总则
General Provisions
为了加快农田水利发展，提高农业综合生产能力，保障国家粮食安全，制定本条例。
These Regulations are formulated to accelerate the development of farmland water conservancy, improve comprehensive agricultural production capacity, and ensure national food security.
农田水利规划的编制实施、农田水利工程建设和运行维护、农田灌溉和排水等活动，适用本条例。
These Regulations apply to the formulation and implementation of farmland water conservancy plans, the construction, operation and maintenance of farmland water conservancy projects, and farmland irrigation and drainage activities.
本条例所称农田水利，是指为防治农田旱、涝、渍和盐碱灾害，改善农业生产条件，采取的灌溉、排水等工程措施和其他相关措施。
For the purposes of these Regulations, "farmland water conservancy" refers to engineering measures such as irrigation and drainage, and other related measures taken to prevent and control drought, waterlogging, waterlogging and salinization disasters on farmland, and to improve agricultural production conditions.
发展农田水利，坚持政府主导、科学规划、因地制宜、节水高效、建管并重的原则。
The development of farmland water conservancy shall adhere to the principles of government leadership, scientific planning, adaptation to local conditions, water-saving and high efficiency, and equal emphasis on construction and management.
县级以上人民政府应当加强对农田水利工作的组织领导，采取措施保障农田水利发展。
People's governments at or above the county level shall strengthen organizational leadership over farmland water conservancy work and take measures to ensure the development of farmland water conservancy.
国务院水行政主管部门负责全国农田水利的管理和监督工作。国务院有关部门按照职责分工做好农田水利相关工作。
The water administrative department of the State Council shall be responsible for the management and supervision of farmland water conservancy nationwide. The relevant departments of the State Council shall do a good job in farmland water conservancy related work according to their respective functions and duties.
县级以上地方人民政府水行政主管部门负责本行政区域农田水利的管理和监督工作。县级以上地方人民政府有关部门按照职责分工做好农田水利相关工作。
The water administrative departments of local people's governments at or above the county level shall be responsible for the management and supervision of farmland water conservancy within their respective administrative regions. The relevant departments of local people's governments at or above the county level shall do a good job in farmland water conservancy related work according to their respective functions and duties.
乡镇人民政府应当协助上级人民政府及其有关部门做好本行政区域农田水利工程建设和运行维护等方面的工作。
Township people's governments shall assist the people's governments at higher levels and their relevant departments in carrying out the construction, operation and maintenance of farmland water conservancy projects within their respective administrative regions.
国家鼓励和引导农村集体经济组织、农民用水合作组织、农民和其他社会力量进行农田水利工程建设、经营和运行维护，保护农田水利工程设施，节约用水，保护生态环境。
The State encourages and guides rural collective economic organizations, farmers' water user associations, farmers and other social forces to carry out the construction, operation and maintenance of farmland water conservancy projects, protect farmland water conservancy project facilities, save water, and protect the ecological environment.
国家依法保护农田水利工程投资者的合法权益。
The State shall protect the legitimate rights and interests of investors in farmland water conservancy projects in accordance with the law.
规划
Planning
国务院水行政主管部门负责编制全国农田水利规划，征求国务院有关部门意见后，报国务院或者国务院授权的部门批准公布。
The water administrative department of the State Council shall be responsible for formulating the national farmland water conservancy plan, which shall be submitted to the State Council or the department authorized by the State Council for approval and promulgation after soliciting opinions from the relevant departments of the State Council.
县级以上地方人民政府水行政主管部门负责编制本行政区域农田水利规划，征求本级人民政府有关部门意见后，报本级人民政府批准公布。
The water administrative departments of local people's governments at or above the county level shall be responsible for formulating farmland water conservancy plans for their respective administrative regions, which shall be submitted to the people's government at the same level for approval and promulgation after soliciting opinions from the relevant departments of the people's government at the same level.
编制农田水利规划应当统筹考虑经济社会发展水平、水土资源供需平衡、农业生产需求、灌溉排水发展需求、环境保护等因素。
The formulation of farmland water conservancy plans shall take into account factors such as the level of economic and social development, the balance of supply and demand of water and soil resources, agricultural production needs, irrigation and drainage development needs, and environmental protection.
