This regulation sets hygiene standards and licensing requirements for public places in China to prevent disease and protect public health.

公共场所的主管部门应当建立卫生管理制度,配备专职或者兼职卫生管理人员,对所属经营单位(包括个体经营者,下同)的卫生状况进行经常性检查,并提供必要的条件。

The competent departments of public places shall establish a hygiene management system, assign full-time or part-time hygiene management personnel, conduct regular inspections of the hygiene conditions of the operating units under their jurisdiction (including individual operators, the same below), and provide necessary conditions.

经营单位应当负责所经营的公共场所的卫生管理,建立卫生责任制度,对本单位的从业人员进行卫生知识的培训和考核工作。

Operating units shall be responsible for the hygiene management of the public places they operate, establish a hygiene responsibility system, and provide hygiene knowledge training and assessment for their employees.

公共场所直接为顾客服务的人员,持有“健康合格证”方能从事本职工作。患有痢疾、伤寒、病毒性肝炎、活动期肺结核、化脓性或者渗出性皮肤病以及其他有碍公共卫生的疾病的,治愈前不得从事直接为顾客服务的工作。

Personnel directly serving customers in public places must hold a 'Health Certificate' to engage in their work. Those suffering from dysentery, typhoid fever, viral hepatitis, active pulmonary tuberculosis, purulent or exudative skin diseases, or other diseases that may affect public health shall not engage in work directly serving customers until cured.

除公园、体育场(馆)、公共交通工具和本条第二款规定的实行卫生备案管理的公共场所外,经营单位应当在营业前向设区的市级、县级人民政府疾病预防控制部门申请办理“卫生许可证”。

Except for parks, stadiums (gyms), public transportation vehicles, and public places subject to hygiene record management as specified in the second paragraph of this Article, operating units shall apply to the disease prevention and control department of the city with districts or the county people's government for a 'Hygiene License' before commencing business.

录像厅(室)、音乐厅、展览馆、博物馆、美术馆、图书馆、书店的经营单位应当在营业之日起30天内向设区的市级、县级人民政府疾病预防控制部门办理卫生备案。

Translation

Operators of video halls (rooms), music halls, exhibition halls, museums, art galleries, libraries, and bookstores shall complete hygiene registration with the disease prevention and control department of the city or county government within 30 days from the start of business.

公共场所因不符合卫生标准和要求造成危害健康事故的,经营单位应妥善处理,并及时报告卫生防疫机构。

If a public place causes a health hazard accident due to non-compliance with hygiene standards and requirements, the operator shall handle it properly and promptly report to the health and epidemic prevention agency.

Health and epidemic prevention agencies at all levels are responsible for hygiene supervision of public places within their jurisdiction.

民航、铁路、交通、厂(场)矿卫生防疫机构对管辖范围内的公共场所,施行卫生监督,并接受当地卫生防疫机构的业务指导。

Translation

Health and epidemic prevention agencies of civil aviation, railways, transportation, and factories (mines) shall implement hygiene supervision over public places within their jurisdiction and accept professional guidance from local health and epidemic prevention agencies.

Health and epidemic prevention agencies shall establish public place hygiene supervisors as needed to carry out tasks assigned by the agency. Public place hygiene supervisors shall be issued certificates by the people's government at the same level.

卫生监督员有权对公共场所进行现场检查,索取有关资料,经营单位不得拒绝或隐瞒。卫生监督员对所提供的技术资料有保密的责任。

Hygiene supervisors have the right to conduct on-site inspections of public places and request relevant materials; operators shall not refuse or conceal. Hygiene supervisors have the duty to keep the technical materials provided confidential.

Penalties

凡有下列行为之一的单位或者个人,卫生防疫机构可以根据情节轻重,给予警告、罚款、停业整顿、吊销“卫生许可证”的行政处罚:

For any of the following acts by a unit or individual, the health and epidemic prevention agency may, depending on the severity of the circumstances, impose administrative penalties such as a warning, fine, suspension of business for rectification, or revocation of the 'Hygiene Permit':

违反本条例的规定造成严重危害公民健康的事故或中毒事故的单位或者个人,应当对受害人赔偿损失。

TranslationArticle 15

Any unit or individual that, in violation of these regulations, causes a serious accident endangering citizens' health or a poisoning accident shall compensate the victim for losses.

违反本条例致人残疾或者死亡,构成犯罪的,应由司法机关依法追究直接责任人员的刑事责任。

Translation

If a violation of these regulations causes disability or death and constitutes a crime, the judicial authorities shall investigate the criminal liability of the directly responsible persons according to law.

Original Chinese第十六条

对罚款、停业整顿及吊销“卫生许可证”的行政处罚不服的,在接到处罚通知之日起15天内,可以向当地人民法院起诉。但对公共场所卫生质量控制的决定应立即执行。对处罚的决定不履行又逾期不起诉的,由卫生防疫机构向人民法院申请强制执行。

TranslationArticle 16

If a party is dissatisfied with administrative penalties such as a fine, suspension of business for rectification, or revocation of the 'Hygiene Permit', they may file a lawsuit with the local people's court within 15 days from receipt of the penalty notice. However, decisions on hygiene quality control in public places shall be implemented immediately. If the penalty decision is not complied with and no lawsuit is filed within the time limit, the health and epidemic prevention agency shall apply to the people's court for compulsory enforcement.

公共场所卫生监督机构和卫生监督员必须尽职尽责,依法办事。对玩忽职守,滥用职权,收取贿赂的,由上级主管部门给予直接责任人员行政处分。构成犯罪的,由司法机关依法追究直接责任人员的刑事责任。

Public place hygiene supervision agencies and hygiene supervisors must fulfill their duties and act in accordance with the law. Those who neglect their duties, abuse their power, or accept bribes shall be given administrative sanctions by the superior competent department. If a crime is constituted, the judicial authorities shall investigate the criminal liability of the directly responsible persons according to law.
