总则
General Provisions
为了健全科学、民主、依法决策机制，规范重大行政决策程序，提高决策质量和效率，明确决策责任，根据宪法、地方各级人民代表大会和地方各级人民政府组织法等规定，制定本条例。
These Regulations are formulated in accordance with the Constitution, the Organic Law of the Local People's Congresses and Local People's Governments, and other relevant provisions, for the purposes of improving the scientific, democratic, and law-based decision-making mechanism, standardizing the procedures for major administrative decisions, enhancing the quality and efficiency of decisions, and clarifying decision-making responsibilities.
县级以上地方人民政府(以下称决策机关)重大行政决策的作出和调整程序，适用本条例。
These Regulations apply to the making and adjustment procedures of major administrative decisions by local people's governments at or above the county level (hereinafter referred to as decision-making organs).
本条例所称重大行政决策事项(以下简称决策事项)包括：
The term 'major administrative decision-making matters' (hereinafter referred to as decision-making matters) as used in these Regulations includes:
(一)制定有关公共服务、市场监管、社会管理、环境保护等方面的重大公共政策和措施；
(1) Formulating major public policies and measures concerning public services, market regulation, social management, environmental protection, and other aspects;
(二)制定经济和社会发展等方面的重要规划；
(2) Formulating important plans for economic and social development and other aspects;
(三)制定开发利用、保护重要自然资源和文化资源的重大公共政策和措施；
(3) Formulating major public policies and measures for the development, utilization, and protection of important natural and cultural resources;
(四)决定在本行政区域实施的重大公共建设项目；
(4) Deciding on major public construction projects to be implemented within the administrative region;
(五)决定对经济社会发展有重大影响、涉及重大公共利益或者社会公众切身利益的其他重大事项。
(5) Deciding on other major matters that have a significant impact on economic and social development, involve major public interests, or directly affect the vital interests of the public.
法律、行政法规对本条第一款规定事项的决策程序另有规定的，依照其规定。财政政策、货币政策等宏观调控决策，政府立法决策以及突发事件应急处置决策不适用本条例。
Where laws or administrative regulations provide otherwise for the decision-making procedures of matters specified in paragraph 1 of this Article, those provisions shall prevail. Fiscal policy, monetary policy and other macro-control decisions, government legislative decisions, and emergency response decisions are not subject to these Regulations.
决策机关可以根据本条第一款的规定，结合职责权限和本地实际，确定决策事项目录、标准，经同级党委同意后向社会公布，并根据实际情况调整。
The decision-making organ may, in accordance with the provisions of paragraph 1 of this Article and in light of its functions, powers, and local realities, determine the catalogue and standards of decision-making matters, publish them to the public after obtaining the consent of the Party committee at the same level, and adjust them according to actual circumstances.
重大行政决策必须坚持和加强党的全面领导，全面贯彻党的路线方针政策和决策部署，发挥党的领导核心作用，把党的领导贯彻到重大行政决策全过程。
Major administrative decisions must adhere to and strengthen the overall leadership of the Party, fully implement the Party's line, principles, policies, and decisions, give play to the core leadership role of the Party, and carry out the Party's leadership throughout the entire process of major administrative decisions.
作出重大行政决策应当遵循科学决策原则，贯彻创新、协调、绿色、开放、共享的发展理念，坚持从实际出发，运用科学技术和方法，尊重客观规律，适应经济社会发展和全面深化改革要求。
When making major administrative decisions, the principle of scientific decision-making shall be followed, implementing the development concepts of innovation, coordination, green, openness, and sharing, proceeding from reality, using scientific techniques and methods, respecting objective laws, and adapting to the requirements of economic and social development and comprehensive deepening of reforms.
作出重大行政决策应当遵循民主决策原则，充分听取各方面意见，保障人民群众通过多种途径和形式参与决策。
When making major administrative decisions, the principle of democratic decision-making shall be followed, fully listening to opinions from all sides, and ensuring that the people participate in decision-making through various channels and forms.
作出重大行政决策应当遵循依法决策原则，严格遵守法定权限，依法履行法定程序，保证决策内容符合法律、法规和规章等规定。
When making major administrative decisions, the principle of lawful decision-making shall be followed, strictly adhering to statutory authority, lawfully performing statutory procedures, and ensuring that the content of decisions complies with laws, regulations, and rules.
