总 则
General Provisions
为了科学、有效地组织实施全国农业普查，保障农业普查数据的真实性、准确性、完整性和及时性，根据《中华人民共和国统计法》，制定本条例。
These Regulations are formulated in accordance with the Statistics Law of the People's Republic of China for the purpose of scientifically and effectively organizing and implementing the national agricultural census, and ensuring the authenticity, accuracy, completeness, and timeliness of agricultural census data.
农业普查的目的，是全面掌握我国农业、农村和农民的基本情况，为研究制定经济社会发展战略、规划、政策和科学决策提供依据，并为农业生产经营者和社会公众提供统计信息服务。
The purpose of the agricultural census is to comprehensively grasp the basic situation of agriculture, rural areas, and farmers in China, to provide a basis for studying and formulating economic and social development strategies, plans, policies, and scientific decision-making, and to provide statistical information services for agricultural producers and operators and the public.
农业普查工作按照全国统一领导、部门分工协作、地方分级负责、各方共同参与的原则组织实施。
The agricultural census work shall be organized and implemented in accordance with the principles of unified national leadership, division of labor and cooperation among departments, hierarchical responsibility at local levels, and joint participation of all parties.
国家机关、社会团体以及与农业普查有关的单位和个人，应当依照《中华人民共和国统计法》和本条例的规定，积极参与并密切配合农业普查工作。
State organs, social organizations, and units and individuals related to the agricultural census shall actively participate in and closely cooperate with the agricultural census work in accordance with the provisions of the Statistics Law of the People's Republic of China and these Regulations.
各级农业普查领导小组办公室(以下简称普查办公室)和普查办公室工作人员、普查指导员、普查员(以下统称普查人员)依法独立行使调查、报告、监督的职权，任何单位和个人不得干涉。
The leading group offices for agricultural census at all levels (hereinafter referred to as census offices) and their staff, census supervisors, and enumerators (hereinafter collectively referred to as census personnel) shall independently exercise the powers of investigation, reporting, and supervision according to law, and no unit or individual may interfere.
各地方、各部门、各单位的负责人不得自行修改普查办公室、普查人员依法搜集、整理的农业普查资料，不得以任何方式要求普查办公室、普查人员伪造、篡改农业普查资料，不得明示、暗示下级单位及其人员或者农业普查对象填报虚假农业普查数据，不得对依法履行职责或者拒绝、抵制农业普查违法行为的单位和个人打击报复。
Heads of localities, departments, and units shall not modify the agricultural census data lawfully collected and compiled by census offices and census personnel, shall not in any way require census offices or census personnel to forge or tamper with agricultural census data, shall not explicitly or implicitly instruct subordinate units and their personnel or agricultural census respondents to fill in false agricultural census data, and shall not retaliate against units or individuals who perform their duties according to law or refuse or resist illegal acts in the agricultural census.
报刊、广播、电视、新闻网站等新闻媒体和网络服务提供者，应当采取多种形式，开展农业普查宣传报道。
News media such as newspapers, radio, television, news websites, and network service providers shall adopt various forms to carry out publicity and reporting on the agricultural census.
农业普查所需经费，由中央和地方各级人民政府共同负担，并列入相应年度预算，按时拨付，确保足额到位。
The funds required for the agricultural census shall be borne jointly by the central and local people's governments at all levels, and shall be included in the corresponding annual budgets, disbursed on time, and ensured to be fully in place.
农业普查经费应当统一管理、专款专用、从严控制支出。
Agricultural census funds shall be managed uniformly, used exclusively for designated purposes, and expenditures shall be strictly controlled.
各级财政部门、审计部门依据职责，加强对农业普查经费的预算监督和审计监督。
Financial departments and audit departments at all levels shall, in accordance with their duties, strengthen budget supervision and audit supervision over agricultural census funds.
农业普查每10年进行一次，尾数逢6的年份为农业普查年度，标准时点为农业普查年度的12月31日24时。特殊地区的农业普查登记时间经国务院农业普查领导小组办公室批准，可以适当调整。
The agricultural census shall be conducted once every 10 years, with years ending in the digit 6 designated as agricultural census years. The standard reference time is 24:00 on December 31 of the agricultural census year. The registration period for agricultural censuses in special regions may be appropriately adjusted with the approval of the Office of the Leading Group for the National Agricultural Census of the State Council.
