总 则
General Provisions
为了加强和规范行政执法监督工作，促进严格规范公正文明执法，提升依法行政水平，强化法治政府建设，根据《中华人民共和国宪法》、《中华人民共和国国务院组织法》、《中华人民共和国地方各级人民代表大会和地方各级人民政府组织法》，制定本条例。
This Regulation is formulated in accordance with the Constitution of the People's Republic of China, the Organic Law of the State Council of the People's Republic of China, and the Organic Law of the Local People's Congresses and Local People's Governments of the People's Republic of China, for the purposes of strengthening and standardizing administrative law enforcement supervision, promoting strict, standardized, fair, and civilized law enforcement, enhancing the level of law-based administration, and reinforcing the construction of a law-based government.
县级以上人民政府依法对本级人民政府所属部门、派出机关和下级人民政府以及法律法规授权的具有管理公共事务职能的组织的行政执法工作开展的行政系统内部监督，适用本条例。
This Regulation applies to the internal supervision within the administrative system conducted by people's governments at or above the county level, in accordance with the law, over the administrative law enforcement work of their subordinate departments, dispatched agencies, lower-level people's governments, and organizations authorized by laws and regulations to manage public affairs.
行政执法监督是行政监督的重要内容，是统筹行政执法工作的基本方式，是党和国家监督体系的重要组成部分。
Administrative law enforcement supervision is an important part of administrative supervision, a basic method for coordinating administrative law enforcement work, and an important component of the Party and state supervision system.
行政执法监督工作坚持中国共产党的领导，坚持以人民为中心，推动实现行政执法政治效果、法律效果和社会效果有机统一。
Administrative law enforcement supervision work shall adhere to the leadership of the Communist Party of China, adhere to a people-centered approach, and promote the organic unity of political, legal, and social effects of administrative law enforcement.
行政执法监督工作坚持统筹协调，增强系统性、整体性、协同性，遵循规范与指导并重、预防与纠错并重、监督与保障并重原则，督促纠治行政执法问题、提升行政执法质效，保障法律法规正确实施。
Administrative law enforcement supervision work shall adhere to overall coordination, enhance systematicness, wholeness, and synergy, follow the principles of balancing guidance with regulation, prevention with correction, and supervision with support, urge the correction of administrative law enforcement problems, improve the quality and efficiency of administrative law enforcement, and ensure the correct implementation of laws and regulations.
县级以上人民政府应当加强对行政执法监督工作的组织领导，研究部署行政执法监督工作，支持和保障行政执法监督机构切实履行职责。
People's governments at or above the county level shall strengthen the organization and leadership of administrative law enforcement supervision work, study and deploy administrative law enforcement supervision work, and support and ensure that administrative law enforcement supervision institutions effectively perform their duties.
县级以上人民政府司法行政部门是本级人民政府的行政执法监督机构，代表本级人民政府承担行政执法监督具体事务，负责实施行政执法监督工作，定期向本级人民政府报告行政执法监督工作情况。
The judicial administrative department of a people's government at or above the county level is the administrative law enforcement supervision institution of that people's government, representing the people's government in undertaking specific administrative law enforcement supervision matters, responsible for implementing administrative law enforcement supervision work, and regularly reporting on the status of administrative law enforcement supervision work to the people's government.
设在乡镇(街道)的司法所协助县级人民政府行政执法监督机构依法开展行政执法监督工作。
Judicial offices established in townships (subdistricts) assist the administrative law enforcement supervision institutions of county-level people's governments in carrying out administrative law enforcement supervision work in accordance with the law.
行政执法监督机构承担下列职责：
Administrative law enforcement supervision institutions shall undertake the following duties:
(一)指导监督行政执法工作，组织落实行政执法责任制和责任追究制度；
(1) Guide and supervise administrative law enforcement work, organize the implementation of the administrative law enforcement responsibility system and the accountability system;
(二)协调行政执法体制改革有关法治事项，协调行政执法争议；
(2) Coordinate legal matters related to the reform of the administrative law enforcement system, and coordinate administrative law enforcement disputes;
(三)组织推动行政执法规范化、正规化、专业化、数字化建设；
(3) Organize and promote the standardization, regularization, professionalization, and digitalization of administrative law enforcement;
(四)统筹实施行政执法主体、行政执法人员、行政执法行为、行政执法保障等方面的管理制度；
(4) Coordinate the implementation of management systems concerning administrative law enforcement subjects, administrative law enforcement personnel, administrative law enforcement acts, and administrative law enforcement guarantees;
(五)法律、法规规定的其他职责。
(5) Other duties as provided by laws and regulations.
