为了加强对长城的保护,规范长城的利用行为,根据《中华人民共和国文物保护法》(以下简称文物保护法),制定本条例。

The competent department of cultural relics under the State Council is responsible for the overall protection of the Great Wall, coordinating and resolving major issues in Great Wall protection, and supervising and inspecting the Great Wall protection work of local governments along the Great Wall.

国家对长城保护实行专家咨询制度。制定长城保护总体规划、审批与长城有关的建设工程、决定与长城保护有关的其他重大事项,应当听取专家意见。

The state implements an expert consultation system for Great Wall protection. Expert opinions shall be solicited when formulating the overall plan for Great Wall protection, approving construction projects related to the Great Wall, and deciding other major matters related to Great Wall protection.

长城所在地省、自治区、直辖市人民政府应当对本行政区域内的长城进行调查;对认为属于长城的段落,应当报国务院文物主管部门认定,并自认定之日起1年内依法核定公布为省级文物保护单位。

TranslationArticle 9

The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government along the Great Wall shall conduct surveys of the Great Wall within their administrative regions; sections believed to be part of the Great Wall shall be reported to the competent department of cultural relics under the State Council for identification, and within one year from the date of identification, they shall be verified and announced as provincial-level cultural relic protection units in accordance with the law.

Translation

The competent department of cultural relics under the State Council, together with relevant departments under the State Council, shall formulate an overall plan for Great Wall protection based on the provisions of the Cultural Relics Protection Law and the actual needs of Great Wall protection, and submit it to the State Council for approval before implementation. The overall plan for Great Wall protection shall specify the protection standards and key points for the Great Wall, determine protection measures by category, and identify sections of the Great Wall where construction projects are prohibited within the protection zones.

The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government along the Great Wall shall, in accordance with the requirements of the overall plan for Great Wall protection, delineate the protection zones and construction control zones for the Great Wall within their administrative regions and announce them.

任何单位或者个人不得在长城保护总体规划禁止工程建设的保护范围内进行工程建设。在建设控制地带或者长城保护总体规划未禁止工程建设的保护范围内进行工程建设,应当遵守文物保护法第十七条、第十八条的规定。

No unit or individual may carry out construction projects within the protection zones where construction is prohibited by the overall plan for Great Wall protection. Construction projects within construction control zones or protection zones not prohibited by the overall plan for Great Wall protection shall comply with the provisions of Articles 17 and 18 of the Cultural Relics Protection Law.

Translation

Construction projects shall bypass the Great Wall. If it is impossible to bypass, the Great Wall shall be crossed by means of an underground passage; if an underground passage cannot be excavated, the Great Wall shall be crossed by means of a bridge. No unit or individual may dismantle, cross, or relocate the Great Wall during construction.

长城所在地省、自治区、直辖市人民政府应当在长城沿线的交通路口和其他需要提示公众的地段设立长城保护标志。设立长城保护标志不得对长城造成损坏。

TranslationArticle 13

The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government along the Great Wall shall set up Great Wall protection signs at traffic intersections along the Great Wall and other locations where the public needs to be reminded. The installation of Great Wall protection signs shall not cause damage to the Great Wall.

The people's government of the province, autonomous region, or municipality directly under the Central Government where the Great Wall is located shall establish archives of the Great Wall within its administrative region, and its cultural relics administrative department shall report the Great Wall archives to the cultural relics administrative department of the State Council for recordation.

TranslationArticle 15

The people's government of the province, autonomous region, or municipality directly under the Central Government where the Great Wall is located shall designate a protection institution for each section of the Great Wall within its administrative region; if a section of the Great Wall has a user unit, that user unit may be designated as the protection institution.

The protection institution shall carry out daily maintenance and monitoring of the Great Wall section under its responsibility, and establish logs; if it discovers a safety hazard, it shall immediately take control measures and promptly report to the cultural relics administrative department of the county people's government.

地处偏远、没有利用单位的长城段落,所在地县级人民政府或者其文物主管部门可以聘请长城保护员对长城进行巡查、看护,并对长城保护员给予适当补助。

For remote sections of the Great Wall without a user unit, the county people's government or its cultural relics administrative department may hire Great Wall protection personnel to patrol and guard the Great Wall, and provide appropriate subsidies to the Great Wall protection personnel.

