总 则
General Provisions
为了强化殡葬行业公益属性，加强殡葬管理，稳妥推进殡葬改革，促进社会主义精神文明建设，制定本条例。
This Regulation is formulated to strengthen the public welfare attribute of the funeral industry, enhance funeral management, steadily advance funeral reform, and promote the construction of socialist spiritual civilization.
在中华人民共和国境内的殡葬管理适用本条例。
Funeral management within the territory of the People's Republic of China shall be governed by this Regulation.
殡葬管理坚持公益惠民、文明节俭、绿色生态，完善殡葬服务，深化殡葬移风易俗。
Funeral management shall adhere to the principles of public welfare benefiting the people, civilized and frugal practices, and green ecology; improve funeral services; and deepen the transformation of funeral customs.
国务院民政部门负责全国的殡葬管理工作。县级以上地方人民政府民政部门负责本行政区域内的殡葬管理工作。
The civil affairs department of the State Council shall be responsible for funeral management nationwide. The civil affairs departments of local people's governments at or above the county level shall be responsible for funeral management within their respective administrative regions.
县级以上人民政府发展改革部门负责按职责履行殡葬设施项目审批程序；财政部门负责按规定将必要的殡葬工作经费纳入本级预算，加强资金监督管理；自然资源部门负责殡葬设施用地审批和规划许可，依据国土空间规划将殡葬设施用地需求统筹纳入土地利用年度计划；卫生健康、中医药、疾控部门负责医疗卫生机构出具死亡证明以及太平间等暂存遗体场所的监督管理；市场监管部门负责依法查处殡葬服务机构和其他经营主体价格违法、违规收费以及垄断、不正当竞争等行为；教育、公安、生态环境、住房城乡建设、人力资源社会保障、农业农村、应急管理、民族、宗教、网信、电信、林业草原等有关部门依照本条例和其他有关法律法规的规定，在各自职责范围内做好殡葬相关工作。
The development and reform departments of people's governments at or above the county level shall be responsible for performing the approval procedures for funeral facility projects according to their duties; the finance departments shall be responsible for incorporating necessary funeral work expenses into the budgets at the corresponding level in accordance with regulations and strengthening fund supervision and management; the natural resources departments shall be responsible for the approval of land use and planning permits for funeral facilities, and based on territorial spatial planning, integrate the land use needs for funeral facilities into the annual land use plan; the health, traditional Chinese medicine, and disease control departments shall be responsible for the supervision and management of the issuance of death certificates by medical and health institutions and the temporary storage of remains in places such as mortuaries; the market supervision departments shall be responsible for investigating and punishing price violations, illegal charges, monopolistic and unfair competition behaviors of funeral service institutions and other business entities in accordance with the law; the education, public security, ecological environment, housing and urban-rural construction, human resources and social security, agriculture and rural affairs, emergency management, ethnic affairs, religious affairs, cyberspace administration, telecommunications, and forestry and grassland departments shall, in accordance with this Regulation and other relevant laws and regulations, perform funeral-related work within their respective responsibilities.
县级以上地方人民政府应当统筹、协调、督促和指导各有关部门在各自职责范围内做好殡葬管理工作。
Local people's governments at or above the county level shall coordinate, integrate, supervise, and guide all relevant departments to perform funeral management work within their respective responsibilities.
乡镇人民政府、街道办事处以及村民委员会、居民委员会依法做好殡葬相关工作。
Township people's governments, sub-district offices, villagers' committees, and residents' committees shall perform funeral-related work in accordance with the law.
殡葬事业是重要的公益事业。
The funeral industry is an important public welfare undertaking.
殡葬服务分为基础项目和非基础项目，收费政策由国务院发展改革部门、财政部门会同国务院民政等部门制定。
Funeral services are divided into basic items and non-basic items. The fee policies are formulated by the development and reform department and the finance department of the State Council together with the civil affairs department of the State Council.
国家制定殡葬服务基础项目清单，将遗体接运、遗体存放、遗体告别、遗体火化、骨灰寄存、生态安葬以及政府举办的殡葬服务机构提供的骨灰格位安葬等纳入清单范围，省、自治区、直辖市人民政府民政部门会同有关部门可以结合实际适当增加本行政区域殡葬服务基础项目。收费标准应当依法制定。
The state formulates a list of basic funeral service items, including body transport, body storage, body farewell, body cremation, ash storage, ecological burial, and ash compartment burial provided by government-run funeral service institutions. The civil affairs departments of provincial, autonomous region, and municipality people's governments, together with relevant departments, may appropriately increase the basic funeral service items in their administrative regions based on actual conditions. Fee standards shall be formulated in accordance with the law.
设区的市级以上地方人民政府民政部门会同有关部门合理确定殡葬服务非基础项目清单，对收费依法实行严格管理。
The civil affairs departments of local people's governments at or above the level of a city divided into districts, together with relevant departments, shall reasonably determine the list of non-basic funeral service items and strictly manage fees in accordance with the law.
国家逐步将具备条件的殡葬服务项目纳入国家基本公共服务范围，并动态调整。
The state will gradually include eligible funeral service items into the scope of national basic public services and make dynamic adjustments.
各级人民政府应当统筹考虑实际需要与财政承受能力，建立与群众基本殡葬服务需求相适应的殡葬事业投入机制。
People's governments at all levels shall comprehensively consider actual needs and financial affordability, and establish a funeral service investment mechanism that meets the basic funeral service needs of the public.
