry out construction projects within the protection zones where construction is prohibited by the overall plan for Great Wall protection. Construction projects within construction control zones or protection zones not prohibited by the overall plan for Great Wall protection shall comply with the provisions of Articles 17 and 18 of the Cultural Relics Protection Law.
进行工程建设应当绕过长城。无法绕过的，应当采取挖掘地下通道的方式通过长城；无法挖掘地下通道的，应当采取架设桥梁的方式通过长城。任何单位或者个人进行工程建设，不得拆除、穿越、迁移长城。
Construction projects shall bypass the Great Wall. If it is impossible to bypass, the Great Wall shall be crossed by means of an underground passage; if an underground passage cannot be excavated, the Great Wall shall be crossed by means of a bridge. No unit or individual may dismantle, cross, or relocate the Great Wall during construction.
长城所在地省、自治区、直辖市人民政府应当在长城沿线的交通路口和其他需要提示公众的地段设立长城保护标志。设立长城保护标志不得对长城造成损坏。
The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government along the Great Wall shall set up Great Wall protection signs at traffic intersections along the Great Wall and other locations where the public needs to be reminded. The installation of Great Wall protection signs shall not cause damage to the Great Wall.
长城保护标志应当载明长城段落的名称、修筑年代、保护范围、建设控制地带和保护机构。
Great Wall protection signs shall indicate the name of the Great Wall section, the construction period, the protection zone, the construction control zone, and the protection agency.
长城所在地省、自治区、直辖市人民政府应当建立本行政区域内的长城档案，其文物主管部门应当将长城档案报国务院文物主管部门备案。
The people's government of the province, autonomous region, or municipality directly under the Central Government where the Great Wall is located shall establish archives of the Great Wall within its administrative region, and its cultural relics administrative department shall report the Great Wall archives to the cultural relics administrative department of the State Council for recordation.
国务院文物主管部门应当建立全国的长城档案。
The cultural relics administrative department of the State Council shall establish national archives of the Great Wall.
长城所在地省、自治区、直辖市人民政府应当为本行政区域内的长城段落确定保护机构；长城段落有利用单位的，该利用单位可以确定为保护机构。
The people's government of the province, autonomous region, or municipality directly under the Central Government where the Great Wall is located shall designate a protection institution for each section of the Great Wall within its administrative region; if a section of the Great Wall has a user unit, that user unit may be designated as the protection institution.
保护机构应当对其所负责保护的长城段落进行日常维护和监测，并建立日志；发现安全隐患，应当立即采取控制措施，并及时向县级人民政府文物主管部门报告。
The protection institution shall carry out daily maintenance and monitoring of the Great Wall section under its responsibility, and establish logs; if it discovers a safety hazard, it shall immediately take control measures and promptly report to the cultural relics administrative department of the county people's government.
地处偏远、没有利用单位的长城段落，所在地县级人民政府或者其文物主管部门可以聘请长城保护员对长城进行巡查、看护，并对长城保护员给予适当补助。
For remote sections of the Great Wall without a user unit, the county people's government or its cultural relics administrative department may hire Great Wall protection personnel to patrol and guard the Great Wall, and provide appropriate subsidies to the Great Wall protection personnel.
长城段落为行政区域边界的，其毗邻的县级以上地方人民政府应当定期召开由相关部门参加的联席会议，研究解决长城保护中的重大问题。
If a section of the Great Wall forms an administrative boundary, the adjacent local people's governments at or above the county level shall regularly hold joint meetings with relevant departments to study and resolve major issues in Great Wall protection.
禁止在长城上从事下列活动：
The following activities are prohibited on the Great Wall:
(一)取土、取砖(石)或者种植作物；
(1) extracting soil, bricks (stones), or planting crops;
(二)刻划、涂污；
(2) carving or defacing;
(三)架设、安装与长城保护无关的设施、设备；
(3) erecting or installing facilities or equipment unrelated to Great Wall protection;
(四)驾驶交通工具，或者利用交通工具等跨越长城；
(4) driving vehicles or using vehicles to cross the Great Wall;
(五)展示可能损坏长城的器具；
(5) displaying implements that may damage the Great Wall;
(六)有组织地在未辟为参观游览区的长城段落举行活动；
(6) organizing activities on sections of the Great Wall that have not been opened as tourist areas;
(七)文物保护法禁止的其他活动。
(7) other activities prohibited by the Cultural Relics Protection Law.
将长城段落辟为参观游览区，应当坚持科学规划、原状保护的原则，并应当具备下列条件：
To open a section of the Great Wall as a tourist area, the principles of scientific planning and original state protection shall be adhered to, and the following conditions shall be met:
(一)该长城段落的安全状况适宜公众参观游览；
(1) the safety condition of the Great Wall section is suitable for public visitation;
(二)该长城段落有明确的保护机构，已依法划定保护范围、建设控制地带，并已建立保护标志、档案；
(2) the Great Wall section has a clear protection institution, has legally designated a protection zone and a construction control zone, and has established protection signs and archives;
(三)符合长城保护总体规划的要求。
(3) it meets the requirements of the overall Great Wall protection plan.
