为保障证券交易系统的安全运转，妥善管理和使用证券交易所风险基金，根据《中华人民共和国证券法》的有关规定，制定本办法。
These Measures are formulated in accordance with the relevant provisions of the Securities Law of the People's Republic of China to ensure the safe operation of the securities trading system and to properly manage and use the stock exchange risk fund.
本办法所称证券交易所风险基金(以下简称“本基金”)是指用于弥补证券交易所重大经济损失，防范与证券交易所业务活动有关的重大风险事故，以保证证券交易活动正常进行而设立的专项基金。
The term "stock exchange risk fund" (hereinafter referred to as "this Fund") as used in these Measures refers to a special fund established to compensate for major economic losses of the stock exchange, prevent major risk accidents related to the business activities of the stock exchange, and ensure the normal conduct of securities trading activities.
本基金来源：
Sources of this Fund:
(一)按证券交易所收取交易经手费的20%提取，作为风险基金单独列账；
(1) 20% of the transaction fees collected by the stock exchange shall be withdrawn as risk fund and recorded in a separate account;
(二)按证券交易所收取席位年费的10%提取，作为风险基金单独列账；
(2) 10% of the annual seat fees collected by the stock exchange shall be withdrawn as risk fund and recorded in a separate account;
(三)按证券交易所收取会员费10%的比例一次性提取，作为风险基金单独列账；
(3) 10% of the membership fees collected by the stock exchange shall be withdrawn in a lump sum as risk fund and recorded in a separate account;
(四)按本办法施行之日新股申购冻结资金利差账面余额的15%，一次性提取；
(4) 15% of the book balance of the interest spread on frozen funds from new share subscriptions as of the date of implementation of these Measures shall be withdrawn in a lump sum;
(五)对违规会员的罚款、罚息收入。
(5) Fines and penalty interest income from non-compliant members.
每一个财政年度终了，本基金净资产达到或超过10亿元后，下一年度不再根据本办法第三条第(一)、(二)项提取资金。
At the end of each fiscal year, if the net assets of this Fund reach or exceed RMB 1 billion, the fund shall not be withdrawn in the following year in accordance with items (1) and (2) of Article 3 of these Measures.
每一个财政年度终了，本基金净资产不足10亿元，下一年度应按本办法第三条第(一)、(二)项规定继续提取资金。
At the end of each fiscal year, if the net assets of this Fund are less than RMB 1 billion, the fund shall continue to be withdrawn in the following year in accordance with items (1) and (2) of Article 3 of these Measures.
中国证券监督管理委员会(以下简称“证监会”)会同财政部可以根据市场风险情况，适当调整本基金规模、资金提取和交纳方式、比例。
The China Securities Regulatory Commission (hereinafter referred to as the "CSRC") together with the Ministry of Finance may appropriately adjust the size of this Fund, the methods and proportions of fund withdrawal and payment based on market risk conditions.
本基金由证券交易所理事会管理。理事会应当指定机构，负责本基金的日常管理和使用。
This Fund shall be managed by the board of governors of the stock exchange. The board of governors shall designate an institution responsible for the daily management and use of this Fund.
本基金应当以专户方式全部存入国有商业银行，存款利息全部转入基金专户。
This Fund shall be deposited in full in a special account with a state-owned commercial bank, and all deposit interest shall be transferred to the special fund account.
本基金资产与证券交易所资产分开列账。本基金应当下设分类账，分别记录按本办法第三条各项所形成的本基金资产、利息收入及对应的资产本息使用情况。
The assets of this Fund shall be recorded separately from the assets of the stock exchange. This Fund shall have sub-ledgers to separately record the assets of this Fund formed under each item of Article 3 of these Measures, interest income, and the use of corresponding assets and interest.
本基金最低支付限额2000万元。
The minimum payment limit of this Fund is RMB 20 million.
按本办法第三条第(四)项所提取的资金，应当在该条其他项资金支付完毕后才能动用。
The funds withdrawn under item (4) of Article 3 of these Measures may only be used after the funds under other items of that Article have been fully paid.
证券交易所应当按照有关法律、法规的规定，建立和完善业务规则、内部管理制度及会员监管制度，最大限度地避免风险事故发生。
The stock exchange shall, in accordance with relevant laws and regulations, establish and improve business rules, internal management systems, and member supervision systems to minimize the occurrence of risk accidents.
动用本基金后，证券交易所应当向有关责任方追偿，追偿款转入本基金；同时，应及时修订和完善业务规则、内部管理制度及会员监管制度。
After using this Fund, the stock exchange shall recover the amount from the responsible parties, and the recovered amount shall be transferred to this Fund; at the same time, it shall promptly revise and improve business rules, internal management systems, and member supervision systems.
经证监会批准，本基金作相应变更、清算时，由证监会会同财政部另行决定本基金剩余资产中应当上交财政和退还有关出资人的比例和数额。
When this Fund is changed or liquidated with the approval of the CSRC, the CSRC together with the Ministry of Finance shall separately determine the proportion and amount of the remaining assets of this Fund to be turned over to the treasury and refunded to relevant contributors.
本基金的财务核算与管理办法由财政部制定。
The financial accounting and management measures for this Fund shall be formulated by the Ministry of Finance.
本办法由证监会负责解释。
These Measures shall be interpreted by the CSRC.
本办法自颁布之日起施行。
These Measures shall come into effect as of the date of promulgation.