农田水利规划应当包括发展思路、总体任务、区域布局、保障措施等内容；县级农田水利规划还应当包括水源保障、工程布局、工程规模、生态环境影响、工程建设和运行维护、技术推广、资金筹措等内容。
Farmland water conservancy plans shall include development ideas, overall tasks, regional layout, safeguard measures, etc.; county-level farmland water conservancy plans shall also include water source guarantee, project layout, project scale, ecological and environmental impact, project construction and operation maintenance, technology promotion, and fund raising.
县级以上人民政府应当组织开展农田水利调查。农田水利调查结果是编制农田水利规划的依据。
People's governments at or above the county level shall organize and carry out farmland water conservancy surveys. The results of farmland water conservancy surveys shall be the basis for formulating farmland water conservancy plans.
县级人民政府水行政主管部门编制农田水利规划，应当征求农村集体经济组织、农民用水合作组织、农民等方面的意见。
When formulating farmland water conservancy plans, the water administrative departments of county people's governments shall solicit opinions from rural collective economic organizations, farmers' water user associations, farmers, and other parties.
下级农田水利规划应当根据上级农田水利规划编制，并向上一级人民政府水行政主管部门备案。
Lower-level farmland water conservancy plans shall be formulated based on higher-level farmland water conservancy plans and shall be submitted to the water administrative department of the people's government at the next higher level for recordation.
经批准的农田水利规划是农田水利建设和管理的依据。农田水利规划确需修改的，应当按照原审批程序报送审批。
Approved farmland water conservancy plans shall be the basis for farmland water conservancy construction and management. If a farmland water conservancy plan needs to be modified, it shall be submitted for approval in accordance with the original approval procedures.
县级以上人民政府水行政主管部门和其他有关部门按照职责分工负责实施农田水利规划。
The water administrative departments of people's governments at or above the county level and other relevant departments shall be responsible for implementing farmland water conservancy plans according to their respective functions and duties.
县级以上人民政府水行政主管部门应当会同本级人民政府有关部门对农田水利规划实施情况进行评估，并将评估结果向本级人民政府报告。
The water administrative departments of people's governments at or above the county level shall, together with the relevant departments of the people's government at the same level, evaluate the implementation of farmland water conservancy plans and report the evaluation results to the people's government at the same level.
编制土地整治、农业综合开发等规划涉及农田水利，应当与农田水利规划相衔接，并征求本级人民政府水行政主管部门的意见。
When formulating plans such as land consolidation and comprehensive agricultural development that involve farmland water conservancy, they shall be coordinated with farmland water conservancy plans and opinions from the water administrative department of the people's government at the same level shall be solicited.
工程建设
Project Construction
县级人民政府应当根据农田水利规划组织制定农田水利工程建设年度实施计划，统筹协调有关部门和单位安排的与农田水利有关的各类工程建设项目。
The people's government at the county level shall, in accordance with the farmland water conservancy plan, organize the formulation of an annual implementation plan for the construction of farmland water conservancy projects, and coordinate the various types of engineering construction projects related to farmland water conservancy arranged by relevant departments and units.
乡镇人民政府应当协调农村集体经济组织、农民用水合作组织以及其他社会力量开展农田水利工程建设的有关工作。
The people's government at the township level shall coordinate rural collective economic organizations, farmer water user associations, and other social forces to carry out relevant work for the construction of farmland water conservancy projects.
农田水利工程建设应当符合国家有关农田水利标准。
The construction of farmland water conservancy projects shall comply with the relevant national standards for farmland water conservancy.
农田水利标准由国务院标准化主管部门、水行政主管部门以及省、自治区、直辖市人民政府标准化主管部门、水行政主管部门依照法定程序和权限组织制定。
Farmland water conservancy standards shall be formulated by the standardization administrative department of the State Council, the water administrative department, and the standardization administrative departments and water administrative departments of provinces, autonomous regions, and municipalities directly under the Central Government in accordance with statutory procedures and authority.
农田水利工程建设应当节约集约使用土地。县级以上人民政府应当根据农田水利规划，保障农田水利工程建设用地需求。
The construction of farmland water conservancy projects shall use land economically and intensively. The people's government at or above the county level shall, in accordance with the farmland water conservancy plan, ensure the land demand for the construction of farmland water conservancy projects.
