为了推动农村公路高质量发展，适应推进乡村全面振兴、加快农业农村现代化需要，制定本条例。
These Regulations are formulated to promote the high-quality development of rural highways and to meet the needs of advancing comprehensive rural revitalization and accelerating agricultural and rural modernization.
本条例所称农村公路，包括县道、乡道和村道。
For the purposes of these Regulations, rural highways include county roads, township roads, and village roads.
农村公路是服务农业、农村、农民的公益性基础设施。国家综合采取多方面措施，支持和促进农村公路发展。
Rural highways are public welfare infrastructure serving agriculture, rural areas, and farmers. The State shall comprehensively adopt various measures to support and promote the development of rural highways.
农村公路发展应当贯彻党和国家路线方针政策、决策部署，与统筹新型城镇化和乡村全面振兴的有关要求相适应，坚持政府主导、统筹规划、因地制宜，坚持建设、管理、养护、运营并重，逐步完善全域覆盖、普惠共享、安全适用、便捷高效的农村交通基础设施网络。
The development of rural highways shall implement the Party and State's lines, policies, and decisions, adapt to the requirements of coordinating new urbanization and comprehensive rural revitalization, adhere to government leadership, overall planning, and adaptation to local conditions, and equally emphasize construction, management, maintenance, and operation, gradually improving a rural transportation infrastructure network that is full coverage, universally beneficial, safe, applicable, convenient, and efficient.
县级人民政府对本行政区域内农村公路发展承担主体责任，加强对农村公路工作的组织领导，落实农村公路发展支持措施，统筹研究和协调解决农村公路工作中的重大问题。
The people's government at the county level bears the primary responsibility for the development of rural highways within its administrative region, strengthens organizational leadership over rural highway work, implements support measures for rural highway development, and coordinates research and resolution of major issues in rural highway work.
县级人民政府交通运输等有关部门、乡镇人民政府依照本条例规定和县级人民政府确定的职责，做好农村公路相关工作。
The transportation and other relevant departments of the people's government at the county level, and the people's governments at the township level, shall perform rural highway-related work in accordance with these Regulations and the responsibilities determined by the people's government at the county level.
国务院交通运输等有关部门、设区的市级以上地方人民政府及其交通运输等有关部门应当加强对农村公路工作的指导监督。
The transportation and other relevant departments of the State Council, and the local people's governments at or above the city divided into districts level and their transportation and other relevant departments, shall strengthen guidance and supervision over rural highway work.
农村公路发展建立以财政投入为主、多渠道筹措为辅的资金保障制度。
A funding guarantee system for rural highway development shall be established, with financial investment as the mainstay and multi-channel fundraising as a supplement.
地方各级人民政府按照财政事权和支出责任划分原则，安排应由其承担的农村公路发展经费，并列入本级预算。
Local people's governments at all levels shall, in accordance with the principle of division of fiscal powers and expenditure responsibilities, arrange the funds for rural highway development that they are responsible for, and include them in their respective budgets.
国家鼓励通过慈善和社会捐助以及综合开发运营农村公路相关资源、权益等方式筹集农村公路发展资金，支持金融机构按照市场化、法治化原则提供与农村公路发展相适应的金融服务，引导社会资本依法参与农村公路发展。
The State encourages raising funds for rural highway development through charitable and social donations, as well as comprehensive development and operation of rural highway-related resources and rights, supports financial institutions in providing financial services compatible with rural highway development in accordance with market-oriented and rule-of-law principles, and guides social capital to participate in rural highway development in accordance with the law.
农村公路建设应当以提升路网质量为重点，推动农村公路路网提档升级、优化结构。
Rural highway construction shall focus on improving the quality of the road network, promoting the upgrading and optimization of the rural highway network structure.
农村公路路网密度不足的偏远山区、边疆地区等，应当根据实际需要有序推进路网延伸，提高路网通达水平。
In remote mountainous areas, border areas, and other areas with insufficient rural highway network density, road network extension shall be promoted in an orderly manner according to actual needs to improve the accessibility of the road network.
新建农村公路应当符合规定的公路技术等级要求。
Newly built rural highways shall meet the prescribed highway technical grade requirements.
