为了加强对奥林匹克标志的保护，保障奥林匹克标志权利人的合法权益，促进奥林匹克运动发展，制定本条例。
These Regulations are formulated to strengthen the protection of Olympic symbols, safeguard the legitimate rights and interests of the owners of Olympic symbols, and promote the development of the Olympic movement.
本条例所称奥林匹克标志，是指：
For the purposes of these Regulations, Olympic symbols refer to:
(一)国际奥林匹克委员会的奥林匹克五环图案标志、奥林匹克旗、奥林匹克格言、奥林匹克徽记、奥林匹克会歌；
(1) The Olympic five-ring emblem, Olympic flag, Olympic motto, Olympic emblem, and Olympic anthem of the International Olympic Committee;
(二)奥林匹克、奥林匹亚、奥林匹克运动会及其简称等专有名称；
(2) The exclusive names such as Olympic, Olympiad, Olympic Games, and their abbreviations;
(三)中国奥林匹克委员会的名称、徽记、标志；
(3) The name, emblem, and symbol of the Chinese Olympic Committee;
(四)中国境内申请承办奥林匹克运动会的机构的名称、徽记、标志；
(4) The name, emblem, and symbol of institutions applying to host the Olympic Games within China;
(五)在中国境内举办的奥林匹克运动会的名称及其简称、吉祥物、会歌、火炬造型、口号、“主办城市名称＋举办年份”等标志，以及其组织机构的名称、徽记；
(5) The name and its abbreviation, mascot, anthem, torch design, slogan, 'host city name + year of hosting' and other symbols of the Olympic Games held within China, as well as the name and emblem of its organizing body;
(六)《奥林匹克宪章》和相关奥林匹克运动会主办城市合同中规定的其他与在中国境内举办的奥林匹克运动会有关的标志。
(6) Other symbols related to the Olympic Games held within China as specified in the Olympic Charter and relevant host city contracts.
本条例所称奥林匹克标志权利人，是指国际奥林匹克委员会、中国奥林匹克委员会和中国境内申请承办奥林匹克运动会的机构、在中国境内举办的奥林匹克运动会的组织机构。
For the purposes of these Regulations, owners of Olympic symbols refer to the International Olympic Committee, the Chinese Olympic Committee, institutions applying to host the Olympic Games within China, and the organizing bodies of the Olympic Games held within China.
国际奥林匹克委员会、中国奥林匹克委员会和中国境内申请承办奥林匹克运动会的机构、在中国境内举办的奥林匹克运动会的组织机构之间的权利划分，依照《奥林匹克宪章》和相关奥林匹克运动会主办城市合同确定。
The division of rights among the International Olympic Committee, the Chinese Olympic Committee, institutions applying to host the Olympic Games within China, and the organizing bodies of the Olympic Games held within China shall be determined in accordance with the Olympic Charter and relevant host city contracts.
奥林匹克标志权利人依照本条例对奥林匹克标志享有专有权。
Owners of Olympic symbols shall enjoy exclusive rights to the Olympic symbols in accordance with these Regulations.
未经奥林匹克标志权利人许可，任何人不得为商业目的使用奥林匹克标志。
No person may use Olympic symbols for commercial purposes without the permission of the owner of the Olympic symbols.
本条例所称为商业目的使用，是指以营利为目的，以下列方式利用奥林匹克标志：
For the purposes of these Regulations, use for commercial purposes means using Olympic symbols for profit in the following ways:
(一)将奥林匹克标志用于商品、商品包装或者容器以及商品交易文书上；
(1) Using Olympic symbols on goods, packaging or containers of goods, and commercial documents;
(二)将奥林匹克标志用于服务项目中；
(2) Using Olympic symbols in service items;
(三)将奥林匹克标志用于广告宣传、商业展览、营业性演出以及其他商业活动中；
(3) Using Olympic symbols in advertising, commercial exhibitions, commercial performances, and other commercial activities;
(四)销售、进口、出口含有奥林匹克标志的商品；
(4) Selling, importing, or exporting goods bearing Olympic symbols;
(五)制造或者销售奥林匹克标志；
(5) Manufacturing or selling Olympic symbols;
(六)其他以营利为目的利用奥林匹克标志的行为。
(6) Other acts of using Olympic symbols for profit.
除本条例第五条规定外，利用与奥林匹克运动有关的元素开展活动，足以引人误认为与奥林匹克标志权利人之间有赞助或者其他支持关系，构成不正当竞争行为的，依照《中华人民共和国反不正当竞争法》处理。
In addition to the provisions of Article 5, if any activity using elements related to the Olympic movement is sufficient to mislead people into believing that there is a sponsorship or other support relationship with the owner of Olympic symbols, constituting an act of unfair competition, it shall be dealt with in accordance with the Anti-Unfair Competition Law of the People's Republic of China.
国务院市场监督管理部门、知识产权主管部门依据本条例的规定，负责全国的奥林匹克标志保护工作。
The market supervision and administration department and the intellectual property administration department of the State Council shall, in accordance with the provisions of these Regulations, be responsible for the protection of Olympic symbols nationwide.
县级以上地方市场监督管理部门依据本条例的规定，负责本行政区域内的奥林匹克标志保护工作。
Local market supervision and administration departments at or above the county level shall, in accordance with the provisions of these Regulations, be responsible for the protection of Olympic symbols within their respective administrative regions.
奥林匹克标志权利人应当将奥林匹克标志提交国务院知识产权主管部门，由国务院知识产权主管部门公告。
Owners of Olympic symbols shall submit the Olympic symbols to the intellectual property administration department of the State Council, which shall announce them.
奥林匹克标志有效期为10年，自公告之日起计算。
The validity period of Olympic symbols is 10 years, calculated from the date of announcement.
奥林匹克标志权利人可以在有效期满前12个月内办理续展手续，每次续展的有效期为10年，自该奥林匹克标志上一届有效期满次日起计算。国务院知识产权主管部门应当对续展的奥林匹克标志予以公告。
The right holder of an Olympic symbol may go through the renewal procedures within 12 months before the expiration of the validity period. Each renewal shall be valid for 10 years, calculated from the day following the expiration of the previous validity period of the Olympic symbol. The intellectual property administration department of the State Council shall announce the renewed Olympic symbol.
取得奥林匹克标志权利人许可，为商业目的使用奥林匹克标志的，应当同奥林匹克标志权利人订立使用许可合同。奥林匹克标志权利人应当将其许可使用奥林匹克标志的种类、被许可人、许可使用的商品或者服务项目、时限、地域范围等信息及时披露。
Anyone who, with the permission of the right holder of an Olympic symbol, uses the Olympic symbol for commercial purposes shall conclude a license contract with the right holder of the Olympic symbol. The right holder of the Olympic symbol shall promptly disclose information such as the types of Olympic symbols licensed, the licensee, the goods or services for which the license is granted, the time limit, and the territorial scope.
被许可人应当在使用许可合同约定的奥林匹克标志种类、许可使用的商品或者服务项目、时限、地域范围内使用奥林匹克标志。
The licensee shall use the Olympic symbol within the types of Olympic symbols, the goods or services for which the license is granted, the time limit, and the territorial scope as agreed in the license contract.
本条例施行前已经依法使用奥林匹克标志的，可以在原有范围内继续使用。
Anyone who has lawfully used an Olympic symbol before the implementation of these Regulations may continue to use it within the original scope.
未经奥林匹克标志权利人许可，为商业目的擅自使用奥林匹克标志，或者使用足以引人误认的近似标志，即侵犯奥林匹克标志专有权，引起纠纷的，由当事人协商解决；不愿协商或者协商不成的，奥林匹克标志权利人或者利害关系人可以向人民法院提起诉讼，也可以请求市场监督管理部门处理。市场监督管理部门处理时，认定侵权行为成立的，责令立即停止侵权行为，没收、销毁侵权商品和主要用于制造侵权商品或者为商业目的擅自制造奥林匹克标志的工具。违法经营额5万元以上的，可以并处违法经营额5倍以下的罚款，没有违法经营额或者违法经营额不足5万元的，可以并处25万元以下的罚款。当事人对处理决定不服的，可以依照《中华人民共和国行政复议法》申请行政复议，也可以直接依照《中华人民共和国行政诉讼法》向人民法院提起诉讼。进行处理的市场监督管理部门应当事人的请求，可以就侵犯奥林匹克标志专有权的赔偿数额进行调解；调解不成的，当事人可以依照《中华人民共和国民事诉讼法》向人民法院提起诉讼。
Any unauthorized use of an Olympic symbol for commercial purposes without the permission of the right holder, or use of a similar symbol that is likely to cause confusion, constitutes an infringement of the exclusive right to use the Olympic symbol. If a dispute arises, the parties shall settle it through consultation; if consultation fails or is refused, the right holder or interested party may file a lawsuit with the People's Court or request the market supervision and administration department to handle the matter. When handling the matter, if the market supervision and administration department determines that the infringement is established, it shall order the immediate cessation of the infringement, and confiscate and destroy the infringing goods and the tools mainly used for manufacturing the infringing goods or for the unauthorized manufacture of Olympic symbols for commercial purposes. If the illegal business turnover is 50,000 yuan or more, a fine of up to five times the illegal business turnover may be imposed; if there is no illegal business turnover or the illegal business turnover is less than 50,000 yuan, a fine of up to 250,000 yuan may be imposed. If a party is dissatisfied with the handling decision, it may apply for administrative reconsideration in accordance with the Administrative Reconsideration Law of the People's Republic of China, or directly file a lawsuit with the People's Court in accordance with the Administrative Procedure Law of the People's Republic of China. Upon the request of the parties, the market supervision and administration department handling the matter may mediate the amount of damages for infringement of the exclusive right to use the Olympic symbol; if mediation fails, the parties may file a lawsuit with the People's Court in accordance with the Civil Procedure Law of the People's Republic of China.
利用奥林匹克标志进行诈骗等活动，构成犯罪的，依法追究刑事责任。
Anyone who uses Olympic symbols to commit fraud or other activities, if constituting a crime, shall be investigated for criminal liability in accordance with the law.
对侵犯奥林匹克标志专有权的行为，市场监督管理部门有权依法查处。
The market supervision and administration department has the authority to investigate and punish acts that infringe the exclusive right to use Olympic symbols in accordance with the law.
市场监督管理部门根据已经取得的违法嫌疑证据或者举报，对涉嫌侵犯奥林匹克标志专有权的行为进行查处时，可以行使下列职权：
When investigating and punishing suspected infringement of the exclusive right to use Olympic symbols based on obtained evidence of illegal suspicion or reports, the market supervision and administration department may exercise the following powers:
(一)询问有关当事人，调查与侵犯奥林匹克标志专有权有关的情况；
(1) Questioning the relevant parties and investigating the circumstances related to the infringement of the exclusive right to use Olympic symbols;
(二)查阅、复制与侵权活动有关的合同、发票、账簿以及其他有关资料；
(2) Consulting and copying contracts, invoices, account books, and other relevant materials related to the infringing activities;
(三)对当事人涉嫌侵犯奥林匹克标志专有权活动的场所实施现场检查；
(3) Conducting on-site inspections of the premises where the parties are suspected of infringing the exclusive right to use Olympic symbols;
(四)检查与侵权活动有关的物品；对有证据证明是侵犯奥林匹克标志专有权的物品，予以查封或者扣押。
(4) Inspecting items related to the infringing activities; sealing or seizing items that have evidence proving to be infringing the exclusive right to use Olympic symbols.
市场监督管理部门依法行使前款规定的职权时，当事人应当予以协助、配合，不得拒绝、阻挠。
When the market supervision and administration department exercises the powers specified in the preceding paragraph in accordance with the law, the parties shall provide assistance and cooperation and shall not refuse or obstruct.
进出口货物涉嫌侵犯奥林匹克标志专有权的，由海关参照《中华人民共和国海关法》和《中华人民共和国知识产权海关保护条例》规定的权限和程序查处。
If imported or exported goods are suspected of infringing the exclusive right to use Olympic symbols, the customs shall investigate and punish them in accordance with the powers and procedures stipulated in the Customs Law of the People's Republic of China and the Regulations of the People's Republic of China on Customs Protection of Intellectual Property Rights.
侵犯奥林匹克标志专有权的赔偿数额，按照权利人因被侵权所受到的损失或者侵权人因侵权所获得的利益确定，包括为制止侵权行为所支付的合理开支；被侵权人的损失或者侵权人获得的利益难以确定的，参照该奥林匹克标志许可使用费合理确定。
The amount of damages for infringement of the exclusive right to use Olympic symbols shall be determined based on the losses suffered by the right holder due to the infringement or the profits gained by the infringer from the infringement, including the reasonable expenses incurred to stop the infringement; if the losses of the infringed party or the profits gained by the infringer are difficult to determine, the amount shall be reasonably determined by reference to the license fee for the use of the Olympic symbol.
销售不知道是侵犯奥林匹克标志专有权的商品，能证明该商品是自己合法取得并说明提供者的，不承担赔偿责任。
A person who sells goods without knowing that they infringe the exclusive right to use Olympic symbols, and can prove that the goods were lawfully obtained and identify the supplier, shall not bear liability for damages.
奥林匹克标志除依照本条例受到保护外，还可以依照《中华人民共和国著作权法》、《中华人民共和国商标法》、《中华人民共和国专利法》、《特殊标志管理条例》等法律、行政法规的规定获得保护。
In addition to being protected under these Regulations, Olympic symbols may also be protected under laws and administrative regulations such as the Copyright Law of the People's Republic of China, the Trademark Law of the People's Republic of China, the Patent Law of the People's Republic of China, and the Regulations on the Administration of Special Symbols.
对残奥会有关标志的保护，参照本条例执行。
The protection of symbols related to the Paralympic Games shall be implemented by reference to these Regulations.
本条例自2018年7月31日起施行。
These Regulations shall come into force on July 31, 2018.