国家推行殡葬改革，稳妥有序实行火葬，改革土葬，节约殡葬用地。
The state promotes funeral reform, steadily and orderly implements cremation, reforms burial, and saves funeral land.
省、自治区、直辖市人民政府应当根据本行政区域人口、交通、土地资源等状况，在已划定实行火葬地区和允许土葬地区的基础上，稳步扩大实行火葬地区的范围，调整情况及时报送国务院民政部门。
Provincial, autonomous region, and municipality people's governments shall, based on the population, transportation, land resources, etc. in their administrative regions, steadily expand the scope of cremation areas on the basis of already designated cremation areas and permitted burial areas, and promptly report adjustments to the civil affairs department of the State Council.
尊重少数民族的丧葬习俗；自愿改革丧葬习俗的，他人不得干涉；鼓励采取符合生态环保、节约用地要求的殡葬方式，按照死亡地的规定处置遗体或者骨灰。
Respect the funeral customs of ethnic minorities; those who voluntarily reform funeral customs shall not be interfered with by others; encourage the adoption of funeral methods that meet ecological and environmental protection and land-saving requirements, and dispose of remains or ashes in accordance with the regulations of the place of death.
国务院民政部门统筹规划、完善全国殡葬基础信息库，及时与国家人口基础信息库实现共享，并会同国务院公安、卫生健康、人力资源社会保障等有关部门建立健全信息共享机制。
The civil affairs department of the State Council shall coordinate planning and improve the national funeral basic information database, timely share it with the national population basic information database, and establish and improve information sharing mechanisms with the public security, health, human resources and social security departments of the State Council.
省、自治区、直辖市人民政府民政部门负责统筹本行政区域殡葬服务信息系统的建设、管理和维护，将殡葬服务主体和相关从业人员纳入系统管理，提供便民殡葬服务。
The civil affairs departments of provincial, autonomous region, and municipality people's governments are responsible for coordinating the construction, management, and maintenance of the funeral service information system in their administrative regions, incorporating funeral service providers and relevant practitioners into system management, and providing convenient funeral services.
推进殡葬领域科技创新和推广应用。加强殡葬服务管理相关专业人才队伍建设。
Promote scientific and technological innovation and application in the funeral field. Strengthen the development of professional talent teams related to funeral service management.
国家机关、群团组织、基层群众性自治组织和广播、电视、报刊等媒体以及互联网平台应当加强宣传教育，引导群众积极开展殡葬移风易俗活动。
State organs, mass organizations, grassroots self-governing organizations, and media such as radio, television, newspapers, as well as internet platforms, shall strengthen publicity and education to guide the public in actively carrying out activities to change funeral customs.
任何组织和个人对违反本条例规定的行为，可以向县级以上人民政府民政部门和有关部门投诉、举报。接到投诉、举报的部门应当按照规定及时处理。
Any organization or individual may report or complain to the civil affairs department of the people's government at or above the county level and relevant departments about acts violating the provisions of these regulations. The department receiving the report or complaint shall handle it in a timely manner in accordance with regulations.
殡 葬 设 施
Funeral and Interment Facilities
殡葬设施是满足群众殡葬服务需求所必需的设施，包括殡仪馆、骨灰堂、公墓。
Funeral and interment facilities are facilities necessary to meet the public's funeral service needs, including funeral homes, cinerary caskets, and cemeteries.
殡葬服务机构为殡葬设施的运营单位。新设殡葬服务机构应当由政府举办，为非营利性机构。不得再新设立营利性殡葬服务机构。
Funeral service institutions are the operating units of funeral facilities. New funeral service institutions shall be established by the government and be non-profit institutions. No new for-profit funeral service institutions may be established.
县级以上地方人民政府民政部门应当依法加强对殡葬服务机构的管理。
The civil affairs department of the local people's government at or above the county level shall strengthen the management of funeral service institutions in accordance with the law.
县级以上地方人民政府应当将殡葬设施建设纳入相关规划，并与国土空间规划相衔接。本行政区域新建殡葬设施应当符合地方相关规划。
The local people's government at or above the county level shall incorporate funeral facility construction into relevant plans and align them with the territorial spatial plan. New funeral facilities within its administrative region shall comply with local relevant plans.
县级以上地方人民政府根据本行政区域人口规模和分布状况按需建设殡仪馆，合理设置殡仪馆的服务网点。
The local people's government at or above the county level shall build funeral homes as needed based on the population size and distribution of its administrative region, and reasonably set up service outlets for funeral homes.
县级以上地方人民政府应当结合实际配备遗体接运车，保障遗体接运需求。
The local people's government at or above the county level shall, based on actual conditions, equip vehicles for transporting remains to ensure the demand for remains transportation.
县级以上地方人民政府建设骨灰堂、公墓，应当结合本行政区域实行火葬、改革土葬以及现有土地资源等状况，按照供需适配、节地生态原则，合理确定建设类型、数量和规模。
When constructing bone ash halls or public cemeteries, local people's governments at or above the county level shall, based on the conditions of cremation implementation, burial reform, and existing land resources within their administrative regions, reasonably determine the type, quantity, and scale of construction in accordance with the principles of supply-demand adaptation and land-saving ecology.
新建殡葬设施用地按照国家有关规定以划拨方式取得国有土地使用权。
Land for new funeral facilities shall be obtained through allocation of state-owned land use rights in accordance with relevant national regulations.