现有农村公路不符合最低技术等级要求的，应当升级改造为符合技术等级要求的公路。县级人民政府应当根据本地区实际情况组织实施农村公路升级改造。
Existing rural highways that do not meet the minimum technical grade requirements shall be upgraded and transformed to meet the technical grade requirements. The people's government at the county level shall organize the implementation of rural highway upgrades and transformations based on local conditions.
农村公路建设选用的具体技术等级及其主要技术指标，应当根据其功能定位，结合地形条件、预计交通流量等因素确定。国务院交通运输主管部门应当健全与农村公路特点相适应的技术等级及其技术指标体系。
The specific technical grade and its main technical indicators selected for rural highway construction shall be determined based on its functional positioning, combined with factors such as terrain conditions and expected traffic volume. The competent transportation department of the State Council shall improve the technical grade and its technical indicator system suitable for the characteristics of rural highways.
农村公路建设应当与国道、省道建设衔接协调，促进城乡交通运输一体化。
Rural highway construction shall be coordinated and connected with the construction of national and provincial highways to promote the integration of urban and rural transportation.
地方各级人民政府应当采取措施，推进农村公路与沿线配套设施、产业园区、旅游景区等一体化建设，统筹农业生产、乡村旅游等需求，促进农村公路建设与乡村产业发展有机融合。
Local people's governments at all levels shall take measures to promote the integrated construction of rural highways with supporting facilities along the route, industrial parks, tourist attractions, etc., coordinate the needs of agricultural production, rural tourism, etc., and promote the organic integration of rural highway construction with the development of rural industries.
鼓励在农村公路建设中推广以工代赈方式。
The adoption of work-for-relief methods in rural highway construction is encouraged.
农村公路建设涉及土地和空间使用的合理需求纳入国土空间规划实施监督系统统筹保障，按照国家有关规定落实用地管理要求。
Reasonable demands for land and space use involved in rural highway construction shall be included in the territorial spatial planning implementation supervision system for overall guarantee, and land use management requirements shall be implemented in accordance with relevant state regulations.
农村公路建设应当依据国土空间规划科学合理选址，优先利用现有道路改建或者扩建，不占或者少占耕地，节约集约用地。
Rural highway construction shall select sites scientifically and reasonably based on territorial spatial planning, prioritize the use of existing roads for reconstruction or expansion, avoid or minimize occupation of arable land, and use land economically and intensively.
对符合投资规模较小、技术方案简单等条件的农村公路建设项目，可以按照国家有关规定简化相关程序。
For rural highway construction projects that meet conditions such as relatively small investment scale and simple technical solutions, relevant procedures may be simplified in accordance with relevant state regulations.
村道两侧的建筑控制区的范围由县级人民政府按照省、自治区、直辖市的规定划定，建筑控制区管理依照有关法律、行政法规的规定执行。
The scope of building control areas on both sides of village roads shall be determined by the people's government at the county level in accordance with the provisions of the province, autonomous region, or municipality directly under the Central Government, and the management of building control areas shall be implemented in accordance with relevant laws and administrative regulations.
县道、乡道两侧的建筑控制区依照有关法律、行政法规的规定划定范围并实行管理。
The scope of building control areas on both sides of county roads and township roads shall be delineated and managed in accordance with relevant laws and administrative regulations.
县级人民政府交通运输主管部门应当依法采取有效措施，加大对农村公路超限运输行为的治理力度，防止超限运输车辆违法在农村公路上行驶。
The competent transportation department of the people's government at the county level shall, in accordance with the law, take effective measures to strengthen the control of overload transport on rural highways, preventing overload transport vehicles from illegally traveling on rural highways.
不属于超限运输的建设工程重型载货汽车确需将农村公路作为施工便道或者在一定时期内集中通行农村公路，可能造成农村公路损坏的，建设单位应当与县级人民政府交通运输主管部门或者乡镇人民政府签订协议，采取合理规划行车线路、控制车辆载荷、加固改造通行路段等防护措施；造成损坏的，应当按照不低于该段公路原有的技术标准及时予以修复、改建或者给予相应的经济补偿。
If heavy-duty trucks for construction projects that are not overload transport indeed need to use rural highways as construction access roads or to travel intensively on rural highways for a certain period, which may cause damage to rural highways, the construction unit shall sign an agreement with the competent transportation department of the people's government at the county level or the people's government at the township level, and take protective measures such as reasonably planning driving routes, controlling vehicle loads, and reinforcing and transforming the sections of road used; if damage is caused, it shall be promptly repaired or reconstructed in accordance with a standard not lower than the original technical standard of that section of road, or corresponding economic compensation shall be given.
