总则
General Provisions
为了加强城市市容和环境卫生管理，创造清洁、优美的城市工作、生活环境，促进城市社会主义物质文明和精神文明建设，制定本条例。
These Regulations are formulated to strengthen the management of urban appearance and environmental sanitation, create a clean and beautiful urban working and living environment, and promote the construction of socialist material civilization and spiritual civilization in cities.
在中华人民共和国城市内，一切单位和个人都必须遵守本条例。
All units and individuals within the cities of the People's Republic of China must comply with these Regulations.
城市市容和环境卫生工作，实行统一领导、分区负责、专业人员管理与群众管理相结合的原则。
The work of urban appearance and environmental sanitation shall implement the principle of unified leadership, division of responsibility by area, and the combination of professional management with mass management.
国务院城市建设行政主管部门主管全国城市市容和环境卫生工作。
The administrative department of urban construction under the State Council shall be in charge of the nationwide urban appearance and environmental sanitation work.
省、自治区人民政府城市建设行政主管部门负责本行政区域的城市市容和环境卫生管理工作。
The administrative department of urban construction under the people's governments of provinces and autonomous regions shall be responsible for the management of urban appearance and environmental sanitation within their respective administrative regions.
城市人民政府市容环境卫生行政主管部门负责本行政区域的城市市容和环境卫生管理工作。
The administrative department of urban appearance and environmental sanitation under the people's government of a city shall be responsible for the management of urban appearance and environmental sanitation within its administrative region.
城市人民政府应当把城市市容和环境卫生事业纳入国民经济和社会发展计划，并组织实施。
The people's government of a city shall incorporate the cause of urban appearance and environmental sanitation into the national economic and social development plan and organize its implementation.
城市人民政府应当结合本地的实际情况，积极推行环境卫生用工制度的改革，并采取措施，逐步提高环境卫生工作人员的工资福利待遇。
The people's government of a city shall, in light of local actual conditions, actively promote the reform of the employment system for environmental sanitation work, and take measures to gradually improve the wages and welfare benefits of environmental sanitation workers.
城市人民政府应当加强城市市容和环境卫生科学知识的宣传，提高公民的环境卫生意识，养成良好的卫生习惯。
The people's government of a city shall strengthen the publicity of scientific knowledge on urban appearance and environmental sanitation, enhance citizens' awareness of environmental sanitation, and cultivate good hygiene habits.
一切单位和个人，都应当尊重市容和环境卫生工作人员的劳动，不得妨碍、阻挠市容和环境卫生工作人员履行职务。
All units and individuals shall respect the labor of appearance and environmental sanitation workers and shall not obstruct or impede them in the performance of their duties.
国家鼓励城市市容和环境卫生的科学技术研究，推广先进技术，提高城市市容和环境卫生水平。
The State encourages scientific and technological research on urban appearance and environmental sanitation, promotes advanced technology, and improves the level of urban appearance and environmental sanitation.
对在城市市容和环境卫生工作中成绩显著的单位和个人，由人民政府给予奖励。
Units and individuals that have made remarkable achievements in urban appearance and environmental sanitation work shall be rewarded by the people's government.
城市市容管理
Urban Appearance Management
城市中的建筑物和设施，应当符合国家规定的城市容貌标准。对外开放城市、风景旅游城市和有条件的其他城市，可以结合本地具体情况，制定严于国家规定的城市容貌标准；建制镇可以参照国家规定的城市容貌标准执行。
Buildings and facilities in cities shall conform to the national standards for urban appearance. Cities open to the outside world, scenic tourist cities, and other cities with conditions may, in light of local specific circumstances, formulate standards stricter than the national standards for urban appearance; towns established with the approval of the State may implement the national standards for urban appearance as a reference.