农业普查的对象、范围和内容
Objects, Scope, and Content of the Agricultural Census
农业普查对象是在中华人民共和国境内的下列单位和个人：
The objects of the agricultural census are the following units and individuals within the territory of the People's Republic of China:
(一)农村住户，包括农村农业生产经营户和其他住户；
(1) Rural households, including rural agricultural production households and other households;
(二)城镇农业生产经营户；
(2) Urban agricultural production households;
(三)农业生产经营单位；
(3) Agricultural production units;
(四)村民委员会；
(4) Villagers' committees;
(五)乡镇人民政府。
(5) Township people's governments.
农业普查对象应当如实回答普查人员就农业普查有关问题的询问，按时填报农业普查表、提供农业普查所需的资料，不得提供不真实或者不完整的农业普查资料，不得迟报、拒报农业普查资料。
Agricultural census respondents shall truthfully answer inquiries from census personnel regarding matters related to the agricultural census, fill in the agricultural census forms on time, and provide the materials required for the agricultural census. They shall not provide false or incomplete agricultural census data, nor delay or refuse to submit agricultural census data.
农业普查对象应当配合县级以上人民政府统计机构依法进行的监督检查，如实反映情况，提供相关证明和资料，不得拒绝、阻碍检查，不得转移、隐匿、篡改、毁弃原始记录和凭证、统计台账、农业普查表、会计资料及其他相关证明和资料。
Agricultural census respondents shall cooperate with the statistical institutions of the people's governments at or above the county level in conducting supervision and inspection according to law, truthfully report the situation, and provide relevant evidence and materials. They shall not refuse or obstruct inspections, nor transfer, conceal, alter, or destroy original records and vouchers, statistical ledgers, agricultural census forms, accounting materials, and other relevant evidence and materials.
要求农业普查对象提供报表、资料，应当坚持必要、规范原则，精简整合填报事项，强化数据共享利用，减轻基层负担。
Requiring agricultural census respondents to provide reports and materials shall adhere to the principles of necessity and standardization, streamline and integrate reporting items, strengthen data sharing and utilization, and reduce the burden on grassroots units.
农业普查行业范围包括：农作物种植业、林业、畜牧业、渔业和农林牧渔辅助性活动。
The industry scope of the agricultural census includes: crop cultivation, forestry, animal husbandry, fishery, and auxiliary activities for agriculture, forestry, animal husbandry, and fishery.
农业普查内容包括：农业生产条件、农业生产经营活动、农业土地利用、农村居民生活、农村劳动力及就业、乡村产业发展、乡村建设、乡村治理等情况。
The content of the agricultural census includes: agricultural production conditions, agricultural production and operation activities, agricultural land use, rural residents' living conditions, rural labor force and employment, rural industry development, rural construction, and rural governance.
国务院农业普查领导小组办公室可以根据具体情况对前款规定的农业普查内容进行调整。
The Office of the Leading Group for the National Agricultural Census of the State Council may adjust the agricultural census content specified in the preceding paragraph based on specific circumstances.
农业普查采用全面调查的方法。国务院农业普查领导小组办公室可以决定对特定内容采用抽样调查、遥感测量等方法。
The agricultural census adopts the method of comprehensive survey. The Office of the Leading Group for the National Agricultural Census of the State Council may decide to use methods such as sample surveys and remote sensing measurements for specific content.
农业普查应当充分利用行政记录、社会大数据等资料。
The agricultural census shall make full use of administrative records, social big data, and other materials.
农业普查执行国家统计标准。
The agricultural census implements national statistical standards.
农业普查方案由国务院农业普查领导小组办公室统一制定，报国务院审批。农业普查应当按照农业普查方案的规定执行。
The agricultural census plan shall be uniformly formulated by the Office of the Leading Group for the National Agricultural Census of the State Council and submitted to the State Council for approval. The agricultural census shall be carried out in accordance with the provisions of the agricultural census plan.
