总则
General Provisions
为了加强危险化学品的安全管理，预防和减少危险化学品事故，保障人民群众生命财产安全，保护环境，制定本条例。
These Regulations are formulated to strengthen the safety management of hazardous chemicals, prevent and reduce hazardous chemical accidents, protect the safety of people's lives and property, and protect the environment.
危险化学品生产、储存、使用、经营和运输的安全管理，适用本条例。
These Regulations apply to the safety management of the production, storage, use, operation, and transportation of hazardous chemicals.
废弃危险化学品的处置，依照有关环境保护的法律、行政法规和国家有关规定执行。
The disposal of waste hazardous chemicals shall be carried out in accordance with the relevant environmental protection laws, administrative regulations, and state provisions.
本条例所称危险化学品，是指具有毒害、腐蚀、爆炸、燃烧、助燃等性质，对人体、设施、环境具有危害的剧毒化学品和其他化学品。
For the purposes of these Regulations, hazardous chemicals refer to highly toxic chemicals and other chemicals that have toxic, corrosive, explosive, combustible, or combustion-supporting properties and are harmful to humans, facilities, and the environment.
危险化学品目录，由国务院安全生产监督管理部门会同国务院工业和信息化、公安、环境保护、卫生、质量监督检验检疫、交通运输、铁路、民用航空、农业主管部门，根据化学品危险特性的鉴别和分类标准确定、公布，并适时调整。
The catalog of hazardous chemicals shall be determined and published by the safety production supervision and management department of the State Council jointly with the competent departments of industry and information technology, public security, environmental protection, health, quality supervision, inspection and quarantine, transportation, railway, civil aviation, and agriculture under the State Council, based on the identification and classification standards for chemical hazard characteristics, and shall be adjusted in a timely manner.
危险化学品安全管理，应当坚持安全第一、预防为主、综合治理的方针，强化和落实企业的主体责任。
The safety management of hazardous chemicals shall adhere to the principles of safety first, prevention-oriented, and comprehensive management, and shall strengthen and implement the primary responsibility of enterprises.
生产、储存、使用、经营、运输危险化学品的单位(以下统称危险化学品单位)的主要负责人对本单位的危险化学品安全管理工作全面负责。
The principal responsible person of a unit that produces, stores, uses, operates, or transports hazardous chemicals (hereinafter collectively referred to as hazardous chemical units) shall be fully responsible for the safety management of hazardous chemicals in that unit.
危险化学品单位应当具备法律、行政法规规定和国家标准、行业标准要求的安全条件，建立、健全安全管理规章制度和岗位安全责任制度，对从业人员进行安全教育、法制教育和岗位技术培训。从业人员应当接受教育和培训，考核合格后上岗作业；对有资格要求的岗位，应当配备依法取得相应资格的人员。
Hazardous chemical units shall have the safety conditions required by laws, administrative regulations, and national or industry standards; establish and improve safety management rules and post safety responsibility systems; and provide safety education, legal education, and post technical training to employees. Employees shall receive education and training and pass assessments before taking up posts; for positions with qualification requirements, personnel who have obtained corresponding qualifications according to law shall be assigned.
任何单位和个人不得生产、经营、使用国家禁止生产、经营、使用的危险化学品。
No unit or individual may produce, operate, or use hazardous chemicals that are prohibited by the state from being produced, operated, or used.
国家对危险化学品的使用有限制性规定的，任何单位和个人不得违反限制性规定使用危险化学品。
Where the state has restrictive provisions on the use of hazardous chemicals, no unit or individual may use hazardous chemicals in violation of such restrictive provisions.
对危险化学品的生产、储存、使用、经营、运输实施安全监督管理的有关部门(以下统称负有危险化学品安全监督管理职责的部门)，依照下列规定履行职责：
The relevant departments responsible for safety supervision and management of the production, storage, use, operation, and transportation of hazardous chemicals (hereinafter collectively referred to as departments with hazardous chemical safety supervision and management responsibilities) shall perform their duties in accordance with the following provisions:
(一)安全生产监督管理部门负责危险化学品安全监督管理综合工作，组织确定、公布、调整危险化学品目录，对新建、改建、扩建生产、储存危险化学品(包括使用长输管道输送危险化学品，下同)的建设项目进行安全条件审查，核发危险化学品安全生产许可证、危险化学品安全使用许可证和危险化学品经营许可证，并负责危险化学品登记工作。
(1) The safety production supervision and management department shall be responsible for the comprehensive work of hazardous chemical safety supervision and management; organize the determination, publication, and adjustment of the catalog of hazardous chemicals; conduct safety condition reviews for construction projects for the new construction, renovation, or expansion of production and storage of hazardous chemicals (including the transportation of hazardous chemicals through long-distance pipelines, the same below); issue hazardous chemical safety production licenses, hazardous chemical safety use licenses, and hazardous chemical operation licenses; and be responsible for the registration of hazardous chemicals.
(二)公安机关负责危险化学品的公共安全管理，核发剧毒化学品购买许可证、剧毒化学品道路运输通行证，并负责危险化学品运输车辆的道路交通安全管理。
(2) The public security department shall be responsible for the public safety management of hazardous chemicals; issue highly toxic chemical purchase permits and road transport permits for highly toxic chemicals; and be responsible for road traffic safety management of vehicles transporting hazardous chemicals.
(三)质量监督检验检疫部门负责核发危险化学品及其包装物、容器(不包括储存危险化学品的固定式大型储罐，下同)生产企业的工业产品生产许可证，并依法对其产品质量实施监督，负责对进出口危险化学品及其包装实施检验。
(3) The quality supervision, inspection and quarantine department shall be responsible for issuing industrial product production licenses for enterprises producing hazardous chemicals and their packaging and containers (excluding fixed large storage tanks for storing hazardous chemicals, the same below); supervise the quality of their products according to law; and be responsible for the inspection of imported and exported hazardous chemicals and their packaging.
(四)环境保护主管部门负责废弃危险化学品处置的监督管理，组织危险化学品的环境危害性鉴定和环境风险程度评估，确定实施重点环境管理的危险化学品，负责危险化学品环境管理登记和新化学物质环境管理登记；依照职责分工调查相关危险化学品环境污染事故和生态破坏事件，负责危险化学品事故现场的应急环境监测。
(4) The environmental protection department shall be responsible for the supervision and management of the disposal of waste hazardous chemicals; organize the identification of environmental hazards and assessment of environmental risks of hazardous chemicals; determine hazardous chemicals subject to key environmental management; be responsible for the environmental management registration of hazardous chemicals and the environmental management registration of new chemical substances; investigate hazardous chemical environmental pollution accidents and ecological damage incidents according to the division of duties; and be responsible for emergency environmental monitoring at hazardous chemical accident sites.
(五)交通运输主管部门负责危险化学品道路运输、水路运输的许可以及运输工具的安全管理，对危险化学品水路运输安全实施监督，负责危险化学品道路运输企业、水路运输企业驾驶人员、船员、装卸管理人员、押运人员、申报人员、集装箱装箱现场检查员的资格认定。铁路监管部门负责危险化学品铁路运输及其运输工具的安全管理。民用航空主管部门负责危险化学品航空运输以及航空运输企业及其运输工具的安全管理。
(5) The transportation department shall be responsible for the licensing of road and waterway transportation of hazardous chemicals and the safety management of transport vehicles; supervise the safety of waterway transportation of hazardous chemicals; and be responsible for the qualification certification of drivers, crew members, loading and unloading managers, escorts, declarants, and container packing site inspectors for road and waterway hazardous chemical transport enterprises. The railway regulatory department shall be responsible for the safety management of railway transportation of hazardous chemicals and their transport vehicles. The civil aviation department shall be responsible for the safety management of air transportation of hazardous chemicals and air transport enterprises and their transport vehicles.
(六)卫生主管部门负责危险化学品毒性鉴定的管理，负责组织、协调危险化学品事故受伤人员的医疗卫生救援工作。
(6) The health department shall be responsible for the management of toxicity identification of hazardous chemicals and for organizing and coordinating medical and health rescue for persons injured in hazardous chemical accidents.
(七)工商行政管理部门依据有关部门的许可证件，核发危险化学品生产、储存、经营、运输企业营业执照，查处危险化学品经营企业违法采购危险化学品的行为。
(7) The administrative department for industry and commerce shall, based on the relevant licenses, issue business licenses for enterprises producing, storing, operating, and transporting hazardous chemicals, and investigate and punish illegal procurement of hazardous chemicals by hazardous chemical operating enterprises.
(八)邮政管理部门负责依法查处寄递危险化学品的行为。
(8) The postalmanagement department shall be responsible for investigating and punishing the sending of hazardous chemicals through the mail according to law.
负有危险化学品安全监督管理职责的部门依法进行监督检查，可以采取下列措施：
Departments with hazardous chemical safety supervision and management responsibilities may take the following measures when conducting supervision and inspection according to law:
(一)进入危险化学品作业场所实施现场检查，向有关单位和人员了解情况，查阅、复制有关文件、资料；
(1) Enter the hazardous chemical workplace to conduct on-site inspections, inquire about the situation from relevant units and individuals, and consult and copy relevant documents and materials;
(二)发现危险化学品事故隐患，责令立即消除或者限期消除；
(2) If potential hazardous chemical accident hazards are discovered, order their immediate elimination or elimination within a specified period;
(三)对不符合法律、行政法规、规章规定或者国家标准、行业标准要求的设施、设备、装置、器材、运输工具，责令立即停止使用；
(3) If facilities, equipment, devices, apparatus, or transport vehicles do not meet the requirements of laws, administrative regulations, rules, or national or industry standards, order their immediate cessation of use;
(四)经本部门主要负责人批准，查封违法生产、储存、使用、经营危险化学品的场所，扣押违法生产、储存、使用、经营、运输的危险化学品以及用于违法生产、使用、运输危险化学品的原材料、设备、运输工具；
(4) With the approval of the principal responsible person of the department, seal up places where hazardous chemicals are illegally produced, stored, used, or operated; and seize hazardous chemicals illegally produced, stored, used, operated, or transported, as well as raw materials, equipment, and transport vehicles used for illegal production, use, or transportation of hazardous chemicals;
(五)发现影响危险化学品安全的违法行为，当场予以纠正或者责令限期改正。
(5) If illegal acts affecting the safety of hazardous chemicals are discovered, correct them on the spot or order correction within a specified period.
负有危险化学品安全监督管理职责的部门依法进行监督检查，监督检查人员不得少于2人，并应当出示执法证件；有关单位和个人对依法进行的监督检查应当予以配合，不得拒绝、阻碍。
When departments with hazardous chemical safety supervision and management responsibilities conduct supervision and inspection according to law, there shall be no fewer than two inspectors, and they shall present their law enforcement credentials; relevant units and individuals shall cooperate with the lawful supervision and inspection and shall not refuse or obstruct it.
县级以上人民政府应当建立危险化学品安全监督管理工作协调机制，支持、督促负有危险化学品安全监督管理职责的部门依法履行职责，协调、解决危险化学品安全监督管理工作中的重大问题。
People's governments at or above the county level shall establish a coordination mechanism for hazardous chemical safety supervision and management, support and urge departments with hazardous chemical safety supervision and management responsibilities to perform their duties according to law, and coordinate and resolve major issues in hazardous chemical safety supervision and management.
负有危险化学品安全监督管理职责的部门应当相互配合、密切协作，依法加强对危险化学品的安全监督管理。
Departments with hazardous chemical safety supervision and management responsibilities shall cooperate and coordinate closely with each other, and strengthen the safety supervision and management of hazardous chemicals according to law.
任何单位和个人对违反本条例规定的行为，有权向负有危险化学品安全监督管理职责的部门举报。负有危险化学品安全监督管理职责的部门接到举报，应当及时依法处理；对不属于本部门职责的，应当及时移送有关部门处理。
Any unit or individual has the right to report to departments with hazardous chemical safety supervision and management responsibilities any act that violates the provisions of these Regulations. Upon receiving a report, the department with hazardous chemical safety supervision and management responsibilities shall handle it promptly according to law; if it is not within its duties, it shall promptly transfer the matter to the relevant department for handling.
国家鼓励危险化学品生产企业和使用危险化学品从事生产的企业采用有利于提高安全保障水平的先进技术、工艺、设备以及自动控制系统，鼓励对危险化学品实行专门储存、统一配送、集中销售。
The state encourages enterprises that produce hazardous chemicals or use hazardous chemicals in production to adopt advanced technologies, processes, equipment, and automatic control systems that help improve safety assurance levels, and encourages dedicated storage, unified distribution, and centralized sales of hazardous chemicals.
生产、储存安全
Safety in Production and Storage
国家对危险化学品的生产、储存实行统筹规划、合理布局。
The state implements overall planning and rational layout for the production and storage of hazardous chemicals.
国务院工业和信息化主管部门以及国务院其他有关部门依据各自职责，负责危险化学品生产、储存的行业规划和布局。
The competent department of industry and information technology of the State Council and other relevant departments of the State Council shall, according to their respective duties, be responsible for the industry planning and layout of the production and storage of hazardous chemicals.
地方人民政府组织编制城乡规划，应当根据本地区的实际情况，按照确保安全的原则，规划适当区域专门用于危险化学品的生产、储存。
When organizing the formulation of urban and rural plans, local people's governments shall, based on the actual local conditions and in accordance with the principle of ensuring safety, plan appropriate areas specifically for the production and storage of hazardous chemicals.
新建、改建、扩建生产、储存危险化学品的建设项目(以下简称建设项目)，应当由安全生产监督管理部门进行安全条件审查。
Construction projects for the new construction, renovation, or expansion of production and storage of hazardous chemicals (hereinafter referred to as construction projects) shall undergo safety condition review by the safety production supervision and management department.
