Measures of the People's Republic of China for the Administration of Salvage of Sunken Vessels

This regulation governs the salvage and management of sunken vessels in China's territorial waters and inland rivers to ensure navigation safety.

严重危害船舶安全航行的沉船,有关港(航)务主管机关有权立即进行打捞或者解体清除,但是所采取措施应即通知沉船所有人,如果沉船所有人不明或者无法通知时,应当在当地和中央报纸上公告。

TranslationArticle 4

For sunken vessels that seriously endanger the safe navigation of vessels, the relevant port (navigation) authority has the right to immediately salvage or dismantle and remove them, but the measures taken shall be promptly notified to the owner of the sunken vessel. If the owner is unknown or cannot be notified, a public announcement shall be made in local and central newspapers.

妨碍船舶航行、航道整治或者工程建筑的沉船,有关港(航)务主管机关应当根据具体情况规定申请期限和打捞期限,通知或公告沉船所有人。

For sunken vessels that obstruct navigation, waterway regulation, or engineering construction, the relevant port (navigation) authority shall, based on the specific circumstances, set a deadline for application and a deadline for salvage, and notify or announce to the owner of the sunken vessel.

有关港(航)务主管机关根据第四条规定所捞起的船体、船用器物、货物或者解体所得的钢材、机件等,在无法或者不易保管的情况下,可以作价处理。

For hulls, ship equipment, cargo, or steel materials and machinery obtained from dismantling that are salvaged by the relevant port (navigation) authority under Article 4, if they cannot be easily stored or are difficult to keep, they may be sold at a price.

沉船所有人自船舶沉没之日起一年以内,可以申请发还捞起的原物或者处理原物所得的价款,过期如不申请即丧失其所有权。

The owner of the sunken vessel may, within one year from the date of sinking, apply for the return of the salvaged original items or the proceeds from their sale. If no application is made within that period, ownership shall be lost.

(一)500总吨以上或者300匹指示马力以上的沉船由交通部批准;

未经过批准,任何人都不得擅自打捞或拆除沉船。偶然捞获的沉没物资应当送当地港(航)务主管机关处理,由各该机关酌情给予奖励。

Without approval, no one may salvage or dismantle sunken vessels. Any sunken materials accidentally salvaged shall be delivered to the local port (navigation) authority for disposal, and the authority may give appropriate rewards.

有修复价值而不严重妨碍航行安全的沉船,不得解体。申请解体沉船必须提出该沉船确无修复价值的可靠勘测资料。解体打捞或者清除机动船舶,不得在水下破坏主副机、锅炉等物,应当尽量完整捞起,并经有关港(航)务主管机关鉴定后,才可以处理。

Sunken vessels with repair value that do not seriously obstruct navigation safety shall not be dismantled. An application for dismantling a sunken vessel must provide reliable survey data proving that the vessel has no repair value. When dismantling salvaging or removing a motor vessel, the main and auxiliary engines, boilers, and other items shall not be destroyed underwater; they shall be salvaged as intact as possible, and may only be disposed of after appraisal by the relevant port (navigation) authority.

全国各地沉船勘测工作,由交通部打捞专业机构负责进行,但是有关港(航)务主管机关因业务上的需要,也可以自行勘测。其他机关、企业、个人必须经有关港(航)务主管机关批准才可以进行沉船勘测工作,并应将勘测结果抄送原批准机关。

The survey of sunken vessels nationwide shall be carried out by the professional salvage organization of the Ministry of Communications. However, the relevant port (navigation) authority may also conduct surveys for operational needs. Other organizations, enterprises, or individuals must obtain approval from the relevant port (navigation) authority before conducting surveys of sunken vessels, and shall submit a copy of the survey results to the approving authority.