殡葬设施所需的遗体接运车、遗体冷藏柜、火化机、火化污染物净化设备等殡葬设备，应当符合相关强制性标准。禁止制造、销售、使用不符合强制性标准的殡葬设备。
Funeral equipment such as body transport vehicles, body refrigerators, cremators, and cremation pollutant purification equipment required for funeral facilities shall comply with relevant mandatory standards. The manufacture, sale, or use of funeral equipment that does not meet mandatory standards is prohibited.
农村集体经济组织或者村民委员会利用村集体土地为村民设置公益性墓地，应当报县级人民政府民政部门备案。相关用地手续按照国家有关规定办理。
Rural collective economic organizations or villagers' committees that use village collective land to set up public cemeteries for villagers shall report to the civil affairs department of the county-level people's government for record. Relevant land procedures shall be handled in accordance with national regulations.
农村公益性墓地原则上不得向村民收取墓位使用相关费用，不得对村民以外的其他人员提供墓穴用地或者墓位。
In principle, rural public cemeteries shall not charge villagers fees related to the use of burial plots, and shall not provide burial plot land or burial plots to persons other than villagers.
县级以上地方人民政府应当结合实际做好农村公益性墓地的建设投入和统一管理。
Local people's governments at or above the county level shall, based on actual conditions, ensure construction investment and unified management of rural public cemeteries.
禁止建立或者恢复宗族墓地。
The establishment or restoration of clan cemeteries is prohibited.
禁止在下列地区建造坟墓：
It is prohibited to build graves in the following areas:
(一)耕地、林地；
(1) Farmland and forestland;
(二)城市公园、风景名胜区和文物保护区；
(2) Urban parks, scenic spots, and cultural relic protection areas;
(三)水库以及河流堤坝附近和水源保护区；
(3) Near reservoirs, river embankments, and water source protection areas;
(四)铁路、公路主干线两侧。
(4) On both sides of railways and major highways.
前款规定区域内现有的坟墓，除受国家保护的具有历史、艺术、科学价值的墓地予以保留外，应当采取妥善方式迁移或者深埋，不留坟头；保障当地居民基本安葬需求且无法避让前款规定区域的公墓和农村公益性墓地，可依法纳入国土空间规划，不在前款规定的情形之内。
Existing graves within the areas specified in the preceding paragraph shall be relocated or deeply buried without leaving grave mounds, except for those protected by the state for historical, artistic, or scientific value. Public cemeteries and rural public welfare cemeteries that are necessary to meet the basic burial needs of local residents and cannot avoid the areas specified in the preceding paragraph may be legally incorporated into territorial spatial planning and are not subject to the restrictions in the preceding paragraph.
殡 仪 服 务
Funeral Services
自然人正常死亡的，医疗卫生机构应当及时出具死亡证明，依托各地政务服务平台共享死亡证明信息。
In the case of natural death of a natural person, the medical and health institution shall promptly issue a death certificate and share the death certificate information through local government service platforms.
医疗卫生机构应当按规定公布殡仪馆及其服务网点的联系方式，方便丧属联系。
Medical and health institutions shall, in accordance with regulations, publish the contact information of funeral homes and their service outlets to facilitate contact by the bereaved family.
涉及公安机关依法处置且未经医疗卫生机构救治的非正常死亡案(事)件的逝者，由公安机关出具死亡证明。
For deceased persons involved in non-natural death cases (incidents) handled by public security organs in accordance with the law and who have not received medical treatment from medical and health institutions, the public security organs shall issue a death certificate.
县级以上地方人民政府卫生健康、中医药、疾控部门和民政部门应当加强医疗卫生机构与殡仪馆的衔接配合。
The health, traditional Chinese medicine, disease control departments, and civil affairs departments of local people's governments at or above the county level shall strengthen the coordination and cooperation between medical and health institutions and funeral homes.
医疗卫生机构的太平间不得外包，不得开展殡仪服务，可以为遗体暂时停放提供便利服务。
The morgues of medical and health institutions shall not be outsourced and shall not provide funeral services; they may provide convenience services for temporary storage of remains.
遗体接运、存放、防腐、整容、火化服务，由殡仪馆专门负责提供。
Services for the transport, storage,anticorrosion, embalming, and cremation of remains shall be exclusively provided by funeral homes.
殡仪馆应当凭死亡证明及时接运遗体，并对遗体进行必要的卫生技术处理。接运遗体时，发现遗体状况与死亡证明所载死因明显不符的，应当立即向公安机关报告。
Funeral homes shall promptly transport remains based on a death certificate and perform necessary sanitary treatment. If, during transport, the condition of the remains is clearly inconsistent with the cause of death stated on the certificate, the funeral home shall immediately report to the public security authority.
殡仪馆存放遗体一般不超过3日，需要延期存放的，丧属或者遗体移交方应当在殡仪馆办理延期存放手续，并按规定交纳延期存放费用。
Funeral homes shall generally store remains for no more than 3 days. If an extension is needed, the bereaved family or the party transferring the remains shall apply for an extension at the funeral home and pay the required fees.
殡仪馆应当凭死亡证明和火化确认书火化遗体，并出具火化证明。
Funeral homes shall cremate remains based on a death certificate and a cremation confirmation document, and issue a cremation certificate.
殡仪馆应当在遗体存放、火化等重点区域安装图像采集设备，并将收集的视频图像信息保存不少于90日备查。
Funeral homes shall install image capture equipment in key areas such as storage and cremation rooms, and retain the collected video footage for no less than 90 days for inspection.