重大行政决策依法接受本级人民代表大会及其常务委员会的监督，根据法律、法规规定属于本级人民代表大会及其常务委员会讨论决定的重大事项范围或者应当在出台前向本级人民代表大会常务委员会报告的，按照有关规定办理。
Major administrative decisions shall, in accordance with the law, be subject to the supervision of the People's Congress and its Standing Committee at the same level. Matters that fall within the scope of major issues to be discussed and decided by the People's Congress and its Standing Committee at the same level according to laws and regulations, or that should be reported to the Standing Committee of the People's Congress at the same level before issuance, shall be handled in accordance with relevant provisions.
上级行政机关应当加强对下级行政机关重大行政决策的监督。审计机关按照规定对重大行政决策进行监督。
Higher-level administrative organs shall strengthen supervision over major administrative decisions of lower-level administrative organs. Audit organs shall supervise major administrative decisions in accordance with regulations.
重大行政决策情况应当作为考核评价决策机关及其领导人员的重要内容。
The situation of major administrative decisions shall serve as an important part of the assessment and evaluation of decision-making organs and their leading personnel.
决策草案的形成
Formation of the Decision Draft
第一节 决策启动
Section 1 Decision Initiation
对各方面提出的决策事项建议，按照下列规定进行研究论证后，报请决策机关决定是否启动决策程序：
Suggestions on decision-making matters from various parties shall, after research and demonstration in accordance with the following provisions, be submitted to the decision-making authority to decide whether to initiate the decision-making procedure:
(一)决策机关领导人员提出决策事项建议的，交有关单位研究论证；
(1) Where a leader of the decision-making authority proposes a suggestion on a decision-making matter, it shall be referred to the relevant unit for research and demonstration;
(二)决策机关所属部门或者下一级人民政府提出决策事项建议的，应当论证拟解决的主要问题、建议理由和依据、解决问题的初步方案及其必要性、可行性等；
(2) Where a department under the decision-making authority or a people's government at the next lower level proposes a suggestion on a decision-making matter, it shall demonstrate the main issues to be resolved, the reasons and basis for the suggestion, the preliminary plan for solving the problem, and its necessity and feasibility;
(三)人大代表、政协委员等通过建议、提案等方式提出决策事项建议，以及公民、法人或者其他组织提出书面决策事项建议的，交有关单位研究论证。
(3) Where a deputy to the People's Congress or a member of the Political Consultative Conference proposes a suggestion on a decision-making matter through suggestions or proposals, or where a citizen, legal person, or other organization submits a written suggestion on a decision-making matter, it shall be referred to the relevant unit for research and demonstration.
决策机关决定启动决策程序的，应当明确决策事项的承办单位(以下简称决策承办单位)，由决策承办单位负责重大行政决策草案的拟订等工作。决策事项需要两个以上单位承办的，应当明确牵头的决策承办单位。
Where the decision-making authority decides to initiate the decision-making procedure, it shall specify the unit responsible for undertaking the decision-making matter (hereinafter referred to as the decision undertaking unit), and the decision undertaking unit shall be responsible for drafting the draft major administrative decision. Where the decision-making matter requires two or more units to undertake, the leading decision undertaking unit shall be specified.
决策承办单位应当在广泛深入开展调查研究、全面准确掌握有关信息、充分协商协调的基础上，拟订决策草案。
The decision undertaking unit shall draft the decision draft on the basis of extensive and in-depth investigation and research, comprehensive and accurate mastery of relevant information, and full consultation and coordination.
决策承办单位应当全面梳理与决策事项有关的法律、法规、规章和政策，使决策草案合法合规、与有关政策相衔接。
The decision undertaking unit shall comprehensively review the laws, regulations, rules, and policies related to the decision-making matter to ensure that the decision draft is lawful and compliant and aligns with relevant policies.
决策承办单位根据需要对决策事项涉及的人财物投入、资源消耗、环境影响等成本和经济、社会、环境效益进行分析预测。
The decision undertaking unit shall, as needed, conduct analysis and forecasting of the costs such as human, financial, and material resources input, resource consumption, and environmental impact, as well as the economic, social, and environmental benefits involved in the decision-making matter.
有关方面对决策事项存在较大分歧的，决策承办单位可以提出两个以上方案。
Where there are significant disagreements among relevant parties on the decision-making matter, the decision undertaking unit may propose two or more schemes.
