为了加强军用土地管理，保护和合理利用军用土地，保障国防和军队建设需要，根据《中华人民共和国国防法》、《中华人民共和国土地管理法》等法律，制定本条例。
These Regulations are formulated in accordance with the National Defense Law of the People's Republic of China, the Land Administration Law of the People's Republic of China, and other laws, with a view to strengthening the management of military land, protecting and rationally utilizing military land, and ensuring the needs of national defense and military construction.
本条例所称军用土地，是指依法由军队单位使用管理的土地，但不包括军队单位租用、借用的土地。
For the purposes of these Regulations, 'military land' refers to land that is used and managed by military units in accordance with the law, excluding land leased or borrowed by military units.
军用土地是国防和军队建设的重要基础资源。国家保障国防和军队建设用地需要，为巩固国防、强军兴军提供有力支撑。
Military land is an important basic resource for national defense and military construction. The State guarantees the land needs for national defense and military construction, providing strong support for consolidating national defense and strengthening the military.
军用土地管理工作坚持中国共产党的领导，贯彻习近平强军思想，贯彻新时代军事战略方针，坚持军事需求牵引、军地统筹保障、优化资源配置、节约集约利用的原则。
The management of military land shall adhere to the leadership of the Communist Party of China, implement Xi Jinping's thinking on strengthening the military, implement the military strategic guidelines for the new era, and adhere to the principles of military demand orientation, military-civilian integrated support, optimal resource allocation, and economical and intensive use.
军用土地的使用权属于中央军事委员会，由中央军事委员会后勤保障部代表中央军事委员会行使。
The right to use military land belongs to the Central Military Commission, and the Logistics Support Department of the Central Military Commission exercises it on behalf of the Central Military Commission.
军队团级以上单位后勤保障部门按照规定职权，负责本单位军用土地使用管理的具体工作。
Logistics support departments of military units at or above the regiment level shall, in accordance with their prescribed functions and powers, be responsible for the specific work of military land use management within their units.
县级以上人民政府自然资源等主管部门依照法律法规和规定的职责负责土地管理工作。
The competent departments of natural resources of the people's governments at or above the county level shall be responsible for land management in accordance with laws, regulations, and prescribed duties.
中央军事委员会后勤保障部应当根据国土空间规划，按照国防和军队建设发展要求，加强对军用土地使用的统筹规划，引导军用土地资源优化配置，提高资源利用效益。
The Logistics Support Department of the Central Military Commission shall, based on the territorial space planning and in accordance with the development requirements of national defense and military construction, strengthen the overall planning of military land use, guide the optimal allocation of military land resources, and improve resource utilization efficiency.
军用土地应当依法办理不动产登记。
Military land shall undergo real estate registration in accordance with the law.
办理军用土地不动产登记，由军队团级以上单位向土地所在地县级以上地方人民政府不动产登记机构提出申请；国家对不动产登记另有规定的，从其规定。
For the real estate registration of military land, a military unit at or above the regiment level shall submit an application to the real estate registration agency of the local people's government at or above the county level where the land is located; if there are other provisions of the State on real estate registration, those provisions shall prevail.
军用土地的权利人登记为中央军事委员会后勤保障部，同时注明具体使用管理的军队单位代号，没有军队单位代号的注明军队单位名称。
The right holder of military land shall be registered as the Logistics Support Department of the Central Military Commission, and the specific military unit code that uses and manages the land shall be indicated; if there is no military unit code, the name of the military unit shall be indicated.
对于下列土地，县级以上人民政府应当按照有关规定确认其使用权属于军队，但是有相反证据证明的除外：
For the following land, the people's government at or above the county level shall, in accordance with relevant provisions, confirm that the right to use it belongs to the military, unless there is evidence to the contrary:
(一)军队依法依规填海、围湖和开垦复垦的土地；
(1) Land reclaimed from the sea, enclosed lakes, and reclaimed or rehabilitated by the military in accordance with laws and regulations;
(二)由军队接收、没有移交地方且仍由军队使用管理的农场、马场、林场、牧场、水产养殖场、训练场、靶场、旧机场等土地；
(2) Land such as farms, horse farms, forest farms, pastures, aquaculture farms, training grounds, shooting ranges, and old airports that have been received by the military, have not been transferred to local authorities, and are still used and managed by the military;
(三)1987年1月1日《中华人民共和国土地管理法》施行前由军队单位占有并一直使用管理至今的土地。
(3) Land that was occupied by military units before the implementation of the Land Administration Law of the People's Republic of China on January 1, 1987, and has been used and managed continuously ever since.
军队单位按照国家自然资源调查监测、地籍调查要求和军队建设发展需要，组织军用土地调查、统计。
Military units shall organize surveys and statistics of military land in accordance with the national natural resources survey and monitoring requirements, cadastral survey requirements, and the development needs of military construction.