在实行火葬的地区，遗体应当就地、就近在殡仪馆火化。确需跨区域运输遗体的，丧属应当凭运输目的地民政部门出具的遗体接收证明联系殡仪馆运输遗体。
In areas where cremation is practiced, remains shall be cremated locally or nearby at a funeral home. If cross-region transport of remains is necessary, the bereaved family shall contact the funeral home for transport based on a remains acceptance certificate issued by the civil affairs department of the destination.
需要跨国(境)运输遗体、骸骨的，按照国家有关规定办理。
For cross-border (overseas) transport of remains or skeletons, the relevant national regulations shall apply.
身份不明、无人认领、交通事故中当场死亡以及因其他突发事件死亡等特殊情形的死亡证明出具、遗体处置的办法，由国务院民政部门会同国务院公安部门、卫生健康部门等制定。
Procedures for issuing death certificates and handling remains in special circumstances such as unidentified remains, unclaimed remains, deaths at traffic accident scenes, and deaths from other emergencies shall be formulated by the civil affairs department of the State Council jointly with the public security department and the health department of the State Council.
安 葬 服 务
Interment Services
推行不占地或者少占地的安葬方式，倡导使用绿色环保丧葬用品，减少墓地石化、硬化。
Interment methods that do not occupy land or occupy less land shall be promoted, and the use of environmentally friendly funeral supplies shall be encouraged to reduce petrification and hardening of cemeteries.
在实行火葬的地区，鼓励和引导骨灰海葬、树葬、花葬、草坪葬等安葬方式；在允许土葬的地区，鼓励和引导遗体深埋、不留坟头、不硬化、不立碑等安葬方式。
In areas where cremation is practiced, interment methods such as sea burial, tree burial, flower burial, and lawn burial of ashes shall be encouraged and guided; in areas where burial is permitted, interment methods such as deep burial of remains without grave mounds, hardening, or tombstones shall be encouraged and guided.
对按照前款规定方式实施生态安葬的，有条件的地方可以给予适当补贴。
For those who implement ecological burial in accordance with the methods prescribed in the preceding paragraph, local governments with the conditions may provide appropriate subsidies.
各地可以按照国家有关规定结合实际在适当场所划定一定区域，实施生态安葬。
Local governments may, in accordance with relevant national regulations and based on actual conditions, designate certain areas in appropriate locations to implement ecological burial.
国家倡导骨灰格位安葬。骨灰堂不收取或者适当收取格位使用费、维护管理费。
The state advocates forash niche burial. Columbaria may charge no fee or an appropriate fee for the use of niches and maintenance management.
禁止在骨灰堂内设置私人祠堂。
It is prohibited to set up private ancestral halls within columbaria.
公墓应当以节地生态安葬为导向，推行墓位和墓碑小型化，并划定一定区域实施生态安葬和骨灰格位安葬。
Cemeteries shall be oriented towards land-saving ecological burial, promote the miniaturization of grave plots and tombstones, and designate certain areas for ecological burial andash niche burial.
县级以上地方人民政府民政部门应当严格限制公墓墓位占地面积和墓碑高度，具体标准由国务院民政部门制定。
The civil affairs departments of local people's governments at or above the county level shall strictly limit the land area of cemetery plots and the height of tombstones. Specific standards shall be formulated by the civil affairs department of the State Council.
禁止变相扩大墓位占地面积或者使用高档材料。禁止设置违背公序良俗的标志物。
It is prohibited to covertly expand the land area of grave plots or use high-end materials. It is prohibited to set up markers that violate public order and good customs.
骨灰堂、公墓应当凭死亡证明、火化证明等有关证明材料提供骨灰格位、公墓墓位。为高龄老人、危重病人等提供骨灰格位、公墓墓位的除外。
Columbaria and cemeteries shall provideash niche niches and cemetery plots only upon presentation of relevant certificates such as death certificates and cremation certificates, except when providing niches or plots for the elderly or critically ill patients.
骨灰格位、公墓墓位一个使用周期不超过20年。使用周期届满，可以办理续用手续并交纳维护管理费。
The usage period for aash niche niche or cemetery plot shall not exceed 20 years. Upon expiration of the usage period, renewal procedures may be completed and maintenance management fees paid.
骨灰堂、公墓的运营单位应当按规定提取费用建立维护基金，在当地民政部门的监督下实行专账管理，用于后续维护和管理。
Operating units of columbaria and cemeteries shall, in accordance with regulations, set aside funds to establish a maintenance fund, which shall be managed under a special account under the supervision of the local civil affairs department, and used for subsequent maintenance and management.
禁止将居民住宅专门用于安放骨灰。禁止在公墓、农村公益性墓地以及依法实施生态安葬的区域以外的地方埋葬遗体、建造坟墓。
It is prohibited to specially use residential houses for storing cremains. It is prohibited to bury remains or build graves outside of cemeteries, rural public cemeteries, and areas where ecological burial is lawfully implemented.
丧 事 活 动
Funeral Activities
办理丧事活动应当遵守法律法规和社会公德，不得妨碍公共秩序、危害公共安全，不得侵害他人的合法权益，不得违背公序良俗。
Funeral activities shall comply with laws, regulations, and social ethics, and shall not disrupt public order, endanger public safety, infringe upon the lawful rights and interests of others, or violate public order and good customs.
鼓励农村红白理事会等组织发挥作用，协助群众文明节俭办理丧事活动，引导移风易俗。
Organizations such as rural red and white councils are encouraged to play a role in assisting the public to conduct funeral activities in a civilized and frugal manner, and to guide the transformation of customs.
