总 则
General Provisions
为了做好石油地震勘探损害补偿工作，正确处理国家、集体、个人三者利益关系，确保石油勘探工作的顺利进行，制定本规定。
These Provisions are formulated to properly handle compensation for damage caused by petroleum seismic exploration, correctly balance the interests of the state, collectives, and individuals, and ensure the smooth progress of petroleum exploration.
本规定适用于中华人民共和国陆地(包括岛屿、海滩、水深五米的浅海在内)石油地震勘探作业和作业地震波的损害补偿。
These Provisions apply to compensation for damage caused by petroleum seismic exploration operations and seismic waves on land within the People's Republic of China (including islands, beaches, and shallow seas with a water depth of less than five meters).
石油地震勘探是沿一定测线通过式作业，在测线每个观测点上通过时间不超过四十八小时，在特殊情况下不超过九十六小时的，免于办理临时用地手续。
Petroleum seismic exploration is a pass-through operation along certain survey lines. If the passage time at each observation point on the survey line does not exceed 48 hours, or under special circumstances does not exceed 96 hours, the procedures for temporary land use are exempted.
石油地震勘探按照实际损害程度由地震作业队给予受损害的个人或者单位一次性补偿，补偿费用应当及时支付。任何单位或者个人不得截留、回扣补偿费用，或者向地震作业队索要补偿费用之外的费用或者实物。
Petroleum seismic exploration shall provide one-time compensation to the damaged individual or unit based on the actual extent of damage, and the compensation fee shall be paid promptly. No unit or individual may intercept or deduct compensation fees, or demand fees or goods beyond the compensation from the seismic operation team.
地震作业队的主管部门，应当在开工前三十日内将本年度的石油地震勘探施工设计和作业计划向作业区所在地的县级人民政府有关主管部门报告，取得支持和帮助。县级人民政府有关主管部门应当在地震作业队作业前将作业区的地面、地下设施、农田作物等有关资料提供给地震作业队主管部门。
The competent department of the seismic operation team shall, within 30 days before the start of operations, report the annual petroleum seismic exploration construction design and operation plan to the relevant competent department of the county-level people's government where the operation area is located, to obtain support and assistance. The relevant competent department of the county-level people's government shall provide the seismic operation team's competent department with relevant data on ground and underground facilities, farmland crops, etc., in the operation area before the seismic operation team begins operations.
地震作业队的作业，应当按照国家有关规定在城市区、工矿区、居民点、车站、码头、港口、铁路、军用基地、人防工程、大中型桥涵、水利工程、电力设施、输油输气管线、国家测量标志、重点文物、通讯设施、广播设施的安全距离之外放炮。特殊情况下，如需在上述安全距离内放炮作业，地震作业队应当征得有关部门同意，采取安全措施后，方可施工。
Seismic operations shall, in accordance with relevant state regulations, conduct blasting outside the safety distance from urban areas, industrial and mining areas, residential areas, stations, docks, ports, railways, military bases, civil air defense projects, large and medium-sized bridges and culverts, water conservancy projects, power facilities, oil and gas pipelines, national survey markers, key cultural relics, communication facilities, and broadcasting facilities. Under special circumstances, if blasting is required within the above safety distances, the seismic operation team shall obtain consent from the relevant departments and take safety measures before construction.
当事人双方对石油地震勘探损害补偿问题发生纠纷时，首先应当协商解决，协商不成的，提请当地县级人民政府及其指定的部门调解处理；对调解处理决定不服的，任何一方可在接到处理决定之日起十五日内向所在地人民法院起诉，但在调解和诉讼期间，应当保证地震作业队正常作业。
When a dispute arises between the parties over compensation for damage caused by petroleum seismic exploration, they shall first seek a resolution through negotiation. If negotiation fails, the matter shall be submitted to the local county-level people's government or its designated department for mediation. If either party is dissatisfied with the mediation decision, it may file a lawsuit with the local people's court within 15 days from the date of receiving the decision. However, during mediation and litigation, the normal operations of the seismic operation team shall be ensured.
