为了加强和规范政府督查工作，保障政令畅通，提高行政效能，推进廉政建设，健全行政监督制度，制定本条例。
These Regulations are formulated to strengthen and standardize government supervision, ensure unimpeded government orders, improve administrative efficiency, promote clean government, and improve the administrative supervision system.
本条例所称政府督查，是指县级以上人民政府在法定职权范围内根据工作需要组织开展的监督检查。
For the purposes of these Regulations, government supervision refers to the supervision and inspection organized and carried out by people's governments at or above the county level within their statutory functions and powers according to work needs.
政府督查工作应当坚持和加强党的领导，以人民为中心，服务大局、实事求是，推进依法行政，推动政策落实和问题解决，力戒形式主义、官僚主义。
Government supervision work shall adhere to and strengthen the leadership of the Party, be people-centered, serve the overall situation, seek truth from facts, promote law-based administration, promote policy implementation and problem resolution, and resolutely avoid formalism and bureaucracy.
政府督查内容包括：
The content of government supervision includes:
（一）党中央、国务院重大决策部署落实情况；
(1) Implementation of major decisions and deployments of the Party Central Committee and the State Council;
（二）上级和本级人民政府重要工作部署落实情况；
(2) Implementation of important work deployments of higher-level and the people's government at the same level;
（三）督查对象法定职责履行情况；
(3) Performance of statutory duties by the subject of supervision;
（四）本级人民政府所属部门和下级人民政府的行政效能。
(4) Administrative efficiency of departments under the people's government at the same level and people's governments at lower levels.
政府督查对象包括：
The subjects of government supervision include:
（一）本级人民政府所属部门；
(1) Departments under the people's government at the same level;
（二）下级人民政府及其所属部门；
(2) People's governments at lower levels and their departments;
（三）法律、法规授权的具有管理公共事务职能的组织；
(3) Organizations authorized by laws and regulations to manage public affairs;
（四）受行政机关委托管理公共事务的组织。
(4) Organizations entrusted by administrative organs to manage public affairs.
上级人民政府可以对下一级人民政府及其所属部门开展督查，必要时可以对所辖各级人民政府及其所属部门开展督查。
A higher-level people's government may conduct supervision over the people's government at the next lower level and its departments, and when necessary, may conduct supervision over people's governments at all levels under its jurisdiction and their departments.
国务院办公厅指导全国政府督查工作，组织实施国务院督查工作。国务院办公厅督查机构承担国务院督查有关具体工作。
The General Office of the State Council guides national government supervision work and organizes the implementation of State Council supervision work. The supervision agency of the General Office of the State Council undertakes specific work related to State Council supervision.
县级以上地方人民政府督查机构组织实施本级人民政府督查工作。县级以上地方人民政府督查机构设置的形式和规格，按照机构编制管理有关规定办理。
The supervision agency of a local people's government at or above the county level organizes the implementation of the supervision work of that people's government. The form and specification of the establishment of the supervision agency of a local people's government at or above the county level shall be handled in accordance with the relevant provisions on organizational establishment management.
国务院办公厅督查机构和县级以上地方人民政府督查机构统称政府督查机构。
The supervision agency of the General Office of the State Council and the supervision agencies of local people's governments at or above the county level are collectively referred to as government supervision agencies.
县级以上人民政府可以指定所属部门按照指定的事项、范围、职责、期限开展政府督查。
A people's government at or above the county level may designate its subordinate departments to carry out government supervision in accordance with the designated matters, scope, responsibilities, and time limits.
县级以上人民政府所属部门未经本级人民政府指定，不得开展政府督查。
No department under a people's government at or above the county level may carry out government supervision without being designated by the people's government at the same level.
县级以上人民政府根据工作需要，可以派出督查组。督查组按照本级人民政府确定的督查事项、范围、职责、期限开展政府督查。督查组对本级人民政府负责。
A people's government at or above the county level may dispatch supervision teams according to work needs. The supervision team shall carry out government supervision in accordance with the supervision matters, scope, responsibilities, and time limits determined by the people's government at the same level. The supervision team is responsible to the people's government at the same level.
督查组实行组长负责制，组长由本级人民政府确定。
The supervision team implements a team leader responsibility system, and the team leader is determined by the people's government at the same level.
可以邀请人大代表、政协委员、政府参事和专家学者等参加督查组。
Deputies to the People's Congress, members of the Chinese People's Political Consultative Conference, government counselors, experts and scholars, and others may be invited to participate in the supervision team.