县级以上地方人民政府民政部门应当加强宣传，引导群众在殡仪馆及其服务网点办理告别等丧事活动。
The civil affairs departments of local people's governments at or above the county level shall strengthen publicity and guide the public to conduct farewell and other funeral activities at funeral homes and their service outlets.
除殡葬服务机构外，从事殡葬服务代理、用品代购、策划主持、信息咨询等殡葬相关服务活动的组织和个人，应当向县级人民政府民政部门备案。
Except for funeral service institutions, organizations and individuals engaged in funeral-related service activities such as funeral service agency, product procurement, planning and hosting, and information consulting shall register with the civil affairs department of the county-level people's government.
县级人民政府民政部门将从事殡葬相关服务活动的组织和个人纳入殡葬服务信息系统和殡葬行业组织管理，对存在以欺骗等手段违规收费、诱导大操大办、强迫接受服务、倒卖逝者信息等损害丧属权益行为的依法处置，并在殡葬服务信息系统中进行标注，向社会公开。
The civil affairs department of the county-level people's government shall include organizations and individuals engaged in funeral-related service activities into the funeral service information system and funeral industry organization management, and shall lawfully handle those who engage in acts that harm the rights and interests of the bereaved, such as illegally charging fees by deception, inducing extravagant ceremonies, forcing acceptance of services, and trafficking in the deceased's information, and shall mark them in the funeral service information system and make them public.
殡葬服务机构不得违反有关规定擅自设立收费项目，或者采取分解项目、扩大范围收费等形式变相提高收费标准。
Funeral service institutions shall not, in violation of relevant regulations, arbitrarily establish charging items, or disguise price increases by splitting items or expanding the scope of charges.
殡葬服务机构、销售丧葬用品的经营主体以及从事殡葬相关服务活动的组织和个人不得实施下列价格违法行为：
Funeral service institutions, business entities selling funeral supplies, and organizations and individuals engaged in funeral-related service activities shall not commit the following illegal pricing acts:
(一)不按规定明码标价，或者在标价之外加价或者收取未标明的费用；
(1) Failing to clearly mark prices as required, or adding prices beyond the marked prices or charging unmarked fees;
(二)利用虚假的或者使人误解的价格手段，诱骗丧属与其进行交易；
(2) Using false or misleading pricing methods to induce the bereaved family to engage in transactions;
(三)采取捆绑、附加不合理条件或者不合理限制等方式，强制或者变相强制销售丧葬用品、提供殡葬相关服务并收取费用；
(3) Bundling, attaching unreasonable conditions or restrictions, forcing or covertly forcing the sale of funeral supplies, providing funeral-related services and charging fees;
(四)强制或者变相强制丧属接受第三方的有偿服务，或者利用相关服务网点重复收取费用；
(4) Forcing or covertly forcing the bereaved family to accept paid services from third parties, or using relevant service outlets to repeatedly charge fees;
(五)法律法规以及国家有关规定禁止的其他价格违法行为。
(5) Other illegal pricing acts prohibited by laws, regulations, and relevant state provisions.
前款规定的单位、组织，不得达成或者实施排除、限制竞争的垄断协议；具有市场支配地位的，不得滥用市场支配地位。
The units and organizations specified in the preceding paragraph shall not reach or implement monopoly agreements that exclude or restrict competition; those with market dominance shall not abuse their market dominance.
禁止制造、销售违反法律法规或者违背公序良俗的丧葬用品。
It is prohibited to manufacture or sell funeral supplies that violate laws, regulations, or public order and good customs.
禁止向实行火葬的地区销售棺材等土葬用品。
It is prohibited to sell coffins and other burial supplies to areas where cremation is practiced.
国家倡导文明、低碳、安全祭扫。
The state advocates civilized, low-carbon, and safe memorial activities.
网络祭扫服务平台应当遵守法律法规，遵循公序良俗，加强逝者信息保护，不得诱导消费，不得违法违规处理逝者信息或者发布、传播法律法规禁止的信息。
Online memorial service platforms shall comply with laws and regulations, follow public order and good customs, strengthen the protection of the deceased's information, shall not induce consumption, and shall not illegally process the deceased's information or publish or disseminate information prohibited by laws and regulations.
乡镇人民政府、街道办事处以及村民委员会、居民委员会可以利用适宜的场地，为群众提供治丧便利。
Township people's governments, subdistrict offices, villagers' committees, and residents' committees may use suitable venues to provide convenience for the public to hold funeral services.
监 督 管 理
Supervision and Management
县级以上地方人民政府应当制定涵盖殡葬活动全链条的监管事项清单，加强部门间情况通报和执法协作配合。县级以上地方人民政府民政部门和有关部门应当依法履行职责，对殡葬活动进行监督检查。
Local people's governments at or above the county level shall formulate a list of regulatory matters covering the entire chain of funeral and interment activities, and strengthen information sharing and law enforcement coordination among departments. The civil affairs departments and relevant departments of local people's governments at or above the county level shall perform their duties according to law and conduct supervision and inspection of funeral and interment activities.
县级以上地方人民政府应当加强对殡葬工作的定期督导，支持、督促各有关部门依法履行职责。

县级以上地方人民政府民政、自然资源、水利、林业草原、文物等部门应当综合运用现代技术手段，及时发现和处置殡葬违法行为。
The civil affairs, natural resources, water resources, forestry and grassland, cultural relics and other departments of local people's governments at or above the county level shall comprehensively use modern technical means to promptly discover and handle illegal acts in funeral and interment.
