为了防范产业链供应链安全风险，提升产业链供应链韧性和安全水平，维护经济社会稳定和国家安全，根据《中华人民共和国国家安全法》、《中华人民共和国对外关系法》、《中华人民共和国反外国制裁法》、《中华人民共和国对外贸易法》等法律，制定本规定。
These Regulations are formulated in accordance with the National Security Law of the People's Republic of China, the Law of the People's Republic of China on Foreign Relations, the Law of the People's Republic of China on Countering Foreign Sanctions, the Foreign Trade Law of the People's Republic of China, and other laws, for the purposes of preventing risks to the security of industrial and supply chains, enhancing the resilience and security level of industrial and supply chains, and maintaining economic and social stability and national security.

The work on industrial and supply chain security shall implement a holistic approach to national security, coordinate development and security, coordinate domestic and international aspects, promote high-level opening up, and facilitate the stable and smooth operation of global industrial and supply chains.

The departments of the State Council for foreign affairs, development and reform, industry and information technology, public security, state security, rule of law, finance, natural resources, transportation, agriculture and rural affairs, commerce, financial management, customs, market supervision and administration, and cyberspace affairs shall, in accordance with their respective functions and duties, be responsible for undertaking work on industrial and supply chain security. The relevant departments of the State Council shall strengthen coordination and cooperation in work on industrial and supply chain security.

The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall, under the national coordination, be responsible for work on industrial and supply chain security related to their respective administrative regions.

The State shall guide the rational and orderly layout of industrial and supply chains, promote the digitalization and intelligentization of industrial and supply chains, enhance the security and controllability of industrial and supply chains, and promote the high-quality development of industrial and supply chains.
鼓励支持企业开拓多元化供应渠道，开展产业链供应链合作，公平参与市场竞争，提升防范产业链供应链安全风险水平。
Enterprises shall be encouraged and supported to diversify supply channels, engage in industrial and supply chain cooperation, participate in market competition on a fair basis, and enhance the level of preventing risks to industrial and supply chain security.
国家坚持平等互利、合作共赢原则，加强产业链供应链领域国际合作，积极参与产业链供应链有关国际规则制定。
The State shall adhere to the principles of equality, mutual benefit, and win-win cooperation, strengthen international cooperation in the field of industrial and supply chains, and actively participate in the formulation of relevant international rules on industrial and supply chains.

The relevant departments of the State Council and the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall, in the process of formulating relevant plans, fully consider the possible impact on the security of industrial and supply chains.