决策事项涉及决策机关所属部门、下一级人民政府等单位的职责，或者与其关系紧密的，决策承办单位应当与其充分协商；不能取得一致意见的，应当向决策机关说明争议的主要问题，有关单位的意见，决策承办单位的意见、理由和依据。
If a decision matter involves the responsibilities of departments under the decision-making body or people's governments at the next lower level, or is closely related to them, the decision undertaking unit shall fully consult with them; if consensus cannot be reached, it shall explain to the decision-making body the main issues in dispute, the opinions of the relevant units, and the opinions, reasons, and basis of the decision undertaking unit.
第二节 公众参与
Section 2 Public Participation
决策承办单位应当采取便于社会公众参与的方式充分听取意见，依法不予公开的决策事项除外。
The decision undertaking unit shall adopt methods that facilitate public participation to fully solicit opinions, except for decision matters that are not disclosed according to law.
听取意见可以采取座谈会、听证会、实地走访、书面征求意见、向社会公开征求意见、问卷调查、民意调查等多种方式。
Opinion solicitation may be conducted through various methods such as symposiums, hearings, field visits, written requests for comments, public solicitation of comments, questionnaires, and public opinion surveys.
决策事项涉及特定群体利益的，决策承办单位应当与相关人民团体、社会组织以及群众代表进行沟通协商，充分听取相关群体的意见建议。
Where a decision matter involves the interests of a specific group, the decision-making undertaking unit shall communicate and consult with relevant people's organizations, social organizations, and representatives of the masses, and fully solicit opinions and suggestions from the relevant groups.
决策事项向社会公开征求意见的，决策承办单位应当通过政府网站、政务新媒体以及报刊、广播、电视等便于社会公众知晓的途径，公布决策草案及其说明等材料，明确提出意见的方式和期限。公开征求意见的期限一般不少于30日；因情况紧急等原因需要缩短期限的，公开征求意见时应当予以说明。
When soliciting public opinions on a decision matter, the decision-making undertaking unit shall publish the decision draft and its explanatory materials through government websites, government new media, newspapers, radio, television, and other channels that are convenient for the public to know, and clearly state the methods and time limit for submitting opinions. The time limit for public consultation shall generally be no less than 30 days; if the time limit needs to be shortened due to urgent circumstances or other reasons, an explanation shall be given when soliciting opinions.
对社会公众普遍关心或者专业性、技术性较强的问题，决策承办单位可以通过专家访谈等方式进行解释说明。
For issues of general public concern or issues of a professional or technical nature, the decision-making undertaking unit may provide explanations through expert interviews or other means.
决策事项直接涉及公民、法人、其他组织切身利益或者存在较大分歧的，可以召开听证会。法律、法规、规章对召开听证会另有规定的，依照其规定。
If a decision matter directly involves the vital interests of citizens, legal persons, or other organizations, or if there are significant disagreements, a hearing may be held. Where laws, regulations, or rules have other provisions on holding hearings, those provisions shall prevail.
决策承办单位或者组织听证会的其他单位应当提前公布决策草案及其说明等材料，明确听证时间、地点等信息。
The decision-making undertaking unit or other unit organizing the hearing shall publish the decision draft and its explanatory materials in advance, and specify the hearing time, location, and other information.
需要遴选听证参加人的，决策承办单位或者组织听证会的其他单位应当提前公布听证参加人遴选办法，公平公开组织遴选，保证相关各方都有代表参加听证会。听证参加人名单应当提前向社会公布。听证会材料应当于召开听证会7日前送达听证参加人。
If it is necessary to select hearing participants, the decision-making undertaking unit or other unit organizing the hearing shall publish the selection method for hearing participants in advance, organize the selection fairly and openly, and ensure that all relevant parties have representatives to participate in the hearing. The list of hearing participants shall be published to the public in advance. Hearing materials shall be delivered to the hearing participants 7 days before the hearing.
听证会应当按照下列程序公开举行：
A hearing shall be held publicly in accordance with the following procedures:
(一)决策承办单位介绍决策草案、依据和有关情况；
(1) The decision-making undertaking unit shall introduce the decision draft, basis, and relevant circumstances;
(二)听证参加人陈述意见，进行询问、质证和辩论，必要时可以由决策承办单位或者有关专家进行解释说明；
(2) Hearing participants shall state opinions, ask questions, cross-examine, and debate; when necessary, the decision-making undertaking unit or relevant experts may provide explanations;
(三)听证参加人确认听证会记录并签字。
(3) Hearing participants shall confirm the hearing record and sign it.