县级以上地方人民政府民政部门应当建立健全对殡葬设施建设运营、公墓安葬标准、丧事活动管理等事项的随机抽查机制。抽查情况以及查处结果应当书面告知被抽查对象，并依法向社会公开。
The civil affairs departments of local people's governments at or above the county level shall establish and improve a random inspection mechanism for matters such as the construction and operation of funeral facilities, burial standards in cemeteries, and management of funeral activities. The inspection situation and handling results shall be notified in writing to the inspected entity and made public according to law.
殡葬服务实行清单化管理并动态调整，禁止在清单之外设立项目、收取费用。
Funeral services shall be managed by a list and dynamically adjusted. It is prohibited to set up items or charge fees outside the list.
县级以上人民政府民政部门会同有关部门依法对殡葬服务加强价格监测和监督管理，遏制过高收费。
The civil affairs departments of people's governments at or above the county level shall, together with relevant departments, strengthen price monitoring and supervision of funeral services according to law, and curb excessively high charges.
县级以上地方人民政府民政部门应当建立与政务服务便民热线等监督渠道的信息共享监督机制，对丧属反映的殡葬服务问题，应当会同有关部门及时予以处理并将处理结果告知丧属。
The civil affairs departments of local people's governments at or above the county level shall establish an information sharing supervision mechanism with supervision channels such as government service hotlines. For funeral service issues reported by bereaved families, they shall, together with relevant departments, promptly handle them and inform the bereaved families of the handling results.
殡葬服务机构应当每年向所属的民政部门报送年度工作报告、财务审计报告。年度工作报告应当包括日常运营、服务管理、安全生产、接受奖惩等情况。上一级民政部门可以通过抽查年度工作报告、财务审计报告的方式，对殡葬服务机构实施监督检查。
Funeral service institutions shall submit an annual work report and financial audit report to the civil affairs department to which they belong each year. The annual work report shall include daily operations, service management, production safety, and rewards and punishments received. The civil affairs department at the next higher level may conduct supervision and inspection of funeral service institutions by randomly checking annual work reports and financial audit reports.
县级以上地方人民政府民政部门应当按照国家有关规定建立殡葬服务主体和相关从业人员信用记录制度，将相关信息纳入全国信用信息共享平台，依法开展失信惩戒。
The civil affairs departments of local people's governments at or above the county level shall, in accordance with relevant state regulations, establish a credit record system for funeral service entities and relevant practitioners, incorporate relevant information into the national credit information sharing platform, and carry out disciplinary actions for dishonesty according to law.
殡葬行业组织应当加强行业自律，引导殡葬服务机构守法、诚信、安全经营。殡葬行业从业人员应当遵守职业道德，规范文明服务。
Funeral industry organizations shall strengthen industry self-discipline and guide funeral service institutions to operate in compliance with laws, with integrity, and safely. Practitioners in the funeral industry shall abide by professional ethics and provide standardized and civilized services.
国家鼓励公民、法人和其他组织对殡葬工作进行社会监督。
The State encourages citizens, legal persons, and other organizations to exercise social supervision over funeral work.
法 律 责 任
Legal Liability
殡葬服务机构有下列情形之一的，由县级以上地方人民政府民政部门责令限期改正，给予警告，没收违法所得；没有违法所得或者违法所得不足10万元的，视情节轻重、危害程度等情况处5万元以上20万元以下的罚款；违法所得10万元以上的，处违法所得2倍以上5倍以下的罚款。对负有责任的领导人员和直接责任人员，依法给予处分：
Where a funeral service institution falls under any of the following circumstances, the civil affairs department of the local people's government at or above the county level shall order correction within a time limit, issue a warning, and confiscate illegal gains; if there are no illegal gains or the illegal gains are less than 100,000 yuan, a fine of not less than 50,000 yuan but not more than 200,000 yuan shall be imposed depending on the severity of the circumstances and the degree of harm; if the illegal gains are 100,000 yuan or more, a fine of not less than two times but not more than five times the illegal gains shall be imposed. The responsible leaders and directly responsible personnel shall be given sanctions according to law:
(一)违反本条例规定接运、存放、火化遗体，或者未按规定保存相关视频图像信息；
(1) Transporting, storing, or cremating remains in violation of these Regulations, or failing to preserve relevant video image information as required;
(二)违反本条例规定出具火化证明或者虚开、伪造、倒卖火化证明；
(2) Issuing cremation certificates in violation of these Regulations, or falsely issuing, forging, or trafficking cremation certificates;
(三)违反本条例规定提供骨灰格位、墓位，设置违背公序良俗的标志物；
(3) Providing ash compartments or burial plots in violation of these Regulations, or setting up markers that violate public order and good customs;
(四)未按照本条例规定报送年度工作报告、财务审计报告或者接受监督检查；
(4) Failing to submit annual work reports, financial audit reports, or accept supervision and inspection as required by these Regulations;
(五)法律法规规定的其他情形。
(5) Other circumstances as provided by laws and regulations.
