总则
General Provisions
为了加强对城镇排水与污水处理的管理，保障城镇排水与污水处理设施安全运行，防治城镇水污染和内涝灾害，保障公民生命、财产安全和公共安全，保护环境，制定本条例。
This Ordinance is formulated to strengthen the management of urban drainage and sewage treatment, ensure the safe operation of urban drainage and sewage treatment facilities, prevent urban water pollution and waterlogging disasters, protect the life, property safety and public safety of citizens, and protect the environment.
城镇排水与污水处理的规划，城镇排水与污水处理设施的建设、维护与保护，向城镇排水设施排水与污水处理，以及城镇内涝防治，适用本条例。
This Ordinance applies to the planning of urban drainage and sewage treatment, the construction, maintenance and protection of urban drainage and sewage treatment facilities, the discharge of sewage into urban drainage facilities and sewage treatment, and the prevention and control of urban waterlogging.
县级以上人民政府应当加强对城镇排水与污水处理工作的领导，并将城镇排水与污水处理工作纳入国民经济和社会发展规划。
People's governments at or above the county level shall strengthen the leadership of urban drainage and sewage treatment work, and incorporate urban drainage and sewage treatment work into the national economic and social development plan.
城镇排水与污水处理应当遵循尊重自然、统筹规划、配套建设、保障安全、综合利用的原则。
Urban drainage and sewage treatment shall follow the principles of respecting nature, overall planning, supporting construction, ensuring safety, and comprehensive utilization.
国务院住房城乡建设主管部门指导监督全国城镇排水与污水处理工作。
The competent department of housing and urban-rural construction under the State Council shall guide and supervise the national urban drainage and sewage treatment work.
县级以上地方人民政府城镇排水与污水处理主管部门(以下称城镇排水主管部门)负责本行政区域内城镇排水与污水处理的监督管理工作。
The competent department of urban drainage and sewage treatment of the local people's government at or above the county level (hereinafter referred to as the competent department of urban drainage) shall be responsible for the supervision and management of urban drainage and sewage treatment within its administrative region.
县级以上人民政府其他有关部门依照本条例和其他有关法律、法规的规定，在各自的职责范围内负责城镇排水与污水处理监督管理的相关工作。
Other relevant departments of the people's government at or above the county level shall, in accordance with the provisions of this Ordinance and other relevant laws and regulations, be responsible for the relevant work of supervision and management of urban drainage and sewage treatment within their respective functions and duties.
国家鼓励采取特许经营、政府购买服务等多种形式，吸引社会资金参与投资、建设和运营城镇排水与污水处理设施。
The State encourages the adoption of various forms such as franchising and government purchase of services to attract social capital to participate in the investment, construction and operation of urban drainage and sewage treatment facilities.
县级以上人民政府鼓励、支持城镇排水与污水处理科学技术研究，推广应用先进适用的技术、工艺、设备和材料，促进污水的再生利用和污泥、雨水的资源化利用，提高城镇排水与污水处理能力。
People's governments at or above the county level encourage and support scientific and technological research on urban drainage and sewage treatment, promote the application of advanced and applicable technologies, processes, equipment, and materials, facilitate the reuse of sewage and the resource utilization of sludge and rainwater, and enhance the capacity for urban drainage and sewage treatment.
规划与建设
Planning and Construction
国务院住房城乡建设主管部门会同国务院有关部门，编制全国的城镇排水与污水处理规划，明确全国城镇排水与污水处理的中长期发展目标、发展战略、布局、任务以及保障措施等。
The competent department of housing and urban-rural development under the State Council, together with relevant departments under the State Council, shall formulate a national urban drainage and sewage treatment plan, specifying the medium- and long-term development goals, development strategies, layout, tasks, and safeguard measures for national urban drainage and sewage treatment.
城镇排水主管部门会同有关部门，根据当地经济社会发展水平以及地理、气候特征，编制本行政区域的城镇排水与污水处理规划，明确排水与污水处理目标与标准，排水量与排水模式，污水处理与再生利用、污泥处理处置要求，排涝措施，城镇排水与污水处理设施的规模、布局、建设时序和建设用地以及保障措施等；易发生内涝的城市、镇，还应当编制城镇内涝防治专项规划，并纳入本行政区域的城镇排水与污水处理规划。
The competent urban drainage department, together with relevant departments, shall, based on the local economic and social development level as well as geographical and climatic characteristics, formulate an urban drainage and sewage treatment plan for its administrative region, specifying the objectives and standards for drainage and sewage treatment, drainage volume and drainage mode, requirements for sewage treatment and reuse, sludge treatment and disposal, waterlogging prevention measures, and the scale, layout, construction schedule, and construction land for urban drainage and sewage treatment facilities, as well as safeguard measures; cities and towns prone to waterlogging shall also formulate a special plan for urban waterlogging prevention and incorporate it into the urban drainage and sewage treatment plan for their administrative region.
