Unemployment Insurance Regulation

为了保障失业人员失业期间的基本生活，促进其再就业，制定本条例。

This Regulation is formulated to ensure the basic livelihood of unemployed persons during the period of unemployment and to promote their reemployment.

城镇企业事业单位、城镇企业事业单位职工依照本条例的规定，缴纳失业保险费。

Urban enterprises and institutions, and their employees, shall pay unemployment insurance premiums in accordance with the provisions of this Regulation.

城镇企业事业单位失业人员依照本条例的规定，享受失业保险待遇。

Unemployed persons from urban enterprises and institutions shall enjoy unemployment insurance benefits in accordance with the provisions of this Regulation.

本条所称城镇企业，是指国有企业、城镇集体企业、外商投资企业、城镇私营企业以及其他城镇企业。

For the purposes of this Article, 'urban enterprises' means state-owned enterprises, urban collective enterprises, foreign-invested enterprises, urban private enterprises, and other urban enterprises.

国务院劳动保障行政部门主管全国的失业保险工作。县级以上地方各级人民政府劳动保障行政部门主管本行政区域内的失业保险工作。劳动保障行政部门按照国务院规定设立的经办失业保险业务的社会保险经办机构依照本条例的规定，具体承办失业保险工作。

The labor and social security administrative department of the State Council shall be in charge of unemployment insurance work nationwide. The labor and social security administrative departments of local people's governments at or above the county level shall be in charge of unemployment insurance work within their respective administrative regions. Social insurance agencies established by the labor and social security administrative departments in accordance with the provisions of the State Council to handle unemployment insurance business shall specifically undertake unemployment insurance work in accordance with the provisions of this Regulation.

失业保险费按照国家有关规定征缴。

Unemployment insurance premiums shall be collected in accordance with the relevant provisions of the State.

失业保险基金由下列各项构成：

The unemployment insurance fund shall consist of the following components:

(一)城镇企业事业单位、城镇企业事业单位职工缴纳的失业保险费；

(1) unemployment insurance premiums paid by urban enterprises and institutions and their employees;

(二)失业保险基金的利息；

(2) interest on the unemployment insurance fund;

(三)财政补贴；

(3) financial subsidies;

(四)依法纳入失业保险基金的其他资金。

(4) other funds legally incorporated into the unemployment insurance fund.

城镇企业事业单位按照本单位工资总额的2%缴纳失业保险费。城镇企业事业单位职工按照本人工资的1%缴纳失业保险费。城镇企业事业单位招用的农民合同制工人本人不缴纳失业保险费。

Urban enterprises and institutions shall pay unemployment insurance premiums at a rate of 2% of their total payroll. Employees of urban enterprises and institutions shall pay unemployment insurance premiums at a rate of 1% of their own wages. Rural migrant workers employed under contract by urban enterprises and institutions are not required to pay unemployment insurance premiums.

失业保险基金在直辖市和设区的市实行全市统筹；其他地区的统筹层次由省、自治区人民政府规定。

The unemployment insurance fund shall be pooled at the municipal level in municipalities directly under the Central Government and cities divided into districts; the pooling level in other areas shall be determined by the people's governments of provinces and autonomous regions.

省、自治区可以建立失业保险调剂金。

Provinces and autonomous regions may establish unemployment insurance adjustment funds.

失业保险调剂金以统筹地区依法应当征收的失业保险费为基数，按照省、自治区人民政府规定的比例筹集。

The unemployment insurance adjustment fund shall be raised based on the unemployment insurance premiums legally collectible in the pooling areas, at a proportion determined by the people's government of the province or autonomous region.

统筹地区的失业保险基金不敷使用时，由失业保险调剂金调剂、地方财政补贴。

When the unemployment insurance fund in a pooling area is insufficient, it shall be supplemented by the unemployment insurance adjustment fund and local financial subsidies.

失业保险调剂金的筹集、调剂使用以及地方财政补贴的具体办法，由省、自治区人民政府规定。

Specific measures for the raising, adjustment, and use of the unemployment insurance adjustment fund, as well as local financial subsidies, shall be formulated by the people's governments of provinces and autonomous regions.

省、自治区、直辖市人民政府根据本行政区域失业人员数量和失业保险基金数额，报经国务院批准，可以适当调整本行政区域失业保险费的费率。

The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may, based on the number of unemployed persons and the amount of the unemployment insurance fund in their administrative regions, and with the approval of the State Council, appropriately adjust the unemployment insurance premium rate in their administrative regions.