建设单位应当对建设项目进行安全条件论证，委托具备国家规定的资质条件的机构对建设项目进行安全评价，并将安全条件论证和安全评价的情况报告报建设项目所在地设区的市级以上人民政府安全生产监督管理部门；安全生产监督管理部门应当自收到报告之日起45日内作出审查决定，并书面通知建设单位。具体办法由国务院安全生产监督管理部门制定。
The construction unit shall conduct a safety condition demonstration for the construction project, entrust an institution with the qualifications prescribed by the state to conduct a safety assessment of the construction project, and submit the safety condition demonstration and safety assessment report to the safety production supervision and management department of the people's government at or above the city with districts where the construction project is located; the safety production supervision and management department shall make a review decision within 45 days from the date of receiving the report and notify the construction unit in writing. Specific measures shall be formulated by the safety production supervision and management department of the State Council.
新建、改建、扩建储存、装卸危险化学品的港口建设项目，由港口行政管理部门按照国务院交通运输主管部门的规定进行安全条件审查。
For port construction projects involving the new construction, renovation, or expansion of storage and loading/unloading of hazardous chemicals, the port administrative department shall conduct safety condition review in accordance with the provisions of the competent transportation department of the State Council.
生产、储存危险化学品的单位，应当对其铺设的危险化学品管道设置明显标志，并对危险化学品管道定期检查、检测。
Units that produce or store hazardous chemicals shall set up clear signs for the hazardous chemical pipelines they lay and regularly inspect and test the hazardous chemical pipelines.
进行可能危及危险化学品管道安全的施工作业，施工单位应当在开工的7日前书面通知管道所属单位，并与管道所属单位共同制定应急预案，采取相应的安全防护措施。管道所属单位应当指派专门人员到现场进行管道安全保护指导。
When conducting construction work that may endanger the safety of hazardous chemical pipelines, the construction unit shall notify the pipeline owner in writing 7 days before the start of construction, and jointly formulate an emergency plan with the pipeline owner and take corresponding safety protection measures. The pipeline owner shall assign specialized personnel to the site to provide guidance on pipeline safety protection.
危险化学品生产企业进行生产前，应当依照《安全生产许可证条例》的规定，取得危险化学品安全生产许可证。
Before commencing production, a hazardous chemical production enterprise shall obtain a hazardous chemical safety production license in accordance with the Regulations on Safety Production Licenses.
生产列入国家实行生产许可证制度的工业产品目录的危险化学品的企业，应当依照《中华人民共和国工业产品生产许可证管理条例》的规定，取得工业产品生产许可证。
An enterprise that produces hazardous chemicals included in the catalog of industrial products subject to the state's production license system shall obtain an industrial product production license in accordance with the Regulations of the People's Republic of China on the Administration of Industrial Product Production Licenses.
负责颁发危险化学品安全生产许可证、工业产品生产许可证的部门，应当将其颁发许可证的情况及时向同级工业和信息化主管部门、环境保护主管部门和公安机关通报。
The departments responsible for issuing hazardous chemical safety production licenses and industrial product production licenses shall promptly notify the competent departments of industry and information technology, environmental protection, and public security at the same level of the issuance of such licenses.
危险化学品生产企业应当提供与其生产的危险化学品相符的化学品安全技术说明书，并在危险化学品包装(包括外包装件)上粘贴或者拴挂与包装内危险化学品相符的化学品安全标签。化学品安全技术说明书和化学品安全标签所载明的内容应当符合国家标准的要求。
A hazardous chemical production enterprise shall provide a chemical safety data sheet that matches the hazardous chemicals it produces, and affix or attach a chemical safety label that matches the hazardous chemicals in the packaging (including outer packaging) to the packaging. The contents of the chemical safety data sheet and chemical safety label shall comply with national standards.
危险化学品生产企业发现其生产的危险化学品有新的危险特性的，应当立即公告，并及时修订其化学品安全技术说明书和化学品安全标签。
If a hazardous chemical production enterprise discovers new hazardous characteristics of the hazardous chemicals it produces, it shall immediately make an announcement and promptly revise the chemical safety data sheet and chemical safety label.
生产实施重点环境管理的危险化学品的企业，应当按照国务院环境保护主管部门的规定，将该危险化学品向环境中释放等相关信息向环境保护主管部门报告。环境保护主管部门可以根据情况采取相应的环境风险控制措施。
An enterprise that produces hazardous chemicals subject to key environmental management shall, in accordance with the provisions of the competent environmental protection department of the State Council, report information such as the release of such hazardous chemicals into the environment to the environmental protection department. The environmental protection department may take corresponding environmental risk control measures based on the circumstances.
危险化学品的包装应当符合法律、行政法规、规章的规定以及国家标准、行业标准的要求。
The packaging of hazardous chemicals shall comply with the provisions of laws, administrative regulations, rules, and the requirements of national or industry standards.
危险化学品包装物、容器的材质以及危险化学品包装的型式、规格、方法和单件质量(重量)，应当与所包装的危险化学品的性质和用途相适应。
The materials of hazardous chemical packaging and containers, as well as the type, specification, method, and unit mass (weight) of hazardous chemical packaging, shall be suitable for the nature and use of the hazardous chemicals being packaged.
生产列入国家实行生产许可证制度的工业产品目录的危险化学品包装物、容器的企业，应当依照《中华人民共和国工业产品生产许可证管理条例》的规定，取得工业产品生产许可证；其生产的危险化学品包装物、容器经国务院质量监督检验检疫部门认定的检验机构检验合格，方可出厂销售。
An enterprise that produces hazardous chemical packaging and containers included in the catalog of industrial products subject to the state's production license system shall obtain an industrial product production license in accordance with the Regulations of the People's Republic of China on the Administration of Industrial Product Production Licenses; the hazardous chemical packaging and containers it produces may be sold only after passing inspection by an inspection institution recognized by the quality supervision, inspection and quarantine department of the State Council.
运输危险化学品的船舶及其配载的容器，应当按照国家船舶检验规范进行生产，并经海事管理机构认定的船舶检验机构检验合格，方可投入使用。
Ships transporting hazardous chemicals and their fitted containers shall be manufactured in accordance with national ship inspection specifications and may be put into use only after passing inspection by a ship inspection institution recognized by the maritime administrative agency.
对重复使用的危险化学品包装物、容器，使用单位在重复使用前应当进行检查；发现存在安全隐患的，应当维修或者更换。使用单位应当对检查情况作出记录，记录的保存期限不得少于2年。
For reusable hazardous chemical packaging and containers, the user shall inspect them before reuse; if potential safety hazards are found, they shall be repaired or replaced. The user shall keep records of the inspection, and the retention period of the records shall not be less than 2 years.
危险化学品生产装置或者储存数量构成重大危险源的危险化学品储存设施(运输工具加油站、加气站除外)，与下列场所、设施、区域的距离应当符合国家有关规定：
The distance between hazardous chemical production facilities or storage facilities for hazardous chemicals that constitute a major hazard source (excluding vehicle fuel stations and gas stations) and the following places, facilities, and areas shall comply with relevant state provisions:
(一)居住区以及商业中心、公园等人员密集场所；
(1) Residential areas, commercial centers, parks, and other densely populated places;
(二)学校、医院、影剧院、体育场(馆)等公共设施；
(2) Schools, hospitals, theaters, stadiums (gymnasiums), and other public facilities;
(三)饮用水源、水厂以及水源保护区；
(3) Drinking water sources, water plants, and water source protection areas;
(四)车站、码头(依法经许可从事危险化学品装卸作业的除外)、机场以及通信干线、通信枢纽、铁路线路、道路交通干线、水路交通干线、地铁风亭以及地铁站出入口；
(4) Stations, docks (except those legally permitted to engage in hazardous chemical loading and unloading operations), airports, communication trunk lines, communication hubs, railway lines, road traffic trunk lines, waterway traffic trunk lines, subway ventilation shafts, and subway station entrances and exits;
(五)基本农田保护区、基本草原、畜禽遗传资源保护区、畜禽规模化养殖场(养殖小区)、渔业水域以及种子、种畜禽、水产苗种生产基地；
(5) Basic farmland protection areas, basic grasslands, livestock and poultry genetic resources protection areas, large-scale livestock and poultry farms (breeding communities), fishery waters, and seed, breeding livestock, and aquatic seedling production bases;
(六)河流、湖泊、风景名胜区、自然保护区；
(6) Rivers, lakes, scenic spots, and nature reserves;
(七)军事禁区、军事管理区；
(7) Military restricted zones and military management zones;
(八)法律、行政法规规定的其他场所、设施、区域。
(8) Other places, facilities, and areas specified by laws and administrative regulations.
已建的危险化学品生产装置或者储存数量构成重大危险源的危险化学品储存设施不符合前款规定的，由所在地设区的市级人民政府安全生产监督管理部门会同有关部门监督其所属单位在规定期限内进行整改；需要转产、停产、搬迁、关闭的，由本级人民政府决定并组织实施。
If existing hazardous chemical production facilities or storage facilities for hazardous chemicals that constitute a major hazard source do not comply with the preceding paragraph, the safety production supervision and management department of the people's government at the city with districts level, together with relevant departments, shall supervise the unit to which they belong to make corrections within a specified period; if conversion, shutdown, relocation, or closure is necessary, the people's government at the same level shall decide and organize implementation.
储存数量构成重大危险源的危险化学品储存设施的选址，应当避开地震活动断层和容易发生洪灾、地质灾害的区域。
The site selection for storage facilities of hazardous chemicals that constitute a major hazard source shall avoid seismically active fault zones and areas prone to floods and geological disasters.
本条例所称重大危险源，是指生产、储存、使用或者搬运危险化学品，且危险化学品的数量等于或者超过临界量的单元(包括场所和设施)。
For the purposes of these Regulations, a major hazard source refers to a unit (including places and facilities) where hazardous chemicals are produced, stored, used, or handled, and the quantity of hazardous chemicals equals or exceeds the critical quantity.
生产、储存危险化学品的单位，应当根据其生产、储存的危险化学品的种类和危险特性，在作业场所设置相应的监测、监控、通风、防晒、调温、防火、灭火、防爆、泄压、防毒、中和、防潮、防雷、防静电、防腐、防泄漏以及防护围堤或者隔离操作等安全设施、设备，并按照国家标准、行业标准或者国家有关规定对安全设施、设备进行经常性维护、保养，保证安全设施、设备的正常使用。
Units that produce or store hazardous chemicals shall, based on the types and hazardous characteristics of the hazardous chemicals they produce or store, install corresponding safety facilities and equipment such as monitoring, surveillance, ventilation, sun protection, temperature regulation, fire prevention, fire extinguishing, explosion prevention, pressure relief, poison prevention, neutralization, moisture prevention, lightning protection, static electricity prevention, corrosion prevention, leakage prevention, and protective dikes or isolation operations in the workplace, and shall regularly maintain and service the safety facilities and equipment in accordance with national standards, industry standards, or relevant state provisions to ensure their normal operation.

生产、储存危险化学品的企业，应当委托具备国家规定的资质条件的机构，对本企业的安全生产条件每3年进行一次安全评价，提出安全评价报告。安全评价报告的内容应当包括对安全生产条件存在的问题进行整改的方案。
Enterprises that produce or store hazardous chemicals shall entrust an institution with the qualifications prescribed by the state to conduct a safety assessment of their safety production conditions every three years and issue a safety assessment report. The safety assessment report shall include plans for rectifying problems in safety production conditions.
生产、储存危险化学品的企业，应当将安全评价报告以及整改方案的落实情况报所在地县级人民政府安全生产监督管理部门备案。在港区内储存危险化学品的企业，应当将安全评价报告以及整改方案的落实情况报港口行政管理部门备案。
Enterprises that produce or store hazardous chemicals shall submit the safety assessment report and the implementation of rectification plans to the safety production supervision and management department of the county people's government where they are located for record. For enterprises storing hazardous chemicals in port areas, they shall submit the safety assessment report and the implementation of rectification plans to the port administrative department for record.
生产、储存剧毒化学品或者国务院公安部门规定的可用于制造爆炸物品的危险化学品(以下简称易制爆危险化学品)的单位，应当如实记录其生产、储存的剧毒化学品、易制爆危险化学品的数量、流向，并采取必要的安全防范措施，防止剧毒化学品、易制爆危险化学品丢失或者被盗；发现剧毒化学品、易制爆危险化学品丢失或者被盗的，应当立即向当地公安机关报告。
Units that produce or store highly toxic chemicals or hazardous chemicals that can be used to manufacture explosives as specified by the public security department of the State Council (hereinafter referred to as explosive-prone hazardous chemicals) shall truthfully record the quantity and flow of the highly toxic chemicals and explosive-prone hazardous chemicals they produce or store, and take necessary safety precautions to prevent loss or theft of highly toxic chemicals and explosive-prone hazardous chemicals; if loss or theft of highly toxic chemicals or explosive-prone hazardous chemicals is discovered, they shall immediately report to the local public security department.

Hazardous chemicals shall be stored in dedicated warehouses, dedicated sites, or dedicated storage rooms (hereinafter collectively referred to as dedicated warehouses) and managed by designated personnel; highly toxic chemicals and other hazardous chemicals that constitute a major hazard source due to storage quantity shall be stored separately in dedicated warehouses and subject to a dual-receipt and dual-custody system.

对剧毒化学品以及储存数量构成重大危险源的其他危险化学品，储存单位应当将其储存数量、储存地点以及管理人员的情况，报所在地县级人民政府安全生产监督管理部门(在港区内储存的，报港口行政管理部门)和公安机关备案。
For highly toxic chemicals and other hazardous chemicals that constitute a major hazard source due to storage quantity, the storage unit shall report the storage quantity, storage location, and information on management personnel to the safety production supervision and management department of the county people's government (for storage in port areas, to the port administrative department) and the public security department for record.
