总 则
General Provisions
为了保护植物新品种权，鼓励培育和推广应用植物新品种，促进农业、林草业的发展，根据《中华人民共和国种子法》，制定本条例。
These Regulations are formulated in accordance with the Seed Law of the People's Republic of China to protect the rights to new plant varieties, encourage the breeding andpromote and apply of new plant varieties, and promote the development of agriculture, forestry, and grassland industries.
本条例所称植物新品种，是指经过人工选育或者对发现的野生植物加以改良，具备新颖性、特异性、一致性、稳定性和适当命名的植物品种。
For the purposes of these Regulations, 'new plant variety' means a plant variety that has been artificially bred or improved from discovered wild plants, possessing novelty, distinctness, uniformity, stability, and an appropriate denomination.
植物新品种保护工作应当坚持中国共产党的领导，贯彻党和国家知识产权战略部署，促进育种创新，推动种业高质量发展。
The protection of new plant varieties shall adhere to the leadership of the Communist Party of China, implement the Party's and the State's intellectual property strategic deployment, promote breeding innovation, and drive high-quality development of the seed industry.
国务院农业农村、林业草原主管部门按照职责分工负责全国植物新品种保护工作，开展植物新品种权申请的受理和审查，并对符合本条例规定的植物新品种授予植物新品种权(以下称品种权)；健全植物新品种测试体系，完善繁殖材料保藏管理，加强植物新品种保护宣传培训和相关技术研究。
The competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall, according to their respective functions, be responsible for the protection of new plant varieties nationwide, handle the acceptance and examination of applications for new plant variety rights, and grant new plant variety rights (hereinafter referred to as variety rights) to new plant varieties that meet the requirements of these Regulations; improve the new plant variety testing system, perfect the management of propagation material preservation, and strengthen publicity and training on the protection of new plant varieties and related technical research.
县级以上地方人民政府农业农村、林业草原主管部门依照各自职责，负责本行政区域内的植物新品种保护工作。
The competent departments of agriculture and rural affairs, and forestry and grassland of local people's governments at or above the county level shall, in accordance with their respective duties, be responsible for the protection of new plant varieties within their respective administrative regions.
对在植物新品种培育和推广应用等工作中做出突出贡献的单位和个人，按照国家有关规定给予表彰和奖励。
Units and individuals that have made outstanding contributions in the breeding andpromote and apply of new plant varieties and other related work shall be commended and rewarded in accordance with the relevant provisions of the State.
生产、经营和推广被授予品种权的植物新品种(以下称授权品种)，应当符合有关种子管理的法律法规的规定。
The production, operation, andpromote of new plant varieties that have been granted variety rights (hereinafter referred to as authorized varieties) shall comply with the provisions of laws and regulations on seed management.
品种权的内容和归属
Content and Ownership of Variety Rights
品种权所有人(以下称品种权人)对其授权品种，享有排他的独占权。除法律和本条例另有规定外，任何单位或者个人未经品种权人许可，不得对该授权品种的繁殖材料，实施下列行为：
The owner of variety rights (hereinafter referred to as the variety rights holder) shall have the exclusive right to the authorized variety. Unless otherwise provided by law and these Regulations, no unit or individual may, without the permission of the variety rights holder, perform the following acts with respect to the propagation material of the authorized variety:
(一)生产、繁殖和为繁殖而进行处理；
(1) production, reproduction, and processing for the purpose of reproduction;
(二)许诺销售、销售；
(2) offering for sale and selling;
(三)进口、出口；
(3) importing and exporting;
(四)为实施本款第一项至第三项行为进行储存。
(4) storing for the purpose of performing the acts specified in items (1) to (3) of this paragraph.
实施前款规定的行为，涉及由未经许可使用授权品种的繁殖材料而获得的收获材料的，应当得到品种权人的许可；但是，品种权人对繁殖材料已有合理机会行使其权利的除外。
Where the acts specified in the preceding paragraph involve harvested material obtained through the unauthorized use of propagation material of the authorized variety, permission from the variety rights holder shall be obtained; however, this does not apply if the variety rights holder has had a reasonable opportunity to exercise its rights over the propagation material.
对下列品种实施第一款、第二款规定的行为，应当得到授权品种的品种权人的许可：
The performance of the acts specified in paragraphs 1 and 2 with respect to the following varieties shall require the permission of the variety rights holder of the authorized variety:
(一)授权品种的实质性派生品种，但该授权品种本身不是实质性派生品种；
(1) essentially derived varieties of the authorized variety, provided that the authorized variety itself is not an essentially derived variety;
(二)与授权品种相比，不具备本条例第十六条规定的明显区别的品种；
(2) varieties that do not possess the distinctness specified in Article 16 of these Regulations compared to the authorized variety;
(三)为商业目的重复使用授权品种进行生产或者繁殖的另一品种。
(3) other varieties produced or reproduced through the repeated use of the authorized variety for commercial purposes.
