Regulations on the Placement of Retired Military Personnel

(Promulgated by Order No. 787 of the State Council of the People's Republic of China and the Central Military Commission of the People's Republic of China on July 29, 2024, effective from September 1, 2024)

为了规范退役军人安置工作，妥善安置退役军人，维护退役军人合法权益，让军人成为全社会尊崇的职业，根据《中华人民共和国退役军人保障法》、《中华人民共和国兵役法》、《中华人民共和国军人地位和权益保障法》，制定本条例。

This Regulation is formulated in accordance with the Law of the People's Republic of China on the Protection of Retired Military Personnel, the Military Service Law of the People's Republic of China, and the Law of the People's Republic of China on the Status and Rights of Military Personnel, in order to standardize the placement of retired military personnel, properly place retired military personnel, safeguard the legitimate rights and interests of retired military personnel, and make military personnel a profession respected by the whole society.

本条例所称退役军人，是指从中国人民解放军依法退出现役的军官、军士和义务兵等人员。

For the purposes of this Regulation, 'retired military personnel' refers to officers, non-commissioned officers, and conscripts who have been honorably discharged from active service in the People's Liberation Army of China in accordance with the law.

退役军人为国防和军队建设做出了重要贡献，是社会主义现代化建设的重要力量。

Retired military personnel have made significant contributions to national defense and military construction and are an important force in socialist modernization.

国家关心、优待退役军人，保障退役军人依法享有相应的权益。

The State cares for and gives preferential treatment to retired military personnel, ensuring that they enjoy corresponding rights and interests in accordance with the law.

全社会应当尊重、优待退役军人，支持退役军人安置工作。

The whole society shall respect and give preferential treatment to retired military personnel and support the placement of retired military personnel.

退役军人安置工作坚持中国共产党的领导，坚持为经济社会发展服务、为国防和军队建设服务的方针，贯彻妥善安置、合理使用、人尽其才、各得其所的原则。

The placement of retired military personnel shall adhere to the leadership of the Communist Party of China, follow the policy of serving economic and social development as well as national defense and military construction, and implement the principles of proper placement, reasonable use, making the best use of talents, and each person finding their proper place.

退役军人安置工作应当公开、公平、公正，军地协同推进。

The placement of retired military personnel shall be open, fair, and just, with coordinated advancement between the military and local authorities.

对退役的军官，国家采取退休、转业、逐月领取退役金、复员等方式妥善安置。

For retired officers, the State adopts methods such as retirement, transfer to civilian work, monthly pension, and demobilization to properly place them.

对退役的军士，国家采取逐月领取退役金、自主就业、安排工作、退休、供养等方式妥善安置。

For retired non-commissioned officers, the state adopts methods such as monthly pension, self-employment, job arrangement, retirement, and support to provide proper placement.

对退役的义务兵，国家采取自主就业、安排工作、供养等方式妥善安置。

For retired conscripts, the state adopts methods such as self-employment, job arrangement, and support to provide proper placement.

对参战退役军人，担任作战部队师、旅、团、营级单位主官的转业军官，属于烈士子女、功臣模范的退役军人，以及长期在艰苦边远地区或者飞行、舰艇、涉核等特殊岗位服现役的退役军人，依法优先安置。

For veterans who have participated in combat, transferred officers who served as principal leaders of divisions, brigades, regiments, or battalions of combat units, veterans who are children of martyrs or model heroes, and veterans who have served long-term in remote and difficult areas or in special positions such as aviation, naval vessels, or nuclear-related duties, priority placement is provided in accordance with the law.

中央退役军人事务工作领导机构负责退役军人安置工作顶层设计、统筹协调、整体推进、督促落实。地方各级退役军人事务工作领导机构负责本地区退役军人安置工作的组织领导和统筹实施。

The central leading body for veterans affairs is responsible for the top-level design, overall coordination, comprehensive promotion, and supervision of the placement of retired military personnel. Local leading bodies for veterans affairs at all levels are responsible for the organization, leadership, and overall implementation of the placement of retired military personnel in their respective regions.

国务院退役军人工作主管部门负责全国的退役军人安置工作。中央军事委员会政治工作部门负责组织指导全军军人退役工作。中央和国家有关机关、中央军事委员会机关有关部门应当在各自职责范围内做好退役军人安置工作。

The competent department of veterans affairs under the State Council is responsible for the nationwide placement of retired military personnel. The political work department of the Central Military Commission is responsible for organizing and guiding the demobilization of military personnel across the armed forces. Relevant central and state organs and relevant departments of the Central Military Commission shall perform their duties in the placement of retired military personnel within their respective responsibilities.

县级以上地方人民政府退役军人工作主管部门负责本行政区域的退役军人安置工作。军队团级以上单位政治工作部门(含履行政治工作职责的部门，下同)负责本单位军人退役工作。地方各级有关机关应当在各自职责范围内做好退役军人安置工作。

The competent department of veterans affairs of local people's governments at or above the county level is responsible for the placement of retired military personnel within their administrative regions. The political work departments (including those performing political work duties, the same below) of military units at or above the regiment level are responsible for the demobilization of military personnel within their units. Relevant local organs at all levels shall perform their duties in the placement of retired military personnel within their respective responsibilities.

省军区(卫戍区、警备区)负责全军到所在省、自治区、直辖市以转业、逐月领取退役金、复员方式安置的退役军官和逐月领取退役金的退役军士移交工作，配合安置地做好安置工作；配合做好退休军官、军士以及以安排工作、供养方式安置的退役军士和义务兵移交工作。

Provincial military commands (garrison commands,garrison command) are responsible for the transfer of retired officers placed by transfer, monthly pension, or demobilization, and retired non-commissioned officers placed by monthly pension, who are assigned to their respective provinces, autonomous regions, or municipalities directly under the central government, and shall cooperate with the placement location in carrying out placement work; they shall also cooperate with the transfer of retired officers and non-commissioned officers placed by retirement, and retired non-commissioned officers and conscripts placed by job arrangement or support.

退役军人安置所需经费，按照中央与地方财政事权和支出责任划分原则，列入中央和地方预算，并根据经济社会发展水平适时调整。

The funds required for the placement of retired military personnel shall be included in the central and local budgets in accordance with the principle of division of financial powers and expenditure responsibilities between the central and local governments, and shall be adjusted in a timely manner based on the level of economic and social development.

机关、群团组织、企业事业单位和社会组织应当依法接收安置退役军人，退役军人应当接受安置。

Organs, mass organizations, enterprises, public institutions, and social organizations shall legally accept and place retired military personnel, and retired military personnel shall accept placement.

退役军人应当模范遵守宪法和法律法规，保守军事秘密，保持发扬人民军队光荣传统和优良作风，积极投身全面建设社会主义现代化国家的事业。

Retired military personnel shall model compliance with the Constitution and laws and regulations, maintain military secrets, preserve and carry forward the glorious traditions and fine conduct of the People's Army, and actively participate in the cause of comprehensively building a modern socialist country.

县级以上地方人民政府应当把退役军人安置工作纳入年度重点工作计划，纳入目标管理，建立健全安置工作责任制和考核评价制度，将安置工作完成情况纳入对本级人民政府负责退役军人有关工作的部门及其负责人、下级人民政府及其负责人的考核评价内容，作为双拥模范城(县)考评重要内容。

Local people's governments at or above the county level shall incorporate the placement of retired military personnel into the annual key work plan and target management, establish and improve the placement work responsibility system and assessment and evaluation system, and include the completion of placement work in the assessment and evaluation content of the departments responsible for retired military personnel work under the people's government at the same level and their responsible persons, as well as the people's government at the lower level and its responsible persons, and as an important part of the evaluation of the dual support model city (county).

对在退役军人安置工作中做出突出贡献的单位和个人，按照国家有关规定给予表彰、奖励。

Units and individuals that have made outstanding contributions to the placement of retired military personnel shall be commended and rewarded in accordance with relevant state regulations.

军官退出现役，符合规定条件的，可以作退休、转业或者逐月领取退役金安置。

Officers who retire from active service and meet the prescribed conditions may be placed through retirement, transfer to civilian work, or receiving a monthly pension.

军官退出现役，有规定情形的，作复员安置。

Officers who retire from active service under prescribed circumstances shall be placed through demobilization.

对退休军官，安置地人民政府应当按照国家保障与社会化服务相结合的方式，做好服务管理工作，保障其待遇。

For retired officers, the local people's government of the place of resettlement shall, in a manner combining state guarantees with socialized services, do a good job in service management and ensure their treatment.

安置地人民政府根据工作需要设置、调整退休军官服务管理机构，服务管理退休军官。

The local people's government of the place of resettlement shall set up and adjust service management institutions for retired officers as needed to serve and manage retired officers.

转业军官由机关、群团组织、事业单位和国有企业接收安置。

Officers transferred to civilian work shall be received and placed by organs, mass organizations, public institutions, and state-owned enterprises.

安置地人民政府应当根据转业军官德才条件以及服现役期间的职务、等级、所作贡献、专长等和工作需要，结合实际统筹采取考核选调、赋分选岗、考试考核、双向选择、直通安置、指令性分配等办法，妥善安排其工作岗位，确定相应的职务职级。

The local people's government of the place of resettlement shall, based on the moral and talent conditions of the officers transferred to civilian work, as well as their positions, ranks, contributions, specialties during active service, and work needs, adopt methods such as assessment and selection, score-based job selection, examination and assessment, two-way selection, direct placement, and mandatory assignment in a coordinated manner, to properly arrange their work positions and determine corresponding positions and ranks.

退役军官逐月领取退役金的具体办法由国务院退役军人工作主管部门会同有关部门制定。

The specific measures for retired officers to receive a monthly pension shall be formulated by the competent department of retired military personnel work of the State Council together with relevant departments.

复员军官按照国务院退役军人工作主管部门、中央军事委员会政治工作部门制定的有关规定享受复员费以及其他待遇等。

Demobilized officers shall enjoy demobilization fees and other benefits in accordance with the relevant regulations formulated by the department of the State Council in charge ofveteran work and the Political Work Department of the Central Military Commission.

第一节　逐月领取退役金

Section 1: Monthly Pension

军士退出现役，符合规定条件的，可以作逐月领取退役金安置。

Non-commissioned officers who retire from active service and meet the prescribed conditions may be placed by receiving a monthly pension.

退役军士逐月领取退役金的具体办法由国务院退役军人工作主管部门会同有关部门制定。

The specific measures for retired non-commissioned officers to receive a monthly pension shall be formulated by the department of the State Council in charge ofveteran work in conjunction with relevant departments.

第二节　自 主 就 业

Section 2: Self-Employment

退役军士不符合逐月领取退役金、安排工作、退休、供养条件的，退役义务兵不符合安排工作、供养条件的，以自主就业方式安置。

Retired non-commissioned officers who do not meet the conditions for monthly pension, job placement, retirement, or support, and retired conscripts who do not meet the conditions for job placement or support, shall be placed through self-employment.

退役军士符合逐月领取退役金、安排工作条件的，退役义务兵符合安排工作条件的，可以选择以自主就业方式安置。

Retired non-commissioned officers who meet the conditions for monthly pension or job placement, and retired conscripts who meet the conditions for job placement, may choose to be placed through self-employment.

对自主就业的退役军士和义务兵，根据其服现役年限发放一次性退役金。

For retired non-commissioned officers and conscripts who choose self-employment, a one-time severance pay shall be issued based on their length of active service.

自主就业退役军士和义务兵的一次性退役金由中央财政专项安排，具体标准由国务院退役军人工作主管部门、中央军事委员会政治工作部门会同国务院财政部门，根据国民经济发展水平、国家财力情况、全国城镇单位就业人员平均工资和军人职业特殊性等因素确定，并适时调整。

The one-time severance pay for self-employed retired non-commissioned officers and conscripts shall be arranged by the central finance. The specific standard shall be determined by the department of the State Council in charge ofveteran work, the Political Work Department of the Central Military Commission, and the department of the State Council in charge of finance, based on factors such as the level of national economic development, national financial conditions, the average salary of employees in urban units nationwide, and the special nature of military service, and shall be adjusted in a timely manner.

自主就业的退役军士和义务兵服现役期间个人获得勋章、荣誉称号或者表彰奖励的，按照下列比例增发一次性退役金：

For self-employed retired non-commissioned officers and conscripts who have received medals, honorary titles, or commendations during active service, the one-time demobilization payment shall be increased according to the following percentages:

(一)获得勋章、荣誉称号的，增发25%；

(1) For those who have received medals or honorary titles, an increase of 25%;

(二)荣立一等战功或者获得一级表彰的，增发20%；

(2) For those who have been awarded first-class combat merit or first-level commendation, an increase of 20%;

(三)荣立二等战功、一等功或者获得二级表彰并经批准享受相关待遇的，增发15%；

(3) For those who have been awarded second-class combat merit, first-class merit, or second-level commendation with approved related benefits, an increase of 15%;

(四)荣立三等战功或者二等功的，增发10%；

(4) For those who have been awarded third-class combat merit or second-class merit, an increase of 10%;

(五)荣立四等战功或者三等功的，增发5%。

(5) For those who have been awarded fourth-class combat merit or third-class merit, an increase of 5%.

对自主就业的退役军士和义务兵，地方人民政府可以根据当地实际情况给予一次性经济补助，补助标准及发放办法由省、自治区、直辖市人民政府制定。

For self-employed retired non-commissioned officers and conscripts, local people's governments may provide a one-time economic subsidy based on local actual conditions. The subsidy standard and distribution method shall be determined by the people's government of the province, autonomous region, or municipality directly under the Central Government.

因患精神障碍被评定为5级至6级残疾等级的初级军士和义务兵退出现役后，需要住院治疗或者无直系亲属照顾的，可以由安置地人民政府退役军人工作主管部门安排到有关医院接受治疗，依法给予保障。

For junior non-commissioned officers and conscripts who are assessed as having a disability grade of 5 or 6 due to mental disorders and require hospitalization or have no direct relatives to care for them after retirement, the veterans affairs department of theresettlement site (placement location) people's government may arrange for them to receive treatment in relevant hospitals, providing guarantees in accordance with the law.

第三节　安 排 工 作

Section 3: Arranged Employment

军士和义务兵退出现役，符合下列条件之一的，由安置地人民政府安排工作：

Non-commissioned officers and conscripts who retire from active service and meet one of the following conditions shall be arranged for employment by the people's government of the placement location:

(一)军士服现役满12年的；

(1) Non-commissioned officers who have served on active duty for 12 years or more;

(二)服现役期间个人获得勋章、荣誉称号的；

(2) Those who have personally received medals or honorary titles during active service;

(三)服现役期间个人荣获三等战功、二等功以上奖励的；

(3) Those who have personally received third-class combat merit or second-class merit or above during active service;

(四)服现役期间个人获得一级表彰的；

(4) Those who have personally received first-level commendation during active service;

(五)因战致残被评定为5级至8级残疾等级的；

(5) Those who are disabled due to war and assessed as having disability grades 5 to 8;

(六)是烈士子女的。

(6) Those who are children of martyrs.

符合逐月领取退役金条件的军士，本人自愿放弃以逐月领取退役金方式安置的，可以选择以安排工作方式安置。

Non-commissioned officers who meet the conditions for receiving monthly pension may voluntarily waive the monthly pension placement and choose work arrangement placement.

因战致残被评定为5级至6级残疾等级的中级以上军士，本人自愿放弃以退休方式安置的，可以选择以安排工作方式安置。

Mid-level or above non-commissioned officers who are disabled due to war and assessed as having disability grades 5 to 6 may voluntarily waive retirement placement and choose work arrangement placement.

对安排工作的退役军士和义务兵，主要采取赋分选岗的办法安排到事业单位和国有企业；符合规定条件的，可以择优招录到基层党政机关公务员岗位。

For retired non-commissioned officers and conscripts who are arranged for work, the method of assigning scores and selecting positions shall be mainly adopted to place them in public institutions and state-owned enterprises; those who meet the specified conditions may be selectively recruited to grassroots party and government organs for civil service positions.

安排工作的退役军士和义务兵服现役表现量化评分的具体办法由国务院退役军人工作主管部门会同中央军事委员会政治工作部门制定。

The specific measures for quantitative scoring of active service performance of retired non-commissioned officers and conscripts arranged for work shall be formulated by the competent department ofveteran work of the State Council jointly with the political work department of the Central Military Commission.

根据工作需要和基层政权建设要求，省级公务员主管部门应当确定一定数量的基层公务员录用计划，综合考虑服现役表现等因素，按照本条例第二十六条的规定择优招录具有本科以上学历的安排工作的退役军士和义务兵。招录岗位可以在省级行政区域内统筹安排。

In accordance with work needs and the requirements for building grassroots political power, provincial-level civil service authorities shall determine a certain number of grassroots civil service recruitment plans, comprehensively consider factors such as active service performance, and, in accordance with Article 26 of these Regulations, select and recruit retired non-commissioned officers and conscripts with bachelor's degrees or above who are eligible for job placement. Recruitment positions may be coordinated and arranged within the provincial administrative region.

参加招录的退役军士和义务兵是烈士子女的，或者在艰苦边远地区服现役满5年的，同等条件下优先录用。

Retired non-commissioned officers and conscripts participating in the recruitment who are children of martyrs, or who have served in difficult and remote areas for a full five years, shall be given priority in hiring under equal conditions.

艰苦边远地区和边疆民族地区在招录退役军士和义务兵时，可以根据本地实际适当放宽安置去向、年龄、学历等条件。

When recruiting retired non-commissioned officers and conscripts in difficult and remote areas and border ethnic areas, conditions such as placement destination, age, and education may be appropriately relaxed based on local realities.

根据安置工作需要，省级以上人民政府可以指定一批专项岗位，按照规定接收安置安排工作的退役军士和义务兵。

In accordance with the needs of placement work, people's governments at or above the provincial level may designate a number of special posts to receive and place retired non-commissioned officers and conscripts who are eligible for job placement, as stipulated.

对安排到事业单位的退役军士和义务兵，应当根据其服现役期间所作贡献、专长特长等，合理安排工作岗位。符合相应岗位条件的，可以安排到管理岗位或者专业技术岗位。

For retired non-commissioned officers and conscripts placed in public institutions, work positions shall be reasonably arranged based on their contributions during active service, expertise, and specialties. If they meet the corresponding position requirements, they may be assigned to management or technical positions.

机关、群团组织、事业单位接收安置安排工作的退役军士和义务兵的，应当按照国家有关规定给予编制保障。

State organs, mass organizations, and public institutions that receive and place retired non-commissioned officers and conscripts eligible for job placement shall provide staffing guarantees in accordance with relevant state regulations.

国有企业应当按照本企业全系统新招录职工数量的规定比例核定年度接收计划，用于接收安置安排工作的退役军士和义务兵。

State-owned enterprises shall determine annual recruitment plans based on the prescribed proportion of new employees recruited across the entire enterprise system, to be used for receiving and placing retired non-commissioned officers and conscripts eligible for job placement.

对接收安置安排工作的退役军士和义务兵任务较重的地方，上级人民政府可以在本行政区域内统筹调剂安排。

For localities with a heavy burden of receiving and placing retired non-commissioned officers and conscripts eligible for job placement, the higher-level people's government may make coordinated and balanced arrangements within its administrative region.

安置地人民政府应当在接收退役军士和义务兵的6个月内完成安排退役军士和义务兵工作的任务。

The people's government of the placement location shall complete the task of arranging jobs for retired non-commissioned officers and conscripts within six months of receiving them.

安排工作的退役军士和义务兵的安置岗位需要签订聘用合同或者劳动合同的，用人单位应当按照规定与其签订不少于3年的中长期聘用合同或者劳动合同。其中，企业接收军龄10年以上的退役军士的，应当与其签订无固定期限劳动合同。

If the placement position for retired non-commissioned officers and conscripts eligible for job placement requires the signing of an employment contract or labor contract, the employer shall sign a medium- to long-term employment contract or labor contract with them for a period of not less than three years, as stipulated. Among them, if an enterprise receives retired non-commissioned officers with more than ten years of military service, it shall sign an indefinite-term labor contract with them.

对安排工作的残疾退役军士和义务兵，接收单位应当安排力所能及的工作。

For disabled retired non-commissioned officers and conscripts who are assigned work, the receiving unit shall arrange work within their capabilities.

安排工作的因战、因公致残退役军士和义务兵，除依法享受工伤保险待遇外，还享受与所在单位工伤人员同等的生活福利、医疗等其他待遇。

Retired non-commissioned officers and conscripts who are disabled due to combat or duty and are assigned work shall, in addition to enjoying work-related injury insurance benefits according to law, also enjoy the same living welfare, medical treatment, and other benefits as employees with work-related injuries in the unit.

符合安排工作条件的退役军士和义务兵无正当理由拒不服从安置地人民政府安排工作的，视为放弃安排工作待遇；在待安排工作期间被依法追究刑事责任的，取消其安排工作待遇。

If a retired non-commissioned officer or conscript who meets the conditions for job assignment refuses to accept the job arranged by the local people's government without justifiable reasons, they shall be deemed to have waived the job assignment treatment; if they are investigated for criminal responsibility during the period of awaiting job assignment, their job assignment treatment shall be canceled.

军士和义务兵退出现役，有下列情形之一的，不以安排工作方式安置：

When non-commissioned officers and conscripts retire from active service, if any of the following circumstances exist, they shall not be placed by means of job assignment:

(一)被开除中国共产党党籍的；

(1) Having been expelled from the Communist Party of China;

(二)受过刑事处罚的；

(2) Having received criminal punishment;

(三)法律法规规定的因被强制退役等原因不宜以安排工作方式安置的其他情形。

(3) Other circumstances stipulated by laws and regulations that make it unsuitable to be placed by means of job assignment due to forced retirement or other reasons.

第四节　退休与供养

Section 4: Retirement and Support

中级以上军士退出现役，符合下列条件之一的，作退休安置：

When mid-level and above non-commissioned officers retire from active service, if they meet one of the following conditions, they shall be placed in retirement:

(一)退出现役时年满55周岁的；

(1) Having reached the age of 55 at the time of retirement from active service;

(二)服现役满30年的；

(2) Having served actively for 30 years;

(三)因战、因公致残被评定为1级至6级残疾等级的；

(3) Having been assessed as having a disability grade of 1 to 6 due to war or duty-related injury;

(四)患有严重疾病且经医学鉴定基本丧失工作能力的。

(4) Suffering from a serious illness and having been medically determined to have basically lost the ability to work.

退休军士移交政府安置服务管理工作，参照退休军官的有关规定执行。

The transfer of retired non-commissioned officers to government placement and service management shall be carried out with reference to the relevant provisions for retired officers.

被评定为1级至4级残疾等级的初级军士和义务兵退出现役的，由国家供养终身。

Junior non-commissioned officers and conscripts who are assessed as having a disability grade of 1 to 4 upon retirement shall be supported by the state for life.

因战、因公致残被评定为1级至4级残疾等级的中级以上军士，本人自愿放弃退休安置的，可以选择由国家供养终身。

Mid-level and above non-commissioned officers who are assessed as having a disability grade of 1 to 4 due to war or duty-related injury and who voluntarily waive retirement placement may choose to be supported by the state for life.

国家供养分为集中供养和分散供养。

State support is divided into centralized support and decentralized support.

第一节　安 置 计 划

Section 1 Placement Plan

退役军人安置计划包括全国退役军人安置计划和地方退役军人安置计划，区分退役军官和退役军士、义务兵分类分批下达。

The placement plan for retired military personnel includes the national placement plan and local placement plans, which are issued in batches by category, distinguishing between retired officers and retired non-commissioned officers and conscripts.

全国退役军人安置计划，由国务院退役军人工作主管部门会同中央军事委员会政治工作部门、中央和国家有关机关编制下达。

The national placement plan for retired military personnel shall be formulated and issued by the competent department of the State Council for the work of retired military personnel, jointly with the political work department of the Central Military Commission and relevant central and state organs.

县级以上地方退役军人安置计划，由本级退役军人工作主管部门编制下达或者会同有关部门编制下达。

The local placement plan for retired military personnel at or above the county level shall be formulated and issued by the competent department for the work of retired military personnel at the corresponding level, or jointly with relevant departments.

伤病残退役军人安置计划可以纳入本条例第三十九条规定的计划一并编制下达，也可以专项编制下达。

The placement plan for sick, injured, or disabled retired military personnel may be incorporated into the plan specified in Article 39 of these Regulations for joint formulation and issuance, or may be formulated and issued separately.

退役军人随调随迁配偶和子女安置计划与退役军人安置计划一并下达。

The placement plan for the accompanying relocated spouses and children of retired military personnel shall be issued together with the placement plan for retired military personnel.

中央和国家机关及其管理的企业事业单位接收退役军人的安置计划，按照国家有关规定编制下达。

The placement plan for central and state organs and their managed enterprises and institutions to receive retired military personnel shall be formulated and issued in accordance with relevant state regulations.

因军队体制编制调整，军人整建制成批次退出现役的安置，由国务院退役军人工作主管部门、中央军事委员会政治工作部门会同中央和国家有关机关协商办理。

The placement of military personnel who retire in batches due to adjustments in the military's organizational structure and system shall be handled through consultation by the competent department of the State Council for the work of retired military personnel, the political work department of the Central Military Commission, and relevant central and state organs.

第二节　安　置　地

Section 2: Placement Location

退役军人安置地按照服从工作需要、彰显服役贡献、有利于家庭生活的原则确定。

The placement location for retired military personnel shall be determined in accordance with the principles of serving work needs, reflecting service contributions, and facilitating family life.

退役军官和以逐月领取退役金、退休方式安置的退役军士的安置地按照国家有关规定确定。

The placement location for retired officers and retired non-commissioned officers who are placed by receiving monthly pension or retirement shall be determined in accordance with relevant state regulations.

退役义务兵和以自主就业、安排工作、供养方式安置的退役军士的安置地为其入伍时户口所在地。但是，入伍时是普通高等学校在校学生，退出现役后不复学的，其安置地为入学前的户口所在地。

The placement location for retired conscripts and retired non-commissioned officers who are placed by self-employment, job arrangement, or support shall be the location of their household registration at the time of enlistment. However, if they were enrolled in a regular institution of higher education at the time of enlistment and do not return to school after retirement, their placement location shall be the location of their household registration before enrollment.

退役义务兵和以自主就业、安排工作、供养方式安置的退役军士有下列情形之一的，可以易地安置：

Retired conscripts and retired non-commissioned officers who are resettled through self-employment, job placement, or support may be relocated to a different place under any of the following circumstances:

(一)服现役期间父母任何一方户口所在地变更的，可以在父母任何一方现户口所在地安置；

(1) If the registered residence of either parent changes during the period of active service, the person may be resettled at the current registered residence of either parent;

(二)退役军士已婚的，可以在配偶或者配偶父母任何一方户口所在地安置；

(2) If a retired non-commissioned officer is married, the person may be resettled at the registered residence of the spouse or either parent of the spouse;

(三)退役军士的配偶为现役军人且符合随军规定的，可以在配偶部队驻地安置；双方同时退役的，可以在配偶的安置地安置；

(3) If the spouse of a retired non-commissioned officer is an active-duty servicemember and meets the conditions for accompanying the military, the person may be resettled at the spouse's military station; if both retire at the same time, the person may be resettled at the spouse's resettlement location;

(四)因其他特殊情况，由军队旅级以上单位政治工作部门出具证明，经省级以上人民政府退役军人工作主管部门批准，可以易地安置。

(4) For other special circumstances, upon issuance of a certificate by the political work department of a unit at or above the brigade level and approval by the veterans work department of the people's government at or above the provincial level, relocation may be permitted.

退役军士按照前款第二项、第三项规定在国务院确定的中等以上城市安置的，应当结婚满2年。

If a retired non-commissioned officer is resettled in a medium or large city designated by the State Council under items (2) or (3) of the preceding paragraph, the marriage must have lasted for at least two full years.

因国家重大改革、重点项目建设以及国防和军队改革需要等情况，退役军人经国务院退役军人工作主管部门批准，可以跨省、自治区、直辖市安置。

If required by major national reforms, key project construction, or national defense and military reforms, retired military personnel may, with the approval of the State Council's veterans work department, be resettled across provinces, autonomous regions, or municipalities directly under the Central Government.

符合安置地吸引人才特殊政策规定条件的退役军人，由接收安置单位所在省级人民政府退役军人工作主管部门商同级人才工作主管部门同意，经国务院退役军人工作主管部门和中央军事委员会政治工作部门批准，可以跨省、自治区、直辖市安置。

Retired military personnel who meet the special talent attraction policy conditions of the resettlement location may, upon consultation between the veterans work department of the provincial people's government where the receiving unit is located and the talent work department at the same level, and with the approval of the State Council's veterans work department and the Political Work Department of the Central Military Commission, be resettled across provinces, autonomous regions, or municipalities directly under the Central Government.

对因战致残、服现役期间个人荣获三等战功或者二等功以上奖励、是烈士子女的退役军人，以及父母双亡的退役军士和义务兵，可以根据本人申请，由省级以上人民政府退役军人工作主管部门按照有利于其生活的原则确定安置地。

For retired military personnel who are disabled due to war, have personally received a third-class meritorious service or second-class award or above during active service, are children of martyrs, or are retired non-commissioned officers or conscripts whose both parents have died, the resettlement location may be determined by the veterans work department of the people's government at or above the provincial level based on the principle of facilitating their life, upon their application.

退役军人在国务院确定的超大城市安置的，除符合其安置方式对应的规定条件外，按照本人部队驻地安置的，还应当在驻该城市部队连续服役满规定年限；按照投靠方式安置的，还应当符合国家有关规定要求的其他资格条件。

When retired military personnel are resettled in a megacity designated by the State Council, in addition to meeting the conditions corresponding to their resettlement method, if resettled based on their military station, they must have served continuously in the military unit stationed in that city for the required number of years; if resettled through dependency, they must also meet other qualification requirements stipulated by relevant state regulations.

退役军人服现役期间个人获得勋章、荣誉称号的，荣立一等战功或者获得一级表彰的，可以在全国范围内选择安置地。其中，退役军人选择在国务院确定的超大城市安置的，不受本条例第四十八条规定的限制。

If a retired military personnel personally received a medal or honorary title during active service, or was awarded a first-class combat merit or first-level commendation, they may choose the placement location nationwide. Among them, if the retired military personnel chooses to be placed in a mega-city determined by the State Council, the restrictions of Article 48 of these Regulations shall not apply.

退役军人服现役期间个人荣立二等战功或者一等功的，获得二级表彰并经批准享受相关待遇的，在西藏、新疆、军队确定的四类以上艰苦边远地区、军队确定的二类以上岛屿或者飞行、舰艇、涉核等特殊岗位服现役累计满15年的，可以在符合安置条件的省级行政区域内选择安置地。

If a retired military personnel personally received a second-class combat merit or first-class merit during active service, or received second-level commendation and was approved to enjoy relevant benefits, or served cumulatively for at least 15 years in Tibet, Xinjiang, the fourth-class or above remote and difficult areas determined by the military, the second-class or above islands determined by the military, or special posts such as aviation, naval vessels, or nuclear-related, they may choose the placement location within the provincial-level administrative region that meets the placement conditions.

退役军人在西藏、新疆、军队确定的四类以上艰苦边远地区、军队确定的二类以上岛屿或者飞行、舰艇、涉核等特殊岗位服现役累计满10年的，可以在符合安置条件的设区的市级行政区域内选择安置地。

If a retired military personnel served cumulatively for at least 10 years in Tibet, Xinjiang, the fourth-class or above remote and difficult areas determined by the military, the second-class or above islands determined by the military, or special posts such as aviation, naval vessels, or nuclear-related, they may choose the placement location within the city-level administrative region that meets the placement conditions.

第三节　交　　接

Section 3: Handover

以转业、逐月领取退役金、复员方式安置的退役军官和以逐月领取退役金方式安置的退役军士的人事档案，由中央军事委员会机关部委、中央军事委员会直属机构、中央军事委员会联合作战指挥中心、战区、军兵种、中央军事委员会直属单位等单位的政治工作部门向安置地省军区(卫戍区、警备区)移交后，由安置地省军区(卫戍区、警备区)向省级人民政府退役军人工作主管部门进行移交。

The personnel files of retired officers placed by job transfer, monthly pension, or demobilization, and retired non-commissioned officers placed by monthly pension, shall be transferred by the political work departments of the organs of the Central Military Commission, directly subordinate organs of the Central Military Commission, the Joint Operations Command Center of the Central Military Commission, theater commands, services and arms, and directly subordinate units of the Central Military Commission to the provincial military commands (garrison commands, garrison commands) of the placement location, and then transferred by the provincial military commands (garrison commands, garrison commands) to the veterans affairs departments of the provincial people's governments.

安排工作的退役军士和义务兵的人事档案，由中央军事委员会机关部委、中央军事委员会直属机构、中央军事委员会联合作战指挥中心、战区、军兵种、中央军事委员会直属单位等单位的政治工作部门向安置地省级人民政府退役军人工作主管部门进行移交。

The personnel files of retired non-commissioned officers and conscripts placed by job arrangement shall be transferred by the political work departments of the organs of the Central Military Commission, directly subordinate organs of the Central Military Commission, the Joint Operations Command Center of the Central Military Commission, theater commands, services and arms, and directly subordinate units of the Central Military Commission to the veterans affairs departments of the provincial people's governments of the placement location.

以自主就业、供养方式安置的退役军士和义务兵的人事档案，由军队师、旅、团级单位政治工作部门向安置地人民政府退役军人工作主管部门进行移交。

The personnel files of retired non-commissioned officers and conscripts placed by self-employment or support shall be transferred by the political work departments of the division, brigade, or regiment-level units of the military to the veterans affairs departments of the people's governments of the placement location.

以转业、逐月领取退役金、复员方式安置的退役军官，由退役军人工作主管部门发出接收安置报到通知，所在部队应当及时为其办理相关手续，督促按时报到。

For retired officers placed by job transfer, monthly pension, or demobilization, the veterans affairs department shall issue a notice of reception and placement reporting. The unit where they served shall promptly handle relevant procedures and urge them to report on time.

以逐月领取退役金、安排工作、供养方式安置的退役军士和以安排工作、供养方式安置的退役义务兵，应当按照规定时间到安置地人民政府退役军人工作主管部门报到；自主就业的退役军士和义务兵，应当自被批准退出现役之日起30日内，到安置地人民政府退役军人工作主管部门报到。无正当理由不按照规定时间报到超过30日的，视为放弃安置待遇。

Retired non-commissioned officers placed by monthly pension, job arrangement, or support, and retired conscripts placed by job arrangement or support, shall report to the veterans affairs department of the people's government of the placement location within the specified time. Retired non-commissioned officers and conscripts placed by self-employment shall report to the veterans affairs department of the people's government of the placement location within 30 days from the date of approval of retirement. If they fail to report on time without justifiable reasons for more than 30 days, they shall be deemed to have waived the placement benefits.

退休军官和军士的移交接收，由退休军官和军士所在部队团级以上单位政治工作部门和安置地人民政府退役军人工作主管部门组织办理。

The handover and reception of retired officers and non-commissioned officers shall be organized and handled by the political work departments at or above the regiment level of the unit where the retired officers and non-commissioned officers served and the veterans affairs departments of the people's governments of the placement location.

退役军人报到后，退役军人工作主管部门应当及时为需要办理户口登记的退役军人开具户口登记介绍信，公安机关据此办理户口登记。

After retired military personnel report for duty, the competent department for the work of retired military personnel shall promptly issue a letter of introduction for household registration to those who need to register their household registration, and the public security organ shall handle the household registration accordingly.

退役军人工作主管部门应当督促退役军人及时办理兵役登记信息变更。

The competent department for the work of retired military personnel shall supervise retired military personnel to promptly handle changes in military service registration information.

实行组织移交的复员军官，由军队旅级以上单位政治工作部门会同安置地人民政府退役军人工作主管部门和公安机关办理移交落户等相关手续。

For demobilized officers who are transferred through organizational means, the political work department of the military unit at or above the brigade level shall, together with the competent department for the work of retired military personnel of the local people's government and the public security organ, handle the relevant procedures for transfer and household registration.

对符合移交条件的伤病残退役军人，军队有关单位和安置地人民政府退役军人工作主管部门应当及时移交接收，予以妥善安置。

For retired military personnel with injuries, illnesses, or disabilities who meet the conditions for transfer, the relevant military units and the competent department for the work of retired military personnel of the local people's government shall promptly transfer and accept them and provide proper resettlement.

对退役军人安置政策落实不到位、工作推进不力的地区和单位，由省级以上人民政府退役军人工作主管部门会同有关部门约谈该地区人民政府主要负责人或者该单位主要负责人；对拒绝接收安置退役军人或者未完成安置任务的部门和单位，组织、编制、人力资源社会保障等部门可以视情况暂缓办理其人员调动、录(聘)用和编制等审批事项。

For regions and units where the implementation of retired military personnel placement policies is not in place and work is not progressing effectively, the competent department for the work of retired military personnel of the people's government at or above the provincial level shall, together with relevant departments, interview the principal responsible person of the local people's government or the principal responsible person of the unit; for departments and units that refuse to accept retired military personnel for placement or fail to complete placement tasks, the organization, staffing, human resources and social security departments may, depending on the circumstances, suspend the approval of personnel transfers, recruitment (employment), and staffing matters.

以转业、逐月领取退役金、复员方式安置的退役军官和以逐月领取退役金、安排工作方式安置且符合家属随军规定的退役军士，其配偶可以随调随迁，未成年子女可以随迁。

For retired officers placed through transfer, monthly pension, or demobilization, and for retired sergeants placed through monthly pension or job arrangement who meet the provisions for family members to accompany the military, their spouses may be transferred or relocated, and minor children may be relocated.

以转业、逐月领取退役金、复员方式安置的退役军官身边无子女的，可以随调一名已经工作的子女及其配偶。

For retired officers placed through transfer, monthly pension, or demobilization who have no children nearby, one working child and their spouse may be transferred.

退役军人随调配偶在机关或者事业单位工作，符合有关法律法规规定的，安置地人民政府负责安排到相应的工作单位。对在其他单位工作或者无工作单位的随调随迁配偶，安置地人民政府应当提供就业指导，协助实现就业。

If the spouse of a retired military personnel who is transferred works in a government organ or public institution and meets the relevant laws and regulations, the local people's government shall arrange for them to work in a corresponding unit. For spouses who work in other units or are unemployed, the local people's government shall provide employment guidance and assist in achieving employment.

对安排到企业事业单位的退役军人随调配偶，安置岗位需要签订聘用合同或者劳动合同的，用人单位应当与其签订不少于3年的中长期聘用合同或者劳动合同。

For spouses of retired military personnel who are transferred and arranged to work in enterprises or institutions, if the placement position requires signing an employment contract or labor contract, the employer shall sign a medium- to long-term employment contract or labor contract of not less than three years.