行政执法监督机构应当严格依法履行监督职责，不得以监督代替行政执法，不得滥用职权干预行政执法，避免增加行政执法机关负担。
Administrative law enforcement supervision institutions shall strictly perform their supervision duties in accordance with the law, shall not replace administrative law enforcement with supervision, shall not abuse their powers to interfere with administrative law enforcement, and shall avoid increasing the burden on administrative law enforcement organs.
监 督 范 围
Scope of Supervision
行政执法监督机构对行政执法机关贯彻落实党中央、国务院关于行政执法工作的重大决策部署，落实行政执法各项制度，依法开展行政执法等进行监督。
Administrative law enforcement supervision institutions shall supervise the implementation by administrative law enforcement organs of major decisions and deployments of the Central Committee of the Communist Party of China and the State Council regarding administrative law enforcement work, the implementation of various administrative law enforcement systems, and the conduct of administrative law enforcement in accordance with the law.
行政执法监督机构应当加强对行政执法主体资格的管理，加强对行政执法人员的监督，健全行政执法人员资格、证件管理制度，监督行政执法机关做好行政执法人员准入和退出工作。
Administrative law enforcement supervision institutions shall strengthen the management of the qualifications of administrative law enforcement subjects, strengthen the supervision of administrative law enforcement personnel, improve the management system for the qualifications and certificates of administrative law enforcement personnel, and supervise administrative law enforcement organs in properly managing the entry and exit of administrative law enforcement personnel.
行政执法监督机构应当加强对行政执法行为的监督，督促行政执法机关提升行政执法质效，依法开展行政许可、行政处罚、行政强制、行政检查、行政征收征用、行政给付等工作。
Administrative law enforcement supervision institutions shall strengthen the supervision of administrative law enforcement acts, urge administrative law enforcement organs to improve the quality and efficiency of administrative law enforcement, and lawfully carry out administrative licensing, administrative penalties, administrative compulsion, administrative inspections, administrative expropriation and requisition, administrative payments, and other work.
行政执法监督机构对行政执法下列情形进行监督：
Administrative law enforcement supervision institutions shall supervise the following circumstances of administrative law enforcement:
(一)行政执法的主体、人员是否具有合法资格；
(1) Whether the subject and personnel of administrative law enforcement have legal qualifications;
(二)行政执法程序是否合法；
(2) Whether the administrative law enforcement procedure is lawful;
(三)行政执法决定是否违法或者明显不当；
(3) Whether the administrative law enforcement decision is unlawful or manifestly improper;
(四)行政执法过程中是否存在有案不立、推诿扯皮、以罚代管、违规异地执法、趋利性执法以及乱收费、乱罚款、乱检查、乱查封等执法不作为、乱作为行为；
(4) Whether there are acts of nonfeasance or misfeasance in the administrative law enforcement process, such as failure to file cases, buck-passing, substituting fines for management, illegal cross-regional law enforcement, profit-driven law enforcement, and arbitrary charges, fines, inspections, and seizures;
(五)行政执法过程中是否存在简单粗暴等不文明行为；
(5) Whether there are uncivilized behaviors such as rudeness in the administrative law enforcement process;
(六)行政执法人员是否规范使用证件、标志标识及执法装备，是否按规定着制式服装；
(6) Whether administrative law enforcement personnel properly use their credentials, insignia, and law enforcement equipment, and whether they wear the prescribed uniform;
(七)其他影响行政执法合法性、适当性的情形。
(7) Other circumstances affecting the legality and appropriateness of administrative law enforcement.