省级普查办公室可以根据需要增设农业普查附表，报经国务院农业普查领导小组办公室批准后实施。
Provincial census offices may add supplementary forms for the agricultural census as needed, subject to approval by the Office of the State Council Leading Group for Agricultural Census.
农业普查的组织实施
Organization and Implementation of the Agricultural Census
国务院设立农业普查领导小组及其办公室。国务院农业普查领导小组负责组织和领导全国农业普查工作。国务院农业普查领导小组办公室设在国家统计局，具体负责农业普查日常工作的组织和协调。国务院农业普查领导小组及其办公室任务完成后自动撤销。
The State Council shall establish a leading group for the agricultural census and its office. The State Council Leading Group for Agricultural Census is responsible for organizing and leading the national agricultural census. The Office of the State Council Leading Group for Agricultural Census is located within the National Bureau of Statistics and is specifically responsible for organizing and coordinating the daily work of the agricultural census. The State Council Leading Group for Agricultural Census and its office shall be automatically dissolved after their tasks are completed.
地方各级人民政府设立农业普查领导小组及其办公室，按照国务院农业普查领导小组及其办公室的统一规定和要求，负责本行政区域内农业普查的组织实施工作。国家统计局派出的调查机构作为农业普查领导小组及其办公室的成员单位，参与农业普查的组织实施工作。地方各级农业普查领导小组及其办公室任务完成后自动撤销。
Local people's governments at all levels shall establish leading groups for the agricultural census and their offices, and shall be responsible for organizing and implementing the agricultural census within their respective administrative regions in accordance with the unified regulations and requirements of the State Council Leading Group for Agricultural Census and its office. The survey agencies dispatched by the National Bureau of Statistics shall participate in the organization and implementation of the agricultural census as member units of the leading groups and their offices. The local leading groups for the agricultural census and their offices at all levels shall be automatically dissolved after their tasks are completed.
村民委员会应当在乡镇人民政府的指导下协助做好本区域内的农业普查工作。
Villagers' committees shall, under the guidance of the township people's governments, assist in the agricultural census work within their respective areas.
县级以上各级人民政府有关部门应当积极参与并密切配合普查办公室开展农业普查工作。
Relevant departments of people's governments at or above the county level shall actively participate in and closely cooperate with the census offices in carrying out the agricultural census.
军队所属单位的农业普查工作，由军队统一组织实施。
The agricultural census work for units under the military shall be organized and implemented uniformly by the military.
新疆生产建设兵团的农业普查工作，由新疆生产建设兵团农业普查领导小组及其办公室负责组织实施。
The agricultural census work for the Xinjiang Production and Construction Corps shall be organized and implemented by the Leading Group for Agricultural Census of the Xinjiang Production and Construction Corps and its office.
农村的农业普查现场登记按普查区进行。普查区以村民委员会管理地域为基础划分，每个普查区可以划分为若干个普查小区。
On-site registration for the agricultural census in rural areas shall be conducted by census districts. Census districts are delineated based on the management area of villagers' committees, and each census district may be divided into several census sub-districts.
城镇的农业普查现场登记，按照农业普查方案的规定进行。
On-site registration for the agricultural census in urban areas shall be conducted in accordance with the provisions of the agricultural census plan.
每个普查小区配备一名普查员，负责农业普查的访问登记等工作。每个普查区至少配备一名普查指导员，负责安排、指导和督促检查普查员的工作，也可以直接进行访问登记。
Each enumeration district shall be assigned one enumerator, who is responsible for conducting interviews and registration for the agricultural census. Each enumeration area shall be assigned at least one supervisor, who is responsible for arranging, guiding, and supervising the work of enumerators, and may also directly conduct interviews and registration.
普查指导员和普查员主要由有较高文化水平的乡村干部、村民小组长和其他当地居民担任。
Supervisors and enumerators shall primarily be selected from village and township cadres with relatively high educational levels, leaders of villagers' groups, and other local residents.
普查指导员和普查员应当身体健康、责任心强。
Supervisors and enumerators shall be in good health and have a strong sense of responsibility.
普查办公室根据工作需要，可以聘用或者按照规定从其他有关单位借调人员从事农业普查工作。有关单位应当积极推荐符合条件的人员从事农业普查工作。
The census office may, based on work needs, hire personnel or borrow personnel from other relevant units in accordance with regulations to carry out agricultural census work. Relevant units shall actively recommend qualified personnel to engage in agricultural census work.
聘用人员应当由聘用单位支付劳动报酬。借调人员的工资由原单位支付，其福利待遇保持不变。
Hired personnel shall be paid labor remuneration by the hiring unit. The salaries of borrowed personnel shall be paid by their original units, and their benefits shall remain unchanged.
农业普查经费中应当对普查指导员、普查员安排适当的工作补助。
Appropriate work subsidies shall be arranged for supervisors and enumerators from the agricultural census funds.
普查办公室应当对普查指导员和普查员进行业务培训，对考核合格的人员颁发全国统一的普查指导员证或者普查员证。
The census office shall provide professional training to supervisors and enumerators, and issue nationally uniform supervisor certificates or enumerator certificates to those who pass the assessment.
普查人员进行农业普查时，有权就与农业普查有关的问题询问有关单位和个人，要求有关单位和个人如实提供有关情况和资料并改正不真实、不准确的资料。
When conducting the agricultural census, census personnel have the right to ask relevant units and individuals questions related to the agricultural census, require relevant units and individuals to truthfully provide relevant information and materials, and correct inaccurate or false materials.
普查人员应当坚持实事求是，恪守职业道德，拒绝、抵制农业普查工作中的违法行为。
Census personnel shall adhere to the principle of seeking truth from facts, uphold professional ethics, and refuse to engage in or resist illegal acts in agricultural census work.
普查办公室、普查人员应当严格执行农业普查方案，如实搜集、报送农业普查资料，不得伪造、篡改农业普查资料，不得以任何方式要求农业普查对象提供不真实的农业普查资料，不得以任何方式要求普查人员或者下级普查办公室伪造、篡改农业普查资料，不得有其他违反本条例规定的行为。
The census office and census personnel shall strictly implement the agricultural census plan, truthfully collect and report agricultural census data, and shall not fabricate or tamper with agricultural census data, shall not in any way require agricultural census respondents to provide false agricultural census data, shall not in any way require census personnel or lower-level census offices to fabricate or tamper with agricultural census data, and shall not engage in any other acts that violate these regulations.
普查指导员和普查员执行农业普查任务时，应当出示普查指导员证或者普查员证；未出示的，农业普查对象有权拒绝提供有关情况和资料。
When performing agricultural census tasks, enumerators and supervisors shall present their enumerator or supervisor certificates; if not presented, the agricultural census respondents have the right to refuse to provide relevant information and data.
普查员应当依法直接访问农业普查对象，当场进行询问、填报。农业普查表填写完成后，应当由农业普查对象签字或者盖章确认。农业普查对象应当对其签字或者盖章的农业普查资料的真实性负责。
Enumerators shall, in accordance with the law, directly visit agricultural census respondents, conduct on-site inquiries, and fill in the forms. After the agricultural census form is completed, it shall be signed or sealed by the agricultural census respondent for confirmation. The agricultural census respondent shall be responsible for the authenticity of the agricultural census data they have signed or sealed.
普查人员应当对其负责登记、审核、录入的农业普查资料与农业普查对象签字或者盖章的农业普查资料的一致性负责。
Census personnel shall be responsible for the consistency between the agricultural census data they register, review, and input and the agricultural census data signed or sealed by the agricultural census respondent.
普查办公室应当对其加工、整理的农业普查资料的真实性、准确性、完整性负责。
The census office shall be responsible for the authenticity, accuracy, and completeness of the agricultural census data it processes and compiles.
数据处理和质量控制
Data Processing and Quality Control
农业普查数据处理方案和实施办法，由国务院农业普查领导小组办公室制定。
The agricultural census data processing plan and implementation measures shall be formulated by the Office of the Leading Group for the National Agricultural Census of the State Council.
普查办公室应当按照数据处理方案和实施办法的规定进行数据处理。
The census office shall conduct data processing in accordance with the provisions of the data processing plan and implementation measures.