鼓励和支持退役军人随调随迁家属自主就业创业。对有自主就业创业意愿的随调配偶，可以采取发放一次性就业补助费等措施进行安置，并提供就业指导服务。一次性就业补助费标准及发放办法由省、自治区、直辖市人民政府制定。随调随迁家属按照规定享受就业创业扶持相关优惠政策。

Encourage and support the accompanying spouses and children of retired military personnel to voluntarily seek employment or start businesses. For accompanying spouses who have the intention to seek employment or start businesses, measures such as issuing a one-time employment subsidy may be taken for placement, and employment guidance services shall be provided. The standard and distribution method of the one-time employment subsidy shall be formulated by the people's government of the province, autonomous region, or municipality directly under the Central Government. Accompanying family members shall enjoy relevant preferential policies for employment and entrepreneurship support in accordance with regulations.

退役军人随调配偶应当与退役军人同时接收安置，同时发出报到通知。

The accompanying spouse of a retired military personnel shall be accepted and placed simultaneously with the retired military personnel, and the reporting notice shall be issued at the same time.

退役军人随调随迁家属户口的迁移、登记等手续，由安置地公安机关根据退役军人工作主管部门的通知及时办理。

The procedures for the relocation and registration of household registration of accompanying family members of retired military personnel shall be handled promptly by the public security organ of the place of placement based on the notice from the competent department of retired military personnel work.

退役军人随迁子女需要转学、入学的，安置地人民政府教育行政部门应当及时办理。

If the accompanying children of retired military personnel need to transfer schools or enroll, the education administrative department of the people's government of the place of placement shall handle it promptly.

转业军官和安排工作的退役军士自愿到艰苦边远地区工作的，其随调随迁配偶和子女可以在原符合安置条件的地区安置。

If transferred military officers and retired non-commissioned officers assigned to work voluntarily go to work in hard and remote areas, their accompanying spouses and children may be placed in the area that originally met the placement conditions.

退休军官、军士随迁配偶和子女的落户、各项社会保险关系转移接续以及随迁子女转学、入学，按照国家有关规定执行。

The settlement of household registration, transfer and continuation of various social insurance relationships, and the transfer and enrollment of accompanying children of retired officers and non-commissioned officers shall be implemented in accordance with relevant state regulations.

退役军人离队前，所在部队在保证完成军事任务的前提下，应当根据需要开展教育培训，介绍国家改革发展形势，宣讲退役军人安置政策，组织法律法规和保密纪律等方面的教育。县级以上地方人民政府退役军人工作主管部门应当给予支持配合。

Before retired military personnel leave the military, their unit shall, on the premise of ensuring the completion of military tasks, carry out education and training as needed, introduce the national reform and development situation, publicize the placement policies for retired military personnel, and organize education on laws, regulations, and confidentiality discipline. The competent department of retired military personnel work of the local people's government at or above the county level shall provide support and cooperation.

军人退出现役后，退役军人工作主管部门和其他负责退役军人安置工作的部门应当区分不同安置方式的退役军人，组织适应性培训。

After military personnel retire from active service, the competent department of retired military personnel work and other departments responsible for the placement of retired military personnel shall organize adaptive training for retired military personnel according to different placement methods.

对符合条件的退役军人，县级以上人民政府退役军人工作主管部门可以组织专业培训。

For eligible retired military personnel, the competent department of retired military personnel work of the people's government at or above the county level may organize professional training.

符合条件的退役军人定岗后，安置地人民政府退役军人工作主管部门、接收安置单位可以根据岗位需要和本人实际，选派到高等学校或者相关教育培训机构进行专项学习培训。退役军人参加专项学习培训期间同等享受所在单位相关待遇。

After eligible retired military personnel are placed in positions, the competent department for retired military personnel work of the local people's government and the receiving unit may, based on job requirements and the individual's actual situation, select and send them to higher education institutions or relevant education and training institutions for specialized study and training. During the period of specialized study and training, retired military personnel shall enjoy the same benefits as those provided by their unit.

退役军人依法享受教育优待政策。

Retired military personnel shall enjoy education preferential policies in accordance with the law.

退役军人在达到法定退休年龄前参加职业技能培训的，按照规定享受职业技能培训补贴等相应扶持政策。

Retired military personnel who participate in vocational skills training before reaching the statutory retirement age shall, in accordance with regulations, enjoy corresponding support policies such as vocational skills training subsidies.

退役军人教育培训的规划、组织协调、督促检查、补助发放工作，以及师资、教学设施等方面保障，由退役军人工作主管部门和教育培训行政主管部门按照分工负责。

The planning, organization and coordination, supervision and inspection, subsidy distribution, as well as the guarantee of teaching staff and teaching facilities for the education and training of retired military personnel shall be the responsibility of the competent department for retired military personnel work and the competent department for education and training, according to their respective division of duties.

国家采取政府推动、市场引导、社会支持相结合的方式，鼓励和扶持退役军人就业创业。以逐月领取退役金、自主就业、复员方式安置的退役军人，按照规定享受相应就业创业扶持政策。

The State adopts a combination of government promotion, market guidance, and social support to encourage and support the employment and entrepreneurship of retired military personnel. Retired military personnel placed through methods such as monthly pension, self-employment, or demobilization shall enjoy corresponding employment and entrepreneurship support policies in accordance with regulations.

各级人民政府应当加强对退役军人就业创业的指导和服务。县级以上地方人民政府每年应当组织开展退役军人专场招聘活动，帮助退役军人就业。

People's governments at all levels shall strengthen guidance and services for the employment and entrepreneurship of retired military personnel. Local people's governments at or above the county level shall organize special recruitment activities for retired military personnel each year to help them find employment.

对符合当地就业困难人员认定条件的退役军人，安置地人民政府应当将其纳入就业援助范围。对其中确实难以通过市场实现就业的，依法纳入公益性岗位保障范围。

For retired military personnel who meet the criteria for being identified as persons with employment difficulties in the local area, the people's government of the placement location shall include them in the scope of employment assistance. For those who are truly unable to find employment through the market, they shall be included in the scope of public welfare job guarantees in accordance with the law.

机关、群团组织、事业单位和国有企业在招录或者招聘人员时，对退役军人的年龄和学历条件可以适当放宽，同等条件下优先招录、招聘退役军人。退役军官在军队团和相当于团以下单位工作的经历，退役军士和义务兵服现役的经历，视为基层工作经历。

When recruiting or hiring personnel, state organs, mass organizations, public institutions, and state-owned enterprises may appropriately relax the age and education requirements for retired military personnel, and under equal conditions, give priority to recruiting or hiring retired military personnel. The experience of retired officers serving in units at the regiment level or below, and the active service experience of retired non-commissioned officers and conscripts, shall be regarded as grassroots work experience.

各地应当设置一定数量的基层公务员职位，面向服现役满5年的高校毕业生退役军人招考。

Local authorities shall set a certain number of grassroots civil servant positions for retired military personnel who are college graduates and have served for at least five years.

用人单位招用退役军人符合国家规定的，依法享受税收优惠等政策。

Employers that recruit retired military personnel in accordance with national regulations shall enjoy tax incentives and other policies as prescribed by law.

自主就业的退役军士和义务兵入伍前是机关、群团组织、事业单位或者国有企业人员的，退出现役后可以选择复职复工，其工资、福利待遇不得低于本单位同等条件人员的平均水平。

For retired non-commissioned officers and conscripts who choose self-employment and were employees of state organs, mass organizations, public institutions, or state-owned enterprises before enlistment, they may choose to return to their original positions or be re-employed after retirement, and their wages and benefits shall not be lower than the average level of employees with equivalent conditions in the same unit.

自主就业的退役军士和义务兵入伍前通过家庭承包方式承包的农村土地，承包期内不得违法收回或者强迫、阻碍土地经营权流转；通过招标、拍卖、公开协商等非家庭承包方式承包的农村土地，承包期内其家庭成员可以继续承包；承包的农村土地被依法征收、征用或者占用的，与其他农村集体经济组织成员享有同等权利。

For retired non-commissioned officers and conscripts who choose self-employment and contracted rural land through household contracting before enlistment, the land shall not be illegally taken back or the transfer of land management rights forced or hindered during the contract period; for rural land contracted through non-household methods such as bidding, auction, or open negotiation, their family members may continue the contract during the contract period; if the contracted rural land is lawfully expropriated, requisitioned, or occupied, they shall enjoy equal rights with other members of the rural collective economic organization.

符合条件的复员军官、自主就业的退役军士和义务兵回入伍时户口所在地落户，属于农村集体经济组织成员但没有承包农村土地的，可以申请承包农村土地，农村集体经济组织或者村民委员会、村民小组应当优先解决。

Qualified demobilized officers, retired non-commissioned officers, and conscripts who choose self-employment shall settle in the place of their household registration at the time of enlistment. If they are members of a rural collective economic organization but have not contracted rural land, they may apply to contract rural land, and the rural collective economic organization, villagers' committee, or villagers' group shall give priority to resolving the matter.

服现役期间因战、因公、因病致残被评定残疾等级和退役后补评或者重新评定残疾等级的残疾退役军人，有劳动能力和就业意愿的，优先享受国家规定的残疾人就业优惠政策。退役军人所在单位不得因其残疾而辞退、解除聘用合同或者劳动合同。

Disabled retired military personnel who were assessed with a disability grade due to war, duty, or illness during active service, or who have their disability grade supplemented or reassessed after retirement, and who have the ability and willingness to work, shall have priority in enjoying the national preferential employment policies for disabled persons. The employer of a retired military personnel shall not dismiss, terminate the employment contract, or labor contract due to their disability.

退休军官的政治待遇按照安置地国家机关相应职务层次退休公务员有关规定执行。退休军官和军士的生活待遇按照军队统一的项目和标准执行。

The political treatment of retired officers shall be implemented in accordance with the relevant provisions for retired civil servants at the corresponding rank in the place of settlement. The living treatment of retired officers and non-commissioned officers shall be implemented in accordance with the unified items and standards of the military.

转业军官的待遇保障按照国家有关规定执行。

The treatment guarantee for transferred officers shall be implemented in accordance with relevant national regulations.

安排工作的退役军士和义务兵的工资待遇按照国家有关规定确定，享受接收安置单位同等条件人员的其他相关待遇。

The salary treatment of retired non-commissioned officers and conscripts who are arranged for work shall be determined in accordance with national regulations, and they shall enjoy other related benefits equivalent to those of employees with the same conditions in the receiving and employing unit.

退役军人服现役年限计算为工龄，退役后与所在单位工作年限累计计算，享受国家和所在单位规定的与工龄有关的相应待遇。其中，安排工作的退役军士和义务兵的服现役年限以及符合本条例规定的待安排工作时间合并计算为工龄。

The years of active service of retired military personnel shall be calculated as length of service, and shall be accumulated with the years of service in the employing unit after retirement, and they shall enjoy the corresponding treatment related to length of service as stipulated by the state and the employing unit. Among them, for retired non-commissioned officers and conscripts who are arranged for work, the years of active service and the time waiting for arrangement that complies with these regulations shall be combined and calculated as length of service.

安排工作的退役军士和义务兵待安排工作期间，安置地人民政府应当按照当地月最低工资标准逐月发放生活补助。

During the period when retired military sergeants and conscripts awaiting placement are waiting for assignment, the people's government of the placement location shall issue a monthly living allowance based on the local monthly minimum wage standard.

接收安置单位应当在安排工作介绍信开具30日内，安排退役军士和义务兵上岗。非因退役军士和义务兵本人原因，接收安置单位未按照规定安排上岗的，应当从介绍信开具当月起，按照不低于本单位同等条件人员平均工资80%的标准，逐月发放生活费直至上岗为止。

The receiving and employing unit shall arrange for retired military sergeants and conscripts to start work within 30 days from the issuance of the placement introduction letter. If, for reasons not attributable to the retired military sergeants or conscripts themselves, the receiving and employing unit fails to arrange for them to start work as required, it shall, from the month the introduction letter is issued, pay a monthly living allowance at a rate not less than 80% of the average salary of employees with equivalent conditions in the same unit until they start work.

军人服现役期间享受的残疾抚恤金、护理费等其他待遇，退出现役移交地方后按照地方有关规定执行。退休军官和军士享受的护理费等生活待遇按照军队有关规定执行。

Other benefits such as disability pension and nursing fees enjoyed by military personnel during active service shall, upon retirement and transfer to local authorities, be implemented in accordance with local regulations. Living benefits such as nursing fees for retired officers and sergeants shall be implemented in accordance with relevant military regulations.

符合条件的退役军人申请保障性住房和农村危房改造的，同等条件下予以优先安排。

Eligible retired military personnel applying for affordable housing and rural dilapidated house renovation shall be given priority under equal conditions.

退役军人符合安置住房优待条件的，实行市场购买与军地集中统建相结合的方式解决安置住房，由安置地人民政府统筹规划、科学实施。

For retired military personnel who meet the preferential conditions for placement housing, a combination of market purchase and centralized military-local construction shall be adopted to resolve placement housing, with the people's government of the placement location making overall planning and scientific implementation.

分散供养的退役军士和义务兵购(建)房所需经费的标准，按照安置地县(市、区、旗)经济适用住房平均价格和60平方米的建筑面积确定；没有经济适用住房的地区按照普通商品住房价格确定。所购(建)房屋产权归分散供养的退役军士和义务兵所有，依法办理不动产登记。

The standard for the funds required for the purchase (construction) of housing for dispersed support retired military sergeants and conscripts shall be determined based on the average price of affordable housing in the county (city, district, banner) of the placement location and a construction area of 60 square meters; in areas without affordable housing, the price shall be determined based on the price of ordinary commercial housing. The property rights of the purchased (constructed) housing shall belong to the dispersed support retired military sergeants and conscripts, and real estate registration shall be handled in accordance with the law.

分散供养的退役军士和义务兵自行解决住房的，按照前款规定的标准将购(建)房费用发给本人。

If dispersed support retired military sergeants and conscripts resolve their housing on their own, the cost of purchasing (constructing) housing shall be paid to them in accordance with the standards specified in the preceding paragraph.

军官和军士退出现役时，服现役期间的住房公积金按照规定一次性发给本人，也可以根据本人意愿转移接续到安置地，并按照当地规定缴存、使用住房公积金；服现役期间的住房补贴发放按照有关规定执行。

When officers and sergeants retire from active service, the housing provident fund during their active service period shall be paid to them in a lump sum in accordance with regulations, or may be transferred and continued to the placement location according to their wishes, and the housing provident fund shall be deposited and used in accordance with local regulations; the distribution of housing subsidies during active service shall be implemented in accordance with relevant regulations.

退役军人服现役期间获得功勋荣誉表彰的，退出现役后依法享受相应待遇。

Retired military personnel who have received honors and commendations during active service shall enjoy corresponding benefits after retirement in accordance with the law.

军人退出现役时，军队按照规定转移军人保险关系和相应资金，安置地社会保险经办机构应当及时办理相应的转移接续手续。

When military personnel retire from active service, the military shall transfer the military insurance relationship and corresponding funds in accordance with regulations, and the social insurance agency at the place of placement shall promptly handle the corresponding transfer and continuation procedures.

退役军人依法参加养老、医疗、工伤、失业、生育等社会保险，缴纳社会保险费，享受社会保险待遇。

Retired military personnel shall participate in social insurance such as endowment, medical, work-related injury, unemployment, and maternity insurance in accordance with the law, pay social insurance premiums, and enjoy social insurance benefits.

退役军人服现役年限与入伍前、退役后参加社会保险的缴费年限依法合并计算。

The years of active service of retired military personnel shall be combined and calculated with the contribution years of social insurance before enlistment and after retirement in accordance with the law.

安排工作的退役军士和义务兵在国家规定的待安排工作期间，按照规定参加安置地职工基本养老保险并享受相应待遇，所需费用由安置地人民政府同级财政资金安排。

Retired non-commissioned officers and conscripts who are assigned work shall, during the period awaiting assignment as prescribed by the state, participate in the basic endowment insurance for employees at the place of placement in accordance with regulations and enjoy corresponding benefits. The required expenses shall be arranged by the fiscal funds of the people's government at the same level as the place of placement.

安置到机关、群团组织、企业事业单位的退役军人，依法参加职工基本医疗保险并享受相应待遇。

Retired military personnel placed in state organs, mass organizations, enterprises, or institutions shall participate in the basic medical insurance for employees in accordance with the law and enjoy corresponding benefits.

安排工作的退役军士和义务兵在国家规定的待安排工作期间，依法参加安置地职工基本医疗保险并享受相应待遇，单位缴费部分由安置地人民政府缴纳，个人缴费部分由个人缴纳。

Retired non-commissioned officers and conscripts who are assigned work shall, during the period awaiting assignment as prescribed by the state, participate in the basic medical insurance for employees at the place of placement in accordance with the law and enjoy corresponding benefits. The employer contribution portion shall be paid by the people's government at the place of placement, and the individual contribution portion shall be paid by the individual.

逐月领取退役金的退役军官和军士、复员军官、自主就业的退役军士和义务兵依法参加职工基本医疗保险或者城乡居民基本医疗保险并享受相应待遇。

Retired officers and non-commissioned officers receiving monthly retirement pay, demobilized officers, and self-employed retired non-commissioned officers and conscripts shall participate in the basic medical insurance for employees or the basic medical insurance for urban and rural residents in accordance with the law and enjoy corresponding benefits.

退休军官和军士移交人民政府安置后，由安置地人民政府按照有关规定纳入医疗保险和相关医疗补助。

After retired officers and non-commissioned officers are transferred to the people's government for placement, the people's government at the place of placement shall include them in medical insurance and related medical subsidies in accordance with relevant regulations.

退休军官享受安置地国家机关相应职务层次退休公务员的医疗待遇，退休军士医疗待遇参照退休军官有关规定执行。

Retired officers shall enjoy the medical treatment benefits of retired civil servants at the corresponding rank level at the place of placement, and the medical treatment benefits of retired non-commissioned officers shall be implemented with reference to the relevant regulations for retired officers.

退役军人未及时就业的，可以依法向户口所在地人力资源社会保障部门申领失业保险待遇，服现役年限视同参保缴费年限，但是以退休、供养方式安置的退役军人除外。

If retired military personnel fail to find employment in a timely manner, they may apply for unemployment insurance benefits from the human resources and social security department at the location of their household registration in accordance with the law. The years of active service shall be deemed as contribution years for insurance, except for retired military personnel placed by retirement or support.

退役军人随调随迁家属，已经参加社会保险的，其社会保险关系和相应资金转移接续由社会保险经办机构依法办理。

For family members accompanying or relocating with retired military personnel who have already participated in social insurance, the transfer and continuation of their social insurance relations and corresponding funds shall be handled by the social insurance agency in accordance with the law.

退役军人工作主管部门和其他负责退役军人安置工作的部门及其工作人员有下列行为之一的，由其上级主管部门责令改正，对负有责任的领导人员和直接责任人员依法给予处分：

Where the competent department for retired military personnel affairs and other departments responsible for the placement of retired military personnel, as well as their staff, commit any of the following acts, the superior competent department shall order correction, and the responsible leaders and directly responsible personnel shall be given sanctions according to law:

(一)违反国家政策另设接收条件、提高安置门槛的；

(1) Setting additional acceptance conditions or raising placement thresholds in violation of national policies;

(二)未按照规定确定退役军人安置待遇的；

(2) Failing to determine the placement benefits for retired military personnel as prescribed;

(三)在退役军人安置工作中出具虚假文件的；

(3) Issuing false documents in the placement of retired military personnel;

(四)挪用、截留、私分退役军人安置工作经费的；

(4) Misappropriating, intercepting, or privately distributing funds for the placement of retired military personnel;

(五)在退役军人安置工作中利用职务之便为自己或者他人谋取私利的；

(5) Using their positions to seek personal gain for themselves or others in the placement of retired military personnel;

(六)有其他违反退役军人安置法律法规行为的。

(6) Other acts violating laws and regulations on the placement of retired military personnel.

接收安置退役军人的单位及其工作人员有下列行为之一的，由当地人民政府退役军人工作主管部门责令限期改正；逾期不改正的，予以通报批评，并对负有责任的领导人员和直接责任人员依法给予处分：

Where units that accept and place retired military personnel, as well as their staff, commit any of the following acts, the competent department for retired military personnel affairs of the local people's government shall order correction within a specified period; if correction is not made within the period, a notice of criticism shall be circulated, and the responsible leaders and directly responsible personnel shall be given sanctions according to law:

(一)拒绝或者无故拖延执行退役军人安置计划的；

(1) Refusing or delaying without reason the implementation of the placement plan for retired military personnel;

(二)在国家政策之外另设接收条件、提高安置门槛的；

(2) Setting additional acceptance conditions or raising placement thresholds beyond national policies;

(三)将接收安置退役军人编制截留、挪用的；

(3) Intercepting or misappropriating the staffing quotas designated for receiving and placing retired military personnel;

(四)未按照规定落实退役军人安置待遇的；

(4) Failing to implement the placement benefits for retired military personnel as prescribed;

(五)未依法与退役军人签订聘用合同或者劳动合同的；

(5) Failing to sign an employment contract or labor contract with retired military personnel in accordance with the law;

(六)违法与残疾退役军人解除聘用合同或者劳动合同的；

(6) Illegally terminating an employment contract or labor contract with a disabled retired military personnel;

(七)有其他违反退役军人安置法律法规行为的。

(7) Other acts violating laws and regulations on the placement of retired military personnel.

对干扰退役军人安置工作、损害退役军人合法权益的其他单位和个人，依法追究责任。

Other entities and individuals that interfere with the placement of retired military personnel or harm the legitimate rights and interests of retired military personnel shall be held accountable according to law.

退役军人弄虚作假骗取安置待遇的，由县级以上地方人民政府退役军人工作主管部门取消相关待遇，追缴非法所得，依法追究责任。

If a retired military person fraudulently obtains placement benefits, the competent department for the work of retired military personnel of the local people's government at or above the county level shall cancel the relevant benefits, recover the illegal gains, and pursue legal liability according to law.

违反本条例规定，构成违反治安管理行为的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。

Violations of these Regulations that constitute acts against public security administration shall be given public security administrative penalties according to law; if a crime is constituted, criminal liability shall be pursued according to law.

中国人民武装警察部队依法退出现役的警官、警士和义务兵等人员的安置，适用本条例。

The placement of officers, sergeants, and conscripts who have lawfully retired from active service in the Chinese People's Armed Police Force shall be governed by these Regulations.

本条例有关军官的规定适用于军队文职干部。

The provisions of these Regulations concerning officers shall apply to civilian cadres in the military.

士兵制度改革后未进行军衔转换士官的退役安置，参照本条例有关规定执行。

The retirement placement of non-commissioned officers who have not undergone rank conversion after the soldier system reform shall be implemented with reference to the relevant provisions of these Regulations.

军官离职休养和少将以上军官退休后，按照国务院和中央军事委员会的有关规定安置管理。

The placement and management of officers who have retired for rest and major generals and above who have retired shall be carried out in accordance with the relevant provisions of the State Council and the Central Military Commission.

军队院校学员依法退出现役的，按照国家有关规定执行。

Students of military academies who lawfully retire from active service shall be handled in accordance with the relevant provisions of the state.

已经按照自主择业方式安置的退役军人的待遇保障，按照国务院和中央军事委员会的有关规定执行。

The treatment guarantee for retired military personnel who have been placed through the voluntary job selection method shall be implemented in accordance with the relevant provisions of the State Council and the Central Military Commission.

本条例自2024年9月1日起施行。《退役士兵安置条例》同时废止。

These Regulations shall take effect on September 1, 2024. The Regulations on the Placement of Retired Soldiers shall be repealed simultaneously.