国家分步实施实质性派生品种制度，国务院农业农村、林业草原主管部门以目录形式确定具体实施范围，报国务院批准后公布施行。
The State shall implement the essentially derived variety system in phases. The competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall determine the specific scope of implementation in the form of a catalogue, which shall be implemented after being reported to the State Council for approval and publication.
实质性派生品种主要依据分子检测、表型测试结果判定，必要时综合考虑育种方法、选育过程、亲缘关系等因素。国务院农业农村、林业草原主管部门应当制定实质性派生品种判定指南，确定适用范围、检测和测试方法、判定阈值、技术流程等，并明确检测、测试机构应当具备的条件。
The determination of essentially derived varieties shall be based primarily on molecular detection and phenotypic test results, and where necessary, factors such as breeding method, breeding process, and genetic relationship shall be considered comprehensively. The competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall formulate guidelines for determining essentially derived varieties, specifying the scope of application, detection and testing methods, determination thresholds, technical procedures, etc., and clarify the conditions that detection and testing institutions shall meet.
国务院农业农村、林业草原主管部门组建由育种、检测、测试、管理及法律等方面专家组成的专家库，为实施实质性派生品种制度提供专业支持。
The competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall establish an expert database composed of experts in breeding, detection, testing, management, and law, to provide professional support for the implementation of the essentially derived variety system.
执行本单位的任务或者主要是利用本单位的物质技术条件所完成的职务育种，品种权的申请权属于该单位；非职务育种，品种权的申请权属于完成育种的个人。利用本单位的物质技术条件所完成的育种，单位与完成育种的个人对品种权的申请权有合同约定的，从其约定。
For a service breeding accomplished in the execution of the tasks of the unit or mainly by using the material and technical conditions of the unit, the right to apply for variety rights shall belong to the unit; for a non-service breeding, the right to apply for variety rights shall belong to the individual who accomplished the breeding. Where a breeding is accomplished by using the material and technical conditions of the unit, and there is a contractual agreement between the unit and the individual who accomplished the breeding regarding the right to apply for variety rights, such agreement shall prevail.
委托育种或者合作育种，当事人可以在合同中约定品种权的申请权归属；没有合同约定的，品种权的申请权属于受委托完成或者共同完成育种的单位或者个人。
For commissioned breeding or cooperative breeding, the parties may agree in the contract on the ownership of the right to apply for variety rights; in the absence of such an agreement, the right to apply for variety rights shall belong to the unit or individual that was commissioned to accomplish or jointly accomplished the breeding.
申请被批准后，品种权属于申请人。
Upon approval of the application, the variety rights shall belong to the applicant.
一个植物新品种只能授予一项品种权。两个以上的申请人分别就同一个植物新品种申请品种权的，品种权授予最先申请的人；同时申请的，品种权授予最先完成该植物新品种育种的人。
Only one variety right may be granted for one new plant variety. Where two or more applicants separately apply for variety rights for the same new plant variety, the variety right shall be granted to the person who filed the application first; if the applications are filed on the same day, the variety right shall be granted to the person who first accomplished the breeding of the new plant variety.
品种权的申请权和品种权可以依法转让。
The right to apply for variety rights and the variety rights themselves may be transferred in accordance with the law.
中国的单位或者个人就其在境内培育的植物新品种向外国人、外国企业或者外国其他组织转让申请权或者品种权的，应当经国务院农业农村、林业草原主管部门批准。
Where a Chinese unit or individual transfers the right to apply for variety rights or the variety rights to a foreigner, foreign enterprise, or other foreign organization for a new plant variety bred within China, approval from the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall be obtained.
转让申请权或者品种权的，当事人应当订立书面合同，并向国务院农业农村、林业草原主管部门登记，由国务院农业农村、林业草原主管部门予以公告。转让自登记之日起生效。
For the transfer of the right to apply for variety rights or the variety rights, the parties shall conclude a written contract and register it with the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council, which shall make an announcement. The transfer shall take effect from the date of registration.
以品种权出质的，由出质人和质权人共同向国务院农业农村、林业草原主管部门办理出质登记，由国务院农业农村、林业草原主管部门予以公告。
Where variety rights are pledged, the pledgor and the pledgee shall jointly apply to the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council for pledge registration, which shall make an announcement.
在下列情况下使用授权品种的，可以不经品种权人许可，不向其支付使用费，但是不得侵犯品种权人依照本条例和有关法律、行政法规享有的其他权利：
In the following circumstances, the use of an authorized variety may be carried out without the permission of the variety rights holder and without payment of royalties, provided that the other rights enjoyed by the variety rights holder under these Regulations and relevant laws and administrative regulations are not infringed:
(一)利用授权品种进行育种及其他科研活动；
(1) using the authorized variety for breeding and other scientific research activities;
(二)农民自繁自用授权品种的繁殖材料。
(2) farmers propagating and using the propagation material of the authorized variety for their own use.