失业保险基金用于下列支出：

The unemployment insurance fund shall be used for the following expenditures:

(一)失业保险金；

(1) unemployment insurance benefits;

(二)领取失业保险金期间的医疗补助金；

(2) medical subsidies during the period of receiving unemployment insurance benefits;

(三)领取失业保险金期间死亡的失业人员的丧葬补助金和其供养的配偶、直系亲属的抚恤金；

(3) funeral subsidies for unemployed persons who die during the period of receiving unemployment insurance benefits, and pensions for their dependent spouses and direct relatives;

(四)领取失业保险金期间接受职业培训、职业介绍的补贴，补贴的办法和标准由省、自治区、直辖市人民政府规定；

(4) Subsidies for vocational training and job placement services received during the period of receiving unemployment insurance benefits; the methods and standards for subsidies shall be prescribed by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government;

(五)国务院规定或者批准的与失业保险有关的其他费用。

(5) Other expenses related to unemployment insurance as prescribed or approved by the State Council.

失业保险基金必须存入财政部门在国有商业银行开设的社会保障基金财政专户，实行收支两条线管理，由财政部门依法进行监督。

The unemployment insurance fund must be deposited into the special financial account for social security funds opened by the financial department in state-owned commercial banks, managed under separate revenue and expenditure lines, and supervised by the financial department according to law.

存入银行和按照国家规定购买国债的失业保险基金，分别按照城乡居民同期存款利率和国债利息计息。失业保险基金的利息并入失业保险基金。

The unemployment insurance fund deposited in banks and used to purchase national bonds according to state regulations shall accrue interest at the deposit interest rate for urban and rural residents for the same period and at the interest rate for national bonds, respectively. The interest on the unemployment insurance fund shall be incorporated into the unemployment insurance fund.

失业保险基金专款专用，不得挪作他用，不得用于平衡财政收支。

The unemployment insurance fund shall be used exclusively for its designated purposes, shall not be misappropriated for other uses, and shall not be used to balance fiscal revenue and expenditure.

失业保险基金收支的预算、决算，由统筹地区社会保险经办机构编制，经同级劳动保障行政部门复核、同级财政部门审核，报同级人民政府审批。

The budget and final accounts of the unemployment insurance fund revenue and expenditure shall be prepared by the social insurance agency in the coordinated region, reviewed by the labor and social security administrative department at the same level, examined by the financial department at the same level, and submitted to the people's government at the same level for approval.

失业保险基金的财务制度和会计制度按照国家有关规定执行。

The financial and accounting systems of the unemployment insurance fund shall be implemented in accordance with relevant state regulations.

具备下列条件的失业人员，可以领取失业保险金：

Unemployed persons who meet the following conditions may receive unemployment insurance benefits:

(一)按照规定参加失业保险，所在单位和本人已按照规定履行缴费义务满1年的；

(1) They have participated in unemployment insurance in accordance with regulations, and the employer and the individual have fulfilled their contribution obligations for at least one year;

(二)非因本人意愿中断就业的；

(2) Their employment has been terminated involuntarily;

(三)已办理失业登记，并有求职要求的。

(3) They have registered as unemployed and have job-seeking requirements.

失业人员在领取失业保险金期间，按照规定同时享受其他失业保险待遇。

During the period of receiving unemployment insurance benefits, unemployed persons shall simultaneously enjoy other unemployment insurance benefits in accordance with regulations.

失业人员在领取失业保险金期间有下列情形之一的，停止领取失业保险金，并同时停止享受其他失业保险待遇：

If an unemployed person falls under any of the following circumstances during the period of receiving unemployment insurance benefits, the payment of unemployment insurance benefits shall be stopped, and the enjoyment of other unemployment insurance benefits shall also cease simultaneously:

(一)重新就业的；

(1) Re-employment;

(二)应征服兵役的；

(2) Enlistment in military service as required;

(三)移居境外的；

(3) Relocation abroad;

(四)享受基本养老保险待遇的；

(4) Enjoyment of basic old-age insurance benefits;

(五)被判刑收监执行或者被劳动教养的；

(5) Sentenced to imprisonment and incarcerated, or subjected to re-education through labor;

(六)无正当理由，拒不接受当地人民政府指定的部门或者机构介绍的工作的；

(6) Without justifiable reasons, refusal to accept a job introduced by the department or institution designated by the local people's government;

(七)有法律、行政法规规定的其他情形的。

(7) Other circumstances as prescribed by laws and administrative regulations.

