(Promulgated by Decree No. 354 of the State Council of the People's Republic of China on May 27, 2002, and revised in accordance with the Decision of the State Council on Amending and Repealing Certain Administrative Regulations on March 1, 2017)
为了规范旅行社组织中国公民出国旅游活动，保障出国旅游者和出国旅游经营者的合法权益，制定本办法。
These Measures are formulated to regulate the organization of outbound tours by travel agencies for Chinese citizens and to protect the legitimate rights and interests of outbound tourists and outbound tour operators.
出国旅游的目的地国家，由国务院旅游行政部门会同国务院有关部门提出，报国务院批准后，由国务院旅游行政部门公布。
The destination countries for outbound tours shall be proposed by the tourism administrative department of the State Council in conjunction with relevant departments of the State Council, submitted to the State Council for approval, and then announced by the tourism administrative department of the State Council.
任何单位和个人不得组织中国公民到国务院旅游行政部门公布的出国旅游的目的地国家以外的国家旅游；组织中国公民到国务院旅游行政部门公布的出国旅游的目的地国家以外的国家进行涉及体育活动、文化活动等临时性专项旅游的，须经国务院旅游行政部门批准。
No unit or individual may organize Chinese citizens to travel to countries other than the destination countries announced by the tourism administrative department of the State Council; organizing Chinese citizens to travel to countries other than the announced destination countries for temporary special tours involving sports activities, cultural activities, etc., must be approved by the tourism administrative department of the State Council.
旅行社经营出国旅游业务，应当具备下列条件：
A travel agency that operates outbound tour business shall meet the following conditions:
(一)取得国际旅行社资格满1年；
(1) Having held the qualification of an international travel agency for at least one year;
(二)经营入境旅游业务有突出业绩；
(2) Having outstanding performance in operating inbound tour business;
(三)经营期间无重大违法行为和重大服务质量问题。
(3) Having no major illegal acts or major service quality issues during the period of operation.
申请经营出国旅游业务的旅行社，应当向省、自治区、直辖市旅游行政部门提出申请。省、自治区、直辖市旅游行政部门应当自受理申请之日起30个工作日内，依据本办法第三条规定的条件对申请审查完毕，经审查同意的，报国务院旅游行政部门批准；经审查不同意的，应当书面通知申请人并说明理由。
A travel agency applying to operate outbound tour business shall submit an application to the tourism administrative department of the province, autonomous region, or municipality directly under the Central Government. The tourism administrative department of the province, autonomous region, or municipality directly under the Central Government shall complete the review of the application within 30 working days from the date of acceptance based on the conditions specified in Article 3 of these Measures. If approved after review, it shall be reported to the tourism administrative department of the State Council for approval; if not approved after review, the applicant shall be notified in writing with reasons stated.
国务院旅游行政部门批准旅行社经营出国旅游业务，应当符合旅游业发展规划及合理布局的要求。
The tourism administrative department of the State Council shall approve travel agencies to operate outbound tour business in accordance with the requirements of the tourism development plan and rational layout.
未经国务院旅游行政部门批准取得出国旅游业务经营资格的，任何单位和个人不得擅自经营或者以商务、考察、培训等方式变相经营出国旅游业务。
Without approval from the tourism administrative department of the State Council to obtain the qualification for outbound tour business, no unit or individual may operate outbound tour business without authorization or in disguised form through business, investigation, training, etc.
国务院旅游行政部门应当将取得出国旅游业务经营资格的旅行社(以下简称组团社)名单予以公布，并通报国务院有关部门。
The tourism administrative department of the State Council shall publish the list of travel agencies that have obtained the qualification for outbound tour business (hereinafter referred to as group travel agencies) and notify the relevant departments of the State Council.
