为了维护社会主义市场经济秩序，制止牟取暴利，保护消费者的合法权益，制定本规定。
These Provisions are formulated to maintain the order of the socialist market economy, prohibit exorbitant profits, and protect the legitimate rights and interests of consumers.
本规定适用于对国民经济和社会发展有重大影响的和与居民生活有密切关系的商品和服务(以下简称商品和服务)。
These Provisions apply to goods and services that have a significant impact on the national economy and social development or are closely related to residents' daily lives (hereinafter referred to as goods and services).
前款规定的商品和服务的项目，由国务院价格主管部门按照国务院的有关规定公布、调整；其中实行国家定价的，按照国家定价和国务院有关价格管理的规定执行。
The items of goods and services specified in the preceding paragraph shall be published and adjusted by the competent price department of the State Council in accordance with the relevant provisions of the State Council; those subject to state pricing shall be implemented in accordance with state pricing and the relevant provisions of the State Council on price management.
省、自治区、直辖市人民政府可以根据本地方的实际情况，在国务院价格主管部门公布的商品和服务的项目的基础上，决定适当增加与本地方居民生活有密切关系的商品和服务的项目，予以公布，并报国务院价格主管部门备案。
The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may, based on local conditions, decide to appropriately increase items of goods and services closely related to local residents' daily lives on the basis of the items published by the competent price department of the State Council, publish them, and report them to the competent price department of the State Council for record.
在中华人民共和国境内从事生产经营和提供有偿服务的公民、法人和其他组织(以下简称生产经营者)必须遵守本规定。
All citizens, legal persons, and other organizations (hereinafter referred to as producers and operators) engaged in production, operation, and provision of paid services within the territory of the People's Republic of China must comply with these Provisions.
生产经营者的价格行为应当遵循公开、公平和诚实信用的原则，执行国家关于商品和服务实行明码标价的规定。
Producers and operators shall follow the principles of openness, fairness, honesty, and credit in their pricing behavior, and implement the state regulations on clearly marked prices for goods and services.
商品的价格和服务的收费标准(以下统称价格)，应当符合下列要求：
The prices of goods and the fee standards for services (hereinafter collectively referred to as prices) shall meet the following requirements:
(一)某一商品或者服务的价格水平不超过同一地区、同一期间、同一档次、同种商品或者服务的市场平均价格的合理幅度；
(1) The price level of a certain good or service shall not exceed a reasonable margin above the market average price of the same good or service in the same region, same period, and same grade;
(二)某一商品或者服务的差价率不超过同一地区、同一期间、同一档次、同种商品或者服务的平均差价率的合理幅度；
(2) The price difference rate of a certain good or service shall not exceed a reasonable margin above the average price difference rate of the same good or service in the same region, same period, and same grade;
(三)某一商品或者服务的利润率不超过同一地区、同一期间、同一档次、同种商品或者服务的平均利润率的合理幅度。但是，生产经营者通过改善经营管理，运用新技术，降低成本，提高效益而实现的利润率除外。
(3) The profit rate of a certain good or service shall not exceed a reasonable margin above the average profit rate of the same good or service in the same region, same period, and same grade. However, this does not apply to profit rates achieved by producers and operators through improving management, applying new technologies, reducing costs, and increasing efficiency.
商品或者服务的市场平均价格、平均差价率、平均利润率以其社会平均成本为基础测定。
The market average price, average price difference rate, and average profit rate of goods or services shall be determined based on their social average cost.
商品或者服务的市场平均价格、平均差价率、平均利润率的合理幅度，按照其与国民经济和社会发展的关系或者与居民生活的密切程度，市场供求状况和不同行业、不同环节、不同商品或者服务的特点规定。
The reasonable margins for the market average price, average price difference rate, and average profit rate of goods or services shall be stipulated in accordance with their relationship to the national economy and social development or their closeness to residents' daily lives, market supply and demand conditions, and the characteristics of different industries, different links, and different goods or services.
商品和服务的市场平均价格、平均差价率、平均利润率及其合理幅度，由省、自治区、直辖市的人民政府价格管理部门会同有关业务主管部门，按照国务院价格主管部门的规定测定和规定，并予以公布；省、自治区、直辖市人民政府价格管理部门也可以根据需要，授权市、县人民政府价格管理部门测定和规定与居民生活有密切关系的部分商品和服务的市场平均价格、平均差价率、平均利润率及其合理幅度，并予以公布。
The market average price, average price difference rate, average profit rate, and their reasonable margins for goods and services shall be determined and stipulated by the competent price departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government jointly with relevant competent business departments in accordance with the provisions of the competent price department of the State Council, and shall be published; the competent price departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may also, as needed, authorize the competent price departments of the people's governments of cities and counties to determine and stipulate the market average price, average price difference rate, average profit rate, and their reasonable margins for some goods and services closely related to residents' daily lives, and publish them.