督查人员应当具备与其从事的督查工作相适应的政治素质、工作作风、专业知识、业务能力和法律素养，遵守宪法和法律，忠于职守、秉公持正，清正廉洁、保守秘密，自觉接受监督。
Supervisors shall possess political quality, work style, professional knowledge, business ability, and legal literacy suitable for the supervision work they engage in, abide by the Constitution and laws, be loyal to their duties, be impartial, be honest and clean, keep secrets, and consciously accept supervision.
政府督查机构应当对督查人员进行政治、理论和业务培训。
Government supervision agencies shall provide political, theoretical, and professional training to supervisors.
政府督查机构履行职责所必需的经费，应当列入本级预算。
The funds necessary for the government supervision agency to perform its duties shall be included in the budget at the corresponding level.
政府督查机构根据本级人民政府的决定或者本级人民政府行政首长在职权范围内作出的指令，确定督查事项。
The government supervision agency shall determine supervision matters based on the decision of the people's government at the corresponding level or the instruction issued by the chief executive of the people's government at the corresponding level within the scope of their authority.
政府督查机构根据党中央、国务院重大决策部署，上级和本级人民政府重要工作部署，以及掌握的线索，可以提出督查工作建议，经本级人民政府行政首长批准后，确定督查事项。
The government supervision agency may, based on major decisions and deployments of the Central Committee of the Communist Party of China and the State Council, important work arrangements of the people's government at the higher level and the corresponding level, as well as clues obtained, propose supervision work suggestions, and after approval by the chief executive of the people's government at the corresponding level, determine supervision matters.
政府督查可以采取以下方式：
Government supervision may adopt the following methods:
（一）要求督查对象自查、说明情况；
(1) Requiring the supervised entity to conduct self-inspection and explain the situation;
（二）听取督查对象汇报；
(2) Listening to reports from the supervised entity;
（三）开展检查、访谈、暗访；
(3) Conducting inspections, interviews, and unannounced visits;
（四）组织座谈、听证、统计、评估；
(4) Organizing seminars, hearings, statistics, and evaluations;
（五）调阅、复制与督查事项有关的资料；
(5) Accessing and copying materials related to the supervision matter;
（六）通过信函、电话、媒体等渠道收集线索；
(6) Collecting clues through letters, telephone, media, and other channels;
（七）约谈督查对象负责人或者相关责任人；
(7) Interviewing the person in charge of the supervised entity or relevant responsible persons;
（八）运用现代信息技术手段开展“互联网+督查”。
(8) Using modern information technology means to carry out 'Internet + supervision'.
政府督查工作需要协助的，有关行政机关应当在职权范围内予以协助。
If assistance is needed for government supervision work, the relevant administrative organs shall provide assistance within the scope of their authority.
县级以上人民政府可以组织开展综合督查、专项督查、事件调查、日常督办、线索核查等政府督查工作。
People's governments at or above the county level may organize comprehensive supervision, special supervision, incident investigation, daily supervision, clue verification, and other government supervision work.
开展政府督查工作应当制定督查方案，明确督查内容、对象和范围；应当严格控制督查频次和时限，科学运用督查方式，严肃督查纪律，提前培训督查人员。
When conducting government supervision work, a supervision plan shall be formulated, specifying the content, object, and scope of supervision; the frequency and time limit of supervision shall be strictly controlled, supervision methods shall be scientifically applied, supervision discipline shall be strictly enforced, and supervision personnel shall be trained in advance.
政府督查工作应当严格执行督查方案，不得随意扩大督查范围、变更督查对象和内容，不得干预督查对象的正常工作，严禁重复督查、多头督查、越权督查。
Government supervision work shall strictly implement the supervision plan, and shall not arbitrarily expand the scope of supervision, change the object and content of supervision, or interfere with the normal work of the supervised entity. Repeated supervision, multi-head supervision, and ultra vires supervision are strictly prohibited.
县级以上人民政府在政府督查工作结束后应当作出督查结论。与督查对象有关的督查结论应当向督查对象反馈。
After the completion of government supervision work, the people's government at or above the county level shall make a supervision conclusion. The supervision conclusion related to the supervised entity shall be fed back to the supervised entity.
督查结论应当事实清楚，证据充分，客观公正。
The supervision conclusion shall be based on clear facts, sufficient evidence, and be objective and fair.
督查对象对督查结论有异议的，可以自收到该督查结论之日起30日内，向作出该督查结论的人民政府申请复核。收到申请的人民政府应当在30日内作出复核决定。参与作出督查结论的工作人员在复核中应当回避。
If the supervised entity has objections to the supervision conclusion, it may, within 30 days from the date of receiving the supervision conclusion, apply for review to the people's government that made the supervision conclusion. The people's government that receives the application shall make a review decision within 30 days. Personnel who participated in making the supervision conclusion shall recuse themselves from the review.