城镇排水与污水处理规划的编制，应当依据国民经济和社会发展规划、城乡规划、土地利用总体规划、水污染防治规划和防洪规划，并与城镇开发建设、道路、绿地、水系等专项规划相衔接。
The formulation of urban drainage and sewage treatment plans shall be based on the national economic and social development plan, urban and rural plan, overall land use plan, water pollution prevention plan, and flood prevention plan, and shall be coordinated with special plans for urban development and construction, roads, green spaces, and water systems.
城镇内涝防治专项规划的编制，应当根据城镇人口与规模、降雨规律、暴雨内涝风险等因素，合理确定内涝防治目标和要求，充分利用自然生态系统，提高雨水滞渗、调蓄和排放能力。
The formulation of a special plan for urban waterlogging prevention shall, based on factors such as urban population and scale, rainfall patterns, and rainstorm waterlogging risks, reasonably determine the objectives and requirements for waterlogging prevention, fully utilize natural ecosystems, and enhance the capacity for rainwater retention, regulation, storage, and discharge.
城镇排水主管部门应当将编制的城镇排水与污水处理规划报本级人民政府批准后组织实施，并报上一级人民政府城镇排水主管部门备案。
The competent urban drainage department shall submit the formulated urban drainage and sewage treatment plan to the people's government at the same level for approval before organizing its implementation, and shall report it to the competent urban drainage department of the people's government at the next higher level for recordation.
城镇排水与污水处理规划一经批准公布，应当严格执行；因经济社会发展确需修改的，应当按照原审批程序报送审批。
Once approved and published, the urban drainage and sewage treatment plan shall be strictly implemented; if modification is necessary due to economic and social development, it shall be submitted for approval in accordance with the original approval procedures.
县级以上地方人民政府应当根据城镇排水与污水处理规划的要求，加大对城镇排水与污水处理设施建设和维护的投入。
Local people's governments at or above the county level shall, in accordance with the requirements of the urban drainage and sewage treatment plan, increase investment in the construction and maintenance of urban drainage and sewage treatment facilities.
城乡规划和城镇排水与污水处理规划确定的城镇排水与污水处理设施建设用地，不得擅自改变用途。
The land designated for urban drainage and sewage treatment facilities as determined by the urban and rural plan and the urban drainage and sewage treatment plan shall not be arbitrarily changed in use.
县级以上地方人民政府应当按照先规划后建设的原则，依据城镇排水与污水处理规划，合理确定城镇排水与污水处理设施建设标准，统筹安排管网、泵站、污水处理厂以及污泥处理处置、再生水利用、雨水调蓄和排放等排水与污水处理设施建设和改造。
Local people's governments at or above the county level shall, in accordance with the principle of planning before construction and based on the urban drainage and sewage treatment plan, reasonably determine the construction standards for urban drainage and sewage treatment facilities, and make overall arrangements for the construction and renovation of drainage and sewage treatment facilities including pipeline networks, pumping stations, sewage treatment plants, as well as sludge treatment and disposal, reclaimed water utilization, rainwater regulation and storage, and discharge.
城镇新区的开发和建设，应当按照城镇排水与污水处理规划确定的建设时序，优先安排排水与污水处理设施建设；未建或者已建但未达到国家有关标准的，应当按照年度改造计划进行改造，提高城镇排水与污水处理能力。
The development and construction of new urban areas shall prioritize the construction of drainage and sewage treatment facilities in accordance with the construction schedule determined by the urban drainage and sewage treatment plan; if such facilities have not been built or have been built but do not meet relevant national standards, renovation shall be carried out according to the annual renovation plan to improve urban drainage and sewage treatment capacity.
县级以上地方人民政府应当按照城镇排涝要求，结合城镇用地性质和条件，加强雨水管网、泵站以及雨水调蓄、超标雨水径流排放等设施建设和改造。
Local people's governments at or above the county level shall, in accordance with urban waterlogging prevention requirements and considering the nature and conditions of urban land use, strengthen the construction and renovation of facilities such as rainwater pipeline networks, pumping stations, rainwater regulation and storage, and excess stormwater runoff discharge.