军队建设使用土地，应当优先使用存量军用土地；确需新增建设用地的，应当符合国土空间规划、土地利用年度计划和用途管制等要求，尽可能使用未利用地，并依法办理建设项目用地相关手续。
When using land for military construction, priority shall be given to the use of existing military land; if new construction land is truly necessary, it shall comply with the requirements of territorial space planning, annual land use plans, and use control, and shall use unused land as much as possible, and shall go through the relevant procedures for construction project land in accordance with the law.
军队建设使用土地，应当不占或者少占耕地；确需占用耕地的，应当依法落实耕地占补平衡要求。
When using land for military construction, cultivated land shall not be occupied or shall be occupied as little as possible; if it is truly necessary to occupy cultivated land, the requirement for the balance of cultivated land occupation and compensation shall be implemented in accordance with the law.
县级以上人民政府组织编制国土空间规划和土地利用年度计划，应当充分考虑保障军队建设用地需要，并征求军队有关单位的意见。
When organizing the preparation of territorial space planning and annual land use plans, the people's government at or above the county level shall fully consider the need to guarantee land for military construction and shall solicit opinions from relevant military units.
国家健全军队建设项目用地需求通报和军地对接机制。
The State shall improve the mechanism for reporting land use needs for military construction projects and for military-civilian coordination.
中央军事委员会后勤保障部根据中央军事委员会批准的军队建设年度计划等决策部署，编制年度新增用地需求清单，会同国务院自然资源主管部门将年度新增用地需求清单通报相关省、自治区、直辖市人民政府。相关省、自治区、直辖市人民政府应当将年度新增用地需求清单转发相关市、县人民政府。相关人民政府应当依照土地管理法律、行政法规和国家有关规定，对军队建设项目用地应保尽保。
The Logistics Support Department of the Central Military Commission shall, based on the decisions and deployments such as the annual military construction plan approved by the Central Military Commission, prepare an annual list of new land use needs, and together with the competent department of natural resources of the State Council, notify the relevant provincial, autonomous region, and municipality people's governments of the annual list of new land use needs. The relevant provincial, autonomous region, and municipality people's governments shall forward the annual list of new land use needs to the relevant city and county people's governments. The relevant people's governments shall, in accordance with land administration laws, administrative regulations, and relevant State provisions, ensure the full supply of land for military construction projects.
军队建设项目用地按照国家有关规定享受税费优惠。
Land for military construction projects shall enjoy tax and fee preferences in accordance with relevant State provisions.
前条规定的军队建设项目新增建设用地的，由军队团级以上单位依照土地管理法律、行政法规和国家有关规定，向土地所在地市、县人民政府自然资源主管部门提出申请，经有批准权的人民政府批准后，由市、县人民政府依法及时、足量供应土地；依法属于划拨供地范围的，以划拨方式供应。涉及征收农民集体所有土地的，军队单位应当按照国家有关规定支付相关费用。
For new construction land for military construction projects as specified in the preceding article, a military unit at or above the regiment level shall, in accordance with land administration laws, administrative regulations, and relevant State provisions, submit an application to the competent department of natural resources of the city or county people's government where the land is located. After approval by the people's government with the authority to approve, the city or county people's government shall supply the land in a timely and sufficient manner in accordance with the law; if it falls within the scope of allocated land supply, it shall be supplied by allocation. If it involves the expropriation of land collectively owned by farmers, the military unit shall pay relevant fees in accordance with relevant State provisions.
军队重点建设项目用地确需调整国土空间规划的，应当依法报经批准。
If land for key military construction projects truly requires adjustment of the territorial space planning, it shall be submitted for approval in accordance with the law.
军队重点建设项目确需提前开工建设的，按照国家有关规定经国务院自然资源主管部门审核批准，可以先行用地；经批准先行用地的，军队单位应当依法及时办理建设用地相关手续。
If a key military construction project truly needs to start construction ahead of schedule, upon review and approval by the natural resources department of the State Council in accordance with relevant state regulations, land may be used in advance; after approval for advance land use, the military unit shall promptly go through the relevant procedures for construction land in accordance with the law.
军队重点建设项目清单由中央军事委员会后勤保障部根据中央军事委员会有关规定编制，按程序会同国务院有关部门联合下达。
The list of key military construction projects shall be compiled by the Logistics Support Department of the Central Military Commission in accordance with relevant regulations of the Central Military Commission, and jointly issued with the relevant departments of the State Council according to procedures.
军队建设项目用地实行标准控制制度。军队单位应当落实军队建设项目用地标准，科学测算建设项目用地需求，严格控制用地规模。
Military construction project land use shall be subject to a standard control system. Military units shall implement the land use standards for military construction projects, scientifically calculate the land demand for construction projects, and strictly control the scale of land use.
