为了加强对卫星电视广播地面接收设施的管理，促进社会主义精神文明建设，制定本规定。
These Provisions are formulated to strengthen the administration of satellite television and radio ground receiving facilities and to promote the construction of socialist spiritual civilization.
本规定所称卫星电视广播地面接收设施(以下简称卫星地面接收设施)，是指接收卫星传送的电视节目的天线、高频头、接收机及编码、解码器等设施。
For the purposes of these Provisions, satellite television and radio ground receiving facilities (hereinafter referred to as satellite ground receiving facilities) refer to antennas, low-noise block downconverters, receivers, and encoders, decoders, and other facilities that receive television programs transmitted by satellites.
国家对卫星地面接收设施的生产、进口、销售、安装和使用实行许可制度。
The state implements a licensing system for the production, import, sale, installation, and use of satellite ground receiving facilities.
生产、进口、销售、安装和使用卫星地面接收设施许可的条件，由国务院有关行政部门规定。
The conditions for licenses for the production, import, sale, installation, and use of satellite ground receiving facilities shall be prescribed by the relevant administrative departments of the State Council.
工业产品生产许可证主管部门许可的生产企业，应当将卫星地面接收设施销售给依法设立的安装服务机构。其他任何单位和个人不得销售。
Production enterprises licensed by the industrial product production license administrative department shall sell satellite ground receiving facilities to installation service institutions established in accordance with the law. No other unit or individual may sell them.
进口卫星地面接收设施必须持国务院广播电视行政管理部门开具的证明，进口卫星地面接收设施的专用元部件必须持国务院电子工业行政部门开具的证明，到国务院机电产品进出口行政部门办理审批手续，海关凭审查批准文件放行。
To import satellite ground receiving facilities, a certificate issued by the radio and television administrative department of the State Council must be held; to import special components and parts of satellite ground receiving facilities, a certificate issued by the electronic industry administrative department of the State Council must be held; and the approval procedures shall be handled with the administrative department of mechanical and electronic products import and export of the State Council, and the customs shall release the goods upon verification of the approval documents.
禁止个人携带、邮寄卫星地面接收设施入境。
Individuals are prohibited from carrying or mailing satellite ground receiving facilities into the country.
卫星地面接收设施的质量认证证书和认证标志，由国务院产品质量监督管理部门或者国务院产品质量监督管理部门授权的部门认可的认证机构按照有关质量认证的法律、法规的规定认证合格后发放；未经质量认证的，不得销售和使用。
The quality certification certificates and certification marks for satellite ground receiving facilities shall be issued by certification bodies recognized by the product quality supervision and administration department of the State Council or by departments authorized by the product quality supervision and administration department of the State Council after passing certification in accordance with relevant laws and regulations on quality certification; those without quality certification shall not be sold or used.
单位设置卫星地面接收设施的，必须向当地县、市人民政府广播电视行政管理部门提出申请，报省、自治区、直辖市人民政府广播电视行政管理部门审批，凭审批机关开具的证明购买卫星地面接收设施。卫星地面接收设施安装完毕，由审批机关发给《接收卫星传送的电视节目许可证》。
If a unit intends to install satellite ground receiving facilities, it must apply to the local radio and television administrative department of the county or city people's government, which shall report to the radio and television administrative department of the province, autonomous region, or municipality directly under the Central Government for approval, and purchase satellite ground receiving facilities based on the certificate issued by the approving authority. After the installation of satellite ground receiving facilities is completed, the approving authority shall issue a "License for Receiving Television Programs Transmitted by Satellites."
个人不得安装和使用卫星地面接收设施。
Individuals shall not install or use satellite ground receiving facilities.
如有特殊情况，个人确实需要安装和使用卫星地面接收设施并符合国务院广播电视行政管理部门规定的许可条件的，必须向所在单位提出申请，经当地县、市人民政府广播电视行政管理部门同意后报省、自治区、直辖市人民政府广播电视行政管理部门审批。
In special circumstances where an individual truly needs to install and use satellite ground receiving facilities and meets the licensing conditions prescribed by the radio and television administrative department of the State Council, the individual must apply to the unit to which they belong, and after obtaining the consent of the local radio and television administrative department of the county or city people's government, report to the radio and television administrative department of the province, autonomous region, or municipality directly under the Central Government for approval.
本规定发布前未经批准设置卫星地面接收设施的，必须自本规定发布之日起6个月内依照本规定办理审批手续。
For those who have installed satellite ground receiving facilities without approval before the promulgation of these Provisions, they must go through the approval procedures in accordance with these Provisions within six months from the date of promulgation of these Provisions.
违反本规定，擅自生产卫星地面接收设施或者生产企业未按照规定销售给依法设立的安装服务机构的，由工业产品生产许可证主管部门责令停止生产、销售。
Anyone who, in violation of these Provisions, produces satellite ground receiving facilities without authorization, or if a production enterprise fails to sell them to installation service institutions established in accordance with the law, the industrial product production license administrative department shall order the cessation of production and sale.
违反本规定，擅自销售卫星地面接收设施的，由市场监督管理部门责令停止销售，没收其卫星地面接收设施，并可以处以相当于销售额2倍以下的罚款。
Anyone who, in violation of these Provisions, sells satellite ground receiving facilities without authorization, the market supervision and administration department shall order the cessation of sales, confiscate the satellite ground receiving facilities, and may also impose a fine of not more than two times the equivalent of the sales amount.
违反本规定，擅自安装和使用卫星地面接收设施的，由广播电视行政管理部门没收其安装和使用的卫星地面接收设施，对个人可以并处5000元以下的罚款，对单位可以并处5万元以下的罚款。
Anyone who, in violation of these Provisions, installs or uses satellite ground receiving facilities without authorization, the radio and television administrative department shall confiscate the installed and used satellite ground receiving facilities, and may also impose a fine of not more than 5,000 yuan on individuals and not more than 50,000 yuan on units.
当事人对处罚决定不服的，可以依照有关法律、行政法规的规定，申请行政复议或者提起行政诉讼。
If a party is dissatisfied with the penalty decision, it may apply for administrative reconsideration or initiate administrative litigation in accordance with the provisions of relevant laws and administrative regulations.
本规定的实施细则由国务院广播电视行政管理部门商有关行政部门制定。
The implementing rules for these Provisions shall be formulated by the radio and television administrative department of the State Council in consultation with the relevant administrative departments.
本规定自发布之日起施行。
These Provisions shall come into force as of the date of promulgation.