新建、改建、扩建市政基础设施工程应当配套建设雨水收集利用设施，增加绿地、砂石地面、可渗透路面和自然地面对雨水的滞渗能力，利用建筑物、停车场、广场、道路等建设雨水收集利用设施，削减雨水径流，提高城镇内涝防治能力。
New construction, renovation, and expansion of municipal infrastructure projects shall include supporting rainwater collection and utilization facilities, increase the capacity of green spaces, gravel surfaces, permeable pavements, and natural surfaces to retain and infiltrate rainwater, and utilize buildings, parking lots, squares, roads, etc., to construct rainwater collection and utilization facilities, thereby reducing rainwater runoff and improving urban waterlogging prevention capacity.
新区建设与旧城区改建，应当按照城镇排水与污水处理规划确定的雨水径流控制要求建设相关设施。
The construction of new areas and the renovation of old urban areas shall build relevant facilities in accordance with the rainwater runoff control requirements determined by the urban drainage and sewage treatment plan.
城镇排水与污水处理规划范围内的城镇排水与污水处理设施建设项目以及需要与城镇排水与污水处理设施相连接的新建、改建、扩建建设工程，城乡规划主管部门在依法核发建设用地规划许可证时，应当征求城镇排水主管部门的意见。城镇排水主管部门应当就排水设计方案是否符合城镇排水与污水处理规划和相关标准提出意见。
For construction projects of urban drainage and sewage treatment facilities within the scope of the urban drainage and sewage treatment plan, as well as new construction, renovation, and expansion projects that need to be connected to urban drainage and sewage treatment facilities, the competent department of urban and rural planning shall, when legally issuing a construction land planning permit, seek the opinions of the competent department of urban drainage. The competent department of urban drainage shall provide opinions on whether the drainage design plan complies with the urban drainage and sewage treatment plan and relevant standards.
建设单位应当按照排水设计方案建设连接管网等设施；未建设连接管网等设施的，不得投入使用。城镇排水主管部门或者其委托的专门机构应当加强指导和监督。
The construction unit shall construct connecting pipeline networks and other facilities in accordance with the drainage design plan; if such connecting pipeline networks and other facilities are not constructed, the project shall not be put into use. The competent department of urban drainage or its entrusted specialized agency shall strengthen guidance and supervision.
城镇排水与污水处理设施建设工程竣工后，建设单位应当依法组织竣工验收。竣工验收合格的，方可交付使用，并自竣工验收合格之日起15日内，将竣工验收报告及相关资料报城镇排水主管部门备案。
After the completion of an urban drainage and sewage treatment facility construction project, the construction unit shall legally organize a completion acceptance inspection. Only after passing the completion acceptance inspection may the facility be delivered for use, and within 15 days from the date of passing the completion acceptance inspection, the completion acceptance report and relevant materials shall be submitted to the competent department of urban drainage for recordation.
城镇排水与污水处理设施竣工验收合格后，由城镇排水主管部门通过招标投标、委托等方式确定符合条件的设施维护运营单位负责管理。特许经营合同、委托运营合同涉及污染物削减和污水处理运营服务费的，城镇排水主管部门应当征求环境保护主管部门、价格主管部门的意见。国家鼓励实施城镇污水处理特许经营制度。具体办法由国务院住房城乡建设主管部门会同国务院有关部门制定。
After the completion acceptance inspection of urban drainage and sewage treatment facilities, the competent department of urban drainage shall determine qualified facility maintenance and operation units through methods such as bidding or entrustment to be responsible for management. If the concession contract or entrustment operation contract involves pollutant reduction and sewage treatment operation service fees, the competent department of urban drainage shall seek opinions from the competent department of environmental protection and the competent department of pricing. The state encourages the implementation of a concession system for urban sewage treatment. Specific measures shall be formulated by the competent department of housing and urban-rural development of the State Council jointly with relevant departments of the State Council.