行政执法监督机构对行政执法机关按照国家有关规定落实下列行政执法制度情况进行监督：
The administrative law enforcement supervision agency shall supervise the implementation of the following administrative law enforcement systems by administrative law enforcement organs in accordance with relevant state regulations:
(一)行政执法人员资格、证件管理制度；
(1) The system for the qualification and credential management of administrative law enforcement personnel;
(二)行政执法公示、执法全过程记录、重大执法决定法制审核等行政执法程序制度；
(2) The administrative law enforcement procedure systems, including the disclosure of administrative law enforcement, full recording of the enforcement process, and legal review of major enforcement decisions;
(三)行政裁量权基准等行政执法标准制度；
(3) The administrative discretion benchmark and other administrative law enforcement standard systems;
(四)行政执法事项清单管理、行政执法责任确定、行政执法状况评议、行政执法责任追究等相关制度；
(4) Relevant systems such as the list management of administrative law enforcement matters, determination of administrative law enforcement responsibilities, evaluation of administrative law enforcement status, and accountability for administrative law enforcement;
(五)行政执法与刑事司法衔接制度；
(5) The system for the connection between administrative law enforcement and criminal justice;
(六)行政执法体制改革中法治建设相关制度；
(6) Systems related to the construction of the rule of law in the reform of the administrative law enforcement system;
(七)与推进全国统一大市场建设相关的行政执法制度；
(7) Administrative law enforcement systems related to promoting the construction of a unified national market;
(八)其他行政执法制度。
(8) Other administrative law enforcement systems.
行政执法监督机构可以对本级行政执法机关之间涉及行政执法事项清单管理、案件管辖以及跨领域、跨区域行政执法等方面的争议进行协调；经协调不能取得一致意见的，行政执法监督机构应当提出处理意见，按程序报人民政府决定。
The administrative law enforcement supervision agency may coordinate disputes between administrative law enforcement organs at the same level concerning the list management of administrative law enforcement matters, case jurisdiction, and cross-field and cross-regional administrative law enforcement; if consensus cannot be reached through coordination, the administrative law enforcement supervision agency shall propose a handling opinion and submit it to the people's government for decision in accordance with procedures.
监 督 方 式
Supervision Methods
行政执法监督机构根据工作需要，综合运用日常监督、重点监督、专项监督等方式，对行政执法工作进行全方位、全流程、常态化、长效化监督。
The administrative law enforcement supervision agency shall, based on work needs, comprehensively apply daily supervision, key supervision, and special supervision to carry out all-round, full-process, normalized, and long-term supervision of administrative law enforcement work.
行政执法监督机构可以采取法律法规执行情况评估、执法资格确认、执法案卷评查、执法质效评议等方式，对行政执法工作进行日常监督。
The administrative law enforcement supervision agency may conduct daily supervision through methods such as evaluation of the implementation of laws and regulations, confirmation of law enforcement qualifications, review of law enforcement case files, and evaluation of law enforcement quality and effectiveness.
行政执法监督机构可以采取问卷调查、个别访谈、实地调研等方式，对行政执法机关执行法律法规情况进行评估。
The administrative law enforcement supervision agency may evaluate the implementation of laws and regulations by administrative law enforcement organs through methods such as questionnaire surveys, individual interviews, and field research.
行政执法监督机构对行政执法主体资格进行确认，对经确认有行政执法主体资格的，按程序向社会公示。
The administrative law enforcement supervision agency shall confirm the qualifications of administrative law enforcement entities, and for those confirmed to have administrative law enforcement entity qualifications, it shall publicly announce them in accordance with procedures.
行政执法监督机构按照规定对行政执法人员资格进行审核，对符合法定条件并通过行政执法资格考试的，制发行政执法证件，确认行政执法人员资格。
The administrative law enforcement supervision agency shall review the qualifications of administrative law enforcement personnel in accordance with regulations, and for those who meet the statutory conditions and pass the administrative law enforcement qualification examination, it shall issue administrative law enforcement credentials and confirm their qualifications as administrative law enforcement personnel.
行政执法监督机构通过执法案卷评查检查行政执法决定是否合法，是否与违法行为的事实、性质、情节以及社会危害程度相当，以及行政执法文书是否规范，证据是否真实、完整。
The administrative law enforcement supervision agency shall, through the review of law enforcement case files, examine whether the administrative law enforcement decision is lawful, whether it is commensurate with the facts, nature, circumstances, and degree of social harm of the illegal act, and whether the administrative law enforcement documents are standardized and the evidence is authentic and complete.
