Interim Regulations on Public Security Committees

治安保卫委员会暂行组织条例

These regulations establish public security committees as mass-based organizations to assist the government in preventing espionage, theft, fire, and counterrevolutionary activities, and to maintain public order.

In order to mobilize the masses to assist the people's government in preventing espionage, espionage, theft, and fire, and to eliminate counterrevolutionary activities, so as to protect national and public security, it is hereby stipulated that public security committees shall be universally established in all cities after the launch of the campaign to suppress counterrevolutionaries and in rural areas after the completion of land reform.

Public security committees shall be established, in cities, generally on the basis of government organs, factories, enterprises, schools, and neighborhoods, and in rural areas, on the basis of administrative villages. The number of committee members shall be determined according to the size and complexity of each unit, ranging from three to eleven persons. Each committee shall have one director and may have one to two deputy directors.

各地于治安保卫委员会建立后,视情况需要,经市、县公安局批准,得建立治安保卫小组,由群众推选积极分子三人至五人组成之;内设组长一人,在治安保卫委员会领导下进行工作。

(一)凡人民中历史清楚、作风正派、善于联系群众、热心治安保卫工作者,均得当选为委员。

(1) Any person among the people who has a clear history, is upright, good at maintaining ties with the masses, and is enthusiastic about public security work may be elected as a member.

(二)治安保卫委员会委员之选举,事前应作充分准备,由群众提出候选人名单,经过介绍、审查、评议、酝酿成熟后再行选举,每半年改选一次,连选得连任。但在任期内如大多数群众认为必要改选时,得改选之。

The masses shall propose a list of candidates, which shall be introduced, reviewed, discussed, and matured before the election. Elections shall be held every six months, and members may be re-elected. However, if during the term of office the majority of the masses consider a re-election necessary, a re-election may be held.

(一)对现行的反革命分子与通缉在逃的罪犯,有捕送政府、公安机关之责;但无审讯、关押、处理之权。

(1) They have the responsibility to arrest and deliver to the government or public security organs any active counterrevolutionaries and criminals who are wanted and at large; but they have no power to interrogate, detain, or dispose of them.

(3) With regard to public order and control work, they have the responsibility to educate the masses to maintain revolutionary order, supervise controlled persons to engage in productive labor, prevent them from speaking or acting recklessly, and promptly report their behavior to the public security organs; but they have no power to detain, punish, or expel them.

(2) The Public Security Defense Committee in urban streets shall be under the leadership of the public security police station; where there is a residents' committee, it shall be under the dual leadership of the police station and the residents' committee. In suburban areas without a police station, it shall be under the leadership of the public security sub-bureau or the district public security assistant.

(一)应使每一治安保卫委员会,定期向当地群众报告工作,征求群众的意见,接受群众的批评。

(1) Each Public Security Defense Committee shall regularly report its work to the local residents, solicit opinions, and accept criticism.

(二)对工作积极有显著成绩者,及时给以表扬、奖励,对脱离群众违犯纪律者,及时给以批评、惩处。奖励与惩处均须经当地群众讨论议定及领导机关批准后执行。

省、市公安厅、局可根据本条例精神,拟定具体执行办法,并报大行政区、中央公安部备案。

Provincial and municipal public security departments (bureaus) may formulate specific implementation measures based on the spirit of these Regulations and shall report them to the greater administrative region and the Central Ministry of Public Security for record.