城镇排水与污水处理设施维护运营单位应当具备下列条件：
Facility maintenance and operation units for urban drainage and sewage treatment shall meet the following conditions:
(一)有法人资格；
(1) Have legal person status;
(二)有与从事城镇排水与污水处理设施维护运营活动相适应的资金和设备；
(2) Have funds and equipment suitable for engaging in urban drainage and sewage treatment facility maintenance and operation activities;
(三)有完善的运行管理和安全管理制度；
(3) Have comprehensive operation management and safety management systems;
(四)技术负责人和关键岗位人员经专业培训并考核合格；
(4) The technical leader and key personnel have received professional training and passed assessments;
(五)有相应的良好业绩和维护运营经验；
(5) Have corresponding good performance and maintenance operation experience;
(六)法律、法规规定的其他条件。
(6) Other conditions stipulated by laws and regulations.
排水
Drainage
县级以上地方人民政府应当根据当地降雨规律和暴雨内涝风险情况，结合气象、水文资料，建立排水设施地理信息系统，加强雨水排放管理，提高城镇内涝防治水平。
Local people's governments at or above the county level shall, based on local rainfall patterns and rainstorm waterlogging risk conditions, combined with meteorological and hydrological data, establish a drainage facility geographic information system, strengthen rainwater discharge management, and improve the level of urban waterlogging prevention and control.
县级以上地方人民政府应当组织有关部门、单位采取相应的预防治理措施，建立城镇内涝防治预警、会商、联动机制，发挥河道行洪能力和水库、洼淀、湖泊调蓄洪水的功能，加强对城镇排水设施的管理和河道防护、整治，因地制宜地采取定期清淤疏浚等措施，确保雨水排放畅通，共同做好城镇内涝防治工作。
Local people's governments at or above the county level shall organize relevant departments and units to take corresponding preventive and control measures, establish an urban waterlogging prevention and control early warning, consultation, and linkage mechanism, leverage the flood discharge capacity of river channels and the flood storage functions of reservoirs, depressions, and lakes, strengthen the management of urban drainage facilities and river channel protection and remediation, and take measures such as regular dredging according to local conditions to ensure smooth rainwater discharge, and jointly do a good job in urban waterlogging prevention and control.
城镇排水主管部门应当按照城镇内涝防治专项规划的要求，确定雨水收集利用设施建设标准，明确雨水的排水分区和排水出路，合理控制雨水径流。
The competent urban drainage department shall, in accordance with the requirements of the special plan for urban waterlogging prevention and control, determine the construction standards for rainwater collection and utilization facilities, clarify the drainage zones and drainage outlets for rainwater, and reasonably control rainwater runoff.
除干旱地区外，新区建设应当实行雨水、污水分流；对实行雨水、污水合流的地区，应当按照城镇排水与污水处理规划要求，进行雨水、污水分流改造。雨水、污水分流改造可以结合旧城区改建和道路建设同时进行。
Except in arid areas, new district construction shall implement rainwater and sewage diversion; in areas where rainwater and sewage are combined, diversion renovation shall be carried out in accordance with the urban drainage and sewage treatment plan. Rainwater and sewage diversion renovation may be carried out concurrently with old city reconstruction and road construction.
在雨水、污水分流地区，新区建设和旧城区改建不得将雨水管网、污水管网相互混接。
In rainwater and sewage diversion areas, new district construction and old city reconstruction shall not mix rainwater pipelines with sewage pipelines.
在有条件的地区，应当逐步推进初期雨水收集与处理，合理确定截流倍数，通过设置初期雨水贮存池、建设截流干管等方式，加强对初期雨水的排放调控和污染防治。
In areas where conditions permit, the collection and treatment of initial rainwater shall be gradually promoted, the interception ratio shall be reasonably determined, and measures such as setting up initial rainwater storage tanks and constructing interception trunk pipelines shall be adopted to strengthen the discharge regulation and pollution prevention of initial rainwater.
城镇排水设施覆盖范围内的排水单位和个人，应当按照国家有关规定将污水排入城镇排水设施。
Units and individuals within the coverage of urban drainage facilities shall discharge sewage into urban drainage facilities in accordance with relevant national regulations.
在雨水、污水分流地区，不得将污水排入雨水管网。
In rainwater and sewage diversion areas, sewage shall not be discharged into rainwater pipelines.
从事工业、建筑、餐饮、医疗等活动的企业事业单位、个体工商户(以下称排水户)向城镇排水设施排放污水的，应当向城镇排水主管部门申请领取污水排入排水管网许可证。城镇排水主管部门应当按照国家有关标准，重点对影响城镇排水与污水处理设施安全运行的事项进行审查。
Enterprises, institutions, and individual industrial and commercial households (hereinafter referred to as drainage entities) engaged in industrial, construction, catering, medical and other activities that discharge sewage into urban drainage facilities shall apply to the competent urban drainage department for a sewage discharge permit. The competent urban drainage department shall, in accordance with relevant national standards, focus on reviewing matters affecting the safe operation of urban drainage and sewage treatment facilities.