国务院旅游行政部门根据上年度全国入境旅游的业绩、出国旅游目的地的增加情况和出国旅游的发展趋势，在每年的2月底以前确定本年度组织出国旅游的人数安排总量，并下达省、自治区、直辖市旅游行政部门。
The tourism administrative department of the State Council shall, based on the performance of inbound tourism nationwide in the previous year, the increase in outbound tour destinations, and the development trend of outbound tours, determine the total number of outbound tourists to be organized for the current year before the end of February each year, and issue it to the tourism administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government.
省、自治区、直辖市旅游行政部门根据本行政区域内各组团社上年度经营入境旅游的业绩、经营能力、服务质量，按照公平、公正、公开的原则，在每年的3月底以前核定各组团社本年度组织出国旅游的人数安排。
The tourism administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government shall, based on the performance of inbound tourism operations, operational capacity, and service quality of each group travel agency in their administrative region in the previous year, and in accordance with the principles of fairness, justice, and openness, determine the number of outbound tourists to be organized by each group travel agency for the current year before the end of March each year.
国务院旅游行政部门应当对省、自治区、直辖市旅游行政部门核定组团社年度出国旅游人数安排及组团社组织公民出国旅游的情况进行监督。
The tourism administrative department of the State Council shall supervise the determination of the annual outbound tourist numbers for group travel agencies by the tourism administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government, as well as the organization of outbound tours by group travel agencies.
国务院旅游行政部门统一印制《中国公民出国旅游团队名单表》(以下简称《名单表》)，在下达本年度出国旅游人数安排时编号发放给省、自治区、直辖市旅游行政部门，由省、自治区、直辖市旅游行政部门核发给组团社。
The tourism administrative department of the State Council shall uniformly print the "List of Outbound Tour Groups of Chinese Citizens" (hereinafter referred to as the "List"), and when issuing the annual outbound tourist number arrangement, it shall be numbered and distributed to the tourism administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government, which shall then issue it to group travel agencies.
组团社应当按照核定的出国旅游人数安排组织出国旅游团队，填写《名单表》。旅游者及领队首次出境或者再次出境，均应当填写在《名单表》中，经审核后的《名单表》不得增添人员。
Group travel agencies shall organize outbound tour groups in accordance with the approved outbound tourist numbers and fill in the List. Both tourists and tour leaders, whether departing for the first time or again, shall be recorded in the List. Once verified, no additional persons may be added to the List.
《名单表》一式四联，分为：出境边防检查专用联、入境边防检查专用联、旅游行政部门审验专用联、旅行社自留专用联。
The List consists of four copies: the copy for exit border inspection, the copy for entry border inspection, the copy for verification and retention by the tourism administrative department, and the copy for retention by the travel agency.
组团社应当按照有关规定，在旅游团队出境、入境时及旅游团队入境后，将《名单表》分别交有关部门查验、留存。
Group travel agencies shall, in accordance with relevant regulations, submit the List to the relevant departments for inspection and retention at the time of departure and entry of the tour group, as well as after the tour group enters the country.
出国旅游兑换外汇，由旅游者个人按照国家有关规定办理。
The exchange of foreign currency for outbound tours shall be handled by individual tourists in accordance with relevant state regulations.
旅游者持有有效普通护照的，可以直接到组团社办理出国旅游手续；没有有效普通护照的，应当依照《中华人民共和国公民出境入境管理法》的有关规定办理护照后再办理出国旅游手续。
Tourists holding valid ordinary passports may directly go to a group travel agency to handle outbound tour procedures; those without a valid ordinary passport shall first apply for a passport in accordance with the relevant provisions of the Law of the People's Republic of China on the Administration of Exit and Entry of Citizens, and then handle outbound tour procedures.
组团社应当为旅游者办理前往国签证等出境手续。
Group travel agencies shall handle exit procedures such as visas for the destination country for tourists.
组团社应当为旅游团队安排专职领队。
Group travel agencies shall arrange a dedicated tour leader for the tour group.