石油地震勘探作业损害补偿
Compensation for Damage Caused by Petroleum Seismic Exploration Operations
石油地震勘探作业(以下简称地震作业)车辆沿测线通过农田，对粮食作物和其他经济作物造成损害的，作物受害量以当地县级人民政府统计部门前三年上报国家产量的年平均数、实际损害面积和实际损害程度计算；作物补偿价格按国家规定的价格和当地市场价格的加权平均值计算，其加权平均值参照定购合同等因素，由双方协商确定。作业车辆损害农田面积以实际碾压宽度和长度计算。
When vehicles of petroleum seismic exploration operations (hereinafter referred to as seismic operations) pass through farmland along survey lines and cause damage to food crops and other cash crops, the amount of crop damage shall be calculated based on the average annual yield reported by the statistical department of the local county-level people's government to the state over the previous three years, the actual damaged area, and the actual extent of damage. The compensation price for crops shall be calculated based on the weighted average of the state-set price and the local market price, with the weighted average determined through negotiation between the parties, taking into account factors such as fixed purchase contracts. The area of farmland damaged by operation vehicles shall be calculated based on the actual rolling width and length.
地震作业车辆沿测线通过造成的农田地面设施损害，根据实际损害程度，由双方协商，给予适当补偿。
Damage to farmland ground facilities caused by seismic operation vehicles passing along survey lines shall be appropriately compensated through negotiation between the parties based on the actual extent of damage.
地震作业对封冻期的青苗损害的补偿标准，按作业车辆实际碾压损害程度确定，一般不超过对该地非封冻期作物损害补偿标准的百分之三十，但个别地方青苗碾压严重的，经当事人双方认定，可酌情提高补偿标准。封冻期的具体期限由当地省级以上人民政府确定。
The compensation standard for damage to seedlings during the frozen period caused by seismic operations shall be determined based on the actual extent of damage caused by rolling of operation vehicles, generally not exceeding 30% of the compensation standard for damage to crops during the non-frozen period in the same area. However, if seedling damage is severe in certain locations, the compensation standard may be appropriately increased upon confirmation by both parties. The specific duration of the frozen period shall be determined by the provincial-level people's government or above.
地震作业对无封冻期的已耕待种地造成损害的，应按照作业车辆实际碾压面积，参照当地劳务费用和机耕费用的标准补偿复耕费。
If seismic operations cause damage to plowed land awaiting planting during the non-frozen period, compensation for replanting costs shall be paid based on the actual rolling area of the operation vehicles, with reference to the local labor costs and mechanized plowing costs.
地震作业对牧区人工种植的草场造成损害的，应按照草场实际损害面积和亩产量，及当地省级人民政府规定的牧草收购价格，予以补偿。
If seismic operations cause damage to artificially planted grasslands in pastoral areas, compensation shall be paid based on the actual damaged area and per-unit yield of the grassland, as well as the purchase price for forage grass stipulated by the local provincial-level people's government.
对已承包给个人或集体的天然草场造成损害的，应根据该天然草场的实际产草情况和损害程度，由当事人双方协商补偿办法。补偿费的标准，由当地省级人民政府确定。
If damage is caused to natural grasslands that have been contracted to individuals or collectives, the compensation method shall be negotiated between the parties based on the actual grass production and the extent of damage. The compensation fee standard shall be determined by the local provincial-level people's government.
地震作业对竹木造成损害的，应对实际损害株数逐株计算，进行补偿。竹木补偿标准由当地省级人民政府确定，被损竹木归原竹木所有者。
If seismic operations cause damage to bamboo and trees, compensation shall be calculated on a per-plant basis for the actual number of damaged plants. The compensation standard for bamboo and trees shall be determined by the local provincial-level people's government, and the damaged bamboo and trees shall belong to the original owner.