行政执法监督机构结合行政执法机关的执法特点和具体情况制定评议方案、标准，对行政执法机关的执法质量、执法效果等进行评议。评议标准、过程、结果应当以适当方式公开。
The administrative law enforcement supervision agency shall, based on the enforcement characteristics and specific circumstances of the administrative law enforcement organ, formulate an evaluation plan and standards, and evaluate the enforcement quality and effectiveness of the administrative law enforcement organ. The evaluation standards, process, and results shall be disclosed in an appropriate manner.
行政执法监督机构对企业和群众反映强烈、产生重大社会影响的典型性、代表性行政执法突出问题进行重点监督。
The administrative law enforcement supervision agency shall conduct key supervision on typical and representative outstanding issues in administrative law enforcement that are strongly reflected by enterprises and the public and have a significant social impact.
行政执法监督机构对通过涉企行政执法诉求沟通机制、政务服务便民热线等渠道反映的行政执法问题线索及时进行研判，确定重点监督事项。
The administrative law enforcement supervision agency shall promptly study and determine key supervision matters based on clues of issues in administrative law enforcement reflected through channels such as the communication mechanism for enterprise-related administrative law enforcement demands and the government service hotline.
重点监督可以采取挂牌督办、提级监督等方式。
Key supervision may be carried out through methods such as listing for supervision and upgraded-level supervision.
省级以上人民政府行政执法监督机构根据党中央、国务院决策部署，可以结合人大代表建议、政协提案、监察建议、司法建议、检察建议、行政复议建议等反映的行政执法问题，对关系经济社会发展大局、人民群众切身利益的特定领域、特定问题开展专项监督。
The administrative law enforcement supervision institution of the people's government at or above the provincial level may, in accordance with the decisions and deployments of the Central Committee of the Communist Party of China and the State Council, and taking into account administrative law enforcement issues reflected in suggestions from people's congress deputies, proposals from the Chinese People's Political Consultative Conference, supervisory suggestions, judicial suggestions, procuratorial suggestions, and administrative reconsideration suggestions, carry out special supervision on specific fields or specific issues that concern the overall situation of economic and social development and the vital interests of the people.
开展专项监督应当制定工作方案，明确专项监督的责任部门、监督重点、进度安排和工作要求等，报本级人民政府批准。
To carry out special supervision, a work plan shall be formulated, specifying the responsible department, supervision focus, progress schedule, and work requirements for the special supervision, and shall be submitted to the people's government at the same level for approval.
开展行政执法监督可以采取下列措施：
The following measures may be taken when carrying out administrative law enforcement supervision:
(一)要求行政执法机关自查、说明情况；
(1) Requiring the administrative law enforcement agency to conduct self-inspection and explain the situation;
(二)开展检查、访谈、暗访；
(2) Conducting inspections, interviews, and unannounced visits;
(三)组织座谈、听证、统计、评估；
(3) Organizing discussions, hearings, statistics, and evaluations;
(四)调阅、复制与监督事项有关的资料；
(4) Accessing and copying materials related to the supervision matter;
(五)约谈行政执法机关负责人或者相关责任人；
(5) Interviewing the person in charge of the administrative law enforcement agency or relevant responsible persons;
(六)其他必要的措施。
(6) Other necessary measures.
行政执法监督机构根据工作需要，可以邀请人大代表、政协委员、行业代表、专家学者、新闻工作者等参加行政执法监督活动。
The administrative law enforcement supervision institution may, based on work needs, invite people's congress deputies, members of the Chinese People's Political Consultative Conference, industry representatives, experts and scholars, and journalists to participate in administrative law enforcement supervision activities.
行政执法监督机构应当通过开展政策解读、答复有关问题、发布典型案例等方式，加强对行政执法工作的指导，促进行政执法机关和行政执法人员依法履行职责。
The administrative law enforcement supervision institution shall strengthen guidance on administrative law enforcement work by conducting policy interpretations, answering relevant questions, and publishing typical cases, so as to promote administrative law enforcement agencies and administrative law enforcement personnel to perform their duties in accordance with the law.
