Administrative Measures for the Verification of Working Measuring Instruments

为适应社会主义现代化建设需要，维护国家和消费者的利益，保护人民健康和生命、财产的安全，加强对强制检定的工作计量器具的管理，根据《中华人民共和国计量法》第九条的规定，制定本办法。
This Measure is formulated in accordance with the provisions of Article 9 of the Metrology Law of the People's Republic of China, in order to meet the needs of socialist modernization, safeguard the interests of the state and consumers, protect people's health and the safety of life and property, and strengthen the management of mandatory verification of working measuring instruments.
强制检定是指由县级以上人民政府计量行政部门所属或者授权的计量检定机构，对用于贸易结算、安全防护、医疗卫生、环境监测方面，并列入本办法所附《中华人民共和国强制检定的工作计量器具目录》的计量器具实行定点定期检定。
Mandatory verification refers to the fixed-point and periodic verification carried out by metrological verification institutions affiliated with or authorized by the metrological administrative departments of people's governments at or above the county level, for measuring instruments used in trade settlement, safety protection, medical care, and environmental monitoring, and included in the attached "Catalogue of Working Measuring Instruments Subject to Mandatory Verification of the People's Republic of China."
进行强制检定工作及使用强制检定的工作计量器具，适用本办法。
This Measure applies to the conduct of mandatory verification work and the use of working measuring instruments subject to mandatory verification.
县级以上人民政府计量行政部门对本行政区域内的强制检定工作统一实施监督管理，并按照经济合理、就地就近的原则，指定所属或者授权的计量检定机构执行强制检定任务。
The metrological administrative departments of people's governments at or above the county level shall uniformly supervise and manage the mandatory verification work within their respective administrative regions, and designate affiliated or authorized metrological verification institutions to carry out mandatory verification tasks in accordance with the principles of economic rationality and local convenience.
县级以上人民政府计量行政部门所属计量检定机构，为实施国家强制检定所需要的计量标准和检定设施由当地人民政府负责配备。
The metrological standards and verification facilities required by the metrological verification institutions affiliated with the metrological administrative departments of people's governments at or above the county level for implementing national mandatory verification shall be equipped by the local people's government.
使用强制检定的工作计量器具的单位或者个人，必须按照规定将其使用的强制检定的工作计量器具登记造册，报当地县(市)级人民政府计量行政部门备案，并向其指定的计量检定机构申请周期检定。当地不能检定的，向上一级人民政府计量行政部门指定的计量检定机构申请周期检定。
Units or individuals using working measuring instruments subject to mandatory verification must, in accordance with regulations, register the mandatory verification instruments they use, report to the local county (city) level metrological administrative department for record, and apply to the designated metrological verification institution for periodic verification. If local verification is not possible, they shall apply to the metrological verification institution designated by the metrological administrative department at the next higher level for periodic verification.
强制检定的周期，由执行强制检定的计量检定机构根据计量检定规程确定。
The period of mandatory verification shall be determined by the metrological verification institution performing the mandatory verification in accordance with the metrological verification regulation.
属于强制检定的工作计量器具，未按照本办法规定申请检定或者经检定不合格的，任何单位或者个人不得使用。
No unit or individual may use any working measuring instrument subject to mandatory verification that has not been applied for verification in accordance with the provisions of this Measure or has failed the verification.
国务院计量行政部门和各省、自治区、直辖市人民政府计量行政部门应当对各种强制检定的工作计量器具作出检定期限的规定。执行强制检定工作的机构应当在规定期限内按时完成检定。
The metrological administrative department of the State Council and the metrological administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government shall stipulate the verification time limits for various working measuring instruments subject to mandatory verification. Institutions performing mandatory verification shall complete the verification within the prescribed time limits.
执行强制检定的机构对检定合格的计量器具，发给国家统一规定的检定证书、检定合格证或者在计量器具上加盖检定合格印；对检定不合格的，发给检定结果通知书或者注销原检定合格印、证。
For measuring instruments that pass verification, the institution performing mandatory verification shall issue a nationally unified verification certificate, verification qualification certificate, or affix a verification qualification stamp on the measuring instrument; for those that fail verification, it shall issue a verification result notice or cancel the original verification qualification stamp or certificate.
县级以上人民政府计量行政部门按照有利于管理、方便生产和使用的原则，结合本地区的实际情况，可以授权有关单位的计量检定机构在规定的范围内执行强制检定工作。
The metrological administrative departments of people's governments at or above the county level may, in accordance with the principles of facilitating management and convenient production and use, and considering the actual conditions of the region, authorize the metrological verification institutions of relevant units to carry out mandatory verification work within a specified scope.
被授权执行强制检定任务的机构，其相应的计量标准，应当接受计量基准或者社会公用计量标准的检定；执行强制检定的人员，必须经授权单位考核合格；授权单位应当对其检定工作进行监督。
The corresponding metrological standards of institutions authorized to perform mandatory verification tasks shall be subject to verification by metrological benchmarks or public metrological standards; personnel performing mandatory verification must pass the assessment by the authorizing unit; the authorizing unit shall supervise their verification work.
被授权执行强制检定任务的机构成为计量纠纷中当事人一方时，按照《中华人民共和国计量法实施细则》的有关规定处理。
When an institution authorized to perform mandatory verification tasks becomes a party to a metrological dispute, it shall be handled in accordance with the relevant provisions of the Implementing Regulations of the Metrology Law of the People's Republic of China.
企业、事业单位应当对强制检定的工作计量器具的使用加强管理，制定相应的规章制度，保证按照周期进行检定。
Enterprises and institutions shall strengthen the management of the use of working measuring instruments subject to mandatory verification, formulate corresponding rules and regulations, and ensure that verification is carried out according to the cycle.
使用强制检定的工作计量器具的任何单位或者个人，计量监督、管理人员和执行强制检定工作的计量检定人员，违反本办法规定的，按照《中华人民共和国计量法实施细则》的有关规定，追究法律责任。
Any unit or individual using working measuring instruments subject to mandatory verification, metrological supervisors and administrators, and metrological verification personnel performing mandatory verification work who violate the provisions of this Measure shall be investigated for legal liability in accordance with the relevant provisions of the Implementing Regulations of the Metrology Law of the People's Republic of China.
执行强制检定工作的机构，违反本办法第八条规定拖延检定期限的，应当按照送检单位的要求，及时安排检定，并免收检定费。
If an institution performing mandatory verification delays the verification time limit in violation of Article 8 of this Measure, it shall promptly arrange verification at the request of the submitting unit and exempt the verification fee.
国务院计量行政部门可以根据本办法和《中华人民共和国强制检定的工作计量器具目录》，制定强制检定的工作计量器具的明细目录。
The metrological administrative department of the State Council may, based on this Measure and the "Catalogue of Working Measuring Instruments Subject to Mandatory Verification of the People's Republic of China," formulate a detailed catalogue of working measuring instruments subject to mandatory verification.
本办法由国务院计量行政部门负责解释。
This Measure shall be interpreted by the metrological administrative department of the State Council.
本办法自1987年7月1日起施行。
This Measure shall come into effect on July 1, 1987.