城镇企业事业单位应当及时为失业人员出具终止或者解除劳动关系的证明，告知其按照规定享受失业保险待遇的权利，并将失业人员的名单自终止或者解除劳动关系之日起7日内报社会保险经办机构备案。

Urban enterprises and institutions shall promptly issue a certificate of termination or dissolution of labor relations to unemployed persons, inform them of their right to enjoy unemployment insurance benefits in accordance with regulations, and report the list of unemployed persons to the social insurance agency for record within 7 days from the date of termination or dissolution of labor relations.

城镇企业事业单位职工失业后，应当持本单位为其出具的终止或者解除劳动关系的证明，及时到指定的社会保险经办机构办理失业登记。失业保险金自办理失业登记之日起计算。

After the employees of urban enterprises and institutions become unemployed, they shall promptly go to the designated social insurance agency to register as unemployed with the certificate of termination or dissolution of labor relations issued by their employer. Unemployment insurance benefits shall be calculated from the date of unemployment registration.

失业保险金由社会保险经办机构按月发放。社会保险经办机构为失业人员开具领取失业保险金的单证，失业人员凭单证到指定银行领取失业保险金。

Unemployment insurance benefits shall be distributed monthly by the social insurance agency. The social insurance agency shall issue a voucher for receiving unemployment insurance benefits to the unemployed person, who shall then go to the designated bank with the voucher to receive the benefits.

失业人员失业前所在单位和本人按照规定累计缴费时间满1年不足5年的，领取失业保险金的期限最长为12个月；累计缴费时间满5年不足10年的，领取失业保险金的期限最长为18个月；累计缴费时间10年以上的，领取失业保险金的期限最长为24个月。重新就业后，再次失业的，缴费时间重新计算，领取失业保险金的期限可以与前次失业应领取而尚未领取的失业保险金的期限合并计算，但是最长不得超过24个月。

If the cumulative contribution time of the unemployed person and their employer before unemployment is at least 1 year but less than 5 years, the maximum period for receiving unemployment insurance benefits is 12 months; if the cumulative contribution time is at least 5 years but less than 10 years, the maximum period is 18 months; if the cumulative contribution time is 10 years or more, the maximum period is 24 months. After re-employment, if the person becomes unemployed again, the contribution time shall be recalculated, and the period for receiving unemployment insurance benefits may be combined with the period that was previously due but not yet received, but the total shall not exceed 24 months.

失业保险金的标准，按照低于当地最低工资标准、高于城市居民最低生活保障标准的水平，由省、自治区、直辖市人民政府确定。

The standard of unemployment insurance benefits shall be determined by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government, at a level lower than the local minimum wage standard and higher than the urban minimum living security standard.

失业人员在领取失业保险金期间患病就医的，可以按照规定向社会保险经办机构申请领取医疗补助金。医疗补助金的标准由省、自治区、直辖市人民政府规定。

If an unemployed person falls ill and seeks medical treatment while receiving unemployment insurance benefits, they may apply to the social insurance agency for medical subsidies in accordance with regulations. The standard of medical subsidies shall be stipulated by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government.

失业人员在领取失业保险金期间死亡的，参照当地对在职职工的规定，对其家属一次性发给丧葬补助金和抚恤金。

If an unemployed person dies while receiving unemployment insurance benefits, a one-time funeral subsidy and pension shall be paid to their family members with reference to the local regulations for on-the-job employees.

单位招用的农民合同制工人连续工作满1年，本单位并已缴纳失业保险费，劳动合同期满未续订或者提前解除劳动合同的，由社会保险经办机构根据其工作时间长短，对其支付一次性生活补助。补助的办法和标准由省、自治区、直辖市人民政府规定。

For farmer contract workers recruited by a unit who have worked continuously for a full year, with the unit having paid unemployment insurance premiums, and whose labor contract expires without renewal or is terminated early, the social insurance agency shall pay them a one-time living subsidy based on the length of their work. The method and standard of the subsidy shall be stipulated by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government.

城镇企业事业单位成建制跨统筹地区转移，失业人员跨统筹地区流动的，失业保险关系随之转迁。

When urban enterprises and institutions relocate across overall planning regions, or unemployed persons move across overall planning regions, their unemployment insurance relationship shall be transferred accordingly.

失业人员符合城市居民最低生活保障条件的，按照规定享受城市居民最低生活保障待遇。

Unemployed persons who meet the conditions for urban minimum living security shall enjoy urban minimum living security benefits in accordance with regulations.

劳动保障行政部门管理失业保险工作，履行下列职责：

The labor and social security administrative department shall manage unemployment insurance work and perform the following duties:

(一)贯彻实施失业保险法律、法规；

(1) Implement laws and regulations on unemployment insurance;

(二)指导社会保险经办机构的工作；

(2) Guide the work of social insurance agencies;

(三)对失业保险费的征收和失业保险待遇的支付进行监督检查。

(3) Supervise and inspect the collection of unemployment insurance premiums and the payment of unemployment insurance benefits.