国务院农业普查领导小组办公室应当建立健全农业普查数据处理系统，并加强日常管理和维护更新，保障数据安全。
The Office of the Leading Group for the National Agricultural Census of the State Council shall establish and improve the agricultural census data processing system, and strengthen daily management, maintenance, and updates to ensure data security.
国家建立农业普查数据质量控制制度。
The state establishes an agricultural census data quality control system.
普查办公室应当按照农业普查数据质量控制制度有关要求，对农业普查实施中的每个环节实行质量控制和检查验收。
The census office shall, in accordance with the relevant requirements of the agricultural census data quality control system, implement quality control and inspection acceptance at every stage of the agricultural census implementation.
普查人员实行质量控制工作责任制。
Census personnel shall implement a quality control work responsibility system.
普查人员应当按照农业普查方案的规定对农业普查数据进行审核、复查和验收。
Census personnel shall, in accordance with the provisions of the agricultural census plan, conduct review, re-examination, and acceptance of agricultural census data.
国务院农业普查领导小组办公室制定农业普查事后质量抽查方案，统一组织农业普查事后质量抽查工作。事后质量抽查结果作为评估全国和各地方农业普查数据质量的重要依据。
The Leading Group Office of the State Council for the Agricultural Census shall formulate a post-census quality inspection plan and uniformly organize post-census quality inspection work. The results of the post-census quality inspection shall serve as an important basis for evaluating the quality of agricultural census data nationwide and in various localities.
数据公布、资料管理和开发应用
Data Publication, Data Management, and Development and Application
国家建立农业普查资料公布制度。
The state shall establish a system for the publication of agricultural census data.
农业普查汇总资料，除依法予以保密的外，应当及时向社会公布。
Aggregated agricultural census data shall be promptly released to the public, except for data that shall be kept confidential in accordance with the law.
全国农业普查数据和各省、自治区、直辖市的主要农业普查数据，由国务院农业普查领导小组办公室审定并会同国务院有关部门公布。
National agricultural census data and the main agricultural census data of provinces, autonomous regions, and municipalities directly under the Central Government shall be reviewed and approved by the Leading Group Office of the State Council for the Agricultural Census and published jointly with the relevant departments of the State Council.
地方普查办公室发布农业普查公报，应当报经上一级普查办公室核准。
When local census offices issue agricultural census bulletins, they shall report to the census office at the next higher level for approval.
普查办公室、普查人员对在农业普查工作中知悉的国家秘密、工作秘密、商业秘密、个人隐私和个人信息，应当予以保密，不得泄露或者向他人非法提供；对在农业普查工作中搜集的能够识别或者推断单个农业普查对象身份的资料，不得对外提供、泄露，不得用于统计以外的目的。
Census offices and census personnel shall keep confidential any state secrets, work secrets, trade secrets, personal privacy, and personal information learned during the agricultural census work, and shall not disclose or illegally provide them to others; data collected during the agricultural census work that can identify or infer the identity of individual agricultural census subjects shall not be provided or disclosed externally, and shall not be used for purposes other than statistics.
普查办公室应当按照国家有关规定建立健全农业普查资料的保存、管理制度，做好农业普查资料的保存、管理，并在农业普查工作结束后，及时做好有关农业普查资料的归档和移交。
Census offices shall, in accordance with the relevant provisions of the state, establish and improve the preservation and management system for agricultural census data, properly preserve and manage agricultural census data, and promptly archive and transfer relevant agricultural census data after the agricultural census work is completed.
有关部门应当依法做好农业普查资料部门间共享和为社会公众提供服务等工作，并对农业普查资料进行开发和应用。
Relevant departments shall, in accordance with the law, properly carry out the sharing of agricultural census data among departments and provide services to the public, and shall develop and apply agricultural census data.
县级以上各级人民政府统计机构和有关部门可以根据农业普查结果，对有关常规统计的历史数据进行修正，具体办法由国家统计局规定。
The statistical institutions of the people's governments at or above the county level and relevant departments may, based on the results of the agricultural census, correct historical data from relevant routine statistics. The specific measures shall be formulated by the National Bureau of Statistics.
奖励和处罚
Rewards and Penalties
对认真执行本条例，忠于职守，坚持原则，做出显著成绩的单位和个人，按照国家有关规定给予奖励。
Units and individuals that earnestly implement these regulations, are devoted to their duties, adhere to principles, and achieve outstanding results shall be rewarded in accordance with relevant state regulations.