为了国家利益或者社会公共利益，国务院农业农村、林业草原主管部门可以作出实施品种权强制许可的决定，并予以登记和公告。
For the sake of national interest or public interest, the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council may make a decision on compulsory licensing of variety rights, and shall register and announce it.
取得实施强制许可的单位或者个人应当付给品种权人合理的使用费，其数额由双方商定；双方不能达成协议的，由国务院农业农村、林业草原主管部门裁决。
The unit or individual that obtains a compulsory license shall pay a reasonable royalty to the variety rights holder, the amount of which shall be negotiated by both parties; if the parties cannot reach an agreement, the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall make a ruling.
品种权人对强制许可决定不服的，品种权人和取得实施强制许可的单位或者个人对强制许可使用费的裁决不服的，可以依法提起诉讼。
If the variety rights holder is dissatisfied with the compulsory licensing decision, or if the variety rights holder or the unit or individual that obtained the compulsory license is dissatisfied with the ruling on the compulsory license royalty, they may file a lawsuit in accordance with the law.
取得实施强制许可的单位或者个人不享有独占的实施权，并且无权允许他人实施。
The unit or individual that obtains a compulsory license shall not have the exclusive right to exploit the variety and shall not have the right to authorize others to exploit it.
授予品种权的条件
Conditions for Granting Variety Rights
申请品种权的植物新品种应当属于国家植物品种保护名录中列举的植物的属或者种。植物品种保护名录由国务院农业农村、林业草原主管部门确定和公布。
A new plant variety for which variety rights are applied for shall belong to a plant genus or species listed in the national catalogue of protected plant varieties. The catalogue of protected plant varieties shall be determined and published by the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council.
对违反法律，危害社会公共利益、生态环境的植物新品种，不授予品种权。
No variety rights shall be granted for new plant varieties that violate the law or harm public interests or the ecological environment.
授予品种权的植物新品种应当具备新颖性。新颖性，是指申请品种权的植物新品种在申请日前该品种繁殖材料、收获材料未被销售、推广，或者经申请权人自行或者同意销售、推广该品种繁殖材料、收获材料，在中国境内未超过1年；在境外，木本、藤本植物品种未超过6年，其他植物品种未超过4年。
A new plant variety for which variety rights are applied for shall possess novelty. Novelty means that, prior to the date of application, the propagation material or harvested material of the variety has not been sold or promoted, or if sold or promoted by or with the consent of the applicant, the sale or promotion has not exceeded one year within China; for woody and vine plants, it has not exceeded six years abroad, and for other plants, it has not exceeded four years abroad.
2016年1月1日《中华人民共和国种子法》施行后新列入植物品种保护名录的植物的属或者种，从名录公布之日起1年内提出品种权申请的，申请日前在中国境内销售、推广该品种繁殖材料、收获材料未超过4年的，具备新颖性。
For plant genera or species newly added to the catalogue of protected plant varieties after the implementation of the Seed Law of the People's Republic of China on January 1, 2016, if an application for variety rights is filed within one year from the date of publication of the catalogue, and the sale or promotion of the propagation material or harvested material of the variety within China before the application date has not exceeded four years, novelty shall be deemed to exist.
除销售、推广行为丧失新颖性外，下列情形视为已丧失新颖性：
In addition to loss of novelty due to sale or promotion, the following circumstances shall be deemed as loss of novelty:
(一)品种经省、自治区、直辖市人民政府农业农村、林业草原主管部门依据播种面积确认已经形成事实扩散的；
(1) the variety has been confirmed by the competent departments of agriculture and rural affairs, and forestry and grassland of the provincial-level people's government to have actually spread based on the sown area;
(二)农作物品种已审定或者登记2年以上未申请植物新品种权的。
(2) a crop variety has been approved or registered for two years or more without applying for variety rights.
授予品种权的植物新品种应当具备特异性。特异性，是指一个植物品种有一个以上性状明显区别于已知品种。
A new plant variety for which variety rights are applied for shall possess distinctness. Distinctness means that the plant variety has one or more traits that are clearly distinguishable from any known variety.
授予品种权的植物新品种应当具备一致性。一致性，是指一个植物品种的特性，除可预期的自然变异外，群体内个体间相关的特征或者特性表现一致。
A new plant variety for which variety rights are applied for shall possess uniformity. Uniformity means that, subject to the variation that may be expected from the particular features of its propagation, the relevant characteristics or traits of the variety are consistent among individuals within the population.
授予品种权的植物新品种应当具备稳定性。稳定性，是指一个植物品种经过反复繁殖后或者在特定繁殖周期结束时，其主要性状保持不变。
A new plant variety for which variety rights are applied for shall possess stability. Stability means that the relevant characteristics or traits of the plant variety remain unchanged after repeated propagation or, where applicable, at the end of each particular cycle of propagation.