将长城段落辟为参观游览区，应当自辟为参观游览区之日起5日内向所在地省、自治区、直辖市人民政府文物主管部门备案；长城段落属于全国重点文物保护单位的，应当自辟为参观游览区之日起5日内向国务院文物主管部门备案。备案材料应当包括参观游览区的旅游容量指标。
If a section of the Great Wall is opened as a tourist area, it shall be reported to the cultural relics administrative department of the province, autonomous region, or municipality directly under the Central Government for recordation within 5 days from the date of opening; if the Great Wall section is a major historical and cultural site protected at the national level, it shall be reported to the cultural relics administrative department of the State Council for recordation within 5 days from the date of opening. The recordation materials shall include the tourist capacity indicators of the tourist area.
所在地省、自治区、直辖市人民政府文物主管部门和国务院文物主管部门，应当自收到备案材料之日起20日内按照职权划分核定参观游览区的旅游容量指标。
The cultural relics administrative department of the province, autonomous region, or municipality directly under the Central Government and the cultural relics administrative department of the State Council shall, within 20 days from receipt of the recordation materials, verify the tourist capacity indicators of the tourist area according to their respective functions and powers.
在参观游览区内举行活动，其人数不得超过核定的旅游容量指标。
Activities held in the tourist area shall not exceed the verified tourist capacity indicators.
在参观游览区内设置服务项目，应当符合长城保护总体规划的要求。
Service projects set up in the tourist area shall comply with the requirements of the overall Great Wall protection plan.
任何单位或者个人发现长城遭受损坏向保护机构或者所在地县级人民政府文物主管部门报告的，接到报告的保护机构或者县级人民政府文物主管部门应当立即采取控制措施，并向县级人民政府和上一级人民政府文物主管部门报告。
If any unit or individual discovers damage to the Great Wall and reports it to the protection institution or the cultural relics administrative department of the county people's government, the protection institution or the county cultural relics administrative department that receives the report shall immediately take control measures and report to the county people's government and the cultural relics administrative department of the next higher level.
对长城进行修缮，应当依照文物保护法的规定办理审批手续，由依法取得文物保护工程资质证书的单位承担。长城的修缮，应当遵守不改变原状的原则。
Repairs to the Great Wall shall be subject to approval procedures in accordance with the provisions of the Cultural Relics Protection Law, and shall be undertaken by units that have lawfully obtained qualification certificates for cultural relics protection projects. Repairs to the Great Wall shall adhere to the principle of not altering the original state.
长城段落已经损毁的，应当实施遗址保护，不得在原址重建。
If a section of the Great Wall has been damaged, site protection shall be implemented, and reconstruction on the original site is prohibited.
长城段落因人为原因造成损坏的，其修缮费用由造成损坏的单位或者个人承担。
If a section of the Great Wall is damaged due to human causes, the repair costs shall be borne by the unit or individual that caused the damage.
违反本条例规定，造成长城损毁，构成犯罪的，依法追究刑事责任；尚不构成犯罪，违反有关治安管理的法律规定的，由公安机关依法给予治安处罚。
Whoever violates these regulations, causing damage to the Great Wall, if constituting a crime, shall be investigated for criminal liability according to law; if not constituting a crime but violating the legal provisions on public security administration, the public security organ shall impose public security penalties according to law.
违反本条例规定，有下列情形之一的，依照文物保护法第六十六条的规定责令改正，造成严重后果的，处5万元以上50万元以下的罚款；情节严重的，由原发证机关吊销资质证书：
Whoever violates these regulations and has one of the following circumstances shall be ordered to make corrections in accordance with Article 66 of the Cultural Relics Protection Law; if serious consequences are caused, a fine of not less than 50,000 yuan but not more than 500,000 yuan shall be imposed; if the circumstances are serious, the original issuing authority shall revoke the qualification certificate:
(一)在禁止工程建设的长城段落的保护范围内进行工程建设的；
(1) Carrying out construction within the protection zone of a Great Wall section where construction is prohibited;
(二)在长城的保护范围或者建设控制地带内进行工程建设，未依法报批的；
(2) Carrying out construction within the protection zone or construction control zone of the Great Wall without submitting for approval according to law;
(三)未采取本条例规定的方式进行工程建设，或者因工程建设拆除、穿越、迁移长城的。
(3) Carrying out construction not in the manner prescribed by these regulations, or demolishing, crossing, or relocating the Great Wall due to construction.
将不符合本条例规定条件的长城段落辟为参观游览区的，由省级以上人民政府文物主管部门按照职权划分依法取缔，没收违法所得；造成长城损坏的，处5万元以上50万元以下的罚款。
If a section of the Great Wall that does not meet the conditions prescribed by these regulations is opened as a tourist attraction, the cultural relics administrative department of the people's government at or above the provincial level shall, according to the division of powers, ban it and confiscate the illegal gains; if damage is caused to the Great Wall, a fine of not less than 50,000 yuan but not more than 500,000 yuan shall be imposed.