社会保险经办机构具体承办失业保险工作，履行下列职责：

Social insurance agencies shall specifically undertake unemployment insurance work and perform the following duties:

(一)负责失业人员的登记、调查、统计；

(1) Be responsible for the registration, investigation, and statistics of unemployed persons;

(二)按照规定负责失业保险基金的管理；

(2) Be responsible for the management of the unemployment insurance fund in accordance with regulations;

(三)按照规定核定失业保险待遇，开具失业人员在指定银行领取失业保险金和其他补助金的单证；

(3) Determine unemployment insurance benefits in accordance with regulations, and issue documents for unemployed persons to receive unemployment insurance benefits and other subsidies at designated banks;

(四)拨付失业人员职业培训、职业介绍补贴费用；

(4) Allocate expenses for vocational training and job placement subsidies for unemployed persons;

(五)为失业人员提供免费咨询服务；

(5) Provide free consulting services for unemployed persons;

(六)国家规定由其履行的其他职责。

(6) Other duties as stipulated by the state.

财政部门和审计部门依法对失业保险基金的收支、管理情况进行监督。

The financial department and audit department shall supervise the revenue, expenditure, and management of the unemployment insurance fund in accordance with the law.

社会保险经办机构所需经费列入预算，由财政拨付。

The necessary expenses of social insurance agencies shall be included in the budget and allocated by the finance department.

不符合享受失业保险待遇条件，骗取失业保险金和其他失业保险待遇的，由社会保险经办机构责令退还；情节严重的，由劳动保障行政部门处骗取金额1倍以上3倍以下的罚款。

If a person who does not meet the conditions for receiving unemployment insurance benefits fraudulently obtains unemployment insurance benefits or other unemployment insurance benefits, the social insurance agency shall order the return of the benefits; if the circumstances are serious, the labor and social security administrative department shall impose a fine of not less than one time but not more than three times the amount fraudulently obtained.

社会保险经办机构工作人员违反规定向失业人员开具领取失业保险金或者享受其他失业保险待遇单证，致使失业保险基金损失的，由劳动保障行政部门责令追回；情节严重的，依法给予行政处分。

If a staff member of a social insurance agency, in violation of regulations, issues documents for an unemployed person to receive unemployment insurance benefits or other unemployment insurance benefits, thereby causing losses to the unemployment insurance fund, the labor and social security administrative department shall order the recovery of the losses; if the circumstances are serious, administrative sanctions shall be imposed in accordance with the law.

劳动保障行政部门和社会保险经办机构的工作人员滥用职权、徇私舞弊、玩忽职守，造成失业保险基金损失的，由劳动保障行政部门追回损失的失业保险基金；构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予行政处分。

If staff members of the labor and social security administrative department or social insurance agency abuse their power, engage in malpractice for personal gain, or neglect their duties, causing losses to the unemployment insurance fund, the labor and social security administrative department shall recover the lost unemployment insurance fund; if the act constitutes a crime, criminal liability shall be pursued in accordance with the law; if it does not constitute a crime, administrative sanctions shall be imposed in accordance with the law.

任何单位、个人挪用失业保险基金的，追回挪用的失业保险基金；有违法所得的，没收违法所得，并入失业保险基金；构成犯罪的，依法追究刑事责任；尚不构成犯罪的，对直接负责的主管人员和其他直接责任人员依法给予行政处分。

If any unit or individual misappropriates the unemployment insurance fund, the misappropriated fund shall be recovered; if there are illegal gains, they shall be confiscated and incorporated into the unemployment insurance fund; if the act constitutes a crime, criminal liability shall be pursued in accordance with the law; if it does not constitute a crime, administrative sanctions shall be imposed on the directly responsible supervisors and other directly responsible persons in accordance with the law.

省、自治区、直辖市人民政府根据当地实际情况，可以决定本条例适用于本行政区域内的社会团体及其专职人员、民办非企业单位及其职工、有雇工的城镇个体工商户及其雇工。

The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may, based on local actual conditions, decide that these Regulations apply to social organizations and their full-time personnel, private non-enterprise units and their employees, and urban individual businesses with employees and their hired workers within their administrative regions.

本条例自发布之日起施行。1993年4月12日国务院发布的《国有企业职工待业保险规定》同时废止。

These Regulations shall come into force as of the date of promulgation. The "Regulations on Unemployment Insurance for Employees of State-owned Enterprises" promulgated by the State Council on April 12, 1993, shall be simultaneously repealed.