To open a section of the Great Wall as a tourist area, the principles of scientific planning and original state protection shall be adhered to, and the following conditions shall be met:

将长城段落辟为参观游览区,应当自辟为参观游览区之日起5日内向所在地省、自治区、直辖市人民政府文物主管部门备案;长城段落属于全国重点文物保护单位的,应当自辟为参观游览区之日起5日内向国务院文物主管部门备案。备案材料应当包括参观游览区的旅游容量指标。

TranslationArticle 20

If a section of the Great Wall is opened as a tourist area, it shall be reported to the cultural relics administrative department of the province, autonomous region, or municipality directly under the Central Government for recordation within 5 days from the date of opening; if the Great Wall section is a major historical and cultural site protected at the national level, it shall be reported to the cultural relics administrative department of the State Council for recordation within 5 days from the date of opening. The recordation materials shall include the tourist capacity indicators of the tourist area.

任何单位或者个人发现长城遭受损坏向保护机构或者所在地县级人民政府文物主管部门报告的,接到报告的保护机构或者县级人民政府文物主管部门应当立即采取控制措施,并向县级人民政府和上一级人民政府文物主管部门报告。

If any unit or individual discovers damage to the Great Wall and reports it to the protection institution or the cultural relics administrative department of the county people's government, the protection institution or the county cultural relics administrative department that receives the report shall immediately take control measures and report to the county people's government and the cultural relics administrative department of the next higher level.

Repairs to the Great Wall shall be subject to approval procedures in accordance with the provisions of the Cultural Relics Protection Law, and shall be undertaken by units that have lawfully obtained qualification certificates for cultural relics protection projects. 违反本条例规定,造成长城损毁,构成犯罪的,依法追究刑事责任;尚不构成犯罪,违反有关治安管理的法律规定的,由公安机关依法给予治安处罚。

TranslationArticle 24

Whoever violates these regulations, causing damage to the Great Wall, if constituting a crime, shall be investigated for criminal liability according to law; if not constituting a crime but violating the legal provisions on public security administration, the public security organ shall impose public security penalties according to law.

Whoever violates these regulations and has one of the following circumstances shall be ordered to make corrections in accordance with Article 66 of the Cultural Relics Protection Law; if serious consequences are caused, a fine of not less than 50,000 yuan but not more than 500,000 yuan shall be imposed; if the circumstances are serious, the original issuing authority shall revoke the qualification certificate:

将不符合本条例规定条件的长城段落辟为参观游览区的,由省级以上人民政府文物主管部门按照职权划分依法取缔,没收违法所得;造成长城损坏的,处5万元以上50万元以下的罚款。

TranslationArticle 26

If a section of the Great Wall that does not meet the conditions prescribed by these regulations is opened as a tourist attraction, the cultural relics administrative department of the people's government at or above the provincial level shall, according to the division of powers, ban it and confiscate the illegal gains; if damage is caused to the Great Wall, a fine of not less than 50,000 yuan but not more than 500,000 yuan shall be imposed.

Translation

If a section of the Great Wall is opened as a tourist attraction without filing as required by these regulations, the cultural relics administrative department of the people's government at or above the provincial level shall, according to the division of powers, order corrections within a time limit; if no correction is made within the time limit, a penalty shall be imposed in accordance with the preceding paragraph.

Whoever violates these regulations and has one of the following circumstances shall be ordered to make corrections by the cultural relics administrative department of the county people's government; if serious consequences are caused, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed on individuals, and a fine of not less than 50,000 yuan but not more than 500,000 yuan shall be imposed on units:

违反本条例规定,有下列情形之一的,由县级人民政府文物主管部门责令改正,给予警告;情节严重的,对个人并处1000元以上5000元以下的罚款,对单位并处1万元以上5万元以下的罚款:

Whoever violates these regulations and has one of the following circumstances shall be ordered to make corrections and given a warning by the cultural relics administrative department of the county people's government; if the circumstances are serious, a fine of not less than 1,000 yuan but not more than 5,000 yuan shall be imposed on individuals, and a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed on units:

行政机关有下列情形之一的,由上级行政机关责令改正,通报批评;对负有责任的主管人员和其他直接责任人员,依照文物保护法第七十六条的规定给予行政处分;情节严重的,依法开除公职:

If an administrative organ has one of the following circumstances, the superior administrative organ shall order corrections and circulate a notice of criticism; the responsible persons in charge and other directly responsible personnel shall be given administrative sanctions in accordance with Article 76 of the Cultural Relics Protection Law; if the circumstances are serious, they shall be dismissed from public office according to law:
