Interim Regulation on Real Estate Registration

(Promulgated by Decree No. 656 of the State Council of the People's Republic of China on November 24, 2014; first amended in accordance with the Decision of the State Council on Amending Certain Administrative Regulations on March 24, 2019; second amended in accordance with the Decision of the State Council on Amending and Repealing Certain Administrative Regulations on March 10, 2024)

为整合不动产登记职责，规范登记行为，方便群众申请登记，保护权利人合法权益，根据《中华人民共和国民法典》等法律，制定本条例。

This Regulation is formulated in accordance with the Civil Code of the People's Republic of China and other laws, for the purposes of integrating real estate registration functions, standardizing registration practices, facilitating public application for registration, and protecting the lawful rights and interests of right holders.

本条例所称不动产登记，是指不动产登记机构依法将不动产权利归属和其他法定事项记载于不动产登记簿的行为。

For the purposes of this Regulation, 'real estate registration' means the act by which a real estate registration authority records the ownership of real estate rights and other statutory matters in a real estate register in accordance with the law.

本条例所称不动产，是指土地、海域以及房屋、林木等定着物。

For the purposes of this Regulation, 'real estate' means land, sea areas, and fixtures such as houses and trees.

不动产首次登记、变更登记、转移登记、注销登记、更正登记、异议登记、预告登记、查封登记等，适用本条例。

This Regulation applies to initial registration, change registration, transfer registration, cancellation registration, correction registration, objection registration, advance notice registration, and seizure registration of real estate.

国家实行不动产统一登记制度。

The State implements a unified real estate registration system.

不动产登记遵循严格管理、稳定连续、方便群众的原则。

Real estate registration shall follow the principles of strict management, stability and continuity, and convenience for the public.

不动产权利人已经依法享有的不动产权利，不因登记机构和登记程序的改变而受到影响。

Real estate rights lawfully enjoyed by real estate right holders shall not be affected by changes in registration authorities or registration procedures.

下列不动产权利，依照本条例的规定办理登记：

The following real estate rights shall be registered in accordance with the provisions of this Regulation:

(一)集体土地所有权；

(1) Collective land ownership;

(二)房屋等建筑物、构筑物所有权；

(2) Ownership of buildings and structures such as houses;

(三)森林、林木所有权；

(3) Ownership of forests and trees;

(四)耕地、林地、草地等土地承包经营权；

(4) Contracted management rights of arable land, forest land, grassland, etc.;

(五)建设用地使用权；

(5) Right to use construction land;

(六)宅基地使用权；

(6) Right to use homestead land;

(七)海域使用权；

(7) Right to use sea areas;

(八)地役权；

(8) Easement;

(九)抵押权；

(9) Mortgage right;

(十)法律规定需要登记的其他不动产权利。

(10) Other real estate rights that require registration as provided by law.

国务院自然资源主管部门负责指导、监督全国不动产登记工作。

The competent department of natural resources under the State Council shall be responsible for guiding and supervising the nationwide real estate registration work.

县级以上地方人民政府应当确定一个部门为本行政区域的不动产登记机构，负责不动产登记工作，并接受上级人民政府不动产登记主管部门的指导、监督。

Local people's governments at or above the county level shall designate a department as the real estate registration authority for their administrative regions, responsible for real estate registration work, and shall accept the guidance and supervision of the competent department of real estate registration of the people's government at the next higher level.

不动产登记由不动产所在地的县级人民政府不动产登记机构办理；直辖市、设区的市人民政府可以确定本级不动产登记机构统一办理所属各区的不动产登记。

Real estate registration shall be handled by the real estate registration authority of the county-level people's government where the real estate is located; the people's government of a municipality directly under the Central Government or a city divided into districts may designate the real estate registration authority at its own level to uniformly handle real estate registration for all districts under its jurisdiction.

跨县级行政区域的不动产登记，由所跨县级行政区域的不动产登记机构分别办理。不能分别办理的，由所跨县级行政区域的不动产登记机构协商办理；协商不成的，由共同的上一级人民政府不动产登记主管部门指定办理。

For real estate registration spanning multiple county-level administrative regions, the real estate registration authorities of the respective county-level administrative regions shall handle it separately. If separate handling is not possible, the real estate registration authorities of the spanned county-level administrative regions shall negotiate the handling; if negotiation fails, the competent department of real estate registration of the common higher-level people's government shall designate the handling.