危险化学品专用仓库应当符合国家标准、行业标准的要求，并设置明显的标志。储存剧毒化学品、易制爆危险化学品的专用仓库，应当按照国家有关规定设置相应的技术防范设施。

Units that store hazardous chemicals shall regularly test and inspect the safety facilities and equipment of their dedicated warehouses for hazardous chemicals.
生产、储存危险化学品的单位转产、停产、停业或者解散的，应当采取有效措施，及时、妥善处置其危险化学品生产装置、储存设施以及库存的危险化学品，不得丢弃危险化学品；处置方案应当报所在地县级人民政府安全生产监督管理部门、工业和信息化主管部门、环境保护主管部门和公安机关备案。安全生产监督管理部门应当会同环境保护主管部门和公安机关对处置情况进行监督检查，发现未依照规定处置的，应当责令其立即处置。
If a unit that produces or stores hazardous chemicals undergoes conversion, shutdown, cessation of business, or dissolution, it shall take effective measures to promptly and properly dispose of its hazardous chemical production facilities, storage facilities, and inventory of hazardous chemicals, and shall not discard hazardous chemicals; the disposal plan shall be submitted to the safety production supervision and management department, the competent department of industry and information technology, the environmental protection department, and the public security department of the county people's government where it is located for record. The safety production supervision and management department shall, together with the environmental protection department and the public security department, supervise and inspect the disposal; if it is found that disposal has not been carried out in accordance with regulations, it shall order immediate disposal.

使用危险化学品的单位，其使用条件(包括工艺)应当符合法律、行政法规的规定和国家标准、行业标准的要求，并根据所使用的危险化学品的种类、危险特性以及使用量和使用方式，建立、健全使用危险化学品的安全管理规章制度和安全操作规程，保证危险化学品的安全使用。
Units that use hazardous chemicals shall ensure that their use conditions (including processes) comply with the provisions of laws, administrative regulations, and the requirements of national or industry standards, and shall establish and improve safety management rules and safe operating procedures for the use of hazardous chemicals based on the types, hazardous characteristics, usage amounts, and methods of use of the hazardous chemicals used, to ensure the safe use of hazardous chemicals.
使用危险化学品从事生产并且使用量达到规定数量的化工企业(属于危险化学品生产企业的除外，下同)，应当依照本条例的规定取得危险化学品安全使用许可证。
Chemical enterprises that use hazardous chemicals in production and whose usage reaches the prescribed quantity (excluding those that are hazardous chemical production enterprises, the same below) shall obtain a hazardous chemical safety use license in accordance with these Regulations.
前款规定的危险化学品使用量的数量标准，由国务院安全生产监督管理部门会同国务院公安部门、农业主管部门确定并公布。
The quantity standards for the use of hazardous chemicals as mentioned in the preceding paragraph shall be determined and published by the safety production supervision and management department of the State Council jointly with the public security department and the agricultural department of the State Council.
申请危险化学品安全使用许可证的化工企业，除应当符合本条例第二十八条的规定外，还应当具备下列条件：
In addition to meeting the requirements of Article 28 of these Regulations, a chemical enterprise applying for a hazardous chemical safety use license shall also meet the following conditions:
(一)有与所使用的危险化学品相适应的专业技术人员；
(1) Have professional and technical personnel suitable for the hazardous chemicals used;
(二)有安全管理机构和专职安全管理人员；
(2) Have a safety management organization and full-time safety management personnel;
(三)有符合国家规定的危险化学品事故应急预案和必要的应急救援器材、设备；
(3) Have an emergency plan for hazardous chemical accidents that meets state requirements and necessary emergency rescue equipment and devices;
(四)依法进行了安全评价。
(4) Have conducted a safety assessment according to law.
申请危险化学品安全使用许可证的化工企业，应当向所在地设区的市级人民政府安全生产监督管理部门提出申请，并提交其符合本条例第三十条规定条件的证明材料。设区的市级人民政府安全生产监督管理部门应当依法进行审查，自收到证明材料之日起45日内作出批准或者不予批准的决定。予以批准的，颁发危险化学品安全使用许可证；不予批准的，书面通知申请人并说明理由。
A chemical enterprise applying for a hazardous chemical safety use license shall submit an application to the safety production supervision and management department of the people's government at the city with districts level where it is located, along with supporting materials demonstrating compliance with the conditions specified in Article 30 of these Regulations. The safety production supervision and management department of the people's government at the city with districts level shall conduct a review according to law and make a decision to approve or disapprove within 45 days from the date of receiving the supporting materials. If approved, it shall issue a hazardous chemical safety use license; if not approved, it shall notify the applicant in writing and state the reasons.

The safety production supervision and management department shall promptly notify the environmental protection department and the public security department at the same level of the issuance of hazardous chemical safety use licenses.
本条例第十六条关于生产实施重点环境管理的危险化学品的企业的规定，适用于使用实施重点环境管理的危险化学品从事生产的企业；第二十条、第二十一条、第二十三条第一款、第二十七条关于生产、储存危险化学品的单位的规定，适用于使用危险化学品的单位；第二十二条关于生产、储存危险化学品的企业的规定，适用于使用危险化学品从事生产的企业。
The provisions of Article 16 of these Regulations concerning enterprises producing hazardous chemicals subject to key environmental management apply to enterprises using hazardous chemicals subject to key environmental management in production; the provisions of Articles 20, 21, the first paragraph of Article 23, and Article 27 concerning units that produce or store hazardous chemicals apply to units that use hazardous chemicals; the provisions of Article 22 concerning enterprises that produce or store hazardous chemicals apply to enterprises that use hazardous chemicals in production.
经营安全
Safety in Operation
国家对危险化学品经营(包括仓储经营，下同)实行许可制度。未经许可，任何单位和个人不得经营危险化学品。
The state implements a licensing system for the operation of hazardous chemicals (including storage operations, the same below). Without a license, no unit or individual may operate hazardous chemicals.
依法设立的危险化学品生产企业在其厂区范围内销售本企业生产的危险化学品，不需要取得危险化学品经营许可。
A legally established hazardous chemical production enterprise that sells the hazardous chemicals it produces within its factory premises does not need to obtain a hazardous chemical operation license.
依照《中华人民共和国港口法》的规定取得港口经营许可证的港口经营人，在港区内从事危险化学品仓储经营，不需要取得危险化学品经营许可。
A port operator that has obtained a port operation license in accordance with the Port Law of the People's Republic of China and engages in the storage operation of hazardous chemicals within the port area does not need to obtain a hazardous chemical operation license.
从事危险化学品经营的企业应当具备下列条件：
An enterprise engaged in the operation of hazardous chemicals shall meet the following conditions:
(一)有符合国家标准、行业标准的经营场所，储存危险化学品的，还应当有符合国家标准、行业标准的储存设施；
(1) Have business premises that meet national or industry standards; if storing hazardous chemicals, also have storage facilities that meet national or industry standards;
(二)从业人员经过专业技术培训并经考核合格；
(2) Employees have received professional technical training and passed assessments;
(三)有健全的安全管理规章制度；
(3) Have sound safety management rules;
(四)有专职安全管理人员；
(4) Have full-time safety management personnel;
(五)有符合国家规定的危险化学品事故应急预案和必要的应急救援器材、设备；
(5) Have an emergency plan for hazardous chemical accidents that meets state requirements and necessary emergency rescue equipment and devices;
(六)法律、法规规定的其他条件。
(6) Other conditions specified by laws and regulations.
从事剧毒化学品、易制爆危险化学品经营的企业，应当向所在地设区的市级人民政府安全生产监督管理部门提出申请，从事其他危险化学品经营的企业，应当向所在地县级人民政府安全生产监督管理部门提出申请(有储存设施的，应当向所在地设区的市级人民政府安全生产监督管理部门提出申请)。申请人应当提交其符合本条例第三十四条规定条件的证明材料。设区的市级人民政府安全生产监督管理部门或者县级人民政府安全生产监督管理部门应当依法进行审查，并对申请人的经营场所、储存设施进行现场核查，自收到证明材料之日起30日内作出批准或者不予批准的决定。予以批准的，颁发危险化学品经营许可证；不予批准的，书面通知申请人并说明理由。
An enterprise engaged in the operation of highly toxic chemicals and explosive-prone hazardous chemicals shall submit an application to the safety production supervision and management department of the people's government at the city with districts level where it is located; an enterprise engaged in the operation of other hazardous chemicals shall submit an application to the safety production supervision and management department of the county people's government where it is located (if it has storage facilities, it shall submit an application to the safety production supervision and management department of the people's government at the city with districts level where it is located). The applicant shall submit supporting materials demonstrating compliance with the conditions specified in Article 34 of these Regulations. The safety production supervision and management department of the people's government at the city with districts level or the county people's government shall conduct a review according to law and conduct an on-site inspection of the applicant's business premises and storage facilities, and make a decision to approve or disapprove within 30 days from the date of receiving the supporting materials. If approved, it shall issue a hazardous chemical operation license; if not approved, it shall notify the applicant in writing and state the reasons.
设区的市级人民政府安全生产监督管理部门和县级人民政府安全生产监督管理部门应当将其颁发危险化学品经营许可证的情况及时向同级环境保护主管部门和公安机关通报。
The safety production supervision and management department of the people's government at the city with districts level and the county people's government shall promptly notify the environmental protection department and the public security department at the same level of the issuance of hazardous chemical operation licenses.
申请人持危险化学品经营许可证向工商行政管理部门办理登记手续后，方可从事危险化学品经营活动。法律、行政法规或者国务院规定经营危险化学品还需要经其他有关部门许可的，申请人向工商行政管理部门办理登记手续时还应当持相应的许可证件。
The applicant may engage in hazardous chemical operation activities only after completing registration procedures with the administrative department for industry and commerce with the hazardous chemical operation license. If laws, administrative regulations, or the State Council stipulate that the operation of hazardous chemicals also requires permission from other relevant departments, the applicant shall also hold the corresponding license when completing registration procedures with the administrative department for industry and commerce.
危险化学品经营企业储存危险化学品的，应当遵守本条例第二章关于储存危险化学品的规定。危险化学品商店内只能存放民用小包装的危险化学品。
If a hazardous chemical operating enterprise stores hazardous chemicals, it shall comply with the provisions of Chapter II of these Regulations concerning the storage of hazardous chemicals. Only small-packaged hazardous chemicals for civilian use may be stored in hazardous chemical stores.
危险化学品经营企业不得向未经许可从事危险化学品生产、经营活动的企业采购危险化学品，不得经营没有化学品安全技术说明书或者化学品安全标签的危险化学品。
A hazardous chemical operating enterprise shall not purchase hazardous chemicals from enterprises that are not licensed to produce or operate hazardous chemicals, and shall not operate hazardous chemicals without a chemical safety data sheet or chemical safety label.
依法取得危险化学品安全生产许可证、危险化学品安全使用许可证、危险化学品经营许可证的企业，凭相应的许可证件购买剧毒化学品、易制爆危险化学品。民用爆炸物品生产企业凭民用爆炸物品生产许可证购买易制爆危险化学品。
Enterprises that have lawfully obtained a hazardous chemical safety production license, hazardous chemical safety use license, or hazardous chemical operation license may purchase highly toxic chemicals and explosive-prone hazardous chemicals with the corresponding license. Civil explosives production enterprises may purchase explosive-prone hazardous chemicals with their civil explosives production license.
前款规定以外的单位购买剧毒化学品的，应当向所在地县级人民政府公安机关申请取得剧毒化学品购买许可证；购买易制爆危险化学品的，应当持本单位出具的合法用途说明。
Units other than those specified in the preceding paragraph that purchase highly toxic chemicals shall apply to the public security department of the county people's government where they are located for a highly toxic chemical purchase permit; those purchasing explosive-prone hazardous chemicals shall provide a statement of lawful use issued by their unit.
个人不得购买剧毒化学品(属于剧毒化学品的农药除外)和易制爆危险化学品。
Individuals shall not purchase highly toxic chemicals (except pesticides that are highly toxic chemicals) or explosive-prone hazardous chemicals.
申请取得剧毒化学品购买许可证，申请人应当向所在地县级人民政府公安机关提交下列材料：
To apply for a highly toxic chemical purchase permit, the applicant shall submit the following materials to the public security department of the county people's government where it is located:
(一)营业执照或者法人证书(登记证书)的复印件；
(1) A copy of the business license or legal person certificate (registration certificate);
(二)拟购买的剧毒化学品品种、数量的说明；
(2) A description of the types and quantities of highly toxic chemicals to be purchased;
(三)购买剧毒化学品用途的说明；
(3) A description of the purpose of purchasing the highly toxic chemicals;
(四)经办人的身份证明。
(4) The identity certificate of the handler.
县级人民政府公安机关应当自收到前款规定的材料之日起3日内，作出批准或者不予批准的决定。予以批准的，颁发剧毒化学品购买许可证；不予批准的，书面通知申请人并说明理由。
The public security department of the county people's government shall make a decision to approve or disapprove within 3 days from the date of receiving the materials specified in the preceding paragraph. If approved, it shall issue a highly toxic chemical purchase permit; if not approved, it shall notify the applicant in writing and state the reasons.
剧毒化学品购买许可证管理办法由国务院公安部门制定。
The measures for the administration of highly toxic chemical purchase permits shall be formulated by the public security department of the State Council.
危险化学品生产企业、经营企业销售剧毒化学品、易制爆危险化学品，应当查验本条例第三十八条第一款、第二款规定的相关许可证件或者证明文件，不得向不具有相关许可证件或者证明文件的单位销售剧毒化学品、易制爆危险化学品。对持剧毒化学品购买许可证购买剧毒化学品的，应当按照许可证载明的品种、数量销售。
When selling highly toxic chemicals and explosive-prone hazardous chemicals, hazardous chemical production enterprises and operating enterprises shall verify the relevant licenses or supporting documents specified in the first and second paragraphs of Article 38 of these Regulations, and shall not sell highly toxic chemicals or explosive-prone hazardous chemicals to units that do not have the relevant licenses or supporting documents. For those purchasing highly toxic chemicals with a highly toxic chemical purchase permit, sales shall be made in accordance with the varieties and quantities specified in the permit.