根据农村公路保护管理需要，县级人民政府交通运输主管部门可以在农村公路沿线设置相应的电子技术监控设备。设置电子技术监控设备应当经过法制和技术审核，确保电子技术监控设备符合标准、设置合理、标志明显，投入使用前设置地点应当及时向社会公布。
Based on the needs of rural highway protection and management, the competent transportation department of the people's government at the county level may install corresponding electronic technology monitoring equipment along rural highways. The installation of electronic technology monitoring equipment shall undergo legal and technical review to ensure that the equipment meets standards, is reasonably installed, and has clear signs; the installation location shall be promptly announced to the public before being put into use.
县级人民政府应当组织交通运输等有关部门、乡镇人民政府依法采取措施，开展农村公路路域环境综合整治，持续优化农村公路路域环境。
The people's government at the county level shall organize the transportation and other relevant departments and the people's governments at the township level to take measures in accordance with the law to carry out comprehensive improvement of the rural highway roadside environment, and continuously optimize the rural highway roadside environment.
县级人民政府应当建立健全农村公路管理养护责任制，明确并支持、督促交通运输等有关部门、乡镇人民政府履行农村公路管理养护职责。
The people's government at the county level shall establish and improve a responsibility system for rural highway management and maintenance, clarify and support and supervise the transportation and other relevant departments and the people's governments at the township level in fulfilling their rural highway management and maintenance responsibilities.
地方各级人民政府应当按照国家有关规定，落实农村公路养护资金财政支出责任，加强农村公路资产管理。农村公路与乡村旅游等经营性项目一体化开发的收益可以用于农村公路养护。
Local people's governments at all levels shall, in accordance with relevant state regulations, fulfill the fiscal expenditure responsibilities for rural highway maintenance funds and strengthen the management of rural highway assets. The proceeds from the integrated development of rural highways and commercial projects such as rural tourism may be used for rural highway maintenance.
县级人民政府交通运输主管部门应当定期组织开展农村公路技术状况检测和评定，并将检测和评定结果作为实施农村公路养护的重要依据。
The competent transportation department of the people's government at the county level shall regularly organize the detection and evaluation of the technical condition of rural highways, and use the detection and evaluation results as an important basis for implementing rural highway maintenance.
农村公路养护按作业性质分为日常养护和养护工程。
Rural highway maintenance is divided into routine maintenance and maintenance engineering based on the nature of the work.
县道的养护由县级人民政府交通运输主管部门组织实施。
The maintenance of county roads shall be organized and implemented by the competent transportation department of the people's government at the county level.
乡道、村道的日常养护由乡镇人民政府组织实施。乡道、村道的养护工程由县级人民政府交通运输主管部门组织实施，或者交由具备条件的乡镇人民政府组织实施。
The routine maintenance of township roads and village roads shall be organized and implemented by the people's government at the township level. The maintenance engineering of township roads and village roads shall be organized and implemented by the competent transportation department of the people's government at the county level, or may be handed over to the people's government at the township level that has the conditions to implement.
农村公路的日常养护可以通过政府购买服务等方式吸纳沿线农村居民参与，保洁、绿化等相关工作可以由农村居民或者家庭承包，统筹用好农村公路管理养护领域公益性岗位，优先吸纳就业困难人员。
Routine maintenance of rural highways may involve rural residents along the route through government purchase of services and other methods; cleaning, greening, and other related work may be contracted to rural residents or families, and public welfare positions in the field of rural highway management and maintenance shall be comprehensively utilized, giving priority to hiring persons with employment difficulties.
国家鼓励、引导专业公路养护作业单位参与农村公路养护，推动建立健全农村公路养护长效机制，提高养护专业化水平。
The State encourages and guides professional highway maintenance units to participate in rural highway maintenance, promotes the establishment and improvement of a long-term mechanism for rural highway maintenance, and improves the level of professional maintenance.
农村公路养护应当按照相应的技术规范和操作规程实施，保证公路经常处于良好的技术状态。
Rural highway maintenance shall be carried out in accordance with corresponding technical specifications and operating procedures to ensure that the highway is constantly in good technical condition.