农田水利工程建设单位应当建立健全工程质量安全管理制度，对工程质量安全负责，并公示工程建设情况。
The construction unit of a farmland water conservancy project shall establish and improve the project quality and safety management system, be responsible for the project quality and safety, and publicize the project construction situation.
县级以上人民政府水行政主管部门和其他有关部门应当按照职责分工加强对农田水利工程建设的监督管理。
The water administrative department of the people's government at or above the county level and other relevant departments shall, in accordance with their respective duties, strengthen the supervision and management of the construction of farmland water conservancy projects.
政府投资建设的农田水利工程由县级以上人民政府有关部门组织竣工验收，并邀请有关专家和农村集体经济组织、农民用水合作组织、农民代表参加。社会力量投资建设的农田水利工程由投资者或者受益者组织竣工验收。政府与社会力量共同投资的农田水利工程，由县级以上人民政府有关部门、社会投资者或者受益者共同组织竣工验收。
For farmland water conservancy projects invested by the government, the relevant departments of the people's government at or above the county level shall organize the completion acceptance, and invite relevant experts and representatives of rural collective economic organizations, farmer water user associations, and farmers to participate. For farmland water conservancy projects invested by social forces, the investors or beneficiaries shall organize the completion acceptance. For farmland water conservancy projects jointly invested by the government and social forces, the relevant departments of the people's government at or above the county level, social investors, or beneficiaries shall jointly organize the completion acceptance.
大中型农田水利工程应当按照水利建设工程验收规程组织竣工验收。小型农田水利工程验收办法由省、自治区、直辖市人民政府水行政主管部门会同有关部门制定。
Large and medium-sized farmland water conservancy projects shall be organized for completion acceptance in accordance with the water conservancy project acceptance procedures. The acceptance measures for small farmland water conservancy projects shall be formulated by the water administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government jointly with relevant departments.
农田水利工程验收合格后，由县级以上地方人民政府水行政主管部门组织造册存档。
After the farmland water conservancy project passes the acceptance, the water administrative department of the local people's government at or above the county level shall organize the creation of a register and archive it.
县级以上人民政府水行政主管部门应当会同有关部门加强农田水利信息系统建设，收集与发布农田水利规划、农田水利工程建设和运行维护等信息。
The water administrative department of the people's government at or above the county level shall, jointly with relevant departments, strengthen the construction of the farmland water conservancy information system, and collect and publish information such as farmland water conservancy plans, construction and operation maintenance of farmland water conservancy projects.
工程运行维护
Operation and Maintenance of Projects
农田水利工程按照下列规定确定运行维护主体：
The operation and maintenance entity of a farmland water conservancy project shall be determined according to the following provisions:
(一)政府投资建设的大中型农田水利工程，由县级以上人民政府按照工程管理权限确定的单位负责运行维护，鼓励通过政府购买服务等方式引进社会力量参与运行维护；
(1) For large and medium-sized farmland water conservancy projects invested by the government, the unit determined by the people's government at or above the county level according to the project management authority shall be responsible for operation and maintenance, and it is encouraged to introduce social forces to participate in operation and maintenance through government purchase of services and other means;
(二)政府投资建设或者财政补助建设的小型农田水利工程，按照规定交由受益农村集体经济组织、农民用水合作组织、农民等使用和管理的，由受益者或者其委托的单位、个人负责运行维护；
(2) For small farmland water conservancy projects invested by the government or subsidized by fiscal funds, if they are handed over to beneficiary rural collective economic organizations, farmer water user associations, farmers, etc. for use and management according to regulations, the beneficiaries or the units or individuals entrusted by them shall be responsible for operation and maintenance;
(三)农村集体经济组织筹资筹劳建设的农田水利工程，由农村集体经济组织或者其委托的单位、个人负责运行维护；
(3) For farmland water conservancy projects constructed with funds raised and labor contributed by rural collective economic organizations, the rural collective economic organization or the units or individuals entrusted by it shall be responsible for operation and maintenance;
(四)农民或者其他社会力量投资建设的农田水利工程，由投资者或者其委托的单位、个人负责运行维护；
(4) For farmland water conservancy projects invested by farmers or other social forces, the investors or the units or individuals entrusted by them shall be responsible for operation and maintenance;
(五)政府与社会力量共同投资建设的农田水利工程，由投资者按照约定确定运行维护主体。
(5) For farmland water conservancy projects jointly invested by the government and social forces, the investors shall determine the operation and maintenance entity according to the agreement.