禁止向个人销售剧毒化学品(属于剧毒化学品的农药除外)和易制爆危险化学品。
It is prohibited to sell highly toxic chemicals (except pesticides that are highly toxic chemicals) and explosive-prone hazardous chemicals to individuals.
危险化学品生产企业、经营企业销售剧毒化学品、易制爆危险化学品，应当如实记录购买单位的名称、地址、经办人的姓名、身份证号码以及所购买的剧毒化学品、易制爆危险化学品的品种、数量、用途。销售记录以及经办人的身份证明复印件、相关许可证件复印件或者证明文件的保存期限不得少于1年。
When selling highly toxic chemicals and explosive-prone hazardous chemicals, hazardous chemical production enterprises and operating enterprises shall truthfully record the name, address, name of the handler, ID number of the purchasing unit, as well as the varieties, quantities, and purposes of the highly toxic chemicals and explosive-prone hazardous chemicals purchased. The retention period for sales records, copies of the handler's identity certificate, and copies of relevant licenses or supporting documents shall not be less than 1 year.
剧毒化学品、易制爆危险化学品的销售企业、购买单位应当在销售、购买后5日内，将所销售、购买的剧毒化学品、易制爆危险化学品的品种、数量以及流向信息报所在地县级人民政府公安机关备案，并输入计算机系统。
Selling enterprises and purchasing units of highly toxic chemicals and explosive-prone hazardous chemicals shall, within 5 days after the sale or purchase, report the varieties, quantities, and flow information of the highly toxic chemicals and explosive-prone hazardous chemicals sold or purchased to the public security department of the county people's government where they are located for record, and input them into the computer system.
使用剧毒化学品、易制爆危险化学品的单位不得出借、转让其购买的剧毒化学品、易制爆危险化学品；因转产、停产、搬迁、关闭等确需转让的，应当向具有本条例第三十八条第一款、第二款规定的相关许可证件或者证明文件的单位转让，并在转让后将有关情况及时向所在地县级人民政府公安机关报告。
Units that use highly toxic chemicals and explosive-prone hazardous chemicals shall not lend or transfer the highly toxic chemicals or explosive-prone hazardous chemicals they have purchased; if transfer is truly necessary due to conversion, shutdown, relocation, closure, etc., they shall transfer to units that have the relevant licenses or supporting documents specified in the first and second paragraphs of Article 38 of these Regulations, and promptly report the relevant information to the public security department of the county people's government where they are located after the transfer.
运输安全
Safety in Transportation
从事危险化学品道路运输、水路运输的，应当分别依照有关道路运输、水路运输的法律、行政法规的规定，取得危险货物道路运输许可、危险货物水路运输许可，并向工商行政管理部门办理登记手续。
Those engaged in road transportation and waterway transportation of hazardous chemicals shall obtain a dangerous goods road transport permit and a dangerous goods waterway transport permit respectively in accordance with the relevant laws and administrative regulations on road transportation and waterway transportation, and complete registration procedures with the administrative department for industry and commerce.
危险化学品道路运输企业、水路运输企业应当配备专职安全管理人员。
Hazardous chemical road transport enterprises and waterway transport enterprises shall be equipped with full-time safety management personnel.
危险化学品道路运输企业、水路运输企业的驾驶人员、船员、装卸管理人员、押运人员、申报人员、集装箱装箱现场检查员应当经交通运输主管部门考核合格，取得从业资格。具体办法由国务院交通运输主管部门制定。
Drivers, crew members, loading and unloading managers, escorts, declarants, and container packing site inspectors of hazardous chemical road transport enterprises and waterway transport enterprises shall pass assessments organized by the transportation department and obtain professional qualifications. Specific measures shall be formulated by the competent transportation department of the State Council.
危险化学品的装卸作业应当遵守安全作业标准、规程和制度，并在装卸管理人员的现场指挥或者监控下进行。水路运输危险化学品的集装箱装箱作业应当在集装箱装箱现场检查员的指挥或者监控下进行，并符合积载、隔离的规范和要求；装箱作业完毕后，集装箱装箱现场检查员应当签署装箱证明书。
Loading and unloading operations of hazardous chemicals shall comply with safety operation standards, procedures, and systems, and be carried out under the on-site command or monitoring of loading and unloading managers. Container packing operations for waterway transportation of hazardous chemicals shall be carried out under the command or monitoring of container packing site inspectors and comply with stowage and segregation specifications and requirements; after packing operations are completed, the container packing site inspector shall sign the container packing certificate.
运输危险化学品，应当根据危险化学品的危险特性采取相应的安全防护措施，并配备必要的防护用品和应急救援器材。
When transporting hazardous chemicals, corresponding safety protection measures shall be taken based on the hazardous characteristics of the hazardous chemicals, and necessary protective equipment and emergency rescue equipment shall be provided.
用于运输危险化学品的槽罐以及其他容器应当封口严密，能够防止危险化学品在运输过程中因温度、湿度或者压力的变化发生渗漏、洒漏；槽罐以及其他容器的溢流和泄压装置应当设置准确、起闭灵活。
Tank containers and other containers used for transporting hazardous chemicals shall be tightly sealed to prevent leakage or spillage due to changes in temperature, humidity, or pressure during transportation; the overflow and pressure relief devices of tank containers and other containers shall be set accurately and operate flexibly.
运输危险化学品的驾驶人员、船员、装卸管理人员、押运人员、申报人员、集装箱装箱现场检查员，应当了解所运输的危险化学品的危险特性及其包装物、容器的使用要求和出现危险情况时的应急处置方法。
Drivers, crew members, loading and unloading managers, escorts, declarants, and container packing site inspectors transporting hazardous chemicals shall understand the hazardous characteristics of the hazardous chemicals being transported, the requirements for the use of their packaging and containers, and the emergency response methods in case of dangerous situations.
通过道路运输危险化学品的，托运人应当委托依法取得危险货物道路运输许可的企业承运。
When transporting hazardous chemicals by road, the consignor shall entrust an enterprise that has lawfully obtained a dangerous goods road transport permit to carry out the transportation.
通过道路运输危险化学品的，应当按照运输车辆的核定载质量装载危险化学品，不得超载。
When transporting hazardous chemicals by road, the hazardous chemicals shall be loaded in accordance with the rated load capacity of the transport vehicle, and overloading is prohibited.
危险化学品运输车辆应当符合国家标准要求的安全技术条件，并按照国家有关规定定期进行安全技术检验。

通过道路运输危险化学品的，应当配备押运人员，并保证所运输的危险化学品处于押运人员的监控之下。
When transporting hazardous chemicals by road, escorts shall be provided, and the hazardous chemicals being transported shall be kept under the monitoring of the escorts.
运输危险化学品途中因住宿或者发生影响正常运输的情况，需要较长时间停车的，驾驶人员、押运人员应当采取相应的安全防范措施；运输剧毒化学品或者易制爆危险化学品的，还应当向当地公安机关报告。
If, during the transportation of hazardous chemicals, a prolonged stop is necessary due to accommodation or circumstances affecting normal transportation, the driver and escort shall take corresponding safety precautions; if transporting highly toxic chemicals or explosive-prone hazardous chemicals, they shall also report to the local public security department.
未经公安机关批准，运输危险化学品的车辆不得进入危险化学品运输车辆限制通行的区域。危险化学品运输车辆限制通行的区域由县级人民政府公安机关划定，并设置明显的标志。
Without the approval of the public security department, vehicles transporting hazardous chemicals shall not enter areas where the passage of hazardous chemical transport vehicles is restricted. Areas where the passage of hazardous chemical transport vehicles is restricted shall be designated by the public security department of the county people's government and marked with clear signs.
通过道路运输剧毒化学品的，托运人应当向运输始发地或者目的地县级人民政府公安机关申请剧毒化学品道路运输通行证。
When transporting highly toxic chemicals by road, the consignor shall apply to the public security department of the county people's government at the place of departure or destination for a road transport permit for highly toxic chemicals.
申请剧毒化学品道路运输通行证，托运人应当向县级人民政府公安机关提交下列材料：
To apply for a road transport permit for highly toxic chemicals, the consignor shall submit the following materials to the public security department of the county people's government:
(一)拟运输的剧毒化学品品种、数量的说明；
(1) A description of the varieties and quantities of highly toxic chemicals to be transported;
(二)运输始发地、目的地、运输时间和运输路线的说明；
(2) A description of the place of departure, destination, transport time, and transport route;
(三)承运人取得危险货物道路运输许可、运输车辆取得营运证以及驾驶人员、押运人员取得上岗资格的证明文件；
(3) Supporting documents proving that the carrier has obtained a dangerous goods road transport permit, the transport vehicle has obtained an operating certificate, and the driver and escort have obtained qualification certificates;
(四)本条例第三十八条第一款、第二款规定的购买剧毒化学品的相关许可证件，或者海关出具的进出口证明文件。
(4) The relevant license for purchasing highly toxic chemicals as specified in the first and second paragraphs of Article 38 of these Regulations, or the import/export certificate issued by the customs.
县级人民政府公安机关应当自收到前款规定的材料之日起7日内，作出批准或者不予批准的决定。予以批准的，颁发剧毒化学品道路运输通行证；不予批准的，书面通知申请人并说明理由。
The public security department of the county people's government shall make a decision to approve or disapprove within 7 days from the date of receiving the materials specified in the preceding paragraph. If approved, it shall issue a road transport permit for highly toxic chemicals; if not approved, it shall notify the applicant in writing and state the reasons.
剧毒化学品道路运输通行证管理办法由国务院公安部门制定。
The measures for the administration of road transport permits for highly toxic chemicals shall be formulated by the public security department of the State Council.
剧毒化学品、易制爆危险化学品在道路运输途中丢失、被盗、被抢或者出现流散、泄漏等情况的，驾驶人员、押运人员应当立即采取相应的警示措施和安全措施，并向当地公安机关报告。公安机关接到报告后，应当根据实际情况立即向安全生产监督管理部门、环境保护主管部门、卫生主管部门通报。有关部门应当采取必要的应急处置措施。
If highly toxic chemicals or explosive-prone hazardous chemicals are lost, stolen, robbed, or become scattered or leaked during road transportation, the driver and escort shall immediately take corresponding warning and safety measures and report to the local public security department. Upon receiving the report, the public security department shall promptly notify the safety production supervision and management department, the environmental protection department, and the health department based on the actual situation. The relevant departments shall take necessary emergency response measures.
通过水路运输危险化学品的，应当遵守法律、行政法规以及国务院交通运输主管部门关于危险货物水路运输安全的规定。
When transporting hazardous chemicals by waterway, the provisions of laws, administrative regulations, and the competent transportation department of the State Council on the safety of dangerous goods waterway transportation shall be complied with.
海事管理机构应当根据危险化学品的种类和危险特性，确定船舶运输危险化学品的相关安全运输条件。
The maritime administrative agency shall determine the relevant safe transport conditions for the transport of hazardous chemicals by ship based on the types and hazardous characteristics of the hazardous chemicals.
拟交付船舶运输的化学品的相关安全运输条件不明确的，货物所有人或者代理人应当委托相关技术机构进行评估，明确相关安全运输条件并经海事管理机构确认后，方可交付船舶运输。
If the relevant safe transport conditions for chemicals to be delivered for ship transport are unclear, the cargo owner or agent shall entrust a relevant technical institution to conduct an assessment, clarify the safe transport conditions, and after confirmation by the maritime administrative agency, the chemicals may be delivered for ship transport.
禁止通过内河封闭水域运输剧毒化学品以及国家规定禁止通过内河运输的其他危险化学品。
It is prohibited to transport highly toxic chemicals and other hazardous chemicals that the state prohibits from being transported through inland waters in enclosed water bodies.
前款规定以外的内河水域，禁止运输国家规定禁止通过内河运输的剧毒化学品以及其他危险化学品。

禁止通过内河运输的剧毒化学品以及其他危险化学品的范围，由国务院交通运输主管部门会同国务院环境保护主管部门、工业和信息化主管部门、安全生产监督管理部门，根据危险化学品的危险特性、危险化学品对人体和水环境的危害程度以及消除危害后果的难易程度等因素规定并公布。
The scope of highly toxic chemicals and other hazardous chemicals prohibited from being transported through inland waters shall be specified and published by the competent transportation department of the State Council jointly with the environmental protection department, the competent department of industry and information technology, and the safety production supervision and management department of the State Council, based on factors such as the hazardous characteristics of the hazardous chemicals, the degree of harm to the human body and water environment, and the difficulty of eliminating the harmful consequences.
国务院交通运输主管部门应当根据危险化学品的危险特性，对通过内河运输本条例第五十四条规定以外的危险化学品(以下简称通过内河运输危险化学品)实行分类管理，对各类危险化学品的运输方式、包装规范和安全防护措施等分别作出规定并监督实施。

通过内河运输危险化学品，应当由依法取得危险货物水路运输许可的水路运输企业承运，其他单位和个人不得承运。托运人应当委托依法取得危险货物水路运输许可的水路运输企业承运，不得委托其他单位和个人承运。
The transport of hazardous chemicals through inland waters shall be carried out by a waterway transport enterprise that has lawfully obtained a dangerous goods waterway transport permit; no other unit or individual may carry out such transport. The consignor shall entrust a waterway transport enterprise that has lawfully obtained a dangerous goods waterway transport permit to carry out the transport, and shall not entrust any other unit or individual.