行政执法监督机构应当加强对行政执法普遍性、规律性问题的研究，总结解决行政执法问题的经验，提出关于改进行政执法工作、完善相关行政执法制度的建议。
The administrative law enforcement supervision institution shall strengthen research on universal and regular issues in administrative law enforcement, summarize experience in solving administrative law enforcement problems, and put forward suggestions for improving administrative law enforcement work and perfecting relevant administrative law enforcement systems.
行政执法监督机构依法履行监督职责时，行政执法机关应当予以配合，任何单位、个人不得干扰、拒绝和阻挠。
When the administrative law enforcement supervision institution performs its supervision duties in accordance with the law, the administrative law enforcement agency shall cooperate, and no unit or individual may interfere, refuse, or obstruct.
监 督 处 理
Supervision and Handling
行政执法监督机构对行政执法监督中发现的问题，根据不同情形制发行政执法监督督办函、行政执法监督意见书或者报请本级人民政府制发行政执法监督决定书等督促有关行政执法机关予以纠正。
For problems discovered in administrative law enforcement supervision, the administrative law enforcement supervision institution shall, depending on the different circumstances, issue a supervision reminder letter, a supervision opinion letter, or, after reporting to the people's government at the same level, issue a supervision decision letter to urge the relevant administrative law enforcement agency to make corrections.
行政执法监督机构对发现的问题能够当场纠正的，应当督促有关行政执法机关立即纠正。
If the problems discovered by the administrative law enforcement supervision institution can be corrected on the spot, it shall urge the relevant administrative law enforcement agency to correct them immediately.
对行政执法机关应当履行而未履行行政执法职责的，行政执法监督机构可以制发行政执法监督督办函，督促其依法履行职责。
If an administrative law enforcement agency fails to perform its administrative law enforcement duties that it should perform, the administrative law enforcement supervision institution may issue a supervision reminder letter to urge it to perform its duties in accordance with the law.
行政执法机关应当按照行政执法监督督办函的要求及时履行行政执法职责，并在规定时限内向行政执法监督机构报送纠正情况。
The administrative law enforcement agency shall promptly perform its administrative law enforcement duties in accordance with the requirements of the supervision reminder letter and report the correction status to the administrative law enforcement supervision institution within the prescribed time limit.
对行政执法监督工作中查明的违法或者明显不当的行政执法问题，行政执法监督机构可以制发行政执法监督意见书，监督有关行政执法机关予以纠正。
For illegal or obviously inappropriate administrative law enforcement problems identified in administrative law enforcement supervision work, the administrative law enforcement supervision institution may issue a supervision opinion letter to supervise the relevant administrative law enforcement agency to make corrections.
行政执法机关应当按照行政执法监督意见书的要求及时纠正，并在规定时限内向行政执法监督机构报送纠正情况。
The administrative law enforcement agency shall promptly make corrections in accordance with the requirements of the supervision opinion letter and report the correction status to the administrative law enforcement supervision institution within the prescribed time limit.
对涉及重大问题或者行政执法机关未按照行政执法监督督办函要求履职、未按照行政执法监督意见书要求纠正的，由行政执法监督机构提出处理建议，报本级人民政府决定；本级人民政府决定纠正的，制发行政执法监督决定书予以纠正。
If a major problem is involved, or if the administrative law enforcement agency fails to perform its duties as required by the supervision reminder letter or fails to make corrections as required by the supervision opinion letter, the administrative law enforcement supervision institution shall propose a handling suggestion and report it to the people's government at the same level for a decision; if the people's government at the same level decides to make corrections, it shall issue a supervision decision letter to make corrections.
行政执法机关对行政执法监督机构作出的处理结果有异议的，可以向其提出并说明理由，行政执法监督机构应当及时处理。
If an administrative law enforcement agency has objections to the handling result made by the administrative law enforcement supervision institution, it may submit its objections to the institution and explain the reasons, and the administrative law enforcement supervision institution shall handle them promptly.