农村土地承包经营权依法流转的，应当同时明确该土地上农田水利工程的运行维护主体。
If the right to contracted management of rural land is legally transferred, the operation and maintenance entity of the farmland water conservancy project on that land shall be clarified at the same time.
灌区农田水利工程实行灌区管理单位管理与受益农村集体经济组织、农民用水合作组织、农民等管理相结合的方式。灌区管理办法由国务院水行政主管部门会同有关部门制定。
Farmland water conservancy projects in irrigation districts shall adopt a combination of management by the irrigation district management unit and management by beneficiary rural collective economic organizations, farmer water user associations, farmers, etc. The measures for the management of irrigation districts shall be formulated by the water administrative department of the State Council jointly with relevant departments.
县级以上人民政府应当建立农田水利工程运行维护经费合理负担机制。
The people's government at or above the county level shall establish a reasonable burden-sharing mechanism for the operation and maintenance funds of farmland water conservancy projects.
农田水利工程所有权人应当落实农田水利工程运行维护经费，保障运行维护工作正常进行。
The owner of a farmland water conservancy project shall allocate funds for the operation and maintenance of the project to ensure the normal conduct of operation and maintenance work.
负责农田水利工程运行维护的单位和个人应当建立健全运行维护制度，加强对农田水利工程的日常巡查、维修和养护，按照有关规定进行调度，保障农田水利工程正常运行。
The units and individuals responsible for the operation and maintenance of farmland water conservancy projects shall establish and improve the operation and maintenance system, strengthen daily inspections, repairs, and maintenance of the projects, carry out scheduling in accordance with relevant regulations, and ensure the normal operation of the projects.
农田水利工程水量调度涉及航道通航的，应当符合《中华人民共和国航道法》的有关规定。
If the water scheduling of a farmland water conservancy project involves navigation, it shall comply with the relevant provisions of the Navigation Law of the People's Republic of China.
县级以上人民政府水行政主管部门和农田水利工程所有权人应当加强对农田水利工程运行维护工作的监督，督促负责运行维护的单位和个人履行运行维护责任。
The water administrative department of the people's government at or above the county level and the owner of the farmland water conservancy project shall strengthen supervision over the operation and maintenance of the project, and urge the units and individuals responsible for operation and maintenance to fulfill their operation and maintenance responsibilities.
农村集体经济组织、农民用水合作组织、农民等发现影响农田水利工程正常运行的情形的，有权向县级以上人民政府水行政主管部门和农田水利工程所有权人报告。接到报告的县级以上人民政府水行政主管部门和农田水利工程所有权人应当督促负责运行维护的单位和个人及时处理。
Rural collective economic organizations, farmer water user cooperation organizations, farmers, etc., who discover situations affecting the normal operation of farmland water conservancy projects, have the right to report to the water administrative department of the people's government at or above the county level and the owner of the farmland water conservancy project. The water administrative department of the people's government at or above the county level and the owner of the farmland water conservancy project that receive the report shall supervise the unit or individual responsible for operation and maintenance to handle it promptly.
禁止危害农田水利工程设施的下列行为：
The following acts that endanger farmland water conservancy project facilities are prohibited:
(一)侵占、损毁农田水利工程设施；
(1) Encroaching upon or damaging farmland water conservancy project facilities;
(二)危害农田水利工程设施安全的爆破、打井、采石、取土等活动；
(2) Activities such as blasting, well drilling, quarrying, and earth taking that endanger the safety of farmland water conservancy project facilities;
(三)堆放阻碍蓄水、输水、排水的物体；
(3) Stacking objects that impede water storage, conveyance, or drainage;
(四)建设妨碍蓄水、输水、排水的建筑物和构筑物；
(4) Constructing buildings or structures that hinder water storage, conveyance, or drainage;
(五)向塘坝、沟渠排放污水、倾倒垃圾以及其他废弃物。
(5) Discharging sewage, dumping garbage, or other waste into ponds, reservoirs, or ditches.
任何单位和个人不得擅自占用农业灌溉水源、农田水利工程设施。
No unit or individual may occupy agricultural irrigation water sources or farmland water conservancy project facilities without authorization.
新建、改建、扩建建设工程确需占用农业灌溉水源、农田水利工程设施的，应当与取用水的单位、个人或者农田水利工程所有权人协商，并报经有管辖权的县级以上地方人民政府水行政主管部门同意。
If a new construction, renovation, or expansion project indeed needs to occupy agricultural irrigation water sources or farmland water conservancy project facilities, it shall negotiate with the unit or individual that uses the water or the owner of the farmland water conservancy project, and report to the water administrative department of the local people's government at or above the county level with jurisdiction for approval.
占用者应当建设与被占用的农田水利工程设施效益和功能相当的替代工程；不具备建设替代工程条件的，应当按照建设替代工程的总投资额支付占用补偿费；造成运行成本增加等其他损失的，应当依法给予补偿。补偿标准由省、自治区、直辖市制定。
The occupier shall construct a replacement project with benefits and functions equivalent to the occupied farmland water conservancy project facility; if conditions for constructing a replacement project are not available, the occupier shall pay an occupation compensation fee based on the total investment amount for constructing a replacement project; if other losses such as increased operation costs are caused, compensation shall be given according to law. The compensation standard shall be formulated by the province, autonomous region, or municipality directly under the Central Government.
农田水利工程设施因超过设计使用年限、灌溉排水功能基本丧失或者严重毁坏而无法继续使用的，工程所有权人或者管理单位应当按照有关规定及时处置，消除安全隐患，并将相关情况告知县级以上地方人民政府水行政主管部门。
If a farmland water conservancy project facility can no longer be used due to exceeding its designed service life, basic loss of irrigation and drainage functions, or severe damage, the project owner or management unit shall promptly handle it according to relevant regulations, eliminate safety hazards, and inform the water administrative department of the local people's government at or above the county level.
灌溉排水管理
Irrigation and Drainage Management
县级以上人民政府水行政主管部门应当加强对农田灌溉排水的监督和指导，做好技术服务。
The water administrative department of the people's government at or above the county level shall strengthen supervision and guidance over farmland irrigation and drainage, and provide technical services.
农田灌溉用水实行总量控制和定额管理相结合的制度。
Farmland irrigation water use shall implement a system combining total quantity control and quota management.
农作物灌溉用水定额依照《中华人民共和国水法》规定的权限和程序制定并公布。
Crop irrigation water quotas shall be formulated and published in accordance with the authority and procedures stipulated in the Water Law of the People's Republic of China.
农田灌溉用水应当合理确定水价，实行有偿使用、计量收费。
Farmland irrigation water use shall reasonably determine water prices, and implement paid use and metered charging.
灌区管理单位应当根据有管辖权的县级以上人民政府水行政主管部门核定的年度取用水计划，制定灌区内用水计划和调度方案，与用水户签订用水协议。
Irrigation district management units shall, based on the annual water intake and use plan approved by the water administrative department of the people's government at or above the county level with jurisdiction, formulate water use plans and scheduling plans within the irrigation district, and sign water use agreements with water users.
农田灌溉用水应当符合相应的水质标准。县级以上地方人民政府环境保护主管部门应当会同水行政主管部门、农业主管部门加强对农田灌溉用水的水质监测。
Farmland irrigation water shall meet corresponding water quality standards. The environmental protection department of the local people's government at or above the county level shall, together with the water administrative department and the agricultural department, strengthen water quality monitoring of farmland irrigation water.
国家鼓励采取先进适用的农田排水技术和措施，促进盐碱地和中低产田改造；控制和合理利用农田排水，减少肥料流失，防止农业面源污染。
The state encourages the adoption of advanced and applicable farmland drainage technologies and measures to promote the improvement of saline-alkali land and low- and medium-yield fields; control and rationally utilize farmland drainage to reduce fertilizer loss and prevent agricultural non-point source pollution.
省、自治区、直辖市人民政府水行政主管部门应当组织做好本行政区域农田灌溉排水试验工作。灌溉试验站应当做好农田灌溉排水试验研究，加强科技成果示范推广，指导用水户科学灌溉排水。
The water administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government shall organize the conduct of farmland irrigation and drainage experiments within its administrative region. Irrigation experiment stations shall conduct research on farmland irrigation and drainage experiments, strengthen the demonstration and promotion of scientific and technological achievements, and guide water users in scientific irrigation and drainage.
国家鼓励推广应用喷灌、微灌、管道输水灌溉、渠道防渗输水灌溉等节水灌溉技术，以及先进的农机、农艺和生物技术等，提高灌溉用水效率。
The state encourages the promotion and application of water-saving irrigation technologies such as sprinkler irrigation, micro-irrigation, pipeline water conveyance irrigation, and canal seepage prevention water conveyance irrigation, as well as advanced agricultural machinery, agronomic and biological technologies, to improve irrigation water use efficiency.
粮食主产区和严重缺水、生态环境脆弱地区以及地下水超采地区应当优先发展节水灌溉。
Major grain-producing areas, areas with severe water shortage and fragile ecological environment, and areas with groundwater overexploitation shall prioritize the development of water-saving irrigation.
国家鼓励企业、农村集体经济组织、农民用水合作组织等单位和个人投资建设节水灌溉设施，采取财政补助等方式鼓励购买节水灌溉设备。
The state encourages enterprises, rural collective economic organizations, farmer water user cooperation organizations, and other units and individuals to invest in the construction of water-saving irrigation facilities, and adopts methods such as financial subsidies to encourage the purchase of water-saving irrigation equipment.
规划建设商品粮、棉、油、菜等农业生产基地，应当充分考虑当地水资源条件。水资源短缺地区，限制发展高耗水作物；地下水超采区，禁止农田灌溉新增取用地下水。
When planning and constructing agricultural production bases for commercial grain, cotton, oil, vegetables, etc., local water resource conditions shall be fully considered. In water-scarce areas, the development of high-water-consumption crops shall be restricted; in groundwater overexploitation areas, new extraction of groundwater for farmland irrigation is prohibited.
保障与扶持
Guarantee and Support
农田水利工程建设实行政府投入和社会力量投入相结合的方式。
The construction of farmland water conservancy projects shall adopt a combination of government investment and social capital investment.
县级以上人民政府应当多渠道筹措农田水利工程建设资金，保障农田水利建设投入。
People's governments at or above the county level shall raise funds for the construction of farmland water conservancy projects through multiple channels to ensure investment in farmland water conservancy construction.
县级人民政府应当及时公布农田水利工程建设年度实施计划、建设条件、补助标准等信息，引导社会力量参与建设农田水利工程。
People's governments at the county level shall promptly publish information such as the annual implementation plan, construction conditions, and subsidy standards for farmland water conservancy projects to guide social forces to participate in the construction of farmland water conservancy projects.
县级以上地方人民政府应当支持社会力量通过提供农田灌溉服务、收取供水水费等方式，开展农田水利工程经营活动，保障其合法经营收益。
Local people's governments at or above the county level shall support social forces in carrying out business operations of farmland water conservancy projects by providing farmland irrigation services, collecting water supply fees, and other means, and guarantee their legitimate business income.
县级以上地方人民政府水行政主管部门应当为社会力量参与建设、经营农田水利工程提供指导和技术支持。
The water administrative departments of local people's governments at or above the county level shall provide guidance and technical support for social forces to participate in the construction and operation of farmland water conservancy projects.
国家引导金融机构推出符合农田水利工程项目特点的金融产品和服务方式，加大对农田水利工程建设的信贷支持力度。
The state guides financial institutions to launch financial products and service methods that meet the characteristics of farmland water conservancy projects, and increase credit support for the construction of farmland water conservancy projects.
农田灌溉和排水的用电执行农业生产用电价格。
The electricity used for farmland irrigation and drainage shall be subject to the agricultural production electricity price.
县级人民政府应当建立健全基层水利服务体系，将基层水利服务机构公益性业务经费纳入本级政府预算。基层水利服务机构应当履行农田水利建设管理、科技推广等公益性职能。
People's governments at the county level shall establish and improve the grassroots water service system, and include the public service business funds of grassroots water service institutions in the budget of the government at the same level. Grassroots water service institutions shall perform public welfare functions such as farmland water conservancy construction management and technology promotion.
国家通过政府购买服务等方式，支持专业化服务组织开展农田灌溉和排水、农田水利工程设施维修等公益性工作。
The state supports specialized service organizations in carrying out public welfare work such as farmland irrigation and drainage, and maintenance of farmland water conservancy project facilities through government purchase of services and other means.