排水户应当按照污水排入排水管网许可证的要求排放污水。
Drainage entities shall discharge sewage in accordance with the requirements of the sewage discharge permit.
排水户申请领取污水排入排水管网许可证应当具备下列条件：
To apply for a sewage discharge permit, a drainage entity shall meet the following conditions:
(一)排放口的设置符合城镇排水与污水处理规划的要求；
(1) The setting of the discharge outlet meets the requirements of the urban drainage and sewage treatment plan;
(二)按照国家有关规定建设相应的预处理设施和水质、水量检测设施；
(2) Corresponding pretreatment facilities and water quality and quantity monitoring facilities have been constructed in accordance with relevant national regulations;
(三)排放的污水符合国家或者地方规定的有关排放标准；
(3) The discharged sewage meets the relevant discharge standards prescribed by the state or local authorities;
(四)法律、法规规定的其他条件。
(4) Other conditions prescribed by laws and regulations.
符合前款规定条件的，由城镇排水主管部门核发污水排入排水管网许可证；具体办法由国务院住房城乡建设主管部门制定。
If the conditions specified in the preceding paragraph are met, the urban drainage authority shall issue a permit for discharging sewage into the drainage network; the specific measures shall be formulated by the housing and urban-rural construction authority of the State Council.
城镇排水主管部门应当加强对排放口设置以及预处理设施和水质、水量检测设施建设的指导和监督；对不符合规划要求或者国家有关规定的，应当要求排水户采取措施，限期整改。
The urban drainage authority shall strengthen guidance and supervision over the installation of discharge outlets, pretreatment facilities, and water quality and quantity monitoring facilities; if they do not meet planning requirements or relevant state regulations, the drainage entity shall be required to take measures and make corrections within a time limit.
城镇排水主管部门委托的排水监测机构，应当对排水户排放污水的水质和水量进行监测，并建立排水监测档案。排水户应当接受监测，如实提供有关资料。
The drainage monitoring institution entrusted by the urban drainage authority shall monitor the water quality and quantity of sewage discharged by drainage entities and establish drainage monitoring files. Drainage entities shall accept monitoring and truthfully provide relevant information.
列入重点排污单位名录的排水户安装的水污染物排放自动监测设备，应当与环境保护主管部门的监控设备联网。环境保护主管部门应当将监测数据与城镇排水主管部门共享。
Drainage entities included in the list of key pollutant-discharging units shall have their automatic water pollutant discharge monitoring equipment connected to the monitoring system of the environmental protection authority. The environmental protection authority shall share monitoring data with the urban drainage authority.
因城镇排水设施维护或者检修可能对排水造成影响的，城镇排水设施维护运营单位应当提前24小时通知相关排水户；可能对排水造成严重影响的，应当事先向城镇排水主管部门报告，采取应急处理措施，并向社会公告。
If maintenance or repair of urban drainage facilities may affect drainage, the operation and maintenance entity of the urban drainage facilities shall notify the relevant drainage entities at least 24 hours in advance; if it may cause a serious impact on drainage, it shall report to the urban drainage authority in advance, take emergency measures, and make a public announcement.
设置于机动车道路上的窨井，应当按照国家有关规定进行建设，保证其承载力和稳定性等符合相关要求。
Manholes installed on motor vehicle roads shall be constructed in accordance with relevant state regulations to ensure that their load-bearing capacity and stability meet relevant requirements.
排水管网窨井盖应当具备防坠落和防盗窃功能，满足结构强度要求。
Drainage network manhole covers shall have anti-fall and anti-theft functions and meet structural strength requirements.
城镇排水主管部门应当按照国家有关规定建立城镇排涝风险评估制度和灾害后评估制度，在汛前对城镇排水设施进行全面检查，对发现的问题，责成有关单位限期处理，并加强城镇广场、立交桥下、地下构筑物、棚户区等易涝点的治理，强化排涝措施，增加必要的强制排水设施和装备。
The urban drainage authority shall, in accordance with relevant state regulations, establish an urban waterlogging risk assessment system and a post-disaster assessment system, conduct a comprehensive inspection of urban drainage facilities before the flood season, order relevant units to address identified issues within a time limit, and strengthen the management of waterlogging-prone areas such as urban squares, underpasses, underground structures, and shantytowns, enhance drainage measures, and add necessary forced drainage facilities and equipment.