有关业务主管部门和生产经营者应当配合价格管理部门的测定工作。
Relevant competent business departments and producers and operators shall cooperate with the determination work of the competent price departments.
生产经营者不得违反本规定，以下列手段非法牟利：
Producers and operators shall not violate these Provisions and illegally seek profits by the following means:
(一)不按照规定明码标价或者在明码标示的价格之外索要高价；
(1) Failing to clearly mark prices as required or demanding a higher price than the clearly marked price;
(二)谎称削价让利，或者以虚假的优惠价、折扣价、处理价、最低价以及其他虚假的价格信息，进行价格欺诈；
(2) Falsely claiming price reductions or concessions, or engaging in price fraud through false preferential prices, discounted prices, clearance prices, minimum prices, or other false price information;
(三)生产经营者之间或者行业组织之间相互串通，哄抬价格；
(3) Colluding among producers and operators or between industry organizations to drive up prices;
(四)违反公平、自愿原则，强迫交易对方接受高价；
(4) Violating the principles of fairness and voluntariness by forcing the other party to accept a high price;
(五)采取其他价格欺诈手段。
(5) Adopting other fraudulent pricing means.
价格监督检查人员依法执行职务，生产经营者不得拒绝、阻碍。
When price supervision and inspection personnel perform their duties according to law, producers and operators shall not refuse or obstruct them.
对生产经营者牟取暴利的行为，任何单位和个人都有权向价格监督检查机构投诉或者举报。
Any unit or individual has the right to complain or report to the price supervision and inspection agency against producers and operators who seek exorbitant profits.
价格监督检查机构受理投诉或者收到举报后，应当及时调查核实情况，依照本规定予以处理，并根据情况对举报者给予奖励。
Upon receiving a complaint or report, the price supervision and inspection agency shall promptly investigate and verify the situation, handle it in accordance with these Provisions, and reward the whistleblower as appropriate.
违反本规定第五条规定的，由价格监督检查机构责令改正；拒不改正的，予以警告、没收违法所得，可以并处违法所得5倍以下的罚款。
Anyone who violates the provisions of Article 5 shall be ordered to correct by the price supervision and inspection agency; if they refuse to correct, they shall be given a warning, have their illegal gains confiscated, and may be concurrently fined not more than five times the illegal gains.
违反本规定第八条规定的，由价格监督检查机构予以警告，责令其向遭受损害的一方退还违法所得，违法所得不能退还的，予以没收，可以并处违法所得5倍以下的罚款；情节严重，构成犯罪的，依法追究刑事责任。
Whoever violates Article 8 of these Provisions shall be warned by the price inspection authority, ordered to return the illegal income to the injured party; if the illegal income cannot be returned, it shall be confiscated, and may also be fined not more than five times the illegal income; if the circumstances are serious and constitute a crime, criminal liability shall be pursued according to law.
以暴力、威胁方法阻碍价格监督检查人员依法执行职务的，依法追究刑事责任；拒绝、阻碍价格监督检查人员依法执行职务，未使用暴力、威胁方法，构成违反治安管理行为的，由公安机关依照治安管理处罚法的有关规定予以处罚。
Whoever obstructs price inspection personnel from performing their duties according to law by means of violence or threat shall be pursued for criminal liability according to law; whoever refuses or obstructs price inspection personnel from performing their duties according to law without using violence or threat, which constitutes a violation of public security administration, shall be punished by the public security organ in accordance with the relevant provisions of the Public Security Administration Punishments Law.
价格监督检查人员玩忽职守、徇私舞弊，或者包庇、纵容牟取暴利的行为的，依法给予行政处分；构成犯罪的，依法追究刑事责任。
Price inspection personnel who neglect their duties, engage in malpractices for personal gain, or cover up or connive at acts of obtaining exorbitant profits shall be given administrative sanctions according to law; if a crime is constituted, criminal liability shall be pursued according to law.
工商行政管理、审计、财政、税务、公安、技术监督等部门，应当在各自的职责范围内，配合价格监督检查机构查处牟取暴利的行为。
The administrative departments for industry and commerce, audit, finance, taxation, public security, technical supervision, and other departments shall, within their respective functions and duties, cooperate with the price inspection authority in investigating and dealing with acts of obtaining exorbitant profits.
省、自治区、直辖市人民政府，可以结合本地方的实际情况，根据本规定制定实施办法。
The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may, in light of the actual local conditions, formulate implementation measures in accordance with these Provisions.
本规定由国务院价格主管部门组织实施。
These Provisions shall be organized and implemented by the price authority under the State Council.
本规定自发布之日起施行。
These Provisions shall come into force on the date of promulgation.