一切单位和个人都应当保持建筑物的整洁、美观。在城市人民政府规定的街道的临街建筑物的阳台和窗外，不得堆放、吊挂有碍市容的物品。搭建或者封闭阳台必须符合城市人民政府市容环境卫生行政主管部门的有关规定。
All units and individuals shall keep buildings clean and beautiful. On balconies and outside windows of buildings along streets specified by the people's government of a city, no articles that obstruct appearance shall be stacked or hung. The construction or enclosure of balconies must comply with the relevant provisions of the administrative department of urban appearance and environmental sanitation under the people's government of the city.
在城市中设置户外广告、标语牌、画廊、橱窗等，应当内容健康、外型美观，并定期维修、油饰或者拆除。
Outdoor advertisements, slogan boards, galleries, display windows, etc., set up in cities shall have healthy content and beautiful appearance, and shall be regularly maintained, painted, or removed.
大型户外广告的设置必须征得城市人民政府市容环境卫生行政主管部门同意后，按照有关规定办理审批手续。
The installation of large outdoor advertisements must obtain the consent of the administrative department of urban appearance and environmental sanitation under the people's government of the city, and then go through the approval procedures in accordance with relevant provisions.
城市中的市政公用设施，应当与周围环境相协调，并维护和保持设施完好、整洁。
Municipal public facilities in cities shall be coordinated with the surrounding environment, and shall be maintained and kept in good condition and clean.
主要街道两侧的建筑物前，应当根据需要与可能，选用透景、半透景的围墙、栅栏或者绿篱、花坛(池)、草坪等作为分界。
In front of buildings on both sides of main streets, transparent or semi-transparent walls, fences, hedges, flower beds (pools), lawns, etc., shall be used as boundaries as needed and possible.
临街树木、绿篱、花坛(池)、草坪等，应当保持整洁、美观。栽培、整修或者其他作业留下的渣土、枝叶等，管理单位、个人或者作业者应当及时清除。
Trees, hedges, flower beds (pools), lawns, etc., along streets shall be kept clean and beautiful. Residue soil, branches, and leaves left from cultivation, pruning, or other operations shall be promptly removed by the management unit, individual, or operator.
任何单位和个人都不得在街道两侧和公共场地堆放物料，搭建建筑物、构筑物或者其他设施。因建设等特殊需要，在街道两侧和公共场地临时堆放物料，搭建非永久性建筑物、构筑物或者其他设施的，必须征得城市人民政府市容环境卫生行政主管部门同意后，按照有关规定办理审批手续。
No unit or individual may stack materials, build buildings, structures, or other facilities on both sides of streets or in public spaces. If temporary stacking of materials or construction of non-permanent buildings, structures, or other facilities on both sides of streets or in public spaces is necessary due to construction or other special needs, the consent of the administrative department of urban appearance and environmental sanitation under the people's government of the city must be obtained, and the approval procedures shall be handled in accordance with relevant provisions.
在市区运行的交通运输工具，应当保持外型完好、整洁，货运车辆运输的液体、散装货物，应当密封、包扎、覆盖，避免泄漏、遗撒。
Transportation vehicles operating in urban areas shall be kept in good appearance and clean. Liquid and bulk cargo transported by freight vehicles shall be sealed, wrapped, or covered to avoid leakage or spillage.
城市的工程施工现场的材料、机具应当堆放整齐，渣土应当及时清运；临街工地应当设置护栏或者围布遮挡；停工场地应当及时整理并作必要的覆盖；竣工后，应当及时清理和平整场地。
Materials and equipment at engineering construction sites in cities shall be stacked neatly, and residue soil shall be promptly removed; sites along streets shall be provided with guardrails or covered with cloth; idle sites shall be promptly organized and covered as necessary; after completion, the site shall be promptly cleaned and leveled.
一切单位和个人，都不得在城市建筑物、设施以及树木上涂写、刻画。
No unit or individual may scribble or carve on urban buildings, facilities, or trees.
单位和个人在城市建筑物、设施上张挂、张贴宣传品等，须经城市人民政府市容环境卫生行政主管部门或者其他有关部门批准。
Units and individuals that hang or post promotional materials, etc., on urban buildings or facilities must obtain approval from the administrative department of urban appearance and environmental sanitation under the people's government of the city or other relevant departments.