The State shall strengthen the security guarantee of industrial and supply chains in key areas. The relevant departments of the State Council shall formulate a list of key areas and make dynamic adjustments to maintain the stability and continuous operation of the production and circulation of raw materials, technologies, equipment, and products in key areas.
国务院有关部门推动关键领域产业链供应链信息共享，强化信息平台支撑，引导行业、企业间加强关键领域产业链供应链信息互联互通，并采取有效措施保障数据安全。
The relevant departments of the State Council shall promote information sharing on industrial and supply chains in key areas, strengthen the support of information platforms, guide industries and enterprises to enhance information interconnection and interoperability on industrial and supply chains in key areas, and take effective measures to ensure data security.
国家建立健全关键领域产业链供应链安全风险监测预警制度。国务院有关部门对关键领域的原材料、技术、设备、产品等供给渠道稳定情况及其对经济社会稳定和国家安全的影响等，组织开展评估监测，识别产业链供应链安全风险，及时发布预警信息。
The State shall establish and improve a system for monitoring and early warning of risks to the security of industrial and supply chains in key areas. The relevant departments of the State Council shall organize assessments and monitoring of the stability of supply channels for raw materials, technologies, equipment, and products in key areas and their impact on economic and social stability and national security, identify risks to industrial and supply chain security, and issue early warning information in a timely manner.
企业、行业协会商会等发现影响产业链供应链安全情形的，可以向县级以上人民政府有关部门报告。
Enterprises, industry associations, chambers of commerce, and others that discover circumstances affecting the security of industrial and supply chains may report to the relevant departments of the people's governments at or above the county level.
国家建立健全关键领域产业链供应链安全风险防范制度。国务院有关部门组织开展关键领域实物储备和能力储备，加大技术、设备、产品研发力度，提升关键领域产业链供应链抗风险能力。
The State shall establish and improve a system for preventing risks to the security of industrial and supply chains in key areas. The relevant departments of the State Council shall organize the implementation of physical reserves and capacity reserves in key areas, increase research and development efforts for technologies, equipment, and products, and enhance the risk resistance capability of industrial and supply chains in key areas.
国务院有关部门和地方人民政府应当结合本行业、本地区特点，有针对性地采取产业链供应链安全风险防范措施。
The relevant departments of the State Council and local people's governments shall, in light of the characteristics of their respective industries and regions, take targeted measures to prevent risks to the security of industrial and supply chains.
国家建立健全关键领域产业链供应链安全应急管理制度，国务院有关部门制定应急工作预案。出现影响关键领域产业链供应链安全情形，危及经济社会稳定和国家安全的，经国务院或者国务院授权的部门决定，可以采取紧急调度、动用储备以及组织生产、运输、供应等应急处置措施。法律、行政法规另有规定的，依照其规定。
The State shall establish and improve an emergency management system for the security of industrial and supply chains in key areas. The relevant departments of the State Council shall formulate emergency work plans. Where circumstances affecting the security of industrial and supply chains in key areas occur, endangering economic and social stability and national security, upon decision by the State Council or a department authorized by the State Council, emergency response measures such as emergency dispatch, use of reserves, and organization of production, transportation, and supply may be taken. Where laws and administrative regulations provide otherwise, those provisions shall prevail.
国务院有关部门和地方人民政府应当按照职责权限实施应急处置措施，并在有关情形消除后及时终止实施。有关组织、个人应当配合应急处置措施的实施。
The relevant departments of the State Council and local people's governments shall implement emergency response measures in accordance with their functions and powers, and terminate the implementation in a timely manner after the relevant circumstances are eliminated. Relevant organizations and individuals shall cooperate with the implementation of emergency response measures.
鼓励、引导社会资金投入，支持关键领域科学技术研发、核心技术攻关，促进科技成果转化。
Social funds shall be encouraged and guided to invest in supporting scientific and technological research and development in key areas, tackling core technologies, and promoting the transformation of scientific and technological achievements.
企业、科研机构等应当完善风险防控体系，实现核心技术及相关信息系统、数据的安全可控。有关部门应当加强指导和培训。
Enterprises, research institutions, and others shall improve their risk prevention and control systems to achieve security and controllability of core technologies and related information systems and data. Relevant departments shall strengthen guidance and training.
任何组织、个人违反我国法律、行政法规、部门规章和国家有关规定，在我国境内开展与产业链供应链相关的调查等信息收集活动的，有关部门依法采取相应处理措施。
Where any organization or individual, in violation of Chinese laws, administrative regulations, departmental rules, and relevant state provisions, conducts information collection activities related to industrial and supply chains, such as investigations, within the territory of China, the relevant departments shall take corresponding handling measures in accordance with the law.
外国国家、地区和国际组织违反国际法和国际关系基本准则，在产业链供应链方面对我国采取歧视性禁止、限制或者其他类似措施，实施或者协助实施损害我国产业链供应链安全行为的，国务院有关部门有权对有关措施或者行为开展产业链供应链安全调查。
Where foreign countries, regions, or international organizations, in violation of international law and basic norms of international relations, take discriminatory prohibitions, restrictions, or other similar measures against China in terms of industrial and supply chains, or implement or assist in implementing acts that damage the security of China's industrial and supply chains, the relevant departments of the State Council shall have the authority to conduct investigations into the security of industrial and supply chains concerning such measures or acts.
国务院有关部门按程序可以采取相应措施，包括但不限于禁止或者限制有关货物、技术进出口或者国际服务贸易，收取特别费用等。
The relevant departments of the State Council may, in accordance with procedures, take corresponding measures, including but not limited to prohibiting or restricting the import or export of relevant goods, technologies, or international service trade, and imposing special fees.
国务院有关部门可以依照《中华人民共和国反外国制裁法》、《实施〈中华人民共和国反外国制裁法〉的规定》等，决定将直接或者间接参与制定、决定、实施本条第一款规定的措施或者行为的组织、个人列入反制清单，采取反制措施。
The relevant departments of the State Council may, in accordance with the Law of the People's Republic of China on Countering Foreign Sanctions and the Provisions on the Implementation of the Law of the People's Republic of China on Countering Foreign Sanctions, decide to include organizations or individuals that directly or indirectly participate in the formulation, determination, or implementation of the measures or acts specified in paragraph 1 of this Article in a countermeasure list and take countermeasures.