国务院确定的重点国有林区的森林、林木和林地，国务院批准项目用海、用岛，中央国家机关使用的国有土地等不动产登记，由国务院自然资源主管部门会同有关部门规定。

Real estate registration for forests, trees, and forest land in key state-owned forest areas designated by the State Council, for sea areas and islands approved for use by projects approved by the State Council, and for state-owned land used by central state organs shall be regulated by the competent department of natural resources under the State Council jointly with relevant departments.

不动产以不动产单元为基本单位进行登记。不动产单元具有唯一编码。

Real estate shall be registered with the real estate unit as the basic unit. Real estate units shall have unique codes.

不动产登记机构应当按照国务院自然资源主管部门的规定设立统一的不动产登记簿。

Real estate registration authorities shall establish a unified real estate register in accordance with the provisions of the competent department of natural resources under the State Council.

不动产登记簿应当记载以下事项：

The real estate register shall record the following matters:

(一)不动产的坐落、界址、空间界限、面积、用途等自然状况；

(1) Natural conditions such as location, boundaries, spatial limits, area, and use of the real estate;

(二)不动产权利的主体、类型、内容、来源、期限、权利变化等权属状况；

(2) Ownership conditions such as the subject, type, content, source, term, and changes of real estate rights;

(三)涉及不动产权利限制、提示的事项；

(3) Matters involving restrictions or cautions on real estate rights;

(四)其他相关事项。

(4) Other relevant matters.

不动产登记簿应当采用电子介质，暂不具备条件的，可以采用纸质介质。不动产登记机构应当明确不动产登记簿唯一、合法的介质形式。

The real estate register shall be in electronic medium; where conditions are temporarily not available, paper medium may be used. The real estate registration authority shall specify the sole and lawful medium form of the real estate register.

不动产登记簿采用电子介质的，应当定期进行异地备份，并具有唯一、确定的纸质转化形式。

If the real estate register is in electronic medium, it shall be regularly backed up off-site and have a unique and definite paper conversion form.

不动产登记机构应当依法将各类登记事项准确、完整、清晰地记载于不动产登记簿。任何人不得损毁不动产登记簿，除依法予以更正外不得修改登记事项。

The real estate registration authority shall accurately, completely, and clearly record all types of registration matters in the real estate register in accordance with the law. No person may damage the real estate register, and no registration matter may be modified except for corrections made in accordance with the law.

不动产登记工作人员应当具备与不动产登记工作相适应的专业知识和业务能力。

Real estate registration staff shall possess professional knowledge and business capabilities commensurate with the real estate registration work.

不动产登记机构应当加强对不动产登记工作人员的管理和专业技术培训。

Real estate registration authorities shall strengthen the management and professional technical training of real estate registration staff.

不动产登记机构应当指定专人负责不动产登记簿的保管，并建立健全相应的安全责任制度。

Real estate registration authorities shall designate specific persons to be responsible for the custody of the real estate register and establish and improve corresponding security responsibility systems.

采用纸质介质不动产登记簿的，应当配备必要的防盗、防火、防渍、防有害生物等安全保护设施。

For real estate registers in paper medium, necessary security protection facilities such as anti-theft, fireproof, waterproof, and anti-pest measures shall be equipped.

采用电子介质不动产登记簿的，应当配备专门的存储设施，并采取信息网络安全防护措施。

For real estate registers in electronic medium, dedicated storage facilities shall be equipped, and information network security protection measures shall be taken.

不动产登记簿由不动产登记机构永久保存。不动产登记簿损毁、灭失的，不动产登记机构应当依据原有登记资料予以重建。

The real estate register shall be permanently preserved by the real estate registration authority. If the real estate register is damaged or lost, the real estate registration authority shall reconstruct it based on the original registration data.

行政区域变更或者不动产登记机构职能调整的，应当及时将不动产登记簿移交相应的不动产登记机构。

In the event of changes in administrative divisions or adjustments in the functions of the real estate registration authority, the real estate register shall be promptly transferred to the corresponding real estate registration authority.

因买卖、设定抵押权等申请不动产登记的，应当由当事人双方共同申请。

Applications for real estate registration due to sale, creation of a mortgage, etc., shall be jointly submitted by both parties.