地方、部门、单位的负责人有下列行为之一的，依法给予处分，并由县级以上人民政府统计机构予以通报：
If the responsible persons of local authorities, departments, or units commit any of the following acts, they shall be given sanctions according to law, and the statistical institution of the people's government at or above the county level shall issue a notice of criticism:
(一)自行修改农业普查资料、编造虚假农业普查数据的；
(1) Unauthorized modification of agricultural census data or fabrication of false agricultural census data;
(二)要求普查办公室、普查人员伪造、篡改农业普查资料的；
(2) Requiring the census office or census personnel to forge or tamper with agricultural census data;
(三)明示、暗示下级单位及其人员或者农业普查对象填报虚假农业普查数据的；
(3) Explicitly or implicitly instructing subordinate units and their personnel or agricultural census subjects to submit false agricultural census data;
(四)对本地方、本部门、本单位发生的农业普查数据严重失实情况和严重农业普查违法行为失察的；
(4) Failing to detect serious inaccuracies in agricultural census data or serious illegal acts in the agricultural census occurring in their locality, department, or unit;
(五)有其他农业普查造假、弄虚作假行为的。
(5) Engaging in other acts of fraud or falsification in the agricultural census.
对依法履行职责或者拒绝、抵制农业普查违法行为的单位和个人打击报复的，依照前款规定给予处分和予以通报。
Anyone who retaliates against a unit or individual that lawfully performs duties or resists or reports illegal acts in the agricultural census shall be subject to the sanctions and public notification as provided in the preceding paragraph.
普查办公室有下列行为之一的，由本级人民政府或者上级人民政府统计机构责令改正，予以通报；对负有责任的领导人员和直接责任人员依法给予处分：
If a census office commits any of the following acts, the people's government at the same level or the statistical institution of the people's government at a higher level shall order correction and issue a public notification; the responsible leaders and directly responsible personnel shall be given sanctions according to law:
(一)未执行农业普查方案的；
(1) Failing to implement the agricultural census plan;
(二)伪造、篡改农业普查资料的；
(2) Forging or tampering with agricultural census data;
(三)要求农业普查对象提供不真实的农业普查资料的；
(3) Requiring agricultural census respondents to provide false agricultural census data;
(四)要求普查人员或者下级普查办公室伪造、篡改农业普查资料的。
(4) Requiring census personnel or lower-level census offices to forge or tamper with agricultural census data.
普查人员有前款所列行为之一的，责令改正，依法给予处分。
If a census personnel commits any of the acts listed in the preceding paragraph, they shall be ordered to correct and given sanctions according to law.
普查办公室有下列行为之一的，对负有责任的领导人员和直接责任人员依法给予处分：
If a census office commits any of the following acts, the responsible leaders and directly responsible personnel shall be given sanctions according to law:
(一)违法公布农业普查资料的；
(1) Illegally publishing agricultural census data;
(二)泄露或者向他人非法提供在农业普查工作中知悉的国家秘密、工作秘密、商业秘密、个人隐私、个人信息的；
(2) Disclosing or illegally providing to others any state secrets, work secrets, trade secrets, personal privacy, or personal information learned during the agricultural census work.
(三)对外提供、泄露在农业普查工作中搜集的能够识别或者推断单个农业普查对象身份的资料的；
(3) Disclosing or leaking information collected during the agricultural census that can identify or infer the identity of an individual agricultural census subject;
(四)违反国家有关规定，造成农业普查资料毁损、灭失的。
(4) Violating relevant state regulations, causing damage or loss of agricultural census data.
普查人员有前款所列行为之一的，依法给予处分。
Census personnel who commit any of the acts listed in the preceding paragraph shall be given sanctions according to law.