城镇排水设施维护运营单位应当按照防汛要求，对城镇排水设施进行全面检查、维护、清疏，确保设施安全运行。
Urban drainage facility maintenance and operation units shall, in accordance with flood prevention requirements, conduct comprehensive inspection, maintenance, and dredging of urban drainage facilities to ensure safe operation.
在汛期，有管辖权的人民政府防汛指挥机构应当加强对易涝点的巡查，发现险情，立即采取措施。有关单位和个人在汛期应当服从有管辖权的人民政府防汛指挥机构的统一调度指挥或者监督。
During the flood season, the flood control command organization of the people's government with jurisdiction shall strengthen patrols of areas prone to waterlogging, and take immediate measures upon discovering danger. Relevant units and individuals shall, during the flood season, comply with the unified dispatch, command, or supervision of the flood control command organization of the people's government with jurisdiction.
污水处理
Sewage Treatment
城镇排水主管部门应当与城镇污水处理设施维护运营单位签订维护运营合同，明确双方权利义务。
The urban drainage competent department shall sign a maintenance and operation contract with the urban sewage treatment facility maintenance and operation unit, specifying the rights and obligations of both parties.
城镇污水处理设施维护运营单位应当依照法律、法规和有关规定以及维护运营合同进行维护运营，定期向社会公开有关维护运营信息，并接受相关部门和社会公众的监督。
Urban sewage treatment facility maintenance and operation units shall carry out maintenance and operation in accordance with laws, regulations, relevant provisions, and the maintenance and operation contract, regularly disclose relevant maintenance and operation information to the public, and accept supervision from relevant departments and the public.
城镇污水处理设施维护运营单位应当保证出水水质符合国家和地方规定的排放标准，不得排放不达标污水。
Urban sewage treatment facility maintenance and operation units shall ensure that the effluent quality meets the national and local discharge standards, and shall not discharge substandard sewage.
城镇污水处理设施维护运营单位应当按照国家有关规定检测进出水水质，向城镇排水主管部门、环境保护主管部门报送污水处理水质和水量、主要污染物削减量等信息，并按照有关规定和维护运营合同，向城镇排水主管部门报送生产运营成本等信息。
Urban sewage treatment facility maintenance and operation units shall, in accordance with relevant national regulations, test the influent and effluent water quality, report information such as sewage treatment water quality and quantity, and reduction of major pollutants to the urban drainage competent department and the environmental protection competent department, and report production and operation cost information to the urban drainage competent department in accordance with relevant regulations and the maintenance and operation contract.
城镇污水处理设施维护运营单位应当按照国家有关规定向价格主管部门提交相关成本信息。
Urban sewage treatment facility maintenance and operation units shall, in accordance with relevant national regulations, submit relevant cost information to the price competent department.
城镇排水主管部门核定城镇污水处理运营成本，应当考虑主要污染物削减情况。
When verifying the operation cost of urban sewage treatment, the urban drainage competent department shall consider the reduction of major pollutants.

排水单位和个人应当按照国家有关规定缴纳污水处理费。

排水监测机构接受城镇排水主管部门委托从事有关监测活动，不得向城镇污水处理设施维护运营单位和排水户收取任何费用。

污水处理费应当纳入地方财政预算管理，专项用于城镇污水处理设施的建设、运行和污泥处理处置，不得挪作他用。污水处理费的收费标准不应低于城镇污水处理设施正常运营的成本。因特殊原因，收取的污水处理费不足以支付城镇污水处理设施正常运营的成本的，地方人民政府给予补贴。

城镇排水主管部门应当根据城镇污水处理设施维护运营单位履行维护运营合同的情况以及环境保护主管部门对城镇污水处理设施出水水质和水量的监督检查结果，核定城镇污水处理设施运营服务费。地方人民政府有关部门应当及时、足额拨付城镇污水处理设施运营服务费。

设施维护与保护

城镇排水与污水处理设施维护运营单位应当建立健全安全生产管理制度，加强对窨井盖等城镇排水与污水处理设施的日常巡查、维修和养护，保障设施安全运行。
The operation and maintenance unit of urban drainage and sewage treatment facilities shall establish and improve the safety production management system, strengthen daily inspection, repair, and maintenance of manhole covers and other urban drainage and sewage treatment facilities, and ensure the safe operation of the facilities.