行政执法监督机构发现行政执法机关拒不落实行政执法制度或者行政执法行为存在突出问题的，可以在一定范围内进行通报或者向社会公布。
If the administrative law enforcement supervision institution discovers that an administrative law enforcement agency refuses to implement the administrative law enforcement system or that there are prominent problems in administrative law enforcement actions, it may circulate a notice within a certain scope or make it public to the society.
行政执法监督机构在履行监督职责过程中，发现行政执法人员存在违法或者明显不当情形的，综合考虑主客观原因、后果、纠正情况等因素，提出对其作出批评教育、离岗教育、调离执法岗位、取消执法资格等处理的建议，由有权机关依法处理。
In the process of performing supervision duties, if the administrative law enforcement supervision institution discovers that an administrative law enforcement officer has illegal or obviously inappropriate conduct, it shall, taking into comprehensive consideration factors such as subjective and objective reasons, consequences, and correction status, propose suggestions for handling such as criticism and education, off-duty education, transfer from law enforcement position, or revocation of law enforcement qualification, and the relevant authority shall handle it in accordance with the law.
行政执法监督应当加强与监察监督的贯通协同，健全信息共享和线索移送机制，按照规定程序向监察机关移送行政执法人员违反本条例规定或者涉嫌贪污贿赂、失职渎职等职务违法或者职务犯罪的问题线索。
Administrative law enforcement supervision shall strengthen coordination with supervisory supervision, improve mechanisms for information sharing and transfer of leads, and transfer to the supervisory authority in accordance with the prescribed procedures any leads on administrative law enforcement officers violating the provisions of these Regulations or suspected of duty-related illegal acts such as corruption, bribery, dereliction of duty, or duty-related crimes.
行政执法监督应当加强与政府督查、行政复议等的协调衔接，建立健全工作沟通和信息共享机制，提高监督质效，形成监督合力。
Administrative law enforcement supervision shall strengthen coordination and connection with government supervision and administrative reconsideration, establish and improve working communication and information sharing mechanisms, improve supervision quality and efficiency, and form a joint supervision force.
对符合行政复议、行政诉讼受理条件的行政争议，行政执法监督机构应当引导当事人依法申请行政复议、提起行政诉讼；对已经进入行政复议、行政诉讼程序的行政争议，行政执法监督机构不重复监督。
For administrative disputes that meet the acceptance conditions for administrative reconsideration or administrative litigation, the administrative law enforcement supervision agency shall guide the parties to apply for administrative reconsideration or file an administrative litigation according to law; for administrative disputes that have already entered the administrative reconsideration or administrative litigation process, the administrative law enforcement supervision agency shall not conduct duplicate supervision.
各级人民政府应当加强行政执法监督结果运用，并将行政执法监督结果作为法治政府建设成效评价的重要内容。
People's governments at all levels shall strengthen the application of administrative law enforcement supervision results, and include the results of administrative law enforcement supervision as an important part of the evaluation of the effectiveness of rule-of-law government construction.
保 障 措 施
Safeguard Measures
国家统筹加强行政执法监督队伍建设，配备与行政执法监督工作任务相适应的行政执法监督人员。
The state shall coordinate the strengthening of the construction of administrative law enforcement supervision teams, and equip administrative law enforcement supervision personnel commensurate with the tasks of administrative law enforcement supervision.
行政执法监督机构应当加强对行政执法监督人员的教育培训，提高其政治能力和业务能力。
Administrative law enforcement supervision agencies shall strengthen education and training for administrative law enforcement supervision personnel to improve their political and professional capabilities.
国务院行政执法监督机构应当研究制定行政执法规范化建设标准，督促行政执法机关加强行政执法规范化建设。
The administrative law enforcement supervision agency of the State Council shall study and formulate standards for the standardization of administrative law enforcement, and urge administrative law enforcement agencies to strengthen the standardization of administrative law enforcement.
国务院行政执法监督机构应当提升全国行政执法监督信息一体化水平，对相关行政执法行为信息进行归集，运用大数据、云计算、人工智能等对行政执法过程中存在的问题进行快速预警，实现精准、高效、实时监督。
The administrative law enforcement supervision agency of the State Council shall enhance the level of integration of national administrative law enforcement supervision information, collect relevant information on administrative law enforcement actions, use big data, cloud computing, artificial intelligence, etc. to quickly warn of problems in the administrative law enforcement process, and achieve precise, efficient, and real-time supervision.