领队在带团时，应当遵守本办法及国务院旅游行政部门的有关规定。
When leading a tour group, the tour leader shall comply with these Measures and the relevant regulations of the tourism administrative department of the State Council.
旅游团队应当从国家开放口岸整团出入境。
Tour groups shall exit and enter the country as a whole group through state-designated open ports.
旅游团队出入境时，应当接受边防检查站对护照、签证、《名单表》的查验。经国务院有关部门批准，旅游团队可以到旅游目的地国家按照该国有关规定办理签证或者免签证。
When entering or exiting the country, tour groups shall undergo inspection by border inspection stations of their passports, visas, and the Name List. With approval from relevant State Council departments, tour groups may apply for visas or be exempted from visas in the destination country in accordance with that country's regulations.
旅游团队出境前已确定分团入境的，组团社应当事先向出入境边防检查总站或者省级公安边防部门备案。
If a tour group has confirmed before departure that it will enter the country in separate groups, the organizing travel agency shall file a record with the general border inspection station or provincial public security border control department in advance.
旅游团队出境后因不可抗力或者其他特殊原因确需分团入境的，领队应当及时通知组团社，组团社应当立即向有关出入境边防检查总站或者省级公安边防部门备案。
If a tour group, after departure, needs to enter the country in separate groups due to force majeure or other special reasons, the tour leader shall promptly notify the organizing travel agency, and the organizing travel agency shall immediately file a record with the relevant general border inspection station or provincial public security border control department.
组团社应当维护旅游者的合法权益。
The organizing travel agency shall protect the legitimate rights and interests of tourists.
组团社向旅游者提供的出国旅游服务信息必须真实可靠，不得作虚假宣传，报价不得低于成本。
The travel service information provided by the organizing travel agency to tourists must be true and reliable, false advertising is prohibited, and the quoted price shall not be below cost.
组团社经营出国旅游业务，应当与旅游者订立书面旅游合同。
When operating outbound tourism business, the organizing travel agency shall enter into a written tourism contract with tourists.
旅游合同应当包括旅游起止时间、行程路线、价格、食宿、交通以及违约责任等内容。旅游合同由组团社和旅游者各持一份。
The tourism contract shall include the start and end times of the tour, itinerary, price, accommodation, transportation, and liability for breach of contract. The tourism contract shall be held by the organizing travel agency and the tourist respectively.
组团社应当按照旅游合同约定的条件，为旅游者提供服务。
The organizing travel agency shall provide services to tourists in accordance with the conditions agreed in the tourism contract.
组团社应当保证所提供的服务符合保障旅游者人身、财产安全的要求；对可能危及旅游者人身安全的情况，应当向旅游者作出真实说明和明确警示，并采取有效措施，防止危害的发生。
The organizing travel agency shall ensure that the services provided meet the requirements for protecting the personal and property safety of tourists; for situations that may endanger the personal safety of tourists, it shall provide truthful explanations and clear warnings to tourists, and take effective measures to prevent the occurrence of harm.
组团社组织旅游者出国旅游，应当选择在目的地国家依法设立并具有良好信誉的旅行社(以下简称境外接待社)，并与之订立书面合同后，方可委托其承担接待工作。
When organizing tourists for outbound tourism, the organizing travel agency shall select a travel agency established lawfully in the destination country with good reputation (hereinafter referred to as the overseas receiving travel agency), and may entrust it with reception work only after entering into a written contract with it.
组团社及其旅游团队领队应当要求境外接待社按照约定的团队活动计划安排旅游活动，并要求其不得组织旅游者参与涉及色情、赌博、毒品内容的活动或者危险性活动，不得擅自改变行程、减少旅游项目，不得强迫或者变相强迫旅游者参加额外付费项目。
The organizing travel agency and its tour leader shall require the overseas receiving travel agency to arrange tourism activities according to the agreed team activity plan, and shall require it not to organize tourists to participate in activities involving pornography, gambling, drugs, or dangerous activities, not to change the itinerary without authorization, not to reduce tourism projects, and not to force or covertly force tourists to participate in additional paid items.