通过内河运输危险化学品，应当使用依法取得危险货物适装证书的运输船舶。水路运输企业应当针对所运输的危险化学品的危险特性，制定运输船舶危险化学品事故应急救援预案，并为运输船舶配备充足、有效的应急救援器材和设备。
When transporting hazardous chemicals through inland waters, transport ships that have lawfully obtained a dangerous goods fitness certificate shall be used. The waterway transport enterprise shall formulate an emergency plan for hazardous chemical accidents on the transport ship based on the hazardous characteristics of the hazardous chemicals being transported, and equip the transport ship with sufficient and effective emergency rescue equipment and devices.
通过内河运输危险化学品的船舶，其所有人或者经营人应当取得船舶污染损害责任保险证书或者财务担保证明。船舶污染损害责任保险证书或者财务担保证明的副本应当随船携带。
The owner or operator of a ship transporting hazardous chemicals through inland waters shall obtain a certificate of insurance for ship pollution damage liability or a financial guarantee certificate. A copy of the certificate of insurance for ship pollution damage liability or the financial guarantee certificate shall be carried on board.
通过内河运输危险化学品，危险化学品包装物的材质、型式、强度以及包装方法应当符合水路运输危险化学品包装规范的要求。国务院交通运输主管部门对单船运输的危险化学品数量有限制性规定的，承运人应当按照规定安排运输数量。
When transporting hazardous chemicals through inland waters, the materials, types, strength, and packaging methods of hazardous chemical packaging shall comply with the packaging specifications for the waterway transport of hazardous chemicals. If the competent transportation department of the State Council has restrictive provisions on the quantity of hazardous chemicals transported by a single ship, the carrier shall arrange the transport quantity in accordance with the provisions.
用于危险化学品运输作业的内河码头、泊位应当符合国家有关安全规范，与饮用水取水口保持国家规定的距离。有关管理单位应当制定码头、泊位危险化学品事故应急预案，并为码头、泊位配备充足、有效的应急救援器材和设备。
Inland river docks and berths used for hazardous chemical transport operations shall comply with relevant national safety specifications and maintain a distance from drinking water intake points as prescribed by the state. The relevant management units shall formulate emergency plans for hazardous chemical accidents at docks and berths, and equip the docks and berths with sufficient and effective emergency rescue equipment and devices.
用于危险化学品运输作业的内河码头、泊位，经交通运输主管部门按照国家有关规定验收合格后方可投入使用。
Inland river docks and berths used for hazardous chemical transport operations may be put into use only after passing acceptance inspection by the transportation department in accordance with relevant state provisions.
船舶载运危险化学品进出内河港口，应当将危险化学品的名称、危险特性、包装以及进出港时间等事项，事先报告海事管理机构。海事管理机构接到报告后，应当在国务院交通运输主管部门规定的时间内作出是否同意的决定，通知报告人，同时通报港口行政管理部门。定船舶、定航线、定货种的船舶可以定期报告。
When a ship carrying hazardous chemicals enters or leaves an inland river port, it shall report matters such as the name, hazardous characteristics, packaging, and entry and exit times of the hazardous chemicals to the maritime administrative agency in advance. Upon receiving the report, the maritime administrative agency shall make a decision on whether to agree within the time limit prescribed by the competent transportation department of the State Council, notify the reporter, and simultaneously inform the port administrative department. Ships with fixed ships, fixed routes, and fixed cargo types may report periodically.
在内河港口内进行危险化学品的装卸、过驳作业，应当将危险化学品的名称、危险特性、包装和作业的时间、地点等事项报告港口行政管理部门。港口行政管理部门接到报告后，应当在国务院交通运输主管部门规定的时间内作出是否同意的决定，通知报告人，同时通报海事管理机构。
When conducting loading, unloading, or lightering operations of hazardous chemicals within an inland river port, matters such as the name, hazardous characteristics, packaging, and operation time and location of the hazardous chemicals shall be reported to the port administrative department. Upon receiving the report, the port administrative department shall make a decision on whether to agree within the time limit prescribed by the competent transportation department of the State Council, notify the reporter, and simultaneously inform the maritime administrative agency.
载运危险化学品的船舶在内河航行，通过过船建筑物的，应当提前向交通运输主管部门申报，并接受交通运输主管部门的管理。
When a ship carrying hazardous chemicals navigates through inland rivers and passes through ship locks, it shall declare to the transportation department in advance and accept the management of the transportation department.
载运危险化学品的船舶在内河航行、装卸或者停泊，应当悬挂专用的警示标志，按照规定显示专用信号。
Ships carrying hazardous chemicals navigating, loading/unloading, or mooring in inland rivers shall display dedicated warning signs and show dedicated signals in accordance with regulations.
载运危险化学品的船舶在内河航行，按照国务院交通运输主管部门的规定需要引航的，应当申请引航。
If a ship carrying hazardous chemicals navigating in inland rivers requires pilotage in accordance with the provisions of the competent transportation department of the State Council, it shall apply for pilotage.
载运危险化学品的船舶在内河航行，应当遵守法律、行政法规和国家其他有关饮用水水源保护的规定。内河航道发展规划应当与依法经批准的饮用水水源保护区划定方案相协调。
Ships carrying hazardous chemicals navigating in inland rivers shall comply with laws, administrative regulations, and other state provisions on the protection of drinking water sources. Inland river waterway development plans shall be coordinated with the legally approved drinking water source protection area delineation plans.
托运危险化学品的，托运人应当向承运人说明所托运的危险化学品的种类、数量、危险特性以及发生危险情况的应急处置措施，并按照国家有关规定对所托运的危险化学品妥善包装，在外包装上设置相应的标志。
When consigning hazardous chemicals, the consignor shall inform the carrier of the types, quantities, hazardous characteristics, and emergency response measures for dangerous situations of the hazardous chemicals being consigned, and shall properly package the consigned hazardous chemicals in accordance with relevant state provisions and set corresponding signs on the outer packaging.
运输危险化学品需要添加抑制剂或者稳定剂的，托运人应当添加，并将有关情况告知承运人。
If the transport of hazardous chemicals requires the addition of inhibitors or stabilizers, the consignor shall add them and inform the carrier of the relevant information.
托运人不得在托运的普通货物中夹带危险化学品，不得将危险化学品匿报或者谎报为普通货物托运。
The consignor shall not mix hazardous chemicals with ordinary goods in consignment, and shall not conceal or falsely declare hazardous chemicals as ordinary goods for consignment.
任何单位和个人不得交寄危险化学品或者在邮件、快件内夹带危险化学品，不得将危险化学品匿报或者谎报为普通物品交寄。邮政企业、快递企业不得收寄危险化学品。
No unit or individual may send hazardous chemicals through the mail or mix hazardous chemicals in mail or express items, and shall not conceal or falsely declare hazardous chemicals as ordinary items for sending. Postal enterprises and express enterprises shall not accept hazardous chemicals for sending.
对涉嫌违反本条第一款、第二款规定的，交通运输主管部门、邮政管理部门可以依法开拆查验。
If there is suspicion of violation of the first or second paragraph of this Article, the transportation department or the postalmanagement department may open and inspect according to law.
通过铁路、航空运输危险化学品的安全管理，依照有关铁路、航空运输的法律、行政法规、规章的规定执行。
The safety management of hazardous chemicals transported by railway or air shall be carried out in accordance with the relevant laws, administrative regulations, and rules on railway and air transport.
危险化学品登记与事故应急救援
Registration of Hazardous Chemicals and Emergency Rescue for Accidents
国家实行危险化学品登记制度，为危险化学品安全管理以及危险化学品事故预防和应急救援提供技术、信息支持。
The state implements a registration system for hazardous chemicals to provide technical and information support for the safety management of hazardous chemicals and the prevention of and emergency rescue for hazardous chemical accidents.
危险化学品生产企业、进口企业，应当向国务院安全生产监督管理部门负责危险化学品登记的机构(以下简称危险化学品登记机构)办理危险化学品登记。
Hazardous chemical production enterprises and import enterprises shall register hazardous chemicals with the institution responsible for hazardous chemical registration under the safety production supervision and management department of the State Council (hereinafter referred to as the hazardous chemical registration institution).
危险化学品登记包括下列内容：

(一)分类和标签信息；
(1) Classification and label information;
(二)物理、化学性质；
(2) Physical and chemical properties;
(三)主要用途；
(3) Main uses;
(四)危险特性；
(4) Hazardous characteristics;
(五)储存、使用、运输的安全要求；
(5) Safety requirements for storage, use, and transportation;
(六)出现危险情况的应急处置措施。
(6) Emergency response measures in case of dangerous situations.
对同一企业生产、进口的同一品种的危险化学品，不进行重复登记。危险化学品生产企业、进口企业发现其生产、进口的危险化学品有新的危险特性的，应当及时向危险化学品登记机构办理登记内容变更手续。
For the same variety of hazardous chemicals produced or imported by the same enterprise, duplicate registration shall not be carried out. If a hazardous chemical production enterprise or import enterprise discovers new hazardous characteristics of the hazardous chemicals it produces or imports, it shall promptly go through the procedures for changing the registration content with the hazardous chemical registration institution.
危险化学品登记的具体办法由国务院安全生产监督管理部门制定。

危险化学品登记机构应当定期向工业和信息化、环境保护、公安、卫生、交通运输、铁路、质量监督检验检疫等部门提供危险化学品登记的有关信息和资料。
The hazardous chemical registration institution shall regularly provide relevant information and materials on hazardous chemical registration to departments such as industry and information technology, environmental protection, public security, health, transportation, railway, and quality supervision, inspection and quarantine.
县级以上地方人民政府安全生产监督管理部门应当会同工业和信息化、环境保护、公安、卫生、交通运输、铁路、质量监督检验检疫等部门，根据本地区实际情况，制定危险化学品事故应急预案，报本级人民政府批准。
The work safety supervision and management department of the local people's government at or above the county level shall, together with the departments of industry and information technology, environmental protection, public security, health, transportation, railway, quality supervision, inspection and quarantine, etc., formulate an emergency response plan for hazardous chemical accidents based on the actual conditions of the region, and submit it to the people's government at the same level for approval.
危险化学品单位应当制定本单位危险化学品事故应急预案，配备应急救援人员和必要的应急救援器材、设备，并定期组织应急救援演练。
A hazardous chemical unit shall formulate its own emergency response plan for hazardous chemical accidents, equip itself with emergency rescue personnel and necessary emergency rescue equipment and devices, and regularly organize emergency rescue drills.
危险化学品单位应当将其危险化学品事故应急预案报所在地设区的市级人民政府安全生产监督管理部门备案。
A hazardous chemical unit shall file its emergency response plan for hazardous chemical accidents with the work safety supervision and management department of the people's government at the city divided into districts level where it is located.
发生危险化学品事故，事故单位主要负责人应当立即按照本单位危险化学品应急预案组织救援，并向当地安全生产监督管理部门和环境保护、公安、卫生主管部门报告；道路运输、水路运输过程中发生危险化学品事故的，驾驶人员、船员或者押运人员还应当向事故发生地交通运输主管部门报告。
When a hazardous chemical accident occurs, the principal responsible person of the unit where the accident occurred shall immediately organize rescue according to the unit's hazardous chemical emergency response plan, and report to the local work safety supervision and management department and the departments of environmental protection, public security, and health; if the hazardous chemical accident occurs during road or waterway transportation, the driver, crew member, or escort shall also report to the transportationcompetent authority of the place where the accident occurred.
发生危险化学品事故，有关地方人民政府应当立即组织安全生产监督管理、环境保护、公安、卫生、交通运输等有关部门，按照本地区危险化学品事故应急预案组织实施救援，不得拖延、推诿。
When a hazardous chemical accident occurs, the relevant local people's government shall immediately organize the work safety supervision and management, environmental protection, public security, health, transportation and other relevant departments to organize and implement rescue according to the local hazardous chemical accident emergency response plan, and shall not delay or shirk.
有关地方人民政府及其有关部门应当按照下列规定，采取必要的应急处置措施，减少事故损失，防止事故蔓延、扩大：
The relevant local people's government and its relevant departments shall take necessary emergency response measures according to the following provisions to reduce accident losses and prevent the accident from spreading and expanding:
(一)立即组织营救和救治受害人员，疏散、撤离或者采取其他措施保护危害区域内的其他人员；
(1) Immediately organize the rescue and treatment of injured persons, evacuate, remove or take other measures to protect other persons in the hazardous area;
(二)迅速控制危害源，测定危险化学品的性质、事故的危害区域及危害程度；
(2) Quickly control the source of hazard, determine the nature of the hazardous chemicals, the hazardous area of the accident and the degree of hazard;
(三)针对事故对人体、动植物、土壤、水源、大气造成的现实危害和可能产生的危害，迅速采取封闭、隔离、洗消等措施；
(3) In view of the actual harm and possible harm caused by the accident to human body, animals and plants, soil, water sources, and atmosphere, quickly take measures such as sealing, isolation, decontamination, etc.;
(四)对危险化学品事故造成的环境污染和生态破坏状况进行监测、评估，并采取相应的环境污染治理和生态修复措施。
(4) Monitor and assess the environmental pollution and ecological damage caused by the hazardous chemical accident, and take corresponding environmental pollution control and ecological restoration measures.
有关危险化学品单位应当为危险化学品事故应急救援提供技术指导和必要的协助。
The relevant hazardous chemical unit shall provide technical guidance and necessary assistance for the emergency rescue of hazardous chemical accidents.
危险化学品事故造成环境污染的，由设区的市级以上人民政府环境保护主管部门统一发布有关信息。
If a hazardous chemical accident causes environmental pollution, the environmental protection department of the people's government at or above the city divided into districts level shall uniformly release relevant information.
法律责任
Legal Liability
生产、经营、使用国家禁止生产、经营、使用的危险化学品的，由安全生产监督管理部门责令停止生产、经营、使用活动，处20万元以上50万元以下的罚款，有违法所得的，没收违法所得；构成犯罪的，依法追究刑事责任。
Whoever produces, operates, or uses hazardous chemicals that are prohibited from production, operation, or use by the state shall be ordered by the work safety supervision and management department to stop the production, operation, or use activities, and shall be fined not less than 200,000 yuan but not more than 500,000 yuan; if there is illegal income, the illegal income shall be confiscated; if a crime is constituted, criminal liability shall be pursued according to law.