城市环境卫生管理
Urban Environmental Sanitation Management
城市中的环境卫生设施，应当符合国家规定的城市环境卫生标准。
Environmental sanitation facilities in cities shall conform to the national standards for urban environmental sanitation.
城市人民政府在进行城市新区开发或者旧区改造时，应当依照国家有关规定，建设生活废弃物的清扫、收集、运输和处理等环境卫生设施，所需经费应当纳入建设工程概算。
When carrying out new urban development or renovation of old areas, the people's government of a city shall, in accordance with relevant state provisions, construct environmental sanitation facilities for the sweeping, collection, transportation, and treatment of domestic waste, and the required funds shall be included in the project budget.
城市人民政府市容环境卫生行政主管部门，应当根据城市居住人口密度和流动人口数量以及公共场所等特定地区的需要，制定公共厕所建设规划，并按照规定的标准，建设、改造或者支持有关单位建设、改造公共厕所。
The administrative department of urban appearance and environmental sanitation under the people's government of a city shall, based on the density of urban residential population, the number of floating population, and the needs of specific areas such as public places, formulate plans for the construction of public toilets, and construct, renovate, or support relevant units in constructing or renovating public toilets in accordance with prescribed standards.
城市人民政府市容环境卫生行政主管部门，应当配备专业人员或者委托有关单位和个人负责公共厕所的保洁和管理；有关单位和个人也可以承包公共厕所的保洁和管理。公共厕所的管理者可以适当收费，具体办法由省、自治区、直辖市人民政府制定。
The administrative department of urban appearance and environmental sanitation under the people's government of a city shall assign professional personnel or entrust relevant units or individuals to be responsible for the cleaning and management of public toilets; relevant units or individuals may also contract the cleaning and management of public toilets. Managers of public toilets may charge appropriate fees, and the specific measures shall be formulated by the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government.
对不符合规定标准的公共厕所，城市人民政府应当责令有关单位限期改造。
For public toilets that do not meet the prescribed standards, the people's government of the city shall order the relevant units to renovate them within a time limit.
公共厕所的粪便应当排入贮(化)粪池或者城市污水系统。
The feces from public toilets shall be discharged into storage (treatment) tanks or the urban sewage system.
多层和高层建筑应当设置封闭式垃圾通道或者垃圾贮存设施，并修建清运车辆通道。
Multi-story and high-rise buildings shall be equipped with enclosed garbage chutes or garbage storage facilities, and access roads for garbage collection vehicles shall be constructed.
城市街道两侧、居住区或者人流密集地区，应当设置封闭式垃圾容器、果皮箱等设施。
On both sides of urban streets, residential areas, or densely populated areas, enclosed garbage containers, litter bins, and other facilities shall be installed.
一切单位和个人都不得擅自拆除环境卫生设施；因建设需要必须拆除的，建设单位必须事先提出拆迁方案，报城市人民政府市容环境卫生行政主管部门批准。
No unit or individual may dismantle environmental sanitation facilities without authorization; if dismantling is necessary due to construction needs, the construction unit must first submit a demolition plan and obtain approval from the administrative department of urban appearance and environmental sanitation under the people's government of the city.
按国家行政建制设立的市的主要街道、广场和公共水域的环境卫生，由环境卫生专业单位负责。
The environmental sanitation of main streets, squares, and public waters in cities established according to the administrative divisions of the State shall be the responsibility of specialized environmental sanitation units.
居住区、街巷等地方，由街道办事处负责组织专人清扫保洁。
In residential areas, streets, and alleys, the subdistrict offices shall be responsible for organizing dedicated personnel for sweeping and cleaning.
飞机场、火车站、公共汽车始末站、港口、影剧院、博物馆、展览馆、纪念馆、体育馆(场)和公园等公共场所，由本单位负责清扫保洁。
Airports, railway stations, bus terminals, ports, theaters, museums, exhibition halls, memorial halls, stadiums (gyms), and parks and other public places shall be cleaned and maintained by the respective units.