境外接待社违反组团社及其旅游团队领队根据前款规定提出的要求时，组团社及其旅游团队领队应当予以制止。
When the overseas receiving travel agency violates the requirements raised by the organizing travel agency and its tour leader according to the preceding paragraph, the organizing travel agency and its tour leader shall stop it.
旅游团队领队应当向旅游者介绍旅游目的地国家的相关法律、风俗习惯以及其他有关注意事项，并尊重旅游者的人格尊严、宗教信仰、民族风俗和生活习惯。
The tour leader shall introduce to tourists the relevant laws, customs, and other related precautions of the destination country, and respect the personal dignity, religious beliefs, ethnic customs, and living habits of tourists.
旅游团队领队在带领旅游者旅行、游览过程中，应当就可能危及旅游者人身安全的情况，向旅游者作出真实说明和明确警示，并按照组团社的要求采取有效措施，防止危害的发生。
During the process of leading tourists on trips and tours, the tour leader shall, regarding situations that may endanger the personal safety of tourists, provide truthful explanations and clear warnings to tourists, and take effective measures in accordance with the requirements of the organizing travel agency to prevent the occurrence of harm.
旅游团队在境外遇到特殊困难和安全问题时，领队应当及时向组团社和中国驻所在国家使领馆报告；组团社应当及时向旅游行政部门和公安机关报告。
When a tour group encounters special difficulties or safety issues abroad, the tour leader shall promptly report to the organizing travel agency and the Chinese embassy or consulate in the country where it is located; the organizing travel agency shall promptly report to the tourism administrative department and the public security organ.
旅游团队领队不得与境外接待社、导游及为旅游者提供商品或者服务的其他经营者串通欺骗、胁迫旅游者消费，不得向境外接待社、导游及其他为旅游者提供商品或者服务的经营者索要回扣、提成或者收受其财物。
The tour leader shall not collude with the overseas receiving travel agency, tour guides, or other operators providing goods or services to tourists to deceive or coerce tourists into consumption, nor shall they demand kickbacks, commissions, or accept property from the overseas receiving travel agency, tour guides, or other operators providing goods or services to tourists.
旅游者应当遵守旅游目的地国家的法律，尊重当地的风俗习惯，并服从旅游团队领队的统一管理。
Tourists shall abide by the laws of the destination country, respect local customs, and obey the unified management of the tour leader.
严禁旅游者在境外滞留不归。
Tourists are strictly prohibited from overstaying abroad.
旅游者在境外滞留不归的，旅游团队领队应当及时向组团社和中国驻所在国家使领馆报告，组团社应当及时向公安机关和旅游行政部门报告。有关部门处理有关事项时，组团社有义务予以协助。
If a tourist overstays abroad, the tour leader shall promptly report to the organizing travel agency and the Chinese embassy or consulate in the country where it is located, and the organizing travel agency shall promptly report to the public security organ and the tourism administrative department. When relevant departments handle related matters, the organizing travel agency has the obligation to assist.
旅游者对组团社或者旅游团队领队违反本办法规定的行为，有权向旅游行政部门投诉。
Tourists have the right to file complaints with the tourism administrative department against the organizing travel agency or tour leader for violations of these Measures.
因组团社或者其委托的境外接待社违约，使旅游者合法权益受到损害的，组团社应当依法对旅游者承担赔偿责任。
If the legitimate rights and interests of tourists are harmed due to breach of contract by the organizing travel agency or its entrusted overseas receiving travel agency, the organizing travel agency shall bear compensation liability to the tourists in accordance with the law.