从事管网维护、应急排水、井下及有限空间作业的，设施维护运营单位应当安排专门人员进行现场安全管理，设置醒目警示标志，采取有效措施避免人员坠落、车辆陷落，并及时复原窨井盖，确保操作规程的遵守和安全措施的落实。相关特种作业人员，应当按照国家有关规定取得相应的资格证书。

禁止从事下列危及城镇排水与污水处理设施安全的活动：
The following activities that endanger the safety of urban drainage and sewage treatment facilities are prohibited:
(一)损毁、盗窃城镇排水与污水处理设施；
(1) Damaging or stealing urban drainage and sewage treatment facilities;
(二)穿凿、堵塞城镇排水与污水处理设施；
(2) Piercing or blocking urban drainage and sewage treatment facilities;
(三)向城镇排水与污水处理设施排放、倾倒剧毒、易燃易爆、腐蚀性废液和废渣；
(3) Discharging or dumping highly toxic, flammable, explosive, corrosive waste liquids and residues into urban drainage and sewage treatment facilities.
(四)向城镇排水与污水处理设施倾倒垃圾、渣土、施工泥浆等废弃物；
(4) Dumping waste such as garbage, slag, or construction mud into urban drainage and sewage treatment facilities;
(五)建设占压城镇排水与污水处理设施的建筑物、构筑物或者其他设施；
(5) Constructing buildings, structures, or other facilities that press on urban drainage and sewage treatment facilities;
(六)其他危及城镇排水与污水处理设施安全的活动。
(6) Other activities that endanger the safety of urban drainage and sewage treatment facilities.
新建、改建、扩建建设工程，不得影响城镇排水与污水处理设施安全。
New construction, renovation, or expansion projects shall not affect the safety of urban drainage and sewage treatment facilities.
建设工程开工前，建设单位应当查明工程建设范围内地下城镇排水与污水处理设施的相关情况。城镇排水主管部门及其他相关部门和单位应当及时提供相关资料。

建设工程施工范围内有排水管网等城镇排水与污水处理设施的，建设单位应当与施工单位、设施维护运营单位共同制定设施保护方案，并采取相应的安全保护措施。
If there are drainage networks or other urban drainage and sewage treatment facilities within the construction area, the construction unit shall jointly develop a facility protection plan with the construction contractor and the facility maintenance and operation unit, and adopt corresponding safety protection measures.
因工程建设需要拆除、改动城镇排水与污水处理设施的，建设单位应当制定拆除、改动方案，报城镇排水主管部门审核，并承担重建、改建和采取临时措施的费用。

县级以上人民政府城镇排水主管部门应当会同有关部门，加强对城镇排水与污水处理设施运行维护和保护情况的监督检查，并将检查情况及结果向社会公开。实施监督检查时，有权采取下列措施：

被监督检查的单位和个人应当予以配合，不得妨碍和阻挠依法进行的监督检查活动。

审计机关应当加强对城镇排水与污水处理设施建设、运营、维护和保护等资金筹集、管理和使用情况的监督，并公布审计结果。

违反本条例规定，县级以上地方人民政府及其城镇排水主管部门和其他有关部门，不依法作出行政许可或者办理批准文件的，发现违法行为或者接到对违法行为的举报不予查处的，或者有其他未依照本条例履行职责的行为的，对直接负责的主管人员和其他直接责任人员依法给予处分；直接负责的主管人员和其他直接责任人员的行为构成犯罪的，依法追究刑事责任。

违反本条例规定，因城镇排水设施维护或者检修可能对排水造成影响或者严重影响，城镇排水设施维护运营单位未提前通知相关排水户的，或者未事先向城镇排水主管部门报告，采取应急处理措施的，或者未按照防汛要求对城镇排水设施进行全面检查、维护、清疏，影响汛期排水畅通的，由城镇排水主管部门责令改正，给予警告；逾期不改正或者造成严重后果的，处10万元以上20万元以下罚款；造成损失的，依法承担赔偿责任。

In violation of these regulations, if a drainage unit or individual fails to pay sewage treatment fees, the urban drainagecompetent authority shall order payment within a time limit; if payment is refused beyond the time limit, a fine of not less than one time but not more than three times the amount of sewage treatment fees payable shall be imposed.