机关、团体、部队、企事业单位，应当按照城市人民政府市容环境卫生行政主管部门划分的卫生责任区负责清扫保洁。
State organs, organizations, military units, enterprises, and institutions shall be responsible for sweeping and cleaning the sanitation responsibility areas designated by the administrative department of urban appearance and environmental sanitation under the people's government of the city.
城市集贸市场，由主管部门负责组织专人清扫保洁。
Urban markets shall be cleaned and maintained by the competent department organizing dedicated personnel.
各种摊点，由从业者负责清扫保洁。
Various stalls shall be cleaned and maintained by the operators.
城市港口客货码头作业范围内的水面，由港口客货码头经营单位责成作业者清理保洁。
The water surface within the operation area of urban port passenger and cargo terminals shall be cleaned and maintained by the terminal operating unit, which shall instruct the operators to do so.
在市区水域行驶或者停泊的各类船舶上的垃圾、粪便，由船上负责人依照规定处理。
Garbage and feces from various vessels navigating or mooring in urban waters shall be disposed of by the person in charge of the vessel in accordance with regulations.
城市人民政府市容环境卫生行政主管部门对城市生活废弃物的收集、运输和处理实施监督管理。
The administrative department of urban appearance and environmental sanitation under the people's government of a city shall supervise and manage the collection, transportation, and treatment of urban domestic waste.
一切单位和个人，都应当依照城市人民政府市容环境卫生行政主管部门规定的时间、地点、方式，倾倒垃圾、粪便。
All units and individuals shall dump garbage and feces at the times, places, and in the manner prescribed by the administrative department of urban appearance and environmental sanitation under the people's government of the city.
对垃圾、粪便应当及时清运，并逐步做到垃圾、粪便的无害化处理和综合利用。
Garbage and feces shall be promptly removed, and efforts shall be made to gradually achieve harmless treatment and comprehensive utilization of garbage and feces.
对城市生活废弃物应当逐步做到分类收集、运输和处理。
Urban domestic waste shall be gradually collected, transported, and treated by classification.
环境卫生管理应当逐步实行社会化服务。有条件的城市，可以成立环境卫生服务公司。
Environmental sanitation management shall gradually implement socialized services. Cities with conditions may establish environmental sanitation service companies.
凡委托环境卫生专业单位清扫、收集、运输和处理废弃物的，应当交纳服务费。具体办法由省、自治区、直辖市人民政府制定。
Those who entrust specialized environmental sanitation units to clean, collect, transport, and treat waste shall pay service fees. The specific measures shall be formulated by the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government.
城市人民政府应当有计划地发展城市煤气、天然气、液化气，改变燃料结构；鼓励和支持有关部门组织净菜进城和回收利用废旧物资，减少城市垃圾。
The people's government of a city shall plan to develop urban gas, natural gas, and liquefied petroleum gas to change the fuel structure; encourage and support relevant departments to organize the delivery of clean vegetables to the city and the recycling of waste materials to reduce urban garbage.
医院、疗养院、屠宰场、生物制品厂产生的废弃物，必须依照有关规定处理。
Waste generated by hospitals, sanatoriums, slaughterhouses, and biological product factories must be disposed of in accordance with relevant regulations.
公民应当爱护公共卫生环境，不随地吐痰、便溺，不乱扔果皮、纸屑和烟头等废弃物。
Citizens shall protect the public health environment, refrain from spitting or defecating indiscriminately, and not discard fruit peels, paper scraps, cigarette butts, or other waste.
按国家行政建制设立的市的市区内，禁止饲养鸡、鸭、鹅、兔、羊、猪等家畜家禽；因教学、科研以及其他特殊需要饲养的除外。
Within the urban areas of cities established according to the administrative divisions of the State, it is prohibited to raise livestock and poultry such as chickens, ducks, geese, rabbits, sheep, and pigs; except for those raised for teaching, scientific research, or other special needs.