决策承办单位应当对社会各方面提出的意见进行归纳整理、研究论证，充分采纳合理意见，完善决策草案。
The decision-making undertaking unit shall summarize, organize, study, and demonstrate opinions raised by all sectors of society, fully adopt reasonable opinions, and improve the decision draft.
第三节 专家论证
Section 3: Expert Argumentation
对专业性、技术性较强的决策事项，决策承办单位应当组织专家、专业机构论证其必要性、可行性、科学性等，并提供必要保障。
For decision matters with strong professional or technical nature, the decision-making undertaking unit shall organize experts or professional institutions to demonstrate their necessity, feasibility, scientific nature, etc., and provide necessary guarantees.
专家、专业机构应当独立开展论证工作，客观、公正、科学地提出论证意见，并对所知悉的国家秘密、商业秘密、个人隐私依法履行保密义务；提供书面论证意见的，应当署名、盖章。
Experts and professional institutions shall independently carry out argumentation work, provide objective, fair, and scientific argumentation opinions, and fulfill confidentiality obligations for state secrets, trade secrets, and personal privacy known to them; if providing written argumentation opinions, they shall sign and affix seals.
决策承办单位组织专家论证，可以采取论证会、书面咨询、委托咨询论证等方式。选择专家、专业机构参与论证，应当坚持专业性、代表性和中立性，注重选择持不同意见的专家、专业机构，不得选择与决策事项有直接利害关系的专家、专业机构。
When organizing expert argumentation, the decision-making undertaking unit may adopt methods such as argumentation meetings, written consultations, or entrusted consultation argumentation. The selection of experts and professional institutions to participate in argumentation shall adhere to professionalism, representativeness, and neutrality, focus on selecting experts and professional institutions with differing opinions, and shall not select experts or professional institutions that have a direct interest in the decision matter.
省、自治区、直辖市人民政府应当建立决策咨询论证专家库，规范专家库运行管理制度，健全专家诚信考核和退出机制。
The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall establish an expert database for decision-making consultation and argumentation, standardize the operation and management system of the expert database, and improve the expert integrity assessment and withdrawal mechanism.
市、县级人民政府可以根据需要建立决策咨询论证专家库。
City and county people's governments may establish expert databases for decision-making consultation and evaluation as needed.
决策机关没有建立决策咨询论证专家库的，可以使用上级行政机关的专家库。
If the decision-making authority has not established its own expert database for decision-making consultation and evaluation, it may use the expert database of the higher-level administrative authority.
第四节 风险评估
Section 4: Risk Assessment
重大行政决策的实施可能对社会稳定、公共安全等方面造成不利影响的，决策承办单位或者负责风险评估工作的其他单位应当组织评估决策草案的风险可控性。
If the implementation of a major administrative decision may cause adverse effects on social stability, public safety, etc., the unit responsible for drafting the decision or other unit responsible for risk assessment shall organize an assessment of the risk controllability of the decision draft.
按照有关规定已对有关风险进行评价、评估的，不作重复评估。
If relevant risks have already been evaluated or assessed in accordance with relevant regulations, no duplicate assessment shall be conducted.
开展风险评估，可以通过舆情跟踪、重点走访、会商分析等方式，运用定性分析与定量分析等方法，对决策实施的风险进行科学预测、综合研判。
When conducting risk assessment, methods such as public opinion tracking, key visits, and consultation analysis may be used, employing qualitative analysis and quantitative analysis methods to scientifically predict and comprehensively evaluate the risks of implementing the decision.
开展风险评估，应当听取有关部门的意见，形成风险评估报告，明确风险点，提出风险防范措施和处置预案。
When conducting risk assessment, opinions from relevant departments shall be solicited, a risk assessment report shall be prepared, risk points shall be identified, and risk prevention measures and contingency plans shall be proposed.
开展风险评估，可以委托专业机构、社会组织等第三方进行。
When conducting risk assessment, third parties such as professional institutions and social organizations may be commissioned.