授予品种权的植物新品种应当具备适当的名称，并与相同或者相近的植物属或者种中已知品种的名称相区别。该名称经授权后即为该植物新品种的通用名称。不论授权品种的保护期是否届满，销售、推广该授权品种应当使用其授权的名称。
A new plant variety for which variety rights are applied for shall be given a suitable denomination, which shall be distinguishable from the denominations of any known variety of the same or closely related plant genus or species. Once authorized, the denomination shall become the common name of the new plant variety. Regardless of whether the protection period of the authorized variety has expired, the authorized denomination shall be used when selling or promoting the authorized variety.
下列名称不得用于品种命名：
The following denominations shall not be used for variety naming:
(一)仅以数字表示的；
(1) consisting solely of numerals;
(二)违反社会公德的；
(2) contrary to social morality;
(三)对植物新品种的特征、特性或者育种者身份等容易引起误解的；
(3) liable to mislead as to the characteristics, traits, or identity of the breeder of the new plant variety;
(四)损害他人在先权利的；
(4) infringing upon prior rights of others;
(五)法律、行政法规以及国家规定禁止的其他情形。
(5) other circumstances prohibited by laws, administrative regulations, and state provisions.
同一植物品种在申请新品种保护和品种审定、品种登记、销售、推广时只能使用同一个名称。
The same plant variety shall use only one denomination when applying for variety protection, variety approval, variety registration, sale, and promotion.
品种权的申请和受理
Application and Acceptance of Variety Rights
中国的单位或者个人申请品种权的，可以直接或者委托代理机构向国务院农业农村、林业草原主管部门提出申请。
A Chinese unit or individual applying for variety rights may file an application directly or through an agency with the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council.
中国的单位或者个人申请品种权的植物新品种涉及国家安全或者重大利益需要保密的，应当按照国家有关规定办理。
If a new plant variety for which a Chinese unit or individual applies for variety rights involves national security or major interests and needs to be kept confidential, the matter shall be handled in accordance with the relevant provisions of the State.
外国人、外国企业或者外国其他组织在中国申请品种权的，应当按其所属国和中华人民共和国签订的协议或者共同参加的国际条约办理，或者根据互惠原则，依照本条例办理。
Foreigners, foreign enterprises, or other foreign organizations applying for variety rights in China shall be handled in accordance with the agreements signed between their country and the People's Republic of China or international treaties to which both are parties, or on the basis of the principle of reciprocity, in accordance with these Regulations.
在中国没有经常居所或者营业场所的外国人、外国企业或者外国其他组织，向国务院农业农村、林业草原主管部门提出品种权申请的，应当委托在中国依法设立的代理机构办理。
Foreigners, foreign enterprises, or other foreign organizations that do not have a habitual residence or business establishment in China shall, when filing an application for variety rights with the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council, entrust an agency legally established in China to handle the matter.
申请品种权的，应当向国务院农业农村、林业草原主管部门提交符合规定格式要求的申请文件。
An application for variety rights shall be submitted to the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council with application documents that meet the prescribed format requirements.
申请文件应当使用中文书写。
The application documents shall be written in Chinese.
国务院农业农村、林业草原主管部门收到品种权申请文件之日为申请日；申请文件是邮寄的，以寄出的邮戳日为申请日。
The date on which the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council receive the application documents for variety rights shall be the date of application; if the application documents are sent by mail, the postmark date of mailing shall be the date of application.
申请人自在外国第一次提出品种权申请之日起12个月内，又在中国就该植物新品种提出品种权申请的，依照该外国同中华人民共和国签订的协议或者共同参加的国际条约，或者根据相互承认优先权的原则，可以享有优先权。
An applicant who, within 12 months from the date of first filing an application for variety rights in a foreign country, files an application for variety rights for the same new plant variety in China may enjoy a right of priority in accordance with the agreement signed between that foreign country and the People's Republic of China or an international treaty to which both are parties, or on the basis of the principle of mutual recognition of priority rights.
申请人要求优先权的，应当在申请时提出书面说明，并在3个月内提交经原受理机关确认的第一次提出的品种权申请文件的副本；未依照本条例规定提出书面说明或者提交申请文件副本的，视为未要求优先权。
An applicant claiming priority shall, at the time of application, make a written declaration and, within three months, submit a copy of the first application documents for variety rights confirmed by the original accepting authority; failure to make the written declaration or submit the copy of the application documents in accordance with these Regulations shall be deemed as not having claimed priority.
对符合本条例第二十二条规定的品种权申请，国务院农业农村、林业草原主管部门应当予以受理，明确申请日、给予申请号，并自收到申请之日起1个月内通知申请人缴纳申请费。
For an application for variety rights that meets the requirements of Article 22 of these Regulations, the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall accept it, determine the date of application, assign an application number, and notify the applicant to pay the application fee within one month from the date of receipt.