Where foreign organizations or individuals, in violation of normal market transaction principles, interrupt normal transactions with Chinese citizens or organizations, take discriminatory measures against Chinese citizens or organizations, or engage in other acts that cause substantial harm or threaten substantial harm to the security of China's industrial and supply chains, the relevant departments of the State Council shall have the authority to conduct investigations into the security of industrial and supply chains.
调查可以采取询问有关当事人，查阅或者复制相关文件、资料以及其他必要的方式，有关当事人应当配合调查。调查期间，当事人可以陈述、申辩。
Investigations may take the form of questioning relevant parties, reviewing or copying relevant documents, materials, and other necessary means. The relevant parties shall cooperate with the investigation. During the investigation, the parties may make statements and defenses.
根据调查结果，国务院有关部门可以对外国组织、个人采取禁止或者限制其从事与我国有关的进出口活动，禁止或者限制其在我国境内投资，禁止或者限制我国境内的组织、个人与其进行有关交易、合作等活动，禁止或者限制相关人员、交通运输工具等入境，取消或者限制相关人员在我国境内工作、停留或者居留资格等措施。有关措施可以适用于外国组织、个人实际控制或者参与设立、运营的组织。
Based on the investigation results, the relevant departments of the State Council may take measures against foreign organizations or individuals, including but not limited to prohibiting or restricting their engagement in import and export activities related to China, prohibiting or restricting their investment within the territory of China, prohibiting or restricting organizations or individuals within the territory of China from engaging in transactions, cooperation, or other activities with them, prohibiting or restricting the entry of relevant personnel and means of transport, and canceling or restricting the qualifications of relevant personnel to work, stay, or reside within the territory of China. Such measures may apply to organizations actually controlled by or established or operated with the participation of foreign organizations or individuals.
我国境内的组织、个人应当执行国务院有关部门依照第十四条、第十五条规定采取的措施。
Organizations and individuals within the territory of China shall implement the measures taken by the relevant departments of the State Council in accordance with Articles 14 and 15.
对违反前款规定的组织、个人，国务院有关部门有权责令改正，禁止或者限制其从事政府采购、招标投标以及有关的货物、技术进出口或者国际服务贸易等活动，禁止或者限制其从境外接收或者向境外提供数据、个人信息，禁止或者限制其出境、在我国境内停留居留等。
For organizations or individuals that violate the provisions of the preceding paragraph, the relevant departments of the State Council shall have the authority to order corrections, prohibit or restrict their participation in government procurement, bidding, and related import and export of goods, technologies, or international service trade, prohibit or restrict their receipt or provision of data or personal information from or to abroad, and prohibit or restrict their exit from the country or stay or residence within the territory of China.
鼓励、支持律师事务所、公证机构等专业服务机构为我国公民、组织提供与产业链供应链安全有关的法律服务。
Law firms, notary offices, and other professional service institutions shall be encouraged and supported to provide legal services related to the security of industrial and supply chains for Chinese citizens and organizations.
本规定自公布之日起施行。
These Regulations shall come into force on the date of promulgation.