在骨灰堂内设置私人祠堂的，在公墓内提供超规定标准墓位、变相扩大墓位占地面积，或者使用高档材料的，由县级以上地方人民政府民政部门责令限期改正，给予警告，没收违法所得；没有违法所得或者违法所得不足50万元的，视情节轻重、危害程度等情况处10万元以上100万元以下的罚款；违法所得50万元以上的，处违法所得2倍以上5倍以下的罚款。对负有责任的领导人员和直接责任人员，依法给予处分。
Where a private ancestral hall is set up in a columbarium, or burial plots exceeding the prescribed standards are provided in a cemetery, the land area of burial plots is expanded in disguised form, or high-grade materials are used, the civil affairs department of the local people's government at or above the county level shall order correction within a time limit, issue a warning, and confiscate illegal gains; if there are no illegal gains or the illegal gains are less than 500,000 yuan, a fine of not less than 100,000 yuan but not more than 1,000,000 yuan shall be imposed depending on the severity of the circumstances and the degree of harm; if the illegal gains are 500,000 yuan or more, a fine of not less than two times but not more than five times the illegal gains shall be imposed. The responsible leaders and directly responsible personnel shall be given sanctions according to law.
违反规定擅自建设殡葬设施的，或者擅自变更殡葬设施占地面积、用途的，依照城乡规划、土地管理等有关法律、行政法规给予处罚。
Anyone who, in violation of regulations, constructs funeral facilities without authorization, or unauthorizedly changes the land area or use of funeral facilities, shall be penalized in accordance with relevant laws and administrative regulations on urban and rural planning, land management, etc.
农村公益性墓地以营利为目的提供墓穴用地或者墓位的，由县级人民政府民政部门责令改正；有违法所得的，没收违法所得，并处违法所得1倍以上5倍以下的罚款。对负有责任的领导人员和直接责任人员，依法给予处分。
If a rural public cemetery provides grave land or grave plots for profit, the civil affairs department of the county-level people's government shall order correction; if there is illegal income, the illegal income shall be confiscated, and a fine of not less than one time but not more than five times the illegal income shall be imposed. The responsible leaders and directly responsible personnel shall be given sanctions according to law.
将应当火化的遗体土葬，或者在公墓、农村公益性墓地以及依法实施生态安葬的区域以外的地方埋葬遗体、建造坟墓的，由县级以上地方人民政府民政部门责令限期改正。
Anyone who buries a body that should be cremated, or buries a body or builds a grave outside public cemeteries, rural public cemeteries, or areas where ecological burial is implemented according to law, shall be ordered by the civil affairs department of the local people's government at or above the county level to make corrections within a specified period.
建立或者恢复宗族墓地的，由县级以上地方人民政府民政部门责令限期改正，并视情节轻重、危害程度等情况处1万元以上5万元以下的罚款。
Anyone who establishes or restores a clan cemetery shall be ordered by the civil affairs department of the local people's government at or above the county level to make corrections within a specified period, and shall be fined not less than 10,000 yuan but not more than 50,000 yuan depending on the severity of the circumstances and the degree of harm.
违反本条例规定在禁止区域建造坟墓的，依照土地管理、森林等有关法律、行政法规给予处罚。
Anyone who, in violation of these regulations, builds a grave in a prohibited area shall be penalized in accordance with relevant laws and administrative regulations on land management, forestry, etc.
有下列情形之一的，由县级以上地方人民政府民政部门会同市场监管部门责令改正，没收违法所得；没有违法所得或者违法所得不足10万元的，处3万元以上20万元以下的罚款；违法所得10万元以上的，处违法所得2倍以上5倍以下的罚款：
In any of the following circumstances, the civil affairs department of the local people's government at or above the county level, together with the market supervision department, shall order correction and confiscate illegal income; if there is no illegal income or the illegal income is less than 100,000 yuan, a fine of not less than 30,000 yuan but not more than 200,000 yuan shall be imposed; if the illegal income is 100,000 yuan or more, a fine of not less than two times but not more than five times the illegal income shall be imposed:
(一)制造、销售、使用不符合强制性标准的殡葬设备；
(1) Manufacturing, selling, or using funeral equipment that does not meet mandatory standards;
(二)制造、销售违反法律法规或者违背公序良俗的丧葬用品；
(2) Manufacturing or selling funeral items that violate laws, regulations, or public order and good customs;
(三)向实行火葬的地区销售棺材等土葬用品。
(3) Selling coffins or other burial items to areas where cremation is practiced.
丧葬用品仿制或者使用人民币图样的，依照人民币管理有关法律、行政法规给予处罚。
If funeral items imitate or use the pattern of RMB, penalties shall be imposed in accordance with relevant laws and administrative regulations on RMB management.
将太平间外包或者在太平间开展殡仪服务的，由县级以上地方人民政府卫生健康、中医药、疾控部门依照职责责令改正，给予警告，没收违法所得；没有违法所得或者违法所得不足10万元的，处3万元以上20万元以下的罚款；违法所得10万元以上的，处违法所得2倍以上5倍以下的罚款。对负有责任的领导人员和直接责任人员，依法给予处分。
Where a morgue is outsourced or funeral service activities are conducted in a morgue, the health, traditional Chinese medicine, and disease control departments of the local people's government at or above the county level shall, within their respective duties, order correction, issue a warning, and confiscate illegal gains; if there are no illegal gains or the illegal gains are less than 100,000 yuan, a fine of not less than 30,000 yuan but not more than 200,000 yuan shall be imposed; if the illegal gains are 100,000 yuan or more, a fine of not less than two times but not more than five times the illegal gains shall be imposed. The responsible leaders and directly responsible personnel shall be given sanctions according to law.
