Regulations on the Import and Export of Endangered Wild Fauna and Flora

为了加强对濒危野生动植物及其产品的进出口管理，保护和合理利用野生动植物资源，履行《濒危野生动植物种国际贸易公约》(以下简称公约)，制定本条例。
These Regulations are formulated to strengthen the import and export management of endangered wild fauna and flora and their products, protect and rationally utilize wild fauna and flora resources, and fulfill the Convention on International Trade in Endangered Species of Wild Fauna and Flora (hereinafter referred to as the Convention).
进口或者出口公约限制进出口的濒危野生动植物及其产品，应当遵守本条例。
The import or export of endangered wild fauna and flora and their products whose import and export are restricted by the Convention shall comply with these Regulations.
出口国家重点保护的野生动植物及其产品，依照本条例有关出口濒危野生动植物及其产品的规定办理。
The export of wild fauna and flora and their products under key national protection shall be handled in accordance with the provisions of these Regulations concerning the export of endangered wild fauna and flora and their products.
国务院林业、农业(渔业)主管部门(以下称国务院野生动植物主管部门)，按照职责分工主管全国濒危野生动植物及其产品的进出口管理工作，并做好与履行公约有关的工作。
The competent departments of forestry and agriculture (fisheries) under the State Council (hereinafter referred to as the competent departments of wild fauna and flora under the State Council) shall, in accordance with their respective functions and duties, be in charge of the import and export management of endangered wild fauna and flora and their products nationwide, and shall carry out work related to the implementation of the Convention.
国务院其他有关部门依照有关法律、行政法规的规定，在各自的职责范围内负责做好相关工作。
Other relevant departments under the State Council shall, in accordance with the provisions of relevant laws and administrative regulations, be responsible for carrying out relevant work within their respective functions and duties.
国家濒危物种进出口管理机构代表中国政府履行公约，依照本条例的规定对经国务院野生动植物主管部门批准出口的国家重点保护的野生动植物及其产品、批准进口或者出口的公约限制进出口的濒危野生动植物及其产品，核发允许进出口证明书。
The national authority for the import and export management of endangered species shall represent the Chinese government in implementing the Convention, and shall, in accordance with the provisions of these Regulations, issue permits for import and export for wild fauna and flora and their products under key national protection that have been approved for export by the competent departments of wild fauna and flora under the State Council, and for endangered wild fauna and flora and their products whose import and export are restricted by the Convention that have been approved for import or export.
国家濒危物种进出口科学机构依照本条例，组织陆生野生动物、水生野生动物和野生植物等方面的专家，从事有关濒危野生动植物及其产品进出口的科学咨询工作。
The national scientific authority for endangered species shall, in accordance with these Regulations, organize experts in terrestrial wild animals, aquatic wild animals, and wild plants to engage in scientific advisory work concerning the import and export of endangered wild fauna and flora and their products.
禁止进口或者出口公约禁止以商业贸易为目的进出口的濒危野生动植物及其产品，因科学研究、驯养繁殖、人工培育、文化交流等特殊情况，需要进口或者出口的，应当经国务院野生动植物主管部门批准；按照有关规定由国务院批准的，应当报经国务院批准。
The import or export of endangered wild fauna and flora and their products whose import and export for commercial trade are prohibited by the Convention is prohibited. If import or export is necessary due to special circumstances such as scientific research, domestication and breeding, artificial cultivation, or cultural exchange, approval shall be obtained from the competent departments of wild fauna and flora under the State Council; if approval by the State Council is required in accordance with relevant regulations, it shall be submitted to the State Council for approval.
禁止出口未定名的或者新发现并有重要价值的野生动植物及其产品以及国务院或者国务院野生动植物主管部门禁止出口的濒危野生动植物及其产品。
The export of unnamed or newly discovered wild fauna and flora and their products of significant value, as well as endangered wild fauna and flora and their products whose export is prohibited by the State Council or the competent departments of wild fauna and flora under the State Council, is prohibited.
进口或者出口公约限制进出口的濒危野生动植物及其产品，出口国务院或者国务院野生动植物主管部门限制出口的野生动植物及其产品，应当经国务院野生动植物主管部门批准。
The import or export of endangered wild fauna and flora and their products whose import and export are restricted by the Convention, and the export of wild fauna and flora and their products whose export is restricted by the State Council or the competent departments of wild fauna and flora under the State Council, shall be approved by the competent departments of wild fauna and flora under the State Council.