地震作业后的炮眼，应当由地震作业队负责回填。地震作业队不回填的，应按照当地省级人民政府规定的标准，支付炮眼回填劳务费。
Shot holes after seismic operations shall be backfilled by the seismic operation team. If the seismic operation team fails to backfill, it shall pay backfill labor fees according to the standards stipulated by the local provincial-level people's government.
地震作业地震波造成损害的补偿
Compensation for Damage Caused by Seismic Waves from Seismic Operations
地震作业队井中放炮，对其地震作业地震波(以下简称地震波)造成损害的补偿范围规定如下：
The scope of compensation for damage caused by seismic waves from borehole blasting by seismic operation teams (hereinafter referred to as seismic waves) is stipulated as follows:
(一)对土坯结构和砖、土坯混合结构的房屋、窑洞、厂房、正常生产的砖窑，炸药量在一至三公斤，地震波损害的补偿范围为距炮点半径四十米以内；炸药量在四至六公斤，地震波损害的补偿范围为距炮点半径五十米以内；炸药量在七至十公斤，地震波损害的补偿范围为距炮点半径七十米以内；炸药量在十一至十五公斤，地震波损害的补偿范围为距炮点半径八十米以内。
(1) For adobe structures and brick-adobe mixed structures such as houses, cave dwellings, factory buildings, and normally operating brick kilns, when the explosive charge is 1 to 3 kg, the compensation scope for seismic wave damage is within a radius of 40 meters from the shot point; when the explosive charge is 4 to 6 kg, the compensation scope is within a radius of 50 meters; when the explosive charge is 7 to 10 kg, the compensation scope is within a radius of 70 meters; when the explosive charge is 11 to 15 kg, the compensation scope is within a radius of 80 meters.
(二)对混凝土结构的厂房建筑、机井、一般桥梁和水闸的地震波损害的补偿范围，比照本条(一)项规定的范围缩小四分之一。
(2) For concrete structures such as factory buildings, machine wells, ordinary bridges, and sluice gates, the compensation scope for seismic wave damage shall be reduced by one quarter compared to the scope specified in item (1) of this Article.
在地震波损害的补偿范围内的地面设施，根据地震作业放炮后新造成的损害的程度，参考原造价和使用年限计算补偿费用，予以补偿。
For ground facilities within the compensation scope of seismic wave damage, compensation fees shall be calculated based on the extent of damage newly caused by seismic blasting, with reference to the original cost and service life.
对地震波损害补偿范围内的机井的损害补偿，由当事人双方共同核实损害程度，并参照当地县级人民政府有关部门提供的机井档案资料、造价、使用年限，计算补偿费用予以补偿。
For compensation for damage to machine wells within the compensation scope of seismic wave damage, both parties shall jointly verify the extent of damage and calculate compensation fees with reference to the machine well archive data, cost, and service life provided by the relevant department of the local county-level people's government.
在海滩和浅海区进行地震作业，应当采用非炸药震源；在陆地进行地震作业，应当尽量避开鱼塘或养殖场。
Seismic operations on beaches and in shallow sea areas shall use non-explosive sources; seismic operations on land shall avoid fish ponds or aquaculture farms as much as possible.
必须在鱼塘或养殖场内及其附近地区进行地震作业的，炮眼井底至鱼塘或养殖场水底的深度不得小于五米，炸药量不得大于十公斤。
If seismic operations must be carried out in or near fish ponds or aquaculture farms, the depth from the bottom of the shot hole to the bottom of the fish pond or aquaculture farm shall not be less than 5 meters, and the explosive charge shall not exceed 10 kg.
因地震作业对鱼类和其它水产类造成损害的，应当根据实际损害情况给予一次性补偿，具体补偿办法由国务院石油工业主管部门和农业主管部门另行规定。
If seismic operations cause damage to fish and other aquatic products, one-time compensation shall be paid based on the actual damage. Specific compensation methods shall be separately stipulated by the competent department of the petroleum industry under the State Council and the competent department of agriculture.