对不符合或者经修改仍不符合本条例第二十二条规定的品种权申请，国务院农业农村、林业草原主管部门不予受理，并通知申请人。
For an application for variety rights that does not meet the requirements of Article 22 of these Regulations or still does not meet them after amendment, the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall not accept it and shall notify the applicant.
申请人可以在品种权授予前修改或者撤回品种权申请。
An applicant may amend or withdraw the application for variety rights before the grant of variety rights.
任何单位或者个人将在中国境内培育的植物新品种向境外申请品种权的，应当向国务院农业农村、林业草原主管部门登记；向境外提供繁殖材料的，应当遵守《中华人民共和国种子法》关于向境外提供种质资源的规定。
Any unit or individual that applies for variety rights abroad for a new plant variety bred within China shall register with the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council; if providing propagation material abroad, the provisions of the Seed Law of the People's Republic of China on providing germplasm resources abroad shall be complied with.
品种权的审查与批准
Examination and Approval of Variety Rights
申请人缴纳申请费后，国务院农业农村、林业草原主管部门对品种权申请的下列内容进行初步审查：
After the applicant pays the application fee, the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall conduct a preliminary examination of the following contents of the variety rights application:
(一)是否属于植物品种保护名录列举的植物属或者种的范围；
(1) whether it falls within the scope of plant genera or species listed in the catalogue of protected plant varieties;
(二)是否符合本条例第二十一条的规定；
(2) whether it complies with the provisions of Article 21 of these Regulations;
(三)是否符合新颖性的规定；
(3) whether it complies with the provisions on novelty;
(四)植物新品种的命名是否适当。
(4) whether the denomination of the new plant variety is appropriate.
国务院农业农村、林业草原主管部门应当自受理品种权申请之日起3个月内完成初步审查；情况复杂的，可以延长3个月。对经初步审查合格的品种权申请，国务院农业农村、林业草原主管部门予以公告，并通知申请人在3个月内缴纳审查费。
The competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall complete the preliminary examination within three months from the date of acceptance of the variety rights application; if the circumstances are complex, the period may be extended by three months. For a variety rights application that passes the preliminary examination, the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall make an announcement and notify the applicant to pay the examination fee within three months.
对经初步审查不合格的品种权申请，国务院农业农村、林业草原主管部门应当通知申请人在3个月内陈述意见或者予以修正。逾期未答复的，品种权申请视为撤回；修正后仍然不合格的，驳回申请。
For a variety rights application that fails the preliminary examination, the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall notify the applicant to present arguments or make corrections within three months. If no response is made within the time limit, the variety rights application shall be deemed to have been withdrawn; if the application still fails after correction, it shall be rejected.
申请人按照规定缴纳审查费后，国务院农业农村、林业草原主管部门对品种权申请的特异性、一致性和稳定性进行实质审查。
After the applicant pays the examination fee as prescribed, the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall conduct a substantive examination of the distinctness, uniformity, and stability of the variety rights application.
申请人未按照规定缴纳审查费的，品种权申请视为撤回。
If the applicant fails to pay the examination fee as prescribed, the variety rights application shall be deemed to have been withdrawn.
国务院农业农村、林业草原主管部门主要依据申请文件和其他有关书面材料进行实质审查。国务院农业农村、林业草原主管部门认为必要时，可以委托指定的测试机构进行测试或者考察业已完成的种植或者其他试验的结果。
The competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall conduct the substantive examination primarily based on the application documents and other relevant written materials. When the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council deem it necessary, they may entrust a designated testing institution to conduct tests or examine the results of completed planting or other experiments.
因审查需要，申请人应当根据国务院农业农村、林业草原主管部门的要求提供必要的资料和该植物新品种的繁殖材料。
For the needs of examination, the applicant shall, as required by the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council, provide necessary materials and propagation material of the new plant variety.
对经实质审查符合本条例规定的品种权申请，国务院农业农村、林业草原主管部门应当作出授予品种权的决定，颁发品种权证书，并予以登记和公告，品种权自授权公告之日起生效。
For a variety rights application that meets the requirements of these Regulations after substantive examination, the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall make a decision to grant variety rights, issue a variety rights certificate, and register and announce it. The variety rights shall take effect from the date of the announcement of the grant.
对经实质审查不符合本条例规定的品种权申请，国务院农业农村、林业草原主管部门予以驳回，并通知申请人。
For a variety rights application that does not meet the requirements of these Regulations after substantive examination, the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall reject it and notify the applicant.
国务院农业农村、林业草原主管部门设立植物新品种复审委员会(以下称复审委员会)。
The competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall establish a Plant Variety Rights Reexamination Board (hereinafter referred to as the Reexamination Board).