有前款规定行为的，安全生产监督管理部门还应当责令其对所生产、经营、使用的危险化学品进行无害化处理。
If there is conduct as described in the preceding paragraph, the work safety supervision and management department shall also order it to carry out harmless treatment of the hazardous chemicals it produces, operates, or uses.
违反国家关于危险化学品使用的限制性规定使用危险化学品的，依照本条第一款的规定处理。
Whoever uses hazardous chemicals in violation of the state's restrictive provisions on the use of hazardous chemicals shall be dealt with according to the provisions of the first paragraph of this article.
未经安全条件审查，新建、改建、扩建生产、储存危险化学品的建设项目的，由安全生产监督管理部门责令停止建设，限期改正；逾期不改正的，处50万元以上100万元以下的罚款；构成犯罪的，依法追究刑事责任。
If a construction project for the new construction, reconstruction, or expansion of production or storage of hazardous chemicals is carried out without safety condition review, the work safety supervision and management department shall order the cessation of construction and correction within a time limit; if correction is not made within the time limit, a fine of not less than 500,000 yuan but not more than 1,000,000 yuan shall be imposed; if a crime is constituted, criminal liability shall be pursued according to law.
未经安全条件审查，新建、改建、扩建储存、装卸危险化学品的港口建设项目的，由港口行政管理部门依照前款规定予以处罚。
If a port construction project for the new construction, reconstruction, or expansion of storage or loading and unloading of hazardous chemicals is carried out without safety condition review, the port administrative department shall impose a penalty according to the provisions of the preceding paragraph.
未依法取得危险化学品安全生产许可证从事危险化学品生产，或者未依法取得工业产品生产许可证从事危险化学品及其包装物、容器生产的，分别依照《安全生产许可证条例》、《中华人民共和国工业产品生产许可证管理条例》的规定处罚。
Whoever engages in the production of hazardous chemicals without lawfully obtaining a hazardous chemical production safety permit, or engages in the production of hazardous chemicals and their packaging materials and containers without lawfully obtaining an industrial product production license, shall be punished respectively according to the provisions of the Regulations on the Administration of Production Safety Permits and the Regulations of the People's Republic of China on the Administration of Industrial Product Production Licenses.
违反本条例规定，化工企业未取得危险化学品安全使用许可证，使用危险化学品从事生产的，由安全生产监督管理部门责令限期改正，处10万元以上20万元以下的罚款；逾期不改正的，责令停产整顿。
In violation of these regulations, if a chemical enterprise uses hazardous chemicals for production without obtaining a hazardous chemical safety use permit, the work safety supervision and management department shall order correction within a time limit and impose a fine of not less than 100,000 yuan but not more than 200,000 yuan; if correction is not made within the time limit, it shall be ordered to suspend production for rectification.
违反本条例规定，未取得危险化学品经营许可证从事危险化学品经营的，由安全生产监督管理部门责令停止经营活动，没收违法经营的危险化学品以及违法所得，并处10万元以上20万元以下的罚款；构成犯罪的，依法追究刑事责任。
In violation of these regulations, if anyone engages in the operation of hazardous chemicals without obtaining a hazardous chemical operation permit, the work safety supervision and management department shall order the cessation of business activities, confiscate the illegally operated hazardous chemicals and illegal income, and impose a fine of not less than 100,000 yuan but not more than 200,000 yuan; if a crime is constituted, criminal liability shall be pursued according to law.
有下列情形之一的，由安全生产监督管理部门责令改正，可以处5万元以下的罚款；拒不改正的，处5万元以上10万元以下的罚款；情节严重的，责令停产停业整顿：
Under any of the following circumstances, the work safety supervision and management department shall order correction and may impose a fine of not more than 50,000 yuan; if correction is refused, a fine of not less than 50,000 yuan but not more than 100,000 yuan shall be imposed; if the circumstances are serious, production or business shall be ordered to suspend for rectification:
(一)生产、储存危险化学品的单位未对其铺设的危险化学品管道设置明显的标志，或者未对危险化学品管道定期检查、检测的；
(1) A unit that produces or stores hazardous chemicals fails to set up obvious signs for its laid hazardous chemical pipelines, or fails to regularly inspect and test the hazardous chemical pipelines;
(二)进行可能危及危险化学品管道安全的施工作业，施工单位未按照规定书面通知管道所属单位，或者未与管道所属单位共同制定应急预案、采取相应的安全防护措施，或者管道所属单位未指派专门人员到现场进行管道安全保护指导的；
(2) During construction operations that may endanger the safety of hazardous chemical pipelines, the construction unit fails to notify the pipeline owner in writing as required, or fails to jointly formulate an emergency response plan with the pipeline owner and take corresponding safety protection measures, or the pipeline owner fails to assign specialized personnel to the site to provide guidance on pipeline safety protection;
(三)危险化学品生产企业未提供化学品安全技术说明书，或者未在包装(包括外包装件)上粘贴、拴挂化学品安全标签的；
(3) A hazardous chemical production enterprise fails to provide a chemical safety data sheet, or fails to affix or attach a chemical safety label on the packaging (including outer packaging);
(四)危险化学品生产企业提供的化学品安全技术说明书与其生产的危险化学品不相符，或者在包装(包括外包装件)粘贴、拴挂的化学品安全标签与包装内危险化学品不相符，或者化学品安全技术说明书、化学品安全标签所载明的内容不符合国家标准要求的；
(4) The chemical safety data sheet provided by a hazardous chemical production enterprise does not match the hazardous chemicals it produces, or the chemical safety label affixed or attached on the packaging (including outer packaging) does not match the hazardous chemicals inside the packaging, or the contents of the chemical safety data sheet or chemical safety label do not meet the requirements of national standards;
(五)危险化学品生产企业发现其生产的危险化学品有新的危险特性不立即公告，或者不及时修订其化学品安全技术说明书和化学品安全标签的；
(5) A hazardous chemical production enterprise discovers new hazardous characteristics of the hazardous chemicals it produces but fails to immediately announce them, or fails to promptly revise its chemical safety data sheet and chemical safety label;
(六)危险化学品经营企业经营没有化学品安全技术说明书和化学品安全标签的危险化学品的；
(6) A hazardous chemical operating enterprise operates hazardous chemicals without chemical safety data sheets and chemical safety labels;
(七)危险化学品包装物、容器的材质以及包装的型式、规格、方法和单件质量(重量)与所包装的危险化学品的性质和用途不相适应的；
(7) The material of hazardous chemical packaging materials and containers, as well as the type, specification, method, and unit mass (weight) of packaging, are not suitable for the nature and use of the packaged hazardous chemicals;
(八)生产、储存危险化学品的单位未在作业场所和安全设施、设备上设置明显的安全警示标志，或者未在作业场所设置通信、报警装置的；
(8) A unit that produces or stores hazardous chemicals fails to set up obvious safety warning signs at the workplace and on safety facilities and equipment, or fails to set up communication and alarm devices at the workplace;
(九)危险化学品专用仓库未设专人负责管理，或者对储存的剧毒化学品以及储存数量构成重大危险源的其他危险化学品未实行双人收发、双人保管制度的；
(9) A dedicated warehouse for hazardous chemicals is not managed by a designated person, or for stored highly toxic chemicals and other hazardous chemicals whose storage quantity constitutes a major hazard source, the dual-person receipt and dual-person custody system is not implemented;
(十)储存危险化学品的单位未建立危险化学品出入库核查、登记制度的；
(10) A unit that stores hazardous chemicals fails to establish a system for checking and registering the entry and exit of hazardous chemicals;
(十一)危险化学品专用仓库未设置明显标志的；
(11) A dedicated warehouse for hazardous chemicals is not set up with obvious signs;
(十二)危险化学品生产企业、进口企业不办理危险化学品登记，或者发现其生产、进口的危险化学品有新的危险特性不办理危险化学品登记内容变更手续的。
(12) A hazardous chemical production enterprise or import enterprise fails to register hazardous chemicals, or discovers new hazardous characteristics of the hazardous chemicals it produces or imports but fails to go through the procedures for changing the registration content of hazardous chemicals.
从事危险化学品仓储经营的港口经营人有前款规定情形的，由港口行政管理部门依照前款规定予以处罚。储存剧毒化学品、易制爆危险化学品的专用仓库未按照国家有关规定设置相应的技术防范设施的，由公安机关依照前款规定予以处罚。
If a port operator engaged in hazardous chemical warehousing and operation has any of the circumstances in the preceding paragraph, the port administrative department shall impose a penalty according to the provisions of the preceding paragraph. If a dedicated warehouse for storing highly toxic chemicals or chemicals that are easy to cause explosion fails to set up corresponding technical prevention facilities according to relevant state regulations, the public security organ shall impose a penalty according to the provisions of the preceding paragraph.
生产、储存剧毒化学品、易制爆危险化学品的单位未设置治安保卫机构、配备专职治安保卫人员的，依照《企业事业单位内部治安保卫条例》的规定处罚。
If a unit that produces or stores highly toxic chemicals or chemicals that are easy to cause explosion fails to set up a security guard organization or equip full-time security guards, it shall be punished according to the provisions of the Regulations on Internal Security of Enterprises and Institutions.
危险化学品包装物、容器生产企业销售未经检验或者经检验不合格的危险化学品包装物、容器的，由质量监督检验检疫部门责令改正，处10万元以上20万元以下的罚款，有违法所得的，没收违法所得；拒不改正的，责令停产停业整顿；构成犯罪的，依法追究刑事责任。
If a manufacturer of hazardous chemical packaging materials and containers sells packaging materials and containers that have not been inspected or have been inspected and found unqualified, the quality supervision, inspection and quarantine department shall order correction, impose a fine of not less than 100,000 yuan but not more than 200,000 yuan, and confiscate any illegal income; if correction is refused, it shall be ordered to suspend production or business for rectification; if a crime is constituted, criminal liability shall be pursued according to law.
将未经检验合格的运输危险化学品的船舶及其配载的容器投入使用的，由海事管理机构依照前款规定予以处罚。
If a vessel for transporting hazardous chemicals and its stowed containers that have not passed inspection are put into use, the maritime administrative agency shall impose a penalty according to the provisions of the preceding paragraph.
生产、储存、使用危险化学品的单位有下列情形之一的，由安全生产监督管理部门责令改正，处5万元以上10万元以下的罚款；拒不改正的，责令停产停业整顿直至由原发证机关吊销其相关许可证件，并由工商行政管理部门责令其办理经营范围变更登记或者吊销其营业执照；有关责任人员构成犯罪的，依法追究刑事责任：
If a unit that produces, stores, or uses hazardous chemicals has any of the following circumstances, the work safety supervision and management department shall order correction and impose a fine of not less than 50,000 yuan but not more than 100,000 yuan; if correction is refused, it shall be ordered to suspend production or business for rectification until the original issuing authority revokes its relevant license, and the administrative department for industry and commerce shall order it to go through the procedures for changing its business scope or revoke its business license; if the responsible personnel constitute a crime, criminal liability shall be pursued according to law:
(一)对重复使用的危险化学品包装物、容器，在重复使用前不进行检查的；
(1) Failing to inspect reusable hazardous chemical packaging materials and containers before reuse;
(二)未根据其生产、储存的危险化学品的种类和危险特性，在作业场所设置相关安全设施、设备，或者未按照国家标准、行业标准或者国家有关规定对安全设施、设备进行经常性维护、保养的；
(2) Failing to set up relevant safety facilities and equipment at the workplace according to the types and hazardous characteristics of the hazardous chemicals it produces or stores, or failing to regularly maintain and service the safety facilities and equipment according to national standards, industry standards, or relevant state regulations;
(三)未依照本条例规定对其安全生产条件定期进行安全评价的；
(3) Failing to conduct regular safety assessments of its safety production conditions as required by these regulations;
(四)未将危险化学品储存在专用仓库内，或者未将剧毒化学品以及储存数量构成重大危险源的其他危险化学品在专用仓库内单独存放的；
(4) Failing to store hazardous chemicals in dedicated warehouses, or failing to store highly toxic chemicals and other hazardous chemicals whose storage quantity constitutes a major hazard source separately in dedicated warehouses;
(五)危险化学品的储存方式、方法或者储存数量不符合国家标准或者国家有关规定的；
(5) The storage method, manner, or quantity of hazardous chemicals does not meet national standards or relevant state regulations;
(六)危险化学品专用仓库不符合国家标准、行业标准的要求的；
(6) The dedicated warehouse for hazardous chemicals does not meet the requirements of national standards or industry standards;
(七)未对危险化学品专用仓库的安全设施、设备定期进行检测、检验的。
(7) Failing to regularly test and inspect the safety facilities and equipment of the dedicated warehouse for hazardous chemicals.
从事危险化学品仓储经营的港口经营人有前款规定情形的，由港口行政管理部门依照前款规定予以处罚。
If a port operator engaged in hazardous chemical warehousing and operation has any of the circumstances in the preceding paragraph, the port administrative department shall impose a penalty according to the provisions of the preceding paragraph.