属于下列情形之一的，可以由当事人单方申请：

In any of the following circumstances, the application may be submitted unilaterally by the party concerned:

(一)尚未登记的不动产首次申请登记的；

(1) Initial registration of real estate that has not yet been registered;

(二)继承、接受遗赠取得不动产权利的；

(2) Acquisition of real estate rights through inheritance or acceptance of a legacy;

(三)人民法院、仲裁委员会生效的法律文书或者人民政府生效的决定等设立、变更、转让、消灭不动产权利的；

(3) Creation, change, transfer, or extinction of real estate rights by effective legal documents of a people's court or arbitration commission, or effective decisions of a people's government;

(四)权利人姓名、名称或者自然状况发生变化，申请变更登记的；

(4) Change of the name or natural conditions of the right holder, applying for change registration;

(五)不动产灭失或者权利人放弃不动产权利，申请注销登记的；

(5) Extinction of real estate or waiver of real estate rights by the right holder, applying for cancellation registration;

(六)申请更正登记或者异议登记的；

(6) Application for correction registration or objection registration;

(七)法律、行政法规规定可以由当事人单方申请的其他情形。

(7) Other circumstances where laws or administrative regulations allow unilateral application by the party concerned.

当事人或者其代理人应当向不动产登记机构申请不动产登记。

The party concerned or its agent shall apply for real estate registration to the real estate registration authority.

不动产登记机构将申请登记事项记载于不动产登记簿前，申请人可以撤回登记申请。

Before the real estate registration authority records the applied registration matter in the real estate register, the applicant may withdraw the registration application.

申请人应当提交下列材料，并对申请材料的真实性负责：

The applicant shall submit the following materials and be responsible for the authenticity of the application materials:

(一)登记申请书；

(1) A registration application form;

(二)申请人、代理人身份证明材料、授权委托书；

(2) Identity certification materials of the applicant and agent, and a power of attorney;

(三)相关的不动产权属来源证明材料、登记原因证明文件、不动产权属证书；

(3) Relevant certification materials of the source of real estate rights, documents proving the cause of registration, and real estate ownership certificates;

(四)不动产界址、空间界限、面积等材料；

(4) Materials on the boundaries, spatial limits, and area of the real estate;

(五)与他人利害关系的说明材料；

(5) Explanatory materials on interests with others;

(六)法律、行政法规以及本条例实施细则规定的其他材料。

(6) Other materials as required by laws, administrative regulations, and the implementing rules of this Regulation.

不动产登记机构应当在办公场所和门户网站公开申请登记所需材料目录和示范文本等信息。

The real estate registration authority shall disclose the catalog of materials required for registration applications and model documents at its office premises and on its portal website.

不动产登记机构收到不动产登记申请材料，应当分别按照下列情况办理：

Upon receiving the application materials for real estate registration, the real estate registration authority shall handle the matter according to the following circumstances:

(一)属于登记职责范围，申请材料齐全、符合法定形式，或者申请人按照要求提交全部补正申请材料的，应当受理并书面告知申请人；

(1) If the matter falls within the scope of registration functions, the application materials are complete and in compliance with statutory forms, or the applicant submits all supplementary materials as required, the authority shall accept the application and notify the applicant in writing;

(二)申请材料存在可以当场更正的错误的，应当告知申请人当场更正，申请人当场更正后，应当受理并书面告知申请人；

(2) If the application materials contain errors that can be corrected on the spot, the authority shall inform the applicant to make corrections on the spot; after the applicant makes corrections on the spot, the authority shall accept the application and notify the applicant in writing;

(三)申请材料不齐全或者不符合法定形式的，应当当场书面告知申请人不予受理并一次性告知需要补正的全部内容；

(3) If the application materials are incomplete or do not comply with statutory forms, the authority shall inform the applicant in writing on the spot of the rejection and notify the applicant of all the contents that need to be supplemented at one time;

(四)申请登记的不动产不属于本机构登记范围的，应当当场书面告知申请人不予受理并告知申请人向有登记权的机构申请。

(4) If the real estate for which registration is applied does not fall within the registration scope of this authority, the authority shall inform the applicant in writing on the spot of the rejection and inform the applicant to apply to the authority with registration authority.

不动产登记机构未当场书面告知申请人不予受理的，视为受理。

If the real estate registration authority fails to inform the applicant in writing of the rejection on the spot, the application shall be deemed accepted.