罚则
Penalties
有下列行为之一者，城市人民政府市容环境卫生行政主管部门或者其委托的单位除责令其纠正违法行为、采取补救措施外，可以并处警告、罚款：
For any of the following acts, the administrative department of urban appearance and environmental sanitation under the people's government of the city or its entrusted unit shall, in addition to ordering the correction of the illegal act and taking remedial measures, also impose a warning or a fine:
(一)随地吐痰、便溺，乱扔果皮、纸屑和烟头等废弃物的；
(1) Spitting, defecating, or discarding fruit peels, paper scraps, cigarette butts, or other waste indiscriminately;
(二)在城市建筑物、设施以及树木上涂写、刻画或者未经批准张挂、张贴宣传品等的；
(2) Scribbling or carving on urban buildings, facilities, or trees, or hanging or posting promotional materials without approval;
(三)在城市人民政府规定的街道的临街建筑物的阳台和窗外，堆放、吊挂有碍市容的物品的；
(3) Stacking or hanging articles that obstruct appearance on balconies or outside windows of buildings along streets specified by the people's government of the city;
(四)不按规定的时间、地点、方式，倾倒垃圾、粪便的；
(4) Dumping garbage or feces not at the prescribed time, place, or in the prescribed manner;
(五)不履行卫生责任区清扫保洁义务或者不按规定清运、处理垃圾和粪便的；
(5) Failing to perform the obligation of sweeping and cleaning the sanitation responsibility area, or failing to remove and dispose of garbage and feces in accordance with regulations;
(六)运输液体、散装货物不作密封、包扎、覆盖，造成泄漏、遗撒的；
(6) Transporting liquid or bulk cargo without sealing, wrapping, or covering, causing leakage or spillage;
(七)临街工地不设置护栏或者不作遮挡、停工场地不及时整理并作必要覆盖或者竣工后不及时清理和平整场地，影响市容和环境卫生的。
(7) Failing to set up guardrails or coverings at construction sites along streets, failing to promptly organize and cover idle sites, or failing to promptly clean and level the site after completion, affecting appearance and environmental sanitation.
饲养家畜家禽影响市容和环境卫生的，由城市人民政府市容环境卫生行政主管部门或者其委托的单位，责令其限期处理或者予以没收，并可处以罚款。
If raising livestock or poultry affects urban appearance and environmental sanitation, the administrative department of urban appearance and environmental sanitation under the people's government of the city or its entrusted unit shall order the person to dispose of them within a time limit or confiscate them, and may also impose a fine.
有下列行为之一者，由城市人民政府市容环境卫生行政主管部门或者其委托的单位责令其停止违法行为，限期清理、拆除或者采取其他补救措施，并可处以罚款：
For any of the following acts, the administrative department of urban appearance and environmental sanitation under the people's government of the city or its entrusted unit shall order the cessation of the illegal act, and order cleaning, removal, or other remedial measures within a time limit, and may also impose a fine:
(一)未经城市人民政府市容环境卫生行政主管部门同意，擅自设置大型户外广告，影响市容的；
(1) Setting up large outdoor advertisements without the consent of the administrative department of urban appearance and environmental sanitation under the people's government of the city, affecting appearance;
(二)未经城市人民政府市容环境卫生行政主管部门批准，擅自在街道两侧和公共场地堆放物料，搭建建筑物、构筑物或者其他设施，影响市容的；
(2) Stacking materials or building buildings, structures, or other facilities on both sides of streets or in public spaces without approval from the administrative department of urban appearance and environmental sanitation under the people's government of the city, affecting appearance;
(三)未经批准擅自拆除环境卫生设施或者未按批准的拆迁方案进行拆迁的。
(3) Dismantling environmental sanitation facilities without approval, or failing to carry out demolition in accordance with the approved demolition plan.