其他组织或者个人擅自进行遗体接运、存放、防腐、整容、火化的，由县级以上地方人民政府民政部门责令改正，给予警告，没收违法所得；没有违法所得或者违法所得不足10万元的，处5万元以上20万元以下的罚款；违法所得10万元以上的，处违法所得2倍以上5倍以下的罚款。
Where any other organization or individual, without authorization, engages in the transportation, storage, embalming, grooming, or cremation of human remains, the civil affairs department of the local people's government at or above the county level shall order correction, issue a warning, and confiscate illegal gains; if there are no illegal gains or the illegal gains are less than 100,000 yuan, a fine of not less than 50,000 yuan but not more than 200,000 yuan shall be imposed; if the illegal gains are 100,000 yuan or more, a fine of not less than two times but not more than five times the illegal gains shall be imposed.
将居民住宅专门用于安放骨灰造成不良影响，或者违反本条例规定办理丧事活动的，由县级以上地方人民政府民政部门会同有关部门依照职责责令改正，进行教育。
Where a residential dwelling is specially used for storing cremains and causes adverse effects, or where funeral activities are conducted in violation of these Regulations, the civil affairs department of the local people's government at or above the county level shall, together with relevant departments within their respective duties, order correction and provide education.
从事殡葬相关服务活动的组织和个人，存在损害丧属权益行为的，应当依法承担民事责任。违反其他法律法规的，按照有关规定处理。
Organizations and individuals engaged in funeral-related service activities that infringe upon the rights and interests of the bereaved shall bear civil liability according to law. If other laws or regulations are violated, the matter shall be handled in accordance with relevant provisions.
存在本条例第四十二条、第四十三条第一款规定的价格违法行为的，依照价格管理有关法律、行政法规和规章给予处罚；有关法律、行政法规和规章没有规定的，由县级以上地方人民政府市场监管部门责令改正，没收违法所得，并处违法所得5倍以下的罚款；没有违法所得的，处5万元以上50万元以下的罚款，情节较重的处50万元以上100万元以下的罚款；情节严重的，并处责令停业整顿或者吊销营业执照。
Where there is a price violation as specified in Articles 42 and 43(1) of these Regulations, punishment shall be imposed in accordance with relevant laws, administrative regulations, and rules on price management; if no such provisions exist, the market supervision department of the local people's government at or above the county level shall order correction, confiscate illegal gains, and impose a fine of not more than five times the illegal gains; if there are no illegal gains, a fine of not less than 50,000 yuan but not more than 500,000 yuan shall be imposed, and for serious circumstances, a fine of not less than 500,000 yuan but not more than 1,000,000 yuan; if the circumstances are especially serious, the violator may also be ordered to suspend business for rectification or have its business license revoked.
存在本条例第四十三条第二款规定的违法行为的，依照反垄断有关法律予以处理。
Where there is an illegal act as specified in Article 43(2) of these Regulations, the matter shall be handled in accordance with relevant anti-monopoly laws.
网络祭扫服务平台违反本条例规定的，由县级以上地方人民政府民政、公安、网信、电信等部门依照职责责令改正，给予警告；拒不改正或者情节严重的，处10万元以上30万元以下的罚款，并可责令停业整顿、予以关闭。
Where an online memorial service platform violates these Regulations, the civil affairs, public security, cyberspace administration, and telecommunications departments of the local people's government at or above the county level shall, within their respective duties, order correction and issue a warning; if the violator refuses to correct or the circumstances are serious, a fine of not less than 100,000 yuan but not more than 300,000 yuan shall be imposed, and the platform may be ordered to suspend business for rectification or be shut down.
县级以上地方人民政府以及有关部门工作人员、殡葬服务机构工作人员在殡葬工作中有下列行为之一的，依法给予处分：
Where staff members of the local people's government at or above the county level and relevant departments, or staff members of funeral service institutions, commit any of the following acts in funeral work, they shall be given sanctions according to law:
(一)在殡葬设施建设、殡葬设备采购、丧葬用品采购以及销售等事项上为他人谋取利益；
(1) Seeking benefits for others in matters such as funeral facility construction, funeral equipment procurement, funeral supplies procurement, and sales;
(二)利用工作之便索取或者非法收受财物；
(2) Soliciting or illegally accepting property by taking advantage of their position.
(三)对不符合本条例规定的殡葬设施予以批准、建设；
(3) Approving or constructing funeral facilities that do not comply with these Regulations;
(四)对违法问题隐瞒不报或者处置不当，造成生态破坏、公共财产损失或者不良社会影响；
(4) Concealing or improperly handling illegal issues, causing ecological damage, public property loss, or adverse social impact;
(五)其他滥用职权、玩忽职守、徇私舞弊行为。
(5) Other acts of abuse of power, dereliction of duty, or engaging in malpractice for personal gain.
利用工作之便索取或者非法收受的财物，应当予以没收、追缴或者责令退赔。
Any property obtained by taking advantage of one's position or illegally accepted shall be confiscated, recovered, or ordered to be returned.
在殡葬管理和服务中，发现有倒卖遗体、人体组织和器官等涉嫌犯罪行为的，应当依法移送公安机关查处。
If, in the course of funeral management and services, suspected criminal activities such as trafficking in human remains, human tissues, or organs are discovered, the matter shall be transferred to the public security organs for investigation and handling in accordance with the law.
违反本条例规定，构成违反治安管理行为的，由公安机关依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
Any violation of these Regulations that constitutes a violation of public security administration shall be subject to public security administrative penalties by the public security organs in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
附 则
Supplementary Provisions
本条例自2026年3月30日起施行。
These Regulations shall take effect on March 30, 2026.