不动产登记机构受理不动产登记申请的，应当按照下列要求进行查验：

After accepting an application for real estate registration, the real estate registration authority shall conduct verification in accordance with the following requirements:

(一)不动产界址、空间界限、面积等材料与申请登记的不动产状况是否一致；

(1) Whether the materials on the boundaries, spatial limits, and area of the real estate are consistent with the condition of the real estate for which registration is applied;

(二)有关证明材料、文件与申请登记的内容是否一致；

(2) Whether the relevant certification materials and documents are consistent with the content of the registration application;

(三)登记申请是否违反法律、行政法规规定。

(3) Whether the registration application violates laws or administrative regulations.

属于下列情形之一的，不动产登记机构可以对申请登记的不动产进行实地查看：

In any of the following circumstances, the real estate registration authority may conduct an on-site inspection of the real estate for which registration is applied:

(一)房屋等建筑物、构筑物所有权首次登记；

(1) Initial registration of ownership of buildings and structures such as houses;

(二)在建建筑物抵押权登记；

(2) Registration of mortgage rights on buildings under construction;

(三)因不动产灭失导致的注销登记；

(3) Cancellation registration due to extinction of real estate;

(四)不动产登记机构认为需要实地查看的其他情形。

(4) Other circumstances where the real estate registration authority deems an on-site inspection necessary.

对可能存在权属争议，或者可能涉及他人利害关系的登记申请，不动产登记机构可以向申请人、利害关系人或者有关单位进行调查。

For registration applications that may involve ownership disputes or may affect the interests of others, the real estate registration authority may conduct investigations with the applicant, interested parties, or relevant units.

不动产登记机构进行实地查看或者调查时，申请人、被调查人应当予以配合。

When the real estate registration authority conducts an on-site inspection or investigation, the applicant and the person being investigated shall cooperate.

不动产登记机构应当自受理登记申请之日起30个工作日内办结不动产登记手续，法律另有规定的除外。

The real estate registration authority shall complete the real estate registration procedures within 30 working days from the date of accepting the registration application, unless otherwise provided by law.

登记事项自记载于不动产登记簿时完成登记。

Registration is completed when the registration matter is recorded in the real estate register.

不动产登记机构完成登记，应当依法向申请人核发不动产权属证书或者登记证明。

Upon completion of registration, the real estate registration authority shall issue a real estate ownership certificate or registration certificate to the applicant in accordance with the law.

登记申请有下列情形之一的，不动产登记机构应当不予登记，并书面告知申请人：

If a registration application falls under any of the following circumstances, the real estate registration authority shall refuse registration and notify the applicant in writing:

(一)违反法律、行政法规规定的；

(1) Violation of laws or administrative regulations;

(二)存在尚未解决的权属争议的；

(2) Existence of unresolved ownership disputes;

(三)申请登记的不动产权利超过规定期限的；

(3) The real estate right for which registration is applied exceeds the prescribed term;

(四)法律、行政法规规定不予登记的其他情形。

(4) Other circumstances where laws or administrative regulations provide for refusal of registration.

国务院自然资源主管部门应当会同有关部门建立统一的不动产登记信息管理基础平台。

The competent department of natural resources under the State Council shall, jointly with relevant departments, establish a unified basic platform for real estate registration information management.

各级不动产登记机构登记的信息应当纳入统一的不动产登记信息管理基础平台，确保国家、省、市、县四级登记信息的实时共享。

Information registered by real estate registration authorities at all levels shall be incorporated into the unified basic platform for real estate registration information management to ensure real-time sharing of registration information at the national, provincial, municipal, and county levels.

不动产登记有关信息与住房城乡建设、农业农村、林业草原等部门审批信息、交易信息等应当实时互通共享。

Real estate registration-related information shall be shared in real time and interoperable with approval information and transaction information of departments such as housing and urban-rural construction, agriculture and rural affairs, and forestry and grassland.

不动产登记机构能够通过实时互通共享取得的信息，不得要求不动产登记申请人重复提交。

If the real estate registration authority can obtain information through real-time interoperability and sharing, it shall not require the real estate registration applicant to submit duplicate information.

自然资源、公安、民政、财政、税务、市场监管、金融、审计、统计等部门应当加强不动产登记有关信息互通共享。

Departments of natural resources, public security, civil affairs, finance, taxation, market regulation, finance, audit, and statistics shall strengthen the interoperability and sharing of real estate registration-related information.

不动产登记机构、不动产登记信息共享单位及其工作人员应当对不动产登记信息保密；涉及国家秘密的不动产登记信息，应当依法采取必要的安全保密措施。

Real estate registration authorities, units sharing real estate registration information, and their staff shall keep real estate registration information confidential; for real estate registration information involving state secrets, necessary security and confidentiality measures shall be taken in accordance with the law.