对驳回品种权申请的决定不服的，申请人可以自收到通知之日起3个月内，向复审委员会请求复审。复审请求符合规定的，复审委员会应当自收到之日起6个月内作出决定，并通知申请人。依法需要检测、测试鉴定的，所需时间不计算在规定期限内。
If an applicant is dissatisfied with the decision to reject the variety rights application, it may, within three months from the date of receipt of the notice, request a reexamination by the Reexamination Board. If the reexamination request meets the requirements, the Reexamination Board shall make a decision within six months from the date of receipt and notify the applicant. If testing or test identification is required by law, the time needed shall not be counted within the prescribed period.
申请人对复审委员会的复审决定不服的，可以依法提起诉讼。
If the applicant is dissatisfied with the reexamination decision of the Reexamination Board, it may file a lawsuit in accordance with the law.
复审的具体规定由国务院农业农村、林业草原主管部门制定。
The specific provisions on reexamination shall be formulated by the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council.
品种权被授予后，在自初步审查合格公告之日起至被授予品种权之日止的期间，任何单位或者个人违反本条例第七条规定的，品种权人享有追偿的权利。
After the variety rights are granted, during the period from the date of announcement of passing the preliminary examination to the date of grant of variety rights, if any unit or individual violates the provisions of Article 7 of these Regulations, the variety rights holder shall have the right to claim compensation.
品种权的期限、终止和无效
Term, Termination, and Invalidation of Variety Rights
品种权的保护期限，自授权公告之日起，木本、藤本植物为25年，其他植物为20年。
The term of protection of variety rights shall be 25 years for woody and vine plants, and 20 years for other plants, calculated from the date of announcement of the grant.
品种权人应当自被授予品种权的当年开始缴纳年费，并且按照国务院农业农村、林业草原主管部门的要求提供用于检测、测试的该授权品种的繁殖材料。
The variety rights holder shall pay an annual fee from the year the variety rights are granted, and shall provide propagation material of the authorized variety for testing and examination as required by the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council.
有下列情形之一的，品种权在其保护期限届满前终止：
Variety rights shall terminate before the expiration of the term of protection in any of the following circumstances:
(一)品种权人以书面声明放弃品种权的；
(1) the variety rights holder makes a written declaration renouncing the variety rights;
(二)品种权人未按照规定缴纳年费的；
(2) the variety rights holder fails to pay the annual fee as prescribed;
(三)品种权人未按照国务院农业农村、林业草原主管部门的要求提供检测、测试所需的该授权品种的繁殖材料的；
(3) the variety rights holder fails to provide the propagation material of the authorized variety required for testing and examination as required by the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council;
(四)经检测、测试该授权品种不再符合被授予品种权时的特征和特性的。
(4) the authorized variety no longer conforms to the characteristics and traits it had at the time of grant, as determined by testing and examination.
品种权的终止，由国务院农业农村、林业草原主管部门登记和公告。
The termination of variety rights shall be registered and announced by the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council.
自公告授予品种权之日起，复审委员会可以依据职权或者依据任何单位或者个人的书面请求，对不符合本条例第十五条至第十八条规定的，宣告品种权无效；对不符合本条例第十九条规定的，责令更名，拒不更名的，宣告品种权无效。宣告品种权无效或者更名的决定，由国务院农业农村、林业草原主管部门登记和公告，并由复审委员会通知当事人。
From the date of announcement of the grant of variety rights, the Reexamination Board may, ex officio or upon a written request by any unit or individual, declare the variety rights invalid if they do not meet the provisions of Articles 15 to 18 of these Regulations; if they do not meet the provisions of Article 19, order a change of denomination, and if the change is refused, declare the variety rights invalid. The decision to declare variety rights invalid or change the denomination shall be registered and announced by the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council, and the Reexamination Board shall notify the parties concerned.
当事人对复审委员会的无效宣告决定不服的，可以依法提起诉讼。
If a party is dissatisfied with the invalidation decision of the Reexamination Board, it may file a lawsuit in accordance with the law.
被宣告无效的品种权视为自始不存在。
Variety rights declared invalid shall be deemed never to have existed.
宣告品种权无效的决定，对在宣告前人民法院作出并已执行的植物新品种侵权的判决、调解书，县级以上人民政府农业农村、林业草原主管部门作出并已执行的植物新品种侵权处理决定，以及已经履行的品种权实施许可合同和品种权转让合同，不具有追溯力。但是，因品种权人的恶意给他人造成损失的，应当给予合理赔偿。
The decision to declare variety rights invalid shall have no retroactive effect on judgments or mediation statements on new plant variety infringement that have been made and executed by the people's court before the declaration, on decisions on new plant variety infringement that have been made and executed by the competent departments of agriculture and rural affairs, and forestry and grassland of the people's government at or above the county level, or on variety rights licensing contracts and variety rights transfer contracts that have been performed. However, if losses are caused to others due to the malice of the variety rights holder, reasonable compensation shall be made.