进口濒危野生动植物及其产品的，必须具备下列条件：
The import of endangered wild fauna and flora and their products shall meet the following conditions:
(一)对濒危野生动植物及其产品的使用符合国家有关规定；
(1) The use of the endangered wild fauna and flora and their products complies with relevant state regulations;
(二)具有有效控制措施并符合生态安全要求；
(2) Effective control measures are in place and ecological safety requirements are met;
(三)申请人提供的材料真实有效；
(3) The materials provided by the applicant are true and valid;
(四)国务院野生动植物主管部门公示的其他条件。
(4) Other conditions published by the competent departments of wild fauna and flora under the State Council.
出口濒危野生动植物及其产品的，必须具备下列条件：
The export of endangered wild fauna and flora and their products shall meet the following conditions:
(一)符合生态安全要求和公共利益；
(1) Ecological safety requirements and public interests are met;
(二)来源合法；
(2) The source is legal;
(三)申请人提供的材料真实有效；
(3) The materials provided by the applicant are true and valid;
(四)不属于国务院或者国务院野生动植物主管部门禁止出口的；
(4) The items are not prohibited for export by the State Council or the competent departments of wild fauna and flora under the State Council;
(五)国务院野生动植物主管部门公示的其他条件。
(5) Other conditions published by the competent departments of wild fauna and flora under the State Council.
进口或者出口濒危野生动植物及其产品的，申请人应当按照管理权限，向其所在地的省、自治区、直辖市人民政府农业(渔业)主管部门提出申请，或者向国务院林业主管部门提出申请，并提交下列材料：
For the import or export of endangered wild fauna and flora and their products, the applicant shall, in accordance with the administrative authority, submit an application to the competent department of agriculture (fisheries) of the people's government of the province, autonomous region, or municipality directly under the Central Government where the applicant is located, or to the competent department of forestry under the State Council, and submit the following materials:
(一)进口或者出口合同；
(1) Import or export contract;
(二)濒危野生动植物及其产品的名称、种类、数量和用途；
(2) Name, type, quantity and purpose of the endangered wild fauna and flora and their products;
(三)活体濒危野生动物装运设施的说明资料；
(3) Description of the packaging and transport facilities for live endangered wild animals;
(四)国务院野生动植物主管部门公示的其他应当提交的材料。
(4) Other materials that the competent wildlife authority of the State Council publicly announces as required to be submitted.
省、自治区、直辖市人民政府农业(渔业)主管部门应当自收到申请之日起10个工作日内签署意见，并将全部申请材料转报国务院农业(渔业)主管部门。
The competent agriculture (fisheries) authority of the people's government of a province, autonomous region, or municipality directly under the Central Government shall, within 10 working days from receipt of the application, provide its comments and forward all application materials to the competent agriculture (fisheries) authority of the State Council.
国务院野生动植物主管部门应当自收到申请之日起20个工作日内，作出批准或者不予批准的决定，并书面通知申请人。在20个工作日内不能作出决定的，经本行政机关负责人批准，可以延长10个工作日，延长的期限和理由应当通知申请人。
The competent wildlife authority of the State Council shall, within 20 working days from receipt of the application, make a decision to approve or disapprove and notify the applicant in writing. If a decision cannot be made within 20 working days, with the approval of the head of the administrative organ, the period may be extended by 10 working days, and the extension period and reasons shall be notified to the applicant.
申请人取得国务院野生动植物主管部门的进出口批准文件后，应当在批准文件规定的有效期内，向国家濒危物种进出口管理机构申请核发允许进出口证明书。
After obtaining the import or export approval document from the competent wildlife authority of the State Council, the applicant shall, within the validity period specified in the approval document, apply to the national endangered species import and export management authority for the issuance of a permit for import and export.
申请核发允许进出口证明书时应当提交下列材料：
When applying for the issuance of a permit for import and export, the following materials shall be submitted:
(一)允许进出口证明书申请表；
(1) Application form for the permit for import and export;
(二)进出口批准文件；
(2) Import or export approval document;
(三)进口或者出口合同。
(3) Import or export contract.
进口公约限制进出口的濒危野生动植物及其产品的，申请人还应当提交出口国(地区)濒危物种进出口管理机构核发的允许出口证明材料；出口公约禁止以商业贸易为目的进出口的濒危野生动植物及其产品的，申请人还应当提交进口国(地区)濒危物种进出口管理机构核发的允许进口证明材料；进口的濒危野生动植物及其产品再出口时，申请人还应当提交海关进口货物报关单和海关签注的允许进口证明书。
For the import of endangered wild fauna and flora and their products whose import and export are restricted by the Convention, the applicant shall also submit the export permit issued by the endangered species import and export management authority of the exporting country (region); for the export of endangered wild fauna and flora and their products whose import and export for commercial trade are prohibited by the Convention, the applicant shall also submit the import permit issued by the endangered species import and export management authority of the importing country (region); for the re-export of imported endangered wild fauna and flora and their products, the applicant shall also submit the customs import declaration form and the import permit endorsed by customs.