县级人民政府交通运输主管部门、乡镇人民政府应当组织开展农村公路日常巡查；发现公路坍塌或者有坑槽、隆起等影响安全通行情形的，应当及时设置警示标志并组织修复。
The competent transportation department of the people's government at the county level and the people's government at the township level shall organize routine inspections of rural highways; if a highway collapse or conditions such as potholes or bumps that affect safe passage are discovered, warning signs shall be promptly set up and repairs organized.
县级人民政府应当建立健全农村公路安全隐患排查治理机制，以农村公路急弯陡坡、临水临崖、平交路口、桥梁隧道、穿村过镇等路段为重点，组织开展安全隐患排查和治理。
The people's government at the county level shall establish and improve a mechanism for investigating and controlling safety hazards on rural highways, focusing on sections such as sharp curves, steep slopes, roads near water and cliffs, level crossings, bridges and tunnels, and sections passing through villages and towns, and organize the investigation and control of safety hazards.
交通事故易发的农村公路平交路口、穿村过镇路段等地点应当设置醒目的安全警示标志，必要时设置车辆减速装置等设施。
At locations such as level crossings on rural highways prone to traffic accidents and sections passing through villages and towns, conspicuous safety warning signs shall be installed, and if necessary, vehicle deceleration devices and other facilities shall be installed.
县级人民政府应当加强农村公路应急保障和防灾抗灾能力建设，组织落实农村公路突发事件应急预案制定、应急物资储备、灾害监测预警等方面的责任。
The people's government at the county level shall strengthen the emergency support and disaster prevention and resistance capacity building of rural highways, and organize the implementation of responsibilities in formulating emergency plans for rural highway emergencies, stockpiling emergency supplies, and monitoring and early warning of disasters.
因自然灾害或者其他突发事件造成农村公路中断的，县级人民政府应当组织交通运输等有关部门及时进行抢通；难以及时抢通的，应当设立警示标志并发布绕行路线。
If a rural highway is interrupted due to natural disasters or other emergencies, the people's government at the county level shall organize the transportation and other relevant departments to promptly carry out emergency repair; if timely repair is difficult, warning signs shall be set up and detour routes announced.
县级人民政府及其有关部门、乡镇人民政府应当采取灵活有效的方式，对农村公路沿线居民开展道路交通安全法律法规和爱路护路宣传教育，鼓励、引导将爱路护路有关要求纳入村规民约，增强农村居民的道路交通安全和爱路护路意识。
The people's government at the county level and its relevant departments, and the people's governments at the township level, shall adopt flexible and effective methods to conduct publicity and education on road traffic safety laws and regulations and road love and protection awareness among residents along rural highways, encourage and guide the inclusion of relevant requirements for road love and protection into village rules and regulations, and enhance the road traffic safety and road love and protection awareness of rural residents.
地方各级人民政府应当完善政策措施，健全激励机制，加快农村货运物流等相关基础设施建设，保障农村客运可持续运营，促进农村客运、货运物流、邮政快递融合发展，拓展农村公路服务功能，提升农村公路服务畅通城乡经济循环的能力。
Local people's governments at all levels shall improve policies and measures, improve incentive mechanisms, accelerate the construction of rural freight logistics and other related infrastructure, ensure the sustainable operation of rural passenger transport, promote the integrated development of rural passenger transport, freight logistics, and postal express delivery, expand the service functions of rural highways, and enhance the ability of rural highways to serve the smooth circulation of urban and rural economies.
国务院有关部门、县级以上地方人民政府及其有关部门、乡镇人民政府在农村公路工作中不履行或者不正确履行职责的，依照法律法规和国家有关规定追究责任，对直接负责的主管人员和其他直接责任人员依法给予处分。
If the relevant departments of the State Council, the relevant departments of the local people's governments at or above the county level, and the people's governments at the township level fail to perform or incorrectly perform their duties in rural highway work, they shall be held accountable in accordance with laws, regulations, and relevant state provisions, and the directly responsible supervisors and other directly responsible personnel shall be given sanctions in accordance with the law.
村道除适用本条例规定外，参照适用《中华人民共和国公路法》、《公路安全保护条例》的有关规定。
In addition to the application of these Regulations, village roads shall apply mutatis mutandis the relevant provisions of the Highway Law of the People's Republic of China and the Regulations on the Protection of Highway Safety.
本条例自2025年9月15日起施行。
These Regulations shall come into force as of September 15, 2025.