依照前款规定不返还植物新品种侵权赔偿金、品种权使用费、品种权转让费，明显违反公平原则的，应当全部或者部分返还。
If the non-return of new plant variety infringement compensation, variety rights royalties, or variety rights transfer fees in accordance with the preceding paragraph is clearly contrary to the principle of fairness, all or part of them shall be returned.
当事人因不可抗力而延误本条例规定的期限或者国务院农业农村、林业草原主管部门指定的期限，导致其权利丧失的，自障碍消除之日起2个月内且自期限届满之日起2年内，可以向国务院农业农村、林业草原主管部门说明理由，并附具有关证明文件，请求恢复其权利。
If a party, due to force majeure, misses the time limit prescribed in these Regulations or specified by the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council, resulting in the loss of its rights, it may, within two months from the date the obstacle is removed and within two years from the date the time limit expires, explain the reasons to the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council and attach relevant supporting documents to request restoration of its rights.
当事人因其他正当理由而延误本条例规定的期限或者国务院农业农村、林业草原主管部门指定的期限，导致其权利丧失的，可以自收到国务院农业农村、林业草原主管部门通知之日起2个月内向国务院农业农村、林业草原主管部门说明理由，请求恢复其权利；但是，延误复审请求期限的，可以自复审请求期限届满之日起2个月内向国务院农业农村、林业草原主管部门请求恢复其权利。
If a party, due to other legitimate reasons, misses the time limit prescribed in these Regulations or specified by the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council, resulting in the loss of its rights, it may, within two months from the date of receipt of the notice from the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council, explain the reasons to the said departments and request restoration of its rights; however, if the time limit for requesting reexamination is missed, it may, within two months from the date the reexamination request time limit expires, request restoration of its rights from the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council.
当事人请求延长国务院农业农村、林业草原主管部门指定期限的，应当在期限届满前，向国务院农业农村、林业草原主管部门说明理由并办理有关手续。
If a party requests an extension of the time limit specified by the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council, it shall, before the time limit expires, explain the reasons to the said departments and go through the relevant procedures.
本条第一款和第二款的规定不适用本条例第十五条、第二十四条、第三十五条规定的期限。
The provisions of paragraphs 1 and 2 of this Article shall not apply to the time limits specified in Articles 15, 24, and 35 of these Regulations.
法 律 责 任
Legal Liability
违反本条例第七条规定，有侵犯品种权行为的，由当事人协商解决。不愿协商或者协商不成的，品种权人或者利害关系人可以请求县级以上人民政府农业农村、林业草原主管部门依据各自的职权进行处理，也可以依法提起诉讼。
Where there is an act infringing variety rights in violation of Article 7 of these Regulations, the parties shall resolve the matter through negotiation. If negotiation is not desired or fails, the variety rights holder or an interested party may request the competent departments of agriculture and rural affairs, and forestry and grassland of the people's government at or above the county level to handle the matter according to their respective functions, or may file a lawsuit in accordance with the law.
县级以上人民政府农业农村、林业草原主管部门依据各自的职权，根据当事人自愿的原则，对侵犯品种权所造成的损害赔偿可以进行调解。调解达成协议的，当事人应当履行；当事人不履行协议或者调解未达成协议的，品种权人或者利害关系人可以依法提起诉讼。
The competent departments of agriculture and rural affairs, and forestry and grassland of the people's government at or above the county level may, according to their respective functions and on the principle of voluntariness of the parties, mediate the damages caused by infringement of variety rights. If a mediation agreement is reached, the parties shall perform it; if a party fails to perform the agreement or mediation fails, the variety rights holder or an interested party may file a lawsuit in accordance with the law.
县级以上人民政府农业农村、林业草原主管部门处理侵犯品种权案件时，为了维护社会公共利益，责令侵权人停止侵权行为，没收违法所得和植物品种繁殖材料；货值金额不足5万元的，并处1万元以上25万元以下罚款；货值金额5万元以上的，并处货值金额5倍以上10倍以下罚款。
When handling cases of infringement of variety rights, the competent departments of agriculture and rural affairs, and forestry and grassland of the people's government at or above the county level shall, in order to safeguard the public interest, order the infringer to cease the infringing act, confiscate the illegal gains and plant variety propagation material; if the value of the goods is less than 50,000 yuan, a fine of not less than 10,000 yuan but not more than 250,000 yuan shall be imposed; if the value of the goods is 50,000 yuan or more, a fine of not less than five times but not more than ten times the value of the goods shall be imposed.