违反本条例规定，城镇排水与污水处理设施维护运营单位有下列情形之一的，由城镇排水主管部门责令改正，给予警告；逾期不改正或者造成严重后果的，处10万元以上50万元以下罚款；造成损失的，依法承担赔偿责任；构成犯罪的，依法追究刑事责任：
In violation of these regulations, if the operation unit of urban drainage and sewage treatment facilities has any of the following circumstances, the urban drainagecompetent authority shall order correction and give a warning; if correction is not made within the time limit or serious consequences are caused, a fine of not less than 100,000 yuan but not more than 500,000 yuan shall be imposed; if losses are caused, compensation liability shall be borne according to law; if a crime is constituted, criminal liability shall be pursued according to law:
(一)未按照国家有关规定履行日常巡查、维修和养护责任，保障设施安全运行的；
(1) Failing to perform daily inspection, repair, and maintenance responsibilities according to national regulations to ensure safe operation of facilities;
(二)未及时采取防护措施、组织事故抢修的；
(2) Failing to take protective measures in a timely manner or organize emergency repairs;
(三)因巡查、维护不到位，导致窨井盖丢失、损毁，造成人员伤亡和财产损失的。
(3) Failure to inspect and maintain, resulting in loss or damage of manhole covers, causing casualties or property damage.
违反本条例规定，从事危及城镇排水与污水处理设施安全的活动的，由城镇排水主管部门责令停止违法行为，限期恢复原状或者采取其他补救措施，给予警告；逾期不采取补救措施或者造成严重后果的，对单位处10万元以上30万元以下罚款，对个人处2万元以上10万元以下罚款；造成损失的，依法承担赔偿责任；构成犯罪的，依法追究刑事责任。
Whoever violates these regulations by engaging in activities that endanger the safety of urban drainage and sewage treatment facilities shall be ordered by the competent urban drainage department to cease the illegal act, restore the original condition or take other remedial measures within a specified period, and be given a warning; if remedial measures are not taken within the time limit or serious consequences are caused, a fine of not less than 100,000 yuan but not more than 300,000 yuan shall be imposed on the unit, and a fine of not less than 20,000 yuan but not more than 100,000 yuan shall be imposed on the individual; if losses are caused, compensation liability shall be borne according to law; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，有关单位未与施工单位、设施维护运营单位等共同制定设施保护方案，并采取相应的安全防护措施的，由城镇排水主管部门责令改正，处2万元以上5万元以下罚款；造成严重后果的，处5万元以上10万元以下罚款；造成损失的，依法承担赔偿责任；构成犯罪的，依法追究刑事责任。
Whoever violates these regulations by failing to jointly formulate a facility protection plan with the construction unit, facility maintenance and operation unit, etc., and take corresponding safety protection measures, shall be ordered by the competent urban drainage department to make corrections, and a fine of not less than 20,000 yuan but not more than 50,000 yuan shall be imposed; if serious consequences are caused, a fine of not less than 50,000 yuan but not more than 100,000 yuan shall be imposed; if losses are caused, compensation liability shall be borne according to law; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定，擅自拆除、改动城镇排水与污水处理设施的，由城镇排水主管部门责令改正，恢复原状或者采取其他补救措施，处5万元以上10万元以下罚款；造成严重后果的，处10万元以上30万元以下罚款；造成损失的，依法承担赔偿责任；构成犯罪的，依法追究刑事责任。
Whoever violates these regulations by unauthorized removal or alteration of urban drainage and sewage treatment facilities shall be ordered by the competent urban drainage department to make corrections, restore the original condition or take other remedial measures, and a fine of not less than 50,000 yuan but not more than 100,000 yuan shall be imposed; if serious consequences are caused, a fine of not less than 100,000 yuan but not more than 300,000 yuan shall be imposed; if losses are caused, compensation liability shall be borne according to law; if a crime is constituted, criminal liability shall be pursued according to law.
附则
Supplementary Provisions
依照《中华人民共和国水污染防治法》的规定，排水户需要取得排污许可证的，由环境保护主管部门核发；违反《中华人民共和国水污染防治法》的规定排放污水的，由环境保护主管部门处罚。
In accordance with the provisions of the Water Pollution Prevention and Control Law of the People's Republic of China, if a drainage household needs to obtain a pollutant discharge permit, it shall be issued by the competent environmental protection department; if sewage is discharged in violation of the Water Pollution Prevention and Control Law of the People's Republic of China, the competent environmental protection department shall impose penalties.
本条例自2014年1月1日起施行。
These Regulations shall come into force as of January 1, 2014.