不予补偿的范围
Scope of Non-Compensation
地震作业队在没有种植农作物的荒岭、荒坡、荒地、荒漠，以及封冻期的无种植耕地、草原进行石油勘探地震作业的，不予补偿，但对作业区的耕地应当负责复垦，恢复利用。
No compensation shall be paid for seismic operations carried out on barren hills, slopes, wasteland, deserts, and non-planted farmland or grasslands during the frozen period. However, the operation team shall be responsible for reclaiming and restoring the farmland in the operation area.
地震作业队在国家和集体所有的闲置地，没有承包的沙滩、沙漠、河滩、湖滩、海滩、森林中的空地进行地震作业的，不予补偿。
No compensation shall be paid for seismic operations carried out on idle land owned by the state or collectives, or on un-contracted beaches, deserts, river beaches, lake beaches, sea beaches, or forest clearings.
地震作业队主管部门向地震作业区所在地人民政府提交作业计划后，任何单位和个人故意在作业线上抢种作物、苗木和突击设置地面设施的，其在地震作业后受到损害的，地震作业队不予补偿。
After the competent department of the seismic operation team submits the operation plan to the people's government of the operation area, if any unit or individual deliberately plants crops, seedlings, or hastily sets up ground facilities on the operation line, the seismic operation team shall not compensate for damage caused after seismic operations.
罚则
Penalty Provisions
地震作业队违反第六条规定，擅自在安全距离内放炮的，应当根据国家有关法律、法规由有关部门对地震作业队责任人员追究行政责任或民事责任；对情节严重构成犯罪的，依法追究其刑事责任。
If a seismic operation team violates the provisions of Article 6 and arbitrarily conducts blasting within the safety distance, the relevant departments shall, in accordance with relevant state laws and regulations, pursue administrative or civil liability against the responsible personnel of the seismic operation team; if the circumstances are serious enough to constitute a crime, criminal liability shall be pursued according to law.
有下列行为之一的单位和个人，视其情节轻重，由当地人民政府有关部门依法给予行政处罚，并责令其赔偿造成的损失；构成犯罪的，由司法部门依法追究刑事责任：
Units or individuals that commit any of the following acts shall, depending on the severity of the circumstances, be subject to administrative penalties by the relevant departments of the local people's government according to law, and shall be ordered to compensate for the losses caused; if a crime is constituted, criminal liability shall be pursued by the judicial department according to law:
(一)扣押、损坏、偷盗地震作业队的设备和器材的；
(1) Seizing, damaging, or stealing equipment and materials of the seismic operation team;
(二)采取挖路、放水、扣车、扣人、围攻及殴打地震作业人员、煽动群众起哄闹事、阻碍地震作业队正常施工作业的；
(2) Digging roads, releasing water, detaining vehicles, detaining persons, surrounding and assaulting seismic operation personnel, inciting crowds to cause disturbances, or obstructing the normal construction operations of the seismic operation team;
(三)采用欺骗的方法，利用损害补偿敲诈勒索的。
(3) Using deceptive methods to extort compensation through damage claims.
违反第四条规定，截留、回扣补偿费用的单位和个人，由监察部门责令其退回被截留、回扣的补偿费用，并可予以行政处罚。
Units or individuals that violate the provisions of Article 4 by intercepting or deducting compensation fees shall be ordered by the supervisory department to return the intercepted or deducted compensation fees and may be subject to administrative penalties.
附则
Supplementary Provisions
其它行业和部门因地震勘探作业所造成的损害，可参照本规定进行补偿。
Damage caused by seismic exploration operations in other industries and departments may be compensated with reference to these Provisions.
本规定由国务院石油工业主管部门负责解释。
These Provisions shall be interpreted by the competent department of the petroleum industry under the State Council.
本规定自发布之日起施行。
These Provisions shall come into effect as of the date of promulgation.