有下列情形之一的，由公安机关责令改正，可以处1万元以下的罚款；拒不改正的，处1万元以上5万元以下的罚款：
Under any of the following circumstances, the public security organ shall order correction and may impose a fine of not more than 10,000 yuan; if correction is refused, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed:
(一)生产、储存、使用剧毒化学品、易制爆危险化学品的单位不如实记录生产、储存、使用的剧毒化学品、易制爆危险化学品的数量、流向的；
(1) A unit that produces, stores, or uses highly toxic chemicals or chemicals that are easy to cause explosion fails to truthfully record the quantity and flow direction of the highly toxic chemicals or chemicals that are easy to cause explosion it produces, stores, or uses;
(二)生产、储存、使用剧毒化学品、易制爆危险化学品的单位发现剧毒化学品、易制爆危险化学品丢失或者被盗，不立即向公安机关报告的；
(2) A unit that produces, stores, or uses highly toxic chemicals or chemicals that are easy to cause explosion discovers that the highly toxic chemicals or chemicals that are easy to cause explosion are lost or stolen but fails to immediately report to the public security organ;
(三)储存剧毒化学品的单位未将剧毒化学品的储存数量、储存地点以及管理人员的情况报所在地县级人民政府公安机关备案的；
(3) A unit that stores highly toxic chemicals fails to report the storage quantity, storage location, and information on the management personnel of the highly toxic chemicals to the public security organ of the people's government at the county level where it is located for the record;
(四)危险化学品生产企业、经营企业不如实记录剧毒化学品、易制爆危险化学品购买单位的名称、地址、经办人的姓名、身份证号码以及所购买的剧毒化学品、易制爆危险化学品的品种、数量、用途，或者保存销售记录和相关材料的时间少于1年的；
(4) A hazardous chemical production enterprise or operating enterprise fails to truthfully record the name, address, name and ID number of the handler, and the type, quantity, and use of the highly toxic chemicals or chemicals that are easy to cause explosion purchased by the purchasing unit, or fails to keep the sales records and related materials for less than one year;
(五)剧毒化学品、易制爆危险化学品的销售企业、购买单位未在规定的时限内将所销售、购买的剧毒化学品、易制爆危险化学品的品种、数量以及流向信息报所在地县级人民政府公安机关备案的；
(5) A sales enterprise or purchasing unit of highly toxic chemicals or chemicals that are easy to cause explosion fails to report the type, quantity, and flow direction information of the highly toxic chemicals or chemicals that are easy to cause explosion sold or purchased to the public security organ of the people's government at the county level where it is located for the record within the prescribed time limit;
(六)使用剧毒化学品、易制爆危险化学品的单位依照本条例规定转让其购买的剧毒化学品、易制爆危险化学品，未将有关情况向所在地县级人民政府公安机关报告的。
(6) A unit that uses highly toxic chemicals or chemicals that are easy to cause explosion transfers the highly toxic chemicals or chemicals that are easy to cause explosion it purchased according to these regulations but fails to report the relevant information to the public security organ of the people's government at the county level where it is located.
生产、储存危险化学品的企业或者使用危险化学品从事生产的企业未按照本条例规定将安全评价报告以及整改方案的落实情况报安全生产监督管理部门或者港口行政管理部门备案，或者储存危险化学品的单位未将其剧毒化学品以及储存数量构成重大危险源的其他危险化学品的储存数量、储存地点以及管理人员的情况报安全生产监督管理部门或者港口行政管理部门备案的，分别由安全生产监督管理部门或者港口行政管理部门依照前款规定予以处罚。
If an enterprise that produces or stores hazardous chemicals or an enterprise that uses hazardous chemicals for production fails to file the safety assessment report and the implementation of the rectification plan with the work safety supervision and management department or the port administrative department as required by these regulations, or if a unit that stores hazardous chemicals fails to report the storage quantity, storage location, and information on the management personnel of its highly toxic chemicals and other hazardous chemicals whose storage quantity constitutes a major hazard source to the work safety supervision and management department or the port administrative department for the record, the work safety supervision and management department or the port administrative department shall impose a penalty according to the provisions of the first paragraph of this article.
生产实施重点环境管理的危险化学品的企业或者使用实施重点环境管理的危险化学品从事生产的企业未按照规定将相关信息向环境保护主管部门报告的，由环境保护主管部门依照本条第一款的规定予以处罚。
If an enterprise that produces hazardous chemicals subject to key environmental management or an enterprise that uses hazardous chemicals subject to key environmental management for production fails to report relevant information to the environmental protection department as required, the environmental protection department shall impose a penalty according to the provisions of the first paragraph of this article.
生产、储存、使用危险化学品的单位转产、停产、停业或者解散，未采取有效措施及时、妥善处置其危险化学品生产装置、储存设施以及库存的危险化学品，或者丢弃危险化学品的，由安全生产监督管理部门责令改正，处5万元以上10万元以下的罚款；构成犯罪的，依法追究刑事责任。
If a unit that produces, stores, or uses hazardous chemicals changes its product, stops production, stops business, or dissolves, and fails to take effective measures to promptly and properly dispose of its hazardous chemical production facilities, storage facilities, and stored hazardous chemicals, or abandons hazardous chemicals, the work safety supervision and management department shall order correction and impose a fine of not less than 50,000 yuan but not more than 100,000 yuan; if a crime is constituted, criminal liability shall be pursued according to law.
生产、储存、使用危险化学品的单位转产、停产、停业或者解散，未依照本条例规定将其危险化学品生产装置、储存设施以及库存危险化学品的处置方案报有关部门备案的，分别由有关部门责令改正，可以处1万元以下的罚款；拒不改正的，处1万元以上5万元以下的罚款。
If a unit that produces, stores, or uses hazardous chemicals changes its product, stops production, stops business, or dissolves, and fails to file its disposal plan for its hazardous chemical production facilities, storage facilities, and stored hazardous chemicals with the relevant departments as required by these regulations, the relevant departments shall order correction and may impose a fine of not more than 10,000 yuan; if correction is refused, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed.
危险化学品经营企业向未经许可违法从事危险化学品生产、经营活动的企业采购危险化学品的，由工商行政管理部门责令改正，处10万元以上20万元以下的罚款；拒不改正的，责令停业整顿直至由原发证机关吊销其危险化学品经营许可证，并由工商行政管理部门责令其办理经营范围变更登记或者吊销其营业执照。
If a hazardous chemical operating enterprise purchases hazardous chemicals from an enterprise that illegally engages in the production or operation of hazardous chemicals without a permit, the administrative department for industry and commerce shall order correction and impose a fine of not less than 100,000 yuan but not more than 200,000 yuan; if correction is refused, it shall be ordered to suspend business for rectification until the original issuing authority revokes its hazardous chemical operation permit, and the administrative department for industry and commerce shall order it to go through the procedures for changing its business scope or revoke its business license.
危险化学品生产企业、经营企业有下列情形之一的，由安全生产监督管理部门责令改正，没收违法所得，并处10万元以上20万元以下的罚款；拒不改正的，责令停产停业整顿直至吊销其危险化学品安全生产许可证、危险化学品经营许可证，并由工商行政管理部门责令其办理经营范围变更登记或者吊销其营业执照：
If a hazardous chemical production enterprise or operating enterprise has any of the following circumstances, the work safety supervision and management department shall order correction, confiscate illegal income, and impose a fine of not less than 100,000 yuan but not more than 200,000 yuan; if correction is refused, it shall be ordered to suspend production or business for rectification until its hazardous chemical production safety permit or hazardous chemical operation permit is revoked, and the administrative department for industry and commerce shall order it to go through the procedures for changing its business scope or revoke its business license:
(一)向不具有本条例第三十八条第一款、第二款规定的相关许可证件或者证明文件的单位销售剧毒化学品、易制爆危险化学品的；
(1) Selling highly toxic chemicals or chemicals that are easy to cause explosion to a unit that does not have the relevant license or certification document as specified in Article 38, paragraphs 1 and 2 of these regulations;
(二)不按照剧毒化学品购买许可证载明的品种、数量销售剧毒化学品的；
(2) Selling highly toxic chemicals not in accordance with the variety and quantity specified in the highly toxic chemical purchase permit;
(三)向个人销售剧毒化学品(属于剧毒化学品的农药除外)、易制爆危险化学品的。
(3) Selling highly toxic chemicals (except pesticides that are highly toxic chemicals) or chemicals that are easy to cause explosion to individuals.
不具有本条例第三十八条第一款、第二款规定的相关许可证件或者证明文件的单位购买剧毒化学品、易制爆危险化学品，或者个人购买剧毒化学品(属于剧毒化学品的农药除外)、易制爆危险化学品的，由公安机关没收所购买的剧毒化学品、易制爆危险化学品，可以并处5000元以下的罚款。
If a unit that does not have the relevant license or certification document as specified in Article 38, paragraphs 1 and 2 of these regulations purchases highly toxic chemicals or chemicals that are easy to cause explosion, or if an individual purchases highly toxic chemicals (except pesticides that are highly toxic chemicals) or chemicals that are easy to cause explosion, the public security organ shall confiscate the purchased highly toxic chemicals or chemicals that are easy to cause explosion, and may also impose a fine of not more than 5,000 yuan.
使用剧毒化学品、易制爆危险化学品的单位出借或者向不具有本条例第三十八条第一款、第二款规定的相关许可证件的单位转让其购买的剧毒化学品、易制爆危险化学品，或者向个人转让其购买的剧毒化学品(属于剧毒化学品的农药除外)、易制爆危险化学品的，由公安机关责令改正，处10万元以上20万元以下的罚款；拒不改正的，责令停产停业整顿。
If a unit that uses highly toxic chemicals or chemicals that are easy to cause explosion lends or transfers the highly toxic chemicals or chemicals that are easy to cause explosion it purchased to a unit that does not have the relevant license or certification document as specified in Article 38, paragraphs 1 and 2 of these regulations, or transfers them to an individual (except pesticides that are highly toxic chemicals), the public security organ shall order correction and impose a fine of not less than 100,000 yuan but not more than 200,000 yuan; if correction is refused, it shall be ordered to suspend production or business for rectification.
未依法取得危险货物道路运输许可、危险货物水路运输许可，从事危险化学品道路运输、水路运输的，分别依照有关道路运输、水路运输的法律、行政法规的规定处罚。
Whoever engages in road transportation or waterway transportation of hazardous chemicals without lawfully obtaining a dangerous goods road transportation permit or a dangerous goods waterway transportation permit shall be punished respectively according to the laws and administrative regulations on road transportation and waterway transportation.
有下列情形之一的，由交通运输主管部门责令改正，处5万元以上10万元以下的罚款；拒不改正的，责令停产停业整顿；构成犯罪的，依法追究刑事责任：
Under any of the following circumstances, the transportation competent department shall order correction and impose a fine of not less than 50,000 yuan but not more than 100,000 yuan; if correction is refused, it shall be ordered to suspend production or business for rectification; if a crime is constituted, criminal liability shall be pursued according to law:
(一)危险化学品道路运输企业、水路运输企业的驾驶人员、船员、装卸管理人员、押运人员、申报人员、集装箱装箱现场检查员未取得从业资格上岗作业的；
(1) The driver, crew member, loading and unloading manager, escort, declarant, or container packing site inspector of a hazardous chemical road transportation enterprise or waterway transportation enterprise works without obtaining the necessary professional qualifications;
(二)运输危险化学品，未根据危险化学品的危险特性采取相应的安全防护措施，或者未配备必要的防护用品和应急救援器材的；
(2) When transporting hazardous chemicals, failing to take corresponding safety protection measures according to the hazardous characteristics of the hazardous chemicals, or failing to equip necessary protective equipment and emergency rescue equipment;
(三)使用未依法取得危险货物适装证书的船舶，通过内河运输危险化学品的；
(3) Using a vessel that has not lawfully obtained a dangerous goods fitness certificate to transport hazardous chemicals through inland waters;
(四)通过内河运输危险化学品的承运人违反国务院交通运输主管部门对单船运输的危险化学品数量的限制性规定运输危险化学品的；
(4) A carrier transporting hazardous chemicals through inland waters violates the restrictive provisions of the competent department of transportation under the State Council on the quantity of hazardous chemicals transported by a single vessel;
(五)用于危险化学品运输作业的内河码头、泊位不符合国家有关安全规范，或者未与饮用水取水口保持国家规定的安全距离，或者未经交通运输主管部门验收合格投入使用的；
(5) An inland river dock or berth used for hazardous chemical transportation operations does not meet the relevant national safety specifications, or fails to maintain the safety distance from drinking water intake points as prescribed by the state, or is put into use without passing the acceptance inspection of the transportation competent department;
(六)托运人不向承运人说明所托运的危险化学品的种类、数量、危险特性以及发生危险情况的应急处置措施，或者未按照国家有关规定对所托运的危险化学品妥善包装并在外包装上设置相应标志的；
(6) The consignor fails to explain to the carrier the type, quantity, hazardous characteristics, and emergency response measures for hazardous situations of the hazardous chemicals consigned, or fails to properly package the consigned hazardous chemicals according to relevant state regulations and set corresponding signs on the outer packaging;
(七)运输危险化学品需要添加抑制剂或者稳定剂，托运人未添加或者未将有关情况告知承运人的。
(7) When transporting hazardous chemicals that require the addition of inhibitors or stabilizers, the consignor fails to add them or fails to inform the carrier of the relevant information.
有下列情形之一的，由交通运输主管部门责令改正，处10万元以上20万元以下的罚款，有违法所得的，没收违法所得；拒不改正的，责令停产停业整顿；构成犯罪的，依法追究刑事责任：
Under any of the following circumstances, the transportation competent department shall order correction, impose a fine of not less than 100,000 yuan but not more than 200,000 yuan, and confiscate any illegal income; if correction is refused, it shall be ordered to suspend production or business for rectification; if a crime is constituted, criminal liability shall be pursued according to law:
(一)委托未依法取得危险货物道路运输许可、危险货物水路运输许可的企业承运危险化学品的；
(1) Entrusting an enterprise that has not lawfully obtained a dangerous goods road transportation permit or a dangerous goods waterway transportation permit to carry hazardous chemicals;
(二)通过内河封闭水域运输剧毒化学品以及国家规定禁止通过内河运输的其他危险化学品的；
(2) Transporting highly toxic chemicals through enclosed inland waters or other hazardous chemicals that are prohibited from being transported through inland waters by the state;
(三)通过内河运输国家规定禁止通过内河运输的剧毒化学品以及其他危险化学品的；
(3) Transporting highly toxic chemicals or other hazardous chemicals that are prohibited from being transported through inland waters by the state through inland waters;
(四)在托运的普通货物中夹带危险化学品，或者将危险化学品谎报或者匿报为普通货物托运的。
(4) Mixing hazardous chemicals in ordinary goods consigned for transport, or falsely reporting or concealing hazardous chemicals as ordinary goods for consignment.