组团社有下列情形之一的，旅游行政部门可以暂停其经营出国旅游业务；情节严重的，取消其出国旅游业务经营资格：
If an organizing travel agency falls under any of the following circumstances, the tourism administrative department may suspend its outbound tourism business; if the circumstances are serious, it shall revoke its qualification for outbound tourism business:
(一)入境旅游业绩下降的；
(1) The performance of inbound tourism has declined;
(二)因自身原因，在1年内未能正常开展出国旅游业务的；
(2) Due to its own reasons, it has failed to normally carry out outbound tourism business within one year;
(三)因出国旅游服务质量问题被投诉并经查实的；
(3) Complaints have been filed due to the quality of outbound tourism services and have been verified.
(四)有逃汇、非法套汇行为的；
(4) Engaging in foreign exchange evasion or illegal arbitrage;
(五)以旅游名义弄虚作假，骗取护照、签证等出入境证件或者送他人出境的；
(5) Using tourism as a pretext to fraudulently obtain passports, visas, or other entry-exit documents, or to facilitate the exit of others;
(六)国务院旅游行政部门认定的影响中国公民出国旅游秩序的其他行为。
(6) Other acts determined by the tourism administrative department of the State Council to disrupt the order of outbound tourism by Chinese citizens.
任何单位和个人违反本办法第四条的规定，未经批准擅自经营或者以商务、考察、培训等方式变相经营出国旅游业务的，由旅游行政部门责令停止非法经营，没收违法所得，并处违法所得2倍以上5倍以下的罚款。
Any unit or individual that, in violation of Article 4 of these Measures, engages in outbound tourism business without approval or in disguised forms such as business trips, inspections, or training, shall be ordered by the tourism administrative department to cease illegal operations, confiscate illegal gains, and be fined not less than 2 times but not more than 5 times the illegal gains.
组团社违反本办法第十条的规定，不为旅游团队安排专职领队的，由旅游行政部门责令改正，并处5000元以上2万元以下的罚款，可以暂停其出国旅游业务经营资格；多次不安排专职领队的，并取消其出国旅游业务经营资格。
If a group organizer, in violation of Article 10 of these Measures, fails to arrange a full-time tour leader for a tour group, the tourism administrative department shall order correction and impose a fine of not less than 5,000 yuan but not more than 20,000 yuan, and may suspend its qualification to operate outbound tourism business; if it repeatedly fails to arrange a full-time tour leader, its qualification to operate outbound tourism business shall be revoked.
组团社违反本办法第十二条的规定，向旅游者提供虚假服务信息或者低于成本报价的，由工商行政管理部门依照《中华人民共和国消费者权益保护法》、《中华人民共和国反不正当竞争法》的有关规定给予处罚。
If a group organizer, in violation of Article 12 of these Measures, provides false service information to tourists or offers prices below cost, the administrative department for industry and commerce shall impose penalties in accordance with the relevant provisions of the Law of the People's Republic of China on the Protection of Consumer Rights and Interests and the Law of the People's Republic of China Against Unfair Competition.
组团社或者旅游团队领队违反本办法第十四条第二款、第十八条的规定，对可能危及人身安全的情况未向旅游者作出真实说明和明确警示，或者未采取防止危害发生的措施的，由旅游行政部门责令改正，给予警告；情节严重的，对组团社暂停其出国旅游业务经营资格，并处5000元以上2万元以下的罚款，对旅游团队领队可以暂扣直至吊销其导游证；造成人身伤亡事故的，依法追究刑事责任，并承担赔偿责任。
If a group organizer or tour leader, in violation of Article 14, paragraph 2, or Article 18 of these Measures, fails to provide truthful explanations and clear warnings about situations that may endanger personal safety, or fails to take measures to prevent harm, the tourism administrative department shall order correction and give a warning; if the circumstances are serious, the group organizer's qualification to operate outbound tourism business shall be suspended, and a fine of not less than 5,000 yuan but not more than 20,000 yuan shall be imposed; the tour leader's tour guide certificate may be temporarily seized or even revoked; if personal injury or death occurs, criminal liability shall be pursued according to law, and compensation liability shall be borne.