县级以上人民政府水行政主管部门应当会同本级人民政府有关部门，制定农田水利新技术推广目录和培训计划，加强对基层水利服务人员和农民的培训。
The water administrative departments of people's governments at or above the county level shall, together with the relevant departments of the people's governments at the same level, formulate a catalog of new technologies for farmland water conservancy promotion and training plans, and strengthen training for grassroots water service personnel and farmers.
对农田水利工作中成绩显著的单位和个人，按照国家有关规定给予表彰。
Units and individuals that have achieved remarkable results in farmland water conservancy work shall be commended in accordance with relevant state regulations.
法律责任
Legal Liability
违反本条例规定，县级以上人民政府水行政主管部门和其他有关部门不依法履行农田水利管理和监督职责的，对负有责任的领导人员和直接责任人员依法给予处分；负有责任的领导人员和直接责任人员构成犯罪的，依法追究刑事责任。
In violation of these regulations, if the water administrative departments of people's governments at or above the county level and other relevant departments fail to perform their duties of farmland water conservancy management and supervision according to law, the responsible leaders and directly responsible personnel shall be given sanctions according to law; if the responsible leaders and directly responsible personnel constitute a crime, criminal liability shall be pursued according to law.
违反本条例规定，县级以上人民政府确定的农田水利工程运行维护单位不按照规定进行维修养护和调度、不执行年度取用水计划的，由县级以上地方人民政府水行政主管部门责令改正；发生责任事故或者造成其他重大损失的，对直接负责的主管人员和其他直接责任人员依法给予处分；直接负责的主管人员和其他直接责任人员构成犯罪的，依法追究刑事责任。
In violation of these regulations, if the operation and maintenance unit of farmland water conservancy projects designated by the people's government at or above the county level fails to carry out maintenance and scheduling as required, or fails to implement the annual water intake plan, the water administrative department of the local people's government at or above the county level shall order correction; if a liability accident occurs or other major losses are caused, the directly responsible supervisors and other directly responsible personnel shall be given sanctions according to law; if the directly responsible supervisors and other directly responsible personnel constitute a crime, criminal liability shall be pursued according to law.
违反本条例规定，有下列行为之一的，由县级以上地方人民政府水行政主管部门责令停止违法行为，限期恢复原状或者采取补救措施；逾期不恢复原状或者采取补救措施的，依法强制执行；造成损失的，依法承担民事责任；构成违反治安管理行为的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任：
In violation of these regulations, any of the following acts shall be ordered by the water administrative department of the local people's government at or above the county level to cease the illegal act, restore the original state or take remedial measures within a time limit; if the restoration or remedial measures are not taken within the time limit, enforcement shall be carried out according to law; if losses are caused, civil liability shall be borne according to law; if the act constitutes a violation of public security administration, public security administration penalties shall be imposed according to law; if a crime is constituted, criminal liability shall be pursued according to law:
(一)堆放阻碍农田水利工程设施蓄水、输水、排水的物体；
(1) Piling objects that impede water storage, conveyance, or drainage of farmland water conservancy project facilities;
(二)建设妨碍农田水利工程设施蓄水、输水、排水的建筑物和构筑物；
(2) Constructing buildings or structures that impede water storage, conveyance, or drainage of farmland water conservancy project facilities;
(三)擅自占用农业灌溉水源、农田水利工程设施。
(3) Unauthorized occupation of agricultural irrigation water sources or farmland water conservancy project facilities.
违反本条例规定，侵占、损毁农田水利工程设施，以及有危害农田水利工程设施安全的爆破、打井、采石、取土等行为的，依照《中华人民共和国水法》的规定处理。
In violation of these regulations, acts such as encroaching upon or damaging farmland water conservancy project facilities, or engaging in blasting, well drilling, quarrying, earth taking, or other acts that endanger the safety of farmland water conservancy project facilities, shall be dealt with in accordance with the provisions of the Water Law of the People's Republic of China.
违反本条例规定，向塘坝、沟渠排放污水、倾倒垃圾以及其他废弃物的，依照环境保护有关法律、行政法规的规定处理。
In violation of these regulations, acts such as discharging sewage, dumping garbage, or other wastes into ponds, dams, or ditches shall be dealt with in accordance with the provisions of environmental protection laws and administrative regulations.
附则
Supplementary Provisions
本条例自2016年7月1日起施行。
These Regulations shall come into force on July 1, 2016.