凡不符合城市容貌标准、环境卫生标准的建筑物或者设施，由城市人民政府市容环境卫生行政主管部门会同城市规划行政主管部门，责令有关单位和个人限期改造或者拆除；逾期未改造或者未拆除的，经县级以上人民政府批准，由城市人民政府市容环境卫生行政主管部门或者城市规划行政主管部门组织强制拆除，并可处以罚款。
For buildings or facilities that do not meet the standards for urban appearance and environmental sanitation, the administrative department of urban appearance and environmental sanitation under the people's government of the city shall, together with the administrative department of urban planning, order the relevant units or individuals to renovate or demolish them within a time limit; if renovation or demolition is not carried out within the time limit, with the approval of the people's government at or above the county level, the administrative department of urban appearance and environmental sanitation or the administrative department of urban planning under the people's government of the city shall organize compulsory demolition, and may also impose a fine.
损坏各类环境卫生设施及其附属设施的，城市人民政府市容环境卫生行政主管部门或者其委托的单位除责令其恢复原状外，可以并处罚款；盗窃、损坏各类环境卫生设施及其附属设施，应当给予治安管理处罚的，依照《中华人民共和国治安管理处罚法》的规定处罚；构成犯罪的，依法追究刑事责任。
If any person damages various environmental sanitation facilities or their ancillary facilities, the administrative department of urban appearance and environmental sanitation under the people's government of the city or its entrusted unit shall, in addition to ordering restoration to the original condition, also impose a fine; if the theft or damage of various environmental sanitation facilities or their ancillary facilities warrants a public security penalty, the penalty shall be imposed in accordance with the Law of the People's Republic of China on Public Security Administration Punishments; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
侮辱、殴打市容和环境卫生工作人员或者阻挠其执行公务的，依照《中华人民共和国治安管理处罚法》的规定处罚；构成犯罪的，依法追究刑事责任。
If any person insults, beats, or obstructs appearance and environmental sanitation workers in the performance of their duties, the penalty shall be imposed in accordance with the Law of the People's Republic of China on Public Security Administration Punishments; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
当事人对行政处罚决定不服的，可以自接到处罚通知之日起15日内，向作出处罚决定机关的上一级机关申请复议；对复议决定不服的，可以自接到复议决定书之日起15日内向人民法院起诉。当事人也可以自接到处罚通知之日起15日内直接向人民法院起诉。期满不申请复议、也不向人民法院起诉、又不履行处罚决定的，由作出处罚决定的机关申请人民法院强制执行。
If a party is dissatisfied with the decision on administrative penalty, it may, within 15 days from the date of receipt of the notice of penalty, apply for reconsideration to the organ at the next higher level of the organ that made the penalty decision; if dissatisfied with the reconsideration decision, it may, within 15 days from the date of receipt of the reconsideration decision, file a lawsuit with the people's court. The party may also directly file a lawsuit with the people's court within 15 days from the date of receipt of the notice of penalty. If the party neither applies for reconsideration nor files a lawsuit with the people's court within the time limit, nor complies with the penalty decision, the organ that made the penalty decision shall apply to the people's court for compulsory enforcement.
对治安管理处罚不服的，依照《中华人民共和国治安管理处罚法》的规定办理。
If dissatisfied with a public security administration penalty, the matter shall be handled in accordance with the Law of the People's Republic of China on Public Security Administration Punishments.
城市人民政府市容环境卫生行政主管部门工作人员玩忽职守、滥用职权、徇私舞弊的，由其所在单位或者上级主管机关给予行政处分；构成犯罪的，依法追究刑事责任。
If staff members of the administrative department of urban appearance and environmental sanitation under the people's government of a city neglect their duties, abuse their power, or engage in malpractice for personal gain, they shall be given administrative sanctions by their unit or the competent authority at a higher level; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
附则
Supplementary Provisions
未设镇建制的城市型居民区可以参照本条例执行。
Urban-type residential areas that have not been established as towns may implement these Regulations as a reference.
省、自治区、直辖市人民政府可以根据本条例制定实施办法。
The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may formulate implementation measures in accordance with these Regulations.
本条例由国务院城市建设行政主管部门负责解释。
These Regulations shall be interpreted by the administrative department of urban construction under the State Council.
本条例自1992年8月1日起施行。
These Regulations shall come into force as of August 1, 1992.