风险评估结果应当作为重大行政决策的重要依据。决策机关认为风险可控的，可以作出决策；认为风险不可控的，在采取调整决策草案等措施确保风险可控后，可以作出决策。
The risk assessment result shall serve as an important basis for major administrative decisions. If the decision-making authority considers the risk controllable, it may make the decision; if it considers the risk uncontrollable, it may make the decision after taking measures such as adjusting the decision draft to ensure the risk is controllable.
合法性审查和集体讨论决定
Legality Review and Collective Discussion Decision
第一节 合法性审查
Section 1: Legality Review
决策草案提交决策机关讨论前，应当由负责合法性审查的部门进行合法性审查。不得以征求意见等方式代替合法性审查。
Before a draft decision is submitted for discussion by the decision-making body, it shall undergo legality review by the department responsible for legality review. Solicitation of opinions or other methods shall not replace legality review.
决策草案未经合法性审查或者经审查不合法的，不得提交决策机关讨论。对国家尚无明确规定的探索性改革决策事项，可以明示法律风险，提交决策机关讨论。
A draft decision that has not undergone legality review or has been found illegal upon review shall not be submitted for discussion by the decision-making body. For exploratory reform decision matters for which the state has not yet issued clear provisions, legal risks may be expressly indicated and the matter may be submitted for discussion by the decision-making body.
送请合法性审查，应当提供决策草案及相关材料，包括有关法律、法规、规章等依据和履行决策法定程序的说明等。提供的材料不符合要求的，负责合法性审查的部门可以退回，或者要求补充。
When submitting for legality review, the draft decision and related materials shall be provided, including the basis of relevant laws, regulations, and rules, as well as explanations of compliance with statutory decision-making procedures. If the provided materials do not meet the requirements, the department responsible for legality review may return them or request supplementation.
送请合法性审查，应当保证必要的审查时间，一般不少于7个工作日。
When submitting for legality review, sufficient review time shall be ensured, generally not less than 7 working days.
合法性审查的内容包括：
The content of legality review includes:
(一)决策事项是否符合法定权限；
(1) Whether the decision matter falls within the statutory authority;
(二)决策草案的形成是否履行相关法定程序；
(2) Whether the formation of the draft decision has complied with relevant statutory procedures;
(三)决策草案内容是否符合有关法律、法规、规章和国家政策的规定。
(3) Whether the content of the draft decision complies with the provisions of relevant laws, regulations, rules, and national policies.
负责合法性审查的部门应当及时提出合法性审查意见，并对合法性审查意见负责。在合法性审查过程中，应当组织法律顾问、公职律师提出法律意见。决策承办单位根据合法性审查意见进行必要的调整或者补充。
The department responsible for legality review shall promptly issue a legality review opinion and be responsible for such opinion. During the legality review process, legal counsel and public lawyers shall be organized to provide legal opinions. The decision-making undertaking unit shall make necessary adjustments or supplements based on the legality review opinion.
第二节 集体讨论决定和决策公布
Section 2: Collective Discussion, Decision and Decision Publication
决策承办单位提交决策机关讨论决策草案，应当报送下列材料：
When the decision undertaking unit submits the decision draft to the decision-making organ for discussion, it shall submit the following materials:
(一)决策草案及相关材料，决策草案涉及市场主体经济活动的，应当包含公平竞争审查的有关情况；
(1) The decision draft and related materials. If the decision draft involves market entity economic activities, it shall include relevant information on fair competition review;
(二)履行公众参与程序的，同时报送社会公众提出的主要意见的研究采纳情况；
(2) If public participation procedures have been carried out, a report on the research and adoption of main opinions raised by the public shall also be submitted;
(三)履行专家论证程序的，同时报送专家论证意见的研究采纳情况；
(3) If expert argumentation procedures have been carried out, a report on the research and adoption of expert argumentation opinions shall also be submitted;
(四)履行风险评估程序的，同时报送风险评估报告等有关材料；
(4) If risk assessment procedures have been carried out, the risk assessment report and other relevant materials shall also be submitted;
(五)合法性审查意见；
(5) The legality review opinion;
(六)需要报送的其他材料。
(6) Other materials that need to be submitted.
决策草案应当经决策机关常务会议或者全体会议讨论。决策机关行政首长在集体讨论的基础上作出决定。
The decision draft shall be discussed at a standing committee meeting or a plenary meeting of the decision-making organ. The chief executive of the decision-making organ shall make the decision based on collective discussion.