组团社或者旅游团队领队违反本办法第十六条的规定，未要求境外接待社不得组织旅游者参与涉及色情、赌博、毒品内容的活动或者危险性活动，未要求其不得擅自改变行程、减少旅游项目、强迫或者变相强迫旅游者参加额外付费项目，或者在境外接待社违反前述要求时未制止的，由旅游行政部门对组团社处组织该旅游团队所收取费用2倍以上5倍以下的罚款，并暂停其出国旅游业务经营资格，对旅游团队领队暂扣其导游证；造成恶劣影响的，对组团社取消其出国旅游业务经营资格，对旅游团队领队吊销其导游证。
If a group organizer or tour leader, in violation of Article 16 of these Measures, fails to require the overseas receiving agency not to organize tourists to participate in activities involving pornography, gambling, or drugs, or dangerous activities, fails to require it not to change the itinerary without authorization, reduce tourism projects, or force or covertly force tourists to participate in additional paid items, or fails to stop the overseas receiving agency when it violates the above requirements, the tourism administrative department shall impose a fine of not less than 2 times but not more than 5 times the fees collected for organizing the tour group on the group organizer, and suspend its qualification to operate outbound tourism business; the tour leader's tour guide certificate shall be temporarily seized; if the impact is severe, the group organizer's qualification to operate outbound tourism business shall be revoked, and the tour leader's tour guide certificate shall be revoked.
旅游团队领队违反本办法第二十条的规定，与境外接待社、导游及为旅游者提供商品或者服务的其他经营者串通欺骗、胁迫旅游者消费或者向境外接待社、导游和其他为旅游者提供商品或者服务的经营者索要回扣、提成或者收受其财物的，由旅游行政部门责令改正，没收索要的回扣、提成或者收受的财物，并处索要的回扣、提成或者收受的财物价值2倍以上5倍以下的罚款；情节严重的，并吊销其导游证。
If a tour leader, in violation of Article 20 of these Measures, colludes with overseas receiving agencies, tour guides, or other operators providing goods or services to tourists to deceive or coerce tourists into consumption, or solicits kickbacks, commissions, or accepts property from overseas receiving agencies, tour guides, or other operators providing goods or services to tourists, the tourism administrative department shall order correction, confiscate the solicited kickbacks, commissions, or accepted property, and impose a fine of not less than 2 times but not more than 5 times the value of the solicited kickbacks, commissions, or accepted property; if the circumstances are serious, the tour guide certificate shall be revoked.
违反本办法第二十二条的规定，旅游者在境外滞留不归，旅游团队领队不及时向组团社和中国驻所在国家使领馆报告，或者组团社不及时向有关部门报告的，由旅游行政部门给予警告，对旅游团队领队可以暂扣其导游证，对组团社可以暂停其出国旅游业务经营资格。
If, in violation of Article 22 of these Measures, a tourist overstays abroad and the tour leader fails to promptly report to the group organizer and the Chinese embassy or consulate in the country where the tourist is staying, or the group organizer fails to promptly report to the relevant authorities, the tourism administrative department shall give a warning, may temporarily seize the tour leader's tour guide certificate, and may suspend the group organizer's qualification to operate outbound tourism business.
旅游者因滞留不归被遣返回国的，由公安机关吊销其护照。
If a tourist is repatriated due to overstaying, the public security organ shall revoke their passport.
本办法自2002年7月1日起施行。国务院1997年3月17日批准，国家旅游局、公安部1997年7月1日发布的《中国公民自费出国旅游管理暂行办法》同时废止。
These Measures shall come into effect as of July 1, 2002. The Interim Measures for the Administration of Self-Financed Outbound Tourism by Chinese Citizens, approved by the State Council on March 17, 1997, and promulgated by the National Tourism Administration and the Ministry of Public Security on July 1, 1997, shall be simultaneously abolished.