假冒授权品种的，由县级以上人民政府农业农村、林业草原主管部门责令停止假冒行为，没收违法所得和植物品种繁殖材料；货值金额不足5万元的，并处1万元以上25万元以下罚款；货值金额5万元以上的，并处货值金额5倍以上10倍以下罚款；构成犯罪的，依法追究刑事责任。
Whoever counterfeits an authorized variety shall be ordered by the competent departments of agriculture and rural affairs, and forestry and grassland of the people's government at or above the county level to cease the counterfeiting act, and the illegal gains and plant variety propagation material shall be confiscated; if the value of the goods is less than 50,000 yuan, a fine of not less than 10,000 yuan but not more than 250,000 yuan shall be imposed; if the value of the goods is 50,000 yuan or more, a fine of not less than five times but not more than ten times the value of the goods shall be imposed; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
县级以上人民政府农业农村、林业草原主管部门在查处侵犯品种权案件和假冒授权品种案件时，有权依法采取下列措施：
When investigating and handling cases of infringement of variety rights and counterfeiting of authorized varieties, the competent departments of agriculture and rural affairs, and forestry and grassland of the people's government at or above the county level shall have the authority to take the following measures in accordance with the law:
(一)进入生产经营场所进行现场检查；
(1) entering the production and business premises for on-site inspection;
(二)对植物品种的繁殖材料、收获材料进行取样测试、试验或者检验；
(2) sampling, testing, experimenting, or inspecting the propagation material or harvested material of plant varieties;
(三)查阅、复制与涉嫌违法行为有关的合同、票据、账簿、生产经营档案及其他有关资料；
(3) consulting and copying contracts, invoices, account books, production and business archives, and other relevant materials related to the suspected illegal act;
(四)查封、扣押有证据证明是侵犯品种权或者假冒授权品种的植物品种繁殖材料，以及用于侵犯品种权或者假冒授权品种的工具、设备及运输工具等；
(4) sealing up or seizing plant variety propagation material that is proven to be infringing variety rights or counterfeiting authorized varieties, as well as tools, equipment, and means of transport used for infringing variety rights or counterfeiting authorized varieties;
(五)查封从事侵犯品种权或者假冒授权品种活动的场所。
(5) sealing up the premises where activities of infringing variety rights or counterfeiting authorized varieties are carried out.
县级以上人民政府农业农村、林业草原主管部门依法行使前款规定的职权时，当事人应当协助、配合，不得拒绝、阻挠。
When the competent departments of agriculture and rural affairs, and forestry and grassland of the people's government at or above the county level exercise the powers specified in the preceding paragraph in accordance with the law, the parties shall assist and cooperate and shall not refuse or obstruct.
当事人就品种权的申请权和品种权的权属发生争议的，可以依法提起诉讼。
If a dispute arises between parties over the right to apply for variety rights or the ownership of variety rights, a lawsuit may be filed in accordance with the law.
对不知道是侵犯品种权的繁殖材料、收获材料实施下列行为，能够证明有合法来源的，不承担赔偿责任：
A person who, without knowledge, performs the following acts with respect to propagation material or harvested material that infringes variety rights, and can prove a legitimate source, shall not bear liability for damages:
(一)为他人繁殖而进行处理；
(1) processing for the purpose of reproduction for others;
(二)许诺销售、销售；
(2) offering for sale and selling;
(三)为实施前两项行为进行储存。
(3) storing for the purpose of performing the acts specified in the preceding two items.
县级以上人民政府农业农村、林业草原主管部门及有关部门工作人员滥用职权、玩忽职守、徇私舞弊或者索取、收受贿赂的，依法给予处分；构成犯罪的，依法追究刑事责任。
If staff members of the competent departments of agriculture and rural affairs, and forestry and grassland of the people's government at or above the county level and relevant departments abuse their power, neglect their duty, engage in malpractice for personal gain, or extort or accept bribes, they shall be given sanctions in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
在品种权申请过程中存在欺骗、隐瞒、伪造等不诚信行为的，由国务院农业农村、林业草原主管部门按照国家有关规定记入相关主体信用记录，并向社会公布。
If there are dishonest acts such as deception, concealment, or falsification in the process of applying for variety rights, the competent departments of agriculture and rural affairs, and forestry and grassland under the State Council shall record such acts in the credit records of the relevant entities in accordance with the relevant provisions of the State and make them public.
附 则
Supplementary Provisions
本条例下列用语的含义是：
For the purposes of these Regulations, the following terms have the meanings assigned to them:
(一)繁殖材料是指可用于繁殖的植物整株或者部分，包括籽粒、果实、根、茎、苗、芽、叶、花等；
(1) 'Propagation material' means the whole plant or parts thereof that can be used for propagation, including seeds, fruits, roots, stems, seedlings, buds, leaves, flowers, etc.;
(二)收获材料是指经过种植后获得的植物整株或者部分。
(2) 'Harvested material' means the whole plant or parts thereof obtained after cultivation.
本条例自2025年6月1日起施行。
These Regulations shall come into force on June 1, 2025.