讨论决策草案，会议组成人员应当充分发表意见，行政首长最后发表意见。行政首长拟作出的决定与会议组成人员多数人的意见不一致的，应当在会上说明理由。
When discussing the decision draft, meeting members shall fully express their opinions, and the chief executive shall express his or her opinion last. If the decision the chief executive intends to make is inconsistent with the majority opinion of the meeting members, the reasons shall be explained at the meeting.
集体讨论决定情况应当如实记录，不同意见应当如实载明。
The circumstances of collective discussion and decision shall be truthfully recorded, and dissenting opinions shall be truthfully documented.
重大行政决策出台前应当按照规定向同级党委请示报告。
Before a major administrative decision is issued, it shall be reported to the Party committee at the same level for instructions in accordance with regulations.
决策机关应当通过本级人民政府公报和政府网站以及在本行政区域内发行的报纸等途径及时公布重大行政决策。对社会公众普遍关心或者专业性、技术性较强的重大行政决策，应当说明公众意见、专家论证意见的采纳情况，通过新闻发布会、接受访谈等方式进行宣传解读。依法不予公开的除外。
The decision-making organ shall promptly publish major administrative decisions through the government gazette of the people's government at the same level, government websites, and newspapers distributed within its administrative region. For major administrative decisions that are of general public concern or highly professional or technical, the adoption of public opinions and expert argumentation opinions shall be explained, and publicity and interpretation shall be conducted through press conferences, interviews, and other means. This does not apply to decisions that are not publicly disclosed in accordance with the law.
决策机关应当建立重大行政决策过程记录和材料归档制度，由有关单位将履行决策程序形成的记录、材料及时完整归档。
The decision-making organ shall establish a system for recording the process of major administrative decisions and archiving materials, and the relevant units shall promptly and completely archive the records and materials formed during the decision-making process.
决策执行和调整
Decision Execution and Adjustment
决策机关应当明确负责重大行政决策执行工作的单位(以下简称决策执行单位)，并对决策执行情况进行督促检查。决策执行单位应当依法全面、及时、正确执行重大行政决策，并向决策机关报告决策执行情况。
The decision-making organ shall designate the unit responsible for executing the major administrative decision (hereinafter referred to as the decision execution unit) and supervise and inspect the execution of the decision. The decision execution unit shall comprehensively, timely, and correctly execute the major administrative decision in accordance with the law and report the execution status to the decision-making organ.
决策执行单位发现重大行政决策存在问题、客观情况发生重大变化，或者决策执行中发生不可抗力等严重影响决策目标实现的，应当及时向决策机关报告。
If the decision execution unit discovers problems with the major administrative decision, significant changes in objective circumstances, or force majeure events that seriously affect the achievement of the decision's objectives, it shall promptly report to the decision-making organ.
公民、法人或者其他组织认为重大行政决策及其实施存在问题的，可以通过信件、电话、电子邮件等方式向决策机关或者决策执行单位提出意见建议。
Citizens, legal persons, or other organizations that believe there are problems with the major administrative decision or its implementation may submit opinions or suggestions to the decision-making organ or the decision execution unit via letters, telephone, email, or other means.
有下列情形之一的，决策机关可以组织决策后评估，并确定承担评估具体工作的单位：
Under any of the following circumstances, the decision-making organ may organize a post-decision evaluation and designate the unit responsible for carrying out the specific evaluation work:
(一)重大行政决策实施后明显未达到预期效果；
(1) The major administrative decision has clearly failed to achieve the expected results after implementation;
(二)公民、法人或者其他组织提出较多意见；
(2) Citizens, legal persons, or other organizations have raised numerous opinions;
(三)决策机关认为有必要。
(3) The decision-making body deems it necessary.
开展决策后评估，可以委托专业机构、社会组织等第三方进行，决策作出前承担主要论证评估工作的单位除外。
When conducting post-decision evaluation, a third party such as a professional institution or social organization may be commissioned, except for the unit that undertook the main argumentation and evaluation work before the decision was made.
开展决策后评估，应当注重听取社会公众的意见，吸收人大代表、政协委员、人民团体、基层组织、社会组织参与评估。
When conducting post-decision evaluation, attention shall be paid to listening to the opinions of the public, and absorbing the participation of people's congress deputies, members of the Chinese People's Political Consultative Conference, people's organizations, grassroots organizations, and social organizations in the evaluation.