作为农业普查对象的农业生产经营单位、村民委员会、乡镇人民政府有下列行为之一的，由县级以上人民政府统计机构责令改正，给予警告，可以予以通报；其负有责任的领导人员和直接责任人员属于公职人员的，依法给予处分：
Where an agricultural production operation unit, villagers' committee, or township people's government that is an agricultural census subject commits any of the following acts, the statistical institution of the people's government at or above the county level shall order correction, give a warning, and may circulate a notice; if the responsible leaders and directly responsible personnel are public officials, they shall be given sanctions according to law:
(一)拒绝或者阻碍普查办公室、普查人员依法进行农业普查的；
(1) Refusing or obstructing the census office or census personnel from conducting the agricultural census according to law;
(二)提供不真实或者不完整的农业普查资料的；
(2) Providing false or incomplete agricultural census data;
(三)拒报或者经催报后仍未按时提供农业普查资料的；
(3) Refusing to report or failing to provide agricultural census data on time after a reminder;
(四)拒绝、阻碍监督检查的；
(4) Refusing or obstructing supervision and inspection;
(五)转移、隐匿、篡改、毁弃或者拒绝提供原始记录和凭证、统计台账、农业普查表、会计资料及其他相关证明和资料的。
(5) Transferring, concealing, altering, destroying, or refusing to provide original records and vouchers, statistical ledgers, agricultural census forms, accounting data, and other related certificates and materials.
农业生产经营单位有前款所列行为之一的，可以并处10万元以下罚款；情节严重的，并处10万元以上50万元以下罚款。
If an agricultural production operation unit commits any of the acts listed in the preceding paragraph, it may also be fined up to 100,000 yuan; if the circumstances are serious, it shall be fined between 100,000 and 500,000 yuan.
农村住户、城镇农业生产经营户有本条第一款所列行为之一的，由县级以上人民政府统计机构责令改正，予以批评教育。
If rural households or urban agricultural production households commit any of the acts listed in the first paragraph of this article, the statistical institution of the people's government at or above the county level shall order correction and provide criticism and education.
农业普查对象有本条第一款第(一)、(四)项所列行为之一，构成违反治安管理行为的，由公安机关依法处理。
If an agricultural census respondent commits any of the acts listed in items (1) or (4) of the first paragraph of this article, which constitutes a violation of public security administration, the public security organ shall handle it according to law.
作为农业普查对象的农业生产经营单位、村民委员会、乡镇人民政府迟报农业普查资料的，由县级以上人民政府统计机构责令改正，给予警告，可以予以通报；其负有责任的领导人员和直接责任人员属于公职人员的，依法给予处分。
If an agricultural production unit, villagers' committee, or township people's government that is an agricultural census respondent delays reporting agricultural census data, the statistical institution of the people's government at or above the county level shall order correction, issue a warning, and may circulate a notice; if the responsible leaders and directly responsible personnel are public officials, they shall be given sanctions according to law.
农业生产经营单位迟报农业普查资料的，可以并处5万元以下罚款。
If an agricultural production unit delays reporting agricultural census data, a fine of not more than 50,000 yuan may also be imposed.
农村住户、城镇农业生产经营户迟报农业普查资料的，由县级以上人民政府统计机构责令改正，予以批评教育。
If a rural household or urban agricultural production household delays reporting agricultural census data, the statistical institution of the people's government at or above the county level shall order correction and provide criticism and education.
违反本条例规定，造成人身损害或者财产损失的，依法承担民事责任；构成犯罪的，依法追究刑事责任。
If a violation of these regulations causes personal injury or property damage, civil liability shall be borne according to law; if a crime is constituted, criminal liability shall be pursued according to law.
普查办公室应当设立举报电话和信箱，接受社会各界对农业普查违法行为的检举和监督。对检举有功的单位和个人按照国家有关规定给予奖励。
The census office shall set up a reporting hotline and mailbox to accept reports and supervision from all sectors of society regarding illegal acts in the agricultural census. Units and individuals that have made meritorious contributions in reporting shall be rewarded in accordance with relevant state regulations.
附 则
Supplementary Provisions
街道办事处、居民委员会涉及农业生产经营活动的，分别参照本条例关于乡镇人民政府、村民委员会的规定执行。
If subdistrict offices and residents' committees are involved in agricultural production and operation activities, they shall refer to the provisions of these regulations concerning township people's governments and villagers' committees, respectively.
本条例自2026年5月1日起施行。
These regulations shall come into force on May 1, 2026.