军队建设项目用地标准由中央军事委员会确定。
The land use standards for military construction projects shall be determined by the Central Military Commission.
在军用土地的上方建设架空设施或者在军用土地的下方建设地下管线、轨道交通设施等公共基础设施的，应当经军队团级以上单位按照中央军事委员会的相关规定报经批准；涉及军事设施的，依照军事设施保护法律、行政法规的规定执行。
If overhead facilities are constructed above military land or underground pipelines, rail transit facilities, and other public infrastructure are constructed below military land, approval shall be obtained from the military unit at or above the regiment level in accordance with relevant regulations of the Central Military Commission; if military facilities are involved, the provisions of laws and administrative regulations on the protection of military facilities shall apply.
县级以上人民政府因基础设施建设、开展公益事业等原因需要借用军用土地的，应当与军队团级以上单位签订协议，按照协议约定的用途和期限使用土地，并不得在借用的军用土地上修建永久性建筑物。协议应当按照中央军事委员会的有关规定报经批准。协议约定的期限一般不超过2年，期满后确需继续借用的，应当重新签订协议并报经批准。
If a people's government at or above the county level needs to borrow military land due to infrastructure construction, public welfare undertakings, or other reasons, it shall sign an agreement with the military unit at or above the regiment level, use the land in accordance with the purpose and term agreed in the agreement, and shall not construct permanent buildings on the borrowed military land. The agreement shall be approved in accordance with relevant regulations of the Central Military Commission. The term agreed in the agreement generally shall not exceed two years; if continued borrowing is truly needed after expiration, a new agreement shall be signed and approved.
县级以上地方人民政府因组织抢险救灾、疫情防控等紧急需要，可以在商请军队师级以上单位同意后临时借用军用土地，军队单位同步办理审批手续。
If a local people's government at or above the county level needs to temporarily borrow military land due to emergency needs such as organizing disaster relief, epidemic prevention and control, it may do so after consulting with the military unit at or above the division level, and the military unit shall simultaneously go through the approval procedures.
根据国防和军队建设以及经济社会发展需要，军队单位可以采取军队与地方土地使用权置换整合或者向地方转移军用土地的使用权等方式处置军用土地的使用权。
In accordance with the needs of national defense and military construction as well as economic and social development, military units may dispose of the use rights of military land by means such as swapping and integrating military and local land use rights or transferring the use rights of military land to local authorities.
处置军用土地的使用权，应当按照中央军事委员会的有关规定报经批准；未经批准的，处置行为无效。
Disposal of the use rights of military land shall be approved in accordance with relevant regulations of the Central Military Commission; without approval, the disposal act is invalid.
处置军用土地的使用权应当优先采取军队与地方土地使用权置换整合方式，将布局分散、利用率低、使用受限的军用土地置换整合为适应国防和军队建设发展需要的土地资源。
Disposal of the use rights of military land shall prioritize the method of swapping and integrating military and local land use rights, converting scattered, low-utilization, or restricted military land into land resources that meet the development needs of national defense and military construction.
军队与地方土地使用权置换整合可以跨县级以上行政区域组织实施，有关地方人民政府应当予以支持，具体办法由国务院自然资源主管部门、中央军事委员会后勤保障部制定。
The swapping and integration of military and local land use rights may be implemented across administrative divisions at or above the county level, and the relevant local people's governments shall provide support. Specific measures shall be formulated by the natural resources department of the State Council and the Logistics Support Department of the Central Military Commission.
有下列情形之一的，军用土地的使用权可以按照有关规定向地方转移：
Under any of the following circumstances, the use rights of military land may be transferred to local authorities in accordance with relevant regulations:
(一)地方为实施国土空间规划进行旧城区改建以及其他公共利益需要，确需使用军用土地；
(1) The local government needs to use military land for old city reconstruction in implementing territorial spatial planning or for other public interests;
(二)军用机场、港口、码头等军事设施报废、迁建或者改作民用，原设施占用的土地军队不再使用、保留；
(2) Military airports, ports, docks, and other military facilities are scrapped, relocated, or converted to civilian use, and the land occupied by the original facilities is no longer used or retained by the military;
(三)军用土地失去军事利用价值，不再需要使用、保留。
(3) Military land has lost its military use value and no longer needs to be used or retained.
军用土地的使用权向地方转移按照有关规定报经批准后，军队团级以上单位和县级以上地方人民政府应当自批准之日起2年内完成土地使用权交接，依法办理不动产登记手续。逾期未完成的，军队团级以上单位应当按照程序上报原审批机关。
After the transfer of the use rights of military land to local authorities is approved in accordance with relevant regulations, the military unit at or above the regiment level and the local people's government at or above the county level shall complete the handover of land use rights within two years from the date of approval and go through the procedures for real estate registration in accordance with the law. If the handover is not completed within the time limit, the military unit at or above the regiment level shall report to the original approving authority according to procedures.