省、自治区、直辖市人民政府行政执法监督机构应当组织建设本行政区域的行政执法监督信息系统，加强数据共享，提高行政执法监督效能。
The administrative law enforcement supervision agency of the people's government of a province, autonomous region, or municipality directly under the Central Government shall organize the construction of an administrative law enforcement supervision information system for its administrative region, strengthen data sharing, and improve the efficiency of administrative law enforcement supervision.
县级以上人民政府应当加强行政执法监督工作保障，将行政执法监督工作所需经费列入本级预算。
People's governments at or above the county level shall strengthen the guarantee of administrative law enforcement supervision work, and include the necessary funds for administrative law enforcement supervision work in the budget at the same level.
法 律 责 任
Legal Responsibility
行政执法监督机构不依法履职的，由本级人民政府或者上级行政执法监督机构责令限期改正；拒不改正的，对负有责任的领导人员和直接责任人员依法给予处分。
If an administrative law enforcement supervision agency fails to perform its duties according to law, the people's government at the same level or the superior administrative law enforcement supervision agency shall order it to make corrections within a time limit; if it refuses to make corrections, the responsible leaders and directly responsible personnel shall be given sanctions according to law.
行政执法监督人员在行政执法监督中滥用职权、玩忽职守、徇私舞弊的，依法给予处分；构成犯罪的，依法追究刑事责任。
If an administrative law enforcement supervision person abuses power, neglects duties, or engages in malpractice for personal gain in administrative law enforcement supervision, he or she shall be given sanctions according to law; if a crime is constituted, criminal liability shall be pursued according to law.
拒绝、阻挠行政执法监督人员开展监督，故意扰乱行政执法监督工作秩序的，依法给予处分。
Anyone who refuses or obstructs administrative law enforcement supervision personnel from carrying out supervision, or intentionally disrupts the order of administrative law enforcement supervision work, shall be given sanctions according to law.
附 则
Supplementary Provisions
县级以上人民政府部门对本部门所属机构、派出机构行政执法工作的监督检查，实行垂直管理的部门或者实行双重领导并且以上级部门领导为主的部门对所属机构、下级部门行政执法工作的监督检查，参照本条例有关规定执行。
The supervision and inspection of the administrative law enforcement work of the subordinate agencies and dispatched agencies by the departments of the people's governments at or above the county level, and the supervision and inspection of the administrative law enforcement work of the subordinate agencies and lower-level departments by the departments implementing vertical management or dual leadership with the higher-level department as the main leader, shall be implemented with reference to the relevant provisions of these Regulations.
县级以上地方人民政府依法对设立在本行政区域内实行垂直管理或者实行双重领导并且以上级部门领导为主的行政执法机关遵守和执行法律和政策情况进行监督，将发现的问题及时告知其上一级主管部门。
The local people's government at or above the county level shall, according to law, supervise the compliance with and implementation of laws and policies by administrative law enforcement agencies established within its administrative region that implement vertical management or dual leadership with the higher-level department as the main leader, and promptly notify the competent department at the next higher level of the problems discovered.
设区的市级以上人民政府部门在本级人民政府行政执法监督机构的指导下，依照有关法律规定对下级人民政府相应部门的行政执法工作进行督促指导。
The departments of the people's governments at or above the level of a city divided into districts shall, under the guidance of the administrative law enforcement supervision agency of the people's government at the same level, supervise and guide the administrative law enforcement work of the corresponding departments of the lower-level people's governments in accordance with relevant legal provisions.
行政执法监督工作中涉及行政执法人员管理、教育培训、行为规范等方面的制度，由国务院行政执法监督机构会同国务院有关部门另行制定。
Systems involving the management, education and training, and code of conduct of administrative law enforcement personnel in administrative law enforcement supervision work shall be formulated separately by the administrative law enforcement supervision agency of the State Council jointly with the relevant departments of the State Council.
本条例自2026年2月1日起施行。
These Regulations shall come into force on February 1, 2026.