将长城段落辟为参观游览区未按照本条例规定备案的，由省级以上人民政府文物主管部门按照职权划分责令限期改正，逾期不改正的，依照前款规定处罚。
If a section of the Great Wall is opened as a tourist attraction without filing as required by these regulations, the cultural relics administrative department of the people's government at or above the provincial level shall, according to the division of powers, order corrections within a time limit; if no correction is made within the time limit, a penalty shall be imposed in accordance with the preceding paragraph.
在参观游览区内设置的服务项目不符合长城保护总体规划要求的，由县级人民政府文物主管部门责令改正，没收违法所得。
If the service items set up in the tourist attraction do not meet the requirements of the overall plan for Great Wall protection, the cultural relics administrative department of the county people's government shall order corrections and confiscate the illegal gains.
违反本条例规定，有下列情形之一的，由县级人民政府文物主管部门责令改正，造成严重后果的，对个人处1万元以上5万元以下的罚款，对单位处5万元以上50万元以下的罚款：
Whoever violates these regulations and has one of the following circumstances shall be ordered to make corrections by the cultural relics administrative department of the county people's government; if serious consequences are caused, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed on individuals, and a fine of not less than 50,000 yuan but not more than 500,000 yuan shall be imposed on units:
(一)在长城上架设、安装与长城保护无关的设施、设备的；
(1) Erecting or installing facilities or equipment unrelated to Great Wall protection on the Great Wall;
(二)在长城上驾驶交通工具，或者利用交通工具等跨越长城的；
(2) Driving vehicles on the Great Wall, or using vehicles to cross the Great Wall;
(三)在长城上展示可能损坏长城的器具的；
(3) Displaying instruments that may damage the Great Wall on the Great Wall;
(四)在参观游览区接待游客超过旅游容量指标的。
(4) Receiving tourists exceeding the tourist capacity index in the tourist attraction.
违反本条例规定，有下列情形之一的，由县级人民政府文物主管部门责令改正，给予警告；情节严重的，对个人并处1000元以上5000元以下的罚款，对单位并处1万元以上5万元以下的罚款：
Whoever violates these regulations and has one of the following circumstances shall be ordered to make corrections and given a warning by the cultural relics administrative department of the county people's government; if the circumstances are serious, a fine of not less than 1,000 yuan but not more than 5,000 yuan shall be imposed on individuals, and a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed on units:
(一)在长城上取土、取砖(石)或者种植作物的；
(1) Taking soil, bricks (stones), or planting crops on the Great Wall;
(二)有组织地在未辟为参观游览区的长城段落举行活动的。
(2) Organizing activities on sections of the Great Wall that have not been opened as tourist attractions.
行政机关有下列情形之一的，由上级行政机关责令改正，通报批评；对负有责任的主管人员和其他直接责任人员，依照文物保护法第七十六条的规定给予行政处分；情节严重的，依法开除公职：
If an administrative organ has one of the following circumstances, the superior administrative organ shall order corrections and circulate a notice of criticism; the responsible persons in charge and other directly responsible personnel shall be given administrative sanctions in accordance with Article 76 of the Cultural Relics Protection Law; if the circumstances are serious, they shall be dismissed from public office according to law:
(一)未依照本条例的规定，确定保护机构、划定保护范围或者建设控制地带、设立保护标志或者建立档案的；
(1) Failing to designate a protection agency, delimit a protection zone or construction control zone, set up protection signs, or establish archives in accordance with these regulations;
(二)发现不符合条件的长城段落辟为参观游览区未依法查处的；
(2) Discovering that a section of the Great Wall that does not meet the conditions has been opened as a tourist attraction without investigating and punishing according to law;
(三)有其他滥用职权、玩忽职守行为，造成长城损坏的。
(3) Other acts of abuse of power or dereliction of duty causing damage to the Great Wall.
保护机构有下列情形之一的，由长城所在地省、自治区、直辖市人民政府文物主管部门责令改正，对负有责任的主管人员和其他直接责任人员依法给予行政处分；情节严重的，依法开除公职：
If a protection agency has one of the following circumstances, the cultural relics administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the Great Wall is located shall order corrections, and the responsible persons in charge and other directly responsible personnel shall be given administrative sanctions according to law; if the circumstances are serious, they shall be dismissed from public office according to law:
(一)未对长城进行日常维护、监测或者未建立日志的；
(1) Failing to carry out daily maintenance, monitoring, or establish logs for the Great Wall;
(二)发现长城存在安全隐患，未采取控制措施或者未及时报告的。
(2) Discovering safety hazards in the Great Wall without taking control measures or failing to report in a timely manner.
本条例自2006年12月1日起施行。
These Regulations shall come into force as of December 1, 2006.