在邮件、快件内夹带危险化学品，或者将危险化学品谎报为普通物品交寄的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
If hazardous chemicals are mixed in mail or express items, or falsely reported as ordinary items for delivery, a public security penalty shall be imposed according to law; if a crime is constituted, criminal liability shall be pursued according to law.
邮政企业、快递企业收寄危险化学品的，依照《中华人民共和国邮政法》的规定处罚。
If a postal enterprise or express delivery enterprise accepts hazardous chemicals for delivery, it shall be punished according to the provisions of the Postal Law of the People's Republic of China.
有下列情形之一的，由公安机关责令改正，处5万元以上10万元以下的罚款；构成违反治安管理行为的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任：
Under any of the following circumstances, the public security organ shall order correction and impose a fine of not less than 50,000 yuan but not more than 100,000 yuan; if a violation of public security administration is constituted, a public security penalty shall be imposed according to law; if a crime is constituted, criminal liability shall be pursued according to law:
(一)超过运输车辆的核定载质量装载危险化学品的；
(1) Loading hazardous chemicals exceeding the rated load mass of the transport vehicle;
(二)使用安全技术条件不符合国家标准要求的车辆运输危险化学品的；
(2) Using a vehicle whose safety technical conditions do not meet the requirements of national standards to transport hazardous chemicals;
(三)运输危险化学品的车辆未经公安机关批准进入危险化学品运输车辆限制通行的区域的；
(3) A vehicle transporting hazardous chemicals enters an area where the transport of hazardous chemicals is restricted without the approval of the public security organ;
(四)未取得剧毒化学品道路运输通行证，通过道路运输剧毒化学品的。
(4) Transporting highly toxic chemicals by road without obtaining a road transport permit for highly toxic chemicals.
有下列情形之一的，由公安机关责令改正，处1万元以上5万元以下的罚款；构成违反治安管理行为的，依法给予治安管理处罚：
Under any of the following circumstances, the public security organ shall order correction and impose a fine of not less than 10,000 yuan but not more than 50,000 yuan; if a violation of public security administration is constituted, a public security penalty shall be imposed according to law:
(一)危险化学品运输车辆未悬挂或者喷涂警示标志，或者悬挂或者喷涂的警示标志不符合国家标准要求的；
(1) A hazardous chemical transport vehicle is not equipped with or does not display a warning sign, or the warning sign displayed does not meet the requirements of national standards;
(二)通过道路运输危险化学品，不配备押运人员的；
(2) When transporting hazardous chemicals by road, no escort is provided;
(三)运输剧毒化学品或者易制爆危险化学品途中需要较长时间停车，驾驶人员、押运人员不向当地公安机关报告的；
(3) When transporting highly toxic chemicals or chemicals that are easy to cause explosion, if a long stop is needed during the journey, the driver or escort fails to report to the local public security organ;
(四)剧毒化学品、易制爆危险化学品在道路运输途中丢失、被盗、被抢或者发生流散、泄露等情况，驾驶人员、押运人员不采取必要的警示措施和安全措施，或者不向当地公安机关报告的。
(4) If highly toxic chemicals or chemicals that are easy to cause explosion are lost, stolen, robbed, or scattered or leaked during road transport, the driver or escort fails to take necessary warning measures and safety measures, or fails to report to the local public security organ.
对发生交通事故负有全部责任或者主要责任的危险化学品道路运输企业，由公安机关责令消除安全隐患，未消除安全隐患的危险化学品运输车辆，禁止上道路行驶。
For a hazardous chemical road transport enterprise that bears full or primary responsibility for a traffic accident, the public security organ shall order it to eliminate safety hazards; hazardous chemical transport vehicles that have not eliminated safety hazards shall be prohibited from driving on the road.
有下列情形之一的，由交通运输主管部门责令改正，可以处1万元以下的罚款；拒不改正的，处1万元以上5万元以下的罚款：
Under any of the following circumstances, the transportation competent department shall order correction and may impose a fine of not more than 10,000 yuan; if correction is refused, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed:
(一)危险化学品道路运输企业、水路运输企业未配备专职安全管理人员的；
(1) A hazardous chemical road transport enterprise or waterway transport enterprise fails to equip full-time safety management personnel;
(二)用于危险化学品运输作业的内河码头、泊位的管理单位未制定码头、泊位危险化学品事故应急救援预案，或者未为码头、泊位配备充足、有效的应急救援器材和设备的。
(2) The management unit of an inland river dock or berth used for hazardous chemical transport operations fails to formulate an emergency rescue plan for hazardous chemical accidents at the dock or berth, or fails to equip the dock or berth with sufficient and effective emergency rescue equipment and devices.
有下列情形之一的，依照《中华人民共和国内河交通安全管理条例》的规定处罚：
Under any of the following circumstances, punishment shall be imposed according to the provisions of the Regulations of the People's Republic of China on the Safety Management of Inland River Traffic:
(一)通过内河运输危险化学品的水路运输企业未制定运输船舶危险化学品事故应急救援预案，或者未为运输船舶配备充足、有效的应急救援器材和设备的；
(1) A waterway transport enterprise that transports hazardous chemicals through inland waters fails to formulate an emergency rescue plan for hazardous chemical accidents on transport vessels, or fails to equip the transport vessels with sufficient and effective emergency rescue equipment and devices;
(二)通过内河运输危险化学品的船舶的所有人或者经营人未取得船舶污染损害责任保险证书或者财务担保证明的；
(2) The owner or operator of a vessel transporting hazardous chemicals through inland waters fails to obtain a certificate of insurance for pollution damage liability or a financial guarantee certificate;
(三)船舶载运危险化学品进出内河港口，未将有关事项事先报告海事管理机构并经其同意的；
(3) When a vessel carrying hazardous chemicals enters or leaves an inland river port, it fails to report the relevant matters to the maritime administrative agency in advance and obtain its consent;
(四)载运危险化学品的船舶在内河航行、装卸或者停泊，未悬挂专用的警示标志，或者未按照规定显示专用信号，或者未按照规定申请引航的。
(4) A vessel carrying hazardous chemicals navigating, loading/unloading, or berthing in inland waters fails to display a dedicated warning sign, or fails to display a dedicated signal as required, or fails to apply for pilotage as required.
未向港口行政管理部门报告并经其同意，在港口内进行危险化学品的装卸、过驳作业的，依照《中华人民共和国港口法》的规定处罚。
If loading/unloading or lightering operations of hazardous chemicals are carried out in a port without reporting to and obtaining the consent of the port administrative department, punishment shall be imposed according to the provisions of the Port Law of the People's Republic of China.
伪造、变造或者出租、出借、转让危险化学品安全生产许可证、工业产品生产许可证，或者使用伪造、变造的危险化学品安全生产许可证、工业产品生产许可证的，分别依照《安全生产许可证条例》、《中华人民共和国工业产品生产许可证管理条例》的规定处罚。
Whoever forges, alters, rents, lends, or transfers a hazardous chemical production safety permit or industrial product production license, or uses a forged or altered hazardous chemical production safety permit or industrial product production license, shall be punished respectively according to the provisions of the Regulations on the Administration of Production Safety Permits and the Regulations of the People's Republic of China on the Administration of Industrial Product Production Licenses.
伪造、变造或者出租、出借、转让本条例规定的其他许可证，或者使用伪造、变造的本条例规定的其他许可证的，分别由相关许可证的颁发管理机关处10万元以上20万元以下的罚款，有违法所得的，没收违法所得；构成违反治安管理行为的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
Whoever forges, alters, rents, lends, or transfers other licenses provided for in these regulations, or uses forged or altered other licenses provided for in these regulations, the relevant license issuing management authority shall impose a fine of not less than 100,000 yuan but not more than 200,000 yuan, and confiscate any illegal income; if a violation of public security administration is constituted, a public security penalty shall be imposed according to law; if a crime is constituted, criminal liability shall be pursued according to law.
危险化学品单位发生危险化学品事故，其主要负责人不立即组织救援或者不立即向有关部门报告的，依照《生产安全事故报告和调查处理条例》的规定处罚。
If a hazardous chemical unit has a hazardous chemical accident and its principal responsible person fails to immediately organize rescue or fails to immediately report to the relevant departments, punishment shall be imposed according to the provisions of the Regulations on the Reporting and Investigation of Production Safety Accidents.
危险化学品单位发生危险化学品事故，造成他人人身伤害或者财产损失的，依法承担赔偿责任。
If a hazardous chemical unit has a hazardous chemical accident causing personal injury or property damage to others, it shall bear compensation liability according to law.
发生危险化学品事故，有关地方人民政府及其有关部门不立即组织实施救援，或者不采取必要的应急处置措施减少事故损失，防止事故蔓延、扩大的，对直接负责的主管人员和其他直接责任人员依法给予处分；构成犯罪的，依法追究刑事责任。
If a hazardous chemical accident occurs and the relevant local people's government and its relevant departments fail to immediately organize rescue, or fail to take necessary emergency response measures to reduce accident losses and prevent the accident from spreading and expanding, the directly responsible person in charge and other directly responsible personnel shall be given sanctions according to law; if a crime is constituted, criminal liability shall be pursued according to law.
负有危险化学品安全监督管理职责的部门的工作人员，在危险化学品安全监督管理工作中滥用职权、玩忽职守、徇私舞弊，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予处分。
If a staff member of a department responsible for the supervision and management of hazardous chemical safety abuses power, neglects duty, or engages in malpractice for personal gain in the work of hazardous chemical safety supervision and management, if a crime is constituted, criminal liability shall be pursued according to law; if a crime is not constituted, sanctions shall be given according to law.
附则
Supplementary Provisions
监控化学品、属于危险化学品的药品和农药的安全管理，依照本条例的规定执行；法律、行政法规另有规定的，依照其规定。
The safety management of monitoring chemicals, pharmaceuticals and pesticides that are hazardous chemicals shall be implemented in accordance with these regulations; if laws and administrative regulations provide otherwise, those provisions shall prevail.
民用爆炸物品、烟花爆竹、放射性物品、核能物质以及用于国防科研生产的危险化学品的安全管理，不适用本条例。
The safety management of civil explosives, fireworks and firecrackers, radioactive substances, nuclear materials, and hazardous chemicals used for national defense scientific research and production shall not be subject to these regulations.
法律、行政法规对燃气的安全管理另有规定的，依照其规定。
If laws and administrative regulations provide otherwise for the safety management of fuel gas, those provisions shall prevail.
危险化学品容器属于特种设备的，其安全管理依照有关特种设备安全的法律、行政法规的规定执行。
If a hazardous chemical container is a special equipment, its safety management shall be implemented in accordance with the laws and administrative regulations on the safety of special equipment.
危险化学品的进出口管理，依照有关对外贸易的法律、行政法规、规章的规定执行；进口的危险化学品的储存、使用、经营、运输的安全管理，依照本条例的规定执行。
The import and export management of hazardous chemicals shall be implemented in accordance with the laws, administrative regulations, and rules on foreign trade; the safety management of the storage, use, operation, and transportation of imported hazardous chemicals shall be implemented in accordance with these regulations.
危险化学品环境管理登记和新化学物质环境管理登记，依照有关环境保护的法律、行政法规、规章的规定执行。危险化学品环境管理登记，按照国家有关规定收取费用。
The environmental management registration of hazardous chemicals and the environmental management registration of new chemical substances shall be implemented in accordance with the laws, administrative regulations, and rules on environmental protection. The environmental management registration of hazardous chemicals shall be charged fees according to relevant state regulations.
公众发现、捡拾的无主危险化学品，由公安机关接收。公安机关接收或者有关部门依法没收的危险化学品，需要进行无害化处理的，交由环境保护主管部门组织其认定的专业单位进行处理，或者交由有关危险化学品生产企业进行处理。处理所需费用由国家财政负担。
If the public discovers or picks up unclaimed hazardous chemicals, the public security organ shall take them over. Hazardous chemicals taken over by the public security organ or lawfully confiscated by relevant departments that require harmless treatment shall be handed over to the environmental protection department for organization of treatment by professional units recognized by it, or to relevant hazardous chemical production enterprises for treatment. The expenses required for treatment shall be borne by the state finance.
化学品的危险特性尚未确定的，由国务院安全生产监督管理部门、国务院环境保护主管部门、国务院卫生主管部门分别负责组织对该化学品的物理危险性、环境危害性、毒理特性进行鉴定。根据鉴定结果，需要调整危险化学品目录的，依照本条例第三条第二款的规定办理。
If the hazardous characteristics of a chemical have not yet been determined, the work safety supervision and management department of the State Council, the environmental protection department of the State Council, and the health department of the State Council shall respectively be responsible for organizing the identification of the physical hazard, environmental hazard, and toxicological properties of the chemical. If, based on the identification results, the hazardous chemical catalog needs to be adjusted, it shall be handled in accordance with the provisions of Article 3, paragraph 2 of these regulations.
本条例施行前已经使用危险化学品从事生产的化工企业，依照本条例规定需要取得危险化学品安全使用许可证的，应当在国务院安全生产监督管理部门规定的期限内，申请取得危险化学品安全使用许可证。
If a chemical enterprise that has used hazardous chemicals for production before the implementation of these regulations needs to obtain a hazardous chemical safety use permit according to these regulations, it shall apply for a hazardous chemical safety use permit within the time limit prescribed by the work safety supervision and management department of the State Council.
本条例自2011年12月1日起施行。
These regulations shall come into force as of December 1, 2011.