军用土地的使用权转移登记或者依法注销后，县级以上地方人民政府自然资源等主管部门应当做好相应的土地管理工作。
After the transfer registration or lawful cancellation of the use rights of military land, the natural resources and other relevant departments of the local people's government at or above the county level shall carry out corresponding land management work.
军队单位处置军用土地的使用权，应当依法组织地价评估，评估价格作为置换土地或者获得补偿的依据。军用土地地价评估办法由国务院自然资源主管部门、中央军事委员会后勤保障部制定。
When disposing of the use rights of military land, military units shall organize land price appraisal in accordance with the law, and the appraised price shall serve as the basis for swapping land or obtaining compensation. The measures for appraising the land price of military land shall be formulated by the natural resources department of the State Council and the Logistics Support Department of the Central Military Commission.
禁止侵占、污染、破坏军用土地。
It is prohibited to encroach upon, pollute, or damage military land.
任何组织或者个人对侵占、污染、破坏军用土地的行为，有权检举、控告。
Any organization or individual has the right to report and accuse acts of encroaching upon, polluting, or damaging military land.
军队后勤保障部门和县级以上人民政府自然资源等主管部门建立军用土地管理信息通报机制，及时互相通报相关违法行为线索等信息。
The military logistics support departments and the natural resources and other relevant departments of the people's governments at or above the county level shall establish a mechanism for information sharing on military land management, promptly exchanging information on relevant illegal acts and clues.
对土地使用权有争议的，由当事人协商解决；协商不成的，由县级以上人民政府处理。当事人对有关人民政府的处理决定不服的，可以依法申请行政复议或者提起行政诉讼。
If there is a dispute over land use rights, the parties shall resolve it through consultation; if consultation fails, the matter shall be handled by the people's government at or above the county level. If a party is dissatisfied with the handling decision of the relevant people's government, it may apply for administrative reconsideration or file an administrative lawsuit in accordance with the law.
因军队战备训练、科研试验等专项军事活动确需借用国有土地或者农民集体所有土地，不改变土地用途的，经军队军级以上单位同意，可以由军队单位与有关地方人民政府自然资源主管部门或者农村集体经济组织、土地使用权人签订用地协议，按照约定的方式和期限使用土地并给予补偿；涉及改变土地用途的，应当依法办理相关手续。
If it is truly necessary to borrow state-owned land or land collectively owned by farmers for special military activities such as combat readiness training, scientific research, and testing, and the land use purpose is not changed, with the consent of the military unit at or above the army level, the military unit may sign a land use agreement with the relevant local people's government's natural resources department or the rural collective economic organization or land use right holder, use the land in the manner and for the term agreed, and provide compensation; if the land use purpose is changed, relevant procedures shall be gone through in accordance with the law.
违反本条例规定，侵占、污染、破坏军用土地的，由县级以上地方人民政府组织自然资源、生态环境、农业农村、林业草原等主管部门依法处罚。
If anyone violates these regulations by encroaching upon, polluting, or damaging military land, the local people's government at or above the county level shall organize the natural resources, ecological environment, agriculture and rural affairs, forestry and grassland, and other relevant departments to impose penalties in accordance with the law.
军队人员、国务院有关部门和地方各级人民政府及其有关部门的工作人员在军用土地管理工作中滥用职权、玩忽职守、徇私舞弊的，依法依规给予处分。
If military personnel, staff members of relevant departments of the State Council, or local people's governments at various levels and their relevant departments abuse their power, neglect their duties, or engage in malpractice for personal gain in military land administration, they shall be given sanctions in accordance with laws and regulations.
违反本条例规定，造成损失的，依法承担民事责任；构成违反治安管理行为的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
Whoever violates the provisions of these Regulations and causes losses shall bear civil liability in accordance with the law; if the act constitutes a violation of public security administration, public security administration penalties shall be imposed in accordance with the law; if the act constitutes a crime, criminal liability shall be pursued in accordance with the law.
本条例适用于中国人民武装警察部队。
These Regulations apply to the Chinese People's Armed Police Force.
军队划入有关单位运营的土地的管理，依照有关法律、行政法规、军事法规的规定以及国务院、中央军事委员会的有关规定执行。
The management of military land transferred to the operation of relevant entities shall be implemented in accordance with the provisions of relevant laws, administrative regulations, military regulations, and the relevant provisions of the State Council and the Central Military Commission.
开展重大基础设施建设使用军用土地的条件、办理程序、补偿标准等事项，由国务院自然资源主管部门、中央军事委员会后勤保障部规定。
The conditions, procedures, and compensation standards for the use of military land in the construction of major infrastructure projects shall be stipulated by the competent department of natural resources of the State Council and the Logistics Support Department of the Central Military Commission.
本条例自2025年11月1日起施行。
These Regulations shall come into force on November 1, 2025.