国家濒危物种进出口管理机构应当自收到申请之日起20个工作日内，作出审核决定。对申请材料齐全、符合本条例规定和公约要求的，应当核发允许进出口证明书；对不予核发允许进出口证明书的，应当书面通知申请人和国务院野生动植物主管部门并说明理由。在20个工作日内不能作出决定的，经本机构负责人批准，可以延长10个工作日，延长的期限和理由应当通知申请人。
The national endangered species import and export management authority shall, within 20 working days from receipt of the application, make a review decision. If the application materials are complete and comply with these Regulations and the requirements of the Convention, it shall issue a permit for import and export; if it decides not to issue a permit for import and export, it shall notify the applicant and the competent wildlife authority of the State Council in writing and state the reasons. If a decision cannot be made within 20 working days, with the approval of the head of the authority, the period may be extended by 10 working days, and the extension period and reasons shall be notified to the applicant.
国家濒危物种进出口管理机构在审核时，对申请材料不符合要求的，应当在5个工作日内一次性通知申请人需要补正的全部内容。
When reviewing, if the application materials do not meet the requirements, the national endangered species import and export management authority shall, within 5 working days, notify the applicant of all the contents that need to be supplemented in a single notice.
国家濒危物种进出口管理机构在核发允许进出口证明书时，需要咨询国家濒危物种进出口科学机构的意见，或者需要向境外相关机构核实允许进出口证明材料等有关内容的，应当自收到申请之日起5个工作日内，将有关材料送国家濒危物种进出口科学机构咨询意见或者向境外相关机构核实有关内容。咨询意见、核实内容所需时间不计入核发允许进出口证明书工作日之内。
When issuing a permit for import and export, if the national endangered species import and export management authority needs to consult the national endangered species import and export scientific institution or verify the relevant content of the import or export permit with the relevant overseas authority, it shall, within 5 working days from receipt of the application, send the relevant materials to the national endangered species import and export scientific institution for consultation or to the relevant overseas authority for verification. The time required for consultation or verification shall not be counted in the working days for issuing the permit for import and export.
国务院野生动植物主管部门和省、自治区、直辖市人民政府野生动植物主管部门以及国家濒危物种进出口管理机构，在审批濒危野生动植物及其产品进出口时，除收取国家规定的费用外，不得收取其他费用。
When approving the import or export of endangered wild fauna and flora and their products, the competent wildlife authority of the State Council, the competent wildlife authority of the people's government of a province, autonomous region, or municipality directly under the Central Government, and the national endangered species import and export management authority shall not charge any fees other than those prescribed by the state.
因进口或者出口濒危野生动植物及其产品对野生动植物资源、生态安全造成或者可能造成严重危害和影响的，由国务院野生动植物主管部门提出临时禁止或者限制濒危野生动植物及其产品进出口的措施，报国务院批准后执行。
If the import or export of endangered wild fauna and flora and their products causes or may cause serious harm or impact to wildlife resources or ecological security, the competent wildlife authority of the State Council shall propose temporary measures to prohibit or restrict the import or export of endangered wild fauna and flora and their products, and implement them after approval by the State Council.
从不属于任何国家管辖的海域获得的濒危野生动植物及其产品，进入中国领域的，参照本条例有关进口的规定管理。
Endangered wild fauna and flora and their products obtained from sea areas not under the jurisdiction of any country and brought into China shall be managed by reference to the provisions of these Regulations on import.
进口濒危野生动植物及其产品涉及外来物种管理的，出口濒危野生动植物及其产品涉及种质资源管理的，应当遵守国家有关规定。
If the import of endangered wild fauna and flora and their products involves the management of alien species, or the export of endangered wild fauna and flora and their products involves the management of germplasm resources, the relevant state provisions shall be complied with.
进口或者出口濒危野生动植物及其产品的，应当在国务院野生动植物主管部门会同海关总署指定并经国务院批准的口岸进行。
The import or export of endangered wild fauna and flora and their products shall be carried out at ports designated by the competent wildlife authority of the State Council in conjunction with the General Administration of Customs and approved by the State Council.
进口或者出口濒危野生动植物及其产品的，应当按照允许进出口证明书规定的种类、数量、口岸、期限完成进出口活动。
The import or export of endangered wild fauna and flora and their products shall be completed in accordance with the type, quantity, port, and time limit specified in the permit for import and export.