决策后评估结果应当作为调整重大行政决策的重要依据。
The results of the post-decision evaluation shall serve as an important basis for adjusting major administrative decisions.
依法作出的重大行政决策，未经法定程序不得随意变更或者停止执行；执行中出现本条例第三十五条规定的情形、情况紧急的，决策机关行政首长可以先决定中止执行；需要作出重大调整的，应当依照本条例履行相关法定程序。
A major administrative decision made in accordance with the law shall not be arbitrarily changed or suspended without following legal procedures; if the circumstances specified in Article 35 of these Regulations occur during implementation and the situation is urgent, the chief administrative officer of the decision-making body may first decide to suspend implementation; if a major adjustment is needed, the relevant legal procedures under these Regulations shall be followed.

Legal Liability
决策机关违反本条例规定的，由上一级行政机关责令改正，对决策机关行政首长、负有责任的其他领导人员和直接责任人员依法追究责任。
If a decision-making body violates the provisions of these Regulations, the administrative organ at the next higher level shall order it to make corrections, and the chief administrative officer of the decision-making body, other responsible leaders, and directly responsible personnel shall be held accountable according to law.
决策机关违反本条例规定造成决策严重失误，或者依法应当及时作出决策而久拖不决，造成重大损失、恶劣影响的，应当倒查责任，实行终身责任追究，对决策机关行政首长、负有责任的其他领导人员和直接责任人员依法追究责任。
If a decision-making body violates the provisions of these Regulations, causing a serious decision-making error, or if it delays making a decision that should have been made in a timely manner according to law, resulting in major losses or adverse effects, the responsibility shall be traced retroactively, and lifelong accountability shall be implemented, with the chief administrative officer of the decision-making body, other responsible leaders, and directly responsible personnel being held accountable according to law.
决策机关集体讨论决策草案时，有关人员对严重失误的决策表示不同意见的，按照规定减免责任。
When the decision-making body collectively discusses a draft decision, if relevant personnel express dissenting opinions on a seriously erroneous decision, their liability shall be reduced or exempted in accordance with regulations.
决策承办单位或者承担决策有关工作的单位未按照本条例规定履行决策程序或者履行决策程序时失职渎职、弄虚作假的，由决策机关责令改正，对负有责任的领导人员和直接责任人员依法追究责任。
If the decision-making undertaking unit or the unit responsible for related decision-making work fails to perform the decision-making procedures in accordance with these regulations, or commits dereliction of duty, malfeasance, or fraud during the performance of decision-making procedures, the decision-making authority shall order correction, and the responsible leaders and directly responsible personnel shall be held accountable according to law.
决策执行单位拒不执行、推诿执行、拖延执行重大行政决策，或者对执行中发现的重大问题瞒报、谎报或者漏报的，由决策机关责令改正，对负有责任的领导人员和直接责任人员依法追究责任。
If the decision execution unit refuses to execute, shirks execution, or delays execution of a major administrative decision, or conceals, falsely reports, or omits reporting major problems discovered during execution, the decision-making authority shall order correction, and the responsible leaders and directly responsible personnel shall be held accountable according to law.
承担论证评估工作的专家、专业机构、社会组织等违反职业道德和本条例规定的，予以通报批评、责令限期整改；造成严重后果的，取消评估资格、承担相应责任。
If experts, professional institutions, social organizations, etc., undertaking demonstration and evaluation work violate professional ethics or the provisions of these regulations, they shall be given a notice of criticism and ordered to rectify within a time limit; if serious consequences are caused, their evaluation qualifications shall be revoked and they shall bear corresponding responsibilities.
附则
Supplementary Provisions
县级以上人民政府部门和乡级人民政府重大行政决策的作出和调整程序，参照本条例规定执行。
The procedures for making and adjusting major administrative decisions by departments of people's governments at or above the county level and by township people's governments shall be implemented with reference to the provisions of these regulations.
省、自治区、直辖市人民政府根据本条例制定本行政区域重大行政决策程序的具体制度。
People's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall formulate specific systems for major administrative decision-making procedures within their respective administrative regions based on these regulations.
国务院有关部门参照本条例规定，制定本部门重大行政决策程序的具体制度。
Relevant departments of the State Council shall formulate specific systems for major administrative decision-making procedures within their departments with reference to the provisions of these regulations.
本条例自2019年9月1日起施行。
These regulations shall take effect on September 1, 2019.
