为保证海关工作人员依法使用武器和警械,履行职责,根据《中华人民共和国海关法》第六条的规定,制定本规定。
These Provisions are formulated to ensure that customs officers lawfully use weapons and police implements in the performance of their duties, in accordance with the provisions of Article 6 of the Customs Law of the People's Republic of China.
海关工作人员使用的武器和警械,经当地公安机关同意后由海关总署统一配发。海关工作人员执行缉私任务时,应当依照本规定使用武器和警械。
Weapons and police implements used by customs officers shall be uniformly issued by the General Administration of Customs after obtaining the consent of the local public security authorities. Customs officers shall use weapons and police implements in accordance with these Provisions when performing anti-smuggling tasks.
海关工作人员使用的武器和警械包括:轻型枪支、电警棍、手铐及其他经批准列装的武器和警械。
Weapons and police implements used by customs officers include: light firearms, electric batons, handcuffs, and other weapons and police implements approved for issue.
配发给海关的武器和警械一律公用,不配发个人专用的武器和警械。
Weapons and police implements issued to customs shall be for official use only; no weapons or police implements shall be issued for personal use.
海关工作人员持枪执行缉私任务时,应当随身携带当地公安机关核发的持枪证或者持枪通行证。
When carrying firearms while performing anti-smuggling tasks, customs officers shall carry with them the firearm permit or firearm pass issued by the local public security authority.
海关工作人员执行缉私任务,遇有下列情形之一的,可以开枪射击:
Customs officers may fire shots when encountering any of the following circumstances during anti-smuggling operations:
(一)追缉逃跑的走私团伙或者遭遇武装掩护走私,非开枪不足以制服时;
(1) When pursuing fleeing smuggling gangs or encountering armed smuggling, and firing is necessary to subdue them;
(二)走私分子或者走私嫌疑人以暴力抗拒检查,抢夺武器或者警械,威胁海关工作人员生命安全,非开枪不能自卫时;
(2) When smugglers or suspected smugglers violently resist inspection, seize weapons or police implements, threaten the life safety of customs officers, and firing is necessary for self-defense;
(三)走私分子或者走私嫌疑人以暴力劫夺查扣的走私货物、物品和其他证据,非开枪不能制止时。
(3) When smugglers or suspected smugglers violently seize confiscated smuggled goods, articles, or other evidence, and firing is necessary to stop them.
海关工作人员执行缉私任务,遇有下列情形之一的,可以使用警械:
Customs officers may use police implements when encountering any of the following circumstances during anti-smuggling operations:
(一)走私分子或者走私嫌疑人以暴力抗拒检查或者逃跑时;
(1) When smugglers or suspected smugglers violently resist inspection or flee;
(二)走私分子或者走私嫌疑人以暴力抗拒查扣走私货物、物品和其他证据时;
(2) When smugglers or suspected smugglers violently resist the seizure of smuggled goods, articles, or other evidence;
(三)执行缉私任务受到袭击需要自卫时;
(3) When attacked during anti-smuggling operations and self-defense is necessary;
(四)遇有其他需要使用警械的情形时。
(4) When other circumstances require the use of police implements.
海关工作人员使用武器或者警械时,应当以制服对方为限度。海关工作人员依照本规定第四条的规定开枪射击时,除特别紧迫的情况外,应当先口头警告或者鸣枪警告,对方一有畏服表现,应当立即停止射击。开枪射击造成人员伤亡的,应当保护现场,并立即向上级海关和当地公安机关报告。
When using weapons or police implements, customs officers shall do so only to the extent necessary to subdue the opponent. When firing shots in accordance with Article 4 of these Provisions, except in cases of extreme urgency, a verbal warning or warning shot shall be given first; once the opponent shows signs of submission, firing shall cease immediately. If firing causes casualties, the scene shall be preserved, and the superior customs authority and local public security authority shall be notified immediately.
海关工作人员违反本规定,滥用武器或者警械的,应当根据情节,依法追究有关人员的责任。
If a customs officer violates these Provisions by abusing weapons or police implements, the responsible person shall be investigated for liability according to law based on the circumstances.
本规定自发布之日起施行。
These Provisions shall come into force on the date of promulgation.