进口或者出口濒危野生动植物及其产品的，应当向海关提交允许进出口证明书，接受海关监管，并自海关放行之日起30日内，将海关验讫的允许进出口证明书副本交国家濒危物种进出口管理机构备案。
When importing or exporting endangered wild fauna and flora and their products, the permit for import and export shall be submitted to customs for supervision, and within 30 days from the date of customs release, a copy of the permit for import and export endorsed by customs shall be submitted to the national endangered species import and export management authority for record.
过境、转运和通运的濒危野生动植物及其产品，自入境起至出境前由海关监管。
Endangered wild fauna and flora and their products in transit, transshipment, or through shipment shall be supervised by customs from entry to exit.
进出保税区、出口加工区等海关特定监管区域和保税场所的濒危野生动植物及其产品，应当接受海关监管，并按照海关总署和国家濒危物种进出口管理机构的规定办理进出口手续。
Endangered wild fauna and flora and their products entering or leaving bonded areas, export processing zones, and other special customs supervision areas and bonded places shall be subject to customs supervision, and import and export procedures shall be handled in accordance with the provisions of the General Administration of Customs and the national endangered species import and export management authority.
进口或者出口濒危野生动植物及其产品的，应当凭允许进出口证明书向海关报检，并接受检验检疫。
When importing or exporting endangered wild fauna and flora and their products, the permit for import and export shall be submitted to customs for inspection and quarantine.
国家濒危物种进出口管理机构应当将核发允许进出口证明书的有关资料和濒危野生动植物及其产品年度进出口情况，及时抄送国务院野生动植物主管部门及其他有关主管部门。
The national endangered species import and export management authority shall promptly send copies of the relevant materials for issuing import/export permits and the annual import/export situation of endangered wild fauna and flora and their products to the competent department of wild fauna and flora under the State Council and other relevant competent departments.
进出口批准文件由国务院野生动植物主管部门组织统一印制；允许进出口证明书及申请表由国家濒危物种进出口管理机构组织统一印制。
Import/export approval documents shall be uniformly printed under the organization of the competent department of wild fauna and flora under the State Council; import/export permits and application forms shall be uniformly printed under the organization of the national endangered species import and export management authority.
野生动植物主管部门、国家濒危物种进出口管理机构的工作人员，利用职务上的便利收取他人财物或者谋取其他利益，不依照本条例的规定批准进出口、核发允许进出口证明书，情节严重，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予处分。
If a staff member of the competent department of wild fauna and flora or the national endangered species import and export management authority, taking advantage of their position, accepts property from others or seeks other benefits, and fails to approve imports/exports or issue import/export permits in accordance with these Regulations, if the circumstances are serious and constitute a crime, criminal liability shall be pursued according to law; if it does not constitute a crime, administrative sanctions shall be imposed according to law.
国家濒危物种进出口科学机构的工作人员，利用职务上的便利收取他人财物或者谋取其他利益，出具虚假意见，情节严重，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予处分。
If a staff member of the national endangered species import and export scientific institution, taking advantage of their position, accepts property from others or seeks other benefits, and issues false opinions, if the circumstances are serious and constitute a crime, criminal liability shall be pursued according to law; if it does not constitute a crime, administrative sanctions shall be imposed according to law.
非法进口、出口或者以其他方式走私濒危野生动植物及其产品的，由海关依照海关法的有关规定予以处罚；情节严重，构成犯罪的，依法追究刑事责任。
If anyone illegally imports, exports, or otherwise smuggles endangered wild fauna and flora and their products, the customs shall impose penalties in accordance with the relevant provisions of the Customs Law; if the circumstances are serious and constitute a crime, criminal liability shall be pursued according to law.
罚没的实物移交野生动植物主管部门依法处理；罚没的实物依法需要实施检疫的，经检疫合格后，予以处理。罚没的实物需要返还原出口国(地区)的，应当由野生动植物主管部门移交国家濒危物种进出口管理机构依照公约规定处理。
The confiscated physical objects shall be handed over to the competent department of wild fauna and flora for disposal according to law; if the confiscated physical objects need to be quarantined according to law, they shall be disposed of after passing quarantine. If the confiscated physical objects need to be returned to the exporting country (region), the competent department of wild fauna and flora shall hand them over to the national endangered species import and export management authority for disposal in accordance with the Convention.
伪造、倒卖或者转让进出口批准文件或者允许进出口证明书的，由野生动植物主管部门或者市场监督管理部门按照职责分工依法予以处罚；情节严重，构成犯罪的，依法追究刑事责任。
If anyone forges, resells, or transfers import/export approval documents or import/export permits, the competent department of wild fauna and flora or the market supervision and management authority shall impose penalties according to law within their respective responsibilities; if the circumstances are serious and constitute a crime, criminal liability shall be pursued according to law.
本条例自2006年9月1日起施行。
These Regulations shall come into force as of September 1, 2006.