对于督查结论中要求整改的事项，督查对象应当按要求整改。政府督查机构可以根据工作需要，对整改情况进行核查。
For matters requiring rectification in the supervision conclusion, the supervised entity shall rectify as required. The government supervision agency may, based on work needs, verify the rectification situation.
政府督查机构可以根据督查结论，提出改变或者撤销本级或者下级人民政府及其所属部门不适当的决定、命令等规范性文件的建议，报本级人民政府或者本级人民政府行政首长。
The government supervision agency may, based on the supervision conclusion, propose suggestions to change or revoke inappropriate decisions, orders, and other normative documents of the people's government at the corresponding level or lower level and its departments, and report to the people's government at the corresponding level or its chief executive.
政府督查机构可以针对督查结论中反映的突出问题开展调查研究，真实准确地向本级人民政府或者本级人民政府行政首长报告调查研究情况。
The government supervision agency may conduct investigation and research on prominent issues reflected in the supervision conclusion, and truthfully and accurately report the investigation and research situation to the people's government at the corresponding level or its chief executive.
政府督查机构可以根据督查结论或者整改核查结果，提出对督查对象依法依规进行表扬、激励、批评等建议，经本级人民政府或者本级人民政府行政首长批准后组织实施。
The government supervision agency may, based on the supervision conclusion or the rectification verification result, propose suggestions to commend, incentivize, or criticize the supervised entity in accordance with laws and regulations, and after approval by the people's government at the corresponding level or its chief executive, organize implementation.
政府督查机构可以根据督查结论或者整改核查结果，提出对督查对象依法依规追究责任的建议，经本级人民政府或者本级人民政府行政首长批准后，交有权机关调查处理。
The government supervision agency may, based on the supervision conclusion or the rectification verification result, propose suggestions to hold the supervised entity accountable in accordance with laws and regulations, and after approval by the people's government at the corresponding level or its chief executive, submit to the competent authority for investigation and handling.
政府督查应当加强与行政执法监督、备案审查监督等的协调衔接。
Government supervision shall strengthen coordination and connection with administrative law enforcement supervision, record review supervision, and other types of supervision.
督查工作中发现公职人员涉嫌贪污贿赂、失职渎职等职务违法或者职务犯罪的问题线索，政府督查机构应当移送监察机关，由监察机关依法调查处置；发现涉嫌其他犯罪的问题线索，移送司法机关依法处理。
If during supervision work, leads are discovered that public officials are suspected of duty-related crimes such as corruption, bribery, dereliction of duty, or malfeasance, the government supervision agency shall transfer the leads to the supervisory authority, which shall investigate and handle the case according to law; if leads of other crimes are discovered, they shall be transferred to the judicial authority for handling according to law.
政府督查机构及督查人员违反本条例规定，滥用职权、徇私舞弊、玩忽职守的，泄露督查过程中所知悉的国家秘密、商业秘密、个人隐私的，或者违反廉政规定的，对负有责任的领导人员和直接责任人员依法依规给予处理；构成犯罪的，依法追究刑事责任。
If a government supervision agency or its supervisors violate these regulations by abusing power, engaging in graft, or neglecting duties; disclosing state secrets, trade secrets, or personal privacy learned during supervision; or violating integrity rules, the responsible leaders and directly responsible personnel shall be dealt with according to laws and regulations; if a crime is constituted, criminal liability shall be pursued according to law.
督查对象及其工作人员不得阻碍督查工作，不得隐瞒实情、弄虚作假，不得伪造、隐匿、毁灭证据。有上述情形的，由政府督查机构责令改正；情节严重的，依法依规追究责任。
Supervised entities and their personnel shall not obstruct supervision work, conceal the truth, engage in fraud, or forge, conceal, or destroy evidence. If any of the above circumstances occur, the government supervision agency shall order correction; if the circumstances are serious, liability shall be pursued according to laws and regulations.
对督查人员或者提供线索、反映情况的单位和个人进行威胁、打击、报复、陷害的，依法依规追究责任。
Anyone who threatens, retaliates against, or frames supervisors or units and individuals that provide leads or report circumstances shall be held liable according to laws and regulations.
县级以上人民政府及其所属部门依照有关法律法规开展的其他监督检查，按照有关法律法规规定执行。
Other supervision and inspections carried out by people's governments at or above the county level and their departments in accordance with relevant laws and regulations shall be executed in accordance with the provisions of those laws and regulations.
本条例自2021年2月1日起施行。
These Regulations shall come into force on February 1, 2021.