权利人、利害关系人可以依法查询、复制不动产登记资料，不动产登记机构应当提供。

Right holders and interested parties may, in accordance with the law, query and copy real estate registration materials, and the real estate registration authority shall provide them.

有关国家机关可以依照法律、行政法规的规定查询、复制与调查处理事项有关的不动产登记资料。

Relevant state organs may, in accordance with laws and administrative regulations, query and copy real estate registration materials related to matters under investigation and handling.

查询不动产登记资料的单位、个人应当向不动产登记机构说明查询目的，不得将查询获得的不动产登记资料用于其他目的；未经权利人同意，不得泄露查询获得的不动产登记资料。

Units and individuals that query real estate registration materials shall explain the purpose of the query to the real estate registration authority and shall not use the obtained real estate registration materials for other purposes; without the consent of the right holder, they shall not disclose the obtained real estate registration materials.

不动产登记机构登记错误给他人造成损害，或者当事人提供虚假材料申请登记给他人造成损害的，依照《中华人民共和国民法典》的规定承担赔偿责任。

If a real estate registration authority causes damage to others due to registration errors, or if a party causes damage to others by submitting false materials for registration, liability for compensation shall be borne in accordance with the provisions of the Civil Code of the People's Republic of China.

不动产登记机构工作人员进行虚假登记，损毁、伪造不动产登记簿，擅自修改登记事项，或者有其他滥用职权、玩忽职守行为的，依法给予处分；给他人造成损害的，依法承担赔偿责任；构成犯罪的，依法追究刑事责任。

If a staff member of a real estate registration authority engages in false registration, damages or forges the real estate register, unauthorizedly modifies registration matters, or commits other acts of abuse of power or dereliction of duty, disciplinary action shall be taken in accordance with the law; if damage is caused to others, liability for compensation shall be borne in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.

伪造、变造不动产权属证书、不动产登记证明，或者买卖、使用伪造、变造的不动产权属证书、不动产登记证明的，由不动产登记机构或者公安机关依法予以收缴；有违法所得的，没收违法所得；给他人造成损害的，依法承担赔偿责任；构成违反治安管理行为的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。

If anyone forges or alters a real estate ownership certificate or real estate registration certificate, or buys, sells, or uses a forged or altered real estate ownership certificate or real estate registration certificate, the real estate registration authority or public security authority shall confiscate it in accordance with the law; any illegal gains shall be confiscated; if damage is caused to others, liability for compensation shall be borne in accordance with the law; if the act constitutes a violation of public security administration, public security administration penalties shall be imposed in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.

不动产登记机构、不动产登记信息共享单位及其工作人员，查询不动产登记资料的单位或者个人违反国家规定，泄露不动产登记资料、登记信息，或者利用不动产登记资料、登记信息进行不正当活动，给他人造成损害的，依法承担赔偿责任；对有关责任人员依法给予处分；有关责任人员构成犯罪的，依法追究刑事责任。

If a real estate registration authority, a unit sharing real estate registration information, or their staff, or a unit or individual that queries real estate registration materials, violates state regulations by disclosing real estate registration materials or registration information, or using real estate registration materials or registration information for improper activities, causing damage to others, liability for compensation shall be borne in accordance with the law; the responsible personnel shall be subject to disciplinary action in accordance with the law; if the responsible personnel constitutes a crime, criminal liability shall be pursued in accordance with the law.

本条例施行前依法颁发的各类不动产权属证书和制作的不动产登记簿继续有效。

All types of real estate ownership certificates issued and real estate registers created before the implementation of this Regulation shall continue to be valid.

不动产统一登记过渡期内，农村土地承包经营权的登记按照国家有关规定执行。

During the transitional period of unified real estate registration, the registration of rural land contractual management rights shall be carried out in accordance with relevant state regulations.

本条例实施细则由国务院自然资源主管部门会同有关部门制定。

The implementing rules of this Regulation shall be formulated by the competent department of natural resources under the State Council jointly with relevant departments.

本条例自2015年3月1日起施行。本条例施行前公布的行政法规有关不动产登记的规定与本条例规定不一致的，以本条例规定为准。

This Regulation shall come into force on March 1, 2015. Where provisions on real estate registration in administrative regulations promulgated before the implementation of this Regulation are inconsistent with the provisions of this Regulation, the provisions of this Regulation shall prevail.
